This is Big Folks.
We are learning that in last week's order by federal judge Beryl Howell,
compelling Donald Trump's lawyers, Evan Corcoran and Jennifer Little,
to testify again before the criminal grand jury, the federal judge Beryl Howell found that the Department of Justice made
a showing that Donald Trump had indeed committed criminal violations. And specifically, a finding
was made that prosecutors and special counsel Jack Smith's office presented compelling preliminary
evidence that Donald Trump knowingly and deliberately misled his own attorneys about his retention
of classified materials after leaving office. And based on that finding, Judge Beryl Howell
found that the crime fraud exception applied to the attorney-client privilege claims that were
being made by Evan Corcoran and Jennifer Little, attorneys to Donald Trump
who were involved in Donald Trump's concealment, mutilation, destruction of thousands of government
records, which he kept at Mar-a-Lago and lied to the Department of Justice that he had returned
all of the documents back to the government back in 2022. You will recall that Evan Corcoran
was one of the lawyers who worked with Christina Bob, and they prepared and drafted an attestation,
basically a declaration to the Department of Justice on June 3rd of 2022. They put in a
red-weld folder about 38 top-secret classified records, returned those to the
Department of Justice, and then had Christina Bobb sign this attestation saying that this is all the
documents, everything has been returned, and that there were no other documents at Mar-a-Lago.
That turned out to be a lie. It also turned out to be a lie that the attestation said that a
diligent search was done of Mar-a-Lago. It appears no diligent search was done and simply Donald
Trump had lied to Corcoran and Bob and Jennifer Little and others saying that all of the documents
were returned when they were not returned at all. One of the things that Judge Beryl Howell put in her order that we're now learning about
from this blockbuster ABC News report is that the criminal scheme that Donald Trump engaged
in actually began with the dress rehearsal.
And that's terminology that we're learning that Judge Beryl Howell may have actually
used in her order. The dress rehearsal was how Donald Trump was lying to the National Archives
after he left the White House in 2021. And after he left, he continued to say all of the documents
were turned over. Then in January of 2022, he turned over 15 boxes, and in between the newspaper clippings, there
was classified information and sensitive compartmented information that was kind of
hidden and concealed within these newspaper articles and other clippings.
That led to the Department of Justice referral, and then a constant stream of lies by Donald
Trump to his lawyers so that his lawyers would then make false representations
to the Department of Justice. And again, Judge Beryl Howell, the federal judge,
basically described what had took place in this order, which, by the way, still remains under
seal. Judge Beryl Howell called it a criminal scheme that was taking place. Judge Beryl Howell called it a criminal scheme that was taking place.
Judge Beryl Howell found that the prosecutor showed sufficient evidence that Trump intentionally
concealed the existence of additional classified documents from Evan Corker and Jennifer Little
and these other lawyers. Donald Trump's team responded to an inquiry from
ABC News about it and responded as Bush League and amateurish and traitorous and weird as you'd
expect them to do. This is what the Trump team responded to this blockbuster report.
Shame on fake news ABC for broadcasting illegally leaked, and that's all in caps,
false allegations from a never Trump now former chief judge against the Trump legal team.
The real story here is that Fake News ABC should be reporting on that prosecutors only attack
lawyers when they have no case whatsoever.
The fact that that statement makes no sense whatsoever is beside the point. Judge Beryl
Howell completed her term. It is a rotating term for who is the chief judge of the federal court
in Washington, D.C. A new judge has taken over just based on the term limits that are set for
that position. But notice, too, that everybody, every single judge in the world, when you actually
have to deal in a world of evidence, is a never-Trumper, is a rhino. They call them uniparty
Republican rhinos or whatever ridiculous phrase the MAGA Republican cult is coming up to.
Just look at the various cases going on right now, right? I mean, when you want to talk about,
let's talk about the judge in New York Attorney General Letitia James case, for example.
The judge there, Arthur Ngoran, someone who Trump has criticized as a never Trumper who slammed him as someone who
Donald Trump said is, you know, again, a, a democratic operative out to get Donald Trump.
