Starting point is 00:00:00 Donald Trump is, I think, I think he has a humiliation kink because he has been humiliated so many times in the national stage. And today is no different. James Comey and Tish James had their prosecutions ruled unlawful by a judge today. Here's some insight on that. Now, before we get to the end, I just want to let you know that we also have James Comey, who's respond to this. I have Caroline Levitt, who is crawling away from it. of Tish James responding to it, and Donald Trump is in hiding during all of this. First, here's just a little bit of what happened in case you don't know.
Starting point is 00:00:38 A federal judge dismissed the criminal cases against former FBI director James Comey and Tish James on Monday delivering an emphatic blow to President Donald Trump's rush efforts to engineer prosecutions of two of his prominent foes. And, interestingly, the U.S. District judge ruled that in Lindsey Halligan, the prosecutor You're overseeing both these cases have been unlawfully appointed as interim U.S. attorney of the Eastern District of Virginia and therefore indictments. She's single-handedly secured against Comey and James must be thrown out. Now, interestingly, it was dismissed without prejudice, which means that it could be brought
Starting point is 00:01:15 up to court again. Only there's one problem. I don't think they can bring this case up again, and I'm going to show you why. Here's Bradley Moss on CNN explaining it. Bondi's saying she was also appointing Lindsay Halligan to another role and that would rectify things. It doesn't work that way. I know that's the way Trump and his acolytes prefer things work. They just paper over everything. Now, we still, at least for the moment, do have laws, do have processes, and they simply didn't follow them. And that's why
Starting point is 00:01:39 this got tossed. Bradley, I wonder, given the very public desire from the administration to pursue charges against James Comey and Letitia James, is it likely that we will see DOJ potentially replace Halligan or find another way to try to to make the argument potentially appeal this to refile these charges? Sure. So there's a couple different options here and different sort of problems for each of them. One is obviously they could appeal, which is what I expect they will try to do. Not so much that they think the Fourth Circuit who would hear it would be all that amenable to the appeal, but so much as they really want to get this before the Supreme Court sort of further expand
Starting point is 00:02:20 the president's sort of unfettered discretion and his powers that they've been doing for the last year. But even if they tried to go back and refile, you'd have the issue of who could lawfully bring a new case. It would have to be someone who met either the district court appointment or someone who was confirmed by the Senate, which right now, you know, good luck to anybody trying to get through the Senate, trying to explain what they'll do differently than what Lindsay Halligan was doing. And with the Comey case, in addition, there's a statute of limitations problem they'll face. Remember, Lindsay Halligan rushed this thing within days of showing up because the statute of limitations to bring the case against Comey was going to expire in like three or four days.
Starting point is 00:02:58 And so now there'll be a whole extra legal fight of can you even bring a case anymore. So this is a mess of their own making. It's the president's, you know, personal vendetta and it's blown up in their faces on a Monday morning as we're getting ready for Thanksgiving. I love it. I love it. I'm going to have Caroline Levitt's response in just a moment. But let us just bask in the fact that Donald Trump is a failed businessman and is a failed
Starting point is 00:03:22 authoritarian. He can't even do authoritarianism correctly. Not that I'm complaining, but it feels like it should be pretty easy to just skirt the law. I guess not. Maybe for Donald Trump, he's just not able to. I mean, he did this in this stupidest way possible. He put someone in there who, I think she was like an insurance lawyer or something. She's never done this before. They rushed it. And because they rushed it, they've bungled it. And because they bungled it, they might not have been, they might not ever be able to get this thing to trial. Thank God. Now here is what Caroline Levin had to say. It knows that James Comey lied to Congress. It's as clear. Well, what I will say, well, what I will say is that everybody knows that James Comey lied to Congress. It's as clear as day. And this judge took an
Starting point is 00:04:11 unprecedented action to throw these cases out to shield James Comey and Letitia James from accountability based on a technical ruling. And the administration disagrees with that technical ruling. We believe the attorney and the technical ruling is that she was unconstitutionally put into that position. That's a little technicality. Case Lindsay Halligan is not only extremely qualified for this position, but she was in fact legally appointed. And I know the Department of Justice will be appealing this in very short order. So maybe James Comey should pump the brakes on his victory lap. White House is in crisis mode.
Starting point is 00:04:45 I can tell you that right now. Now, James Comey did respond to this. And here is what he had to say. And then I have Tiss James Commons as well. And a reflection of what the Department of Justice has become under Donald Trump, which is heartbreaking. But I was also inspired by the example of the career people who refuse to be part of this travesty. It costs some of them their jobs, which is painful. But it preserved their integrity, which is beyond price.
Starting point is 00:05:10 And I know they will serve again. I was very lucky that some of the best lawyers in America stepped forward to represent me. I hope they serve as an example to more. more and more lawyers, especially at some of the big firms, to participate in protecting our liberty, protecting the rule of law. And my family and friends were always with me, and luckily for me, include some of those great lawyers. This case mattered to me personally, obviously, but it matters most because a message has to be sent that the President of the United States cannot use the Department of Justice to target his political enemies. I don't care what your politics are.
Starting point is 00:05:53 You have to see that as fundamentally un-American and a threat to the rule of law that keeps all of us free. I know that Donald Trump will probably come after me again, and my attitude is going to be the same. I'm innocent. I am not afraid. And I believe in an independent federal judiciary, the gift from our founders that protects us from a would-be tyrant. When I was a kid, my parents would wake us up
Starting point is 00:06:20 for school every morning by snapping open the shades and saying, time to rise and shine and show the world what you're made of. Well, it's that time, America. It's time to stand up and show the fools who would frighten us, who would divide us, that were made of stronger stuff, that we believe in the rule of law,
Starting point is 00:06:43 that we believe in the importance of doing things by the law. So stand tall, shine, and keep the faith. Okay, so I'm glad that he's not being persecuted by our government. Now, he made it seem like this is a huge victory lap because, like, the judge sided with the fact that this was a political persecution. That's not what happened. It was out of technicality.
Starting point is 00:07:08 So I think the messaging's off there. Two, is anyone else watching that thinking of yourselves how he was so, like, this is all because he fucking was not independent around the email shit. and he had for some reason wanted to put himself in the middle of a presidential election in 2016. Anyone, I was watching this kind of getting pissed off. I'm glad our government is not going after him, but I can't help but feel like this is all because of you. This is all because of you. All right, Tish James kept it short and sweet, which I appreciate. She said, I am heartened by today's victory and grateful for the prayers
Starting point is 00:07:46 and support I have received from around the country. I remained fearless in the face of these baseless charges as I continue fighting for New Yorkers every single day. And Donald Trump for his part is just nowhere to be fine. Now, he was supposed to do an event today where he's supposed to release a health care plan that didn't come out.
