What have we learned since Donald Trump was indicted, arrested, and arraigned in federal
court in Miami earlier this week? Well, for one thing, that Donald Trump lied to the people in the bakery
that he visited after his arraignment, saying that he was going to comp their food. Donald Trump,
a liar? Wow. We've learned that Donald Trump's lawyers recommended to Trump he actually tried
to settle with the Department of Justice in the fall of 2022, something Donald Trump flatly rejected and instead took the advice from someone who isn't a lawyer by the name of Tom Fitton, who can't fit in to his very tight shirts and doesn't know the law. We've learned also that corrupt federal judge Eileen Cannon, who
unfortunately got assigned this criminal case against Trump brought by special counsel Jack
Smith, is not recusing herself. So the proverbial ball is now in special counsel Jack Smith's court,
no pun intended, whether he will file a recusal affidavit under
USC section 144. And I don't even know how this is possible, but Trump has been acting even more
unhinged lately, stating that the United States agencies are running illegal psychological warfare on American citizens for seven years.
That's what Donald Trump posted. This is both involuntary psychological hold levels of insanity
by Trump, but it's also pure projection since for the last seven years, and frankly, his entire life,
Donald Trump has been psychologically tormenting
Americans and the world. Special Counsel Jack Smith, however, continues his other criminal
investigation into Trump's 2020 election interference and sedition relating to the
January 6th insurrection. At the same exact time of Trump's arraignment earlier this week, as that
was going down, corrupt Republican Nevada fake electors were seen entering the Washington DC
grand jury by NBC. And of course, that grand jury is investigating Trump's crimes for sedition and election interference. This,
as we learned that Rudy Giuliani was using the alias Helen and an email address with the name
Helen numbers at Gmail to communicate leading up to the insurrection with people like Mark Meadows.
Hello, Helen. A federal judge in New York has granted E. Jean Carroll's motion
to amend her other defamation lawsuit against Donald Trump, which is still pending, to add
new allegations of Trump's defamatory conduct following the New York federal jury ruling
against Donald Trump and awarding E. Jean Carroll
$5 million. And the federal judge, Judge Lewis Kaplan, set a trial date in that new defamation
trial that's set to start. That new trial date is January 15th of 2024. Also, the GOP today is
admitting that its most recent conspiracy, although who can keep track, this one involving recordings about President Biden being bribed from seven years ago that was claimed by some Russian oligarch. He says those recordings don't exist. And Rudy Giuliani, or should I say Helen, says that the other whistleblower that he was aware of is dead.
Oh, again, seems to happen every single week.
But the right wing media, you know what they're focused on, Brett, right? They want to know how will the GOP protect Russian oligarchs who want to provide false
information about Biden so they stop getting killed.
How do we protect the Russian oligarchs, GOP?
I kid you not.
That was a conversation that Jim Jordan had today on one of these wackadoodle right wing
networks.
And I'm being generous by saying wackadoodle.
I should say traitorous. And good news, inflation since last June is down from 9.1% to 4%. Inflation has now
fallen for 11 straight months and is now the lowest in over two years. And wages are up.
Border crossings are down over 70% since Trump's Title 42 policy was ended. Guess what?
Trump was wrong. Who would have predicted? Also, murder rate is down 12% this year. Also,
President Biden got another judge confirmed, Dale Ho, to be a federal district judge in New York.
That is judge number 133 for President Biden. He's far outpacing Donald Trump's ability to select federal judges. And of
course, we know the import and impact of that when Donald Trump put people on the bench like
the corrupt Judge Eileen Cannon. Woof! Got a lot to talk about, Brett. How are you doing?
I'm doing good. Where did Jordy go i was i was looking around i pulled the camera back
jordy's not to be found did we lose him what's what's happening here i don't know jordy claimed
to have some wi-fi issues i want to give the kid a break he's jordy has some internet connectivity

It's clearly the deep state. It's clearly the deep state. They know-
It's psychological warfare.
They know that Jordy carries the bulk of this show and they were too afraid to let Jordy speak.
