The Republican Party in the state of Ohio is removing President Biden from the November 2024
general election ballot, claiming that President Biden is violating Ohio state law because the
Democratic nominating convention takes place after August 7th. It will be taking place August 19th, 2024 through August 22nd, 2024. The Ohio legislature back in 2010
passed a very strange law that states that presidential nominations need to be submitted
before 90 days from the general election. And because the nomination would be received right around August of 22nd, not August 7th,
Republicans in the state of Ohio are saying that President Biden will be banned.
He will be removed from the ballots.
Now, in the past, this has been dealt with in a very kind of rational, common sense way,
despite this very odd law that was passed by Ohio in 2010
with this law providing that the nominating convention has to be held 90 days before the
general election and the name submitted 90 days before the general election to the Secretary of
State. In the past, when it came to Republican candidates or candidates from other political parties,
the legislature would simply pass an extension or pass a resolution that would allow for an extension
so that a Republican candidate's name could appear on a general election ballot.
Also, you could potentially use some sort of provisional ballot process. But there was always
workarounds based on this odd law that really nobody in Ohio actually understands how this
became part of Ohio law, this rule that you have to submit the nominee 90 days before.
But now the legislature, which is a MAGA Republican-controlled legislature, MAGA Republicans
have a super majority in the legislature thanks to the gerrymandering that's occurring in the
state of Ohio. The legislature is refusing to provide any extension to allow President Biden
to be on the ballot. They are thereby excluding him from the ballot, removing him from the ballot.
The ultimate irony here is, whereas Donald Trump engaged in an insurrection that we all observed,
and therefore under the 14th Amendment, Section 3 should be banned from running from office based
on being an insurrectionist, the MAGA Republicans were claiming, oh, that's so unlawful.
They ended up taking it all the way to the Supreme Court. And the Supreme Court held that Donald
Trump would not be allowed to be removed from state ballots, regardless of whether he engaged
in insurrection, that Congress would have to pass the law. And you remember MAGA Republicans being
so outraged that you're taking Donald Trump's name off. This is unconstitutional. I mean, he was involved in an
insurrection and we all read the plain meaning of the 14th Amendment, Section 3. Nonetheless,
the United States Supreme Court ruled that Donald Trump would stay on the ballots despite a state
Supreme Court ruling in Colorado. But now in the state of Ohio, MAGA Republicans are saying,
President Biden, you're off the ballot because you do not meet these very bizarre requirements
where Ohio used to provide just basic matter-of-fact extensions. Therefore, you're
banned from being on the ballot in the state of Ohio. They've got a letter that was just written by Frank LaRose, the
Secretary of State in Ohio, MAGA Republican. And here's what MAGA Republican Frank LaRose,
big Trumper, here's what he had to say to the chairwoman of the Ohio Democratic Party.
Dear Chairman Walters, I write to inform you that my office still has not received communication on behalf of the Ohio Democratic Party or the Democratic National Committee that clarifies the party's intent to comply with Ohio's ballot access deadline. Ohio Revised Code requires a political party selecting its presidential and vice presidential
candidate by nominating convention to certify the names of those candidates to the Secretary
of State honor before the 90th day before the day of the general election. The conflict between the
August 7th, 2024 certification deadline and the date of your party's nominating convention. Remember, the nominating convention is
August 19, 2024, is well established. In my correspondence to you dated April 5, 2024,
I offered two possible remedies. So here, the MAGA Republican Secretary of State's writing to the
Democratic chairwomen of the Ohio Democratic Party and saying, here are the two things that I had offered you.
I offered two possible remedies. One, a change in the date by which your party formally nominates
the presidential candidate or action by the Ohio General Assembly to create an exception to the
statutory requirement. So the two remedies I offered you was one, the MAGA Republican-controlled General Assembly provides an extension.
The other is change the date.
We want to control when the Democratic Convention takes place.
We, the Ohio Republican Party, want told members of the media there would not be a legislative solution as there is just not the will to do that from the legislature.
So you're not exactly offering a remedy where the MAGA Republican Speaker of the Ohio House is saying that there is not the will to put President Biden on the ballot by allowing for
a simple extension to take place. The letter goes on to say, with a legislative remedy taken off the
table, I must remind you that the deadline is fast approaching and the matter remains unresolved.
Unless your party plans to comply with the statutory deadline, I am duty-bound to instruct boards of elections to begin preparing ballots that do not include the Democratic Party's nominees for is in the best interest of the Ohio voters to have a choice
between at least the two major party candidates for the nation's highest political office.
