by my brothers Brett and Jordy Mycelis a superseding indictment was just filed by
special counsel Jack Smith adding additional additional charges, at least three
new charges in the superseding indictment against Donald Trump. Also, a new co-defendant added
Carlos de Oliveira, a maintenance worker at Mar-a-Lago, has now joined Walti Nauta and Donald Trump as co-defendants. And the additional charges
in the superseding indictment relate to the destruction, manipulation, attempted destruction
of surveillance footage that was kept at Mar-a-Lago and in pain staking detail in this 60 page plus
superseding indictment, special counsel Jack Smith lays out moment by moment from when the
Department of Justice issued a subpoena in 2022 at Mar-a-Lago for the documents to when the Department of Justice arrived on June 3rd,
to the subsequent subpoena of surveillance footage records. And then it has all of the
steps that were taken by Donald Trump, Walti Nauta, and now this new co-defendant, this
maintenance worker, Carlos de Oliveira, to try and destroy the surveillance footage, including statements that
are attributed to witnesses. Actual quote saying de Oliveira said, Trump wants this gone. Trump
wants to get rid of this. We are doing it for Trump. They use the shush emoji. The shush emoji is featured in the superseding indictment.
That's included in this indictment.
And then there's an additional, I think, critical point in this superseding indictment, which I think deserves equal amount of attention. tension. And this relates to that meeting where Donald Trump was showing classified information
to the ghostwriters of the Mark Meadows book. In the initial indictment, it didn't specifically say
what those documents were. And so Donald Trump and the Trump lawyers, and they kind of fell
right into special counsel Jack Smith trap. They're like, oh, that was just Trump being Trump and braggadocious. That was just magazines that Donald Trump,
he didn't actually have the war plans. Well, special counsel Jack Smith just said,
checkmate, we've got the documents. They were the war plans. We know the exact documents that
he was showing Mark Meadows. And it's just so amateurish. And
thankfully, Trump's such an idiot and his lawyers are so bad that he fell into that trap.
Anybody who's dealt with federal prosecutors before as a criminal defense lawyer knows that
you better get all of your discovery right. You better look through all of it before you go out
there and make statements
because there's always a disparity of information. But yes, count 32, which relates to page 17 of the
indictment. Now, the superseding indictment makes it clear that those documents were Iranian
war plans that Donald Trump was showing it. And those documents are in the possession of special
counsel Jack Smith as well. So that additional fact has now been added. So we now have deletion
of surveillance footage, additional counts related to making false statements, a new criminal
defendant in Carlos de Oliveira, and they go through his false statements that he previously made to the FBI
saying that he had no involvement. It's clear there are more cooperating witnesses
identified as employee number four, who I believe to be someone by the name of Yusel Tavares,
who is an IT worker at Mar-a-Lago, who if you've watched Midas Touch Network, we've talked about
Yusel Tavares, the IT worker who's been speaking with special counsel Jack Smith. And if you've watched Midas Touch Network, we've talked about Yusel Tavares, the IT worker who's
been speaking with special counsel Jack Smith. And if you've been following the Midas Touch
Network, what have we been telling you? We said a superseding indictment would be coming.
We said that Carlos de Oliveira was the target. Our prediction was correct because we were
following the facts data who was showing up to the grand jury. But one of the
things today, and I'll turn it over to you, Brett, and you, Jordy, all eyes were focused on Washington,
D.C., where we thought that at any moment the grand jury there could indict Donald Trump for
criminal election interference in the 2020 election. Donald Trump's lawyers met with special
counsel Jack Smith's team there, and from special counsel, Jack Smith's team there. And
from all reporting, Jack Smith's team said, be prepared. Trump is about to be indicted. So we
thought, was this going down today? We then heard that the grand jury had left. Reporting was that
the magistrate judge's office was closed for the day. And so there was a moment where I drove to my office
for a second outside of where I record because I thought, all right, there's not going to be any
major news, at least for the next hour. So I have one hour to pick up some files from my office.
Then I was going to head back to prepare for the show. About 30 minutes into my drive,
10 minutes before I get to the
office, I get a call from Brett. Brett's like, did you hear? And I said, what? Brett goes,
superseding indictment. Are you going to record? I go, I don't have a place to record. What are
we talking about? And so I found a studio. I was calling in every favor. The audio is not quite as great for my hot take, but the background is pretty amazing. But I found a place, ran there, put on the mic, recorded the hot take, rushed back, and now I'm here to report on this historic news live on the Midas Touch podcast with the brothers. So we're going to spend the first part of this episode talking about the superseding indictment. We'll go through it in more detail. Then, of course,
we'll talk about what was going on in Washington, D.C. We can talk about Rudy Giuliani as well,
who admitted that he engaged in defamatory statements about Georgia election workers,
Ruby Freeman and Shea Moss. Then Giuliani did a video
of himself saying, I never said that. What are you talking about? You said it. We have your
declaration. You absolutely said it. And then if we have time, we should discuss that hit piece
that it seems like it's actually a far right-wing group called NewsGuard that tries to act like
it's an objective media
that gives rankings like, are you progressive bias?
And they go on and basically say, Fox, very neutral.
Tim Pool, very neutral.
And they went on and they were like, you at Midas Touch never give the alternative viewpoint.
And I responded in the letter to them like, what are you talking about?
I show Trump's tweets.
I show the videos of all of the things
the MAGA Republicans say.
I'm the alternative viewpoint.
Do you even watch this?
So I did a whole response.
I did it as a YouTube video to the letter
to her name is Valerie Palavidias or something.
But we'll talk about that as well. But there you have it. Woof,
I think I could take a breath now. Brett and Jordy, how are you?
I think that's the show. I think you just summed it up. I think that's it. Thanks,
everybody, for joining us today. Now, what a day. Spicy, spicy show ahead of us here.
All eyes, of course, were on DC throughout the day. Today, everybody thought today could be indictment day.
And I guess after all, it ended up being indictment day, just not in the way that we
thought it was going to be indictment day. All day, we had eyes on the grand jury out of Washington,
DC with Trump's lawyers going in for their last ditch attempt to try to argue, you know what,
please don't charge my client, please, please, please. And even Trump apparently was like,
what a waste. What a waste of time. They already have the goods. They're going to charge.
And so they went in there. The reporting is that Jack Smith told them to expect indictments against Donald Trump, their client, of course, for his involvement leading January 6th, 2020 election interference.
All the aspects around that, the attempted coup against the United States of America.
And that is still imminent.
That could still come at any moment. But the surprise at the end of the day, these new charges coming from special counsel Jack
Smith in the form of a superseding indictment, making what I got to say an already airtight,
incredibly powerful, detailed, strong case against Donald Trump, even stronger, looping in another co-conspirator
as a defendant to really hammer that nail into Walt Nauta and Donald Trump. And things just
continue to get worse. This evidence is absolutely damning. And we'll just read through the indictment.
If you didn't see Ben's hot take, let's just read through some parts of the indictment here,
because it is absolutely breathtaking. The level of detail of evidence that they have against
Donald Trump, Nauta, and de Oliveira is truly, truly, truly stunning.
Jordy, always great to have you here. How are you doing today?
I'm doing well. I cannot wait for this show. I'm just so happy that we also get to do the show
live live because it lets us get the most up-to-date information literally right before
we jump on. And so these last two hours, page one rewrite, like we always tell you,
we put together a whole outline and plan of what direction the show is going to go.
Page one rewrite. We had Ben finding studios in the middle of LA.
This is hilarious.
This is wild.
I'm so excited for tonight's show.
Ben, back to you.
Let's just talk about what a superseding indictment is.
The word supersede.
It's almost like an amended complaint in the criminal context.
And it goes before a grand jury.
