So we know that Donald Trump filed a notice of appeal regarding the gag order imposed on him by federal judge Tanya Chutkan in the Washington, D.C. federal case. One problem though, Donald Trump's lawyer, John Lauro, who filed the Notice of Appeal, is not a licensed lawyer to practice law before the D.C. Circuit Court of Appeal, where they filed a Notice of Appeal.

That's right, It's now been uncovered that John Loro, Donald Trump's lawyer, is not a member of the bar who's permitted to practice before the D.C. Circuit Court of Appeals. He has to submit an application. He is a licensed lawyer in other jurisdictions, but you have to be licensed as well to practice before the various courts of appeals throughout the United States of America. That's kind of like law 101 even before that. It's kind of like when you take an exam, you got to put your name on the exam. So yes, Donald Trump's lawyer not licensed to practice in the DC Circuit Court of Appeal where they're trying to appeal the gag order. How do we know this? Well, the United

States Court of Appeals, the DC Circuit, sent a letter to John Loro to Donald Trump's lawyer. It doesn't get much more humiliating than this. So here is the letter from the United States Court of Appeals that says, Dear Counsel, to John Loro, it is my understanding that you represent a party in the above caption case USA v. Donald Trump. Our records reveal that you are not a member of the bar of this court. It is the policy of the court that all attorneys appearing before it be members of the bar of this court. Our rules do not allow us to accept filings from attorneys who are not members. Also, the names of non-members may not appear on any opinion that the court issues. Generally, attorneys must be members of this court to present argument. See Washington DC Circuit Handbook of Practice

and Internal Procedures written in 2021, the updated version of 2021. may be electronically submitted with payment through the bar admission utility within the electronic filing system. Very truly yours, the clerk of the DC Circuit Court of Appeals. And it's signed by the deputy clerk as well. And then it says, the following forms and notices are available on the court's website. So you have John Loro, Donald Trump's lawyer who was trying to be a tough guy at the gag order hearing, the one who was basically yelling at Judge Chutkin and was saying, are you trying to censor me, Judge Chutkin? Are you trying to censor me? And Judge Chutkin said, John, Mr. Loro, tone it down here. I know that you probably have an

audience that you're trying to appeal to outside of me. I know you probably got an audience that's someone other than this court, i.e. Donald Trump, but this is a court of law. Calm down, tone it down. And then John Loro's like, I am calm down. I am calm down. And then Judge Chutkin in this hearing on Monday was asking him questions. So you think it's okay, Mr. Loro, that Donald Trump threatens to execute witnesses and kill witnesses? You're okay with that? And John Loro's like, well, I wouldn't advise a client to do that. You would agree that that would be a threat and that should be prohibited conduct. Or she said, so you think that Donald Trump threatening witnesses that if they testify bad things will happen to them, you're okay with that, Mr. Laro? Well, it's free speech. It's free

speech. And she ended up issuing an order and John Laro and Donald Trump, we're going to appeal. This order is unconstitutional. Let me just read for you just very briefly the order just so you see how narrowly tailored it is. To be clear, what does the lawyer not say? Well, Judge Chutkin expressly makes that very clear in the order. She goes, this order shall not be construed, shall not be construed to prohibit defendant Donald Trump from making statements criticizing the government generally, including the current administration or the Department of Justice, statements asserting that the defendant is innocent of the charges against him or that his prosecution is politically motivated, or statements criticizing

the campaign platforms or policies of defendants' current political rivals, such as former Vice President Pence and others. So Donald Trump, you are free. Criticize your political opponents. Go after them. Do all the things you want to do. What you can't do is threaten and attack the special counsel and the special counsel's team. You can't threaten and attack the judge, the court, and the court staff. And you can't threaten and attack witnesses. It's limited to that. And you're being treated no different than any other criminal defendant. And Donald Trump appealed that. Donald Trump appeals that. And then Donald Trump's lawyer, John Loro,

turns out for all of the bluster and bravado, he is not licensed to practice law in the DC Circuit Court of Appeals. He is not a member of the bar. Think about that. They had to send him the forms. If you want to apply, here's what it is. Now look, the application process is, if you're already a member of the bar in other jurisdictions,

which to be clear, he is, the application form is not all that hard to do to become a member of the DC Circuit Court of Appeals. If you are a member of the bar, but you have to submit fees, you have to submit an application, you have to be approved, you have to go through that process. But just like their client, Donald Trump, they don't follow the rules at all. And then when you just go through this order too, that Judge Chutkin issued the gag order that was imposed on Donald Trump, again, just saying you can't threaten and attack people in this case. That's the focus. to national audiences using language communicating not merely that he believes the process to be illegitimate, but also that particular individuals involved in it are liars or thugs or deserve death. And she cites the post that Donald Trump made where he threatens to execute people like General Mark Milley, where he threatens to kill people. So Donald Trump now wants to appeal this to the D.C. Circuit Court of Appeals. They filed a notice of appeal. There it is. Defendant Donald Trump hereby provides notice that he appeals to

the United States Court of Appeals for the District of Columbia Circuit Court from the opinion and order of the district court dated October 17, 2023, signed John Loro. You see John Loro's signature? Not licensed member of the bar there, as we just saw from the letter. But Donald Trump wants to appeal an order to the D.C. Circuit Court of Appeals. Here's my theory, though, of what's actually going to happen. This is going to backfire massively on him. I think Judge Chutkin, who's the judge presiding over the D.C. case being prosecuted by Special Counsel Jack Smith for Donald Trump's attempt to overthrow the 2020 election.

I mean, the reality is because she's the trial judge, she's trying to keep this thing on track. So she doesn't want to be baited by Donald Trump to do anything that's going to cause delay because trial's set for March of 2024. So I think she's kind of even bending over backwards here to not issue sanctions or things that would happen with normal, you know, or remand him into custody that would normally happen with other criminal defendants because we want to keep the trial track on schedule for law and order here. I think that's the way she's thinking about it. But I think the Court of Appeals is going to look at this record and they're going to be horrified with Donald Trump's conduct. I think he's going

to get smacked down big time. And it's already not a good way to start when your lawyer is not licensed to practice law and submits a filing when they're not a member of the bar for the DC Circuit Court of Appeals.
