We are learning that Stephen Miller, a former top advisor to Donald Trump and Donald Trump's former speechwriter, appeared on Tuesday before the criminal federal grand jury in Washington, D.C., investigating crimes relating to the January 6th insurrection, as well as 2020 election interference. And their investigation, of course, includes potential crimes committed by Donald Trump. Now, Stephen Miller is the first witness to be called before the federal criminal grand jury since Jack Smith took over the investigation, the criminal investigation of Donald Trump as part of his appointment as special counsel after being appointed by Attorney General Merrick Garland. Now, the fact that Stephen Miller, a former top aide in the executive branch, was questioned by the federal grand jury in Washington, D.C. on Tuesday,

tells us a number of things that we can draw from this. So the first thing that it tells us is that Jack Smith is pursuing this investigation in a very aggressive manner, too. It tells us that Jack Smith hasn't missed a beat in his criminal investigation. And third, it tells us that Donald Trump is now unable or is struggling in his ability to assert these frivolous privileges, which he had been fighting the Department of Justice for many months. And specifically, Donald Trump had previously been asserting executive privilege. And as we reported here on the Midas Touch Network, the Department of Justice had to go before the presiding judge, Judge Beryl Howell, who oversees these criminal grand juries in Washington, D.C., and to actually get an order from the judge, which took place back in October

after a lot of these issues were raised several months back, where witnesses, for example, Mark Short, the former chief of staff to former Vice President Pence, and Greg Jacobs, the former general counsel to former Vice President Pence and Greg Jacobs, the former general counsel to former Vice President Pence. They said, look, we want to answer your questions, but Trump's asserting executive privilege. We're happy to answer questions about our communications with Donald Trump. Just get us a court order that says that we can testify on these things and we'll answer those questions.

And also note this, that those individuals did not answer those questions before the January 6th committee. They continued to assert the executive privilege, but the Department of Justice successfully prevailed before Judge Beryl Howell with respect to Mark Short and Greg Jacobs, which I believe to basically be a precedent-setting ruling for all of these other individuals who have the same issues, like Pat Cipollone, Trump's former top lawyer, and Cipollone's top deputy, Patrick Feldman, when they're asserting executive privilege. Now the Department of Justice just points to Judge Beryl Howell's prior orders with Short and with Greg Jacobs and says, look, you've already ruled that executive privilege

doesn't apply here. And so the fact that we now have this testimony from Stephen Miller, who ostensibly would be someone asserting executive privilege. Now, grand juries take place in secret, so we don't specifically know what transpired during the testimony. But the fact that the testimony lasted a significant duration, it's believed to have taken place over many hours. There has not been any leaks of any assertion of executive privilege.

Leads us to believe that the Department of Justice has really successfully prevailed in stopping Donald Trump's bogus assertion of executive privilege and is able to get to the heart of the matter, these communications with Donald Trump. Now, Stephen Miller is a very important figure for a lot of reasons in the criminal investigation here. He was an important figure in the Trump White House as well, and he should never have been an important figure based on how despicable his views are and how incompetent he is. But he was a major figure in the Trump administration as it relates to the January 6th insurrection. He had apparently removed from the speech on the Ellipse the references to Vice President Pence at the request of other lawyers who worked or lawyers who worked within the White House who said, you can't threaten Vice President Pence like this. And so in the speech, Stephen Miller removed

references to Vice President Pence and removed other references that the lawyers told them could in fact be criminal in nature, inciting a violent mob to kill former Vice President Pence and to attack the Capitol. But then we know that Donald Trump added that stuff back in himself after the fact. And that's just one instance, an example that Stephen Miller will be able to provide in his testimony. But now that the executive privilege is likely not to apply, it should never have applied in the first place, but Donald Trump still was permitted to at least assert it, even though it was frivolous. We had to get a court order. The Department of Justice had to get a court order to overrule it. But now the Department of Justice can ask questions that the January 6th committee couldn't. And we know that Pence spoke before the January 6th committee back in, I believe it was

April, for over eight hours, but weren't able to get at what did Donald Trump specifically say to you because of the assertion of executive privilege. Now the Department of Justice, as part in the criminal investigation of January 6th is proceeding earnestly. Stephen Miller is a very high level person to be questioned. We will undoubtedly hear more about others being questioned. We know, for example, the Department of Justice and Special Counsel want to question Mike Pence. And so you climb the ladder and Mike Pence doesn't really have any good explanation here about why he couldn't testify. But this is why you got to build the case diligently brick by brick, because if you just rush this thing, you would never have

gotten this type of testimony that we are seeing right now. And so we'll keep you posted here on the Midas Touch network of any additional updates of new witnesses who are being questioned. Oh, by the way, it's important to note that the actual person who questioned Stephen Miller here was not Jack Smith, but was Thomas Windham. Thomas Windham was leading the investigation previously before the special counsel. And it is believed that Windham will now be folded into the special counsel's operation. But you have Jack Smith, the special counsel, and Thomas Windham, who are probably the two top prosecutors in the country right now who are now both working hand in hand, which is Donald Trump's worst nightmare in this situation.