And so the deep state and the corrupt, even when you just say the words, doesn't it sound so stupid?
It sounds so stupid and it's all the Republicans trafficking. Every single day, they are truly
as dumb as they are dangerous, but I emphasize the dangerous part here. But we all better be
incredibly thankful that they are as dumb as they are dangerous. Because if you think they're
doing damage now, just imagine if they had actual intelligence in spreading all these lies. I mean,
it feels like Groundhog Day in a lot of ways when you read the headlines that you read in today's
intro, as we see yet another GOP conspiracy, yet Donald Trump again attacking prosecutors. It's the same playbook over and
over again. And the things that we never hear are the Republicans have some good ideas to help the
actual American people. The Republicans put forth some great policies today. That's noticeably
absent from every episode and from just the world in general, because they simply do not do that. I challenge
everybody listening to the show. In fact, I challenge you to try to think to the last time
that the Republican Party was right about something. What was the last time?
Any issue at all.
Any issue. Pick an issue. COVID, guns, Russia, Ukraine. pick literally any issue out there and they will find themselves on the
wrong side of it. I have to say, it is kind of funny though, that we get to watch Trump right
now plan out his summer. You think he's got to plan it around all the indictments? I want to
make some plans for August, but I might be getting indicted in Georgia around August. So I'm going to
have to work my schedule around Georgia. Might be back in DC for the January 6th indictment. So
maybe I plan a trip around DC. Is that how he's looking towards his schedule right now?
What do I do in September of 2023, October of 23, New York Attorney General Letitia James
has her trial seeking at least $250 million for Trump's fraudulent financial valuations.
It is going to be a summer of indictments, a summer of justice, but that doesn't necessarily
mean that everything is going to go smoothly. You have to, though, have the right people in place.
And I, for one, am very confident in special counsel Jack Smith
to deal with all of the kind of landmines, legal landmines that exist. And of course,
the biggest one that just kind of came out randomly, but Judge Eileen Cannon is back.
She ain't recusing herself under the law. The first kind of instance of how a recusal would
go would normally be the judge self-recusing. Thereafter, special counsel Jack Smith can now
file an affidavit to seek her recusal or disqualification. The way we know she isn't
recusing herself is because she issued an order today. And she wouldn't have issued this order if she disqualified herself and recused herself.
So this was the order that she issued, June 15, 2023.
It states, on or before June 16, 2023, all attorneys of record and forthcoming attorneys
of record shall contact the litigation security group of the U.S. Department
of Justice, if they have not done so already, to expedite the necessary clearance process for all
team members anticipated to participate in this matter, and thereafter file a notice of compliance
by no later than June 20th, 2023. And because this is a case that involves the Classified Information
Procedures Act, it involves Donald Trump's theft of thousands of top secret and classified records,
there is a process and procedure whereby defense lawyers have to fill out a bunch of paperwork and
essentially have to be cleared in order to review the records that are
going to be produced as part of discovery. So here, Judge Eileen Cannon is ordering an expedited
process where that takes place. But what she should have done under 28 U.S.C. Section 455
is disqualified herself. Section 28 U.S.C, section 455, disqualification of justice judge
or magistrate judge, subsection A states, any justice judge or magistrate judge of the United
States shall disqualify himself, but himself, herself, or themselves in any proceeding in which impartiality might be reasonably questioned,
be he, she, they shall also disqualify themselves in the following circumstances,
where they have a personal bias or prejudice concerning a party or personal knowledge of
disputed evidentiary facts concerning the proceeding. So I ask this, do you believe
that there is a reasonable possibility here that Judge Eileen Cannon's impartiality might be
questioned? First and foremost, the very fact that she was appointed by Donald Trump in 2020,
now would be presiding over a case where he is being criminally charged, that in and of itself
for me raises that question. But then you go to the second part of that analysis,
where she previously has been determined, not once, but twice by the 11th Circuit Court of
Appeals, her supervisors, that she unlawfully assumed jurisdiction over the search
warrant the Department of Justice executed at Mar-a-Lago over this exact case relating to Donald
Trump in 2022. It has been adjudicated that she acted unlawfully in furtherance of Donald Trump's interest twice by the 11th Circuit Court of
Appeals. So if that doesn't raise reasonable questions of impartiality, I don't know what
does. And you think about it. Remember that judge who recused himself in the Ron DeSantis
Disney case because the judge's cousin had like 10 shares of Disney stock. That is how judges
are supposed to actually apply the statute and self-recuse. So now what happens is under 28 USC
section 144 and 28 USC 144 and 28 USC 455, they're read together, basically. And 28 USC 144 basically says,
whenever a party to any proceeding in a district court makes and files a timely and sufficient
affidavit that the judge before whom the matter is pending has a personal bias or prejudice,
either against him or in favor of any adverse party. Such judge shall
proceed no further therein, but another judge shall be assigned to hear such proceeding. The
affidavit shall state the facts and reasons for the belief that bias or prejudice exists and shall
be filed not less than 10 days before the beginning of the term at which the proceeding is to be heard
and it goes on.
