Starting point is 00:05:46 1942 so the trial of the 39th street gang for the murder of Jose Gaiardo Diaz was on okay it was called
Starting point is 00:06:04 the Sleepy Lagoon trial. You've got to have a catchy name. It was very Tim Burton coded. It is. The New Lagoon really is Tim Burton, yeah. The local prosecutors hatched a plan. That's good. To try all 38 street boys together instead of individually.
Starting point is 00:06:25 That way, they could lump them all in as a gang in the eyes in the jury. I don't think so. It's called the lasso trial. So then the jury of all... If they find one person guilty, they find all guilty. Yeah, then they're like, well, they're a crew. They're all doing it. And look, the boys didn't help themselves.
Starting point is 00:06:49 What made Henry Leibos respected on the streets didn't really translate into the courtroom situation. Sure. He was absolutely not ready for a spotlight, which he shouldn't be. He's just a dude got, essentially he got beat up and then attack back. Like, that's all that happened. He seems unpolished. He is a little unpolished.
Starting point is 00:07:09 I don't know what we're going to do with him. Get him in the suit suit. That'd be good. And so he played into the popular perception that the 38th Street youths were little more than, quote, mad-brained young wolves. Wolves. Okay, wolves. So those cartoon depictions are.
Starting point is 00:07:29 are super races and we're probably part of the I mean the cartoons that we're thinking of and if you're older you know but I don't even even it might even
Starting point is 00:07:40 for younger people they might even seen flashes of it online people know Looney Tunes for the most part so yeah so because Looney Tunes did a lot of propaganda the smoking stuff
Starting point is 00:07:51 and like crazy shit so a lot of war pro war shit so the wolf in Zoot is very clearly propaganda for this. Like they are terrifying, right? Yeah, and I think when you showed that picture before,
Starting point is 00:08:08 it is like you remember it and you were like, oh yeah, they like made me, they were definitely these predatory. They were predatory, yeah. And even that drawing you showed, it's like very fangy. Yeah, yeah. Like that's what led us to the Maid Marian stuff where it's like, it depends on how the artist draws the animal.
Starting point is 00:08:27 No, I'm not like, I don't want to get back into it, But that's what got us there because I was saying, you know, it is, you know, the beauty of the dog or the fox or the wolf is dependent on the artist's ability to, you know, what kind of qualities they want to give it. They want to make it scary fangs, big nose, you know what I mean? They want to make a hot dog, you know, made Marion kind of. I genuinely think that it was the first time you really started noticing boobs on anything. thing and it was a cartoon. I think that's what's going on here. I'm not kidding when I say the first thing that turned my crank was a cartoon animal.

I would be like, I was humanized and seems like kind of... I agree. I totally agree with you. Like, it's like, oh, yeah, he's just like. That doesn't seem like a dangerous, violent person.
Starting point is 00:12:43 I mean, again, not to judge off a picture, but I would imagine that would make people be like, he doesn't seem like a criminal. There are these ideas we're only supposed to act a certain way after death when you've been sexually assaulted. When you're on trial, you're only allowed in society to have a certain way. So you're supposed to look very serious and upset.
Starting point is 00:13:04 A lot of times the people in. charge of that way are biased. Yeah. So the caption was quote, ringleader of bloodthirsty mob, smirking
Starting point is 00:13:19 Henry Levasse, stands accused of dealing fatal blows and murder. Here he is, after freshly devouring a human skull. Look at the laughing death man. Disgusting. Someone took the Joker's makeup off with a hose. So,
Starting point is 00:13:34 it doesn't look good for the defendants. That's crazy that that picture... Right? Yeah. The cops... Well, I was going to be unbiased, but then I saw the picture of him smiling, and I realized he is a vampire. I look at him and I see him standing over the body of my daughter. That is pure evil.
Starting point is 00:13:56 So the cops lie multiple times under oath that they never beat up the boys. One of the boys' lawyers is so upset. that she tries to get herself put on the witness stand to testify that the police had beat them. Wow. She wanted to tell the jury, she found Henry, quote, in the room where police were questioning him, slumped forward in a semi-conscious state with his shirt dappled from the blood and saliva that fell from his swollen lips and bleeding nose. How can you get yourself called as the lawyer?
