been charged like seven times with this already so again the walls are closing in i'm sure we'll
hear a uh another series of walls are closing in statements again about this absolutely pathetic
case donald trump in case you missed the news uh was indicted by a new york grand jury after
months and months of them trying to indict him on the
felonious Mopary charge. That means 12 of 23 people agreed to hands down a true bill.
My guess is it happened. The timing is extremely suspicious. I'll leave that for another day.
But it happened now. It's a perfect distraction, of course, from everything going on.
And of course, the people in charge on the left, they've shown us who they are.
Again, they're on their political battlefield right now.
They're showing us.
They're basically dropping their jaws, showing us their asses and saying,
now we're tyrants.
We're not hiding.
We're tyrants.
We want you to know we're tyrants.
And what are you going to do about us being tyrants?
That's basically what's happening.
Now, Nancy Pelosi, one of the political leaders on the left and believe me that word leaders doing a lot of work in that sense apparently doesn't even understand the constitution
after the indictment of donald trump so much so that she tweeted out this nonsense and how to get
fact checked by twitter twitter where there are a bunch of lefties in their community.
She said, the grand jury has acted upon the facts and the law.
No one is above the law.
That's except Hunter Biden and Hillary Clinton, by the way, Nance.
But getting back to her tweet,
and everyone has a right to a trial to prove innocence?
Wait, what?
Hopefully the former president will peacefully respect the system which grants him
that right oh dude you weren't born here right but you've you've read the constitution once
you've seen it right it's he's he's very familiar with the legal process i see i was under the
impression i'm not a lawyer folks but that you're not obligated to prove your
innocence against the government that you're presumed innocent that the government's obligated
to prove its case against you I didn't I I just I came in this morning Guy had to tell me that
he's like why is this tweet now I'm like I don't know it's a Nancy Pelosi thing she's like you
really he's like you realize there's a constitutional problem i said i didn't i didn't know i didn't know gee
i didn't know i'm a former law enforcement i was totally unaware as a law enforcement agent
but you're presumed innocent this is nancy pelosi she had to get fact checked by twitter
quote miss pelosi mistakenly says that trump can prove his innocence at trial
law in the united states assumes the innocence of a defendant,
and the prosecution must prove guilt for a conviction.

So somebody's like, well, we were, and we're going to keep that.

