President Biden attended the Firefighter Union's annual gathering and was praised by the president
of the Firefighter Union before a packed crowd as the best president in the history of the United States for firefighters.
Look, President Biden delivers for first responders. It's not about empty slogans or
BS promises. It's just about doing the hard work. By the way, Biden gave a great speech there about how his policies are actually honoring
the work of first responders like firefighters. We will discuss and compare this to what took
place at Colt Pack. I mean, CPAC, headlined by Brazil's insurrectionist Jair Bolsonaro
and America's insurrectionist Donald Trump. Donald Trump gave
quite possibly the most bizarre and low energy speech ever before a very small crowd saying
he doesn't know the word subpoena. He's never heard of that word, nor has he heard of the word
grand jury. He called the criminal investigations into
him a quote lynching. He of course bragged about his relationship with Vladimir Putin.
He called the porn star he paid hush money to a horse face and he told the crowd he should be
elected so that he could be their quote retribution. And by the way, Don Jr. had to bribe guests
to attend his daddy's cult pack speech with fake golden chocolate candy bars.
You can't make this up. Look, Trump is terrified, and frankly, he should be.
In the Manhattan District Attorney's criminal investigation,
Trump's former trusted aide, Hope Hicks, met with these Manhattan prosecutors on Monday,
this after Kellyanne Conway met last week. And I've said before, and I'm going to say it again,
many have doubted me, many have criticized me for saying it. I've always said that the Manhattan District Attorney is going to be the first to criminally indict Donald Trump. And by the way,
I have said that before and everyone's like, no, no, no, you suck, Ben, you're wrong.
I'm telling you. Is that what they say? I don't know. That's a very unpopular opinion that I have.
But I'm telling you, I've always said that if you
follow it, and I still believe it's true. Now, turning to Jack Smith's criminal investigation
at the federal level, look, Donald Trump is trying his usual shtick, right? Delay, delay,
delay. He's trying to delay Jack Smith's criminal investigation, and Trump is failing. We just learned that Donald Trump
filed a new motion, this one, a motion to exclude testimony that was already given to DC federal
criminal grand jury members by his former top White House lawyers, Pat Cipollone and Patrick
Feldman. This is another motion that Donald Trump is almost certainly going to lose.
But when you look at what Donald Trump is saying and you see his actions that are taking
place behind closed doors in federal court, you know that things are getting really, really
bad.
And so Trump is lashing out like a maniac against all these prosecutors, right?
He's calling Alvin Bragg and Fannie Willis
racists. He's calling Jack Smith an animal. And he's accusing prosecutors of, quote,
torturing witnesses by flying the witnesses on economy class to Washington, D.C., or where their
respective grand jurors are located, paying for their Ubers and lodging to have them testify
before the different grand juries. Trump says that is torture. What a man of the people.
To a snowflake trader, sweet Justice Jordy, just seems so unfair. This is the Midas Touch podcast.

So let's get right into it, folks. And I think the best way to get into it is let's compare a speech by President Biden, where he gave the speech, who he gave the speech to, his messaging in the speech. And let's compare it to the speech that Donald Trump gave around the same time. And let me just say, Ben, buckle your seatbelts, everybody, because you are going to get some whiplash on this episode of the Midas Touch podcast
when you see the contrast, when you see these clips play back to back. So buckle up, folks.
It's going to get weird. Before it gets so weird, that's actually why for this episode,
I want to start with Biden's, which is so not weird. I almost want to ease into
these Trump clips because it is some of the most deranged, unhinged, weird buckle up for this
episode. But first, let's talk about today where President Biden spoke before a packed house of professional firefighters at the International
Association of Firefighters 2023 Legislative Conference. This conference gathered the
leaders from the firefighting profession in Washington, D.C. to meet with lawmakers. And
during his remarks, President Biden recounted numerous anecdotes involving firefighters and other first responders and talking about the efforts his administration has made to improve safety for firefighters. of the Firefighter Association, the International Firefighters Association,
talking about President Biden and saying, look, you get it. You get us. Play the clip.
Well-deserved, Mr. President. I can tell you I've listened to a lot of politicians talk.
We hear things that are nice to hear, like we run in when others run out. You are the only person I've ever heard say that the only thing that makes firefighters safer is more firefighters.
You get it. You get us. In just two years, you have clearly established yourself as the greatest president firefighters have ever had in this country.
Thank you so much.
You're making our very dangerous job as safe as it possibly can be, one leadership decision at a time, and we thank you.
And we thank you on a personal level.

You know, when you cut through all of the performative stuff, have a little blue stripe on a flag and just start shouting it out.
But the question ultimately is, and I think Americans are waking up to it, is that everything Donald Trump does, it's Don the con.
His whole life is conning people.
What he spews out of his mouth are just
complete lies, the promises, complete and total BS. So what you have to do is not just take the
words, you have to take the actual action. So here's President Biden talking about the dangers
of the job of firefighters, the risks associated with it. Play this clip.
I've done more firefighter funerals than I want to acknowledge. The only thing that protects you
is more firefighters, more firefighters. In 2022, there were 99 line of duty deaths.
I've been, as I said, far too many firefighter funerals in my life. And I know too many of you are dealing with cancer from chemicals and toxins on the job and in your gear.
It's wrong. It's wrong.
Let me tell you something.
I have your back.
Eddie just talked to me about the three requests he has.
And I won't go into them now, but I'm going to push all of them.
And I promise you, I promise you, you've had my back and I'll have yours.
You know what I...
I know you know that the things that protects firefighters, again, I'll say it again and
again, is more firefighters.
So what does it mean to have the backs of firefighters?
It's not just saying the word, right?
It's actual tangible
steps. And President Biden goes into it. For example, he talks about the need to protect
collective bargaining and the dignity of having a job and well-paying jobs. Play this clip.
My dad used to have an expression. He said, Joey, a job's about a lot more than a paycheck it's about your dignity it's
about respect so being able to look at your child and say honey it's going to be okay
that's why I fight so damn hard to protect your right to collective bargaining
and here's a bill that President Biden actually signed that gave firefighters and their families
workers' compensation for certain kinds of heart problems, cancers, and other ailments.
Actually doing the hard work. Play the clip.