The grand jury is still impaneled, right? The grand jury hears new facts. The grand jury votes on it. New evidence goes before a grand jury and it supersedes the previous indictment, except there are some differences. And yes, we have what's posted,
the key difference right there as you go down through the complaint that we've seen before.
And there's a whole new section that's called the attempt to delete security camera footage.
And this section, of course, was not in the previous iteration. And this is about three or
four pages where it goes through,
again, painstaking detail. I'm not going to read the entire thing, but I'll give you
a flavor of it and then give you kind of the key parts. And so it talks about how on June 3rd,
2022, when FBI agents were at the Mar-a-Lago Club to collect the documents with classification
markings from Trump attorney one,
who we believe is Evan Corcoran, and Trump attorney three. The agents, I think three may
be Christina Bob, the agents observed that there were surveillance cameras located near the storage
room. So on June 22nd, 22, the DOJ first emails a draft subpoena for surveillance. They then on
June 24th, I'm just skipping ahead a little bit, they then give the actual subpoena for surveillance. They then on June 24th, I'm just skipping ahead a
little bit, they then give the actual subpoena for any and all surveillance records and videos,
photographs, and other CCTV from internal cameras. I mean, right there, that's great detective work
by the FBI agents who are in Mar-a-Lago. They see surveillance footage, go, we want to get that. So they immediately make that request and they request
it from January 10th, 2022 to June 24th, 2022, which is the date the subpoena issued. Reminder,
they're there June 3rd. And usually these surveillance cameras keep the footage for
about 45 to 60 day time periods. Sometimes it's longer, sometimes it's less, but when you make a subpoena
like that, you want to be as broad as possible. And then paragraph 78, 79, and 80 start talking
about this causes a great deal of concern. You have Nauta receiving a text message from a co-worker
that Donald Trump wants to talk to him. There's a
phone call between Donald Trump and Nauta. Then Nauta changes his travel plans. He reaches out
to De Oliveira. There is a number of text messages that paragraph 80 talks about between Nauta and Deoliveria, and it's written so bizarre, like,
hey, brother, I want to see you, brother. You cool with that, brother? Yeah, let's get in touch,
brother, like a back and forth like that. Then you have on Saturday, June 25th, 2022,
Nauta traveled from Bedminster, New Jersey to Florida. Prior to Nauta's trip, De Oliveira told
a valet at the Mar-a-Lago club that Nauta was coming down. De Oliveira asked Trump employee
five not to tell anyone that Nauta was coming down because Nauta wanted the trip to remain
a secret. Shortly after arriving in Palm Beach on the evening of June 25th,
Nauta went to the Mar-a-Lago Club, met with De Oliveira at 5.46 p.m. At the Mar-a-Lago Club,
Nauta and De Oliveira went to the security guard booth where surveillance video footage is
displayed on the monitor, walked with a flashlight through the tunnel where the storage room was located and
observed and pointed at the surveillance. It then talks about how they go to employee number four
to try to see if they can delete the footage. And the text message basically says how the boss
wants the surveillance footage deleted. We believe employee number four is the IT worker who,
if you've been watching the Midas Touch Network, you know his name is Yusel Tavares,
who it's clear now Yusel Tavares is cooperating with the Department of Justice. But let me read
for you these key paragraphs right here about what went down. So at 9.49 a.m. or on June 27, 2022, Trump employee four, Yusel Tavares and Deoliveria
left the area of the IT office together and walked through a basement tunnel.
Deoliveria took Trump employee four to a small room known as an audio closet near the white
and gold ballroom.
Once inside the audio closet, Deoliverira and Trump employee four had the following exchange.
A, DeOliveira told Trump employee four that their conversation should remain between the two of
them. B, DeOliveira asked Trump employee four how many days the server retained footage. Trump
employee four responded that he believed it was approximately 45 days. C, de Oliveira told Trump employee four that, quote,
the boss wanted the server deleted. Trump employee four responded that he would not know how to do
that and that he did not believe that he would have the rights to do that. Trump employee four
told de Oliveira and de Oliveira would have to reach out to another employee who was a supervisor
of security for Trump's business organization.
De Oliveira then insisted to Trump's employee for that the boss wanted the server deleted and asked,
what are we going to do? At 10.14 a.m., De Oliveira texted Nauta, who was still in Florida,
hey, buddy, are you working today? De Oliveira then called Nauta at 10.15 a.m. and they spoke for approximately one
minute. Later that day at 1.06 p.m., Nauta texted De Oliveira, who was at the Mar-a-Lago club,
on my way to you. Between 1.31 p.m. and 1.50 p.m., De Oliveira walked through the bushes
on the northern edge of the Mar-a-Lago Club property to meet with Nauta on the adjacent property,
then walked back to the IT office, and then he had visited the morning, and then walked again
through the bushes on the northern edge of the Mar-a-Lago Club property to meet with Nauta
on the adjacent property. At 3.55 p.m., Trump called de Oliveira and then spoke for approximately
three and a half minutes. I want to obviously talk
more about this superseding indictment, but those are some of the critical new allegations there.
But notice what Jack Smith does also. There's still a disparity of information. Jack Smith's
not telling the whole story. He's not telling everything he knows. He's setting another trap that,
if you're honest, is not a trap. But clearly, this testimony is coming from numerous cooperating
witnesses at Mar-a-Lago who are prepared to testify, as they've already done, under penalty of perjury at trial. And this is going to nail, nail Donald Trump and Waltine
Nauta. Waltine Nauta, who's been glued to Donald Trump, buying him Philly cheesesteaks or whatever,
just got a stank sandwich right here in the form of a superseding indictment,
not the steak sandwich, steak sandwich, steak sandwich. I saw what you did.
No, I mean, incredibly detailed.
It reads like a movie and it honestly reads like an episode of The Sopranos.
And the way they were criming, so to speak, was just so obvious and so blatant that it
truly seemed like they are kind of the world's dumbest criminals
on the entire planet, right? And here's the thing also to remind everybody of,
who is this Carlos de la Veria? If you listen to Legal AF, you have probably heard his name
a billion times. If you watch the hot takes on the My Dissociation Network, you've probably heard
his name a million times, and in the context of being a likely addition to a superseding indictment. But I think one of the
important references to give you also is if you remember, D. Oliveira is the Mar-a-Lago employee
who drained the pool. Remember, there was that very peculiar story a few months back that I think
was a CNN exclusive. They drained the pool. And just so
coincidentally, when he drained the pool, he managed to flood the room where they kept all
their surveillance footage. Oh, what a surprise. How did that happen? Okay. So that is who this
guy is. And it makes that story feel even a whole lot more suspicious than it even did in the first place. And I have to
wonder, just looking through this, the level of detail, Ben, is so precise. And these text messages,
the conversations are so specific. And I remember De Oliveira was one of the individuals as well,
whose phone was seized by the justice department if i remember correctly
is that where they're getting these conversations from how does jack smith have access to these
conversations at such a great detail or does it hint that de olivera maybe he's added but maybe
he's also cooperating with the investigation is that a possibility? What are the possibilities here? What is happening?
He got it. At first, de Oliveira gave statements, so we know what those statements are. If de Oliveira is cooperating, that would be in the discovery material that was already turned over
to Donald Trump. That's part of the discovery obligations by the DOJ. That's why I can
confidently say no. As you go to the new
counts that are being charged, so scroll down to like count 42 of the indictment. And so this will
talk about like what DeOliveira said. And it's a charge for making false statements, I believe.
Let me pull open 42. Yeah, false statements and representations. Not a horrible memory for just seeing this thing as I was driving to the office.
Count 42, false statements and representations.
So this was the meeting that took place.
And this is why DeOliveri is being charged with making false statements.
