And Trump's lawyers media tour is not going very well and exposing just how bad Donald Trump's lawyers are, as well as how many steps ahead of the game special counsel Jack Smith is. Jack Smith, in the indictment itself, predicted the types of arguments that Donald Trump's
Starting point is 00:01:37 lawyers were going to make. I will show you specifically in the indictment where special counsel Jack Smith put that knowing what Donald Trump's lawyers were going to say. But let me show you what Donald Trump's lawyer has been saying. This is Donald Trump's lawyer, John Loro. And John Loro did the rounds on all the networks. And Loro said that what this is really about here is not a crime. There was just a spirited argument here about the results of the election. And Donald Trump was getting advice from his lawyer, a renowned constitutional lawyer. So claim it's a free speech thing.
Starting point is 00:02:17 That's kind of step one. And two, throw the lawyer, John Eastman, and other lawyers under the bus. Here is John Loro, the lawyer, who will probably find himself thrown under the bus one day. Play the clip. You may disagree with it and people have spirited arguments about the law all the time and that's why lawyers are in business. But we've never had a situation where a spirited debate about the Constitution has become a criminal case. What's going to happen when there's a Republican administration? Is there going to be an effort to criminalize speech by Democrats? Is there going to be an effort to characterize something that a Democrat politician
Starting point is 00:02:54 says that doesn't meet some kind of true standard at the Department of Justice? Okay, and here is John Loro repeating that message that this is a constitutional abyss and this is a freedom of speech issue. It isn't. And I'm going to show you specifically to where special counsel Jack Smith just knew they were going to go there. But here is John Loro again. Play this clip. I think this is an incredibly weak case. I love Jonathan Turley's line, the free speech killing indictment. I wish I thought of it. Well, the president is strong and resolute.
Starting point is 00:03:35 He has a fight in front of him. But this is the first time that in the history of the United States that the Justice Department has weaponized and politicized political speech. The president believes in his heart that he had not only responsibility, but the right as any American to contest issues in the 2020 election, to raise important facts that the public needed to know. And now that public policy, that advocacy is being prosecuted. And it's being prosecuted by his political opponent who controls the Justice Department and is using the tools, the sacred tools of the criminal justice system to censor a political opponent in the middle of an election period where President Trump, by all polls, is leading, and at the same time, President Biden is facing
Starting point is 00:04:27 an unbelievable, unprecedented scandal that goes directly to his ability to serve in office. We are on uncharted territory. We are in a constitutional abyss right now. But one thing about this indictment, we're going to take it, look at it very, very carefully, but it addresses one major issue, and that's an attack on the First Amendment that should never be allowed in this country. You know, when I see these clips of John Loro, you know, Donald Trump likes lawyers right out of, Donald Trump says this, right out of central casting. You know, Trump actually has a smart lawyer, this Christopher Kice, who's been sidelined because it doesn't look like he's in central casting. But Christopher Kice is the lawyer who actually told Donald Trump back in August or September
Starting point is 00:05:13 of 2022 to try to settle with Merrick Garland regarding the case involving Trump's willful retention of national defense information. And then Kice got sidelined basically after giving that advice. But here's Loro just saying that some of the dumbest legal things that you can say. Here's Loro basically saying that he wants to try to move the trial to West Virginia. Play the clip. Would you seek a venue change? Absolutely. That's one of the first things we're going to do. Where do you want it to go instead? Well, there's other options. I mean, there's certainly West Virginia, which is close by.
Starting point is 00:05:50 There's other areas of the country. West Virginia. Absolutely. It's very in close proximity to D.C. Which is like the political opposite of Washington, D.C. Well, here is John Loro whining that special counsel Jack Smith wants to try to take the case in 90 days. This is on the Today Show. Play the clip. So earlier this morning, we had the chance to speak to one of Mr. Trump's defense attorneys, John Lauro. We started with the timing of a trial. The special counsel said yesterday he would like to see a speedy trial. That is 70 days from now. Are you
Starting point is 00:06:21 ready to go? Would you like to see a speedy trial? Well, the speedy trial right is the defendant's right, not the government's right. So we're entitled to understand what the charges are. We're entitled to do our own investigation. The special counsel or the Justice Department, the Biden Justice Department, has had three years to investigate this. To take President Trump to trial in 90 days, of course, is absurd. The question is, why do they wanna do that? If you wanna seek justice, then you need to offer President Trump an opportunity to get a hold of all the evidence and understand what the facts are.