In December, I was proud to sign the Federal Firefighters Fairness Act,
giving more than 10,000 federal firefighters and their families critical workers' compensation
and other benefits by making sure certain kinds of heart problems,
lung disease, and cancers are presumed to be caused by the job.
But we can do more, and President Biden asks Congress to actually do something the way when the Democrats
controlled it, they were doing something. And Biden asked Congress pass the Honor Act to extend
the Public Safety Officer Benefit Program to cover firefighters who die from cancer. Play this clip.
Senator Globuchar and Congressman Pasquarell are working on what
they call the Honor Act to extend public safety officer benefit program to cover firefighters
who die from cancer. I support it. Congress should introduce it, pass it, and get it to my desk for
me to sign it. We can't lose sight of the fact that that is actual what governance is. That is what governance
looks like. And when you compare that to what's going on in MAGA Republican land,
the contrast cannot be more stark. I mean, this is from the cult pack convention over the weekend.
This is from Don Jr.
Because very few people even showed up to this thing, which is supposed to be their big conference.
Don Trump Jr. had to bribe people to show up at his daddy's speech with fake golden
chocolate candy bars as the magical ticket to get into the don trump speech like this is some
this is deranged unhinged stuff here play this clip uh check under your seats
if there happens to be a gold chocolate bar underneath there that's a vip oh I'm not joking, that's a VIP ticket to my father's reception tomorrow
at CPAC.
Cause your president, President Donald Trump will be here, he's not out raising money from
the billionaire Chinese sympathists like others, you know.
Matt, they're gonna do that. Well others didn't show, I was like Matt, they're going to do that. Well, others didn't show.
Again, they're raising money from the people who don't necessarily believe in America first,
but because they need their money.
So who's got gold bars?

Well, I think you guys will have an awesome time.

You're trying to get under other seats?
They're ballot harvesting, Matt.
By the way, my political speech for the day,
if we don't start doing the same thing that Democrats do, none of it matters.
What kind of Willy Wonka BS is that?
I was going to say that.
That is the worst sequel to Willy Wonka of all time.
Just bizarro land.
And so what the folks listening can't see
are people going to other seats throughout the venue because most of the seats in the venue are empty.
So they set these bars under seats, most of which are empty, and they're telling people, check under your seats for the prize.
However, most people aren't sitting at seats that have the prize because most of the seats are empty.
So the people are running across the room, running across empty seats to try to find these.
And what we're going to see throughout all of this is you already saw the calm competence,
the getting stuff done of President Biden, doing it quietly, doing work for all Americans,
appealing to all Americans.
And what we're going to see
in watching these clips that we're watching, starting with that one, is a cult that is
simply trying to placate their cult. And that's it. They've realized, they've almost given up at
this point on even appealing to regular Americans. They've almost given up on appealing to independents, to moderates, because they are just so weird, so bizarre. And you just see them go all in to just try to energize
this cult as much as possible. How perfectly Trump is that clip that we just, I'm talking Trump
family. They're just so totally incompetent that of course the plan that he probably thought out
haphazardly doesn't work when he tells people to look under their freaking chairs for the golden chocolate bar.
I mean, it's just so, they're just so unserious.
And that's probably for me what the most frustrating part about people being sucked into their
BS is just how unserious they are, these MAGA Republicans, the Trump family, comparatively
to people who are actually getting stuff done.
And I think one of the major themes that we saw earlier is that the people who are working,
like the blue collar folks, the folks that these policies are affecting in their daily lives,
they feel it. They do feel it. And that's been the coolest thing for me is just seeing,
you know, people who have not traditionally fallen to maybe, you know, the MAGAverse,
so to speak, not no longer falling for these tactics
and just being like, hey, I actually like the things that Pioneer are doing and I'm not afraid
to say it. And you see how the folks at CPAC, these MAGA cultists, I'm not going to underestimate
the danger of MAGA still because it is an extremely dangerous movement. But what is very
clear in watching these clips and in looking at the audience and in seeing the enthusiasm
and in seeing the infighting is seeing that MAGA is ultimately a dying movement.
Now, where does it go from here as it dies? It's going to evolve and that strain is going to be
out there in various forms. There'll be the Marjorie Taylor Greene strain, which is in your face. There'll be the Ron DeSantis strain, which is a
little more subtle, but maybe even more dangerous. That's what we need to look out for. But MAGA,
as we've traditionally known it over these past few years, is certainly dying, and people are not
buying the BS. And the pro-democracy community as MAGA is a dying movement, though.
Well, we need to be very clear about it. And it's why it's important to show that clip of
President Biden with the firefighters union. And you'll be able to show that Biden standing with
workers, not in a performative way, but through actual legislation and rebutting all of these false narratives that went unrebutted for many, many, many years with the new Democratic Party that's got its fight back, that is out there these former MAGA Republicans, when they're like, what is going on here, that they know, though, that, look, all of the things that you've been fed, this diet of propaganda from Fox and OAN about leftists and it's Marxism and all of these things and Mr. Potato Head and Green M&M and Skittles and Dr. Seuss and pronouns and all of these things,
that all of that is just complete and total BS. I mean, the thing that they talked about as the
most pressing issue at CPAC with all of the speakers before Donald Trump is bathrooms.
They just talked about bathrooms all of the time.
And they wouldn't even ask the question. They would just say, I'm going to have to ask you
to respond to this. Bathrooms. I mean, when you wake up in the morning, I have to go to the
bathroom. But other than having to go to the bathroom, then I don't think about the bathroom anymore
for the rest of the day. And the fact that the top thing in their mind is bathrooms
is a very, very, very strange thing. Brett, you talked about the infighting. So let's get into
these clips from Trump's speech though. And the purity test right now is such that people like Jeb Bush
and Karl Rove, people like Paul Ryan, they're not even viewed as Republicans anymore. So what
Donald Trump wanted to be very clear about is that these people, he says, are freaks. He calls them freaks and spends a lot of his time
attacking. If you're not a MAGA Republican and you're still calling yourself Republican,
you're a freak, he says. Play this clip. When we started this journey, a journey like there has
never been before. There's never been anything like this. We had a Republican party
that was ruled by freaks, neocons, globalists, open border zealots, and fools. But we are never
going back to the party of Paul Ryan, Karl Rove, and Jeb Bush. Think about that that he think he calling them freaks and by the way let me say i think
he's right about it i think they are freaks but if they're freaks maga are super freaks you know
like carl rove not like not like super freaky like like no not like super freaky
we can't get claimed on YouTube.
