Manhattan and was immediately put in his place by Justice Juan Merchan. Donald Trump had held a
press conference on Thursday afternoon where Trump was whining and complaining, saying that he wanted to testify at
his criminal trial, but he was not allowed to because of the gag order. As we reported yesterday
and again this morning, that is 100% false. And we predicted here at the Midas Touch Network that
Justice Mershon, the judge presiding over this case, would inform Donald Trump that that was false, that he had an absolute constitutional right to testify, and that if he received advice that he is
not permitted to testify, that is 100% false.
And that's exactly what Justice Mershon did this morning as Donald Trump entered the courtroom.
Justice Mershon informed Donald Trump, you have a constitutional right.
A gag order simply precludes certain extra judicial statements about the jury, about witnesses,
about court staff, and about family members of all of those categories. But as the name implies,
it is a limitation on extra judicial statements, which by the way, shouldn't even apply at all
during examination during the trial, but it's extrajudicial outside of court. The gag order
does not apply inside the courtroom if Donald Trump were to actually testify. Now, I think
Donald Trump knew that the judge was going to go in this direction. So when Donald Trump arrived at trial on Friday, he basically contradicted exactly what he
said yesterday.
In other words, he admitted that he lied yesterday.
There's no consistency in anything that this maniac says.
Here he is today as he arrived, when he was asked if the gag order prevented him from
testifying.
And as he was answering these questions right before as he was entering the courtroom, he said, no, the gag order doesn't prevent me from testifying.

The gag order stops me from talking about people and responding when they say things
about me.
We have people saying things about me and I'm not allowed to respond.
So this judge has taken away my constitutional right.
And as a Republican candidate and somebody that's leading Biden by a lot, I should be
able to respond.
But this guy's got me with a gigger. Now, we're filing, I think today, a constitutional motion to get this out.
We'll be filing a lawsuit on the constitutionality of it.
But if somebody says something about me and I'm not allowed to respond, that's never happened before.

All right, but quite literally less than 24 hours before Donald Trump had said that,
he had lied to the press and said that the gag order prevented him from testifying.
And then you'll see right away in the video from yesterday,
he looked at his lawyer and said, right, the gag order prevents me from testifying.
And then Trump's lawyer like shook his head, nodded yes,
like the gag order prevented him from testifying, which again is 100% false.
Here, play this clip. We're going to be appealing the gag order. I'd love to answer that question. It's a very easy question. The easiest question so far.
But I'm not allowed to testify because this judge, who's totally conflicted, has me under an unconstitutional gag order.
Nobody's ever had that before.
And we don't like it, and it's not fair.
Other people are allowed to do whatever they want to us and I'm not allowed as a presidential candidate the leading candidate the Republican Party nominee and the one
who's leading Biden by a lot I'm not allowed to talk there's never been any
abuse like this before this conflicted judge ought to get out of this case he
shouldn't be he should not be having this case. He gives us nothing. It's such a rigged court.
So I'm not allowed to testify because of an unconstitutional gag order.
We're appealing the gag order and let's see what happens.

Also, when Donald Trump arrived for trial today, he just looked very unwell.
He continued to whine.
He was saying how New York City is a, he goes, New York City is a violent city.
It's become violent with cashless bail.
I'm the only one that has to put up bail.
I don't, yeah, I don't think he just knows what he's talking about at all.
Is he confusing the bond that he had to post when he was found liable for fraud in a civil case?
He has no clue what he's talking about regarding anything at all.