But special counsel Jack Smith would need to file that soon. The issue is that then would become appealable to the 11th Circuit Court of Appeals. And ultimately, you would be looking at a three
to six to nine month fight potentially over just the recusal issue before getting into the facts
of the case. So because this is a case brought under
SEPA, the Classified Information Procedures Act, by itself right now, a lot of the orders that
Judge Eileen Cannon can make are immediately reviewable to the 11th Circuit Court of Appeal.
So one of the tactics that Jack Smith may have is, let's see what her first orders are. Then let's
see if she's overturned fairly early on in the
process by the 11th Circuit Court of Appeals. And then let's figure out a potential disqualification
by making a good faith showing that it is appropriate now given kind of strike three,
if you will. But that's special counsel Jack Smith's decision that he has to make.
And also many have suggested that because some of
the crimes occurred at Bedminster themselves, not only the withholding of national defense
information, which took place at Mar-a-Lago, but the transmittal, another violation of the
Espionage Act that took place in New Jersey, will special counsel Jack Smith impanel a grand jury in New Jersey and
bring an indictment there as well? And also, we should still never forget that there is another
grand jury out in Washington, D.C. investigating Donald Trump's crimes relating to the January 6th
insurrection and election interference. But if you want any further evidence that Judge Eileen Cannon is not going to
be a good faith actor, she made her first order already where she should have recused herself
to me under the plain letter of the law and under 11th Circuit precedent in the case United States
versus Martin, Brett. Yeah. I mean, I never expected Judge Cannon to do the right thing.
I mean, we've been following Judge Cannon. First off, how many judges do you really know who aren't
Supreme Court justices in the world, in the entire country? How many Supreme Court justices can you
name? But I bet nearly all of our listeners can name Eileen Cannon because we are all scarred
from the last saga that we had with her. But I trust Jack Smith here. I trust that he knows exactly
what he's doing and that he is steering the ship. He has not veered off course yet, and I don't see
why he would do so now. But it really shows you the sort of asymmetrical warfare on the turf that
Republicans play on versus what the rest of the country plays on, which is Republicans just don't
follow the law. They don't follow norms.
Yet Democrats at the slightest whiff of potentially violating any norm, they immediately
back off like in the DeSantis case, which I was like, really? Because the judge had a cousin who
invested in Disney stock, so he couldn't- 20 shares or 30 shares. Like ridiculous, like ridiculous. But it goes to show you just the integrity gap between
Republicans and between, I'm not even going to say between Republicans and Democrats,
because it's like the entire rest of the country up against these corrupt,
anti-democratic Republicans who just scoff at the rule of law. Then you have somebody like Judge
Cannon who, what, she did something like, what, four cases? She presided over four cases,
a total of 14 days in her life. That's her entire experience. Now she is handling the most important
trial in American history. Of the person who gave her her job.