So I'm not going to, my voice probably triggers it because I'm going to sound just like the
recording.
So I'm going to-
It's true.
You have a great voice.
Voice of an angel.
But no, he's so close there, right?
Like Colorado, Paul Ryan, Jeb Bush, horrible.
All of them, horrible.
The antidote to that is not MAGA.
Like they doubled down on all that and became crazier and crazier and crazier.
And it shows you how far right they become, that they look at somebody like Karl Rove and they go,
lib, liberal, Democrat. In what world? In what world?
Well, to your point, Brett. Yeah, Jordy, go.
Just replace MAGA with freak when he's talking. He's an ultra freak, man.
I mean, what these people are doing, you know, it's one thing when you disassociate yourselves
from other Republicans and start calling them rhinos.
But when you're going to look at your base, people who bend over backwards to try and
find ways to support you and you start calling them freaks, like just the average, you know,
the citizen, the voter, you're going to start turning on them.
They're not going to respond too kindly to that i'll tell you majority then he's like paul ryan carl rove jeb bush
they're freaks stormy daniels you're a horse face i mean at the same time it's like you know it's
like what you play play the clip this is what he's calling the porn star that he paid hush money to,
that he had two seconds of sex with.
He's calling, he's saying, not a fair horse face.
After calling them not freaks, play this clip. Remember the days where if a politician spelled potato incorrectly, that would be a major
scar on their reputation, or if a major news story would be, oh my God, Obama wore a tan suit. Wow.
Donald Trump is calling a porn star who he paid hush money to a horse face after calling the
other Republican leaders freaks. And then that's somehow normal. By the way, I was listening before
the podcast started for a second. My fiance was playing one of these news
channels and they were like, the Republicans, like these people, like they're almost treating
them like it's like the way it was framed on one of these shows. Like, like they're a normal,
like it's like a normal political party. I'm like, they're led by someone calling a porn star,
a horse face. And then he's called. And by the way, it's not done there.
Then he goes, he goes, I just imagine though, just imagine for one second, like, put this
in your brain.
It's unfathomable.
Imagine for one second that President Biden had sex with a porn star already.
We're already in insanity land, right?
We're already like, what?
Imagine the reaction to that alone.
Okay. right? We're already like, what? Imagine the reaction to that alone, okay? Then imagine he
paid hush money to cover it up using campaign funds or whatever the hell Trump did. Okay,
number two. Then imagine he repeatedly calls that woman horse face and then calls the prosecutor
investigating it a racist. It's unfathomable to even understand.
What a racist. The other a mad dog psycho animal.
Can I just say this too real quick? The horse face comment is despicable, misogynist, just gross.
That's the second weirdest part of the clip. Why does he keep throwing in no affair, no affair?
I mean, it was an affair. He was married, he had a kid, and while he was
married and had a kid, he had sex with somebody else. That is probably the definition of what-
While his wife was pregnant.
The definition of having an affair is exactly that. So no affair. What the hell is that?
It is a funny addition.
Yeah. So then he goes after calling other people a freaks and then calling a porn star a horse face.
He then goes on to say that he's never heard these words like subpoena.
It's a new word to me.
Grand jury.
I've never heard of someone who says I'm the best at words has never heard of the word subpoena.
He's never heard of the word grand jury.
Like the most deranged human being
ever here play this sanity people said to me are you sure you want to do it sir i said oh this will
be so amazing why does he talk like that what the hell did you get me into
i didn't know the word subpoena i didn't know the word subpoena. I didn't know the word grand jury, those words, grand jury.
I didn't know that they want to lynch you for doing nothing wrong.
I didn't know they want to lynch you for doing a great job.
I didn't know they want to put you away because your poll numbers are better than anybody they've seen in years.
So then he says, by the way, can we just address the way he speaks?
And I want to...

But today, I finally did.

So what's Donald Trump's plan? What's his hopeful message going into the 2024? It's that
for those who have been wrong and betrayed, I'm your retribution. So he's basically, to be clear,
talking to the insurrectionists at this point. And he's basically saying, if you feel wrong
because we didn't succeed in the last insurrection,
I'm your guy and I'm going to do what you wanted me to do the last time.

That's what he's intending to talk about. It is a call to action for violence. It is as clear
and present of a threat. I also think it's even a step further than that. I think it's violence against
a group of people, but I think it's also threatening the destruction of
the United States of America, like the entire system on which the United States of America
rests upon. He is planning on taking a dagger to American democracy. And when he says he wants to completely obliterate
the deep state, he wants to obliterate the government workers who don't kowtow to his
beliefs, to his demands. That's exactly what he's saying there, because he wants to rule
as an unchecked dictator who just does whatever he wants, makes whatever demands he wants,
and forces people to do them, whether they're constitutional or not. And that, to me, is the big not-so-subtext of what he's
saying there. Well, I mean, you pair that with the fact that he says he will use the federal
government to lead one of the largest deportations, a mass deportation in American history. Play this

Counsel Jack Smith. I want to talk about Donald Trump's just nonstop posts because he is completely

I mean, it's crazy. It's crazy. It is really, really, really disturbing.
And, you know, part of the speeches that you see, I'll pull up this clip in a second of Tom Fitton.
Like all of the speakers would speak and they would be like, Donald Trump, he's a victim.
They're all coming after him.
We all know that Trump is the victim.
He's a victim.
Here, play this clip of Fitton taught Trump's advisor. Obama knew, Clinton knew, Comey knew, Biden knew,
Brennan knew, McCabe knew, Strzok knew, Clapper knew, Schiff knew, the FBI knew, the DOJ knew,
the CIA knew, the State Department knew. They all knew Trump was innocent, but they smeared and
spied on him anyway. Worse than Watergate. Trump is a crime victim. Let's remember that.
But when they say worse than Watergate, he's saying that Nixon was the victim in Watergate.
They're like, did you pick that up when he said worse than Watergate?
As though the deep state got Nixon. Just to be clear, he wasn't saying Trump's conduct is worse than Watergate.
He's saying the way Trump has been investigated is far worse than Nixon,
just to be very clear. And that, folks, is the modern day MAGA Republican Party.