So as part of the meeting between DeOl of area and the FBI, the following false answers
were given question.
When, after the end of the presidency boxes arrived at Mar-a-Lago, were you part of any
group to help answer?
No.
Unload them and move them.
Answer.
No.
Do you, were you, do you even know, like, were you even there or where that boxes were?
No.
Like all of this stuff was being moved
in. Never saw anything. Okay. Yeah. And then question, even his personal stuff, like his
clothes, never. And furniture, nothing. Never saw nothing. Okay. So you don't know where items
would have been stored as soon as he moved back to Mar-a-Lago? No, 120, paragraph 120. The underscored statements and
representations above were false, as D'Oliveira knew, because D'Oliveira had personally observed
and helped move Trump's boxes when they arrived at Mar-a-Lago Club in January 2021. Brett,
if he was cooperating, Special Counsel Jack Smith would have that information. So he's not cooperating. Special counsel,
Jack Smith and his team, unlike Donald Trump's team of lawyers who are horrific,
like the worst of the worst. And that's who Donald Trump surrounds himself with,
the worst of the worst people. And anybody who's good on Donald Trump's team has at this point quit. He's got horrible lawyers.
And special counsel Jack Smith's team is like LeBron James in their prime of prosecutors.
So it's basically like saying, oh, how does LeBron James dunk, right?
Like Jack Smith gets this information.
Like this is the equivalent of a layup for special counsel Jack Smith's team.
So they've subpoenaed everybody's phone, all of the records. The person who's cooperating
is employee number four, Yusel Tavares. He's the one who hasn't been charged.
So Jack Smith's getting it from there, from the subpoenaed phones, from other witnesses,
from other surveillance footage, from other employees. And Jack Smith's
created not a minute by minute, a second by second chart of everything that has happened.
And special counsel Jack Smith's team of prosecutors, all the top counterintelligence
officials ever, some people who have left private practice to join this dream
team. They have all of the data. So you combine that with how freaking stupid Donald Trump and
his team are. Like any white collar criminal defense lawyer would tell you, look, you better
be careful when you make any statements about these documents that are being
referred to, for example, on page 17, which is now count 32 of the complaint. So if you're going to
go out there and say, oh, these were just magazines and Donald Trump was just bragging and just saying
that these things were classified military war plans when they were not.
You know, special counsel Jack Smith may actually have the documents, right? Like
you realize that and it's going to show that you're just a liar and everything. But you know,
MAGA Republicans are just so divorced from evidence and reality and the courts that they spin this fiction in these interviews and think it's without
repercussion. And I suppose to cowards like Kevin McCarthy and Elise Stefanik, freaking traitors,
let's just call them out who they are, Jim Jordan, James Comer, who would better be Vladimir Putin's
right hand than be people who lead major committees in
Congress. Maybe this crap works with these freaking morons, with these damn idiots.
But for people who care about evidence and actual law and order, look at what Jack Smith just did
in this superseding indictment. You talk about page 16, page 17. Go to page 16. It talks about
this encounter where Donald Trump's showing the classified material, the war plans for invading
Iran to Mark Meadows' ghostwriter saying, doesn't this make me better than the chairman of the
Joint Chiefs of Staff, Mark Milley? Aren't I cooler than Mark Milley? Aren't I the best?
That's actually what Donald Trump is saying. And everybody said, okay, these seem to be war plans.
And Donald Trump in their defense was, no, he was just bragging. Those weren't really war plans.
Jack Smith doesn't have anything. Yeah, he has everything. Because you go down and here's where
it's just one sentence added to the superseding
indictment, right? It supersedes the other one. So this sentence wasn't in the other indictment
and Jack Smith does it with surgical precision. And here's what he says. Top of page seven.
We didn't add those sound effects. That came straight from Ben, just for the audio listeners
only. Samurai sword. Careful about your microphone, Ben. Okay. Jack Spitz just goes,
the document that Trump possessed and showed on July 21, 2021 is charged as count 32
in this superseding indictment. All right. So I go, okay, what's count 32? What's count 32?
Scroll down, scroll down, scroll down to the counts. 32, 32, 32, 28, 29, 30, 31, 32,
January 20th, 2021, January 17th, 2022. Top secret, no F-O-R-N as a top secret document, presentation concerning military activity in a foreign country.
In other words, special counsel Jack Smith has got it. He's got the goods. We've got the goods.

Jordy. Ben fired up today. I love to see you fired up.
I noticed some energy there.
The one thing I love about all this, though, it's what we've been saying for a long time now,
that these lies, and this is something Ben was hitting on before, these lies may be okay
if you're Kevin McCarthy going and speaking to the press.
It might be okay if you're Rudy Giuliani speaking to the press or
going on your podcast or doing whatever you're doing. And we'll get to Rudy in just a moment
here. But the second that this actually enters a lane in which evidence matters, all of that
completely crumbles. And the evidence here in this case, and frankly, in all of the Trump cases, is so overwhelming, is so undeniable.
It is at such a level of detail that especially what Ben just read feels like a movie when you read it,
with them going through with flashlights and looking for the documents to hide and pointing them at the surveillance cameras. I mean, this stuff does have this odd kind of cinematic
feel to it. And it's not even everything that Jack Smith has. This is just what he is dangling out
there. And we are lucky that these criminals are so dumb. This is feeling now more than ever,
even more like a Watergate than it used to feel like with this destruction and
concealment and hiding of documents, of recordings, of tapes.
I mean, talk about the past repeating itself, but this is on such a grander level.
And Jack Smith, every step of the way going, okay, Donald, why don't you give that bullshit
excuse?
Why don't you tell me that you
can't find that document, that it didn't exist, that you were actually just rattling around a
newspaper or a magazine? Go speak, speak, speak. Nope. I got the goods. Here they are,
adding it to the indictment. You're done. You're fired.
It's stupid Watergate is what it is though. I think John Oliver used
to say that. Trump in general and this situation, stupid Watergate. That's the brand. That's what
this is. One of the reasons I am kind of jubilant today, number one is that law and order and
justice is being served. I think that's so important. But two, the journey we're all taking as part of the Midas Mighty community,
kind of feeling a little bit back in my professorial mode, all of these pieces that
lined up, including predicting the superseding indictment, who was going to be charged,
why Carlos de Oliveira was going to be charged,
what he did, who's useful to Varys. The whole process, I think when you see how we've built
brick by brick here, that's why watching the Midas Touch Network every day kind of builds on itself.
And sometimes I'm redundant, but I just want to try to build for people who are joining as this community keeps on
growing. But I hope everybody kind of when they heard this news, even though of course it was
shocking maybe that it happened today, the overall news that this went down is not shocking. And also
I want to be very clear that I was never just trying to give people hopium. I don't operate
like that. If things are not going in that direction, I've said, I don't think it's going
in that direction. This isn't going in that direction. Here, if we just track what's going on,
it's like following a weather pattern in a way. And you can kind of see a weather pattern develop does that mean
for sure that's where it's ultimately going to go no but it follows a pattern
and then there are certain kind of branches where it can go and then we
could try to identify using all of the data the the most available probability
of what the outcomes going to be which is why a little bit later in the show
when I when I show you what appears to be kind of a psy-op group called News Guard or something
that really kind of works for right-wing interests that tries to label groups that
are spreading the truth, has like ultra-progressive bias. We're going to get into that. And it's like,
I delivered this really long response because the facts matter so much to me, not the political parties. I identify with the only major political
party right now that aligns with the facts. But if that changes, then I'm going to change.
Right now, it's the Democratic Party, which aligns with democracy, with facts, with objective
reality. And I show you what goes on in the committee
hearings. That's why I'm supportive of them. But as I said, the bottom line is President Biden
posts one QAnon post, one, for all of the support for the PACT Act and the CHIPS Act and the
Inflation Reduction Act and the Infrastructure Act and Build Back Better, all of the Biden stuff.
