Starting point is 00:00:00 Get ready to hear the truth about America on a show that's not immune to the facts with your host, Dan Bongino. Do you have any idea how bad this case has to be? This case against Donald Trump, if they're having trouble, having trouble with a grand jury indictment. I mean, the old adage, you're going to diet a ham sandwich, is not inaccurate. If you gave me a ham sandwich, not a big fan of ham or ham sandwiches for that matter, I couldn't diet it. Oh, I'm sure. Do you have any idea how bad this case against Donald Trump has to be
Starting point is 00:00:39 to be having trouble in a grand jury? It doesn't even have to be unanimous. It doesn't even have to be closeous. It doesn't even have to be close. Anywhere close to being unanimous. I got a big show for you. New information about Hunter Biden, all this stuff. Economic news out of yesterday. Hey, that's so good.
Starting point is 00:00:57 We're kind of like a pick your poison moment here. Today's show brought to you by Birch Gold Group. Listen, inflation has consequences. You're seeing it on the stock market, on your pension, on your savings, on everything. Bonds are diminishing in value. Inflation's crippling your ability to go and buy the things you need to stay alive, food, services. The recent surge in gold prices shows why what I've been saying, gold, it's been a historically great hedge against the stock market and against inflation. That's why I buy gold. The only company I trust to help you diversify into gold is Birch Gold Group, B-I-R-C-H.
Starting point is 00:01:29 I buy my gold from them, have multiple times. You can do the same. Text DAN, D-A-N, to 989898 to get a free information kit on gold. Birch Gold will help you convert an existing IRA or 401k that's tied to a volatile market into an IRA and physical precious metals. You can touch it. You can't print gold. And the best part, it's tax sheltered. Text Dan to 989898 to claim your free information kit on gold today with an A-plus rating with the Better Business Bureau
Starting point is 00:01:55 and thousands of happy customers. Birch Gold is who I trust to protect my future and yours. Text Dan to 989898 today. Past performance is not a guarantee of future results. Message and data rates apply. Thanks, Birch Gold. All right, Joe. Big show today, so let's get this baby going. All right, let's go, daddy-o. Here we go.
Starting point is 00:02:14 You okay? A couple of jobless? You sound a little down. You a little depressed? You were doing something else. Here's the deal, folks. Here's what's going on behind the scenes. We're working on a lot of technical stuff now with the new live chat and everything.
Starting point is 00:02:30 And there's a lot of big developments coming with the Dan Bongino show. So actually, Joe, I'm glad we started out that way because stay tuned. You're going to really like it. We're working on a ton of things. I'm really excited about the future of the show. So everybody here is working really hard.
Starting point is 00:02:44 I know. He wants to tell working really hard. I'm okay. I know. He wants to tell everybody, too. But we got to hold out. I just want to make sure. We're working on the tech stuff. You never want to go big with an announcement, and then boom, everything flops. Bad move.
Starting point is 00:02:56 So, again, you have any idea how bad this case has to be? That they are having trouble up in New York City, Twinkies, in the Manhattan DA's office, getting an indictment on Donald Trump on this Stormy Daniels nonsense, right? Let's go through a couple of things because there's a lot of information out there. I got to tell you, folks, on both sides of the aisle, the pro-Trump side and the lunatic anti-Trump side, there's a lot of information out there that's being sent your way through a partisan lens, but it's not helping people get to the bottom of this whole thing. All right, so let's clear this whole thing up. First, Red State article by Nick Arama. Again, as always, you can read this in the newsletter, bongino.com slash newsletter.
Starting point is 00:03:39 Please subscribe. It's free. Reason for the Trump grand jury delay it was delayed yesterday they sent the grand jurors home on wednesday yesterday which is very strange and said hold on time out there's a flag on the field they know the case could be in big trouble bragg's office notably wasn't commenting on the reason for the delay of course saying we don't want to comment on grand jury matters you expect they're going to say that but sources familiar with the case told Fox News that the proceedings were canceled amid, quote, listen, major dissension within the district attorney's office. One source claimed the DA is having trouble convincing the grand jury on potential charges due to the weakness of the case. Holy Moses, folks. Do you understand how bad this is? Let's go through the rules of the grand jury fast. Up in New York State, you've got 16 to 23 grand jurors. They literally sit in a room. I've testified in front of grand
Starting point is 00:04:42 juries before. 16 to 23 because people get sick and they sit for a long time. Grand juries don't hear one case. They hear a ton of cases. They'll sit for a long time, weeks, maybe months. 16 to 23 people. You have to have at least 16, no more than 23. And like I said, it varies. People don't show up one day, the kid got sick, whatever it may be. Now, you may say, what's the process for bringing what they call a true bill? A true bill is an indictment. You just need 12 of them. So think about this. If 23 are seated, which I'm telling you, in a case like this, listen to me here, I've done this before, involving Donald Trump, a former president, with major, major implications. Every one of those grand jurors is there. I would venture to say there are 21 to 23 seated
Starting point is 00:05:39 every single day. Why does this matter? Again, there's a lot of misinformation and confusion out there about what's happening. If there's 21 to 23 of them out there and you can't get 12, which is barely 55, 60%, about half of them. Do you have any idea the suck level on your case? Do you know how almost unprecedented this is in a case like this to waltz it in in front of a grand jury in a liberal city like New York? And you can't get 12 out of 23 people to say not even that he's guilty. That's not what the grand jury. All they're there for is to say, is there probable cause evidence of a crime? That's it. They don't need beyond a
Starting point is 00:06:31 reasonable doubt, anything. You don't even need unanimity. And they can't even get that. Now, if you listen to the show and the radio show, Joe, remember we brought this up the other day. I said to you folks, Joe heard it. I said, it is not a guarantee that he is going to be indicted. I said, this case is so bad. Now, again, this isn't some Stygian witches moment where I was like, give me the eye and I can predict the future. I've just sat on grand juries. And eventually you have to produce some amount of evidence. And eventually you have to produce some amount of evidence. The problem is it's leading to a lot of kind of misinformation from the left, but some confusion on our side too, from people who are having some trouble with the process, which I understand. I mean,
Starting point is 00:07:15 if you're, if you've never sat at a grand jury or been a lawyer or law enforcement officer, why would you, you know, it's not your thing. You're an engineer, a pilot, you do your thing.