Brett, I want to get your point, but this is why everything we're about to discuss
with the criminal investigations going on right now is so, so vital. Brett?
It's an important call out to point that out, because I think most people watching that clip
would think that they're comparing the horror of Watergate, the crime of Watergate to what
is happening right now, but they are actually doing the opposite. And that's what this MAGA
strain of the Republican Party has learned. That's their new revisionist history that we are seeing unfold. It's that the deep state took down Nixon. Nixon didn't do enough
to stop them, but they're going to do enough to stop them. And that's what this entire
right-wing ecosystem right now is living by. It's revisionist history from top to bottom.
They want to rewrite history. They want to make facts irrelevant,
and they want to create their own reality. And we are seeing that every single day.
By the way, including right now, as we record this podcast live, you have Tucker Carlson
revealing, I put that in quotes, the footage, the real footage from January 6th, as he puts it,
where he cherry picks little bits and pieces
to try to rewrite the narrative. And even on Tucker's show tonight, Tucker Carlson went in
and said, well, you know, no honest person could say that the 2020 election was fair.
There's no honest person that could say that, except you, Tucker, in sworn deposition testimony
that was handed out in this Dominion lawsuit against Fox. You said that you knew it
was BS, and you said that you were scared of Trump, that Trump is a demon, that Trump is a
destroyer. That came out of your mouth. Now, this guy has the nerve to go on TV today, tomorrow,
to try to rewrite the history of January 6th. This is a movement built on deception, built on disinformation,
and it is horrific to witness. And we need to be here to combat it.
And one of the good things, though, is it might actually end up being the undoing of Fox,
because for all of the money that they did this for, this Dominion lawsuit is no joke. If you want to know what my biggest concern
in the Dominion lawsuit is, it's not liability, right? It is ultimately going to be the damages.
I just haven't seen the economic models. Dominion suing for $1.6 billion. I hope they get $8 billion.
I just don't know with the economists that they have the way they are projecting that. And I hope they get $8 billion. I just don't know with the economists that they have
the way they are projecting that. And I hope they prove it, but this is a slam dunk case.
And when you talk about the punitive damages, right? And we use legal terms like ratification,
the dominion lawyers, when they're watching Tucker do this tonight, this would be the greatest piece of evidence for my punitive
damage case and frankly, my liability case. One of the things I would ask Tucker, I would say,
so after this, after you admitted that you were lying, you then went in and you made that
statement and read exactly what you said. I would say, roll the tape. And I would say,
you knew when you said that, that you were lying. And Tucker
would go, whoa, I didn't know that. All right, well, let's play your deposition testimony.
So even though we have your deposition testimony, here you are on March 6th saying the big lie.
Why is that, Tucker? Were you afraid you were going to lose your ratings? Were you afraid that
because the Dominion filing became public that people started
realizing who you were, Tucker? Oh, I don't know. I don't know. That's why you did it, Tucker,
isn't it? That cross-exam, I hope Dominion does not settle this case. I want the world
to see that take place. But you dig the hole deeper and deeper and deeper when Tucker starts saying
those things. And we know what they are saying behind the scenes. And probably the only lesson
that Fox has learned from this whole ordeal, though, is don't put it in text messages.
Don't put the truth in emails. Do it all by phone and do it all by in-person meetings.
Disappearing signal chats, letting signal chats. That's why Donald
Trump doesn't have a cell phone. That's why he doesn't use emails. That's why he doesn't have
text messages. So he blames it on everybody around him who has emails and text messages.
But look, let's go talk about these criminal investigations right now. I've said it before
here that I thought that the Manhattan district attorney's office would be
the first indictment. And there were so many people who disagreed with that assessment and said,
you know, because I get the frustration with Alvin Bragg, especially with Dunn and Pomerantz
quitting and that grand jury from Cy Vance, it felt so close. So it felt like a piece of us was ripped away when it felt like we were on the finish line
and someone new took over. But I've said before, I said, I think that Alvin Bragg's going to
recalibrate a 30-year district attorney. He's worked in the district attorney's office,
at the AG's office. So he knows what he's doing. Probably the most experienced, I believe he's a
Harvard lawyer. He's a very smart person and he's developed an incredible team. And all of the moves
there, I've always said, I follow the data. That's why I've always believed his will go first,
his criminal prosecution will go first. And what it seems his strategy is,
let's focus on a way, on a very discreet case. Let's focus on the payment, unlawful payments
of hush money to Stormy Daniels. There's an easy paper trail. There's a four-year prison sentence
for it. The way that could be charged, that could be charged as a felony, it is the quickest route
to getting Donald Trump in Rikers Island. The broader case is being pursued as a civil case
by Attorney General Letitia James. And that broader case is the one that Cy Vance was looking
into. Now, Alvin Bragg doesn't just give up on that other case because he's pursuing the discreet one.
The same way with respect to Allen Weisselberg, the fact that Allen Weisselberg served time at Rikers for the plea agreement he entered into with the case against the Trump org didn't all posts is that Alvin Weisselberg, rather
Allen Weisselberg, is being prosecuted or being persecuted and being tortured by Alvin
Bragg.
And he's saying he's using those terms.
He's being absolutely tortured, harassing and tormenting my 75-year-old employee who they have thrown in jail trying to force him to say
something bad, lie about me. So one of the things that Alvin Bragg is working on is saying, look,
I'm going to try you again because we learned a lot more crimes in the case we tried against
the Trump criminal law. I never waived any other case against you. So how did Rikers Island feel?
How did it feel, Weisselberg?
Because you're going back there again now that you got a taste of it.
And we want you to testify against Trump in this case involving the hush money payments to Stormy Daniels that Trump unlawfully classified as legal reimbursement when it was a bribe, when it was hush money payments that he should have
disclosed accurately. So a very easy case to prove and to throw Trump in jail quickly. And that's,
by the way, I think why Alvin Bragg is pursuing that strategy. We all want him in jail. He
deserves to be in jail. Let's not lose track of the bigger case, but let's not let the bigger case
be used as a way for Trump to delay this for the rest of his life.
If you view it through that scope and prism, I think it's actually surgical and smart.
But I hear all of the Alvin Brandt criticisms and I get it.
I just think he's going to be the first to criminally indict and it's going to change people's perspectives of him when he does it.
