Starting point is 00:01:31 I'm Ben Micellis from the Midas Touch Network. The audacity of the MAGA Republican propaganda machine is such a disgrace and is so dangerous. Let me show you, for example, what Fox was saying earlier in the day, and let me debunk it for you very simply by just looking at the court documents filed by special counsel Jack Smith and by Donald Trump in the Washington DC criminal case, which if anybody cared about facts and evidence, which we care about in a system of law and order, that's what matters. So what the MAGA Republicans have been saying is that the January 6th committee destroyed all of their records. They just destroyed the records. They don't exist anymore. I mean, aside from the fact that you can find them online right now and they are archived besides the fact that it was the MAGA Republicans who shut down the January 6th committee. Here, watch this clip

Starting point is 00:02:25 of Fox from earlier in the morning, just so cavalierly, so nonchalantly, just make a affirmatively false statement and say the January 6th committee just destroyed all of their records. Here, play this clip. There's a lot of strategic sort of hypotheses at play. What say you about this? Well, just to take a look at what's happening here, we had from Democrats years of investigations into how to keep Donald Trump off the ballot, how to get him into prison. You had the January 6th committee, which was a one sided committee handpicked by Nancy Pelosi to to find out all sorts of information. They handed that over to Jack Smith, but then

Starting point is 00:03:05 destroyed the evidence so that Republicans, once they took over Congress, could not look through it. Jack Smith had years to work on this and other people at the Department of Justice. Even at the time that Joe Biden was elected, he said he hoped there would be a way to legally prevent his primary political opponent from being able to run for office. So you've had years of work put into this. The Trump team was asking for just a little bit of time to go through all the documents that they have gathered. This judge, who is very partisan, who's known for being partisan, says, no, we're going to do it right in the middle of the election season.

Starting point is 00:03:38 And she's very partisan about how she's been very open about how much she hates Donald Trump. It seems like she should not be actually overseeing this trial, but that's what we have here. This is not election interference. I heard some people say, this is election interference. This is straight up election rigging on the part of Democrats to keep their primary political opponent out of office.

Starting point is 00:03:58 And where does Fox get these talking points from? Well, directly from Donald Trump. And in Donald Trump's posts, he makes these statements that the records have been destroyed and then it's spread by Fox and others. Donald Trump says in his posts after Judge Chutkin set a March 4th, 2024 trial date, Trump goes deranged. Jack Smith and his team of thugs who were caught going to the White House just prior to indicting the 45th president of the United States, an absolute no-no, have been working

Starting point is 00:04:30 on this witch hunt for almost three years, but decided to bring it smack in the middle of crooked Joe Biden's political opponents campaign against him. Election interference. Today, a biased Trump hating judge gave me only a two-month extension. I will appeal. He can't appeal because it's a two-month extension. I will appeal. He can't appeal because it's a non-appealable order. He goes, how do you have an indictment that is based almost entirely on findings of the January 6th unselect committee of Marxist, fascist,

Starting point is 00:04:55 political hacks, blah, blah, blah, whine, whine, whine. And then he says, purposely and illegally destroyed and deleted all of the evidence, findings, and proof of the January 6th committee. So Donald Trump is saying this also, that the documents were destroyed. The January 6th committee files were destroyed. And by the way, then Fox posts it on its social media platform, and they've been continuing just to post these falsehoods. And they go, January 6th committee failed to preserve records, has no data on Capitol Hill security failures, GOP charges. You know that GOP charges is doing a lot of work right there. Adam Kinzinger then responds, who was on the January 6th committee. By the way, committee

Starting point is 00:05:39 records can be found at this repository, govinfo.gov selection january 6 and he provides the address where any of us can access the hearings the deposition transcripts all of the archives witness statements so on and so forth and kinzinger goes as well as house clerk with four terabytes of data any dhs records containing sensitive information was determined by X branch after committee dissolved. Try again with your conspiracy. And then just so you see as well, people, right-wing influencers then spread it. They go, the sham January 6th committee destroyed all of their records and documents cover up. But I wonder if this is taking place and Donald Trump's lawyers were requesting an April 2026 trial date, wouldn't

Starting point is 00:06:32 they raise to the federal judge? Hey judge, the reason that we need a trial date in April 2026 is because the January 6th committee documents were destroyed. And we need those records, Judge. Don't you think Trump's lawyers would make that argument? Starting point is 00:08:28 Why would Trump's lawyers argue the exact opposite? Why would they argue, Judge, we needed an April 2026 trial date because we received too many documents from Jack Smith, including a million records from the January 6th committee, in addition to other records from the Secret Service and millions of other records. So why would they not be arguing in that court? Oh, wait, wait a minute. In court, evidence matters. In court, facts matter. You can't just spew right-wing propaganda and then put a comma and say, GOP says. Well, GOP said that there were 17 audio recordings of President Biden being involved in a bribe and then said, oops, we just lied about that. The GOP said that there were all these whistleblowers who determined to

Starting point is 00:09:18 be dead, missing, or spies of China, or that they were talking about things that happened while Donald Trump was in office. But why don't we take a look at the court filings, right? Because in court where evidence matters, here is what special counsel Jack Smith put in his legal brief. This was when Jack Smith was responding to Trump's lawyers and Trump's lawyers said they needed a lot more time in order to hold trial. Jack Smith wanted it January 2nd, 2024. Trump's lawyers wanted April, 2026. The judge ultimately said it March 4th of 2024. But here, Jack Smith is saying, here are what the records are. Here's the volume of discovery. It says, the government respects defendant Trump's need to review discovery and prepare for trial, but his characterization of the volume of discovery miss important facts.

Starting point is 00:10:12 The majority or roughly 65% of the government's first discovery production in which the government front loaded the most important materials consist of materials to which the defendant has functionally had access, are duplicative, or do not constitute Rule 16 discovery. Approximately 3 million pages of discovery, 25% of the first production, come from entities associated with Donald Trump. Hundreds of thousands of other pages came from the National Archives, meaning that the defendant or his representatives reviewed them before the government received them or are publicly available, including the defendant's tweets, truth social posts, campaign statements, and court papers involving challenges to the 2020 election by the defendant or his allies.

Starting point is 00:10:55 Nearly 1 million more pages came from the House Select Committee to investigate the January 6th attack on the United States Capitol, including hundreds of transcripts of interviews or depositions, a majority of which are already public in redacted form. And then it gives a link to the website I just told you about, govinfo.gov slash collection slash January 6th committee final report. So in the court filings, unrebutted by Donald Trump's lawyers, over a million documents relating to the January 6th committee were turned over to Donald Trump. Now, it shouldn't be Democrats, Republicans. One side focuses on the evidence and facts. The other side just makes crap up.

Starting point is 00:11:47 That's not the way our politics should be. It should be both political parties care about facts and evidence and then maybe have different opinions about the implementation about how to make our country stronger and better and more prosperous and make sure we help as many people as we can and make sure we espouse values and views of equality, competence, intelligence, and so forth. But right now you only have the Democratic Party espousing evidence-based logic. And then the GOP says, so then the GOP lies. I just showed you how they lied. And then the lie is laundered because, well, now the GOP said it, a major political party, and then Fox just says it. And then they say it with such a degree of confidence, like this is something

Starting point is 00:12:38 that's real. Like the January 6th committee destroyed its records. And then that becomes a narrative. But we need to look at evidence. And I know you care about evidence.
