Marjorie Taylor Greene just committed a very serious crime, in my opinion, during a congressional hearing. And the crime I believe she committed is so astonishing that a member of the House of Representatives would engage in this conduct. The crime I'm talking about is Washington DC's

law against revenge porn. Specifically, here is what the DC law states, specifically DC Code Section 22-3054. A third party who comes into possession of the sexual image and who publishes, shares it with six or more people, can be charged with second-degree unlawful publication of a sexual image. This is a misdemeanor offense punishable by up to 180 days in jail and or a fine of $1,000. In order to prove this offense, the government must establish that one, the defendant knowingly published a sexual image that was obtained through a third party. Two, the person depicted was either identified or identifiable. Three, the person depicted did not consent to the disclosure or publication of the image. And four, the defendant published the sexual image with

conscious disregard that the image was obtained as a result of a previous disclosure or publication of the image made with an intent to harm the person depicted or to receive a financial gain. So, during this congressional hearing held by the MAGA Republican-controlled Oversight Committee, Marjorie Taylor Greene showed the non-consensual nudes of Hunter Biden. He obviously did not consent to these photographs being shared. She shared these photographs during the congressional hearing just to mock Hunter Biden. And this was a hearing about the MAGA Republican conspiracy theories about Hunter Biden, but they are obsessed with sharing these non-consensual nudes.

So here is Marjorie Taylor Greene. And then I want to talk about what Marjorie Taylor Greene's argument is going to be. Then let's talk about some reactions by Democrats to what she did. Mr. Chairman, we're at 1 minute and 53 seconds over. As long as Ms. Ocasio-Cortez can get equal time. I will let Ms. Greene wrap up in five seconds, and then I'll give Mr. Mifune additional time. Thank you, Mr. Chairman. Mr. Shapley, you started an investigation into Hunter Biden, codenamed Sportsman, which opened in November of 2018. It was an offshoot of an investigation the IRS was conducting into a foreign-based amateur online pornography platform. This is evidence of Hunter Biden making sex, excuse me, this is my time, making pornography.

Should we be displaying this, Mr. Chairman, in the committee? The ladies' time has expired and went two and a half minutes over. So you see there, it satisfies each and every one of the elements. And this is how some of the Democrats responded. You had Robert Garcia saying House Republicans are obsessed with dick pics, apparently. And here's what Robert Garcia said Democratic Congress members said during the hearing. Today's hearing is like most of the majority's investigations in hearings. A lot of allegations, zero proof, no receipts, but apparently some dick pics.

Here is what Representative Eric Swalwell said that McCarthy's GOP, Kevin McCarthy's GOP, a party of non-consensual nudes, hashtag creep summer. And Jared Moskowitz, Democratic Congress member from Florida said, based on this photo, perhaps we should call Hunter Biden the big guy. I want to show you also, this is, remember the questioning of those Twitter execs or former Twitter execs that these MAGA Republican hearings, MAGA Republicans called

to their hearings and they showed the same thing, the photographs of Hunter Biden. And then one of the former Twitter executives said, yeah, the reason that those photos were taken down is that they're non-consensual nude photographs. Here, play this clip. And this is MAGA Republican Byron Donalds asking the question. Play the clip. You have no idea how many people actually engaged with the Twitter team or how frequently that engagement happened. No. And again, that was by design. We kept those functions separate from content moderation so that we could impartially assess reports like that. Do you know how many tweets were actually flagged and taken down at the behest of the Biden team? I wouldn't agree with the characterization of it as being at

the behest of them. These tweets were reported and Twitter independently evaluated them under its rules. But the email is very clear. More to review from Biden team. The response three hours later at the bottom, hold this up real quick so we can see, the request at the bottom, it says, handled these. What does handled these mean? My understanding is that these tweets contained non-consensual nude photos of Hunter Biden, and they were removed by the company under- Hold on, real quick, Mr. Roth, how could you know so much about the content of these tweets? I mean, as far as I'm concerned, these are just web addresses. I don't know what's in these tweets? I mean, as far as I'm concerned, these are just web addresses. I don't know what's in these tweets.

You have these things committed to memory that you know the content, but you don't know who you talk to at the Biden team? Sir, I didn't meet with the Biden team, but there was extensive public reporting about these tweets specifically that uncovered what they were. So that was back in January, February of 2023. This is Congress member Eric Swalwell from last week basically ridiculing the MAGA Republicans for their claim that Hunter Biden's laptop of non-consensual nudes is the reason that the Republicans lost the 2020 election. That's why Trump lost here. Play this clip. The use of the word laptop about 20 times. In fact, in the chairman's opening statement,

he said that he's upset that he believes the FBI prevented more Americans from learning about a private citizen's laptop. That is bananas to me. You all are bringing up FISA. Every single question, you're essentially saying to the American people that you're guardians of personal security and privacy. But the 2020 election was determined because the FBI didn't let more Americans see a private citizen's non-consensual nudes. Is that what we're saying here? That you lost the election, not because of your ideas, but because a private citizen's laptop.

Do you want an answer? Was it out there? That's bananas. Like you should be a party of ideas, not a party of non-consensual nudes to help you win an election. Will you yield for an answer? It seems like that is what the objection is here today. And we should be talking about the mass shootings that occurred over the last 10 days. This hearing has turned into absolute chaos. And finally, here is Democratic Congress member Adam Smith, the ranking member of the House Armed Services Committee on Kevin McCarthy promoting Marjorie Taylor Greene. Play this clip. Congresswoman Marjorie Taylor Greene tells CNN that she ultimately voted for the bill because Speaker McCarthy offered her a seat on the Joint House and Senate Armed Services

Conference Committee. This is conferences committees are after the House passes a bill, the Senate passes a version, and then the conferences committee come together and suss it out and then, you know, and have one bill that goes back to the House and Senate. It's odd because Marjorie Taylor Greene is not on the House Armed Services Committee to begin with, but she's going to be put on this conference committee for this. What do you make of that? Well, what I make of it is the extreme MAGA Republicans run the Republican Party. Yeah, I mean, you basically, Kevin McCarthy will do whatever he has to do to appease the most extreme, obnoxious members of his party at every turn. Because that bill that I mentioned that we passed out of the Armed Services Committee,

that would have passed the House floor with probably 360, 370 votes. We would have lost a few, you know, the Freedom Caucus members and some of our folks on the left who don't vote for the defense bill typically. We had a very strong bipartisan bill. But Kevin McCarthy's made it clear, whatever the far right wants, he will give them. And no, we've never had anyone serve on the conference committee who's not a member of the committee. But again, he will give away what he has to give away to keep them at least marginally happy, I suppose. So Marjorie Taylor Greene is likely going to argue that under the speech or debate clause, that she is immunized from liability, that she cannot be sued civilly, or she cannot be held

to answer for that. But I've read a lot of these cases relating to the speech or debate clause, and specifically Gravel versus USA. And in that case, it involved the conduct of a former senator who was taking bribes, a sitting senator at the time who was taking bribes. And so the case related to whether that type of conduct would be immunized. When it comes to Marjorie Taylor Greene, to me, committing a crime like this would not be within any legitimate functions of legislative activity, it would be criminal. And I hope that this is pursued, that there is a criminal investigation,

that there is an inquiry. Such a disgraceful thing to watch. Really, this is really embarrassing for our country, the way these MAGA Republicans are acting. It's shameful, disgusting conduct.