Starting point is 00:07:23 I don't know anything about piloting a plane. Here's where the confusion starting on our side so the confusion on the left is they thought this thing was lock stock and two smoking barrels like trump's finished grand jury new york liberal new york city's done he's totally done no well maybe maybe maybe indicted he may be But that doesn't seem to be the case right now. Sent the grand jury home. But on our side, there's been some confusion too. There is a letter that emerged from the FCC to Trump's lawyer, Michael Cohen. Just quickly, the essence of the charge is this.
Starting point is 00:08:00 The allegation is that Donald Trump marshaled this deal to pay off this porn star, Stormy Daniels, to not talk about the, you know, the little thing they had, the liaison, let's say. Is that a crime? No. about the payment that his lawyer, Michael Cohen, paid Stormy Daniels, which he did, but that Trump reimbursed him for legal expenses, which are really hush money expenses. You get it? And the Bragg allegation is it's a felony because it was effectively a campaign donation. Campaign donation? How the hell is that? Exactly. Exactly. That's the point. Bragg's saying, well, he was trying to further his political campaign by silencing someone who would make him look bad. Folks, it's the dumbest definition of a campaign donation I've ever seen. Hence, why the grand jury is having a real problem right now with a true bill.
Starting point is 00:08:59 The problem on our side is a letter emerged yesterday. You can see it here. The problem on our side is a letter emerged yesterday. You can see it here. It's an FCC letter from Michael Cohen to the FCC. Now, Cohen and Bragg are alleging that there was a payoff from Trump to Cohen. You following the gravy train here? To reimburse the porn star to shut up in this NDA deal. Well, here's the problem. As you can see from this letter from Michael Cohen's lawyer that
Starting point is 00:09:28 emerged yesterday, he says, quote, Cohen's lawyer said in this letter to the FCC a while ago that neither the Trump organization or the Trump campaign was a party to the transaction with Ms. Clifford. I think, guys, Stephanie Clifford's her name. Stormy Daniels, obviously her screen name, if you know what I mean. And neither reimbursed Mr. Cohen for the payment directly or indirectly. If there was ever a time. Here it comes. Here it comes.
Starting point is 00:10:00 Did we lose the bird well? What's that? Is it behind me? Oh, it is behind me. This is time for the Birdwell. The Birdwell comes out. It's been a while. I'm going to keep this close.
Starting point is 00:10:22 Folks, if there was ever in the history of exculpatory evidence, in other words, evidence of your innocence, if there was ever exculpatory evidence in the history of legal cases, this is it. This is the equivalent of me accusing Guy of a murder. And then the guy who I accused Guy of murdering shows up in court to say I wasn't murdered. Kind of causes a problem for a murder case, no? Hey, I was not murdered by Guy. Well, how do you know that, sir? Because I'm here. The whole, you guys follow me? The gist of the case is that Trump hid the payment to Cohen. He paid him, Cohen, to shut this woman up.
Starting point is 00:11:06 Cohen's lawyer literally signed a letter saying that that didn't happen. So like Trump wasn't even a party. He said that. Now, now, now there's a possibility. Hold your horses here. I'm a cost to make room. All, there's a possibility. Hold your horses here, Omar Costas-McGrew. Hold your horses.
Starting point is 00:11:29 There's a possibility, fairly enough, that Cohen, who was Trump's lawyer at the time, was lying to cover for Trump and wrote the letter to the FCC to cover for Trump. But the problem then is Cohen's a liar. How do you trust anything this guy said? You get the point? So he's either a totally not credible witness who will lie to the FCC and to his lawyer, or the letter's accurate and Trump had nothing to do with it. There's this case. Listen, I love Donald Trump. He's my guy. I get it. But I'm telling you in the most objective way humanly possible, this case is a freaking dog. It's a dog. It is probably one of the worst cases I have ever seen brought against, forget a politician, against anyone.
Starting point is 00:12:26 This is a murder trial where the guy who's supposed to be murdered shows up in court to say hello. Okay, let's get to the part where there's some confusion. It started making its way around social media yesterday that, gosh, this is a Brady violation. We'll get to that later, by the way. That's another topic. A Brady violation. What's Brady violations? Brady violations are when the government has information of your innocence and hides it. If the FBI is prosecuting Guy for a bank robbery and the bank wasn't in fact robbed and the FBI knows that and they don't tell Guy's attorney that, that's it, they're finished. You may open yourself up to civil litigation if you do that. Brady material is evidence of a subject's innocence that the government is obligated to turn over.
Starting point is 00:13:11 It's not optional. So a number of people, fairly enough, said, well, isn't this exculpatory information that should have been presented to the grand jury and it made its way around the internet? The answer is, that's a convenient argument, but no. What do you mean? No, no, it's exculpatory.