He gives me one QAnon tweet and says,
where we go one, we go all. I go away from supporting President Biden. That's where I go
because it's disqualifying. You have to have standards. You have to believe in truth and
evidence. And that is so critical that we go over the evidence for you. And that's why this whole Rudy Giuliani thing is another perfect example of right wing gaslighting that we can expose really, really, really kind of easily for everybody.
So you can just see how it is that they lie. I'm going to show you the declaration that Giuliani lodged in a defamation case brought
by Ruby Freeman and Shea Moss, Georgia election workers who Giuliani brutally defamed, destroyed
their lives.
They received so many death threats and Giuliani basically said that they're drug traffickers
and like their history of being drug traffickers and criminals, they're harvesting
ballots and secretly bringing in ballots into Georgia. And they're the reason that Donald Trump
lost. And he put it on them. His attacks were clearly racist. His attacks were misogynistic.
His attacks were lies, disgusting lies. So Ruby Freeman and Seymour sued because they had to sue.
But for them doing that, the truth would not have come out. But for them having a great law firm
that represents them, the truth would never have come out and the lies would continue to be spread
on these MAGA Republican networks like Fox and others. And frankly, other media would not
have done a good job. I want to show you the video that Giuliani made of himself today after filing
a declaration where he admits to committing defamation. Each and every element of defamation
he admits to, including that the statements he made about the Georgia election workers
and everything they state in the complaint about him, that they are true and that he made false statements.
But here is the video he recorded of himself today. Play this clip.
Number one, Giuliani is cooperating against Trump. Untrue. Giuliani is telling the truth,
which is that Trump is entirely innocent.
Fake news number two, Giuliani admitted that he lied.
No, Giuliani, in a lawsuit, in order to reach the merits of the lawsuit,
didn't contest the earlier portion of it with a clear statement that that was no admission,
that it was true or false. Happens all the time in lawsuits.
It's called admission arguendo.
And of course, only the most dishonest and cheapest of reporters deliberately misunderstand it. So
let's make it clear. I have not admitted that I lied at any point. I haven't. And of course,
I'm not cooperating against Donald Trump because there's nothing to cooperate about. The man is innocent and they're framing.
OK, so let's go through the declaration that Rudy Giuliani filed.
So he said, I never made any statements saying that what I did was false.
Well, Giuliani, this is a declaration that you filed and this is what they don't want
to put on their right wing media.
And by the way, it's what legacy media is too lazy to go
through. I know it's a little bit boring going through declarations. You rather have two talking
heads yell at each other and then call a commercial break. I get it. But that's not what the people
want. The American people want the truth. The American people want to know, show me the document.
I appreciate your opinion. I appreciate
you doing the samurai sword gesture, Ben. All funny, all good. Now can you show me the document,
please? It's like Jerry Maguire, show me the money. Show me the document. Well, here's the
document right here. And this is a declaration filed in a federal court in the Giuliani case where he's being sued for defamation. It says,
one, defendant Giuliani concedes solely for purposes of this litigation before this court
and on appeal that defendant Giuliani made the statements of and concerning plaintiffs,
Ruby Freeman and Shea Moss, which include all of the statements detailed in plaintiff's amended complaint,
and he does not dispute for purposes of this litigation that the statements carry meaning
that is defamatory per se. So basically accepts all of the allegations against him as true,
and he does not dispute that it carries a defamatory meaning. Two, so that's element
number one of a defamation case.
Two, defendant Giuliani, for purposes of this litigation only, published those statements to
third parties. So one, it was defamatory per se. Two, those statements were published to third
parties. And then three, that Giuliani, for purposes of this litigation only, does not
contest that to the extent the statements were statements
of fact and otherwise actionable, such actionable factual statements were false. Were false. Let me
just read that again. That such factual statements were false. That is what you said, false. Paragraph four just says that Giuliani will
not contest any other cause of action against him. For example, intentional infliction of
emotional distress. He's stipulating to that as well. He's stipulating to liability. And Giuliani
goes, oh, that's just admission arguendo. It happens all the time.
No, it doesn't.
That doesn't happen all the time.
Maybe in a personal injury case, like involving a car accident where liabilities established
because like one car crashed into the other car.
So it's obvious liability.
In a case like that, there's admitted liability.
In a defamation case, stipulating to liability is almost unheard of.
I've never heard of it before. And I've been and I've seen high profile defamation cases.
It doesn't exist. It would be like Fox saying, you know what, Dominion? Yeah,
we defamed you. That's not what happened. The judge on summary judgment had to make that
finding because Fox didn't stipulate
the defamation. And so what Giuliani is basically saying, because Giuliani's broke,
is I'm going to admit to everything and I'm basically going to declare bankruptcy. Now,
it's a non-dischargeable debt. An intentional tort is non-dischargeable, but Giuliani's broke.
So in Giuliani's mind, why is he saying this? Because he doesn't want to get
sanctioned more money for not turning over documents. And by admitting to liability,
he doesn't have to produce extra records and documents because the case is already proven.
He basically loses. Now it's just a matter of what were the damages caused. But ultimately,
he figures, okay, this may delay trial for a year.
His gamble is, well, maybe Trump wins and there's a fascist takeover of the country.
So that's essentially where he's going with this. But when he puts out a statement and goes,
I didn't say that, you did. And you're a bunch of liars. In a moment, we're going to show a
Trump podcaster recognize that he's living in a cult.
Steve Deist or whatever this guy's name is on Blaze podcast. He realizes that he's in a cult
live during the broadcast. But before getting there, Brett, Jordy, any comments?
Yeah, my comments is it's once again, you see what they say on TV, you see what they say on
their podcast, and then you see what they're actually saying in court filings when it actually matters legally.
And Rudy here is trying to play both sides.
And Rudy himself brought up his interview with the Department of Justice, that proffer agreement that Ben has talked about in depth.
You can check out all of Ben's hot takes on that. But one of the interesting things about this to me is if he is willing to
admit guilt in this scenario with Ruby Freeman and Shea Moss, it seems likely to me that when
he's being questioned by Jack Smith and the special counsel prosecutors, that he would also
admit guilt in a similar way because he is a coward. When he is actually being questioned by the law,
when there is actually something on the line, be it prison time, be it monetary sanctions,
he will spill the beans and then he'll go off and he'll say whatever he wants to the cult.
Rudy's going to do whatever he needs to do to stay out of prison, Brad. So I totally agree.
He's going to cave the second Jack Smith starts to really dig into there.
I just still, every time I see the man, I just cannot believe where he was in 2000s
to where Rudy Giuliani is here today.
It is one of the saddest things to see.
And it just goes to show like morals matter.
Like your morals are something that's like ingrained in in you from childhood. It's not something you just
lose. So to me, it's just so questionable that he had this moment where I think a lot of America
at the time rallied behind him, thought he was doing such a great job in New York. And it's
almost just like, man, what a disappointment. Thought you were better than that. But no,
he's not. Not even freaking close. Yeah. What do you have the Republicans doing right now? Sorry. Do you want to go, Ben?
Look, it's not like I dislike Giuliani because he has duty dripping down his head.
Exactly.
That's not – I don't just dislike. It's because he's a liar. It's because of his conduct. And what I try
to do is evaluate the person's body of work and their conduct. And I try to evaluate the evidence
and I tried to look at the data. And when I see things like that, you know, you know, it's so
malicious what they do. It's so vicious. It's so harmful to our democracy.
And the fact that you have an entire MAGA Republican Party right now, that's all this.
