Donald Trump, fresh off of the $1 million in sanctions order against him by Judge Middlebrooks in the Southern District of Florida,
continues to withdraw cases that were, frankly, incredibly frivolous, where Trump realizes that he was
likely going to be sanctioned. In other words, Donald Trump is backing down like the coward
that he is. And we reported last week that Donald Trump immediately dismissed a lawsuit against New
York Attorney General Letitia James that was filed first in state court in Florida,
then removed into federal court. And it went before Judge Donald Middlebrooks, the same judge
who sanctioned him $1 million. And in that $1 million sanction order, Judge Donald Middlebrooks
flagged that specific case against New York Attorney General Letitia James as being utterly frivolous. And now Donald Trump has dismissed voluntarily a second lawsuit that was filed against New
York Attorney General Letitia James.
This one was before the Second Circuit Court of Appeals.
It had already been dismissed by a New York federal judge up in Syracuse, Judge Brenda Saines, back in May of 2022.
And this was a lawsuit that Donald Trump filed against Letitia James in 2021 during her special
proceeding, which ultimately led to the filing of the fraud lawsuit. The fraud lawsuit was filed in the fall of 2022, seeking at least
$250 million against Donald Trump, the Trump Organization, and Donald Trump's adult children
and others. But while the special proceeding, which is basically an investigation under the New York Attorney General statute where New York Attorney
Generals can engage in these civil investigations of businesses engaged in systemic fraud. And
that's where Donald Trump was deposed in connection with those special proceedings.
And he invoked the Fifth Amendment over 400 times when asked very simple questions. During the special proceeding
when that was taking place in 2021, Donald Trump filed this lawsuit in federal court. He claimed
his civil rights were being violated and that he was being targeted and persecuted by New York
Attorney General Letitia James. And the federal judge up in Syracuse, where the case was filed, said, no, there's no
civil rights violations here. No, you're not being specifically persecuted. You're not being
targeted. The New York attorney general has significant information that you, Donald Trump,
and the Trump organization engaged in ongoing criminal conduct and significant criminal conduct in the past. And they had every
right to engage in this special proceeding, this investigation that was taking place. And in
addition, the federal judge Sands, she basically said, look, I don't even have jurisdiction to hear
this. You can't file a federal lawsuit and say your civil rights are being violated in connection with a New York
Attorney General's criminal investigation. So in May, by the way, that case was filed by Alina
Haba, completely frivolous lawsuit. Again, Alina Haba just files these frivolous lawsuits. She was
the one who filed the case where Donald Trump also got sanctioned $1 million before Judge Donald Middlebrooks in Florida. So in May of 2022,
the federal judge in New York dismissed this case against Letitia James, and Donald Trump then
filed with the Second Circuit Court of Appeals, which is the court of appeals that oversees
all of the federal courts in New York.
And that case was pending before the Second Circuit Court of Appeals, which had not yet
made any rulings about the frivolous lawsuit that was filed.
But look, the writing was on the wall.
Donald Trump realized that he was going to get likely sanctioned again for bringing frivolous
lawsuits.
He recognizes that the federal courts have now
caught on to him, and this is what he filed. Let's pull it on up. This is what it says.
Donald Trump and the Trump Organization versus Letitia James. Pursuant to federal rules of
appellate procedure 42B, the undersigned counsel for the party stipulate that the above-captioned
appeal is withdrawn with prejudice without costs or
attorney's fees to any party dated January 24th, 2023. It's a stipulation to dismiss. And there
you see Alina Haba's name as the lawyer representing Donald Trump dismissing it on Trump's
behalf. And then for Letitia James, you have Eric Del Pozo, who's representing the Attorney General's
office for purposes of this filing.
This looks awfully similar, right, to the other case that Donald Trump dismissed against
New York Attorney General Letitia James in Florida.
So dismiss the one in New York.