Unfortunately, however, the Ohio House of Representatives has refused to act and the
Democratic Party has so far offered no legally acceptable remedies. The legally acceptable
remedy is put him on the ballot. Put the Democratic,
put the president of the United States and the Democratic nominee's name on the ballot. That's
the solution right there. But they're trying to ban President Biden from being on the ballot.

As the Ohio Attorney General's office has advised my office, the Democratic Party's offer to submit a provisional
certification by the statutory deadline simply is not provided for by law, and there is no provision
in Ohio's election code that would permit the Secretary to provide the Democratic Party with
an alternative process to the one required in the statute. Oh, so our attorney general is also saying
the solution that you're providing,
which seems very common sense to deal with,
and the fact that we've allowed Republican candidates
in the past not to deal with this deadline,
you can't do that.
That's not a solution.
So change the day of the Democratic Convention
or you be banned, President Biden,
you're banned from the ballot. It goes on to say
further, the General Assembly, MAGA Republican controlled, has clearly stated that no public
official shall cause an election to be conducted other than in time, place, and manner prescribed
by the revised code. The integrity of our elections begins with our citizenry having full faith and confidence
that their chief election officer will always follow the law. Oh, so Ohio's saying, and this
is the dystopian Orwellian language that they use, and they say that for election integrity to take
place, we're not going to have the president of the United States on the ballot. You're going to
be removed unless you want to change the date of the Democratic National Convention. As such, my office seeks a remedy that both upholds the law and serves in
the best interest of the voters of our state. I trust that you will act quickly to resolve this
conflict so we can move forward with clarity in preparing for the November general election.
Thank you for your prompt attention to this matter. Ohio
Secretary of State Frank LaRose, as David Pepper used to lead the Democratic Party in Ohio,
says the following. He goes, duty-bound to follow the law guy and his statehouse buddies
pushed to have an election last August on a day that openly violated the law that he had championed. But now they can't even have
Ohio hold a presidential election for now. This embarrassing moment in history confirms
that no state government is more broken and corrupted in America. David Pepper says last year,
Ohio legislators forced a statewide election to crush direct democracy
on a day they had banned having elections.
This year, they can't even pass.
And that was the right of women to reproductive rights.
This year, they can't even pass a routine law to let Ohio weigh in on the presidency
of our nation.
Talk about a laboratory of autocracy. And as
David Pepper says, 49 states can figure it out, not Ohio, from bellwether to broken. Karen
Kassler writes, Republican House Speaker Jason Stevens says there won't be a legislative fix to
change the 90-day certification deadline to get President
Biden on the Ohio ballot. No will among the supermajority Republicans to do it. But he says
he's confident that Biden will figure out a way to get on the ballot. And that's basically where
we are today. By the way, what the legislature is focused on is a Republican,
the Ohio legislature, a Republican-led bill introduced in the Ohio House would charge
teachers and librarians with a felony offense for distributing material deemed obscene. The
problem is the bill does not explain what materials would be considered obscene. Here's some commentary from the Ohio Capital Journal
that talks about an obscure provision of Ohio law could keep Biden off the ballot in November.
And they talk about the law that I described, that the Secretary of State must be notified
that presidential candidates have been officially nominated 90 days before the general election to get on the ballot.
That's the earliest deadline of any state.
The Democratic National Convention that will formally nominate Biden won't open until nearly two weeks after Ohio's August 7th deadline.
The Republican National Convention will wrap up nearly three
weeks before the deadline, so Trump won't have a problem getting on. The 90-day deadline has
often caused trouble since its adoption in 2010. Only in 2016 did both parties' conventions take
place before the Ohio cutoff date. Both conventions took place after the deadline in 2012 and 2020, and legislatures
extended the deadlines both times. This is the first time that only one convention comes too late,
but again, it says Republicans could well be affected in the future. As long as it's
MAGA Republican gerrymandered, they're not going to grant the extension, but they previously have
granted the extensions when it was the Republican convention, but now they're not going to grant the extension, but they previously have granted the extensions when
it was the Republican convention, but now they're not granting a routine extension.
So what happens next? Well, it looks like there's going to have to be litigation
under the 14th Amendment. Ironically, the Supreme Court ruling that says that Donald Trump can't be taken off a ballot by a state for
being an insurrectionist. That law may ultimately be used against the precedent by the Supreme Court
that's created there, even though the Constitution was pretty clear insurrectionist is the one where
you can't be on the ballot. That may be used in a lawsuit, but it seems like
there's going to have to be a litigation that's going to be filed against Ohio and Ohio's Secretary
of State. But again, laboratory of autocracy, you're seeing it right there. But as of now,
they're taking President Biden's name off the ballot in Ohio. It's outrageous. It's outrageous what these Republicans
