Starting point is 00:00:00 So this is breaking news that came out of today regarding the appeal for Carmelo Anthony's murder conviction. The judge that presided over his original case is now officially recused himself. A major decision in the case of convicted murderer Carmelo Anthony in his fight to get a new trial. A judge today ruled in favor of a defense motion to recuse the trial judge John Roach Jr. from overseeing the appeals process. The defense accused Judge Roach of not being impartial during Carmelo Anthony's trial. They point to an interview in which Roach said he believed the trial was fair despite having no black jurors and agreed the jury reached the correct verdict. Anthony was convicted of murdering Austin Metcalf by stabbing him with a pocket
Starting point is 00:00:48 knife during a track meet in April of last year. And the jury did have two Asian members and one of Native American descent as well on there. So when you talk about was there diversity, yes, there was. Now, I have the opinion that this is purely an optics call, meaning they want to make sure that everything looks impartial. It doesn't mean that the conviction is wrong. But obviously, his supporters will, you know, relish in this and say, yes, this is justice. This is one step closer to him getting a fair shot, you know, the jury. They were extreme in their verdict. And quite frankly, I guess my question is, are these the same people who believe he's innocent? Because he's not innocent. I mean, the evidence was overwhelming. His own witnesses,
Starting point is 00:01:37 their statements were overwhelming. His friends even contradicted the defense team. So I'm not too sure what is the goal here. Maybe you guys can explain it to me. Let's hear more. But this issue, Josh, with the judge being forced to say he'd recuse himself by another judge, What does this mean? I think it's the right decision. Now, in no way does that mean that the judge who presided over the trial was unfair or made a wrong decision or somehow the racial makeup of the jury was biased and not favorable toward Carmelo Anthony. But much of the defense argument in this attempt to gain an appeal has been about the judge.
Starting point is 00:02:21 And so you can understand how it would be difficult from an optics perspective to have that same judge making decisions. essentially reviewing himself, making decisions about whether or not his prior decisions were fair or not. I wouldn't read too much into this as far as this being somehow favorable to Carmelo Anthony. I think it's just the right decision to make sure that everything moving forward is treated in a proper way. And there can be no accusations later on down the line that that judge, that trial judge, was simply backing his own prior decision. If you guys could recall, there was another high profile case by the rapper name Young Thug in, Fulton County, Georgia. They came across the same issue. The defense team wanted the judge to recuse himself. He actually refused to do so. So they had to actually appeal to an entirely
Starting point is 00:03:12 different judge outside of that county. And it was a whole mess. And so it makes total sense why this is happening. Again, it doesn't mean the verdict is going to get overturned. But again, it's not going to stop the supporters from showing up to the courthouse today and doing this. Starting point is 00:04:49 Thank you guys. All right. Here's the other thing you guys should know. He's going to actually have a hearing tomorrow on Thursday, he'll be there in person for his appeal to officially be heard. This is why they wanted to remove the current judge to make sure that he wasn't part of that decision. I don't think it's going to make a difference, but that's just me. Why don't we go to someone who says they are an attorney who actually supports Carmelo Anthony. Here's his mindset.
