Donald Trump's lawyers just gave a very strange response in a stipulation that they, along
with Special Counsel Jack Smith's office, filed in the new case brought against
Donald Trump by special counsel Jack Smith for Trump's crimes relating to the 2020 election,
as well as Trump's crimes relating to the January 6th insurrection. We previously reported that
the federal judge presiding over the case in Washington, D.C., Judge Tanya S.
Chutkin, issued a minute order on August 7th stating the following, minute order as to
Donald J. Trump. Upon consideration of the government's motion for protective order
and defendant's response, as well as the government's reply, the court will schedule a hearing on the party's respective proposals. The court will waive the requirement of defendant's
appearance, meaning Trump does not have to appear accordingly. It is hereby ordered that no later
than 3 p.m. on August 8th, 2023, the parties shall meet and confer and file a joint notice of two dates and times
on or before August 11th, 2023, when both parties are available for a hearing.

A pretty direct order, but do you think that Donald Trump and his lawyers are capable of
complying with pretty direct
orders?
Absolutely not.
Here is the joint notice in response to the court's August 7th, 2023 minute order.
Not even necessarily a stipulation because Trump's lawyers don't stipulate to anything
or follow court orders.
Here's what it says.
By minute order on August 7th, 2023, which I just read for you, the court directed the
parties to meet and confer and inform the court by joint notice, quote, of two dates
and times on or before August 11th, 2023, when both parties are available for a hearing.
The parties have conferred and hereby
provide notice. The government is available at any time on August 9th, 10th, or 11th.
So special counsel Jack Smith saying, my team is ready to go whenever Wednesday, Thursday, Friday, judge, we are ready to go.
And now Trump's response, the defense represents the following.
First, it starts off by saying, President Trump will not appear.
Okay, well, why are you even saying that? If you go to the minute order, it clearly and specifically says,
the court will waive the requirement of
defendants appearance. So just shows you the level of immaturity of these lawyers. So it says
president Trump will not appear. However, he would like to have both his counsel, John Loro
and Todd Blanche at the hearing. Todd Blanche is not available on Thursday since he must appear
for a court proceeding in the prosecution brought against the same defendant, they call him
President Trump, he's not the president, by the special counsel in the Southern District of
Florida. Mr. Loro is available on Thursday with a preference for an afternoon setting. However, since we lost
Friday as an option, we would respectfully request a setting on Monday after 12 p.m. or Tuesday
all day to allow for both Mr. Blanche and Mr. Loro to be present because Donald Trump would like both lawyers
to be present. It was a very simple request and order by Judge Chutkin, provide me with dates and
times that you're available on or before August 11th. And the response by Trump's lawyer is Trump
will not appear, which Judge Chutkin already said he doesn't need to appear, and the response by Trump's lawyer is Trump will not appear, which Judge Shutkin already said
he doesn't need to appear, and leave it to Trump's lawyers to propose next Monday and next Tuesday,
completely in contravention of this court order. And so this is signed by special counsel Jack
Smith and John Loro, one of Donald Trump's lawyers. I assume very soon we will get an order
by Judge Chutkin and we will bring you that order as soon as we hear it.

But of course, this all relates to last Friday,
where special counsel Jack Smith brought a motion for a
protective order within an hour or so of Donald Trump posting a threatening message on his
social media platform saying, if you come after me, I come after you.
And thereafter, Jack Smith filed the protective order.
Donald Trump's spokesperson said, oh, we weren't talking about prosecutors or the court or these
proceedings.
Donald Trump was talking about the RINOs, you know, like the Koch brothers, these other
Republican groups.
That's who Donald Trump was talking about because it's gaslighting 101.
Then Donald Trump's lawyers sought to delay and ask for a full briefing schedule when Judge Chutkin said,
No, I want to hear y'all positions by Monday. Give me the positions about what you think, Trump lawyers, about the protective order.
Seems like a pretty standard protective order. So then on Monday, Donald Trump's lawyers filed their proposed
protective order, which under their version, basically they wanted to reveal the identities
of witnesses to the public, and they wanted to shift the burden of grand jury secrecy
so that special counsel Jack Smith would have to justify grand jury secrecy as opposed to the presumption that witness interviews and things that take place in the grand jury are almost always in criminal proceedings subject to protective orders, keeping it confidential from the public but not the parties. And then special counsel Jack Smith's team filed a scathing
reply in support of their motion for protective order, calling out Donald Trump and his lawyers
tactics where they've just been going on a media tour. And the type of pre-trial publicity
that Trump's lawyers are engaged in, especially with all of the lies that
they are spreading, is actually from an ethical perspective in criminal proceedings, very
problematic. And actually, there are rules both at the state bar, local state level, and within the
case law and federal cases. And special counsel Jack Smith's calling them out saying, local, state level, and within the case law in federal cases.
And special counsel Jack Smith's calling him out saying, well, the case law and all of
the kind of ethical rules, exactly what Trump's lawyers are trying to do is something that
you're not supposed to do in criminal cases.
What's supposed to happen in criminal cases is that Trump gets the right to a fair trial, that Trump will be given the evidence
on a swift and expedited basis, that he will get all of these interviews and everything that
special counsel Jack Smith intends to rely on in the case being brought by special counsel Jack
Smith. But there isn't this idea in criminal cases that they're supposed to be tried in the
media with lies. So you go through this motion filed by special counsel Jack Smith in support
of their motion for a protective order, and they detail all of the appearances of Trump's lawyers
over the weekend where they say these lies and they talk about the case.
And it's the lawyers basically saying, look, the media should be outraged
that the government wants a protective order.
Also, special counsel Jack Smith put a footnote
in reminding the court of Donald Trump's threats
to witnesses like former Vice President Pence.
And so that's in there as well. And so here's
where we are right now. A hearing date will be set by Judge Chutkin. We should expect that to
take place in a swift and expedited manner. But it just goes to show you such a bizarre
stipulation that's filed.
Even the most basic things, Donald Trump's lawyers are going to engage in this kind of
gaslighting and problematic conduct.
But special counsel Jack Smith is ready for it.
