The case that was just filed in Washington, D.C. in connection with Donald Trump's criminal conduct relating to the 2020 election and the January 6th insurrection, as well as the other case, Special Counsel Jack Smith brought in the Southern District of Florida with the superseding indictment that brought in the Southern District of Florida with the superseding indictment that brought in the new co-defendant Carlos de Oliveira. Last week, special counsel Jack Smith is pushing both cases forward on a very expedited schedule, and he is doing everything
Starting point is 00:01:39 in his power to make sure that those cases will go to trial before the 2024 election. First, let me talk about the superseding indictment in the Southern District of Florida and the motions and notices Special Counsel Jack Smith filed to ensure that as much as he can with Judge Eileen Cannon, that that matter is expedited so trial takes place before the 2024 election. And then let's talk about the other case, special counsel Jack Smith just brought in Washington, DC, and the steps he's taking there to ensure a trial date before the November 2024 election. One of the interesting things when you now look up United States v. Trump on Google to take a look at the court docket. You see two federal cases, United States v. Trump, 123 CR 00257, the DC case,
Starting point is 00:02:34 and then United States v. Trump, 923 CR 80101, the willful retention of national defense information, Donald Trump showing classified documents to strangers case in Donald Trump obstructing justice matter. So let's talk about the one in the Southern District of Florida. First, back on July 27th of 2023, when Special Counsel Jack Smith filed the superseding indictment regarding the conspiracy by Donald Trump, Walti Nauta, and the new co-defendant, Carlos de Oliveira, to destroy surveillance footage at Mar-a-Lago. We all talked about the superseding indictment, but Jack Smith filed another document that not many people are talking about, but we're going to talk about it here on the Midas Touch Network. Here it is right here,
Starting point is 00:03:21 Doc 86, notice regarding superseding indictment. And here, Special Counsel Jack Smith informs the court of the new allegations and the superseding indictment, but also says this notice is intended to apprise the court and defendants of specific changes to the original indictment and the steps that special counsel's office is taking to ensure that the superseding indictment does not disturb the court's scheduling order for a May 20th, 2024 trial date. Okay. Definitely do not want to disturb the court's scheduling order. Okay, so what it talks about is the new count under 18 U.S.C. Section 793, which is the new count 32, which adds to the unlawful retention of national defense information. This is the Iranian war plan document that was not in
Starting point is 00:04:21 the first indictment. It's now in the superseding indictment. Donald Trump said, I was just showing the magazines and paper. No, you were showing war plans. Special counsel Jack Smith's got it. So Jack Smith says, we've added that. We've added new obstruction claims. We've talked about the attempting to destroy surveillance footage in the various paragraphs, new false statement and representations count. And then special counsel Jackson says, okay, here's what we've added, but let's talk about the court's scheduling order now because there is a May 2024 trial date there. Here's what it says. The superseding indictment should not disturb the court's scheduling order or the May 20th, 2024 trial date. And the special counsel's office is taking steps related to discovery and security clearances to ensure that it does not do so.
Starting point is 00:05:12 First, with respect to Trump and now to count 32 does not expand the scope of the unclassified discovery that has been provided and that will be provided. The special counsel's office will promptly produce discovery related to the new obstruction defendant allegations and counsel will identify material within previously produced discovery that relates to the new charges. Second, with respect to De Oliveira,
Starting point is 00:05:37 the special counsel's office will provide counsel a copy of the protective order for unclassified discovery. And once counsel has entered an appearance in the case, will arrange to produce for unclassified discovery. And once counsel has entered an appearance in the case, we'll arrange to produce all unclassified discovery that has been provided to the other defendants. Moreover, the special counsel's office will immediately contact De Olivares' counsel with litigation security group to begin arrangements for clearing De Olivares' counsel to review classified discovery. In other words, Special Counsel Jack Smith's like, let's go. We brought this superseding indictment, but we're not touching that May 2024 trial date.