It's all low character, low intelligence, or if they have high intelligence, they have to act low intelligence to fit in. It is disgraceful. And I frankly welcome a real
Republican Party again. I'd be fine with that, that if we could have real debates and we can
talk about, well, should this or that or the other thing, and maybe tax policy, this or that,
I'd be happy to talk about the success of Bidenomic versus trickle down. I'd be happy to have that debate,
but I'm not debating that LGBTQ people exist. Okay. I'm not debating that they exist. Not a
culture war. It's you freaking hating and being a hateful, despicable person. That's not a culture
war. That's you wanting to eliminate people. I'm not debating that you MAGA Republican
sickos want to be in the doctor's office and in the bedrooms telling people how they should have
sex, telling women to control their bodies. That is sick. That is disgusting. And I'm not having
a debate with you over women should be able to control their bodies, you freaking disgusting
sickos. And we need to call them out like that because that is who they are, disgusting people
right now. And I use that language because there's nothing else that captures it.
And so, yeah, I'm fired up. I'm fired up because of the superseding indictment. I'm fired up from the earlier hit that we did about this right wing PSYOP that basically tries
to spread these lies so it could be picked up
in like bios of people when this is evidence and data based.
But I am also excited to know that people are waking up.
People are waking up.
And I'll just show you this example.
This is Steve Deese,
this right-wing podcaster. And here's a moment of reflection where he goes,
I think I'm the mark. I'm in a cult. Play the clip.
We are going to the mattresses for these people. We are offering them more accommodation,
more chances than we'd offer our own family members, for goodness sakes.
And for what?
To have Rudy Giuliani go down to Georgia and admit that he lied?
Have Jason Miller tell the January 6th Commission, yeah, we all knew it was BS.
What is this?
Some of you don't like it when I use the cult word, but when you like being treated like a schmuck
and ask for more, that is a cult.
I'm the mark. I'm the sucker.
I want to be such.
And I resent the person who tries to get me out of that.
Those are marks of groupthink, frankly.

Because I went to the mattresses on COVID
and the election fraud issue.
Only to have Rudy Giuliani say, yeah, I was lying.
And Jason Miller say, oh, we knew it was all BS.

You know, one of the hardest things for people who are in a cult is because they've lost so many family members because they've made this part of their identity for so long. And so many people have said to them, look, you're being lied to, you're being lied to.
So for them to admit that they were lied to, and then to try to get back into society,
one of the things we've learned from cult deprogramming, that is why
cult members actually, even when they know they're being lied to, dig deeper down the rabbit hole,
hoping and grasping. It's like going for a bigger drug and a bigger high because the fear is once
you get out, what that withdrawal is going to be like. And when it comes to culty programming, the withdrawal that people fear is what is their
family going to say about them?
What's the community going to say about them?
And that's why here, even if somebody, I mean this, and it's hard, even if somebody
was not necessarily in the insurrection, although Pam Hemphill, the J6 grandma-
Yeah. I want to talk about that in a sec, but keep going. I want to bring something up though
when you're done with this. I don't want to slam the door on people's face if they are waking up to the reality. I want to give them a smooth landing and I want to be
compassionate to them. And rather than mock them and say, hey, it's so late now, you think?
I do want to say, look, I know that was really screwed up and you may have done some things
that were bad as a result of it. But I think people can get out
of that. And I want to be helpful for people to get out of that. But I wanted to share that lesson
on culty programming to everybody. Yeah. And Ben, no, you're spot on. Sorry,
Brad. I just wanted to add one thing before I kick it to you. It is just even beyond, Ben,
the familial loss
and the loss of community that happens to these folks when they're in the cult,
the monetary loss is so big. I mean, think about what that podcaster had said during the scheme of
it. He said, how many of you donated to the Stop the Steal campaign? They're so personally and
financially invested and they don't want to admit that they're wrong, which is so hard to pull them
out from. Sorry, Brett. And a lot of Brett. Sometimes people think like, how could I help somebody get out? There are certainly
things that people can do, but oftentimes people need to take their own journeys and they need to
have that epiphany within themselves to take it upon themselves and say, I got to do something.
Then hopefully when they do reach out,
hopefully instead of shutting them down, you're able to help them out. But to the point, and I know we've been building up to this NewsGuard piece, which I'm excited to speak about, but I
just want to give the listeners here a sense of some of our guests that we've had on the Midas

perspectives that people hear from and to understand that what we're trying to build

on our network. So when you come at us and you say that, oh, you are this far left organization
or whatever you're going to throw at us, you're clearly not paying attention because that is not
at all what this is about. And as Ben likes to say, do we personally have a lot of progressive
ideals? Sure. We do not use that framing though. And we actually find ourselves to actually be far
more conservative than these people who want to literally overthrow our democracy. Nothing conservative about that.
Donald Trump has come out. Donald Trump has said publicly in writing that he wants to terminate
the constitution. His words, terminate the constitution. I'm sorry, but I don't need to say,
well, maybe he's got a point there. Maybe we need to bring on someone from MAGA to
give us the benefits about terminating the Constitution and destroying the country.
And if we don't do that, oh, I guess we're just biased lefties. No, I'm putting my foot down.
That paradigm is stupid, frankly, just to speak bluntly about it. And it does severe, severe damage when you have an organization
that is rating people within that paradigm. And then other organizations, because this
NewsGuard organization that we're going to talk about, they partner with all the big,
like with Bing and MSN and all these large companies who look to them for who is trustworthy
and who is not trustworthy. And then also what happens? People, Wikipedia, biographies,
websites, news links, they then reference the articles that they do and they'll go,
oh, this hyper-biased platform in this way. Oh, the super biased far left organization, whatever they want to say.
And that's how these narratives are created. And when the pressure on you, when they're asking you
these questions of, well, why didn't you provide this alternative viewpoint on should America
exist or should it not exist? What are you even talking about? And even in our own hits,
even in the hits Ben does every single day, the main through line of just about all of them is here is a clip of this perspective. Now let me fact check it with the truth.
And we do that every day, 12X. And that is kind of the entire thesis of Midas Touch. It's combating these lies. And so we are going to
continue to combat these lies unapologetically. You could call it what you want. I here just call
it the truth. And do we get it right 100% of the time? Absolutely not. And I would be crazy if we
told you we did. But I think we have a pretty good batting average.
I think we lead with good faith. And I think we are always in search of the truth as our North
Star. And that should be more important, not balancing, well, so-and-so said this,
but Kellyanne Conway said this. So the truth is probably sprinkled somewhere in the middle.
No, I'm sorry. That's not how it works. And MAGA and these forces
that want to destroy our country rely on you thinking that's how everything should be framed
in order to push this country off a rightward cliff. Enough is enough. Whoa.
Love it. Love it. Love it. And also we should talk about Bidenomics is working also, because I think it's important to just reflect on, you reminded me that when you say kind of
trickle down, I think about how trickle down economics doesn't work, but Bidenomics is
actually not at a point where we spike the football, but we should talk about that. Also,
a lot of breaking news when it comes to special counsel Jack Smith, because he filed a renewed protective order. And one of the things that Trump is asking for is to
review the classified information outside of sensitive compartmented information facilities.
He wants to review them in places that don't have skiffs. He wants to take classified information
and review them in non-classified places, it's going to be a big,
important ruling for Judge Eileen Cannon because ultimately, if she rules that he can do that,
I think then that will be immediately appealed to the 11th Circuit Court of Appeals. It may be a
good thing because then it will be bye-bye Judge Eileen Cannon. Let's talk about that in this

We're back live on the Midas Touch podcast.
I'm Ben Micellis, joined by Brett and Jordi Micellas. Let's first go over special counsel Jack Smith's new filing, a renewed request for a protective order.
Let's talk about Bidenomics is working. And then let's talk about this NewsGuard letter we received.