Starting point is 00:14:33 I don't know. to do that is amazing. The defense calls me. Me. I'm going up there right now. I'd like to go up there. Try to stop me. Yes. You're not allowed to do that.
Starting point is 00:14:46 Calling myself! I will go as Heidi. Calls Heidi Fleming to the stand? No. The judge, Judge Flick. Will you guys call me? Call me up. Hey, can you guys over there?
Starting point is 00:15:01 You guys call me. Can the prosecutors call me? Call me. Call me. Hey, hey, call me. I stand. So the judge, Frick, denies a request saying that it's totally crazy for a defense attorney to take the witness stand in her own case. I agree.
Starting point is 00:15:18 And that's why I think I belong in there to talk about this. So this is a time when there are commies around. This is before the... I don't want to live in the same time. This is before the Un-American Committee, the whole fucking 50s shit, right? Before the red list. Senator fucking dishback. So, Larue McCormick was a powerhouse of a woman, sturdy and smart.
Starting point is 00:15:48 Leru, the red? La Rue. Yeah, sure. Sturdy and smart, a veteran labor organizer who, quote, earned high praise from her colleagues for her energy, wit, and organizing skills. So she's looking for a case that was going to blend race, and class in a way that she felt could rally and unite the left. I got one.
Starting point is 00:16:10 Where? This one. Oh, I thought you're talking about the Maid Marian. Come on, man. Relax. Do you want me to listen or not? The Sleeby Lagoon murder case was perfect, and she immediately began organizing a campaign around it. One of her first strategies backfired terribly. They brought in a judge who had overruled one of Frick's prior,
Starting point is 00:16:39 Judge Frick's prior rulings about Mexican-Americans on account of it being incredibly racist, even for the 40s. So they called him to the stand? Yes. Wow. To try to. Judge Frick was like, no, for God to say. What the fuck is.
Starting point is 00:16:55 How are you, Ted? Do you guys know what a fucking judge is? Hey, Ted. Hi, how are you? Good. What the fuck are you? I just didn't want me to talk about a fucking racist. I do.
Starting point is 00:17:05 What? Yeah. He, I golfed to the McCle. What? Overruled. Now overruled. You're overruled. Don't judge fight.
Starting point is 00:17:14 On an all new judge fight. Judge to judge. Sustained. Ah! Yeah! So he didn't like that, obviously, that this, he's going to be confronted by a man who makes him look like an idiot. And so now he doesn't let that go for the rest of the trial as if he's not already racist.
Starting point is 00:17:40 So he would get angry and angry at the defense as the trial went on. Okay. That is quite a move. It is pretty great. We call a judge who hates you. Yeah, what? Yeah, your judge enemy, we're calling. After you're trying to put yourself on the stand, like, this is fucking crazy. If I can't get on the stand, then I call your mommy. I'm calling Judge Nemesis. Yeah. Your wife.
Starting point is 00:18:08 What? Holy shit. Your mother-in-law. It's been bad. Yeah. Leroux found a better defense lawyer, reaching out to a Lebanese American attorney George Shibli, who she knew from the Congress of Industrial Organizations, CIO, and International Labor Defense. So a huge fucking lefty.
Starting point is 00:18:30 Okay. Right. Shibli was charismatic, charismatic, and passionate and had a good sense of humor. A bit of a wild man. Okay. What's on a show? Okay. Love it. He does not speak Spanish fluently, but that didn't stop him from trying. And his respectful attempts to communicate with the families in their own language earn him gratitude. Now, I have a different. I'm seeing that in a way. U, uh, L, L, uh... Donde est a, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh,

Starting point is 00:20:05 the defense that it was previously lacked. And he puts prosecutors on the defensive because he's always going after him, right? But shit is going very bad for the defendants. Jury, 100% white.
