Just when I thought that Donald Trump filed the most frivolous court filing I had ever seen in my legal career. I should not be surprised that there's even a more frivolous filing. Remember the case where Donald Trump and Alina Haba were sanctioned almost $1 million by a federal judge in the Southern District of Florida for this absurdly frivolous lawsuit that Trump filed against Hillary Clinton and like 29 other individuals and the federal judge, Judge Donald Middlebrooks in his scathing sanctions order, like the most scathing sanctions order I've read basically said that Alina Haba should be disciplined by state bar authorities as well.
Starting point is 00:01:46 Remember that case where the judge said this doesn't even look like a complaint. It looks like almost the rantings and ravings of a mad person kind of cut and paste into this thing. Remember that case? Well, Donald Trump just filed a new motion in that case. And in the new motion, Donald Trump is asking the judge to reconsider additional information because the Durham report has been published and that the judge should reopen the case that the judge sanctioned Donald Trump and Alina Haba nearly $1 million for. So I thought to myself, who's filing this thing? Which lawyer is going to file this thing and destroy their entire career? And it is a second
Starting point is 00:02:34 year associate that filed this absurd legal document. It is an individual by the name of Jared Roberts at the Banal Law Group, who just graduated law school. And in this frivolous motion that he filed to reopen the case, a case that Donald Trump was sanctioned almost a million dollars for with Alina Haba, this is the most insane legal document I have ever seen. This second-year associate sacrificing his entire legal career. This is what I've referred to before with Donald Trump's lawyers as kamikaze lawyering. It is self-destructive, this ridiculous thing. Let me just read for you the previous order first by Judge Middlebrooks when he dismissed the case that was originally filed by Alina Abba and Donald Trump and then awarded nearly a million dollars in sanctions. Several months ago, this is what
Starting point is 00:03:40 Judge Middlebrooks wrote. Order on sanctions. This case should never have been brought. Its inadequacy as a legal claim was evident from the start. No reasonable lawyer would have filed it. Intended for a political purpose, none of the counts of the amended complaint stated a cognizable legal claim. 31 individuals and entities were needlessly harmed in order to dishonestly advance a political narrative. A continuing pattern of misuse of the courts by Mr. Trump and his lawyers undermines the rule of law, portrays judges as partisans, and diverts resources from those who have suffered actual legal harm. Here's another part of the order by Judge Middlebrooks. So who is responsible for this
Starting point is 00:04:33 case and others like it? The rule of law is undermined by the toxic combination of political fundraising with legal fees paid by political action committees, reckless and factually untrue statements by lawyers at rallies and in the media, and efforts to advance a political narrative through lawsuits without factual basis or any cognizable legal theory. Lawyers are enabling this behavior, and I am pessimistic that Rule 11 sanctions alone can effectively stem the abuse. Aspects may be beyond the purview of the judiciary, requiring the attention of the bar and disciplinary authorities. Additional sanctions may be appropriate, but legal filings like those at issue here should be sanctioned under Rule 11 sanctions,
Starting point is 00:05:26 both to penalize this conduct and deter similar conduct by these lawyers and others. To deter similar conduct by these lawyers and others. So this second year associate by the name of Jared Roberts, who just graduated law school, who has now filed this document, this new motion in this same case. He just filed it on behalf of Trump and Alina Haba was apparently undeterred and is now going to have completely destroyed his reputation. That's probably the best result for this kid is that his reputation will be destroyed. What Judge Middlebrooks is going to do with him, whether it's a referral to disciplinary authorities, whether it's additional rule 11 sanctions against this guy. I mean, this is despicable.
Starting point is 00:06:19 This is despicable, despicable stuff by Jared Roberts. Amateurish and utterly pathetic. Let me show you what he wrote. Plaintiff and plaintiff's attorney's motion for indicative ruling based on new evidence. They want to revive the case that the judge dismissed based on the Durham report. This is what it says. The recent release of the Durham report seismically alters the legal landscape of this case. While this court previously held that Trump and his counsel made frivolous factual and legal allegations, the Durham report corroborates many facts and allegations about which this court expressed skepticism. Footnote one.
Starting point is 00:07:06 Oh, there's a footnote. What is the second year associate going to put in footnote number one? Footnote one. The orders entered by this court imposing sanctions against, they have to call him President Trump. It's so pathetic when they represent him, they have to call him President, against Trump and his counsel raise reasonable questions as to the appearance of impartiality of the court and therefore a motion to disqualify his forthcoming. Are you kidding me? You've got a second year associate, someone who just graduated from law school, calling out the renowned federal judge Don Middlebrooks and saying that Judge Middlebrooks' sanction order, his well-reasoned sanction order, calls into question his ability to be impartial.