Starting point is 00:13:33 I just explained that. But folks, that is the point. What do you mean? The grand jury, these 23 grand jurors that sit, the government prosecutor, in this case, the DA's office in Manhattan, has zero obligation whatsoever in there to present exculpatory information. How did I open up the show? What did I say, guys?
Starting point is 00:13:59 I said you couldn't diet a ham sandwich. That's how it's just put it in the internet. Put it on the search engine. Diet a ham sandwich. People have been saying it for decades. Why? Because the government prosecutor goes in there and can say basically whatever evidence they want
Starting point is 00:14:13 without giving the exculpatory evidence. Now that'll come up in discovery and a trial, but not in the grand jury. Now let's tie it all together. How freaking bad Is this case folks That the government The DA's office had no obligation
Starting point is 00:14:31 To even disclose this Now everybody knows it's out there Didn't have to disclose it Should have but didn't And they still They still can't get a true bill And indictment Do you Can you process the suck level Still, he still can't get a true bill of indictment.
Starting point is 00:14:57 Do you can you process the shock level on this case that they've got information sitting out there that the guy was supposed to be murdered is still alive. They withhold it from the grand jury while going in there, making this murder case and not telling the grand jury any of the stuff about how bad the case sucks. And they still don't agree. Now, if you're a sane person, unlike Twinkies in New York, right? Because the guy's clearly been eating too much and it's polluted his frontal lobe, okay? If you're Twinkies right now and you know this letter's out there entirely absolving the defendant in this case, potentially Donald Trump, of guilt in this. You haven't yet disclosed it to the grand jury.
Starting point is 00:15:33 If you're smart, which Twinkies isn't, one of the dumbest human beings ever to occupy any law enforcement position in the United States. Lord of the idiots. position in the United States. Lord of the idiots. Oh my gosh. Monarch of the stupids. Emperor of the imbeciles. You go forward with the case. Push through, keep going back to the grand jury over and over. That's why I told you folks, you think this case is going to hurt Donald Trump? Donald Trump is going to walk out of this. There is zero chance, zero chance that whether through the appeals process at the end of the day, that this verdict, say it is guilty, which I'm not even sure it would be, if it even goes to trial, if they even get out a grand jury, there's almost zero chance Donald Trump doesn't come out victorious in this in the end. You get my point here? Don't fall for the exculpatory evidence trap here.
Starting point is 00:16:21 It is exculpatory. However, the DA has no obligation to put that in front of a grand jury. That starts at discovery and at the trial process, not in a grand jury. That's why you couldn't diet a ham sandwich. You don't have to tell the grand jury anything about the subject being potentially innocent. That's the whole point. And they still can't get them. Now, even the the hardcore lefties some of them are starting to wake up that this is going to be a disaster some of them 99 of tyrannical left-wing communists are just straight up imbeciles and want to see trump in handcuffs even though they know it's
Starting point is 00:17:01 going to blow up in their faces because they're idiots with no sense of response consequence. Here's Van Jones yesterday on CNN. Here's Van Jones starting to question. I mean, the guy's liberal bona fides aren't in question, right? Here's Van Jones saying, dude, are we really sure we want to go forward with this? This Manhattan DA better wake up soon. Because this case probably isn't that great. Take a listen.
Starting point is 00:17:31 I think that the heat is on this DA. I think he's going to make a very sober decision. And I would not be surprised if he doesn't step back from the brain. Now, of course, Jones, who I'm no fan of, he's no fan of mine either. Jones is just saying the truth. Whereas I just told you the truth about the exculpatory evidence thing. Don't go on Twitter. Oh, look, they withheld the exculpatory evidence from the
Starting point is 00:17:53 grand jury because I don't want you to get burned because it makes your credibility look bad. He doesn't have to do that. The left doesn't care. They don't want the truth like I'm giving you. They don't want the truth like I'm giving you. They want to be told one thing and one thing only. You guys know what it is.
Starting point is 00:18:11 Donald Trump, lock him up, hang him by his toenails. They don't care. Shave his head, put him in prison, mugshot. They don't care. So Van Jones is stating the obvious. This case is a dog, an absolute dog. They don't want to hear it here's illy mistel that lunatic from msnbc another guy with a twinkies problem maybe him and alvin bragg eat at the same place here's another twinkies guy the fatty acids clogging up his neurons here he is he tweets in response to this van jones is the Tim Scott of Maggie Haberman's.
Starting point is 00:18:47 And then Mueller, she wrote a hilariously stupid podcast that actually believed the Mueller probe was going to find collusion. Tweets back, OMG, ha ha. I remember at Politicon once they asked me to be on their podcast. I was like, yeah, sure, maybe tomorrow. It's true. They know what happened. I didn't figure out. I had no idea who they were. I'm like, Mueller?