So here's the new filing. It's the United States renewed motion for protective order
pursuant to Section 3 of SEPA, the Classified Information Procedures Act.
Let's go down to the main area of dispute between special counsel Jack Smith and Trump's lawyers over the proposed protective order.
And mind you, now, this is in the context of the fact that we know Donald Trump showing war plans to people.
We know what the superseding indictment is. We know that Donald Trump's asking to destroy evidence. So after the superseding
indictment, that adds additional context to this motion that's being filed by Special Counsel Jack
Smith. So here it says, the government's proposed protective order limits the areas in which
classified information may be handled and discussed. For example, pursuant to the
government's proposed protective order, any classified information the defense discusses
with defendants in any way shall be handled in accordance with this order in the attached
memorandum of understanding, including such requirements as confining all discussions,
documents, and materials to an accredited SCIF, Sensitive
Compartmented Information Facility, because we're dealing with classified information.
And this is what happened when Jack Smith's team called Trump's legal team.
Defendant Trump's lawyer, counsel, objects to the provisions in the proposed protective
order that require them to discuss classified information with their client only within a SCIF.
They expressed concerns regarding the inconvenience posed by this limitation and
requested that defendant Trump be permitted to discuss classified information with his counsel
in his office at Mar-a-Lago and possibly Bedminster. The government is not aware of any case in which a defendant has been permitted
to discuss classified information in a private residence and such exceptional treatment would
not be consistent with the law. Then it goes through the intelligence directives as well as
common sense that it says a significant portion of the classified discovery in this case,
including the majority of the charged documents, include sensitive compartmented information.
Moreover, discussing even non-SCI classified information in an unsecure area would be in violation of regulations. All persons who have authorized access to classified information
are responsible for ensuring that classified information is not communicated in unsecured areas. So the gall, the gall,
and MAGA Republicans will support this guy. They'll support this guy. So that is the filing
that Special Counsel Jackson that just made Trump's lawyer say, yeah, he's credibly
charged with stealing classified information and doing things with them in unsecure areas,
but it's going to be so inconvenient for him to have to drive to a skiff.
It's going to be inconvenient for him. And Jack Smith's calling out. We'll see what Judge Eileen
Cannon does, but it's going to be a major ruling for her because,
by the way, I don't trust Judge Eileen Cannon. I think Jack Smith would actually be happy if
she ruled the wrong way so he could run immediately to the 11th Circuit and try to
get rid of her in this case. But wow, wow, wow, wow. And Jack Smith's response,
there is no basis for the defendant's request that he
be given the extraordinary authority to discuss classified information at his residence. And it
is particularly striking that he seeks permission to do so in the very location at which he is
charged with willfully retaining the documents charged in this case. It's such a good point too. You want to take this information that
you weren't supposed to have at this place and you want to read it at the same place
where you were charged for these crimes. It's just so, so, so brazen.
What I ask, and I ask you, Ben, too, from the legal perspective, and Brett, I'm interested to hear your take, too, is that the play? Is that Trump's playbook in all of this, is that he wants the ruling to go in his favor so he can review them exactly at the scene of the crime? So he could then say, look, they ruled on it. I'm allowed to look in the mirror. How sensitive could these documents be? Is that the crayon up the nose chest that Trump is trying to play here, Ben. Listen, personally, we get Ben's response soon. I think we need to all stop thinking about Donald
Trump as some super mastermind genius who's going to flip out of this one. Everyone complains,
oh, it's taking so long. It's taken years and years and years, and we've been waiting eight
years. No, first off, no, we haven't. Nothing was ever going to happen while he was president. I'm
sorry. It was not going to happen. So it's really just been the
past few years. And now as you see these indictments, sure, did we want them to come
quicker? Absolutely. And I understand that 100%. But you see how meticulous they are,
and you see the level of detail that they are in there, and you see all the mechanisms that
prosecutors have to ultimately get their end
result if they want it, right? They are going to use every legal means necessary to ensure that
Donald Trump is not out there in his drained Mar-a-Lago pool, flipping through sensitive,
compartmented, classified documents. And so Jack Smith has that move, like Ben said,
where if it comes to it and Judge Cannon does make an absolutely disgusting ruling, and she might,
or maybe she cares a little bit about her credibility. I don't know about that, but
we will see. If she does not make the right decision, Jack Smith then has that option to
appeal, and that appeal could end up getting Judge Cannon completely off the case entirely.
So for all this talk about Trump, the Teflon Don, all this stuff, to me, it's my opinion,
I do not see it that way. I think he is in a whole lot of trouble. And I think
with these charges, I see only one out for him. And it's exactly why he's running for
president because his one out is he gets to be president, he becomes a dictator, he shuts
down the DOJ investigations, and that's that. And is that a possibility? Scarily enough, yes, it is a
possibility. But is he going to escape things through any other legal means while our democracy
still exists? No, I truthfully don't believe it. I believe they have him dead to rights
on all of these cases, on the federal cases, on the state cases. I think he is in a whole lot of trouble.
And I think he knows he is in a whole lot of trouble and it's going to keep getting worse
for him. That's my opinion. I agree. My question was more, I agree,
Brett. No, that's an excellent way to phrase it. But Ben, when you answer it, I guess my question
is more on the optics. Is Trump trying to play an optics game here? Does that make sense?
It makes sense. Look, he's a malignant narcissist. So on one level,
everything is me, me, me. It inconveniences me. But Jordy, you do raise a good point, right?
If at the end of the day, he's permitted to look at these documents in the crime scene,
does his lawyers go to the jury and go, his lawyers say, look, he looked at the documents
there anyway as part of this case because it's a secure place because he was allowed to.
This is the argument they're going to make.
I don't agree with this.
So what was the issue?
So he looks at it in Mar-a-Lago.
Then he looked at it in this case.
It would allow the lawyers on closing to try to make that argument.
The government would file a motion to eliminate precluding that. But part of it is, it inconveniences me. This is an inconvenience.
It's not an inconvenience to the nation when you show our classified war plans and documents
to people. And Brett, his only defense right now is the one that he's pursuing, which is destroy democracy,
destroy America. That's what he is trying to do. Meanwhile, you have Bidenomics working.
I do want to highlight the fact that President Joe Biden's economy continues to grow. The US GDP
shot up again in the second quarter. You've got the insiders saying these are all the headlines
from today. U.S. economy is surging. Economy defies expectation. GDP surge is 2.4%. U.S. GDP
growth accelerates to 2.4%. Blowing past estimates, a resilient U.S. economy grew at a 2.4%
annual pace in the second quarter, propelled by steady consumer spending and a rebound in
business investment. Consumer spending, the main engine of U.S. growth, rose at a 1.6% pace from
April to June, the government said Thursday. Business investment increased by nearly 8%
and construction and manufacturing facilities contributed more to growth than it has in 40
years. Real personal disposable income increased by 2.5% last quarter. Inflation continues to fall.
Core PCE inflation fell to its lowest quarterly rate in two years. Inflation is now under 3%.
And while doomsayers once predicted 100% chance of recession. Wall Street is now directly crediting Bidenomics for
much stronger growth this year than expected. It's the latest evidence that Bidenomics is
growing our economy from middle out and bottom up, not top down. 13.2 million jobs created under
President Biden, nearly 4 million more jobs than before the pandemic. 3.6% unemployment, that's under 4% for
17 consecutive months, the longest stretch over 50 years. More Americans are joining the labor
force. The share of working age Americans with jobs is the highest in 20 years. Inflation has
fallen for 12 months in a row and is down two thirds from last year. Wages are rising. Wages
are higher than they were before
the pandemic, even accounting for inflation. I want to show you this clip right now of Democratic
Congress member Ted Lieu talking about what Democrats are focused on, the economy rising,
and what is it that the Republicans are focused on. Play the clip. Today, Bloomberg reported that U.S. GDP growth accelerated to 2.4 percent, blowing past economists' estimates.
