So does Special Counsel Jack Smith have a plan to bring other charges against Donald Trump relating to the theft of government records and classified documents and sensitive compartment information and national defense information, in addition to the case filed in the Southern District of Florida, which has been randomly assigned to the disappointment of many, myself including, to Judge Eileen Cannon, who previously made a number of unlawful orders for Donald Trump last year in connection with the search warrant executed by the Department
Starting point is 00:01:31 of Justice on Mar-a-Lago. So on Friday, Special Counsel Jack Smith filed a motion for a protective order, which may give a hint about other criminal investigations that are still taking place. And the fact that Special Counsel Jack Smith filed a motion for a protective order on Friday means that he is not initially filing a recusal motion seeking to disqualify Judge Eileen Cannon under 11th Circuit precedent based on her conduct in the case involving the search warrant executed at Mar-a-Lago. But with that said, does Special Counsel Jack Smith have a plan? And what many have wondered is in the existing indictment with 37 counts against Donald Trump for willful retention of national defense information, conspiracy, making false statements, and obstruction of
Starting point is 00:02:25 justice, and an overlapping count for a total of 38 counts with Walt Nauta for the entire indictment. There was no count in there that involved the willful transmission of classified records, only the willful retention of national defense information, not the willful transmittal of national defense information. And we know from the indictment that Donald Trump willfully transmitted national defense information in Bedminster in New Jersey. And notice that special counsel Jack Smith did not bring a separate count for that in the indictment brought in the Southern District of Florida. So is special counsel Jack Smith involved in an ongoing criminal investigation in New Jersey? Is a grand jury impaneled in New Jersey in addition to Washington, D.C.?
Starting point is 00:03:26 Is other activity going to be taking place relating to charging Donald Trump for crimes that took place at Bedminster, New Jersey, where a new case, a separate case, could be filed in New Jersey for Donald Trump's willful transmission of the records, which is seen in paragraphs 6A and 6B, and also discussed later in the indictment where Donald Trump shows these random ghost writers for Mark Meadows' book. Hey, you see these plans? Aren't I better than Chairman of the Joint Chiefs of Staff Mark Milley? These are our plans to attack Iran. What do you think about this? Didn't I win? Aren't I a winner? And then he also transmitted other national defense information to an individual who is at his political action organization. So one thing special counsel Jack Smith can be doing is saying, look, let's take a look at Judge Eileen Cannon's orders. We're not going to charge Donald Trump for the
Starting point is 00:04:18 Bedminster conduct in Florida. That is more properly venued in New Jersey. And then if Judge Eileen Cannon is delaying this thing, let's file a separate case in New Jersey. I mean, I can't say my theory is 100% correct, but there are some, I think, Easter eggs in the recent motion for protective order filed by Special Counsel Jack Smith, where he talks about the type of information that needs to go under a protective order. And it talks about how the materials also include information pertaining to ongoing investigations, the disclosure of which would compromise those investigations and identify uncharged individuals. And I think one of the reasons that special counsel Jack Smith has insisted on this protective order, among other reasons, has a lot to do with that statement right
Starting point is 00:05:11 there as well, because it would be a violation of this protective order if Donald Trump learned through the documents produced by the Department of Justice that they are contemplating bringing additional criminal charges based on his willful transmission of national defense information. If Trump were to post about it, then Trump could be held in contempt of court, and Donald Trump could actually be placed in custody and remanded for engaging in that conduct. But it says, materials also include information pertaining to ongoing investigations, the disclosure of which could compromise those investigations and identify uncharged individuals. So what could those other
Starting point is 00:05:51 investigations be? I don't believe that's referring to special counsel Jack Smith's criminal investigation into Trump's conduct relating to the January 6th insurrection and Trump's potential wire fraud and Trump's campaign finance violations and the threats to local and state election officials, I think that may be referring to an entirely new criminal investigation or different criminal investigation that still may be going on in DC or in Benminster, New Jersey. This also has some support in a Department of Justice letter that they sent responding to Jim Jordan's attempt to try to interfere with Special Counsel Jack Smith. information, and prosecutions preserves the American people's confidence in the even-handed administration of justice by guarding against the appearance of political pressure or other

Disclosing such information could also violate statutory requirements or court orders, reveal roadmaps of our investigations, and interfere with the department's ability to gather facts, interview witnesses, and bring criminal prosecutions where warranted. Maintaining confidentiality also safeguards the legal rights, personal safety, and privacy interests of individuals implicated by or who assist in our investigations. And that letter was sent by an assistant attorney general, Carlos Urarte. But again, it's talking about other criminal investigations that could be still
Starting point is 00:09:11 taking place here. So Donald Trump was charged under 18 U.S.C. Section 793E, gathering, transmitting, or losing national, losing defense information. But Donald Trump was only charged on subsection E with the willful retention. So you see E, whoever having unauthorized possession of, access to, or control over any document, writing, code book, signal, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense or information relating to the national defense, which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits, or causes to be communicated, delivered,
Starting point is 00:10:01 or transmitted, or attempts to communicate, deliver, transmit, or cause to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit, or cause to be communicated, delivered, or transmitted, the same to any person entitled, not entitled to receive it, I believe applies to Donald Trump's conduct at Bedminster, having willfully communicated this information to people who shouldn't have it. Look at F, where Donald, where it states, whoever being entrusted with or having lawful possession or control of any document, writing, code, book, signal, sketch, photograph, photographic, negative, blueprint, plan, map, model, instrument, appliance, note, or information relating to the national defense through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust or to be lost, stolen, abstracted, or destroyed, or two, having knowledge
Starting point is 00:10:45 that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust or lost or stolen, abstracted, or destroyed, and fails to make prompt report of such lost, theft, abstraction, or destruction to his superior officer, shall be fined under this title or imprisoned for not more than 10 years or both. So could special counsel Jack Smith be charging Donald Trump with 793F if Judge Eileen Cannon tries to delay it and file that case in New Jersey federal court as a separate case? So I'm going to be looking out for that if that's what's going on. But I will say this one thing. On Friday, Judge Eileen Cannon did issue an order actually doing
Starting point is 00:11:33 the right thing. When Special Counsel Jack Smith put forward the protective order, Judge Eileen Cannon didn't assert that she was the one who should have jurisdiction to make the decision over the protective order. She sent it to the magistrate judge, which is what the actual procedure is. So at least in this first instance, Judge Eileen Cannon has followed the correct legal procedures with respect to a protective order. But does special counsel Jack Smith have in his back pocket the ability to charge Donald Trump in other jurisdictions for willful transmission or other criminal conduct relating to these records that will not be before Judge Eileen Cannon.