Starting point is 00:19:13 What the heck is that? These people take Mueller seriously? Folks, the libs are losing it. They are completely detached right now from legal reality, from political reality, anything else. They don't realize right now that legal reality from political reality anything else they don't realize right now that the reason donald trump i'm telling you i'm getting this from listen to me listen to me quick please i'm getting this from the most reliable of sources trump's not afraid
Starting point is 00:19:37 of this case one bit you may think he is may make you feel better oh we got him now joe the walls are closing in gee they got him now walls are, the walls are closing in. Guy, they got him now. Walls are closing in. You may think so, but I'm telling you right now, Trump isn't the least bit afraid of this case. He knows it's a dog and he knows he's going to have his moment walking out of the courthouse, shaking his fist in the air as he's victorious in this case. He knows it. And he knows you guys are setting yourselves up for failure. Folks, the Democrats have been salivating for years too over an indictment of Trump. It's really pathetic. I got a super cut of that coming up in a second. And then is the next shoe to drop here in this case, the White House involvement in this? Was the White House involved in pushing
Starting point is 00:20:19 Twinkies to try to charge Donald Trump? Because then we got a real problem. Let's get to this first. Patriotmobile.com slash Dan. Americans have had it. They're done supporting companies that rake in hundreds of millions, billions of dollars off us and then turning around and screwing us by supporting woke left-wing causes. You know, we used to have to take it, but we don't anymore. Parallel economy companies like Patriot Mobile are building a whole new economy, one which embraces the values that made America the greatest country on earth and respects our values. Patriot Mobile, they're
Starting point is 00:20:49 America's only Christian conservative wireless provider. Starting point is 00:21:20 Get free activation today with the offer code Dan. We got to stand together, folks, and support companies that share our value. Patriotmobile.com slash DAN or call 878-PATRIOT. Thanks, Patriot Mobile. So the Democrats have, and this is a hat tip, Tom Elliott over at Grabian, have been salivating for years over an indictment of Donald Trump. It shows you why, tie in this segment up, why what I just said matters. They are completely detached from any kind of legal or political realities. Their case is a legal dog. It's an even worse political one because Trump is going
Starting point is 00:21:56 to beat them and they're going to martyr the guy and make him look like a superhero. Karl Rove wrote a piece yesterday at the Wall Street Journal suggesting otherwise, that this isn't going to politically help Trump. I entirely, completely disagree. Sometimes I agree. Sometimes I disagree. Completely disagree. I think he is totally misreading this situation.
Starting point is 00:22:17 And I say it as a guy who really loves a Florida governor. And I like the former president a lot. I'm being objective as possible. I think he's totally misreading this. This is what the Republican base sees when they see Trump fighting the deep state. And when he wins this, they're going to see it as a victory over these people. Take a look. It's clear that Trump is the target and he'll be indicted eventually. On the day Donald Trump leaves office, the Justice Department may indict him. Now there is talk of jail time for the president.
Starting point is 00:22:51 That Mueller could indict the president for obstruction of justice. Donald Trump should be indicted for calling a cooperating witness a rat. He should have been indicted. A sitting president can be indicted by the Justice Department. Why aren't we at the target, Trump, having committed crimes to get the presidency? So why aren't we at an indictment yet? I think there's generally consensus the president has probably committed indictable crimes. It's very strongly in favor of indicting the president when he is out of office. That
Starting point is 00:23:21 there may be enough evidence to indict Trump. Is Donald Trump going to be indicted? Maybe it'll happen. Maybe he'll go to prison. Will you ever see the inside of a prison cell? DA could get a ham sandwich indicted. Hey, listen, Trump's the Big Mac. Even if Donald Trump himself is not ever indicted, there is another way that prosecutors can actually indict the entire Trump org. There is another way that prosecutors can actually indict the entire Trump org. Now, Joe cut that. That video is three minutes and 30 seconds, three minutes and 30 seconds long. You can go to Tom Elliott's Twitter feed or Grabian and take a look yourself.
Starting point is 00:23:58 It goes on and on from 2018 all the way up till now. Democrats just, you know, blood from their fangs salivating, foaming at the mouth, rabid-like, begging for a Trump indictment. Again, back to my point, it has detached them from reality. They have lost, they have totally lost their bearing on, they're in the matrix now. They're in this false reality where they think they're going to legally or politically hurt this guy. They may legally cost them a lot of legal bills, but the case is against them. Whether it's Georgia and classified documents or this are all dogs.
Starting point is 00:24:33 The classified documents case only brings attention back to Joe Biden, who has got a far worse scandal. The Georgia case keeps bringing attention back to people who have a lot of questions about what happened to Georgia. And this case just keeps highlighting Trump's war with the deep state. None of this is working. Here's the next shoe to drop, by the way. Read this piece by John Solomon. The House Judiciary Committee is probing whether D.C. Democrats intervene to pressure Twinkies to charge Trump. Oh, boy.
Starting point is 00:25:02 That could be a problem. That could be a real problem, especially considering the Department of Justice decided not to prosecute this case against Trump because they knew it was what, fellas? A dog. A dog. Now, as I said to you yesterday, I'm very concerned about our republic, and you should be too. You need two things for a social revolution. And I don't mean this revolution in any kind of a qualitatively positive way. I'm talking about societies collapsing and violence in the street.
Starting point is 00:25:40 You need two things for that to happen, generally speaking. Imagine the worst possible scenario. Neighbor against neighbor, no police, civil war in the streets. Imagine that. Horrible, right? You're never going to get there in a prosperous country like the United States without two things. Number one, faith in institutions collapsing. People don't do this stuff because they're afraid of the police and being arrested. They're afraid of a military crackdown or the FBI investigating them.
Starting point is 00:26:11 That's a good thing. We don't want civil war in the streets. You want people killing their neighbors. Obviously, I mean, does that even require us saying that? But you have faith in institutions and you believe like your neighbor's not going to come after you either, even if they're a Democrat and you're a Republican, because we have laws and we have what? Faith in institutions. When you see societal upheavals, people lose faith in institutions. Oh, the FBI is not going to protect me. Matter of fact, not only are not going to protect me, they're going to target me because I'm a MAGA supporter. order. That's happening now. I just described to you how nobody has any faith in this justice system anymore. New York City, you're a sitting duck if you're a conservative. Why you'd stay there is beyond me. The second part you need is not just faith in institutions collapsing.