pound my chest out, chin up, whatever it may be. Now, Josh Hawley appeared on Fox last night,
and he's absolutely correct. We are now on a political battlefield where they're telling you,
we're tyrants. We don't care that you know we're tyrants now do something about it they're trying to
instigate some kind of political civil war in the united states right now there's no doubt about that
here's josh hawley last night pay very close attention to this part he says straight up and
he's absolutely correct this is nothing but a raw power play for the future of the country and he's
not wrong check this out i think what this is about it's nothing to do with the future of the country. And he's not wrong. Check this out. I think what this
is about is nothing to do with the rule of law, Jesse. Obviously, this is about power. It is a
demonstration of raw power. I think the Democrats know this has nothing to do with the law. They're
sending a message and the message is they will use any power that they have to interfere in the
next presidential election. They will not willingly allow Donald Trump to run for president. They will
not willingly lose the next election. They're going to use every means at their disposal. Jesse,
these are the same people who have sent SWAT teams to pro-life activists, who use the FBI
against parents at school board meetings. They will do anything, use any kind of power to try
and hold on to their own privileges, their own positions. And we are seeing that tonight.
This is just unprecedented in American history.
And the only way out now is to win.
You know, ironically, two of the worst, most overused words in the English language are
unique and unprecedented, which is ironic when you think about that, right?
Maybe ironic is one of them too, which would really be ironic.
But this is without precedent. Josh Hawley's correct. There is no precedent
for a former president who is now a political candidate for the presidency again to be indicted
by a member of the opposite political party for what is obviously a fake made up crime.
There's no precedent. We've never seen this in
American history. You want to upend 200 years of American jurisprudence, throw the constitutional
Republican in the toilet bowl over an alleged payment to a woman named Stormy Daniels. I just want to be sure here that libs,
this is what you're going to go with. This is the hill to die on. So after you've used SWAT teams
to target the MAGA folks, after you've government spying to the FBI and elsewhere, after you use
social media to spy on us.
After you've weaponized the FBI to come after parents and Trump supporters.
You've weaponized the IRS to go after the Tea Party.
You used local DAs to put Trump supporters in jail.
And now you've used the Bar Association to try to prevent Donald Trump from getting any kind of legal protection.
After you've done all that, now you go, Joe, straight to the handcuffs.
Just put him in cuffs if we can't do it.
Oh, by the way, I want to forget this.
I forgot him.
How do I forget impeachment?
I got to take notes so I don't miss that later for the radio show.
You've impeached the president on fake charges multiple times.
Now you just go straight to the handcuffs.
There is a solution to this, folks.
It may not be the solution some of you want to hear,
but it's the only morally, ethically, and politically correct one if you really believe this country's worth saving.
If you don't believe the country's worth saving,
there's nothing I can help you with.
I am long in the United States.
I had a guy call in my radio show
yesterday. I didn't tell you this, Joe. His name was Bud. I take calls at the end of the show.
He said, Dan, I'm a Vietnam veteran. And I just want to propose something about the school
shootings that have been happening. And I stopped him and I said, hold on before you give us your
solution to this problem.
I said, I want to thank you, bud.
I said, guys like you went,
wrapped yourself in our flag and fought for a mission
that wasn't popular with a lot of people, granted,
but you did it because you believed in your country
and you believed you were doing the right thing.
And you came back,
people were spitting on you
and treated you like total garbage.
I said, you know, my uncle fought there
and came back in a box on the day he was supposed
to come back on his feet and it destroyed my family forever.
So I said, I want to thank you.
And then Bud went on to say how he's willing to volunteer to go stand in front of schools
and protect these kids.
Now, Joe, just based on the chronology of time,
Bud, obviously, if he fought in Vietnam,
is obviously an older gentleman.
The fact that Bud, who's already served this country,
wants to go back now and volunteer his own time
to defend the lives of young kids.
You want to know why I'm long in the United States
and why after days like today, I don't just
dial it and, ah, it's all over. It's done because it's not all over. We've been handed a problem.
We are dealing with a growingly radical, miserable, tyrannical police state, increasingly violent
left. That problem can be dealt with. It's been dealt with in the past. In the 60s, in the 70s, we came out
