I want to show you how January 6th insurrectionists who are being criminally prosecuted are trying to use in court filings the assistance of Donald Trump and the MAGA Republican Speaker of the House, MAGA Mike Johnson, and their efforts to release 40,000 hours of Capitol surveillance footage and footage that, if released, would cause potential national security risks because it potentially details the safety and security protocols and other necessary ways to protect members of Congress, House of Representatives, members of the United

States Senate. Let's go over this court filing here of Michael John Dillon. Before doing that, though, again, I want to show you this other clip right here. This is Donald Trump bragging to Sean Hannity that he makes music with the January 6th insurrectionists, as Donald Trump says. It's Donald Trump and the Jay Sixers. And he says that his songs with the January 6th insurrectionists, and this just isn't true. It's not a lie. He says, does better than Taylor Swift. Here, listen to this.

By the way, that's sort of like- Are you really beating Taylor Swift, by the way? Yeah, I did. The J6 is beating Taylor Swift. It's Donald Trump and the J6 prisoners on iTunes and on Amazon and on Billboard, which is the big deal. Number one, Donald Trump. So now I feel like Elvis because now we've done The Apprentice. That was a great success.

We did. Now I've done now I've done a recording or whatever you call it. But no, it was number one. And you know what that is? That's a tribute to the fact that people feel the J6 people have been very unfairly treated. Okay, now back to this court filing right here by Michael John Dillon. Michael John Dillon has been charged by the Department of Justice with a complaint being filed February 7th of 2023.

You see some photos of Michael John Dillon right there and there. Those are the photos of him right there. He's been charged with entering and remaining in a restricted building or grounds, disorderly or disruptive conduct, disorderly conduct in the Capitol building, parading, demonstrating, or picketing in the Capitol building. And one of the filings that was just made by Michael John Dillon was to remove the standard protective order that was issued in the criminal prosecution. This is a standard protective order that has been utilized in hundreds or potentially even over a thousand of these January 6th insurrection cases that are being prosecuted by the Department of Justice. And the Department of Justice explains that

what Michael John Dillon, this January 6th insurrectionist, is arguing here is because MAGA Mike Johnson has stated that he wants to release these 40,000 hours of Capitol surveillance footage, that that should serve as a waiver of the protective order, and that everything, including the names and identities of informants, should now be released. And what the Department of Justice responds with in this filing, government's opposition to defendant Michael John Dillon's motion to lift the protective order and orders in limine, these pretrial motions, is that one, it's not even clear why you believe that with MAGA Mike Johnson's release of these 40,000 hours, that gives you

a right to undo the protective order in your case. But setting that aside, the fact that these MAGA Republicans in Congress are engaging in this surveillance footage, in reality, Maga Mike has only released a small fraction of footage. And even Maga Mike, despite the performative PR move of claiming he's releasing these tapes recognizes a national security interest in keeping these tapes private for purposes of maintaining necessary information and classified information and other things that are important to our national security. What's interesting as you go through this motion as well in this opposition filed by the Department of Justice is a whole insurrectionist body of case law has been developed. And so other cases are being cited with these MAGA Republican machinations and chicanery. For example, there's a case where a January 6th insurrectionist tried to cite the provision of the surveillance footage to Tucker Carlson and how Tucker Carlson played it on Fox when he was there at Fox and how other insurrectionists tried to argue that that somehow creates a change of circumstances for purpose of the protective order and discovery. And there the court said, uh-uh, just because Tucker played it doesn't open the floodgates

for others to engage in this type of behavior. And the Department of Justice cites other instances like that. If you go through this opposition by the government here, it talks about how defendant Michael Dillon asked this court to quote, lift all protective orders and orders in limiting evidence and discussion of CCTV footage location. Dillon claims that the U.S. House of Representatives announcement of the release of this footage opens the floodgates for him to do the same. And it says on April 27, 2023, this court issued with Dillon's consent a protective order governing the discovery that is produced in this case. And that protective order is identical to those entered in hundreds of other January 6th insurrection

case. That order requires the parties to make a good faith effort to resolve any dispute about a sensitivity designation before requesting court intervention. The motion goes on to cite, or the opposition by the DOJ goes on to cite, that on November 17th, the Speaker of the House, Maga Mike Johnson, they don't call him that, I call him that, Maga Mike Johnson said he wants to release approximately 40,000 hours of Capitol surveillance footage. And that announcement makes clear that the House is not and has not released all of the CCV footage from January 6th. The Speaker stated

that the Committee of house administration would move as quickly as possible to upload a portion of the CCV footage to the committee's public website. And as of the date of this motion, the committee's online viewing room appears to have made only approximately 90 clips of surveillance footage publicly available. They're kind of mocking and calling him out right there. It goes on to say the speaker has also stated that prior to uploading any footage, the committee would process the USCP CCTV footage to blur the faces of private citizens on the yet unreleased tapes to avoid any persons from being targeted for the retaliation of any kind of segregated estimate of 5% of the video that may involve sensitive

security information related to the building's architecture. It goes on to say that Dillon also does not explain how the committee's release of a limited tranche of Capitol surveillance footage eliminates the national security interest in protecting any such footage, an interest also recognized by the speaker's announcement. They're calling out the speaker. They're calling out MAGA Mike and saying, look, in your own announcement, you recognize that there could be a serious national security interest that needs to be protected or that can be infringed upon in a situation like this.

And so that's why, Maga Mike, you've only released a small fraction. It's all a performative gesture that you're engaged in to your base. Then it goes on to cite all of those other cases I was talking to you about, one involving Tucker Carlson, like this case right over here, United States v. Pope, April 26, 2023, where the court held, quote, the fact of that mediated access to Capitol surveillance footage by Tucker Carlson alone does not defeat the security interest advanced by a protective order in these cases of highly sensitive material that's handed over to the defendant. It then goes on to say that this motion is baseless to try to overturn the protective

order and should be rejected. But it's interesting the hand and glove relationship here between the MAGA Republicans in the House of Representatives and what you see right here with how it's being used by these January 6th insurrectionists and the government having to respond to it.
