The Department of Justice has filed a notice of appeal regarding the duration of the sentencing delivered by federal judge Amit Mehta to seven oath keepers,
including the leader of the terrorist group, Stuart Rhodes. Stuart Rhodes was sentenced to
18 years in prison by federal judge Amit Mehta. And in this appeal, so far only a notice of appeal has been filed.
The Department of Justice will be asking the D.C. Circuit Court of Appeals to ensure that Stuart Rhodes is given the full amount of time that was requested by the Department of Justice, the full 25 years. Now, many observers looked at the sentencing handed down to these Oath Keepers as
being quite a serious penalty, but the Department of Justice is sending a message here saying that
if you were in the Oath Keepers, this terrorist organization, you deserve to get the maximum sentence provided for by law, which the Department of Justice set forth in their
sentencing memorandum before the sentencing which took place in May of this year. Among the
individual sentences that are being appealed by the Department of Justice includes the terrorist
Stuart Rhodes, who was sentenced to 18 years when the Department
of Justice requested 25 years. Florida Oathkeeper Leader Kelly Meggs, who received a 12-year
sentence when the Department of Justice sought 21 years. Robert Minuta of New York was sentenced to four and a half years when the Department of Justice
sought 17 years.
Joseph Hackett of Florida received a three and a half year sentence when the Department
of Justice sought 12 years.
Ed Vallejo of Arizona received a three year sentence when the DOJ sought 17 years.
David Morshell of Florida was sentenced to three years.
The Department of Justice sought 10 years, and the DOJ also appealed the convictions of two
oath keepers acquitted of seditious conspiracy but convicted of conspiring to obstruct an official
proceeding of Congress. Jessica Watkins of Ohio, who was sentenced to 8.5 years in jail.
The Department of Justice sought 18 years. And Kenneth Harrelson of Florida, who was sentenced
to four years. The Department of Justice sought 15 years. What is interesting about this dynamic is that Judge Amit Mehta has been a law and order, fairly no-nonsense judge. He was
appointed by the Obama administration, and we've talked a lot about Judge Amit Mehta on the Midas
Touch Network about his very, very, very kind of strong handling of these January 6th related cases.
But, you know, to the Department of Justice's point, when you do look at that sentencing,
where the Department of Justice for many of these Oath Keepers was requesting 10, 15, 17 years,
and he was giving them three years, I understand why the Department of Justice would be filing this appeal.
And they want to send a message that if you are involved in this type of conduct, we are not just
going to let that rest. We are going to make sure that you are sentenced to every single day
that the law provides. Back in May, during the sentencing of the Oath Keepers, and specifically
the one of Stuart Rhodes. We cover that here on
the Midas Touch Network. And remember, Judge Amit Mehta looked at Stuart Rhodes and said the
following, quote, what we absolutely cannot have is a group of citizens who, because they did not
like the outcome of an election, who did not believe the law was followed as it should be foment revolution. That is what you did, Mr. Rhodes.
I dare say, Mr. Rhodes, and I have never said this to anyone I have sentenced, you pose an
ongoing threat and peril to our democracy and the fabric of this country. He also said to Stuart Rhodes, you are not a political prisoner.
You are an ongoing threat and a peril to this country.
Here is the notice of appeal regarding the sentencing of Stuart Rhodes and all of the other Oath Keepers who I mentioned.
Also, there are notice of appeals for that as well.
Harry Littman, a former top official at the DOJ,
who is a member of the Midas Touch Network family,
states,
DOJ appealing the fairly long sentences for Rhodes,
18 years, guideline was 25, among other things.
It's bad news for Trump.
It's rare for the Department of Justice
to appeal sentences as too light,
but shows the resolve to treat
insurrectionists with the utmost seriousness. Richard Signorelli, a former AUSA, Assistant
United States Attorney, Federal Prosecutor in the Southern District of New York said, wow,
rare sentencing appeal by Gov. Great sign that the Department of Justice is showing resolve here.
These are meritorious appeals, by the way,
given the otherwise applicable guideline ranges. And by the way, if you look at some of Signorelli's
other posts, Signorelli is very, very critical of Merrick Garland.

these are federal sentencing guidelines where you look at the crime,
the conviction, you look at if there are enhancements, you look at if there are mitigating
factors, and there's basically a formula that you come up with that provides a sentencing range.