of it with the greatest eight-year run we've had in probably modern history in the Reagan year,
where we won 49 out of 50 states, something the Democrats haven't managed to do in decades.
Don't tell me America's not worth saving. This is our problem, and it's our problem to deal with.
And there's a way to deal with this.
Ehud Barak gave you the example on yesterday's show.
He gave you the example.
Show up in the streets, but do it the right way.
Do it the right way because it's the moral, ethical, and politically sound thing to do.
Now, when we win, because we will win in 2024, we will win. We have to believe that.
When we win, because we're going to show up. You hear me? We're going to show up.
The first thing, I don't know if you guys agree with me or not on this. There's a lot going on,
taxes, social security problems, healthcare issues, budget issues, schooling issues.
I totally get it.
There's a lot going on.
The first thing an incoming president has to do,
whether it's Trump, DeSantis, or anyone else,
there has to be a massive purge of strict political actors out of the government.
You fire one, the media loses their mind,
fire 10 more the next day.
When they're writing stories about 10 loses their mind, fire 10 more the next day. When they're
writing stories about 10 people that fired, fire 100 more. That has to be the first priority of
anyone getting in there. If you're not committed to doing that, and I think Trump and DeSantis
both would be, then please don't run. Matter of fact, I think in this case, Trump's actually
better positioned because what does he have that DeSantis doesn't? He doesn't have any pressure for reelection. Get rid of them all. Get rid of them all. If you cannot swear an oath, regardless
of your political party, don't fire people because of politics, then you just continue the cycle.
Fire people because they took an oath to defend the Constitution of the United States
that they've now flushed down the toilet you need to go that'll be the first step in taking this back to the constitutional republic
i want to play this tucker brought up a great comment last night folks the unfortunate part
about this whole thing is there's no turning back now you can't unsee this you can't rewrite history
you know that eckhart tolle had that power and now book the only thing
we live in is is the now the future hasn't happened yet the past is already written in
the books joe you can't burn those pages that is it they're inscribed in stone we can't change the
past the problem now is there's no coming back from this just like they set a precedent dumping
the judicial filibuster for nominees in the courts,
which the Republicans then used later on
to stick it to the Democrats.
You now got an era where basically political figures,
it's legal open season now.
There's going to be no way for the left,
if Joe Biden finds himself in handcuffs
or Hunter Biden or anyone else,
there's no way for them to say,
oh, we don't do that. There's no precedent for that. There is now.
Listen to Tucker's take on this. A good one. Either way, the net result is Donald Trump is
the first former president of the United States ever to be indicted. So no matter what happens
next, we can be certain there is no coming back from this moment. There could be retaliation from
red states.
The governor of Florida has already said, Ron DeSantis has already issued a statement saying
that he will not participate in any extradition of Donald Trump to New York. That's apparently
scheduled for next week. As you can probably tell, we're not certain of the full outlines of the
story, but we know this moment is a historic one. It's a historic one for all the wrong reasons.
And can I tell you what really, really frightens me here?
Let's put all the nonsense aside.
It's not time for hyperbole today.
It's not time for bulge.
It's not the time for that.
What has me really terrified right now is not just our descent into police state madness,
which we obviously are at right now.
It's not even, again, that's not even open for dispute. What scares me is Iran, China, North Korea, and Russia, nuclear-powered and soon
if not already nuclear-powered powers, are watching everything happening in the United States right
now. Everything. Their future conduct
in potentially starting and lighting a fuse
that could lead to World War III,
which would lead to a horror you have never seen.
You have never seen a world war in the nuclear age.
You have not.
You've seen a world war where we had nuclear weapons.
Our enemies did.
That's a totally different scenario.
China is watching.
You have a DA up in New York, Twinkies here, who is so short-sighted and politically myopic
and maybe just straight up dumb that he didn't have the balls or the guts
to stop what he knows is a political persecution of a former president while nuclear powered
enemies of the United States have their eyeballs directly trained on what's happening right now.
Folks, please, I joke with Joe and flag it and stuff. This isn't even the time.
I'm telling you right now, pay close attention to what I just said.
They will rue the day they did this.
If something happens on the world stage and the best thing you can do is stick Donald Trump.