So why do I think this?
Well, five people have already spoken before the grand jury there.
Not a special grand jury, a grand jury that has the power to actually indict.
And then we see what looks to be the final stages of this process, right?
Kellyanne Conway, and she was involved in calling Michael Cohen and confirming
that the hush money payments were, that Trump appreciated that the hush money payments were
made. So that's why Kellyanne Conway is involved. She spoke to Alvin Bragg twice last week.
Hope Hicks is now meeting with the Manhattan District Attorney's Office. She was Trump's
former top aide. These key people, And look, Michael Cohen, who we host
the political beatdown with, I host that show every Tuesday and Thursday, has now met 17 times,
three times with the new team. He was skeptical and very critical of Alvin Bragg's team.
But now he said after these three meetings with Bragg's team, he goes, no, no, Ben. And he said
it to all of our political beatdown brigade. He said, this is the real deal team. He said, this flight is in air and I think it will get
to the destination of justice very soon. He can't talk about the specifics, but he says he's meeting
for prep. We'll hear more from him tomorrow on the live show of Political Beatdown at 12 Pacific 3 Eastern, where he'll probably tell
us as much as he can. But every sign indicates that Alvin Bragg is going to be criminally
indicting Trump directly and soon. And we could be mad about Bragg for everything. I'm just telling
you what the data is saying. And I think we all agree that that data is a good thing, but that's what it suggests.
Ben, just at a real high level, because I feel like we've been talking about the Stormy Daniels
situation now for quite a bit. At a real high level though, the understanding that the audience
has and why this is actually criminal for Trump is because of the classification of how he used
the money. It was actually campaign money that right, that he used to pay Stormy.
And that's what makes it illegal, correct?
He classified it as a legal reimbursement to Michael Cohen.
It is a false classification of business records.
And a false classification of business records in and of itself is a misdemeanor.
When you combine that with the campaign finance element of it, those two aspects together
turn it into a felony where it could become a four-year sentence.
So you add those two factors.
And by the way, you think about it.
You're a New York jury hearing this case.
Donald Trump's wife is pregnant with her first son with him.
He's having sex with a porn star, three seconds of sex with a porn star.
He's then paying hush money to cover it up.
And just put yourself in the mindset of all this you'll be able to see really easily.
The case can probably be tried in two days, right?
Maybe three days.
So you're in and out.
You literally want to vomit after you hear this case about what a disgusting, vile person engages in this conduct.
You think the jury goes, they'll deliberate for what,
three or four hours maybe? And I think also, no matter where you stand on the political spectrum,
you're going to be repulsed by these fact patterns and the documents are going to be right there.
And then once Trump's guilty and he's sentenced, what are the appeal process? It's not a case where
Trump has a lot of room to appeal. So Trump can get thrown in jail, into Rikers pretty quickly
in that case. It's not as long as we probably want. It's a four-year sentence. By the time you
look at the sentencing guidelines, maybe you're talking about a year
or slightly longer, maybe two years of actual hard time that he'll do in Rikers. But then
Bragg doesn't give up the other case. We just started with a point where Trump's locked up
for committing crimes, which he deserves to be. And then you have the civil case. The civil case comes in October 3rd,
where Tish James is suing for $250 million at least for the fraudulent valuations that Trump
engaged in with an injunctive relief to shut down the Trumps from doing business in New York.
Do you all see how that one-two punch works though and why that may actually be
a very effective surgical strategy if you ultimately want the results to happen?
I'll leave you with this one final result for everybody who's very upset with the timing of
all of this. We talked about a lot of these Nixon cases and accountability. Nixon was never held accountable.
Let's be real, right?
He left office, but he was parted.
Nixon was actually never held accountable like he should.
And if you look at a lot of the Nixon related cases of when the courts made rulings on a
lot of his unlawful conduct, where he's asserted immunities and things like that, look at the
dates, 81, 82, right?
Nixon v. Fitzgerald, the big absolute immunity case in 82. So in perspective of things,
these cases actually are, and justice couldn't come sooner for us, especially after I show you
all those clips of that deranged maniac. He deserves to be in bars,
behind bars immediately. I get it. But in terms of the process that just exists within our system,
historically, it's not going to be helpful necessarily for me to say this. I could only give you the legal perspective that it is moving
quicker than any case in the past. And for similarly situated cases where a defendant
is a wealthy millionaire or billionaire type of person who can make all of these motions.
So I want to at least give you that perspective. Good perspective. I love the sound effects you're adding too.

You ever notice how Trump also, whenever he tries to frame something and tries to make
his goons feel like the victim, it's always like, my young kid, Don Jr., they're being
so mean to my young son.
It's like, dude, he's what?
How old is Don Jr, your young kid?
And then with Weisselberg, he goes, he's a poor old 75-year-old man. In Donald Trump's world,
people just go from young kids to old people very quickly. That's how Donald Trump-
His definition, because he's such a weak little traitor snowflake, his definition of what torture is, real torture, when Trump threw Michael Cohen
in solitary confinement for many, many, many days because Cohen had the audacity of wanting to write
a book. That's actually, if we want to talk about torture, but let me tell you what's not torture,
where witnesses get called before a grand jury
and the Department of Justice pays for their travel. Oh, they got to fly an economy class
and they get to stay in a Sheraton and the Ubers are paid for. Oh my gosh, the torture,
the torture. This is what he's calling a torture. Here, pull up this post where he calls Jack Smith an animal prosecutor. He goes,
the animal prosecutor that they stuck on me over the boxes hoax is trying to torture,
and he puts that in caps, my people into telling lies. It's all for political reasons and the fact
that I'm leading big in all of the polls. He's flying people from all over and throwing them in front of a DC
grand jury. They are confused and scared. They've never done this before. These Democrat Marxist
pigs should be the ones that are investigated. The nice guy prosecutor in the Biden documents case
hasn't even started yet. I mean, just calling it torture, throwing them as though like Jack Smith,
you pull up the photo of Jack Smith, as though he's taking them and just throwing them in there
and grabbing them by their collar and saying, you need to testify and then torture it.
But it's, ha ha, you need to testify.

