The jury in the E Jean Carroll federal trial has returned a verdict after three hours of deliberation,
and they have found Donald Trump liable of sexually abusing E. Jean Carroll.
The jury also returned a verdict finding Donald Trump liable of defamation of character with malice awarding E. Jean Carroll damages with respect to Donald Trump's defamation of character. A major victory for E. Jean Carroll and the jury only took
three hours of deliberation to return this verdict. I want to show you the verdict form
right now that was used and the first question was whether Donald Trump had raped Ms. Carroll. And for that
answer, the jury wrote no. And I'll explain why in a minute. But number two, the question was,
did Mr. Trump sexually abuse Ms. Carroll? And to that, they answered yes. Number three was,
did Mr. Trump forcibly touch Ms. Carroll? And to that one, they answered yes. And the question of, was Ms. Carroll injured as a result of Mr.. Jean Carroll? They answered yes. Was it done with
actual malice? They answered yes. Was she damaged? They answered yes. So the total damage award
to E. Jean Carroll is $5 million. Yes. So the jury found Donald Trump liable on both of the major claims, the sexual abuse and the defamation, awarding E. Jean Carroll a total of $5 million.
Regarding the first question, there is a technical definition and the jury had to find by a preponderance of evidence whether or not what took place constitutes a legal definition.
And ultimately, the jury made the finding that what took place by a preponderance of evidence satisfied the threshold of sexual abuse and awarded E. Jean Carroll damages there.
So Donald Trump, of course, did not show up to trial. He was deposed
in this action. His deposition was played for the jury. Donald Trump, while this trial was
taking place, he fled to Scotland and Ireland where, like the coward he is, made up some excuse about why he wasn't going
to be there at his own civil trial. Unlike criminal cases, in a civil case, you don't
actually have to show up to the trial. But nonetheless, a party can point out that another
party didn't show up. And that's precisely what E. Gene Carroll's lawyers did
in their closing argument. They said to the jury that Donald Trump did not even have the respect
and dignity to show up and to look you in the eyes and claim that he did not do it because,
of course, he did do it. And the jury also was told by E. Jean Carroll's lawyers,
for you to find in favor of Donald Trump, you will have to find that somebody who lies about
every single thing his entire life is the only person who is telling the truth in these proceedings. You would have to believe that not only E. Jean
Carroll, but the two contemporaneous witnesses who testified, who were told on or around 1996
when E. Jean Carroll left the Bergdorf government, when E. Jean Carroll left, what took place,
you'd have to believe that those individuals were lying. You'd have to believe that the other victims who also experienced the same.
And testify that in the semi public spaces that Donald Trump engaged
in this conduct against them, you'd have to believe that they were lying
and that you'd have to believe that Donald Trump is the only person
telling you the truth here, but he's lied consistently and he hasn't even been here at this trial.
You saw his deposition testimony and during his deposition where he was shown a photograph of E. Jean Carroll from several decades ago where he thought that E. Jean Carroll was Marla Maples, his second wife. And then when he
was told by his lawyer, no, no, no, he was coached. He was told that is E. Jean Carroll. He said, oh,
I can't tell. The photo is blurry. And E. Jean Carroll's lawyers pointed out to the jury,
the photo's not blurry. That's just him lying and lying and lying like he always does and like he's done consistently here.
And he didn't even have the courage to show up.
And Donald Trump claimed he was going to show up and testify.
The judge gave him every ability to do so.
Even after Donald Trump's lawyer put on the record that Donald Trump waived his rights to
testify. Donald Trump still was given the opportunity by Judge Lewis Kaplan to show up
and to testify. The deadline passed there and Donald Trump did not respond to the court's
deadline. And so just more lies by Donald Trump when he was lying to the press and saying
that he was going to show up. So this is a civil case. It's not a criminal case. In a civil case,
the standard is preponderance of evidence. In a criminal case, the standard is beyond a reasonable doubt. So here, the jury had to be a unanimous jury. It had to be
9-0, meaning all of the jurors who heard all of the evidence all agreed that Donald Trump committed
the sexual abuse with respect to E. Jean Carroll and defamed E. Jean Carroll and all of them agreed to the damages
award of five million dollars meeting that preponderance of evidence standard. Will Donald
Trump appeal? Of course he will appeal but it will just be more delay delay. He doesn't have any solid grounds for an appeal. This went to a jury. The jury heard all
of the evidence. Donald Trump did not even show up at the trial. Donald Trump's lawyers did not
even put forward any witnesses, not a scintilla of evidence that they put up. And ultimately,