Starting point is 00:26:57 You need economic collapse because you need to make people desperate. Once they're desperate, only four missed meals away from chaos right that's the old line civilization's a thin crust on a volcano right it's been said before once you get to economic collapse you've got this witch's brew for a dangerous societal upheaval folks it's happening right now you got this perfect storm going on right now as the Fed raised rates again yesterday, 25 basis points. The economy is teetering on an edge that broke after the podcast yesterday. We have a lot of trouble. But back to the faith in institutions part in a second. This has been a multi-day part. I've been covering these over the last couple of days because I'm very worried about this.
Starting point is 00:27:42 You want to see why faith in institutions is collapsing? Well, you're probably saying to yourself, oh, well, you know what? Even if Twinkies indicts them, our institutions will hold, Joe. You know, we got courts, we got judges. I mean, judges are just, you know, guys and ladies in black robes and they're not partisan at all
Starting point is 00:27:57 and they know the law and they understand the law and they'll back us up. Of course, that got thrown out of the way with January 6th where guys have been sitting in gulags for two years, despite habeas corpus. Yeah. Oh yeah, they've had initial appearances, but they've been kept in prison for absolutely absurd, absurd reasons. Nobody has faith in the judicial system anymore. People are losing it. How do you expect to get a fair trial as a conservative in front of this guy? Let me introduce you to a man named Cato Cruz, who is being nominated for a court seat by Joe Biden.
Starting point is 00:28:34 He is a federal magistrate now. He's asked a pretty simple question about Brady material. Brady material. You know, like we've been discussing for the last three weeks and everyone else has been discussing in the media. It's evidence of a defendant's innocence that's not presented to him, i.e. the FCC letter from Michael Cohen's lawyer to the FCC about the payment Donald Trump didn't make, according to the letter. to the letter. Brady material is a concept taught to a law enforcement officer
Starting point is 00:29:07 and a 101 law student in college. This is not a complicated thing. So a federal magistrate, you guys think they know a little bit about Brady material? It's like asking Joe. Joe, you know anything about processing sound? No, no, nothing.
Starting point is 00:29:24 You want to be the sound engineer? I'll figure it out. No, we're actually looking for someone with some skills. Listen to this. Here's Cato Cruz responding to Senator John Kennedy, Republican from Louisiana, who asked him a simple question. What's Brady material? Check this out. Show me how you analyze a Brady motion.
Starting point is 00:29:44 How I analyze a Brady motion? Yes. Senator, in my four and a half years on the bench, I don't believe I've had the occasion to address a Brady motion in my career. Do you know what a Brady motion is? Senator, in my time on the bench, I've not had occasion to address that. And so it's not coming to mind at the moment what a Brady motion is? Senator, in my time on the bench, I've not had occasion to address that and so it's not coming to mind at the moment what a Brady motion is. Do you recall
Starting point is 00:30:12 the U.S. Supreme Court case, Brady v. Maryland? I do recall the name of the case, Senator, yes. And what did it hold? I believe that the Brady case in, well, Senator senator i believe the brady case involves something regarding the second amendment it is not i have not had occasion to address that if
Starting point is 00:30:33 that issue were to come before me i would certainly analyze that supreme court precedent and apply it as i would need to to the facts in front of me. Thank you, Mr. Chairman. You're a federal magistrate who confuses the Brady v. Maryland case. Again, a case taught to a first day FLETC student training to become a TIGTA agent for the IRS. Federal Law Enforcement Training Center, FLETC, as they call it. Federal Law Enforcement Training Center, FLETC, that's what they call it. You're confusing one of the most important cases in American history, Brady v. Maryland, with the Brady bill?
Starting point is 00:31:13 He told you Brady v. Maryland. You don't even know what it is? That's like not understanding the significance of Marbury versus Madison. Folks, this is embarrassing. And I'm just putting it out there. I'm not a Biden supporter. I mean, does anyone need, obviously, you don't need an explanation there.
Starting point is 00:31:39 But like I would expect to get a fair trial in front of a judge, even if they were a Biden or Obama appointee, I would give these get a fair trial in front of a judge, even if they were a Biden or Obama appointee. I would give these guys a fair shake, too. Maybe they are good guys. Maybe they're not. I'm sorry. That's automatically disqualifying. Automatically disqualifying.
Starting point is 00:31:56 There is no way anyone should vote to put this guy through. He has no idea what exculpatory evidence is. It's not like we just had this conversation about the QAnon shaman and about Michael Cohen. I mean, all the guy had to do, Joe, is turn the news on where the idea of exculpatory evidence and Brady material comes up every day. The January 6th videos of Jacob Chansley, the QAnon shaman, being escorted around by police. Brady came up. All you have to do is put the news on you think you're going to get a fair trial in front of this guy are you crazy zero
Starting point is 00:32:33 chance this guy was clearly chosen for ideological reasons and not his knowledge of the judicial process and i loved watching lefties defend this stupidity. If that was a conservative nominee, forget it. They would have went crazy. They don't care. All right, let me get to my next sponsor. I want to show you something else because the January 6th case, by the way,
Starting point is 00:33:00 has gotten very, very strange. And it's curious how many so-called civil libertarians on the left are staying real quiet about an explosive new allegation about FBI sources. You'd think they'd care about this stuff, you know, the law and everything. You need some goodness in your life?