Josh Hawley clip where he's saying the coward tape was a lie, that Josh Hawley
wasn't running. But when you watch the tape, I guess his point is that Hawley wasn't the only
person running and that other lawmakers were running as well. Hawley was just one of the last
people to run. That's the kind of stuff that they are feeding their base and that Kevin McCarthy thought
that Tucker should be the one who has it. By the way, Brett, to the point you made earlier,
the fact that Kevin McCarthy, who knows as well about the big lie and said that Donald Trump
should probably resign, we know that Kevin McCarthy said that right after the insurrection.
Um, that he would give it to Tucker who the first thing Tucker said with these
tapes is that to your point, Brett, that the 2020 election was a grave
betrayal of the American people.
That's the first person who gets the record.
Not that it, by the way, if you want to make it public and you want to ignore what the Capitol Police have to say, what the Department of Justice have to say, if you want to ignore all of that and just make it public, then make it public.
You're going to cause grave harm, as the Capitol Police warned, but you give an exclusive to Tucker?
How traitorous is that? It's just so utterly
traitorous. And so let's talk about, though, this motion that we're learning about that Donald Trump
filed. He's trying to exclude testimony that was already given. So it's like, let's exclude the
testimony the grand jury in Washington, D.C. has already heard. So you may recall that Patrick Philbin and Pat Cipollone, his former top White House
lawyers, were first summoned to the grand jury, were first subpoenaed to the grand jury
and testified back in mid-September.
I think it was September 14th or so of 2022.
They couldn't testify to everything because Donald Trump had asserted
executive privilege. The Department of Justice then had to file motions to get an order from
federal Judge Beryl Howell that executive privilege does not apply. The Department of
Justice prevailed. Judge Beryl Howell made that order that executive privilege doesn't apply. Patrick Feldman and Pat Cipollone then had to show up a second time. They showed up in December of 2022 and they testified about communications or deliberative communications with a president are supposed to remain confidential.
A few points, though.
Executive privilege is held by the current president, not former presidents.
And even if it were to be held in the most narrow circumstances by former presidents, it could be overridden by compelling interests like criminal investigations.
So it was fairly easy to overcome the executive privilege claims there.
These individuals, Cipollone and Philbin, already testified. And now Donald Trump is going to the
Court of Appeals and saying, we want that testimony excluded from the grand jury. Now, we know Cipollone and Philbin
previously testified before the January 6th committee. However, you may remember that there
were limitations on their testimony even there. They didn't testify about their specific
communications with Trump and other specific observations in Trump's presence. They testified
about a lot of other things, but when they were
asked specifically, they would say, we can't because Trump is asserting executive privilege.
But even there, I also want to use this as kind of a teaching moment, right? Because it takes time
to subpoena the witnesses, and you don't just want to subpoena a witness before building your case
brick by brick, right? So before they brought in Cipollone and Philbin, they also want to bring lower you need a bill to the top because you want to be able to make
sure you're asking the best questions, right? So then they subpoena and you have to come up
with a date that works with the grand jury schedule. Grand juries don't meet every day.
They meet a few times a month where they take in a lot of testimony. You have to coordinate
with the
witness and you can't just force witnesses to show up without good faith scheduling. Otherwise,
a judge isn't going to let you take their testimony. So you then get their testimony
in September, right? Then Donald Trump asserts executive privilege. So they can't testify to
everything. Then the Department of Justice has to file a motion
to compel. Under our system, Donald Trump gets an opportunity to respond.
Then the DOJ gets a reply. Then the court makes an order and the court orders them to reappear
in December because that period takes 60 or 90 days. Everybody remembers how long it took with Trump's frivolous
case before Judge Eileen Cannon, when the motions would be heard and eventually all gets heard.
That was a discrete issue. It eventually works its way up to the Court of Appeals.
But that's just the process generally that we have. And now we know, for example,
the Department of Justice compelled Pence. And before it compelled
Pence's testimony, and there's got to be a ruling on that, to get Pence, you got to get the lower
level people. So all of this builds brick by brick by brick. And frankly, in terms of a perspective
of how quick all of that has moved for the judges to make rulings, for that testimony to go before
the grand jury, and the fact that we're up to the level of Pence, all in all, and I know it's
slower than I ever want, but we don't want to have a situation where you indict and everyone's happy.
What a great headline. We're all celebrating because
we've been waiting for this indictment forever. So Trump gets indicted and then we want a quick
trial. So we go to trial right away. And then on the stand for the very first time,
questions are asked of Cipollone, questions are asked of Philbin, and then an
executive privilege objection is asserted. And then the judge goes, lawyer for the DOJ,
what efforts did you make before the grand jury to challenge this executive privilege?
And then they go, well, none. We wanted to indict right away.
So judge make the ruling. And when then the judge goes, I can't make that ruling now.
You didn't go through the steps that you were supposed to, to get the testimony. I'm going to
exclude that testimony right there from ever getting in. We don't just want an indictment. We want the
indictment to stick. And let me give you another scenario. Donald Trump was able to appoint a lot
of federal judges and a lot of federal judges where this case ultimately is going to go before
in the DC federal courts. There are a lot of Trump appointees who by and
large have made pretty good rulings for democracy, but when it comes to the January 6th cases,
but also remember, it's like a Trump judge, Judge Nichols, who found the obstruction statute,
the obstruction of justice statute does not apply to insurrectionists unless the insurrectionists specifically directed their obstruction to destroy documents, even though the statute talks about official proceedings. if the Trump case gets assigned to a Trump-appointed judge who will not recuse themselves.
I promise they should, but they won't, and the Supreme Court will not disqualify them.
You want the DOJ to make sure that they've got every piece of evidence because that Trump judge will look for the smallest, smallest failure to do diligence
and will throw out the case in a second. The Department of Justice knows that.
So as we talk about what the Department of Justice is up against here, I think ultimately
these motions to exclude are going to fail by Donald Trump.
Former president doesn't have executive privilege. Even if you claim that there was executive
privilege, compelling interest overrides executive privilege. These are the steps that the DOJ has
to take. And I hope going through that process with you, although perhaps frustrating, at least
gives you a window into what all these steps are and why Jack Smith or before that Merrick
Garland couldn't just say, we all saw it happen in Dite right now because it would
backfire.
And then everybody would be saying, you blew it, Merrick Garland,
you blew it. Yeah. I mean, first off, going back, I think the pardoning of Nixon, I'm probably going
way back at this point, was probably one of the most hurtful things that could have ever been done
for our country, because it just really, I think, put a dagger in the rule of law and set a really, really, really
bad standard.
