Leticia, James, they've all seen it. Well, we'll be appealing, but more important than that, this is Russia, this is China, this is the same game. All comes out of the DOJ, it all comes out of Biden. It's a witch hunt against his political opponent, the likes of

which our country has never seen before. You see it in third world countries, banana republics, but you don't see it here. That is Donald Trump whining after he was hit with a $364 million verdict in the New York Attorney General's civil fraud case. And in addition to that $364 million number, there's also prejudgment interest. So that number actually could top about $400 million. And what I want to do though right now is let me show you a little more clips of Donald Trump whining. I'm not going to show that many of them, but let's take a look at Donald Trump whining a bit more and just saying absurd and ridiculous things. But what I really want to do is then

compare it with the evidence for you. Why did New York Justice Arthur Ngaran rule the way he did? What did the evidence show that Donald Trump and the Trump Organization was doing in connection with the various allegations against it and the fraud lawsuit, and even what was the Trump organization doing in the past 14 months, as determined by an independent monitor. Another judge, this a retired federal judge, the well-respected, very well-respected retired federal judge, Barbara Jones. So let me just play for you another clip right here. The other one,

Donald Trump says, this is like Russia, this is like China. By the way, Donald Trump recently said, didn't he, that he would want Russia to do whatever the hell they wanted to do with our NATO allies. And isn't Donald Trump's buddy Tucker Carlson out there bragging about supermarkets and stuff in Russia? Anyway, here is Donald Trump again saying that he's going to appeal. And if he doesn't win on the appeal, people are going to leave the state of New York. New York will be done, he says. Here, play this clip. And they want me out. Oh, let's see if we can get them out.

These are radical left Democrats. They're lunatics. And it's election interfering. So I just want to thank you for being here. We'll appeal. We'll be successful. I think because frankly, if we're not successful, New York state is gone. People are moving out of New York state.

And because of this, they're going to move out at a much faster rate. No, we just want you out. No one cares about you, Donald Trump. Just you have engaged in so much persistent fraud. Everybody in New York and in Atlantic City and New Jersey know the types of devastation and damage your grift has caused. Here again, Donald Trump talking about this is like Biden heading up. It's like Russia and China all being controlled by Biden. Play this clip. It's a state that's going bust. It's a state that's going bust because everybody's leaving.

And it's all headed up by Biden, who's destroying our country. So this is Russia. This is China. This is what you've been reading about all your lives. And it's happening right here in our country. Here, Donald Trump brags about paying taxes. He paid the best taxes with the accorded hands. No one's paid taxes like he's paid taxes.

He goes, play this clip. I think very importantly, and I think ultimately the most important, we've employed tens of thousands of people in New York and we pay taxes like few other people have ever paid in New York and we paid taxes like few other people have ever paid in New York. And they- Here Donald Trump says the reason that he got fined $355 million because they did the perfect job that they, that the Trump organization behaved perfectly. Here, play this clip.

But we're not going to stand for it. So thank you very much. We will get back to work. It's a ridiculous award. This is a fine of $355 million for doing a perfect job. And here Donald Trump says how the banks, they love Trump, he says. The banks love him. Here, play this clip. So I just wanna say this, you build a great company, there was no fraud. The banks all got their money, 100%. They love Trump.

They testified that Trump is great, great customer, one of our best customers. They testified beautifully. And the judge knows that. He's just a corrupt person. All right, so that's what Donald Trump said after the $364 million verdict hit. Let's take a look at the evidence, shall we? Why don't we start with depositions? Then I'll move on to kind of testimony and the independent monitor report. So let's take a look at the leaders of the Trump organization. Take a look at what the leaders say.

First, here's what Donald Trump said in terms of who was responsible for preparing compliant statement of financial conditions and other financial documents. He said Weisselberg was. Here, play this clip. To meet your obligation here of presenting the information in accordance with GAAP. Was Allen Weisselberg responsible for that? Object to the form. I would say yes. All right, that's what Trump said.

Okay. Well, what did Trump's now former CFO, Allen Weisselberg, have to say at his deposition? Here, play the clip. If I said the phrase GAAP, G-A-A-P, are you familiar with that acronym? I've heard of that, yes. Okay. Tell me everything you know about GAP. What is GAP? Generally accepted accounting principles. I don't know what's in GAP. I never took the CPA exam.

Okay. I never studied for it. So I don't know all the various components of what GAP is. Are there any components you know about what GAAP is? Not really. Okay. No. So Alan Weisselberg there talking about how he's not a CPA. He doesn't know what generally accepting accounting principles are. Just think about it. The CFO of the organization doesn't

know what generally accepted accounting principles are and is not a CPA and supposed to be running this sprawling business. All right, well, what about Eric Trump? Eric Trump was a co-trustee, a leader in the Trump organization. Does Eric, do you know anything about any of this? Let's see what Eric has to say. Play the clip. I don't remember a video conference in 2021 talking about the statement of financial condition. Did I? I mean, maybe you

could show me something, but I, you know, again, I don't think I ever signed a statement of financial condition. I don't, you know, I've done a lot to try and jog my memory and I simply can't because I don't think I've ever had any involvement in the statement of financial condition, to the best of my knowledge. Okay, so Eric doesn't know anything. Okay, well, what does Don Jr. have to say about anything? Don Jr., what do you have to say? Do you have any familiarity with an acronym, GAP, G-A-A-P? Generally Accepted Accounting Principles, yes.

