I'm Ben Mycelis from the Midas Touch Network. Special Counsel Jack Smith set the perfect trap for Donald Trump, Trump's co-defendants, Waltine Nauta and Carlos
de Oliveira's counsel, and of course for Judge Eileen Cannon. And special counsel Jack Smith,
thinking multiple steps ahead, knew how Judge Cannon was going to react, knew how the lawyer for Trump's co-defendant,
Waltine Nauta, was going to react, and Jack Smith was ready and just filed a pitch-perfect reply brief.
Let me tell you what went down.
This all relates to the case, a criminal case against Donald Trump
and now two co-defendants in the Southern District of Florida
for Donald Trump's willful retention of national defense information, stealing classified and top
secret documents and keeping it in Mar-a-Lago, as well as counts for making false statements
and obstruction of justice against Trump and Trump's co-defendants, Waltine Nauta, his valet. And then in a superseding
indictment, Carlos de Oliveira, the maintenance worker at Mar-a-Lago, was brought in as a
co-defendant then. So what special counsel Jack Smith did was he brought not one, but two Garcia motions raising to Judge Eileen Cannon the unwaverable conflicts of interest
that exist with Donald Trump's political action committee paying for the lawyer, Stan Woodward,
and also another lawyer, John Irving. Woodward is representing Waltine Nauta. Irving is representing Carlos de Oliveira.
Those lawyers being paid by the PAC also have represented multiple witnesses who may be
providing testimony, because they're being paid by the PAC, who may be providing testimony that is adverse,
that would be incriminating to the clients, criminal defendants, Waltine Nauta, as well as
Carlos de Oliveira. And in this reply brief that Jack Smith filed, he conclusively stated, look what happened with Stan Woodward, Judge. This is why we need a
Garcia hearing. And what Jack Smith lays out, if you've been following us on the Midas Touch
Network, this is what we said we believed happened, and this is exactly how it went down,
that employee number four, who we've identified here, it's not identified in Jack Smith's motion,
but it's Usul Tavares, the head of IT, was represented by Stan Woodward. So Stan Woodward
represented Waltine Nauta as well as Usul Tavares. Prior to the indictment being handed down in the Southern District of Florida on June 8th of 2023.
Special Counsel Jack Smith was engaged in an ongoing criminal investigation.
And as he held interviews with his teams, with many, all of the witnesses,
Usel Tavares was one of the witnesses.
Usel Tavares showed up in Jack
Smith's office, represented by Stan Woodward. And as Jack Smith explains, Yusel Tavares, the head
of IT, lied and said that he did not know anything about the surveillance footage. He knew nothing
about the classified documents. That was a lie. And Jack Smith, through his other subpoenas and
warrants and investigative work, knew that Yusel Tavares, along with Carlos de Oliveira,
the head of maintenance, along with Walti Nauta and Trump, collectively discussed destroying surveillance footage, constituting the crime
of obstruction of justice. So by lying in March of 2023 to Jack Smith and investigators,
that became an independent crime as well that Tavares committed, that Carlos de Oliveira committed, that Waltine Nauta committed as well. And so Jack Smith knew
that. Now, Jack Smith indicts Donald Trump and Waltine Nauta June 8th, 2023. But the grand jury
in Washington, D.C. continues its work specifically regarding the false statements made
by Yusel Tavares and by Carlos de Oliveira. Remember, it wasn't until the superseding
indictment that Carlos de Oliveira was brought in as a defendant in this action. So as of June 8,
2023, it was just Trump and Waltine Nauta who were criminal defendants in this action. So as of June 8th, 2023, it was just Trump and Waltine Nauta who
were criminal defendants in that action. So because the false statements were made to Jack
Smith by Carlos de Oliveira and Usel Tavares in DC, Jack Smith, even though he indicted Donald
Trump in Florida, continued to use the Washington DC grand jury, which is
presided over by Jeb Boasberg, to address the false statements. Jack Smith made a brilliant
move here, which Judge Eileen Cannon seems to be taking issue with, but Jack Smith addressed
exactly what went down and kind of called Eileen
Cannon out in this motion. You see, what Jack Smith did is after he brought the indictment on
June 8th, 2023, which was voted on by a Florida grand jury because the crimes of willful retention
of national defense information by Trump were committed at Mar-a-Lago, so it was properly venued in Florida. Then the next week,
Jack Smith goes to Jeb Boasberg, who's presiding over the DC grand jury, and says,
we need to hold a Garcia hearing because it is vital to inform and to have a hearing where
Yusel Tavares, the head of IT, knows about this potential conflict of interest.
And let's see if Yusel Tavares wants to hire or bring in his own lawyer because he could be
appointed a federal public defender to represent him and he can know that he has that right.
So he doesn't have to be represented by the lawyer being paid for by Donald Trump's Political Action Committee.
So Jeb Boasberg held a hearing and informed Yusel Tavares.
This was after the first indictment of his rights.
And Tavares was like, and he had just received a target letter around that, that he could
be potentially criminally prosecuted.
