I'm Ben Mycelis from the Midas Touch Network. Special Counsel Jack Smith is not done with his criminal investigation work yet before the Washington, D.C. grand jury in connection with Donald Trump's crimes relating to the 2020 election. We know there are at least six unindicted co-conspirators in the indictment that was brought against Donald Trump for trying to overthrow our democracy and to overthrow our free and fair election. But that grand jury is still impaneled through September 15th. And from all of the latest reporting, we know that special counsel Jack Smith is still calling
Starting point is 00:02:10 witnesses. He is still engaged in a criminal investigation. And specifically, the focus of Jack Smith's ongoing investigation is on the money. Follow the money. Follow the money. The fundraising by Donald Trump's political action organizations, the fundraising by Donald Trump's unindicted co-conspirators like Sidney Powell, they're raising money by making false allegations of election fraud, knowingly, intentionally, maliciously, and then taking that money and diverting it to places that it's not supposed to go to, well, if you can establish that that's
Starting point is 00:02:52 what took place, that's what's called wire fraud. That can be considered money laundering as well. And then if you look, where is that money utilized? Was that money, for example, going to fund people who then broke into election offices, whether it was in Antrim, Michigan, whether it was Coffey County in Georgia, whether it was in Pennsylvania? Let's not forget there were multiple breaches of election offices where election data was stolen, affirmatively stolen if you were living in those counties, in those areas. And so the way they did this is where people who were part of the MAGA conspiracy, for example, like in Coffey County, somebody by the name of Kathy Latham, who used to be the GOP chair of the Republican Party in Coffey County, somebody by the name of Kathy Latham, who used to be the GOP chair of the Republican Party in Coffey County.
Starting point is 00:03:48 She used her connections to walk into the election office. Once inside the election office, gave over election data to Trump's team so that they could then manipulate that data to try to further their fraud, to try to further the phony accusations and allegations they were making and manipulate that data. That happened in numerous locations, including Pennsylvania, as I mentioned, Coffey County, Georgia, as I mentioned in Michigan. And we know the attorney general in Michigan, Dana Nessel, has indicted many people, not just the fake electors, but people who were involved there in stealing election data as well in the state of Michigan. Great work there by Dana Nessel.
Starting point is 00:04:32 And so here's a report by CNN, which is, by the way, I mean, if you go back to some of the reporting we've done here, I think we've talked about this as well, but CNN has an exclusive that further confirms this. And it says, special counsel election probe continues with focus on fundraising and the voting equipment breaches. It goes on to say how recent witnesses who are still going before the grand jury in Washington, D.C. are focusing on the money that was raised off of the baseless claims of voter fraud, and then how that money was used and funneled, laundered, in order to have people breach election offices. Now, there is no dispute that people breached election offices. Let's just
Starting point is 00:05:21 pause there. Every time one of the MAGA Republicans go, oh, this is our First Amendment right. Really? You think you had a First Amendment right? One, to overthrow our democracy. Two, to engage in insurrection. But three, to go in and steal election data. Don't let them gaslight you with that argument. There's video footage of them going into these election offices. This isn't like a hypothetical scenario. But the question is, was the money fundraised off of the false accusations used for that purpose? That's something that Special Counsel Jackson has focused on. By the way, even if the money was used for other improper purposes, that could be criminal conduct too. But we know this is an area of inquiry based on what witnesses are telling CNN who have gone before the grand jury in Washington, D.C. recently. For example, one of the focuses is on the invoices and CNN
Starting point is 00:06:17 obtained invoices by Sidney Powell's nonprofit, it's laughable that it's even called that, defending the republic for the forensic firms that ultimately accessed, breached voting equipment in four swing states, won by President Biden, Georgia, Pennsylvania, Michigan, and Arizona. One of the most interesting things is in Georgia, where Sidney Powell is a criminal defendant, her, I kid you not, her defense, how she's arguing that
Starting point is 00:09:01 her case should be severed and tried separately from all of the other criminal defendants. She claims she was never representing Trump, never even representing Trump, never representing the campaign. Think about it. She was on stage with Giuliani and Jenna Ellis and Trump's other lawyers. She went to all of these events. She went and did all the interviews.