Starting point is 00:06:11 We're ready to go. I mean, folks, you know, I've seen a lot of federal cases. I've been around a lot of federal criminal cases. On August 1st, again, this isn't really being talked about on any other network. You're not going to hear about the second speedy trial report filed by special counsel Jack Smith anywhere other than here on the Midas Touch Network. Jack Smith says, look, pursuant to the local rules and the court's omnibus order, setting trial dates and establishing pretrial instructions and sentencing procedures, both of which require the filing of a speedy trial report. The United States hereby files this speedy trial report regarding the status of this case
Starting point is 00:08:46 under the Speedy Trial Act. You talk about the first speedy trial report filed on July 11th. The government reported that, it just talks about different dates and things that were told, but then it mentions how, you know, with the superseding indictment
Starting point is 00:09:03 that was filed on July 27th, it restarts the Speedy Trial Act, meaning that the case has to be tried within 70 days unless the court grants an extension for good cause shown. And here, Special Counsel Jack Smith says, yeah, we recognize what the Speedy Trial Act says. And here, the May 2024 trial date is still compliant now with everything. And there is no basis about why this case should be delayed any further or for any reason at all. But again, another Speedy Trial Report. I'm not going to read you all the words, but you can go and just check it out. We'll try to post it on MidasTouch.com with all these other court documents. You could check it out there. But special counsel Jack Smith's putting this thing in front of the judge again, May 20th, 2024 trial date, by the way, the day after my birthday, May 20th, 24.
Starting point is 00:10:00 That'd be a good birthday present that trial. That's what special counsel Jack Smith is saying there. Okay. So those are just two examples of documents filed by special counsel Jack Smith in the past few days, focusing on keeping this trial date May 20th, 2024. And then of course, special counsel Jack Smith also turned over additional discovery, the third tranche of discovery to Donald Trump and Walt T. Nauta, and to also, he will turn that over to Dale Lavera. Dale Lavera is going to be arraigned August 10th now. He needed to find local counsel and didn't have local counsel at the time. Okay, now let's talk about the other case in Washington, D.C. Special Counsel Jack Smith framed that lawsuit in a very surgical way. I mean, the criminal case against Donald Trump for all of his criminal conduct relating to the
Starting point is 00:10:55 2020 election, the indictment. I know I was saying lawsuit, the indictment regarding the, I get so in the weeds here, the indictment relating to the 2020 election. So there's many people who thought in this, one of the things you could have done is bring the criminal charges against Donald Trump's PAC, the financial crimes, money laundering, as well as wire fraud. There seems to be a clear pattern and practice of criminal conduct there. But see, special counsel Jack Smith did not bring those charges. I'll tell you why. A financial crimes case, like lots of white collar financial crimes cases, but a financial crimes case, those case take years, tons of experts, forensic
Starting point is 00:11:47 accountants. And can you imagine the amount of documents and data and receipts and bills that would be required to be analyzed if this was a financial case, right? If this case related to Donald Trump's criminal conduct regarding the political action committees and the representations that were made, then go back. I think special counsel Jack Smith is going to still bring those charges. Those charges are in forfeited, right? The statute of limitations on those would clearly extend in my humble opinion, through 2024, through 2025. So I think special counsel Jack Smith knows he can bring financial crimes charges against Donald Trump regarding the 2020 election. But this case needs to be tried in 2024 before the election. So what does special counsel Jack Smith does? He focuses on three discrete
Starting point is 00:12:47 issues. Conspiracy to defraud the United States by using dishonesty, fraud, and deceit to impair, obstruct, and defeat the lawful federal government function by which the results of the presidential election are collected, counted, and certified by the federal government in violation of 18 U.S.C. Section 371B, a conspiracy to corruptly obstruct and impede the January 6th congressional proceeding at which the collected results of the presidential election are counted and certified in violation of 18 U.S.C. Section 1512, by the way, which carries with it obstruction of official proceeding, a 20-year sentence, and C, a conspiracy against the right to vote and to have one's vote counted in violation of 18 U.S.C. Section 241. Discrete issues. By focusing on those issues,
Starting point is 00:13:40 Special Counsel Jack Smith is going to go to Tanya Chutkin, the federal judge, Judge Chutkin, and is going to say this case should be heard right around, you know, if the other case is being heard in May of 2024, have this one heard in April of 2024. Watch for special counsel Jack Smith, I think asking for an April 2024 or even a February or March 2024 trial date. So prepare for that. But if special counsel Jack Smith made this more expansive, there's lots of other crimes to charge Trump. That could go to 2025, 2026.
Starting point is 00:14:16 So I bet it was frustrating for special counsel Jack Smith to be like, God, there's so many other crimes I could charge him with right now. But restraint, restraint. That's what makes special counsel Jackson a very special, very smart, the brightest that there is in the game. Why he was appointed by Merrick Garland. Law and order, smart, sharp, special counsel.