China invades Taiwan.
Russia lets a tactical nuke go in Ukraine and invades Poland. The North Koreans do another nuclear test. And Donald Trump, the former president, is in court in handcuffs to answer
for charges about a payment to a woman named Stormy Daniels.

here's john turley legal comment on Fox, on how they basically bootstrapped, just fabricated this entire charge.
How it makes absolutely no sense and it's clearly political.
Keep in mind, Turley and I disagree on the approach to the thing completely
and he's not a conservative from what I know.
He's telling you this is a really bad idea.
Take a listen.
For many months, this bootstrapping theory has been put out there.
This idea that you could take a misdemeanor under New York law that has expired,
that has a two-year statute of limitations,
and revive it by connecting it to a federal crime,
in this case, a federal election violation.
Now, there's a host of problems with that.
First of all, it's a federal crime.
The Department of Justice chose not to prosecute.
Bragg's own predecessor declined to prosecute.
But he is attempting to bootstrap that federal crime into a state case.

And if that is the basis for the indictment,
I think it's rather outrageous.
I think it's legally pathetic.
Listen again, Turley's,
we have big differences on approach to this. That's fine.
Fox has different people with different approaches on.
But he knows far more about the law than I do.
He's no conservative here. This is a joke. He's telling you it's legally pathetic.
This, in the midst of a potential world war, this is what Alvin Bragg, this is what Twinkies wants?
Here's Alan Dershowitz, a lifelong liberal, by the way, I might note.
Lifelong liberal.
Nobody's going to question that.
Here's Dershowitz saying, this is kind of weird.
I hadn't even considered this.
Their reason for delaying this, because this was from seven years ago,
this alleged payment to Stormy Daniels, seven years ago.
Seven. was from seven years ago this alleged payment to stormy daniel seven years ago seven he says the reason alvin bragg is saying and i say saying in a sarcastic tone because alvin bragg's just making
all this up i want to be crystal clear he's a tyrant he's not a serious person right bragg's
saying well we would have gotten trump sooner but he was down in florida which is really weird
as dershowitz knows because they indicted him when he was in Florida.
Take a listen.
The most important thing is they indicted him when he was out of New York.
And that means they could have indicted him within the statute of limitations when he was out of New York.
Statute of limitations is way expired.
They claim they couldn't have indicted him because he was outside of New York.
But now they've indicted him when he's not in New York.

but now they've indicted him when he's not in New York.
So they've made a foolish, foolish decision,
which will cause the case to be thrown out,
I think, on statute of limitations grounds. This is why I'm hearing from even Democrats
what a disaster this is going to be.
This is going to be a legal abomination.
Now, he may not get a fair trial,
but folks, I see almost no way
that this case makes it to the appellate court in New York.
And they uphold this.
You've got to remember,
once these courts set a legal precedent,
it's used for future rulings.
If the statute of limitations clauses are effectively nullified just because you want to went after Donald Trump,
there's going to be a slew of new cases brought
because they're going to say, well, there's no statute of limitations.
You guys just said so.
This thing is a disaster.
Now, governor in Florida, he's not going to cooperate.
Applaud Governor DeSantis for saying,
listen, this is a weaponization of the system.

It's un-American, and Florida's not going to assist
in an extradition request,
given the questionable circumstances at issue
with the Soros-backed prosecutor.
Good for him.
Now, as I said the other day,
applaud the response. I don't think
extradition is going to be an issue because the Trump team has already indicated that they're
going to turn themselves in this coming week, this Tuesday. So you only extradite when someone
doesn't agree to appear. I don't see this being an issue, but I'm glad to see that the governor
in Florida is like, nah, we're not going to cooperate with your garbage. This is obviously made up.
Folks, it's time for everyone right now.

You've got pro-Trump, pro-DeSantis.
You've got pro-Tim Scott, pro-Vivake, pro-Nikki Haley.
Everyone, please.

So Michael Steele, he quote tweeted an appearance I made on Jesse Waters.
And he says, when I said they're basically destroying the police state,
he says, nah, he says they're coming for Trump. Rest of y'all okay. Unless of course you've
committed a crime. Don't know why people are still confused by this point. Rest of y'all are okay.
Yeah. Tell that to Peter Navarro, Roger Stone, Mike Flynn, all prosecuted on trumped up ridiculous charges that have almost
no precedent handled criminally in U.S. history. Steve Bannon, which is interesting because Michael
Steele kisses Eric Holder's ass. He claims to be a Republican, which is hilarious. And yet Eric
Holder, who ignored a congressional subpoena, he's not in handcuffs. But Steve Bannon was so strange,
so weird. It's almost like Michael Steele's full of crap. So I sent this back to him.

the sellout piece of garbage used to show up at my political events in
Maryland to try to stay relevant, which is true, which is true.
We put up with him,
even though my staff didn't want him around because he was such a rhino.
He also used to beg me to be on his low rated radio show.