Starting point is 00:09:21 And she just says, what, she was just doing theater? She was acting. This is literally an motion that she filed last week in Georgia. She goes, contrary to widely publicized false statements in the media, Sidney Powell did not represent Donald Trump or the Trump campaign. She had no engagement agreement with either. She appears on no pleadings for Trump or the campaign. She appeared in no courtroom or hearings for Trump or the campaign. She had no contact with most of her purported co-conspirators and rarely agreed with those she knew or spoke with.
Starting point is 00:09:57 Gotta love Sidney Powell, the wackiest of the bunch. Dangerous as heck, but the wackiest. Release the Kraken. Saying these types of things right now, are you absolutely kidding me? And it's like, okay, so if you're saying you were it in court, doesn't that make it worse because you knew your arguments would not succeed in a court of law because they were pure and utter crap? Yeah, I don't think you can go, your honor, we'd like to release the Kraken. No, it's just freaking ridiculous. Going back to the CNN exclusive, it talks about, as I mentioned,
Starting point is 00:10:34 the Coffey County breach. It talks about the breach in Antrim. And it mentions that the Washington, D.C. grand jury, the same D.C. grand jury that's already indicted Donald Trump in Washington, D.C. That's the case that's before federal judge Tanya Chutkin. It's set to expire on September 15th, but it can be extended beyond that term. So even when it hits September 15th, Jack Smith can request an extension. That'll tell us a lot. Mark your calendars for September 15th because we will do a hit on that date to see if there's an extension. I predict there will be an extension. Also of note, special counsel Jack Smith was asking these witnesses before the grand jury about Sidney Powell's and others' conspiracy theories to raise money like the Venezuelan president Hugo Chavez, who's not alive, utilized software to rig the election. I mean, again, just complete and utterly deranged conspiracy theories there.
Starting point is 00:11:47 So as we think about the moves that special counsel Jack Smith can make, here's what I think is important. So Jack Smith does not want to lose the March 4th, 2024 trial date against Donald Trump. So Jack Smith is not, in my humble opinion, going to bring a superseding indictment if it has the risk of delaying the March 4th, 2024 trial date. See, in the Southern District of Florida, in the case involving Donald Trump's theft of all of these classified records, as well as his co-defendants. Special Counsel Jack Smith was fine there. It's in front of Judge Eileen Cannon, superseding indictment, whether that causes a delay or not. Jack Smith is fine with that. Jack Smith would be fine bringing another superseding indictment
Starting point is 00:12:34 in the Southern District of Florida. He'll be very careful of losing that March 4th, 2024 trial date. Now, if Jack Smith, though, wants to indict Donald Trump and any additional defendants for these fundraising crimes, the posture I think Jack Smith would bring it at is not as a superseding indictment, but simply as another indictment. Either you bring it after the first trial of Donald Trump, because it involves a different set of facts, fundraising, wire fraud. And if you can say, hey, this is not directly related to the other case, it is tangentially related, but the crimes are very different and there's a different series of co-defendants, you'd probably have to argue, you would say, no superseding indictment. You'd bring another indictment. Then Trump's lawyers would try to
Starting point is 00:13:30 respond and say, no, this should be consolidated and tried together and then cause delay. But this is exactly what Jack Smith is focused on. And Jack Smith's brilliant because he realized, if I bring financial crimes cases against Donald Trump, then you have to have forensic accountants and you have to have everyone as experts. That could take years and years and years. And Judge Tanya Chutkin would not have given that March 4th, 2024 trial date. is going to keep developing the evidence of criminality. I think keep that in his pocket. See how all the cases are shaping up. If he feels confident that it's not going to cause delay in the DC federal case that's already pending, I think he brings a new indictment. If he feels that it could in any way interfere with the trial date, I think he's going to exercise his discretion and not go there. But that's what he's weighing right now. But you have this grand jury hearing more evidence focused on the grift, the fundraising, potential wire fraud, money laundering, to the tune of tens
Starting point is 00:14:36 of millions of dollars that were being funneled to Donald Trump and others based on these fraudulent representations that there was election fraud when Donald Trump was being advised by his own consultants and his own advisors that that's false and it's not accurate and that they were spreading lies. So that's what we have there, folks. We'll keep you posted, of course, but Jack Smith continuing, continuing to develop evidence in the criminal investigation while cases are pending.