But I don't think it's fully appreciated right now.
And honestly, how could it be?
How big of a deal it is that there is a former president of the United States who is likely
to get indicted?
And not one indictment, but likely multiple indictments.
What we are about to experience in this country, I don't quite think anybody is prepared for it.
And I think we need to really start setting our minds now in that direction of just kind of
mentally prepping for what's going to be pretty chaotic when all this starts
happening. And by the way, I do think that there is a direct connection right now between Tucker
Carlson trying to rewrite the history of January 6th and these prosecutors getting closer and closer to indictments.
I've always said from the beginning, as we get closer, they are going to get more and
more insane.
The disinformation is going to go into overdrive.
Them trying to fight back is going to quadruple.
And we are seeing that right here, right now.
And by the way, we ain't seen nothing yet. I'm telling you that. And I know that might sound scary, but I believe that to be true.
That's terrifying. We all know that there's obvious evidence of intent, but under our constitution, you have a
right to a speedy trial and evidence has to be admissible, right? You can't just point out and
say, everybody knows judge jury. Come on. Everybody gets it. Donald Trump will invoke his fifth
amendment right against self-incrimination. He's not going to testify. Mark Meadows will invoke
his fifth amendment right against self-incrimination. Meadows isn't going to testify. When Pence probably goes through the process,
he may invoke his Fifth Amendment right against self-incrimination, and he may not testify.
So you're going to want, I promise you, Patrick Philman and Pat Cipollone and Mark Short and Greg Jacob and all of these people that the
Department of Justice is pursuing to testify. And you got to make sure the evidence is admissible
because the moment you file, the moment you file, if Trump wants that trial quickly,
he can get a quick trial. And so you better have all of your evidence
completely buttoned up. And while the DOJ is pursuing these criminal investigations through
the special counsel's office now as well, let's not forget they're putting all of the high-level
terrorists in jail. Oath keepers, first trial, seditious conspiracy, guilty. Second oath keepers trial,
seditious conspiracy, guilty. The Proud Boys are currently in trial. And by the way, let's not
forget one of the reasons, Brett, this whole thing is going on with giving the tapes to Tucker
and also giving the tapes to the insurrectionists. By giving the tapes to
the insurrectionists, one of the plan to Kevin McCarthy is to actually hurt and slow down the
DOJ's investigation into Donald Trump and the insurrectionists, because none of that material
actually matters for any of the prosecutions. However, because it's new material, which the insurrectionists who have pled,
who have been convicted or who are being tried, they're going to claim,
whoa, the government was secretly hiding Brady material, exculpatory information that I could
have proved my innocence. And we all know that's not the case. We see them walking into the footage that mattered to them was turned over to them, right? But they're going to argue, we now need to go all 45,000 hours of footage to determine if there may be
exculpatory evidence in there. And now that's diverting resources from actually prosecuting
terrorists. That's one of the strategies, a direct threat to try to undermine the Department
of Justice. So I want you to think about that plot right there.
And while Brett's on mute and doesn't realize he's on mute, Ben, let me just compliment you.
I know that that's weird for me to do, but I like complimenting you. Ben, that was a great
breakdown. I listen to other podcasts that might sound crazy other than the Midas Touch podcast,
and other than podcasts that are on our network. I know it sounds crazy. Nobody gives that level
of detail that you just gave. That was awesome. But it's a hard truth to talk about. And that's why I don't think people do it.
Yeah. Because the reality is, I am also, part of me is like, what the hell are you doing? doing yeah indict that you know and and and and i and everybody who feels that way is 100 justified
to have this being done so flagrantly so in our faces is so disturbing is so disturbing but also
we do have a due process system that is intended to protect others. The fact that it is being abused
by a authoritarian tyrant is not surprising. However, I do know that we've got the best
team behind all of these prosecutions, and that's what I feel very strongly about.
Finally, I want to talk about this one other topic, which isn't getting a huge amount of
attention, but I do think it deserves a lot of attention. And this is the Donald Trump
and MAGA-led plan against something that's called ERIC. E-R-I-C.
I think he picked it.
I think he first thought it was his son, and he's like, yeah, screw Eric.
Yeah, get Eric out of here.
And then he dug in, and he was like, oh, I could use this to my benefit.
This is what Eric stands for, Electronic Registration Information Center.
It is a nonprofit organization, by the way, founded by three
Republicans. It was founded by three Republican state governors.
Rhinos, Ben.
With the sole mission of assisting states to improve the accuracy of America's voter rolls
and increase the access to voter registration for all eligible citizens.
It is governed and managed by states,
even Republican and Democrat states, and actually what it helps find if your
goal is to find actual election fraud because it kind of cross references
people's movements, DMV registrations with voter rolls,
to see people moving from state to state, you can actually find out if someone is voting
in a state where they shouldn't be voting and if they should be removed from a certain state.
In theory, this is everything that the Republicans have been calling for. If you think about it,
it actually exists. And because it exists, because it actually is providing the data,
the truth that undercuts what the MAGA Republicans are saying, they want to destroy the database.
Jordy, this is the brilliant point you made on the last pod,
right? The way they address COVID, if you're a MAGA Republican, is don't test. If you don't test,
it doesn't exist. Just don't keep track of the data. Their policy, when it comes to things like
the Chinese spy balloons, right? Don't track.
Don't track it.
You don't have the technology. If you don't build the infrastructure to even locate it,
you won't have to run into a situation where you have to make the hard decision.
So when Biden came in, he goes, whoa, there's these Chinese spy balloons that are flying over
our country that the Trump administration wasn't even looking at. Let's develop a system. So when Biden develops the system, yes, it's complicated. It's
hard, right? And MAGA Republicans go, oh, you're letting the Chinese spy balloons over America.
That was happening repeatedly when Trump was in office. However, they didn't test. They didn't search. They didn't track. And this is their
theory. So we could spread our lies if you're a MAGA Republican, if you don't have Eric,
if you don't have the Electronic Registration Information Center. And it was one of the tools
that undercuts their claims of voter fraud. Because wait a minute,
here's the person. These aren't dead voters. These voters are real and they want to spread lies. So
just destroy the data. Here's Donald Trump's post. All Republican governors should immediately pull
out of ERIC, the terrible voter registration system that,
quote, pumps the rolls for Democrats and does nothing to clean them up. It is a fool's game
for Republicans. And while these governors are at it, and this is all in caps like the maniac that
he is, go to same day voting, all paper ballots, end voter ID, voter identification, mail-in voting
only for faraway military and
those that are very sick, problems on elections solved.