Starting point is 00:20:20 And they visibly hate them. They visibly hate them. You can tell them they're just sitting in there. They fucking hate them. I'm going to say that's just, that's kind of the death nail. Yeah. Yeah. That's never a good sign. It's never a good sign when it's a bunch of whites who are like,
Starting point is 00:20:34 I won't be swayed. A note taker hired by Shibli, quote, The hostility of the jury was almost palpable. You could see that they were looking at the defendants as though they were loathsome. The dudes, the teens are not helping themselves. They're teenagers and they do teenage boy stuff. So some were flippant, quote, at times the boys, at times, the boys, at Times the boys through spit wads at each other.
Starting point is 00:21:08 At each other. Mr. Cotta. It's just so funny. You're watching guys through spitwads. You're like, well, that's a murder. Jesus Christ. I mean, how many are there? There's quite a few.
Starting point is 00:21:22 I think it was like 20. There's 20 of them. They picked it. They poked at one another or they laughed to relieve the tedium of a seemingly endless testimonies. So the trial's gone on forever. There sound like teenagers at a trial. Yeah.
Starting point is 00:21:37 Yeah. Shibli didn't make things easy on himself. He had a habit of grinning every time the judge overruled him. That is a tough one. That is not what you do. That is not what you do. Grasia. Tortugas.
Starting point is 00:21:58 Ah. Much Augusto, Your Honor. And due to his strategy. of objecting to every single racist remark. Yeah, objection. The judge overruled him a lot. Yeah, objection. So he's getting overall, cussily, and smiling every time that happens.
Starting point is 00:22:18 This led to the judge shouting at him, quote, I do not like that smiling attitude on your face. They hate smiling. They don't like smiling. Very strange. I get it. Yeah, you do. And yet the boys have reason to hope.
Starting point is 00:22:38 Shibbley gave a brilliant summation. Played on the emotions of the jury like a violin. Also, the prosecutors have no real evidence to back up the charges. Child goes on for three months. Endless witnesses, because they're trying, oh, there's 22 boys. They're trying to lump together the 22 boys. So they have to call in tons of witnesses to tie them all to each other as well as the crime. Now, the cops never found a murder weapon.
Starting point is 00:23:12 So the ice picks out there somewhere. Sure. The shoddy evidence didn't even prove without a shadow of a doubt that Jose Diaz was murdered. That's tough. This is a trial for what? Murdered. Okay. Yeah.
Starting point is 00:23:26 Okay. The only thing the prosecution showed for certain is that a lot of the teens went to Sleepy Lagoon to retaliate. against the Downy Boys for beating up Henry and Dora. See, that's, to me, that's the biggest faux pa. You can't go to handjob pond and start bringing violence. This is, we're here for jerkingings and fingerings. Steer clear. So you're saying the Downey Boys deserved it?
Starting point is 00:23:57 Well, I'm just saying, wait, wait until they leave the neck point, you know? let the well they did oh okay and i got no beef oh you're saying you're saying the downy boys when they went to beat up the 30th street boys they should have waited until yeah the heavy i'm gonna call let's go with heavy petting the boob the boob feels sure uh tea fucking teafugging the the the t-bagging whatever was going on there wait until i don't know if it'd be waiting till the tea bagging by the one just to be clear you said heavy petting and now you're bringing tea tea bagging is part of heavy petting no no yeah yeah no no no there's no that there's not a base for what that is oh no you put it right in the mouth.

And that some of them were seeing at Victoria Delgado's birthday party, which is very close to where Jose Diaz died, right? He died out on the street nearby. So many of the kids were hopeful justice would be served when the jury came back.
Starting point is 00:25:55 They're like, well, there is literally nothing that we actually did. They can prove that we did. Being there is not a crime. Joe Carpio, Richard Gestellum, Edward Grandprey. Grand Prix. It's great. Eddie Grand Prix. Ruben Peña, Daniel Vordugo were found not guilty.
Starting point is 00:26:19 Okay. One, two, three, four, five. So did they go with the lump prosecution? Yes. Oh, so the, okay. But so they were individually. Yeah. And then, yeah, they did the lump prosecution.
Starting point is 00:26:32 But then, yeah, but then they can't convict them as a lump. Right. They have to convict. How do you find the lump? Well, why didn't. know we were lumping. Guilty. Most of the lump did it, Your Honor.