Um, and you know, that's what he said about Arthur and Goran. You go to Robert McBurney,
uh, the superior court judge in Fulton County, Georgia. Donald Trump just filed a motion to try to disqualify
Robert McBurney and attacked McBurney in a motion that was filed just the other day,
a completely frivolous motion there. Here attacking the chief judge of the federal court
in Washington, D.C. as a never-Trumper. I mean, he would go to prosecutors attacking Alvin Bragg as George Soros funded.
I mean, it's so predictable and amateurish what Donald Trump does when he attacks all
of these people.
And it just looks utterly, utterly and completely ridiculous.
But here's what we know and notice from Donald Trump's statement.
He's not denying that that was a finding that was actually
made by a judge in an order on Friday. So it still remains under seal. That means this reporting is
coming from a source who has knowledge of what the order is. That could be a DOJ source. It could be
a source in Donald Trump's camp. Heck, it could potentially even be, and I think this is most
likely where it came from, although I have no knowledge of this, a source related to Evan
Corcoran, Jennifer Little, or Christina Bob, because it actually seems like who would want
to get this information out right now, especially where the Department of Justice and Jack Smith
have always been very closed lip. They've never, they think they don't leak at all. It would seem to be Trump's lawyers
wanting the world to know that Donald Trump lied to them. And that is why they are being
compelled to testify again, not because they are the ones who lied. So we see here also
what appears to be taking shape is Donald Trump's
lawyers basically saying Donald Trump lied to us. They're not taking the fall for Donald Trump
because if they wanted to take the fall for Donald Trump, they could basically say, yeah,
we conducted a diligent search. We found that there was no documents. We certified what we did. This is why Jack Smith's stick-to-itiveness and his aggressiveness is so important, folks.
And when people want this process to be sped up, trust me, I want it to be sped up too.
But you want this to be handled diligently for these exact reasons by forcing the attorneys to provide their reasoning and rationale why they
did certain things versus rushing into it. The lawyers have now had to basically make a decision.
Are they going to fall with Donald Trump or are they going to say Donald Trump gave us
incorrect information? And it seems what took place here is that the lawyers are saying, hey,
Donald Trump told us that he had returned all the classified records.
That's why we were making those representations to the Department of Justice.
That's why we were signing attestations, because Donald Trump told us.
So they're leaving Donald Trump out to dry, which is, I think, a very significant development
here.
And look, we know that Evan Corcoran and
Jennifer Little were compelled to testify. They have to show up again for further testimony.
We also know that Donald Trump is appealing that ruling to the D.C. Circuit Court of Appeals,
arguing that the crime fraud exception should not apply, that attorney-client privilege should not
have been pierced, and that those communications where Trump was using the privilege of confidential
attorney-client communications to commit crimes should be kept confidential when indeed the crime
fraud exception says, look, if the attorney services are being utilized to commit crimes
and those communications are in furtherance of those crimes, if those two steps are met,
you can't claim the attorney client privilege shields communications. You can't claim that
confidentiality between you and an attorney if you're using those services to commit crimes, in this case,
obstruction of justice, as you normally would able to assert attorney-client privilege.
We know there are six categories of information that Evan Corcoran, Trump's lawyer, tried to
claim as attorney-client privilege, which here, Judge Beryl Howell said that Trump could ask
questions on. Similarly, we know Jennifer Little,
one of Donald Trump's other lawyers, who is less well known, but also was involved in this.
There was one category of attorney client information, which she was allowed to maintain,
but the others she had to testify to as well. So what does this all boil down to, folks?
The walls are really closing in on Donald
Trump. Now where you've got Trump's lawyers being compelled to testify, they're turning on Donald
Trump. They're saying, we didn't intend to lie to the DOJ. Don't prosecute us. We didn't know.
We were basing it on what Donald Trump said. The one thing about Corcoran and Christina Bob, though,
were even turning on Donald Trump may not make the biggest difference here is the fact that they
still claim they did a diligent search of Mar-a-Lago. They obviously did not do a diligent
search of Mar-a-Lago when they asserted that in the attestation on June 3rd of 2022, because on August 8th of 2022, when the Department of Justice
executed a search warrant after a probable cause determination was made by the magistrate judge,
by the way, somebody who Trump attacked as well, that magistrate judge, you see the theme here?
They found thousands of records, including at least 100 top-secret classified and sensitive
compartmented information as well.
