Let's talk about the big ruling issue just moments ago by federal judge Tanya S. Chutkin in the criminal case just brought by special counsel Jack Smith against Donald Trump in the federal court in Washington, D.C. for Donald Trump's crimes relating to the 2020 election and the January 6th insurrection. Here is the minute order issued just moments ago by Judge Chutkin. Minute order as to Donald J. Trump. The court hereby schedules a hearing on the party's respective protective order proposals in this matter on August 11th, 2023 at 10 a.m. in courtroom nine. The requirement of defendant's appearance is waived for this

Starting point is 00:01:48 hearing and Judge Chutkin is moving this case along in an expeditious manner. She's also set a hearing for August 28th where she has stated through the magistrate judge, Judge Upadhyaya, that she will be setting a trial date at the August 28th hearing. And in making this minute order, Judge Chutkin is rejecting the request by Donald Trump's lawyers that this hearing take place next week. Trump and his lawyers were seeking delay, delay, delay. And in a stipulation that was brought by the parties or what was supposed to be a stipulation brought by the parties, Donald Trump said, Donald Trump said, I want both of my lawyers to appear. My lawyers aren't going to be ready until next week. For some reason, he said

Starting point is 00:02:36 that they're losing the day of Friday and Judge Chutkin is not buying it at all. And she's setting a hearing. We did a video earlier today about the joint notice that was brought by special counsel Jack Smith and Donald Trump's lawyers after Judge Chutkin issued this minute order on August 7th. On August 7th, Judge Chutkin issued a minute order saying, upon consideration of the government's motion for protective order and defendant's response, as well as the government's reply, the court will schedule a hearing on the party's respective proposals. The court will waive the requirement of defendant's appearance. So she already said right there that Donald Trump doesn't have to appear.

Starting point is 00:03:20 Accordingly, it is hereby ordered that no later than 3 p.m. Eastern on August 8, 2023, the party shall meet and confer and file a joint notice of two dates and times on or before August 11, 2023, when both parties are available for a hearing. And so let's go to the stipulation or the notice that the parties filed. And you'll see that Donald Trump didn't even pay attention to what Judge Chutkin asked for there. This was the joint notice filed earlier in the day, joint notice in response to court's August 7th, 2023 minute order. By minute order on August 7th, 2023, the court directed the parties to meet and confer and inform the court by joint notice, quote, of two dates and times on or before August 11th, 2023, when both parties are available for a hearing. The parties have conferred and hereby provide notice.

Starting point is 00:04:15 The government is available at any time on August 9th, 10th, or 11th. So special counsel Jack Smith was like, you name a day, you name a time. This case is important. We will be there. Donald Trump's response. The defense represents the following. Oh, it's already a paragraph. So, you know, it's going to be a bunch of nonsense.

Starting point is 00:04:36 And here's what it says. President Trump will not appear. Okay. Well, we know that because Judge Chutkan previously said he does not need to appear. President Trump will not appear. Okay, well, we know that because Judge Chutkin previously said he does not need to appear. President Trump will not appear. However, he would like to have both his counsel, John Loro, and Todd Blanche at the hearing. Todd Blanche is not available on Thursday since he must appear for a court proceeding in the prosecution brought against the same defendant. They say President Trump, but I don't call him that, Trump, by the special counsel

Starting point is 00:05:05 in the Southern District of Florida, Mr. Loro is available on Thursday with a preference for an afternoon hearing. However, since we lost Friday as an option, we would respectfully request a setting on Monday after 12 p.m. or Tuesday all day to allow for both Mr. Blanche and Mr. Loro to be president. What do you mean? You lost Friday? I don't even know what you've been talking about. Well,

Starting point is 00:05:31 Judge Chutkin said, I'm going to hold it on Friday and I'm going to hold it on August 11. So we'll see you there at 10 a.m. Just now it all makes sense. Going back to the minute order, the big minute order issued earlier today, Judge Chutkin's like, I'm not doing this next week. We're doing it this week. Starting point is 00:08:10 You don't care what Donald Trump's lawyers say. So talking about this protective order motion and this ruling, the motions and orders came fast and furious. You'll recall last week that soon after Donald Trump posted a threatening message on his social media platform stating, if you go after me, I'm coming after you. needs to be entered immediately also to expedite the case and saying, look, we need to keep witnesses who went before the grand jury secret. There's grand jury secrecy. Trump's allowed to know the name. The parties can know, but this stuff is always kept confidential in criminal cases. So it should all be pursuant to a standard protective order, the same type of standard protective order that Trump's already entered in the Southern standard protective order, the same type of standard protective order that Trump's already entered in the Southern District of Florida, the same type of protective orders

Starting point is 00:09:10 that Trump's lawyers have agreed to in other cases involving the January 6th insurrectionists, the same type of standard protective order that courts throughout the Washington DC federal court system have entered on a routine basis. Donald Trump is no different. He's not above the law and enter a normal protective order, Judge. Then Donald Trump first said, we want a whole briefing schedule. We want to delay even briefing the issue of a protective order. Judge Chutkan immediately said, nope, I want your response by Monday, August 7th. Trump then responded with a very bizarre motion opposing the government's protective order, including this photograph of President Joe Biden drinking a cup

Starting point is 00:09:53 of coffee and stating in Donald Trump's opposition, Donald Trump's lawyers write, President Biden has likewise capitalized on the indictment, posting a thinly veiled reference to his administration's prosecution of President Trump just hours before the arraignment. It is a video that President Biden posted of himself drinking a cup of coffee, mocking the fact that MAGA Republicans call him dark Brandon. Well, they call him Brandon. Let's go Brandon and say F you, which President Biden turned into a funny joke because MAGA Republicans are so vile that they were saying F you to him and having their kids chant F you that Biden turned it into like a funny thing about Dark Brandon. But according to Donald Trump, that is harassing and threatening him because Donald

Starting point is 00:10:41 Trump always plays the victim. But the key to Donald Trump's opposition is that Donald Trump wanted to try the case in the media and special counsel Jack Smith pointed that out brilliantly in the government's reply brief in support of the motion for protective order, where Jack Smith pointed the media tour that Donald Trump's lawyers engaged in over the weekend, where they went to every single network. They did every interview they could do spreading lies. And at the same time, Donald Trump threatening former Vice President Pence and attacking other witnesses and special counsel Jack Smith's team in their filing said, look, what Donald Trump's trying to do here is leak

Starting point is 00:11:21 the identities of witnesses, threaten, intimidate, and harass witnesses. We should have a standard protective order entered. Judge Chutkin then said, okay, let's have a hearing immediately. You're coming into my courtroom. Folks, this is what a law and order judge looks like. This is the way a case is supposed to proceed. Meanwhile, you have Donald Trump whining, complaining about the judge. Here is a recent post that was made by Donald Trump, again, attacking the judge the same way he attacks everything. He goes, the Obama appointed judge in the free speech indictment of me by my political opponent, Crooked Joe Biden's Department of Justice, shared professional ties at the law firm that worked for energy company Burisma based in Ukraine, which Hunter Biden, Hunter Biden, Hunter Biden, Hunter Biden, Hunter Biden,

Starting point is 00:12:17 Hunter Biden, Hunter Biden, Hunter Biden, just a bunch of so pathetic, so pathetic, whiny, whiny, whiny. But folks, we have a law and order judge in Judge Chutkin.