Starting point is 00:26:46 Your Honor, we actually can't tell the difference. They all look the same. Your Honor, it's been very tough as a jury. We are so racist. We don't know who's who. You know? So the rest are not as lucky. Henry Levas, Jose Ruiz, and Robert Tellis were found guilty of murder.
Starting point is 00:27:10 in the first degree with two counts of assault with a deadly weapon with intent to commit murder. How the fuck are you doing that when you don't have the murder weapon? Or anybody connects them to the actual first degree. Yeah, there's nothing, there's no physical evidence connecting them to the body. We believe it was a manslaughter, but we hate Mexicans. Manuel Delgado, Johnny Matus, Jack Melendez, Angel Padilla, Yisemil Parra, Emmanuel Reyes, Bobby Thompson, and Henry, what's Bobby Thompson? Your Honor.

Starting point is 00:29:05 a little lost in the game. I know you. You went off on a place that nobody cares about. So they're all convicted of second degree murder and two counts of assault with a deadly weapon with intent to commit murder. All of them. The other ones. So that's one, two, three, four, five, six, seven, eight, nine. So they believe it was a gang stabbing with two holes and no murder weapon.
Starting point is 00:29:29 And then right now we've got 14 guys convicted. and again, what's the difference between... How are you picking the six who aren't there or eight who aren't? The sex is really good. one evening around dusk a police sergeant who was moonlining as a security guard at a Venice dance hall eaves dropped on some white high school kids in front of the venue are you a cop no a moonlight now it's a Mexican-American dance venue okay he heard them say quote it's talked the zootsuiters have taken over the beach front hey did you guys hear the zoot suitors are parachuting in they're storming the beaches of venice seriously what is it Normandy like what are you talking about what the fuck are you doing? Bam-ba-dam, bam, bam, bam.
Starting point is 01:02:04 And we're going to straighten things out. Someone got them wet, and now little Zooters are popping off them like Remlins. Right then some sailors came in in a whipped-up frenzy shouting that a sailor had been stabbed inside the dance hall. Let's get to Zooters, they urged the high school boys. Now, the sergeant slash security guard tried to cool things down, telling the kids that everything's under control, at least inside the dance hall. happening. He said the troublemakers
Starting point is 01:02:30 have been kept out, so no sailor was stabbed inside. But nobody listened or cared, what he had to say. They had made up their minds. As one eyewitness later said, quote, they didn't care whether the Mexicans were zootsuits or not. And for that matter, most of the kids dancing
Starting point is 01:02:46 were not. They just wanted Mexicans. So now we can't even identify clothing? Well, race alludes us, but now clothing is... Well, now they're moving. on as expected from clothing to, oh, just
Starting point is 01:03:02 Mexicans. Clothing to full skin. As this is always about. Yes. Yeah. It's evolving. When the dance ended and the Mexican-American teenagers began to exit, a crowd of 500 sailors and
Starting point is 01:03:19 white civilians began to chase them down the boardwalk, yelling, quote... We heard you killed Jesus. Yelling, quote, let's get them. Let's get the chili eating bastards. Okay, first of all, fellas, we need to talk about Mexican food.
Starting point is 01:03:36 Yeah, this is the problem. Chili is not actually largely associated with... Well, then that guy heard that, and he was like, I'll open a Mexican restaurant called Chili's. Oh, shit, good move. That'll show you. Touche. I've been thinking about doing a trip this August to properly explore Quebec.
Starting point is 01:04:00 City. Talking about wandering the cobblestone streets of the old city, grabbing a fresh-baked croissant before anyone else is awake, then wandering over to Marce des Vue Port, where locals grab maple butter and fresh cheese right by the train station. Starting point is 01:05:09 The mob shatters they ran past bingo parlors and concessions stands. You know those Mexicans with their pizza pies. Disgusting. And their hamburgers. Oh, I've seen the other one making a falafel the other day. When the police responded, finally responded to a radio call about what was happening of Venice, they pulled up to an eerie sight. So because of the war, the pier, along with the rest of the coastline, is totally blacked out.