Ridiculous. And lest we forget, Ben, lest we forget, she was confirmed to the job after
Donald Trump lost the election. That's how recently she was confirmed. Trump had already
lost by the time that she was voted in. So we just need to step back and remember all of
that as well. It's the problem with the way the Republicans run the country as a term I've used
on the show, a cacistocracy, Ben. You know what a cacistocracy is? It's a-
A government of idiots.
Basically, yeah. It's a government run by the most incompetent people imaginable. And that's
what Republicans do.
And it's by design.
It's by design that they put the person who's against education in charge of the Education
Committee.
They put the person who doesn't believe COVID is a thing in charge of the COVID response.
And like Ron DeSantis.
It's the guy who doesn't pass the bar exam as the head of the Judiciary Committee, Jim
Drew.
Exactly.
We're seeing a theme here.
The non-lawyer,
the non-lawyer, Tom Fitton, not an attorney, never passed the bar, not an attorney.
Never went to law school. Never went to law school. At least Jim Jordan went to a law school.
Tom Fitton never even attended one day of law school in his life. And he has the most idiotic,
moronic assessment of both. That's Tom
Fitton. It's like, this is beyond parody, people. I don't care what shirt to wear. He's going to
try to give you legal advice. He can't even give fashion advice. Donald Trump, though, choosing the
advice of Tom Fitton, as we're learning from all these reports, choosing Tom Fitton, a non-lawyer,
someone who's never been to law school, following Tom Fitton's advice when Fitton said,
you know what you could do? Those are your documents, actually. This is what Fitton told
Trump. He goes, those are your documents and you could do whatever you want with them.
And the Justice Department wants them. Just say no. Just say no, they're mine. They're mine.
Meanwhile, you have a guy like Chris Keis, who's no. Just say no, they're mine. They're mine. Meanwhile, you have a
guy like Chris Keis who's like a real serious attorney who Donald Trump paid $3 million up
front, which by the way, is the most surprising part of this entire saga that Donald Trump paid
his attorney $3 million. It's not because Donald Trump's political action committee paid it.
True, true, true, true. Point taken. Now, we'll get to it, but Donald Trump's
political action committee couldn't have paid for the food at Versailles and the Cuban restaurant
in Miami when he stiffed the place and left everybody empty-handed. We'll get to that soon.
But instead of choosing his actually experienced lawyers, there's a few of them on his team,
not many of them, but there are a few of
them. He decides to go with Tom Fitton, who gave him the advice ultimately that led him straight
to an indictment and could very well lead him straight to a prison cell.
Here's the thing, Brett. It wasn't that to me. It wasn't that Trump took Tom Fitton's advice per se.
Fitton just gave the advice that Donald Trump
wanted to hear. Donald Trump was going to pursue that path no matter what. Tom Fitton was just the
idiot who goes, oh, you know, in 2012, I lost the case that I filed in district court.
He lost the case.
He lost the case. And now this case is precedent that basically says that former presidents can steal any record that they want.
What court was this even?
And here's the thing.
It was in front of a district court.
So let's just set aside the facts for a second.
District courts do not set a precedent.
The Court of Appeal sets a precedent.
The Supreme Court sets a precedent. The Court of Appeal sets a precedent. The Supreme Court sets a precedent. Even if
everything that Tom Fitton says happened, which didn't happen in the case, that would not be a
precedent. Could it be persuasive authority? Potentially it could be persuasive authority,
but it's not persuasive authority in that specific case. The district court found it had absolutely
no jurisdiction to hear this idiotic
case brought by Tom Fitton in 2012 against President Clinton from 1999 over Clinton's
personal notes related to Clinton's personal autobiography. And the federal court said,
that's his personal, the federal court said, you idiot, that's his personal autobiography.
So if he's saying those are his personal That's his personal autobiography. So if he's saying those
are his personal notes for his personal autobiography and the National Archives agrees,
those are personal. The court didn't say, on that logic, Bill Clinton could have claimed
the nuclear codes are personal, just like his autobiography. The court says the exact opposite
in the case. So not only is it not precedent, not persuasive authority, it, if anything, creates persuasive
authority very much against the proposition that Donald Trump is claiming here.