E. Jean Carroll's lawyers told the jury, this is about evidence.
This is about facts. And while Donald Trump and his lawyer, Joe Takapina, want to argue and try
to deflect and distract, focus on the facts, focus on the evidence. That's what matters in the court
of law. So ultimately though, if Donald Trump files an appeal, what's
going to happen? Ultimately it would go to the second circuit court of appeals, which oversees
the Southern district of New York. But again, I have very, very, very little, I'm completely
confident. Let's just say that Donald Trump is not going to prevail on an appeal right here.
Nonetheless, he will file one.
But E. Jean Carroll left the courthouse.
She was, you know, all smiles, very happy with her legal team.
What incredible courage, what incredible strength, what incredible resilience she showed as Donald Trump threw the entire
kitchen sink of his MAGA Republican fascist tactics at her, tried to intimidate her,
tried to threaten her as recently as right before the jury verdict, trying to constantly,
constantly engage in that stochastic terrorism to try to destroy her life. Exactly why
she feared coming forward in the first place. But what an incredible example she has set for all
Americans and what a microcosm of who Donald Trump is. A complete and total coward, doesn't even show
up, disgusting individual who engages in heinous conduct and then doesn't even show up, disgusting individual who engages in heinous conduct and then
doesn't even show up and basically throws his own legal team under the bus with the lies that he
makes saying he's going to show back up and doesn't. This is a statement that Donald Trump
just put out on his social media platform after losing this case. Let me read it for you now. He writes,
I have absolutely no idea who this woman is. The verdict is a disgrace, a continuation of the
greatest witch hunt of all time, he writes. So again, just spreading more and more disinformation,
but this likely could constitute another claim of defamation that E. Jean Carroll
could bring against Donald Trump. And let's not forget also that there still is another defamation
case that E. Jean Carroll has against Donald Trump. This case that was in federal court
involves the defamatory statements Donald Trump made in October 2022 and claims that were now permitted
under the Adult Survivors Act, where individuals who are victims of sexual abuse and sexual assault
can break claims in New York state if the statute of limitations expired for a period of one year.
But E. Jean Carroll also sued Donald Trump for the statements that he made in 2019 while he was in office. That worked
its way up through the various courts of appeals, Second Circuit, then ultimately a court of appeal
in Washington, D.C., one of the highest courts there. And ultimately, that case is permitted to
go to trial also. So we will see what happens with that case but eugene carroll still has
another case for defamation against donald trump that she can bring um as well as based on donald
trump's recent defamatory statements the one i just read for you right now and he made more
statements about eugene carroll while he was in scotland and Ireland, she has potential claims there. So again, because this is a civil case and a civil verdict, it involves monetary damages.
It doesn't involve jail time.
It's not about prison.
That's what Special Counsel Jack Smith is focused on regarding Donald Trump's election
interference and Donald Trump's theft of thousands of government records and obstruction of justice.
That's what the Fulton County District Attorney, Fawnie Willis, is focused on. That's what the
Manhattan District Attorney, Alvin Bragg, is focused on. This is a civil case. But again,
it shows that Donald Trump, when you actually stand up to this, frankly, just disgusting human
being, when you stand up to him and you bring
him to court in a place where evidence matters, Donald Trump is not the Teflon Don and he
consistently and continuously loses. The same way he lost in the Manhattan District Attorney's case
against the Trump Organization where in under nine hours of deliberation,
that was a criminal case, they found the Trump organization guilty of 17 felony counts. Here in a civil case in federal court, less than three hours of deliberation,
Donald Trump found liable on both counts, on the sexual abuse as well as the defamation case. So folks, a big day for justice, a big victory for
E. Jean Carroll, a big victory for the truth. I'm honored to be able to report this after all the
