Starting point is 00:00:00 Good morning, everyone. I'm Megan Kelly. It's Tuesday, October 28th, 2025, and this is your AM update. A Minnesota resident arrested after allegedly offering a $45,000 bounty on social media, calling for the death of Attorney General Pam Bondi. The defendant's request to appear in civilian clothing for all pretrial proceedings is granted. The judge overseeing the accused Charlie Kirkassassassin Tyler Robinson's case, rules on motions related to the defendant's court appearance, as well as some rules for media coverage. Hurricane Melissa officially swelling to the most powerful storm of 2025, just prior to slamming Jamaica. One theory on how you might try to serve a third term is that you could run as the vice president. And President Trump triggering the media yet again in response to his plans for 2028.

A Minnesota resident arrested earlier this month for allegedly posting a $45,000 bounty on TikTok calling for the death of Attorney General Pam Bondi, according to an FBI affidavit. Authorities taking Tyler Maxen Avalos into custody on October 16th after a post from an account he allegedly controls was reported to the FBI. The post features a picture of A.G. Bondi with a sniper scope red dot laid over her forehead and a caption reading, quote, wanted, Pam Bondi, reward, 45,000 dead or alive, preferably dead. The profile bio containing they, them, theirs, pronouns, and reading, quote, make John Brown proud. Brown was a pre-Civil War abolitionist who
Starting point is 00:02:33 believed slavery in the U.S. could only be ended through violent uprising. Avalos' profile also containing multiple symbols of the letter A with a circle around it, commonly associated with an anarchy, the page also linking to an anarchist FAQ book. More from the affidavit, quote, Avalos has a multi-state conviction history, including a July 22, felony stalking conviction from Dakota County, an August 2016 felony third-degree domestic battery from Polk County, Florida, and an April 2016 misdemeanor domestic assault from Dakota County, which appears to have been reduced from a felony domestic assault by strangulation charge. Last Wednesday, Avalos, who is believed to be 29 or 30 years old,
Starting point is 00:03:20 released from custody on personal recognizance, meaning no bond, but he must follow a certain set of restrictions, including staying within Minnesota, continuing mental health treatment, no alcohol or drug use, and subject to random drug testing, no computer or internet access without approval, and GPS monitoring. Avalos has not been formally indicted. He was arrested on a charge of interstate transmission of a threat to injure another person. His attorney, Daniel Gertz, tells AM Update, quote, no date is set for the next court hearing because he has not yet been indicted. He was arrested on the basis of a criminal complaint. In federal court, the Fifth Amendment requires an indictment to go forward. He is not guilty of any crime, however, so we will wait and see.
Starting point is 00:04:08 The judge overseeing defendant Tyler Robinson's case ruling yesterday on whether the 22-year-old accused of assassinating Charlie Kirk will be allowed to appear unrestrained and in civilian attire in future court appearances. Judge Tony Graff holding the hearing virtually, Robinson speaking only once off camera, confirming he was able to hear the proceedings. Robinson originally set to appear in court for the first time this Thursday, that hearing postponed, allowing more time to complete discovery and file additional motions relating to whether certain hearings should be conducted virtually and issues relating to restrictions on media coverage. Judge Graff issuing a decision on a motion filed earlier this month by the defendant's
Starting point is 00:04:52 legal team regarding his court apparel. Mr. Robinson sits before this court presumed innocent, and that presumption remains unless and until each element of every offense charged against him is proved beyond a reasonable doubt. To date, this has not occurred, and the presumption of innocence remains. Balancing these factors, the court finds that Mr. Robinson's right to the presumption of innocence outweighs the minimal inconvenience of permitting civilian attire, and Mr. Robinson shall be dressed as one who has presumed innocent. Accordingly, the defendant's request to appear in civilian clothing for all pretrial proceedings is granted. The defendant's counsel ordered to provide civilian apparel 72 hours before any upcoming hearings. Judge Graff denying
Starting point is 00:05:42 the defense's request for the defendant to appear without physical restrictions. To the Second request, request to appear without physical restraints. Mr. Robinson also request to appear unrestrained during pretrial proceedings. He argues that visible restraints would prejudice potential jurors, undermine his dignity, and interfere with his ability to communicate with counsel. The court recognizes that Mr. Robinson has no criminal history and no record of misconduct while in custody. However, the charges he faces are extraordinarily serious. carrying potential penalties of life imprisonment or death. The safety of Mr. Robinson, the attorneys, court staff, and the public must remain
Starting point is 00:06:28 the court's highest priority. The emotional nature of these proceedings also raise the risk of disruption. Judge Graff, directing the Sheriff's Department to, quote, use the least restrictive restraints necessary to maintain safety. Media will be prohibited from capturing images of the defendant entering, exiting, or standing in court when his shackles will be visible. Judge Graff directing both sides to file a joint motion in the event they wish to restrict electronic media coverage any further. The defendant is charged with one count of aggravated murder, felony discharge of a firearm, obstruction of justice,
Starting point is 00:07:04 two counts of witness tampering, and commission of a violent offense in front of a child. Prosecutors will seek the death penalty. The next two pretrial hearings set for January 16th and 30th at 1 p.m. The defendant is set to appear in person. Hurricane Melissa officially reaching category five strength on Sunday night by Monday afternoon rising to the strongest storm of 2025, the worst Jamaica has ever seen, with sustained winds of 175 miles per hour and even stronger gusts. Only nine Atlantic hurricanes on record have been stronger than Melissa, according to CNN. As of Monday afternoon, Melissa pivoting north toward Jamaica, already responsible for six deaths across the Caribbean. Three in Haiti, one in the Dominican Republic, and two in Jamaica. The Jamaicans killed while cutting trees in preparation for the hurricane. A national oceanic and atmospheric administration, or NOAA, aircraft, forced to abandon