Starting point is 00:33:22 You know, you think cereals for grownups. Ah, come on, they're so bland. I don't want to eat those. No, no, no. Put a little magic in your life? Thanks, man. All right. So the craziest thing is, again, Brady material is all over the place. The January 6th cases, the Mike Flynn case, the Michael Cohen, Donald Trump case, if this guy, Cato Cruz, this judicial nominee, just turned the news on Joe, hit the power button on the remote, he would have learned what Brady material is. Now, this is coming up again, because one of the defendants in the January 6th case, who was charged with all kinds of things, you know, felonious mopery and the umpteenth degree and all these other charges and everything else.
Starting point is 00:35:28 One of the defendants, his legal counsel just wrote, filed a motion, and he makes a suggestion in here that, I got to tell you, I was communicating with a former FBI friend of mine yesterday about this, and he said to me, I have never heard anything like this. It reminds me of that scene in that movie Seven with Morgan Freeman and Brad Pitt. They're investigating the serial killer and he whispers in his ear, have you ever seen anything like this? The answer is no. The lawyer for one of the defendants in the January 6th case is implying that an FBIbi confidential source doesn't mean it was an fbi agent it could have meant it was someone who had infiltrated their group or
Starting point is 00:36:13 someone they flip quote participated in prayer meetings with members of one or with one or more of the defendants families the chsS, Confidential Human Source, also engaged in discussions with one of the defendant's family members about replacing one of their lawyers? The above may not include all the communications that were initiated by or engaged by the CHS. Folks, listen, again, please, I promise you objectivity in this matter.
Starting point is 00:36:47 I am not subjective. i am a conservative i believe in conservative principles i promise you objectivity in this matter i am putting all of that aside to tell you as a former federal agent myself i have never heard of anything like this let me just sum up what you're you know what? Let's play Christopher Wray first. Maybe it explains this. Here's a video. He's being questioned by a Republican congressman. This is months ago. FBI Director Christopher Wray is asked specifically about this. Did you or did you not have FBI sources inside the January 6th crowd, the Proud Boys and other entities that were there that day. Listen to the shady, slimy answer he gives, which should have sounded the alarm early. Check this out. There's a suggestion, for example, that the FBI's confidential human sources or FBI employees
Starting point is 00:37:38 in some way instigated or orchestrated January 6th. That's categorically false. Did you have confidential human sources dressed as Trump supporters inside the Capitol on January 6th, that's categorically false. Did you have confidential human sources dressed as Trump supporters inside the Capitol on January the 6th prior to the doors being opened? Again, I had to be very careful. It should be a no. Pretty much a yes or no answer, right? Julie Kelly, Darren Beattie,
Starting point is 00:38:00 that was from the Laura Ingraham show. They've been on this story for a long time. Now the liberals out there who listen to my show and want to send me death threats and everything, I know how you are. Just for a minute, take the cotton out of your ears and stick it in your mouth. Do you understand how devastating this is? How if you continue to support this, this situation could degenerate quickly and turn around and ensnare you? It's really amazing. Joe, remember the whole infiltration of the Black Panthers thing in the late 60s and 70s? They went crazy. The Cointelpro. Oh, my gosh. How awful.
Starting point is 00:38:30 It's amazing how when it's a left leaning group like the Black Panthers that ascribes to these socialist principles, the left loses their mind with what they declare the FBI heavy hand. with what they declare the FBI heavy hand. Now that it's pretty clear the FBI had a source inside of some of these January 6th defendants groups, the left loves it. They think it's the greatest thing ever. Now, let's be clear. There's nothing wrong legally.
Starting point is 00:39:00 But morally, it's up to you. You judge it however you see fit. There's nothing wrong legally with the FBI using sources to get information, as long as it's up to you. You judge it however you see fit. There's nothing wrong legally with the FBI using sources to get information, as long as it's not obtained illegally. However, there is something administratively unquestionably wrong, and they are going to have a real problem if these allegations are true, that the FBI developed a source inside this Proud Boys network
Starting point is 00:39:24 and was giving somehow legal advice to the families? Keep supporting. Where's the ACLU on this one? Where are you guys? You understand how bad that is? Imagine it, right? Joe's got a group of people that robbed the bank, right? So he robbed the bank.
Starting point is 00:39:47 And the FBI's had a source in it and are paying off one of the guys to give them information the whole time about the bank robbery. Joe's then in prison. And then the same guy who the FBI's using as a source is showing up with the family and getting the legal strategy
Starting point is 00:40:03 from the lawyer that's going to defend Joe in court? Wait, what? Are you crazy? I'm talking to this FBI guy yesterday, Joe, on Signal. And he's like, this is by far the craziest thing I've ever heard. And I've heard a lot of crazy lately. This is nuts. Now you see why I'm worried about the witch's brew of the economy collapsing at the same time faith in institutions is totally eviscerated. You're going to trust the FBI after this debacle? You're going to trust the court system with a guy who doesn't even know what a freaking Brady case is? Now, combine that with this, the economy going down in flames at the same time.