And it is just such an idiotic premise to say dumb.
It's so dumb.
That's by the way, when you hear him say the socks case, the socks case.
But here's the thing, too.
They rely on a very
uneducated base. That's why Trump goes, I love the uneducated who don't know what precedent is.
And they don't spend the time on Fox or Newsmax to educate, which they should. People should know
this is precedent. This is not precedent. The Sox case, here's what the Sox case actually says. Instead,
you got Donald Trump posting things like the persecution is being done by the same weaponized
agencies that for seven years have been running illegal psychological warfare campaigns against
the American people. Illegal psychological warfare. When I started my legal career at the law firm that I worked at,
we would get these messages from people who would say the CIA has hacked into my brain
and conducts illegal psychological warfare campaigns against us. And we'd be like,
yeah, we would say that's a 5150 email, meaning involuntary psychological. His messages are 5150 emails incarnate. And this is who the
MAGA Republicans say, you know what? We got to give this guy the nuclear codes again.
This guy, let's give it to him again. Yeah, sure. We know that he was just showing random dudes at
Bedminster and Mar-a-Lago. The audio recordings of Donald Trump showing people
this material, our military operations, it'd be one thing if Donald Trump even sounded
sophisticated in it. It would still be horrifically criminal. But the idiocracy here is like,
he's like, yo, do you think this makes me look better than chairman of the Joint Chiefs of Staff
Mark Milley? Do I win? Does this make me a winner?
That's what's on the recording as he's showing random strangers military operational plans,
not even people he's close with. So imagine what's not on audio recordings.
It's completely deranged. And it's pretty clear that Donald Trump is viewing the fight ahead of
him as he's viewed every fight throughout his political career. And that's, he's viewing it as a political battle, even more so than a legal one. And he's
viewing it as a public relations battle, even more so than a legal one. And, you know, that's fine.
If you're running for president, I guess that's even probably maybe okay if you're in a civil
case and you just want to kind of sway public opinion and whatnot. But by the time you get into the courtroom, all your lies are not going to hold up. You could pretend to your base that the Presidential Records Act means the exact opposite of what the Presidential Records Act says in very plain language, like you could all read the Presidential Records Act. It says the complete opposite of what Donald Trump says it says. Yet Donald Trump tells his
supporters that it says the opposite. And that's fine for him to do on Truth Social. And if it was
a civil case he was dealing with, okay, the worst he's looking at is a steep fine or whatever.
But Donald Trump right now is charged with serious federal crimes.
And Donald Trump is going to be charged with even more serious federal crimes.
And then Donald Trump is going to be charged with serious state crimes. And he can't gaslight
his way out of that. The public relations strategy ultimately is not going to work.
He's just going to be like a madman,
ranting and raving. He's going to be like at the end of one of those movies when you see somebody
being whisked away into an insane asylum and they're like, put the Presidential Records Act,
put the... Sir, sir, sir, sir, sir, you're going to prison, sir, sir, calm down. But the, but the
socks case, the socks case, psychological operations. And let's not forget this though.
Ultimately, while special counsel, Jack Smith investigated and brought the charges,
special counsel, Jack Smith didn't make a wave, a magic wand and indict, right? It was a grand jury of Donald Trump's peers
sitting in the Miami federal courthouse who saw all of this evidence that we now know exists
based on the speaking indictment. They were the ones who voted on the indictment.
Same thing in the Manhattan district attorney, right? It went in front of a grand jury. The
grand jury voted to indict. It wasn't Manhattan District Attorney Alvin Bragg. It was a grand jury of Donald Trump's peers who made that vote.