Starting point is 00:09:36 its mission, which included flying into the storm to collect data on Monday morning due to extreme turbulence. The colossal storm making landfall in Jamaica late last night, analysts anticipating it could be the strongest direct landfall since the beginning of record-keeping. In advance, authorities ordering mass evacuations, opening more than 800 shelters, closing both international airports. The AP reporting some residents insisting upon staying in their home. Holmes, Bruce Dawkins holding a beer and wearing a raincoat saying, quote, I'm not going anywhere, telling the reporter he intends to ride out the storm with a friend. The National Hurricane Center warning Monday, quote, do not venture out of your safe shelter. Catastrophic and life-threatening
Starting point is 00:10:22 flash flooding and numerous landslides are likely today through Tuesday. The slow-moving storm crawling at roughly three miles per hour, expected to drop 30 to 40 inches of rain, unleash destructive winds and push a storm surge of up to 15 feet along Jamaica's southern coast, according to ACUweather. Officials predicting catastrophic flooding, landslides, and power outages. Here, Jamaican Prime Minister Andrew Holness. No one can say that the government was not forward-leaning in giving the information to persons who are in areas of risk. You have been warned. So it's now up to you. to use that information to make the right decisions.
Starting point is 00:11:08 This is an unusual system. Normally, a hurricane, you focus on two things, wind and rain, because it happens very quickly. No, we have to focus on three things. It's wind, rain, and the length of time it will probably linger over the country. Whilst we understand wind and rain and what it can do, but if it stays for a very long time, you're not just dealing with saturation,
Starting point is 00:11:31 you're dealing with a higher level of destruction, a higher probability of landslides, a higher probability of flooding, even in areas where flooding would not have taken place. So we have to bear that in mind and be prepared. The U.S. State Department pre-positioning supplies in six warehouses to deliver emergency relief to those impacted, Accuweather Chief Meteorologist Jonathan Porter, telling the AP, quote,
Starting point is 00:11:57 this can become a true humanitarian crisis very quickly, and there is likely going to be the need for a lot of international support. Melissa is expected to move into Cuba by tomorrow morning, hitting portions of the Bahamas as well. Forecasters predicting the storm will indirectly impact the United States as well. According to the Washington Post, its moisture is expected to fuel another storm that could douse the East Coast from the mid-Atlantic up to New England. President Trump weighing in again on the possibility of running for a third term in office as he swings through a diplomatic tour of Asia. The latest round of speculation prompted by recent comments made by Trump advisor, Steve Bannon, to the economist.
Starting point is 00:12:42 Well, he's going to get a third term. So Trump 28, Trump is going to be president in 28, and people just ought to get accommodated with that. So what about the 22nd Amendment? There's many different alternatives. At the appropriate time, we'll lay out what the plan is. But there's a plan, and President Trump will be the president in 28. We need him for at least one more term, right? And he'll get that in 28. Mr. Trump in recent months, trolling the media and Democrats, passing out Trump, 2028 hats.
Starting point is 00:13:10 The 22nd Amendment provides that, quote, no person shall be elected to the office of the president more than twice, end quote. One commonly floated theory suggests Mr. Trump could run as a vice presidential candidate, then the president would step aside, allowing him to ascend. to the top job. That scenario would also likely run into legal roadblocks, as the Constitution specifically states, quote, no person constitutionally ineligible to the office of president shall be eligible to that of vice president. Regardless, the president on Monday firmly ruling out that option. One theory on how you might try to serve a third term is that you could run as the
Starting point is 00:13:52 vice president. Yeah, I'd be allowed to do that. Is it the White House or the White House's counsels your legal of position, I guess. He'd be allowed to do that, but I wouldn't do that. I think it's too cute. Yeah, I wouldn't rule that out because it's too cute. I think the people wouldn't like that. It's too cute. It's not, it wouldn't be right. Asked whether he would be willing to go to court to challenge the two-term limitation, Mr. Trump replying that he hasn't really thought about it, then touting the political strength of his possible successors in his administration. We have some very good people, as you know.
Starting point is 00:14:25 You are the very good people. You said that for 2028, there are very good people who do you have in mind? Well, we have great people. I don't have to get into that, but we have one of them standing right here. We have JD, obviously. The vice president is great. And Marco's great. I think I'm not sure if anybody would run against us.
Starting point is 00:14:44 I think if they have a formed a group, it would be unstoppable. I really do. I believe that. I would love to do it. I have my best numbers ever. It's very terrible. I have my best numbers. So you're not ruling out on their term? Am I not ruling it out? You'll have to tell me. All I can tell you is that we have a great group of people, which they don't.
Starting point is 00:15:07 Out of that full comment, some outlets cherry picking that one line, quote, I would love to. MSNBC, quote, Trump renews talk about seeking a third term, colon, I would love to do it. Axios, quote, Trump again declines to rule out. unconstitutional third term.