Consumer confidence is also at the highest level in over two years, and inflation has now declined for 12 consecutive months to a low of 3%. The United States has the highest GDP growth and the lowest inflation of all the G7 countries.
So growth is up, consumer confidence is up, inflation is down.
This is Bidenomics, and it did not happen by accident.
When Democrats were in control last term, we passed numerous laws to grow our economy from the bottom up in a middle out.
We passed the American Rescue Plan, the Inflation Reduction Act, the Chips and Science Act, the infrastructure law.
All of those laws have now grown our economy and grown the middle class. What are Republicans focused on?
Putting women in jail for concealing abortions.
Powerful.
Very powerful.
And one of my favorite traditions always is anytime we hear some good economic news,
that's the exact time.
And this is going to be the only time that I recommend.
Turn over to Fox News is going to be the only time that I recommend, turn over
to Fox News and try to catch the moment where they're forced to cover positive economic
news.
They'll throw in Hunter Biden here and there.
They'll throw in other things to distract, but at a certain point, they have to cover
the good economic news.
Oh, it hurts them so bad, But they could not even hide their excitement
today about the GDP numbers. And if you haven't seen this, you're in for a treat.
This, Maria, 2.4%. Wow. This is the first read, the advanced read for second quarter GDP.
Estimate was only for 1.8%. Talk about a strong economy. There goes that recession talk, right?
And what's interesting here is the expectation was we were going to have a weaker Q2 this first
read that we had in Q1. Remember, we had a 2% read in Q1 for this year. We're thinking we were
going to have a slowdown. It's the opposite, 2.4%. And, you know, even the range, this is in the high
end of the range that economists were looking for.
So that's pretty darn interesting.
Really, Q4 was 2.6 percent.
So economy is still strong.
There you have it.
And, you know, always brings a of stories over the past year plus that a recession
is going to hit any day now. Here comes the recession, recession around the corner. Are we
in a recession? Oh, I think we're in a recession. None of that was true. None of it was ever true.
And I don't want to spike the football on this issue by any means because there are
a lot of people struggling out there and things are hard for people and prices are still incredibly
high for people.
But the data don't lie.
And so it's important that we show that and that we show that data in an objective way
without that fear mongering, without telling you every day, oh, the are recessions around the corner. I got so sick and tired of hearing that.
And now all of these analysts, every single one of them who was wrong now go,
whoops, whoops, are bad. And then they start making more horrible predictions.
And one of the things I noticed about that list of all the organizations that had headlines, when you look at it and you see the CNBCs and you see Fortune and you see all those companies,
those were a lot of the companies that previously had actually been predicting
the most doom imaginable for the economy. And now it truly looks like we're going into the back half of this year, we're going into
next year with a lot of indicators now heading into the right direction, with consumer confidence
at its highest levels in years, with people starting to feel good about the economy.
It's not only showing up in numbers, but it's actually showing up in people's
perceptions, which is arguably even more important than what the data says, right?
I mean, it's important that people are feeling the effects personally and that people feel like
they could take their family out to dinner, that people feel like they could go see a movie on the
weekend, that they could go fill their refrigerator with fresh produce and fresh food for the week.
Now, all of that is being felt. We're seeing inflation come down. We're seeing the jobs
numbers grow. We're seeing this manufacturing super cycle. All the while, we are seeing
Republicans take more and more and more extremist stances because what they're doing right now
is they are not trying to help people. They're not trying to put forward policies
that are going to make people's lives easier. Unfortunately, I wish they were putting their
ideas forward of what they think they would make people's lives easier, but they are in fact doing
the opposite. They're stripping away people's freedoms. That's the only legislation that they
seem to be able to pass around the country, just depriving people of their rights. And at the same time,
they are weaponizing the government in order to try to protect Donald Trump, spread misinformation,
platform people who say despicable things, platform people who are like literal insurrectionists.
That's what they are concerned about right now, trying to talk about and float these ideas of,
oh, we got to impeach Joe Biden. Why do you want to impeach President Biden? I don't know. Donald Trump told me to do it, so I'm going to
do it. I mean, this is how they're running the country right now. And now we're looking down
the pipe and now what's their next scheme? Oh, maybe we force a government shutdown this year.
Maybe that's going to be our move. We weren't able to shut the
country down with the debt ceiling. So let's hold the economy hostage once again. That's coming,
folks. And keep your eyes out for it. And we'll be speaking about that a lot more on this show.
But look at their moves, look at their decisions, and look who they impact and how they impact them.
And to me, that is what tells you everything about
them. I want to now talk about NewsGuard. And to be fair, I don't know if this is the whole
organization, if it is just the questions that were being asked. I do want to say this, at least
based on the current research that I have, they consider Fox News to be credible
with exceptions. That is the rating that they give Fox. So if I was a little hyperbolic in saying
that it is a right-wing whatever, I want to be clear. I don't want to fall into the trap in my
evidence-based special counsel Jack Smith approach. I don't want to-

I don't want to get overzealous.
I'll be clear because my other approach is very evidence-based and facts-based.
And what the situation is with Fox, they call Fox credible with exceptions.
And that to me is exceptionally ignorant that that's
at least my understanding of their current review. Beyond that, I have no evidence to suggest
anything. Okay. Now that I... I'll pull up a little bit of the other evidence of what they said
to us. So this is a staff writer. Her name is Valerie Pavilonis. And she goes, my name is Valerie
Pavilonis. I'm a staff analyst for NewsGuard, which reviews and rates online sources of news
and information. I hope this email finds you well. I previously emailed a personal email of one of
the hosts, but this address seems more appropriate. I'm writing because I'm currently working on a
report of the Midas Touch podcast. I have some questions about the podcast, which are included below. One, who technically owns the podcast? We
said the Midas Touch Network. Two, when we rate podcasts, we check whether podcasts are dominated
by one-sided opinion. From what I've listened to, the Midas Touch podcast is dominated by one-sided
liberal opinion without alternative views. And I won't waste our time
reading the full letter. I'll just give you an example that she cites where she says we are
biased and only provide one-sided liberal views. She goes, later in the segment,
Ben Micellas said of the Republican Party, the whole party is, hold on, I want to go up a little
bit more. During July 18, 2023 episode, the host discussed the 2023 Turning Point Action
Annual Summit. And this is what I said, quote, so what went down at this conference, said co-host
Ben Micellas? Well, you had Donald Trump Jr. saying he doesn't do cocaine because that's
somehow important to the American people. Lauren Boebert saying that she is a rhino hunter because what are you even talking about? Marjorie Taylor Greene saying it's a bad thing that President Biden is like Lyndon B. Johnson. Ted Cruz saying the Barbie movie is a communist Chinese plot. And Trump making up fake conversations that never happened between himself and Vladimir Putin.
I mean, such a sad state of affairs for the Republican Party on full display at that conference in Congress and just throughout the country. Later in the segment, Ben said of the
Republican Party, the whole party is completely destroyed. The whole party is completely deranged.
What we are seeing are the last gasps of a dying political movement. And it is our job to usher in
an era of normalcy. The episode did not provide alternative viewpoints. So just pause right there.
Like that is false. Like the alternative viewpoints or the viewpoints, I showed all of
the clips of Don Jr. I showed what Lauren Boebert said. I showed what Marjorie Taylor Greene said.
I showed what Charlie Kirk said. I showed what Ted Cruz says. A lot of the people who complain to me in
the chats say, Ben, why are you posting Donald Trump's viewpoint? Why are you posting those
clips? Why are you showing his truth social posts? Stop platforming him. Stop platforming him. And I
always say, because I think it's important that you see the alternative
viewpoint. So what I do is I say, here is what they are saying. And I just play their words.
