That is a video that Donald Trump released and we call that in the legal field 404 evidence
under the federal rules of evidence.
And that is something that special counsel Jack Smith will
undoubtedly use at the time of the federal criminal trial in Washington, D.C. I also think
that Fulton County District Attorney Fawnie Willis is going to use that in the Fulton County RICO
case against Donald Trump and his various co-defendants in that matter. So what Rule 404
of the Federal Rule of Evidence state is that normally character
evidence is inadmissible to show the propensity of somebody to act a certain way. However,
there are exceptions in 404B, and Rule 404B says if the behavior demonstrates notice, goes to a criminal defendant's intent, if it shows a common plan and scheme,
if it shows a pattern of engaging in the same criminal conduct. And there in that video that
you saw at the outset is something that would be admissible. And what it shows is that throughout
Donald Trump's life, no matter what the circumstances, if he believes he's going
to lose or no matter what, he claims that there's a fraud. He claims that there is some massive
conspiracy to try to rig an election against him. It goes to Donald Trump, no matter what,
denying the results of free and fair elections. And back on December 5th,
special counsel Jack Smith gave notice to the federal court in Washington, D.C. that he intends
to introduce federal rule of evidence 404B material. By the way, just like the video that
you just saw. Now, Donald Trump just released that video. I think he released it before as well or a variation, but he just released that video yesterday. And so this is the type of evidence that Donald Trump keeps generating for special counsel Jack Smith's December 5th brief. So you can see for yourself, here it is.
Government's notice pursuant to federal rule of evidence 404B, and it says the government will
provide the defendant in court extensive advance notice on the intrinsic evidence it plans to
introduce at trial, including through its exhibits and witness lists, motions eliminate, and a
detailed trial brief setting forth the government's
planned trial presentation. In the abundance of caution, the government below notices evidence
that although intrinsic to the charged crimes, pre- or post-dates the charged criminal conspiracies,
if the court were to find that any part of the noticed evidence below is extrinsic,
the evidence is also admissible under federal rule of evidence 404B because the government will offer it not to show
defendants criminal propensity or character, but to establish his motive, intent, preparation,
knowledge, absence of mistake, and common plan. And then it says over here, Donald Trump's historical
evidence of defendants' consistent plans of baselessly claiming election fraud.
As set forth in the indictment, the defendant's criminal conspiracies relied on his knowingly
false claims of election fraud. At trial, the government will introduce a number of public
statements by the
defendant in advance of the charged conspiracies, claiming that there would be fraud in the 2020
presidential election. These statements sowed mistrust in the results of the presidential
election and laid the foundation for defendants' criminal efforts. In addition to this intrinsic
evidence of false statements about the 2020 election, the government will offer evidence reflecting the defendant's historical record in making such claims.
For example, as early as November 2012, the defendant issued a public tweet making baseless claims that voting machines had switched votes from then-candidate Romney to then-candidate Obama. During the 2016 presidential campaign, the defendant claimed repeatedly with no basis
that there was widespread fraud, including through public statements and tweets.
For instance, on October 17, 2016, tweeting,
of course there is large-scale fraud happening on or before Election Day.
Why do Republican leaders deny what is going on?
The defendant's false claims about the 2012 and 2016
election are admissible because they demonstrate the defendant's common plan of falsely blaming
fraud for election results he does not like, as well as his motive, intent, and plan to obstruct
the certification of the 2020 election. And you notice that in the prior paragraph,
special counsel Jack Smith says not only Donald Trump's statements that predate the 2020 election,
but also statements that post date and special counsel Jack Smith did not have that video
that I just played for you at the outset of the video because Donald Trump had not made that
statement yet. But now that becomes
evidence as well. I just want to show you this clip here. This is from a recent speech also that
will undoubtedly, I think, be used as 404B evidence by special counsel Jack Smith. And here at this
traveling fascist circus thing that Donald Trump calls a rally, here's what he says. Play the clip.
I'm proud and strong. Election, I'm a very proud election denier. He says, I am a very proud election
denier. And let's just take a look at the evidence that special counsel Jack Smith will have in his
possession. Take a look at what Donald Trump said in on February 3rd, 2016 about the Iowa primaries.
This was in 2016.
Donald Trump lost to Ted Cruz in the Iowa primaries.
Donald Trump said the following.
The state of Iowa should disqualify Ted Cruz from the most recent election on the basis
that he cheated, a total fraud.
Ted Cruz didn't win Iowa.
He stole it. That is why all of the
polls were so wrong and why he got far more votes than anticipated. Bad. Ted Cruz should be
disqualified from his fraudulent win in Iowa. Weak RNC and Republican leadership probably won't let
this happen. Based on the fraud committed by Senator Ted Cruz during the Iowa caucus,
either a new election should take place or the Cruz results should be nullified. And all of those
are from February of 2016. February of 2016. Donald Trump has a pattern of engaging in this behavior, a common plan and scheme, as he says, of being a
proud election denier. That is who he is. Let's take a look at this montage that the Washington
Post created. This is a very powerful video right here where they show Donald Trump's history of
denying the results of elections and saying that he won't accept the results of the election.
All of this is the type of evidence that special counsel Jack Smith is going to introduce.
And I think that Fulton County District Attorney Fannie Willis will introduce at their respective trials.