I want to give a hat tip to some of the court,
the reporters who were in the courtroom like Erica Ordon.
Here's how she describes what went down moments ago.
She says, Justice Mershon instructed Trump that the gag order
does not prevent him from testifying at his criminal trial,
correcting the comment that Donald Trump made on Thursday afternoon. Quote, you have an absolute right to testify at trial if that's what you decide to do
after consultation with your attorneys, Justice Merchan said. Justice Merchan also said the order
restricting extrajudicial statements, a gag order, does not prevent you from testifying in any way. In fact,
as the name of the order indicates, it only applies to extra judicial statements. It does
not apply to statements made from the witness stand. Adam Klassfeld, a great reporter who's
in the courtroom as well for this trial, writes, Justice Mershon addressed Trump's comments
yesterday at his end-of-the-day press conference, falsely claiming he's gagged from testifying.
Quote, I want to stress to you, Mr. Trump, you have an absolute right to testify at trial.
The Constitution guarantees that right to you.
Do you understand?
Now, one of the reasons why we were saying yesterday that it was going to be so important that Justice Mershon addressed Donald Trump's comments is that one potential basis that
Donald Trump could use to appeal when and if he is convicted, or I should say if and
when he is convicted in this criminal trial,
is ineffective assistance of counsel. As part of your due process rights, you have the right to
have effective counsel representing you the same way you have a constitutional right to testify.
You also have a constitutional right not to testify against yourself under the Fifth Amendment.
If it is determined that you got like false or improper or malpractice infused advice
from an ineffective lawyer, courts in criminal cases have the authority to sometimes overturn
a conviction if you make a claim of ineffective assistance of counsel.
So one of the things that I suggested that Donald Trump may have been doing there,
although he may just be an idiot, or he may just have gotten incorrect information,
or he's just a liar about everything, probably all of the above,
is was Donald Trump kind of planting a poison pill there, getting ready to blame his lawyer and throw his lawyer, Todd Blanche,
who you saw nodding there under the bus?
Was it going to be Donald Trump's plan?
And notice he did do that in the E. Jean Carroll trial number one with Joe Takapina.
Remember, Donald Trump blamed Joe Takapina.
That's a civil case, not a criminal case. But Donald Trump said, I wanted to testify, but Joe Takapina. That's a civil case, not a criminal case.
But Donald Trump said, I wanted to testify, but Joe Takapina, my lawyer, he told me not
to testify.
I should have testified.
It's all his fault.
In a criminal case, unlike a civil case, a criminal defendant can try to turn that into
a grounds for appeal on ineffective assistance of counsel.
So was Donald Trump
gearing up to throw Todd Blanche under the bus once Donald Trump is convicted and say, look,
I wanted to testify, but my lawyer gave me false information that the gag order prevented me from
testifying. Had I not had this bad lawyer here, Todd Blanche, I absolutely would have testified.
And Blanche went right for it and
started shaking his head yes, whether he was complicit in it or just so in fear of Donald
Trump. I mean, I'll let you decide that. But I think that's one of the things that was going on
as well. Also, what was addressed earlier in the proceedings this morning, Donald Trump's lawyer, Todd Blanch, then tried to say,
we should not be talking about the Access Hollywood tapes at all, where Donald Trump
bragged about sexually assaulting women, because of a recent decision by the top court in New York,
which is actually called their Court of Appeal, is their highest court in New York, regarding the
Harvey Weinstein case, throwing out certain
evidence and witness testimony, something referred to as Mullineaux evidence or Mullineaux issues
where other people testify about assault, other people testify about their experiences.
And so the Harvey Weinstein case in New York got overturned for allowing certain testimony. So Todd Blanch
was citing Harvey Weinstein as precedent for Donald Trump. I suppose that's fitting that
Trump would be using Harvey Weinstein as his own precedent. But then Justice Marchand said,
I really don't see why the Harvey Weinstein decision in any way impacts this case. The
Court of Appeals did not create new law, Justice Merchant says.
They simply applied it to the facts of that case. Then you had this custodian of records from the
district attorney's office testify who Donald Trump's lawyers tried to cross-examine and act
like the audio recordings that were extracted from, I think, Michael Cohen's devices
and other devices were actually fabrications or like the FBI planted it and that they're not real.
Those are the audio recordings where Donald Trump acknowledged that, you know, he was involved in
setting up the bank accounts and making the hush money payments. And Donald Trump is
heard on the audio recording saying, keep me posted. Let me know
what's going on. And knowing and being involved in the plan. So that's what we have right now.