And here, John Loro, I guess, boasting that now because of this indictment that he has subpoena power and that they're really going to get to the bottom of what happened in the 2020 election. I mean, it's just absurd that you're going to use subpoena power to try to prove that the 2020 election was stolen. I mean, Donald Trump makes this guy go up and say the most ridiculous conspiracy theories like this is not what being a lawyer is about. This is what being, frankly, I won't even say it here, play the clip.
Starting point is 00:09:09 Thing I will say, though, in 2020, the Mr. Trump's campaign had a few weeks to gear up and present evidence and was very difficult. We now have the ability in this case to issue our own subpoenas and we will relitigate every single issue in the 2020 election in the context of this litigation. It gives President Trump an opportunity that he has never had before, which is to have subpoena power since January 6th in a way that can be exercised in federal court. What you're talking about should be noted. The federal judge now presiding over this matter is Judge Tanya S. Chutkin. She was appointed by President Barack Obama, confirmed 95 to zero in the United States
Starting point is 00:09:58 Senate. And Chutkin is the only federal judge in Washington, D.C. who has sentenced January 6th defendants to sentences longer than the government has requested. So you actually have a real law and order judge right now. Let's pull up the indictment where I told you special counsel Jack Smith kind of anticipated the arguments that were going to be made right here, paragraph three. And special counsel Jack Smith in this paragraph was like, look, Donald Trump had the right to even make false claims just publicly. He had a free speech right to make certain false claims. But when the false claims were weaponized into conduct and then a conspiracy to overthrow the results of the election, you go from an area of just being a whiny fascist loser baby. I mean, I'm paraphrasing here. It doesn't say that in the indictment, but it goes from that to criminal conduct where you take the whining.
Starting point is 00:11:08 If Donald Trump wants to go at these traveling fascist cult rallies and go, oh, this person hates me and this person hates me and this person doesn't like me and that person doesn't like me and the election is this and here's what happened in the election and oh, they're all out to get me. If he wants to go and say those things, he has a free speech right to say them. I, we have a free speech right to say that this man is an idiot, that this man is a traitor, that this man is a weirdo, fascist, malignant, narcissistic sociopath. We have a free speech right too, and he has a free speech right to do that.
Starting point is 00:11:49 But where the free speech no longer is just speech when you weaponize the conduct to have fake elector schemes, to engage in conspiracies, to change votes from Biden to Trump, to steal electoral data, to threaten local election officials, to engage in that pattern, then it becomes criminal, right? That's like saying, you know, you have free speech, right? To give, you know, certain speeches. But if you threaten someone's life, that becomes a crime, right? It's still speech, but it becomes criminal.
Starting point is 00:12:28 And here's where special counsel Jack Smith talks about it. The defendant had a right, like every American, to speak publicly about the election and even claim falsely that there had been outcome determinative fraud during the election and that he had won. So Jack Smith's saying Trump even had the right to claim he won like a loser, even though he lost. Trump had the right to do that. He was also entitled to formally challenge the results of the election through lawful and appropriate means, such as by seeking recounts or audits of the popular vote in states or filing lawsuits,
Starting point is 00:13:03 challenging ballots and procedures. Indeed, in many cases, the defendant did pursue these methods of contesting the election results. His efforts to change the outcome in any state through recounts, audits, or legal challenges were uniformly unsuccessful. Shortly after election day, the defendant also pursued unlawful means of discounting legitimate votes and subverting the election results. In so doing, the defendant perpetrated three criminal conspiracies. A conspiracy to defraud the United States by using dishonesty, fraud, and deceit to
Starting point is 00:13:41 impair, obstruct, and defeat the lawful federal government function by which the results of the presidential election are collected, counted, and certified by the federal government in violation of 18 U.S.C. Section 371, a conspiracy to corruptly obstruct and impede the January 6th congressional proceeding at which the collected results of the presidential election are counted and certified in violation of 18 U.S.C. Section 1512K, a conspiracy against the right to vote and to have one's vote counted in violation of 18 U.S.C. Section 241. So you see, special counsel Jack Smith knew where they were going. They knew that was going to be the argument that Trump's lawyers made. And Trump's lawyers just
Starting point is 00:14:22 had that script. And so when Jack Smith called them out, they just stuck to the script versus adapting to what's actually in the indictment itself and having fluidity and to change it up. Well, they can't because it really is indefensible. But special counsel Jack Smith draws the distinction. Yes, there is certain deranged, delusional, but yes, protected free speech. But here's where it got criminal, where you're trying to actually overthrow the results of the election with the lies. Brilliant.