The Republican Party had any guts, they would have terminated Cruz from that election because honestly, he cheated like a dog. And I would have won Ohio had I not been given a dirty poll
saying that Florida was tougher than I thought.

Isn't it amazing the way they say there's no voter fraud?
Folks, it's a rigged system, and it's a rigged election.
Believe me.
If you look at voter registration,
you look at the dead people that are registered to vote,
who vote.

We're gonna find out but it could very well be that much, California

is if this is a rigged election.

transferal of power after the election?

December 5th of 2023, one of the other categories of evidence that special
counsel Jack Smith is going to introduce is what he refers to as post-conspiracy evidence
of defendant Donald Trump's steadfast support and endorsement of the rioters. This is Donald
Trump saying that he stands in solidarity with the January 6th
terrorists. And in fact, that Donald Trump sings songs with the terrorists and has a band. He made
a musical with the January 6th insurrectionists in jail. For real, it's something that Donald
Trump did. Here's what Jack Smith writes in his brief. As described in the government's opposition to another motion
by defendant, the government plans to introduce evidence at trial showing that in the years since
the January 6th attack on the Capitol, defendant Donald Trump has openly and proudly supported
individuals who criminally participated in obstructing the congressional certifications
that day, including by suggesting that he will pardon
them if reelected, even if as he has conceded that he had the ability to influence their actions
during the attack. Of particular note are the specific January 6th offenders whom the defendants
supported, namely individuals convicted of some of the most serious crimes charged in relation
to January 6th, such as seditious conspiracy
and violent assaults on police officers.
During a September 17th, 2023 appearance
in Meet the Press, for instance,
defendants said regarding Proud Boys leader Enrique Tarrio,
who was convicted of seditious conspiracy,
I want to tell you he and the other people
have been treated horribly.
Let's play that clip.
Proud Boys leader Enrique Tarrio was sentenced to 22 years in jail. Now that you know what the
sentence is, 22 years in jail. Will you give him a pardon? Will you give other Proud Boys a pardon?
I don't know him. I never met him. I never heard of him until I started reading this.
Will you pardon him?
But I want to tell you, he and other people have been treated horribly. Will you pardon him? But I want to tell you, he and other people have been
treated horribly. Will you pardon him? In Minneapolis, I'd certainly look at it. I'd
look at that and I'd look at all the other people that have suffered, the J6 people.
Back to special counsel Jack Smith's motion. The defendant then criticizes the kinds of lengthy
sentences received only by defendants who, like Tarrio, committed the most serious crimes on January 6th.
Similarly, the defendant has chosen to publicly and vocally support the January 6th choir,
a group of defendants held at the District of Columbia Jail,
many of whose criminal history and or crimes on January 6th were so violent
that their pretrial release would pose a danger to the public.
The defendant nonetheless has financially supported and celebrated these offenders,
many of whom assaulted law enforcement on January 6th by promoting and playing their recording of the national anthem
at political rallies and calling them hostages.
First, let me show you this video of Donald Trump in an interview with Hannity saying
that him and the January 6th choir do better than Taylor Swift and other singers. Play this clip.
By the way, that's sort of like- Are you really beating Taylor Swift, by the way?
Yeah, I did. The J6 is beating Taylor Swift. It's Donald Trump and the J6 prisoners.
The Pledge of Allegiance. And on iTunes and on Amazon and on Billboard, which is the big deal.
Number one, Donald Trump.
So now I feel like Elvis because now we've done The Apprentice.
That was a great success.
We did.
Now I've done now I've done a recording or whatever you call it.
But no, it was number one.
And you know what that is?
That's a tribute to the fact that people feel
the J6 people have been very unfairly treated. I'll show you. This is Donald Trump at a traveling
fascist circus thing he calls a rally where he brags about it as well. Play the clip.
And they asked me whether or not I would partake and do the beautiful words. And I said, yes,
I would. And you saw the spirit.
The spirit was incredible.
And when that came out,
it went to the number one song.
It was beating everybody. It beat Taylor Swift.
It beat Miley Cyrus,
who was number one and two.
They were number one and two.
We knocked them off for a long time.
And here's a video of Donald Trump
calling the
January 6th insurrectionist hostages. Play the clip. Minneapolis where they took over the police station. They took it over and they burned it
down. By the way, what happened to those people? Are those people in jail with the J6 hostages?
What happened to those people? Come to think of it, they're not in jail with the J6 hostages.
I don't call them prisoners, I call them hostages, hostages.
And then special counsel Jack Smith goes on to say in the brief that he calls these people like the Proud Boys and the Oath Keepers patriots.
And then he says that he will pardon them. Play the clip.
There'll be a lot of pardons and commutations of people that
you think were treated unfairly. J6 defendants, January 6th defendants under an administration,
your administration. Yes, absolutely. So I wanted to show you at the outset the new evidence that
Donald Trump is generating for special counsel Jack Smith. And now, you know, 404B, what it
looks like, and then show you the other evidence that special counsel Jack Smith
has amassed and continues to be amassing against Donald Trump. And if by the end of the time you
watch this video and you say to yourself, wow, that's not disqualifying. I mean, I think you
have to take a deep look and work to then.
So, I mean, share this video with family members, friends, colleagues, coworkers, whoever,