Sure. I just play, I literally play what it is they said. And then I say, well, Ted Cruz saying
the Barbie movie is a communist Chinese plot is insane. Or Lauren Boebert saying that she is a rhino hunter,
that that is insane, that she's hunting rhinos and that they believe people like Bill Barr
is a rhino, like Bill Barr, Trump's attorney general, like what in the world are you,
like what are you even talking about? And then notice what I say. I say it is our job to usher in an era of normalcy because that's how I frame things. The bottom line is if the Democratic Party starts talking about the Barbie movies, the communist Chinese plot, and they're dino hunters or they – as I said, it's not the Democratic Party because I love the fact that like liberals.
No, it's the overall – it's not like rooting for the Dodgers versus the Yankees or whatever.
It's what the views are that are being espoused and that's the most important part to me. And then it goes on to say, during the June 16, 2023 episode, the host discussed the aftermath
of Donald Trump's arrest and arraignment that week in a federal courthouse in Miami, quote,
but Donald Trump right now is charged with serious federal crimes. True. The co-host said,
and Donald Trump is going to be charged with even more serious federal crimes.
And then Donald Trump is going to be charged with serious state crimes,
and he can't gaslight his way out of that. The public relations strategy ultimately is not going to work. He's just going to be like a madman ranting and raving. He's going to be like at
the end of one of those movies when you see somebody being whisked away into an insane asylum.
The episode did not provide any... That's a good quote.
I think that was me. I'm a little upset they didn't...
The episode did not provide any alternative viewpoints. We provided Donald Trump's viewpoint.
I show you all of the posts. We show you what the lawyers are saying. And by the way,
it goes to show you we were right on June 16, 2023, because we're talking about now a
superseding indictment. What I said was going to happen based on a data-based approach
happened on July 27th. And so here she is criticizing my data-based analysis that has
proven to be correct on July 27th. Why? Because I didn't, in addition to showing you what the
lawyers in Trump were saying, I didn't platform them on the show so they could
say, Ben, you're wrong. That's not going to happen. When it is going to happen, how would that be a
helpful thing? And then when you... And I'd ask her if she's watching this, and I'm sure she's
seen the comment section now. And a lot of people are saying, hey, Ben, tell her I'm a Republican. Tell her I'm an
independent. Tell her I'm a conservative. And I support the Midas Touch Network because you guys
tell the truth and you show the evidence and you show the data right there. And so to me,
her saying these things and using these as examples within which no matter what I say to
her, she'll probably come back. You could
tell how these questions are being asked. And then Brett, to your point, then whether it's
advertisers or whether it's an aggregator, they then go, oh, I guess Midas touches Butte as
very progressive, very liberal by this rating agency. And it's just a bunch of crap. It's just
a bunch of crap. Because's just a bunch of crap.
Because sure, are some of my views progressive and liberal? Yeah, if you go through my views,
they are. But also, you've got MAGA Republicans, they claim to be small government, but they want
to be in the bedroom, like when people are having sex and telling you who you can have sex with and
who you can't, and controlling women's bodies. They want government to teach you religion in schools and to tell you when you need to... They're doing
everything that small government's actually not supposed to be. So it's not a liberal or
progressive bias that I went through a court opinion and then I said, here is what I think
is going to happen. And Valerie, if you're watching this,
that's the problem with what you're doing. You're the one creating the labels. I'm not creating the
labels. I'm just trying to go through a paradigm of pro-democracy. And here's what she says,
number three, if podcasts have a point of view, we typically look for that point of view to be
discussed either in the podcast description or
in the beginning of the episode. However, I didn't see a disclosure of the show's progressive stance
anywhere. If I missed such a disclosure, can you point me to it? If not, why does the podcast not
disclose its stance? Well, from the outset, we say we are a pro-democracy podcast. We're unapologetically
pro-democracy. That's what we put everywhere. We own the trademark. Unapologetically pro-democracy.
That's what we say over and over again. And she's saying what? I have to say that
Marjorie Taylor Greene's conservative? She ain't. I have to say James Comer and Jim
Jordan, who are creating alliances with unregistered foreign agents in China, I got to go
say that's conservative. That ain't. I got to go and say that MAGA Republicans singing songs on
congressional delegations with January 6th insurrectionists
and posting it on Apple Music, that that's conservative? That ain't. I got to say,
spreading COVID conspiracy theories, that that is conservative? That ain't. Supporting election
denialism? That ain't conservative. I'm sorry. Just because that
party was taken over by MAGA Republicans, that don't make that conduct conservative one bit.
That makes that conduct criminal. That makes it fascist. And that is what is going on right there.
And you know what? I get heated up because the amount of effort spent going
through line by line by line and making these points very clear you know is is
something that this community prides itself on and and and it's just so
ridiculous when you show the video of what they're saying and then you comment
on it you're like well why didn't you show the opinion? It's like, I did. There's the opinion right there. And I think that's a broader thing
that we talk about all the time on this show. We talk about it all the time that the media,
and I suppose these rating agencies, are not meant for the moment. And perhaps they'll only be satisfied when
you finally have somebody like a Trump just destroy the democracy.
Is that when you'll go, oh, we should have spoken up. We should have spoken up.
And what makes this community so special, what makes this community so great is that the message
that's being spread is actually not. It's got to be
the Democrats. It's pro-democracy, which is represented by the Democratic Party right now.
And that's the views and values and point of view that needs to be shared over and over and over
again, Brett. I mean, I've had people who come over to me. Well, first, let me just go back to Valor for a second. It seems like she is probably new to this as well. So I want to give
her a little bit of the benefit of the doubt there. I think she's thinking in a very antiquated
framing of things. But I think we made a compelling case here as to why that sort of thinking is so toxic and why it does feed into
all of the reasons why the media is incredibly broken right now. And it's important that we
don't go, oh, well, this person said this thing, which is true, but this person said this thing
that is just totally lies and gaslighting, but you know what?
Let's balance those two as if they are the same and say, you know what?
You have your opinion, they have their opinion, let's call it a day.
We just can't do that and it's more important than ever.
And when I go around, when people come over to me and say, oh, Midas Touch, Midas Touch,
that's usually it.
Here's the two things I get.
I get Midas Touch, Midas Touch, Here's the two things I get. I get Midas Touch,
Midas Touch, or I get Jordy. Those are the two things I get when I'm out.
I get Popok.
You get Popok. And often people tell me a little bit about their backgrounds and I always find it
interesting. I always ask, oh, where do you watch us on YouTube? Do you follow us on Instagram,
on Twitter? And the backgrounds of the
people who listen to this show and follow us are always so incredibly diverse. And I wear that here
with the badge of honor, that somebody could come up to me and I've had people say, hey, listen,
I voted for Trump in 2016. And I watched your videos and they kind of helped me get knocked
out a little bit. And then finally, when I was fully out, I become like a huge Midas fan.
I've had people, you know, who are as progressive as progressive gets come over to me.
I've had people who've been lifelong Democrats.
It really spans the political range because I think at the end of the day, what we all
want here, what all you want, um, who are watching, are for our politics not to be an absolute
shit show, right?
We want competent people trying their best, trying to do the best things for the American
people to help them out, to help move the country forward, to make sure that the most
vulnerable among us do not fall through the cracks.
And that's my North Star for everything we do here.
That's my opinion of how things should be.
And I'm super thankful for this community who gets it,
the community who truly understands what it all means,
who understands that we're at a moment right now
that truly transcends political parties.
This is about our democracy.
This is about the United States of America.
And it is so much bigger than any one of us.