Starting point is 00:05:17 Carmelo Anthony's judge from his original trial has now officially been recused from any possible retrial criminal defense attorney jack palmer here out of south florida this is amazing news this is great news for camelo and his team and all of his supporters i being one of those supporters today's decision will feed directly into tomorrow's argument that carmelo never did and never could have gotten a fair trial in part and maybe in large part because of this judge's conduct and inherent beliefs about the case before it was even concluded. I've been a staunch advocate for Camelo. Notice in that entire monologue of his, he doesn't actually explain how the guilty verdict was wrong. He doesn't actually prove that Carmelo Anthony was innocent. We've gone over
Starting point is 00:06:11 at multitude of times, guys. I mean, at some point, you just have to take the L. If you call a defense witness and you are the defense team and your defense. defense witness contradicts your entire case and that defense witness is friends with Carmelo Anthony, what do you want the jury to do? It just doesn't make any sense whatsoever. All right, as I told you guys, the hearings will be tomorrow. Let's hear more information on that. Yes, good morning. Within the last 30 minutes, both the families of Austin Metcalfe and Cremelo Anthony entered into the courtroom. Carmelo Anthony also entered a little bit later on. Now, he had his haircut. He was wearing handcuffs initially. His defense team asked for those cuffs to be removed,
Starting point is 00:06:55 and that did happen. Now, Anthony was sentenced to 35 years in prison for the fatal stabbing of Austin Metcalf a year ago. Anthony has a completely new legal team this time around, though, made up a pretty well-known civil rights and criminal defense attorneys. They're hoping for both a new judge and a new trial. All right. So we'll be looking forward to what happens tomorrow. and we'll definitely post a video about it and see what the results are in regards to his case. Again, I just don't think it's going to happen for reasons I've already explained in depth. But let's move on to our next update. The fallout from last night's primary elections that happen in the state of Florida.
Starting point is 00:07:37 One of the DSA candidates were actually successful in winning. That was Angie Nixon, who I would say is a very interesting character. Definitely wouldn't want to hang out with her. but here she is already threatening her opponent, Ashley Moody, and saying that she can't wait to beat her. Take a listen. We do have some conflicting messaging in the Democratic Party after yesterday's election. As you mentioned, DSA Socialists, she won that nomination for the U.S. Senate,
Starting point is 00:08:06 but the Democrat running for governor, he's rejecting socialism outright. So let's start with that major upset. State Representative Angie Nixon, defeating Alex Vindman with the grassroots campaign, delivering a major left-wing victory over an establishment Democrat. Vidman is a formal national security official who was a key witness in President Trump's impeachment trial. Nixon won by double digits despite just under a million dollars compared to Vidman's $16 million. Nixon gained national attention after her arrest for staging a sit-out outside Governor Ron DeSantis's office this year. She'll now face an uphill battle in November against Republican Senator Ashley Moody,
Starting point is 00:08:48 who got 1.3 million votes. Nixon wasted no time calling out her opponent. She doesn't care about anyone but herself. And so I look forward, Ashley Moody, to taking you on and to whooping you in November, and you will be calling me your senator. President Trump posting, Sleasbag Bidaman loses tonight to a radical left lunatic.
Starting point is 00:09:10 How cool is that? I mean, Angie Nixon plays into the stereotype of black woman, man. I don't know why she had to come out so aggressively. But, hey, that's her stitch. If that's what she wants to do, go right on ahead. It's, you know, she has every right to run her campaign, how she wants to. Clearly, she was successful in definitely beating that scumbag. I mean, I'm not even going to waste breath talking about him.
Starting point is 00:09:34 But I want you guys to continue to listen to some of her interview on CNN last night. Watch. Some of the agenda includes things that have been controversial. Things you did not name, by the way, in what is most important to you and the voters of Florida. including defunding police or abolishing prisons. Because those are part of the platform, the DSA officially agenda has talked about, do you support those or want to be distanced from those
Starting point is 00:10:00 in people's consideration? So I want to be clear. There are things that are a part of the Democratic, clearly platform since Hakeem Jeffries and Chuck Schumer are not supportive of Medicare for All, which should be a right for folks to have access to quality health care. I want to abolish for-profit prisons because I believe right now people aren't educating our children and they're ushering them into the school to prison pipeline because they want to exploit labor. They're enhancing penalties because they want cheap labor.
Starting point is 00:10:33 And so those are some of the things that I am supportive of. Now, that was actually a previous interview, not the one from last night, but it's a reminder of what she truly believes. By the way, she's a new member of the Democrat Socialist of America. so she's just showing up to this party. So we don't even know she's truly a believer. She might just be leveraging the moment in order to get into elected office. Who knows? But there is a legitimate problem like Fox News just pointed out.