So let's talk about what happened after Donald Trump was arraigned. He went to one of Miami's
popular Cuban restaurants, Versailles, in Little Havana to kind of spew his propaganda saying Marxism and communism and
all of those things. And by the way, I will recommend everybody to watch the interview we
did here with Democratic Congress member Jared Moskowitz, who talked about a great framework
for how Democrats need to be addressing politics in Florida and making sure that their messages
is getting to all of the communities
in Florida but let's play this video where Donald Trump basically says he's buying food for everyone
play this clip are you ready are you ready food for everyone except there was no food for everyone
and he was narrator except there was no food for everyone and he's a complete
liar but that's how he treats people like i'm reminded in puerto rico where he's like
throwing uh paper towels at people you want that after people have lost loved ones thousands of
people have died people are suffering you know know, chucking paper towels like an idiot. But no,
Donald Trump has not paid anyone. That was confirmed by the Miami New Times. So after
lying there, Donald Trump then goes to Bedminster where purportedly tickets cost up to $100,000.
Who knows if anybody actually paid that fee because he lies about everything.
But Donald Trump gave a completely deranged speech.
And here in this speech, after Donald Trump's arraignment, this is what he says about the documents that he stole.
He just admits it, he says.
But he claims he had every right to steal the documents and admits to his crime.

President, the law that applies to this case is not the Espionage Act, but very
simply the Presidential Records Act, which is not even mentioned in this ridiculous 44-page
indictment. Under the Presidential Records Act, which is civil, not criminal, I had every right
to have these documents. The crucial legal precedent is laid out in the most important case ever on this subject,
known as the Clinton Socks Case.
You know what that means.
After leaving the White House, Bill Clinton kept 79 audio tapes in his sock draw.
They included discussions of U.S. military involvement
in Haiti, discussions of U.S. foreign policy,
both defense and offense, against Cuba, recordings
of President Clinton's conversations with all of
the many foreign leaders at the time.
Think of that.
Sensitive facts about trade negotiations taken from presidential briefings.
Discussions with the Secretary of State about conflict in Bosnia and much, much more.
Very big stuff.
Not only was Bill Clinton never even considered for criminal prosecution based on the tapes he took,
but when he was sued for them, he won the case.
Judge Amy Berman Jackson's decision states,
under the statutory scheme established by the Presidential Records Act,
the decision to segregate personal materials from presidential records
is made by the president during the
president's term and in the president's. And here's the thing though, too, despite the fact
that it's all false, Donald Trump has never declared those records personal. I know he gives
those speeches, but his lawyers have never made any filings to say that the classified records – remember when Judge Eileen Cannon, there was that whole process she appointed like that – the other judge who was reviewing the documents and there was the other judge appointed.
And then they went through the process of designating documents as whether they were special master is the word I was looking
for. Is that Raymond Deary? Raymond Deary. Whether documents were personal, Donald Trump never claimed
those as personal records because they're not personal records. Notes and recordings for your
autobiography are personal. Documents that you stole like classified briefings, those documents are clearly
not personal. They belong to the United States government. One fact that always stood out though
to me about the arraignment though is what a coward Donald Trump is because all of the reporting
was that special counsel Jack Smith would make eye contact, or tried to make eye contact with Donald Trump.
The whole time special counsel Jack Smith was just looking at Trump
and just intently staring at him, trying to make eye contact.
And Donald Trump, according to everyone, looked frustrated.
He was shrugging the entire time with his head down
and refused to even glance at special counsel.
He didn't call him deranged Jack Smith. He didn't threaten his wife in person. He didn't do all the
things that he does from behind the keyboard. He didn't do that to Jack Smith when he was
actually able to confront him in person. What an absolute shock.
Here's what he said during that speech at Bedminster about Jack Smith's wife. Think about
what a vile, vile criminal Donald Trump is. Play this clip.
He's a raging and uncontrolled Trump hater, as is his wife, who also happened to be the producer
of that Michelle Obama puff piece. Total puff piece. This is the guy I've got.
And Donald Trump, though, I mean, look, he is a coward. He's a keyboard
warrior in all caps. This is why the MAGA Republican Party to me is just so utterly cowardly
also because they're afraid of that. That gets them nervous. Oh, he's going to do all caps.