And then Tavares was like, I don't want to be represented by Stan Woodward
anymore. I want to have a federal public defender represent me and I'm ready to tell Jack Smith the

was represented by truly independent counsel, and this is why these Garcia hearings are very, very, very important,
told Jack Smith, you know what happened was that Carlos de Oliveira and Trump and Walti Nauta
wanted to destroy surveillance footage. And Jack Smith, I lied to you before. So in exchange for
cooperation with independent counsel, Jack Smith did not charge Yusel Tavares, but charged Carlos
de Oliveira, who is being represented by John Irving, another lawyer being paid for by the Trump
political action arm. So Judge Eileen Cannon was then recently, about two weeks ago, was apparently watching Fox, where one of Trump's surrogates
and former lawyers, Jim Trustee, called out the Washington DC grand jury proceedings as being
improper because on her own, Judge Eileen Cannon demanded that Jack Smith submit a brief on the propriety of using a Washington, D.C. grand jury to develop evidence while a case was pending in Florida.
And because Jack Smith then had also teed up the Garcia hearings, he was ready, Cannon, you want to know why we did it? Because there were false statements that were made by Tavares and Carlos de Oliveira in Washington, D.C.
And Yusel Tavares told us the truth. And now what we're doing here is exactly, Your Honor, what we did in D.C. Because now that Carlos de Oliveira
and Walti Nauta have been charged here, we now are going to, Your Honor, and you should be doing
exactly what Jeb Boasberg, the federal judge who presides over the Washington, D.C. grand jury did.
Because Jack Smith realized, too, that Judge Eileen Cannon is so corrupt that if you just went to her
and asked for a Garcia hearing on her own, she probably wouldn't grant it and she wouldn't
inform the defendants of the potential conflicts of interest and what the issues are. So Jack Smith
now is like, look, and this is going to, if Cannon denies a Garcia hearing done in the way that Jack
Smith wants to do it, Jack Smith's going to go and get the appeal to the 11th Circuit Court of
Appeal and say, look, this is what the DC judge, Jeb Boasberg did, federal judge. And look, it
turned out that while represented by a Trump paid for lawyer, he was lying. And then once he had
independent counsel, he told the truth. And so what Jack Smith is focused on right now is I think
he realizes that Trump is not letting Walti Nauta out of his sight at all. But I think Jack Smith
realizes that Carlos de Oliveira, the head of maintenance,
he should know that the main reason he's being charged is because he decided to lie. He decided
to have the Trump-appointed lawyer, the Trump-paid-for lawyer, instead of independent counsel. But see, now Jack Smith, through this reply, can also be telling Carlos de Oliveira and
sending a message there that maybe Carlos de Oliveira's lawyer, John Irving, is not
delivering, which is, if you cooperate, there will be leniency on you.
You are being dragged down here by Donald Trump.
Why are you doing that?
You're going to destroy your future.
I think that's what Jack Smith is focused on here.
And so when Eileen Cannon said, please talk to me about the propriety of the grand jury
in D.C., Jack Smith was like, bet.
I'll tell you about the propriety of D.C.
The propriety is that false statements were made to us in Washington, DC
when these people were represented by Trump's lawyers. And then when the DC judge appointed
an independent lawyer, Usel Tavares told us the truth. And to examine false statements,
which is an independent crime committed in Washington, DC, we needed to utilize that
grand jury. And by the way, judge, we've been keeping you informed of this.
We've been notifying you of this, Judge Cannon.
So now Judge Cannon, she's been outmaneuvered.
I mean, what does Judge Cannon, she's going to what, reject the Garcia hearing and not
inform Carlos de Oliveira and Walti Nauta of the conflicts, not go through the ramifications.
What's she going to do? Walti Nauta's lawyer, Stan Woodward, is telling Judge Cannon,
and this is what Jack Smith is pointing out, that he wants, Stan Woodward, the Trump paid
for lawyer, wants to now suppress the testimony of Yusel Tavares as a remedy for the conflicts of interest that Stan Woodward and Trump are responsible for.
By the way, that's the kind of absurd ruling that I wouldn't be shocked if Judge Eileen Cannon makes suppressing the evidence of Yusel Tavares. But all of this, Jack Smith has put the chess
pieces perfectly in place for an appeal and to try to get Judge Cannon removed as he's moving
up all of his other cases, as he's moving up the case in Washington, D.C. before Judge Tanya
Chutkin. So this is brilliant strategizing here by Jack Smith.
And now the ball's in Judge Eileen Cannon's court.
You know she's going to make the wrong ruling here.
She always makes the wrong ruling.
And when she does, because she's created this tangled web and Jack Smith was ready, here's
what I did at DC.
That's the propriety.
Here's why we need the Garcia hearing.
And you're going to create a situation, Judge Cannon, where you're basically furthering criminal conduct. You see how he set the perfect trap there? And now she's going to
have to do an order. You know she's going to make the wrong order. So we'll follow up what happens
there. But that's what this reply is. Reply in further support of government's motion for