Starting point is 01:05:37 Because before they could even turn off the engine, a young Mexican-looking guy sprints up to the car and, you know, feverishly asks if they're policemen. And the cops said yes. And the young man yells that there was a big fight happening at the end of the pier. So instead of going to the dance hole, the cops follow the kid. and as soon as a lassie As soon as the cops Walked 10 feet Toward the pier
Starting point is 01:06:06 They found themselves Invelled in a quote Moustrom of brass knuckled fists And flailing blackjacks It was a trap Oh shit About a You son of a bitch

Starting point is 01:06:59 One of the cops was knocked to his knees by a blow to his left eye. As he staggered about the pier trying to stand up, his eye filled with blood. He was again struck on the face with a blow that drove his front teeth through his upper lip. Yeesh. The youth continued to... The youth continued to pound the struggling policeman who lay virtually prostrate on the ground several more times on his back with lead pipes. His partner was shoved against... Dave, I'm going to call it.
Starting point is 01:07:25 This is not going to be good. his partner was shoved against the rail of the pier and drew his weapon to avoid being pushed over it amazingly the young men involved somehow managed to escape arrest oh dear one LAPD officer admitted that if there were to be any more conflicts between sailors and zootsuiters then the only plan of action the cops would have
Starting point is 01:07:49 was to arrest Mexican kids even if they were the victims quote I'm pretty shocked this one on record quote our actions were limited by what the public thinks
Starting point is 01:08:04 we can't do they can do the right thing the public is public is they want their they want their Mexicans in cages what are we going to do not put them in cages boy when racist
Starting point is 01:08:19 the will of the people really will take over and and by by public, he's just talking about the well-off whites. Yeah, right. The paranoid whites. The rich whites.

Starting point is 01:09:27 facility were fed up with being treated like shit. Yeah. So it's like it's like when the L.A., when the Rodney King riots happened, like there were a few trap set up for cops. Yeah.
Starting point is 01:09:40 Yeah, I guess what have, I guess these are cussions and you'd call them repercussion. I don't know. I mean, these things are going to happen. Stop. They were done being stomped on by the cops, but especially by the sailors who infested their neighborhood.
Starting point is 01:09:59 On the night of Monday, May 31st, 1943, at around 8 p.m., 12 or so sailors and soldiers ambled down Main Street. Once they hit Chinatown, they spotted a group of sexy ladies across the sidewalk. The women probably hamming it up by giggling and batting their eyelashes at the boys, beckoned them to cross the street and we're all too happy to strut over except for one sailor who kept moving for some reason. We don't know why. But one guy just was like, maybe too drunk or
Starting point is 01:10:32 gay, maybe very gay. Or maybe just like seems like a trap. Yeah, seems like a trap. Hey, come out over here. Hi, boy. Nobody wants to fuck sailors this bad. But that guy crossed paths with a group of suits suited dudes. That guy's the bad guy. That guy's an idiot. He's alone. Yeah, he's an idiot.
Starting point is 01:10:49 sensing something was wrong he grabbed one of the boys by the arm aggressively now that was not the move to make soon he was knocked unconscious his face slammed down on the pavement breaking his jaw in two places just then on the street and where else seemingly out of nowhere a mess of zoots suited kids poured out from all directions pouncing on the unwilling unwitting military boys. So, yeah, so it was a trap. Quote, swinging rocks and bottles with fists and feet with fury. The military guys managed to crawl away from the melee and drag their passed out friend with him.
Starting point is 01:11:33 Did anyone get a phone number? Those girls seem really down to clown. He called me Cockbacher. Barry. What is known is that the sailor, the sailor made the first aggressive move, which could have instigated
Starting point is 01:11:49 the whole fucking thing. Sure. But the white boys didn't see it that way, quote, the triumph of the civilian youths would be short-lived, however, for it was ultimately, it would ultimately provide the sailors at the armory with all the justification they would need to take the law into their own hands. Every time a sailor now tells this story to his mates,
Starting point is 01:12:10 it gets bigger and further from the truth. It's not a dozen kids they fought off. It's closer to 100. They didn't have broken bottles and blackjacks. They had guns. So that following Thursday, a whole group of sailors strolled into town with one thing on their minds, fighting every single Mexican teenager they laid their eyes on. And this was the first night of the Zoot Suit Riots. End of part two.