Okay, how did you become familiar with that acronym? Probably an Accounting 101 at Wharton. Okay, what do they teach you about Generally Accepted Accounting Principles in Wharton? Well, I'm not an accountant, but that they are generally accepted. Anything else? That's pretty much what I remember from accounting 101. Have you told me everything you know about tap? Basically. I'm sure I could come up with some creative stuff to kill time, but I'd be doing neither of us a favor in terms of educating ourselves. Ivanka, do you know anything about this? Play the clip. The financial statement with your father before it was sent. I don't believe so. I'm not sure what it means by recent financial statement.

So I don't, I don't. You wrote it, ma'am. What did you mean? Like I said, I don't remember. I don't remember the email I could have meant. I don't know. It could have been on the property. It could have been on any number of things. So I just don't know. Not what your email says. My father will send you his most recent financial statement. The prior sentence, you mentioned that you were including marketing materials on the property as well as our projections.

And in our, you're referring to the Trump Organization, right? Or his and ours, yes. I mean, I use them a little interchangeably, but yeah, I don't know. I think the last sentence is clear. My father will also, this is your statement, my father will also send you his most recent financial statement. Okay. Do you understand that to mean that it was your father's financial statement?

I mean, it says what it says, but I just don't have any recollection of this. I don't know what I meant by it, or I don't recall having sent it. So I don't know. By the way, talking about the testimony in the case itself, one of the things that Justice Arthur Ngoron talked about was how, this is what he said about Ivanka, she consistently denied recalling the

contents of documentary evidence that confirmed that she actively participated in events even after she was confronted with evidence. The court found her inconsistent recall depending on whether she was questioned by the Office of Attorney General or the defense suspect. In any event, what Ms. Trump cannot recall is memorialized and contemporaneous emails and documents, in the absence of her memory, the documents speak for themselves. So what are we doing here in the Midas Touch Network? We're showing you what they're saying in the deposition.

You see, for example, what Ivanka, you saw her actual testimony, and now you're seeing how the judge is characterizing her testimony, right? Consistent with what you see there. You also saw Don Jr. and Eric. ongoing conduct by the Trump Organization, as determined not just by Justice Arthur Ngoran, but by the independent financial monitor, the very well-respected retired federal judge, Barbara Jones, who used to be a judge in the Southern District of New York.

Here is what Justice Ngoran talks about, why the Trump Organization needs ongoing oversight. Get this. In a decision and order dated November 14, 2022, this court granted a motion by plaintiff for a preliminary injunction and, among other things, as an independent monitor tasked with overseeing the Trump Organization's financial disclosures to any third parties and any transfer or other dissipation of assets. This is from Justice Arthur and Goran's verdict on Friday. The court also directed Judge Jones to provide regular updates to the court, summarizing her findings and observations to date. She has provided six reports, the last of which was dated January 26, 2024, after the conclusion of the trial.

In her final report, Judge Jones made the following findings and observations. to no longer submit statement of financial conditions, instead crafting their own list of, quote, the trust's material assets and material liabilities, which does not include estimated current values of the properties contained therein, and does not include a balance sheet of the guarantor or any representations regarding his financial condition, notwithstanding the loan covenants that still require it. During the course of her monitorship, defendants transferred significant funds outside of the trust without notifying the monitor, as they were obligated to do.

Three, during the course of her monitorship, defendants have submitted disclosures to third parties that fail to include significant liabilities. Four, the defendants are no longer representing that any disclosures are GAAP compliant, that they don't comply with generally accepted accounting principles, despite certain continuing obligations to do so. Five, annual budgets of actual budgets of the prior year in which excluded or significantly reduced

actual management fees as liability. Six, the internal accounting structure of the Trump organizations continues to be plagued by math and or reporting errors. And seven, there are no adequate internal controls over the financial reporting in place at the Trump organization to ensure that there will not continue to be misstatements and errors going forward. Further, the court notes that the top leadership roles at the Trump Organization, particularly the CFO and Comptroller, remain vacant.

Approximately five months after Weisselberg pleaded guilty to having committed 15 counts of tax fraud at the Trump Organization, Eric Trump negotiated, approved, and executed a separation agreement. The role of CFO has remained vacant ever since, a fact that Donald Trump Jr. did not know at trial, mistakenly believing that Mark Hawthorne was the new CFO. Similarly, the role of controller has remained vacant since McCani left the Trump Organization in February 2023. Thus, the Trump Organization does not have the ability to operate with functional financial reporting structures that would protect against fraud in the future. The fact that there are

virtually no internal controls in place at the Trump Organization creates an atmosphere conducive to fraud. And what Justice Arthur N. Gorin points out here in footnote 56 is, look, the court did not appoint Judge Jones randomly or arbitrarily or by happenstance. Rather, she was the only one of the three candidates that both sides proposed for the position of independent monitor, meaning,

Trump, you chose her also. However, after she issued a scathing January 26, 2024 report, quite critical of defendants' financial practices, defendants changed their tune. Overnight, a universally respected former judge with a stellar resume, nominated by defendants themselves, joined the ranks of all of those people and institutions, being unfair to defendants and out to get them. In other words, now you're attacking retired federal judge Barbara Jones. So no, Donald Trump, this isn't Russia or China or anything like that. The only person trying to create that system here is you. This is evidence

based and you don't like the evidence. So you attack the judge and you attack the system. By the way, that's why it's so important. I wanted to share with you from the order and not just give you my opinions. I mean, let's show you what Trump says, show you what Weisselberg says, show you what Ivanka says, show you what the order says, and you make the decision, make an informed one. I'm Ben Mycelis.