And then we talked about last week how he dismissed the lawsuit that was in Florida
before Judge Donald Middlebrooks.
That was the notice of voluntary dismissal without prejudice. Here it is right there. Plaintiff President Donald
J. Trump, by and through his undersigned counsel and pursuant to federal rule of civil procedure
41A1AI, hereby voluntarily dismisses his claims in this action against defendant Letitia James without prejudice. That one was dated January 20th,
2023. So all within about four days of each other and five days of the $1 million sanctions order,
Donald Trump backing down, withdrawing his lawsuits. The message was sent by federal judge
Donald Middlebrooks, you need to stop filing vexatious litigation
or you are going to suffer serious sanctions
in the courthouse and courthouses across the country.
And when you stand up to Donald Trump,
when you stand up to these MAGA extremists
and you don't give them an inch,
what happens is precisely this.
They back down. And when you confront them with
the law and you don't allow them to break the law consistently, this is the outcome. And in
Judge Donald Brooks' scathing order, where he ordered $1 million in sanctions last week,
he set forth the roadmap of Donald Trump's filing of vexatious litigation across the country.
And specifically, the judge called out all of these lawsuits that Donald Trump has filed
that are completely frivolous. These lawsuits, the lawsuits against the Pulitzer board,
which he brought in Okeechobee County, which as the judge said, there's no even basis to bring this in Okeechobee County.
And Donald Trump's lawsuits against Twitter and Donald Trump's lawsuits against anyone who he
perceives as a political enemy. And he says, look, this is what Judge Donald Middlebrook said, look,
Donald Trump uses this as a fundraising tool. He lies in the complaint. He uses
despicable, false language. He attacks the judge. He attacks the the complaint. He uses despicable, false language.
He attacks the judge.
He attacks the judicial process.
And that is part of a systemic pattern of abuse where Donald Trump is the mastermind
of abusing our judicial processes.
$1 million sanctions.
Then Donald Trump, the coward that he is, gets the message, dismisses one federal lawsuit,
dismisses this appeal.
We will see as those dominoes continue to fall, Donald Trump likely going to be dismissing
some of these other cases because now the Middlebrooks decision, the $1 million sanctions
decision, that's now going to be cited by all of these other courts across the country,
federal and
state courts.
Also, the people who Donald Trump sues are going to cite Judge Donald Middlebrook's
opinion.
By the way, if you get a demand letter or one of these crazy lawsuits against Donald
Trump, heck, what I would do is I would just attach Judge Donald Middlebrook's order and say, here's who this is, here's the vexatious litigant,
and this is what the repercussions are. One more point I want to make. The lawsuit that Donald
Trump filed to try to block the Department of Justice from getting its records back that was
ultimately decided by the 11th Circuit Court of Appeals and the United States Supreme Court during one of the preliminary injunctive relief orders that were given returning the
classified records back to the Department of Justice that went before Judge Eileen Cannon.
Judge Eileen, that lawsuit right there was frivolous. That lawsuit right there should
have been sanctioned. To let you know just what a horrible judge, Judge Eileen Cannon was and is, the fact that she granted Trump's relief and had to go to the 11th
Circuit, that should have received serious sanctions because all of the case law was
clearly against Donald Trump there. And in the case that Donald Trump got sanctioned $1 million
in around April or May, Trump tried to get that case sent to Judge Eileen
Cannon. They tried to disqualify Judge Donald Middlebrooks. And Judge Donald Middlebrooks,
in a footnote, this was before anyone knew who Judge Eileen Cannon was because all that happened
in August where we learned about Judge Eileen Cannon. Judge Donald Middlebrooks said, I see
what you're trying to do. You're trying to get this case before Eileen Cannon, and that's not a basis for my recusal.
Recusal denied.
So there you have it, folks.
Donald Trump, Alina Haba, more cases being dismissed voluntarily.
You stand up to the bullies.
You stand up to these traitors, and they reveal themselves as the cowards that they are.