Starting point is 00:10:58 She's obviously supporting Democrat socialist policies. But the guy running to be the next governor of Florida, which is absolutely going to lose David Jolly, he's rejecting them. Take a listen. Is this a state, Florida, that can elect you as governor, but also elects progressive Angie Nixon for the U.S. Senate, at the same time.
Starting point is 00:11:18 Well, we're going to find out. We're going to find out. Look, I reject the DSA. I reject socialism. I'm a capitalist, and I think capitalism provides the greatest amount of economic mobility. So let's stop it right there. I want that to truly sink in. So on one hand, at first, he was supporting these policies, didn't condemn them publicly at a minimum.
Starting point is 00:11:37 Now he's condemning them because he knows he cannot ask the people of Florida to seriously vote for a man who supports those policies to be the next, governor of Florida. There's just no way. So he's already a flip-flopper. He was an ex-Republican, by the way, or he is won. So that tells you how much he's willing, I guess, to switch side, so to speak. So David Jolly shouldn't be taken seriously, by the way. I think that's very clear. And I don't think Florida's going to do it. We talked about it last night after Byron Donald's won the GOP primary election. And also, I just want to point out, it's a confirmation that the
Starting point is 00:12:13 internet is not real life, if you guys know what I mean. There's more of what he had to say. I have been with Angie on the trail and I'll tell you this. She's a fighter. She leaves it all on the field. She goes in every room talking about what I talk about. Can we improve your access to housing, affordable housing, to health care? Do you know where to educate your kids?
Starting point is 00:12:30 What is it that government can do where the private sector is unable to improve your life? Angie's out there fighting for those same values. I think she and I have a very different approach to this. Look, I reject socialism. I'm a capitalist. We'll see how Florida's voters sort that out in November. Well, you heard it in his own words. He rejects socialism. He's a capitalist. But he's a shape-shifter is what he's really saying. I think that's fair to say. And Angie Nixon, man,
Starting point is 00:12:57 she's no better. You're talking about a person who's like, yeah, I want to abolish prisons who are for profit. Okay. So where do these people go? I mean, again, they're confidently wrong, which is a dangerous combo. We might as well wrap it up with what Ashley Moody had to say about Angie Nixon. Take a listen. Angie Nixon, who will be my opponent in November and her comrades want to destroy this country and everything that it is built on. I am not exaggerating. I believe that America is the greatest country on earth.
Starting point is 00:13:41 And in the face of anti-American rhetoric, folks that want to de-examination rhetoric, folks that want to de-examine, stabilize this country, I think we all need to stand on that line. Absolutely. They are anti-American. Their policies are anti-American. Their way of thinking is anti-American. They want to blow it all up. These are not hyperbolic statements. The DSA says they want to abolish the Senate, abolished prisons, abolish police. They're using the word abolish. Okay, they're proud to use it. Why do you think you've seen more DSA candidates doing interviews on Fox News than establishment Democrats. They're not afraid to admit what they truly believe, which is why Bernie Sanders, AOC, Hakeem Jeffries, they all had to come out and say, hey, wait a minute, we're actually not for all
Starting point is 00:14:31 these policies, okay? We're kind of moderate all of a sudden. Yeah, sure. Let me take you back down memory lane. So you guys truly understand who Angie Nixon truly is. Take a look. We have nothing to lose but our chains. our chains are tax on the voting rights act our chains are them closing down our neighborhood schools
Starting point is 00:14:54 our chains are them spending a billion dollars on a ballroom you will never get to dance in uh-huh mm-hmm you will listen to me blah blah blah blah blah a lot of yapping and screaming it's unfortunate, man. This is a woman who has a chance. I don't think she's going to beat Ashley Moody, just so you guys understand. But this is who they put up. She won her election.
Starting point is 00:15:46 The other two DSA candidates did not.