You also look at the report by the probation department. They submit a report. You put all this data, you funnel it through basically a formula, and you come up with the
sentencing guidelines. And back before the sentencing of these terrorist Oath Keepers in May,
the Department of Justice submitted a 183-page brief. That's how serious they are, telling Judge Amit Mehta about the guidelines,
what the sentencing should be for all of these Oath Keepers who were ultimately convicted by
a jury of their peers of the crimes. This was the government's omnibus sentencing memo
and motion for upward departure that was filed back on May 5th of 2023. The sentencings were
late May of 2023. Here's what it said. The defendants were prepared to fight not for their
country but against it. In their own words, they were willing to die in a guerrilla war
to achieve their goal of halting the transfer of power after the 2020 presidential election. As a co-conspirator recognized,
their actions made these defendants traitors. Using their positions of prominence within an
affiliation with the Oath Keepers organization, these defendants played a central and damning
role in opposing by force the government of the United States, breaking the solemn oath that many of them swore
as members of the United States Armed Forces. To support their operation, they amassed an arsenal
of firearms across the Potomac River and led a conspiracy that culminated in a mob's attack
on the United States Capitol while our elected representatives met in a joint session of Congress. Two juries found all defendants guilty of
participating in this grave conduct. These defendants are unlike any of the other hundreds
of others who have been sentenced for their roles in the attack on the Capitol.
Each defendant, therefore, deserves a significant sentence of incarceration.
After adopting the PSR's factual findings. That's the
probationary report's findings. Chapter two, specific offenses, characteristics, and chapter
three, adjustments. That's what I was saying, kind of upward and downward departures and adjustments.
And then departing upwards from the sentencing guideline range based on defendant's
terroristic conduct under section 3A1.4, Note 4.
The court should impose the following terms of incarceration.
And then it listed the terms that I previously gave.
You see there, too, the Department of Justice appropriately referring to the conduct here as terroristic.
So what's been filed already is the notice of appeal. It's that bare bones notice
that I showed you. There's going to now be a memorandum of points and authorities filed,
but you got the DOJ appealing the sentencing of a Obama appointee, Judge Amit Mehta, who spoke
very harshly and critically of the January 6th insurrectionists and specifically
of the Oath Keepers. It will now go to the D.C. Circuit Court of Appeals, and the D.C. Circuit
Court will take a look at Judge Amit Mehta's ruling and then make a determination as well.
You may be wondering a few things here. Does that violate any type of
double jeopardy? It doesn't. It's an appeal on the law on the sentencing. That is something that the
Court of Appeals can have jurisdiction over. If an individual was acquitted, that can't be appealed.
They were acquitted by a jury that can't be appealed. But the
D.C. Circuit Court of Appeals can look at the sentencing and then say, hey, the judge applied
the facts wrong. And you may be wondering by the end of this video, OK, Ben, you say he's a law and
order judge. He is an Obama appointee. Why did he do the sentencing this way? Well, I think he
viewed his sentencing of Stuart Rhodes. It was the biggest sentencing, the longest sentencing of any January 6th insurrectionist before it. So I think
he thought the 18 years was a serious sentence. And then the way he described other people's
involvement, he almost described Stuart Rhodes as being this cult-like figure who manipulated all these other individuals and that
they were following Stuart Rhodes' orders. A lot of the other individuals, after they were convicted,
took responsibility and apologized, whereas Stuart Rhodes claimed he was a political prisoner.
But I guess the judge was thinking, hey, these people were manipulated by Rhodes. But
he did, you know, you look at the facts, he gave some of these ins, hey, these people were manipulated by Rhodes, but he did, you know,
you look at the facts, he gave some of these insurrectionists, people who are convicted of
sedition or obstructing an official proceeding with massive sentences, I think pretty light
sentences. That's been one of my gripes with these federal judges as well and the overall
sentencing guidelines for these January 6th insurrectionists. I mean,
you got people who are being charged with sedition, obstruction of official proceeding,
people who try to overthrow our country. To me, it shouldn't be a few-year sentence. That should
be the highest possible sentences, among the highest possible sentences in terms of years
that exists under the sentencing guidelines
if you're trying to overthrow our democracy. But there you have it. We'll keep you posted
on this Department of Justice appeal. But again, for those who have been critical of Merrick Garland,
take a look at the steps he's been taking. I mean, these are strong pro-democracy steps that I got to say,
I'm not sure many other attorney generals would be this aggressive. And it's good to see him doing