Starting point is 00:40:47 We now have two choices, folks, with the economy moving forward. Fed met yesterday, bumped up the rates 25 basis points. You can see at the Washington Times, Fed raises rates, declares sound banking system. Oh, yeah. They declared inflation was transitory, too. I don't know about that. I'm going to take that and stick that right in the toilet bowl. Fed's got an interesting problem right now. I summed it up for people yesterday. I see it made its way around Twitter. A lot of
Starting point is 00:41:15 people are saying, Hey, listen to Dan show. He sums it up. Here's the choice right now we have in the economy. There's a third choice, but it's not an option because Joe Biden's in charge. I'll get to that in a second. But we have two choices right now in the economy, and only two with the Democrats in charge. You're going to have hyperinflation or a bank collapse. Or both. There's a third option to fix this right now, but the Democrats won't take it. Let me get to my last sponsor and I'll explain exactly what's going on, why you should be concerned. And a guy on Fox explained it really
Starting point is 00:41:50 well, what's going on right now, why we're in a little bit of trouble. Brickhouse Nutrition. Folks, I am a big believer in Field of Greens. It is a fruit and vegetable powder by Brickhouse Nutrition. You can get it at brickhousenutrition.com slash Dan. Use promo code Dan for 15% off. Listen, here's the story. The owner of this company, I am a big believer in the power of fruits and vegetables. I am a huge believer. I get my blood work done all the time for obvious reasons. And the doc says to me, he says, listen, you got the blood work of a 20-year-old. That's because of diet and exercise, both. But my diet would be lost without field of greens because I don't always have time to prepare every day, especially between shows, a big cornucopia of colorful fruits and vegetables. So I asked the owner of the company if he could make a product.
Starting point is 00:42:37 So he took the most wholesome, best organic fruits and vegetables. They grind them up into a great tasting powder and it goes into a jar of field of greens. Take a scoop, put it in whatever beverage you want. Protein shake, water, green tea I put it in sometimes. Stir it, drink, tastes great. He loves the lemon lime. I drink the wild berry. I don't eat as healthy as I should sometimes. I just don't have the time. That's why I take field of Greens. Field of Greens. But the best test for you will be your next checkup. When I bet your doctor says, whatever you're doing, it's working.
Starting point is 00:43:10 Keep it up. So let's get started today with Field of Greens. You'll get 15% off if you visit BrickHouseNutrition.com slash Dan and use promo code Dan. That's promo code Dan at BrickHouseNutrition.com slash Dan. BrickHouseNutrition.com slash Dan. Don't wait another day. Take care of your health. Thatutrition.com slash Dan. BrickHouseNutrition.com slash Dan. Don't wait another day. Take care of your health. That goes away.
Starting point is 00:43:28 Nothing else matters. Thanks, BrickHouse. So pick your poison right now. The Fed's got to raise interest rates because they've got to dry up the money supply. Interest rates go up. It makes money more expensive, right? Everything has a price. Bagels, cars, money has a price too.
Starting point is 00:43:44 For you to get money at a bank, you got to pay an interest rate, right? Everything has a price. Bagels, cars, money has a price too. For you to get money at a bank, you got to pay an interest rate, right? The higher the interest rate, the harder the money is to get. Well, I can't afford a 9% loan, but I can afford a 5% loan. Think of an interest rate as a price of money, kind of the price of capital. But for sake of argument, in order to dry up the money supply and make money harder to get, the Fed raises interest rates in inflationary periods. Okay, that's a great idea. We're in inflation. What's the problem, Dan? The problem, as I've said for the last week, is as the interest rates go up, the banks all have a bunch of bonds on the books that lose money when interest rates go up. No one wants a bond paying 2% if I can get a 5% bond because interest rates
Starting point is 00:44:27 go up. Very simply stated. So what you're saying, Dan, is as the feds keep raising rates, banks are going to continue to lose money? Isn't that going to cause a banking crisis? Yes. That's the point, man. So there's a third answer here. The third answer is to do what Reagan did and to juice the economy by cutting government spending and massively cutting taxes, letting the economy grow, which would produce more products, which like a sponge would suck up all the money because it'd be chasing more products and prices would come down. That's out of the question. Biden's a communist, doesn't want to do that. So what's going to happen, folks? Biden's a communist, doesn't want to do that. So what's going to happen, folks? Well, I'm telling you, either hyperinflation is going to happen or you're going to see more banks going down. He was a guest at Eddie Gabor on Fox yesterday explaining exactly the problem we're in now. Check this out. Eddie, does backing up the banks make any difference to your bearish outlook for stocks? It does not. Look, the fact that Yellen has to even come out and
Starting point is 00:45:26 say that there's a potential to need to backstop more banks, in my opinion, gives people less confidence in these smaller banks. And so we have a banking crisis, unfortunately. And look, this goes well beyond the banks, right? Think about the financial institutions that aren't backed by FDIC, the shadow banking that have these same types of high risk loans that are out there. They're going to start to see defaults there and there won't be any government backing. Look, at the end of the day, the government can't backstop every business and every bank and every depositor. Right. This is a function of poor monetary policy and loose and zero interest rates for over a decade. And we just started this banking crisis a couple of weeks ago.
Starting point is 00:46:11 Just because Yellen comes up and speaks about it doesn't mean it's going to reverse itself overnight. This guy just absolutely nails it. He absolutely nails it. It's not just the banking system that's in trouble. It's a shadow banking system. What's the shadow banking system? A lot of these companies that aren't going to be able to get loans from standard banks, Joe, because they got a product that may or may not work and they're new and they have no reputation in the space. They go to this venture capital angel investor space who lend them money too. A lot of them are going to have problems as interest
Starting point is 00:46:44 rates go up too and money starts to dry up. them are going to have problems as interest rates go up too and money starts to dry up. This entire shadow banking system that's interest rate sensitive has the same issue the banking system does. A lot of these companies that were going to go public or not, a lot of these companies that are public and have been borrowing money at low rates and have bonds on their books, their bonds are going to be worthless. Now you see why I'm a little worried? I'm worried very simply because the witch's brew for social revolution is economic trouble. At the same time, faith in institutions collapses. Sounds like something is happening right now.
