The MidasTouch.com editorial team has identified another gag order violation in the Manhattan criminal trial committed by Donald Trump on Thursday night.
This has not yet been addressed by the Manhattan District Attorney's Office.
It was just caught by the editorial team at MidasTouch.com.
Donald Trump posted on Thursday night a video on Rumble from the Steve Bannon show of a program that has Ben Berkham
and Andrew Giuliani where they made false and harassing statements about Justice Mershon's
daughter that is a clear violation of the gag order which makes that what makes this violation
of the gag order particularly serious as well is that on Thursday morning, there was
a contempt hearing that was held for further violations of the gag order committed by Donald
Trump. Trump was previously found in criminal contempt in the Manhattan criminal trial on nine
separate violations. He was fined $9,000, $1,000 per violation. That's the max allowed by New York
law. Justice Merchant said then that he was not going to be imposing an incarceratory punishment,
which Donald Trump could be thrown in jail for up to 30 days because the district attorney's
office had not yet requested that, given that this was the kind of first violations in this case. But
there was a warning back then issued by Justice Merchant, and this was the kind of first violations in this case. But there was a
warning back then issued by Justice Merchant, and here was the warning that the defendant is hereby
warned that the court will not tolerate continued willful violations of its lawful order and that
if necessary and appropriate under the circumstances, it will impose an incarceratory
punishment. And then it is hereby ordered that then the monetary fine was imposed.
Now, the second contempt hearing
that was held this past Thursday
also relates to statements, though,
that were made before this punishment
was handed down on April 30th, 2024.
The statements precede that punishment,
so that's why the district attorney's office
has not requested incarceratory punishment for the second grouping of violations of the gag order.
But this is different. This is after this initial contempt, criminal contempt order was handed down after the second contempt hearing was handed down.
We still don't have an order yet on if Donald Trump will be held in criminal contempt again for the second time.
Also, MidasTouch.com reporting was critical there. We were first to break the story about Donald Trump in an interview saying how unfair the
jury was, saying that the jury was 95% Democratic, which is 100% false.
And that was one of the major violations that Justice Mershon focused on in the Thursday
hearing.
But this is a new one.
This follows that Thursday hearing.
This is subsequent to the April 30th contempt order. And so that's why I think
this is a significant one that could potentially carry with it the punishment of incarceration.
We'll see if the Manhattan District Attorney will flag this and will file a further motion
for contempt against Donald Trump. Based on the reporting here at Midas Touch. I predict they will. Here's our story at MidasTouch.com.
Trump violates gag order by posting video attacking judge's daughter. This potential
violation occurred after Judge Mershon held Trump in contempt of court and after the Thursday,
which was the second contempt proceeding, and Mershon still hadn't issued and handed down
that ruling. Then on Thursday night, Donald Trump makes these statements about Justice Mershon's
daughter. Let me play for you. First, let me show you. This is just so you see it. Here's Donald
Trump's post. So you see that Donald Trump's posting it. You see he gives a link to this
Rumble video. You see it's the Steve Bannon show and one of these right wing media networks controlled by Steve Bannon.

You'll see Andrew Giuliani on the right.

Tell me about this. The judge just or
I think held Trump in contempt. And I think in court he threatened him with jail time. If President
Trump continues to bang up against this unconstitutional gag order, your thoughts?
Yeah, I mean, he's fined him for nine times of this and he made him actually remove this. He's
making him remove it from his social media.
So talk about violating his first amendment rights on this. And you got to remember, Steve,
going back to all this, the gag order that he is violating, that according to the judge that Donald Trump is violating is just pointing out the fact that the judge's daughter has profited
to the tune of $90 million. That's right. Over $90 million from Adam Schiff,
Kamala Harris, and other leftists. Over $30 million from Adam Schiff, over $7 million from
Kamala Harris, and over $50 million from other Democrats. And Donald Trump cannot point that out

Well, what it tells me, number one, is that everything you say is absolutely false.
The judge's daughter didn't profit in those amounts.
It's just 100% false.
Also, it shows how willful these violations are by Donald
Trump. He's posting people who are talking about his violations of the gag order. They're then
violating the gag order, and he is reposting that where they're acknowledging that the judge has
found him in contempt for violation of the gag order. You can't get more willful and directly willful than that.
Obviously, it's not a First Amendment violation. Donald Trump's being held to the standard
or should be held to the standard of any other criminal defendant. And you're not allowed to
attack witnesses, attack jury, attack the family members of have as a criminal defendant. There is no First Amendment
protection for that at all. This is just all false. It's all a lie. And this is another further
violation. Let's take a look more at the story that we posted on MidasTouch.com. On Thursday
night, Trump posted a link to the Rumble Clip of Steve Bannon's War Room podcast in which Trump's
supporting hosts Doug Burkham and Andrew Giuliani, the son of Trump co-defendant Rudy Giuliani,
commented on Trump's trial and interviewed supporters outside of the courthouse.
The clip complained about Trump's gag order and about Judge Mershon's daughter,
a topic covered by the expanded gag order. In the clip, Bannon falsely claimed that the gag
order is unconstitutional and asked Giuliani to comment on Justice Merchan's gag order ruling
and the warning that Trump could face jail for continued violations. Giuliani noted the fine,
stated Trump had to remove the violations, and then lobbed an attack on Justice Merchan's daughter, which Trump then reposted in violation of the gag order.
On Thursday, Judge Merchan held Trump in contempt of court for nine gag order violations.
Trump was fined $9,000 for each violation, which is the maximum allowed by law.
Merchan noted that the fine might be an insufficient deterrent for Trump
and warned of potential jail time and future violations.
The Steve Bannon video that we just played was over 16 minutes long, but the relevant
gag order violation was in the first two minutes.
So while that was a 16-minute video in total, the part where they're talking about Justice
Merchan's daughter was the very first thing that people will see.
So Donald Trump is putting that out there.
People are going to be able to see that right away.
And it's Trump just reposting violations of the gag order, which he is obviously not allowed to do.

Punishment and order.
Criminal contempt is punishable by a fine exceeding $1,000 and by jail not exceeding...
Oh, sorry, let me pull
up the gag order. That was the prior contempt order. The gag order says ordered that the court's
order of March 26, 2024 is amended as indicated below. Defendant is directed to refrain from
making or directing others to make public statements about known or reasonably foreseeable
witnesses concerning their potential participation in the investigation or in this criminal proceeding.
B, making, directing others to make public statements about 1, counsel in this case other than the district attorney, members of the court staff, and three, family members of any counsel, staff members, the court,
or the district attorney if those statements are made with the intent to materially interfere with
or to cause others to materially interfere with counsel or staff's work in this criminal case or
with the knowledge that such interference is likely to result, and C, making or directing
others to make public statements about any prospective
juror or any juror in this criminal proceeding.
It is a clear violation of subsection B of the gag order.
Let's see if the district attorney's office brings this to the attention of Justice Mershon.