And so what does the fascist governor of Florida do?
Terminates their relationship with Eric because, whoa, this could be a winning issue in the
Republican Party if we go after Eric.
So the Florida, they go after Eric and they want to
eliminate Eric. By the way, the whole funding for Eric for the states, it's like $25,000 per state.
So like we can't fund this thing. You can't fund this like $25,000 dues like a month. It's not a
huge amount of money for a state to fund. And by the way, the board of Eric are the governors and
their designees. They're the ones who sit on it. And it's equal Democrats, equal Republicans.
And don't we want to find this stuff out? And let me put it in perspective. By early 2022,
there were 34 states who used the system, red, blue, anything in between here. They had all joined to use this system.
It includes Texas. It includes Florida. It includes Massachusetts. It includes Minnesota.
It includes all six of the closely contested battlegrounds in the 2020 election. This is
widely used, has always been widely accepted, and it's about election integrity. If you actually care about
that issue, that's what it's about. But they're all in this war of brinkmanship, trying to one
up each other, trying to out fascist each other. And it just goes to show you every time Trump says
something that DeSantis thinks he should do to try to help him win the presidential nomination,
DeSantis goes, oh, I got to do that now. And if DeSantis goes with an idea and Trump thinks it's a good idea for him, Trump then
goes, oh, I got to do that now.
It's really a pathetic thing that we are witnessing right now.
And I also just, I got, I'm sorry, I have to say it, that when Trump made this post on his social media app, and he was talking about pulling out of Eric, I got to imagine that he's used the phrase pull out for Eric in other contexts before. I'm just going to say it, folks he was talking smack about obviously, you know, his son, Eric, and then Eric overheard and got upset. He's like, no, no, no. I wasn't talking
about you. I wasn't saying we need to get rid of you, Eric. I was talking about this thing over
here. Someone needs to deliver the straight talk here. But I mean, that's why though, when we watch
the news media, the mainstream news media, when we speak to people, we're in a situation where we need to be using the rhetoric that matches what
we are seeing. What we are seeing is fascism in America. What we are seeing are traitors to this
country. These are traitors. We can't be afraid to say that. We can't be afraid to say that for
the sake of, oh, we just have to be nice to each other and get along. There are a lot of people
who identify as Republicans who I agree with, who I'm friends
with, but this strain, what we're seeing right now, this is a whole different ball game and
we have to be calling it out.
What Tucker Carlson is doing right now as we record this, what Kevin McCarthy did in
handing him this footage so that he could manipulate this footage and have these selective
leaks to try to rewrite the history of an attack on our nation? That's evil. That's traitorous.
And we need to be calling it out as evil, as traitorous, and not be afraid of, oh,
you're going to offend both sides. You're going to offend the other side though.
That kind of rhetoric is inflammatory.
You need to be dealing with things in the terms in which they actually exist. And this is a red alert for our country. We have to, have to, have to. And that's why when people say, oh,
the Midas Touch Network, the liberal leftist network, if you were to probably look at a lot of the views and values, would they
traditionally line up with progressive or liberal? In many cases, yeah. I don't have a checklist of
views, though, that go, I want what's best for our democracy. But to me, those labels don't make
any sense anymore. It's why I'm very frustrated
by those very labels, because it puts people into certain camps and it assumes that on the other
side, there are these conservatives and they're fiscally conservative and they're conservative
in their policies. No, they're maniacs. They're maniacs. What else do you want me to call? They're
traitors. They're engaged in treasonous conduct. They're out there calling for national divorce.
They're saying, if you elect me, I will be your retribution. They're calling porn stars horse
face and clapping for it. They're talking about golden chocolate milk or whatever,
golden chocolate tickets underneath the seats. They're talking about potato heads and skittles,
and they're talking about being angry at pronouns and that
the biggest issue in their day is bathrooms. There's nothing conservative about people who
call insurrectionists political prisoners. There's nothing conservative about election denialism.
People who don't accept free and fair elections, they're not conservative. They're certainly not fiscally conservative.
They want to blow up our country's economy.
They're willing to have us default on our full faith and credit.
And then it's like, okay, well, what is your plan?
MAGA, tell us, MAGA, what is your, surely you have a plan.
And they come up with some stupid acronym, the RAIN Act. We're going to rain. Okay, well, what is your, surely you have a plan. And they come up with some stupid acronym,
the RAIN in Act. We're going to RAIN. Okay. Well, what is this Act? We need oversight over
three executive orders. That's the RAIN. What are you talking about? You just want to use the term
RAIN in. And that's the difference here though, right? Between performative BS and someone who actually is delivering for the people.
So as we leave this episode, I want to show you what happened this weekend when President Biden
joined marchers in Selma to commemorate the 58th anniversary of Bloody Sunday, the day in 1965
where white police beat black civil rights marchers as they attempted
to cross the bridge to gain the right to vote. I want to talk to you about that. And I want to show
you what President Biden said, that no matter how hard some people try, President Biden says it
better. So let me play his clip.
The truth matters.
Notwithstanding what the other team is trying to hide.
They're trying to hide the truth.
No matter how hard some people try,
we can't just choose to learn what we want to know
and not what we should know.
We should learn everything.
The good, the bad, the truth of who we are as a
nation. And everyone should know the truth of Selma. And finally, Biden says this is a time
of choosing. That is a message we talk about here on the Midas Touch podcast and network. This is

of democracy. Unsure of their fate, but certain of the cause was righteous. So she would go on to
say, quote, you can never know where you're going unless you know where you've been. We know where we have been.
My fellow Americans, on this Sunday of our time,
we know where we've been,
and we know, more importantly, where we have to go.
Forward, together.
So let's pray, but let's not rest.
Let's keep marching.
Let's keep the faith.
But most of all, let's remember who we are.
We're the United States of America, and there's nothing, nothing beyond our capacity when we act together. So let's go and finish the job. God bless you all, and may God bless our troops.