Starting point is 00:47:23 Speaking of faith in institutions collapsing, you see this email? The America First Legal Foundation. They got this email from Kate Bedingfield when she was working at the VP office, Biden. Look at the date, 2015. Biden's the vice president. This is hilarious. She's answering to Eric Schwerwin, who was one of Hunter Biden's business partners at Rosemont Seneca. They're talking about making the Hunter Biden story go away. She was absolutely, this is in the VP's office. She says, absolutely. We've had two conversations about it. She's talking about her conversations with someone from the press.
Starting point is 00:47:56 She will only use the press, if her editors hold a gun to her head, she absolutely will not do the second thing. Talking about covering these past stories about Hunter Biden and his time in the Navy and his corrupt business deals. You think we're going to get honesty from the fourth estate in the media? You had someone in the media telling the VP's office they're not going to actually cover the bad news about the VP unless they, quote, have a gun to their heads. You think you're going to get honesty from the White House? Here's Kareem Jean-Pierre. Anyone changing their vote in advance? Guy?
Starting point is 00:48:28 John? Anyone? Still sucks. Worst press secretary in the history of the United States by far. She's asked yesterday by Peter Doocy about this unfolding disaster of the Biden Mafia corruption ink racket and the new information from bank records
Starting point is 00:48:44 about Hunter Biden. Keep in mind, these are bank records. No one's disputing the authenticity of them. And the Kareem Jean-Pierre defense is the Beavis and Butthead defense, the infamous cartoon from the 90s. The other kids did it defense. The what me defense. Here, listen to this. you kareem uh house oversight says they've got bank records showing a chinese energy company paying three biden family members through a third party what were they paid for look i'm just not going to respond to that from here. Look, we have heard from House Republicans for years and years and years how the inaccuracies and lies when it comes to this issue. And I don't even know where to begin to even answer that question because, again, it's been lies and lies and inaccuracy for the past
Starting point is 00:49:40 couple of years. And I'm just not going to get into it from here. a couple years and I'm just not going to get into it from here. This is really stunning defense, how the media lets this go. They have the bank records, just like they have the laptop. Nobody's disputing the authenticity of either one. Nobody. And they still are going with the wasn't me defense. And the media obviously doesn't care unless you quote the Kate Bedingfield's
Starting point is 00:50:08 email. They will not print it unless you put a gun to their heads. This is just insane. By the way, I got to get to these stories. Questions for tomorrow. If you want to submit questions for tomorrow, ask. We do Ask Me Anything tomorrow on Friday. Go to my Locals account. Download the Locals
Starting point is 00:50:24 app. I'm at DBongino. And I'll put a Questions for Dan post up. And then you can also Go to my Locals account. Download the Locals app. I'm at D. Bongino. And I'll put a Questions for Dan post up. And then you can also go to my True Social account at D. Bongino. Say Questions for Dan. Submit a question for tomorrow. But I want to get to this. I've been holding it for a couple of days. First, as I've said, what's old is new again with the left.
Starting point is 00:50:38 Joe, segregation is back with the left. Now we can take another vote. Segregation, Joe, good or bad thing? Bad, Dan. Guy? Guy's giving it a thumbs down. That's a three for segregation. Definitely no good.
Starting point is 00:50:53 As I told you, though, the Libs want to bring it back. Grand Valley State University lists their graduation ceremonies for black students, Asian students, Latinx students, and Native American students next month. They'll also have a general commencement for black students, Asian students, Latinx students, and Native American students next month. They'll also have a general commencement for all students when they're done with segregated students. Segregation, it's back with the left. Here's a video too I haven't shown you yet. This is Lydia Glaze. She's a state representative in Georgia. Here she is about school choice. They want, again, segregated schools, poor minority students in crappy schools.
Starting point is 00:51:29 She's a Democrat, of course. They want poor minority students in crappy schools. And they want, you know, white and other students in other schools. So this is a Democrat's argument. And here's Lydia Glaze, state rep in Georgia, arguing against school choice, saying, you parents, you're just too stupid to figure it out. Kind of similar arguments that are made by racists all the time.
Starting point is 00:51:48 Check this out. I see access as a problem. I see parents being able to direct their child's education and they are already in the lower 25 percentile, meaning a lot of those parents did not finish high school and cannot direct their could not finish their own education i am extremely concerned that we would put money in their hands in that and that entire piece of life in the hands of parents who are not qualified to make those decisions and they don't have the money to put in the difference that their child would need to attend a private school. Now, Joe and I and Guy don't hang around with racists, but in our effort to stop them, I've researched a lot of their stupidity.
Starting point is 00:52:34 And one of the arguments is that people of a different race are stupid and dumb and have some genetic limitation. Doesn't sound that much different from that one right there. Bunch of idiots. Can't figure out what to do with your kids. Here's the hilarious part. Lydia Glaze, Georgia State Representative, took advantage of school choice by using her money
Starting point is 00:52:56 to send their kids to private school. Check this out. I am for private schools. All of my children graduated from private schools, but I am not for them. If we take public school dollars and use them for private schools, we pay for it. Hilarious public school dollars, Joe, as if they come from the money fairy.
Starting point is 00:53:18 It's money taken by force from parents to pay for other kids, to pay for other kids' public school. So you're not allowed to take your money, send your kid to a private school like she did. We'll just confiscate it and give it to other parents instead. People are so stupid, man. It's old is new again, folks.
Starting point is 00:53:36 Segregation's back. The left's loving every second of it. Hey, thanks again for tuning in. I really appreciate it. Don't forget to submit your questions tomorrow. And if you would, please subscribe to the podcast. It is absolutely free. It helps us so much.