Starting point is 00:09:54 Oh, wait. Yes, second year associate, did you know that Alina Haba already tried to disqualify Judge Middlebrooks in this exact same case and well before any of us really from legal observers were paying attention to Judge Eileen Cannon. Alina Habba was trying to get this case before Judge Eileen Cannon by trying to disqualify Middlebrooks like a year ago or perhaps even longer ago in this case, and Judge Middlebrooks saw right through it then. And in a scathing order back then, Judge Middlebrooks denied the disqualification and then said, I think that you're trying to forum shop this case to somebody who Donald Trump appointed. That was prescient.
Starting point is 00:10:35 That was before the motion to dismiss was granted, before we even knew anything about Judge Eileen Cannon on the DOJ cases, Judge Middlebrooks had made that order. So you wanna file the second disqualification motion. Judge Middlebrooks had made that order. So you want to file the second disqualification motion against Judge Middlebrooks? Are you trying to top how frivolous whatever this filing that you have here is? By now, you're going to file a motion to disqualify Judge Middlebrooks? Oh, I would love to be a fly on the wall. I hope Judge Middlebrooks holds a hearing and brings in this guy, this lawyer,
Starting point is 00:11:05 the second here associate, and makes him do an oral argument. That would be fantastic right there. Here is, let me read you the rest. It goes, in fact, the Durham report bolsters several allegations that this court seemed to dismiss as unsupported, not giving them the assumption of the truth that they deserved at the motion to dismiss stage. Notably, the Durham report outlines the role that each RICO defendant played to harm President Trump and directly contradicts factual claims previously made by certain defendants before the court. Look, what are you talking about? What are you talking? The Durham report doesn't even provide any recommendations at all. Okay.
Starting point is 00:11:49 John Durham tried two cases that went to trial and the people were found not guilty. Not guilty. He was 0 for 2. His report doesn't even include recommendations. His report, if you look at it, basically says, oh, the FBI should have opened up a limited investigation before opening up the general investigation. That's the only thing that he says. And he makes no recommendations about anything that should even be changed. Durham had the ability, if Durham saw RICO crimes, Durham could have prosecuted it. He didn't because he didn't find any crimes. One of the only things we know about the Durham investigation is that he told Bill Barr that
Starting point is 00:12:31 the only credible criminal allegation that he had really heard was that Trump was engaged in financial crimes in Europe, and he was told this by credible sources from Italy. And then Bill Barr in Durham deep-sixed it and buried it. That's what we know about the Durham report. Remember the Durham hearing here? Let me show you. This is Democratic Congress member Jerry Nadler when he questioned John Durham and pointed out, you lost. You lost your cases. Play the clip. It's not correct. No, I mean, there were multiple parts of that. Did it take four years to complete? Correct. Okay. And with all these resources and all these people you were sent to help you investigate the investigators,
Starting point is 00:13:11 you only filed three criminal cases. You only brought two cases to trial, correct? Correct. And you lost all the cases you brought to trial, correct? Correct. In fact, two juries acquitted your defendants on all charges. And the one conviction that you obtained, the defendant pleaded guilty to a single count and never went to trial, correct? Correct. I will note that in that case, the primary investigative steps were all completed by Inspector General Horowitz.
Starting point is 00:13:35 Perhaps you were better when it came to your report. From my reading, your report did not make any specific concrete recommendations to improve DOJ or FBI policies or procedures. In fact, your report repeatedly references the recommendations made by Inspector General Horowitz, almost all of which DOJ and FBI have already implemented. Again, your investigation lasted four years, four years and untold sums of money, and you still obtained only one conviction. You did produce a 300 page report, though, and that's given my Republican counterparts plenty of material to spin. So again, just an utterly absurd document asking to reopen the case, to reopen this frivolous case that Donald Trump filed, where the court said, you blew all of the statute of limitations. You're not even asserting claims and valid causes of action.
Starting point is 00:14:26 You are wrong on the law. You're barred by the fact. Everything is wrong about this. Every single fact is false, is what Judge Middlebrook's ruled. But the second-year associate thinks he knows better, and he's going to try to reopen the case. But by the way, now, guess what has to happen? Clinton and all of those with 29, 30 other defendants, they all have to respond. That's going to incur attorney's fees and they better file, I'm hoping, and I think they will, seek additional Rule 11 sanctions now against Trump for this conduct, for filing this frivolous motion. A completely and utter frivolous document saying, if I go through all 20 pages, it's going to make all of us collectively
Starting point is 00:15:14 less intelligent because it is the most pathetic document. Suffice to say, it argues that the Durham report should allow them to reopen their racketeering case against Hillary Clinton and 30 other individuals. That was all based on false. Like every fact in the complaint was false. They'd be like, this guy runs the DNC. It's like the person doesn't even work at the DNC. This guy lives in Virginia.
Starting point is 00:15:36 He like lives in New York. Like just the wrong name, like every, the most basic things were wrong. But welcome, welcome to the show, Jared Roberts.
