Fulton County District Attorney Fawnie Willis has formally requested a trial date
in the criminal RICO case against Donald Trump and the other co-defendants.
She is requesting August 5th, 2024 for the trial date. This is almost exactly what I predicted on the
Midas Touch podcast, the last one that we did. I'll show you that in a little bit, but let's
take a look at the motion filed by Fawnie Willis here. She says that the state of Georgia by and
through the Fulton County District Attorney's Office moves the court to schedule trial for the remaining defendants, including Donald Trump,
to August 5th, 2024. The state of Georgia requests the court schedule the remaining
defendants for a final plea hearing the date of Friday, June 21st, 2024, and to begin trial on Monday, August 5th, 2024. This proposed trial date
balances potential delays from defendant Donald Trump's other criminal trials in sister sovereigns
and other defendants' constitutional speedy trial rights. Currently, defendant Trump is set for trial in the District of Columbia on March 4th, 2024, and the Southern
District of Florida on May 20th, 2024. A start date of August 5th, 2024 is therefore unlikely
to be subject to delay or interference from these other trials. Additionally, setting trial to begin on August 5th, 2024 would begin trial within one
year of August 14th, 2023, the date of the indictment and would show deference for each
defendant's constitutional speedy trial rights. The August 5th, 2024 trial date would balance
these two scheduling concerns. In this motion by Fulton County
District Attorney Fawnie Willis requesting a trial date of August 5th, 2024, Fawnie Willis
also makes clear that she does not want any of the defendants to be severed. She thinks that all
of the co-defendants can be tried together who remain in the case. You will recall that Donald Trump's lawyers like
Jenna Ellis, Ken Chesbrough, and Sidney Powell, his co-defendants in this criminal RICO case,
have already pled guilty. That leaves about a dozen plus other co-defendants. There was one
other co-defendant that pled guilty as well.
But you have Donald Trump.
You've got John Eastman.
You've got Giuliani and other co-defendants as well, including some of the other fake
electors.
Now, folks, this is what I thought that Fulton County District Attorney Fawnie Willis should
do and would do.
And I said, Fulton County District Attorney's Office, if you are listening
to the Midas Touch Network, this would be the perfect strategy because you will recall that
back on November 10th, Judge Eileen Cannon in the Southern District of Florida thought she was
too smart and too cool for school. So what she did was she did not adjourn the May 20th, 2024 trial date because she
thought I'm going to try to protect this trial date period from any other cases being set.
And she figured, well, maybe that will stop the Fulton County District Attorney and others from trying to set their trial during this date. And what Judge Cannon did, she set a March 1st, 2024 status conference. She moved the other dates
and said that she would deny without prejudice moving or adjourning the May 20th, 2024 trial
date. So I said, she's always planning on moving that May 20th, 2024 trial date. So I said, she's always planning on moving
that May 20th, 2024 date,
but she was gonna have that March 1, 2024 date
and then probably move it then.

One of the things that I noted about Judge Cannon's prior scheduling order,
when you pull it up right here, which I talked about in a previous hot take as well,
is it was missing a critical deadline in a SEPA section five.
In a SEPA case, which is a SEPA section five deadline,
the critical SEPA deadline where
a defendant provides notice to the court of the potential classified information that
it intends to use in a trial.
So you can then get to SEPA Classified Information Procedures Act Section 6, where the government
can respond and say, look, there should be redactions or summaries of the classified
information to protect our national security. But Judge Cannon didn't set a SEPA Section 5
deadline. So Special Counsel Jack Smith swooped in, filed a notice, Judge, set a SEPA Section 5
deadline. It's missing from your order. Judge Cannon then responded yesterday with this paperless order,
denying the government's request that she set a SEPA section five deadline.
So as I said on the Midas Touch podcast, the last one that we held, here's what I would do if I was
Fulton County District Attorney Fawnie Willis. Now that you have Judge Cannon having this May 20th,
2024 date, which she probably will try to move. But
if I'm Fulton County District Attorney Fulton Willis, I was waiting to see what Judge Cannon
did. Recall, we have the March 4th, 2024 Washington DC trial date. We've got Judge
Cannon, May 20th, 2024. And then we have what was going to happen with the Fulton County District Attorney case.
So I was like, you know what?
If Judge Cannon is setting it and not moving her date, set the date.
I said, to be fair, June or July.
I was so close, August 5th.
So I was right there.
But I think Fulton County District Attorney Fawney Willis had it right,
and I think nailed the concept that I talked about on the podcast. So just so you see
that when I make these predictions for you, that they are data driven and that the predictions,
I would say, are about as accurate and precise as any other legal show or news network out there.
Let me show you right here what went down when I
made that prediction on the last episode of the Midas Touch podcast. Watch how close it used to
what actually went down. Play the clip. Now, what do I hope the response is? Well, I hope that the
Fulton County District Attorney looks at this order and now requests a trial date for Donald
Trump right in that June or July period.
And I hope Fulton County District Attorney Fannie Willis says, even though, it says it
to Judge McAfee, even though Judge Cannon has kept this May date by not setting a SEPA
Section 5 schedule, it is impossible that that case goes to trial. So Judge McAfee,
why don't you set your trial date for June or July? And if we have to move it, we can move it,
but we know that Judge Cannon is playing games. That's how I would strategize this. If I'm Fulton
County District Attorney Fonny Willis, that would be my response. And Jack Smith, unfortunately,
is a bit stuck right now. As long as this is being construed as scheduling, he can't make that interlocutory appeal right now.
But that's how I would respond if I'm Fulton County District Attorney Fawnie Willis,
or if any of them happen to be watching the show. Who knows? Maybe they watch
the Midas Touch Network. So not bad folks right there. Let me reiterate the headline one more time
that Fulton County District Attorney Fawnie Willis has filed a motion to set the trial
deadline in the criminal RICO case for August 5th of 2024. That is big. I'm sure Donald Trump
and all the other co-defendants will oppose that. We will keep you posted as we