rely on the appellate court. So I'll

So can Trump get a fair trial uh in new york in front
of a jury ladies and gentlemen uh i doubt it the great julie kelly who wrote the book january 6th
on her twitter account posted some audio that it aired on c-span this audio is extremely relevant
to the new police state we live in now Now, when you are subjected to a trial,
Joe, it is a jury of your what? Peers, correct? Last time I heard Joe,
gee, you're pretty familiar with that, right? Jury of your peers. It's not a jury of people
who hate your guts, a jury of your political enemies. It's a jury of your peers. Well,
what's the problem in Washington, DC and New York? If you were a Republican,
there aren't many peers to choose from.
That's kind of an issue.
So you're basically being tried by people with a political axe to grind.
The crazy part is when jurors actually come out and admit that there may be political axes to grind.
Here is a Jan 6th Oath Keepers jur, admitting on audio, Julie Kelly picked this up,

Thank God there was an attorney who worked in the Justice Department on the jury. How that was allowed, I'll never know. He couldn't believe it.

because he's accurate. Okay, sure. Fair trial. Righto. So the Secret Service, as I said before,
has the full federal power and authority to protect the president, former president of the United States. That power is not usurped in any way by Twinkies up in New York. You need to
understand that. Alvin Bragg has no authority over the Secret Service whatsoever. However, the Secret Service does have authority
over what Alvin Bragg can do. Now, I shouldn't say if the Secret Service committed a crime in
New York City, any agent can be arrested under New York City's penal code. No doubt about it.
I'm suggesting to you when it comes to the protection of Donald Trump and the bubble
around him, Alvin Bragg has no authority whatsoever to usurp the Secret Service.
The Secret Service derives its power from 18 U.S.C. 3056, as you can see right here.
And as I've noted before, if Alvin Bragg tries to get in their way and create a dangerous situation for Trump, putting him in front of criminals, putting him around criminals, the Secret Service can arrest Alvin Bragg and fine him.
They'd arrest him, the government would fine him.
Here it is.
Whoever, notice it doesn't say whoever with an asterisk here,
except the New York DA.
Whoever knowingly and willfully obstructs, resists,
or interferes with a federal law enforcement agent
engaged in the performance of the protective functions
authorized by this section shall be fined or imprisoned.

If the Secret Service is doing its job,

they're not political actors,
they are not handling this politically,
and they've already told the political actors,
we will not allow you to put the former president
in this situation.

Secret Service to do that if someone tries to get in the way. Here's the other code the Secret
Service operates under, 1752 United States Code. They can restrict an access to the former
president. They can say you're not allowed near him. No, no, no, Dan. Alvin Bragg is going to say I'm the DA. It doesn't matter.
I just told you it doesn't matter.
Because in this section, the Secret Service can declare something a restricted building or ground.
Meaning a cordoned off area that basically their protectee or a former president is temporarily visiting.
There's no exceptions here. There's no exceptions. You need
to understand that. The Secret Service can say you cannot come in here for this reason. There's
nothing they can do about it. We'll see where that goes. They'll do their job. I'm sure of it.
All right. There was a ton of news yesterday, too. The timing of that indictment was really suspicious.

We had the Democrats go all in from the White House podium, defending basically a serial killer.
We had a day of trans vengeance announced after a alleged trans serial killer murdered six people, including three nine-year-olds.
This is the police state we live in.
This, of course, will blow up spectacularly in the left's face as the country realizes
we're dealing with straight-up lunatics right now.
But there was also a couple of insurrections yesterday, one in the Tennessee Capitol, and
there was also chaos at the Kentucky Capitol, too, by trans activists and gun grabbers
who want to put your kids in danger
who use kids as props.
Did you catch the insurrection yesterday?

I expect the FBI
will be investigating this immediately.
They used a bunch of kids,

to go out and attempt to disarm you
and put your kids in danger

some of them got violent in this insurrection in Tennessee. I'm sure the FBI will be on this

ourselves under an EMP attack. At least the circuits will work in your house. It won't get