He's going to be mean to me in all caps. I can't let him give me a nickname. Oh my gosh.
Or I don't want him to say mean things about me. Stand up, right? Stand up for yourself and say,
you're a traitor. I think people would respect that far more. If you just said,
what you're doing is traitorous. What you're doing is-
If there was one strong figure, one actually
strong figure in the Republican Party, one person who was not a complete and utter coward and had
the charisma and the gravitas to be able to confront Donald Trump directly, I do think that
is the only way. That is the only way that they could get through this just disgusting phase that they are in.
And I hope it is just a long, horrific phase.
And you see Chris Christie trying to do that right now.
And so I will give, I hate to give anybody in this party credit, but I will give Chris
Christie a little bit of credit for at least bringing it directly to Donald Trump.
One of the things I noticed in kind of tracking Chris Christie's polls was
before he announced Christie was at like zero to 1%, he was barely registering.
It's not a big jump, so I'm not going to overstate this. But last poll I saw he was at after going
after Trump, he went up to like 4%. It's enough that gets him in the debate under the RNC rules,
which they set a 1% threshold. So to have Chris Christie at the debate,
and I'm with you. I mean, Chris Christie's done horrific things. He's aided and abetted Donald
Trump, deserves very little credit, but to at least have a voice calling out Donald Trump for
the traitor that he is, is going to, exactly. But look, special counsel Jack Smith continues on with his other criminal investigation
of Donald Trump relating to Trump's 2020 election interference. I want to talk about that. An order
by a federal judge in New York granting E. Jean Carroll's motion to amend her other defamation
lawsuit. And let's talk about the GOP admitting that their latest conspiracy, well, was just that,
a deranged conspiracy. We'll talk about that and more right after this quick break.

Of New York. E. Jean Carroll and her lawyer, Roberta Kaplan, they filed a motion to amend the other defamation case that they have
against Donald Trump, in addition to the one that they just prevailed, to add additional allegations
to it based on what went down in the other defamation case where they won, as well as
Donald Trump's defamatory statements that he made at that so-called CNN town hall thing where he
further defamed E. Jean Carroll. And earlier this week, Judge Lewis Kaplan, who presided over
the trial that E. Jean Carroll prevailed, unworried jury awarded her $5 million,
granted E. Jean Carroll's leave to amend, meaning she can file this amended complaint where she will now be seeking at least
as a floor $10 million based on all of the new conduct engaged in by Donald Trump.
And since essentially Donald Trump has been found by a jury to have engaged in the sexual assault
and defamation, it leaves very little to resolve at this point in the other defamation case, which went through a whole appeals process that I won't bore you with.
Suffice it to say, it's an entirely other defamation case that now combines 2019 statements made by Donald Trump along with the new defamatory statements made by Donald Trump in that so-called town hall and it was just from a lawyer's perspective
a brilliant surgical move by eugene carroll's lawyer roberta kaplan who instead of filing a
whole new case eugene carroll three i guess it would be called but she can still do just add
those new allegations the case that's going to be heading to trial anyway to expedite those charges
being heard before a jury. And guess
what? Earlier today, as of the date of this recording, Judge Lewis Kaplan set a trial date
in that matter for January 15, 2024, where Donald Trump will be going to trial again. But by the
time the jury hears that case, I think the jury will already be instructed. Donald Trump engaged in defamatory
false statements. Donald Trump engaged in sexual assault. And you, the jury, just have to determine
if he acted with actual malice, which should be an easy finding, as well as the damages to award.
And the damages are going to be significant because just think about it. Here, E. Jean Carroll was,
she just won her trial.
Her name was vindicated.
Then Donald Trump goes on CNN in front of three million people and defames her again.
It's like an open and shut case.
I think a jury is going to hit him for 20, 50, even $100 million in that case.
I would not be surprised with that type of ruling.
The more Donald Trump opens his mouth,
there's a reason why lawyers typically like when their clients remain quiet.
There's a reason why people are read their Miranda rights where you have a right to remain silent.
Anything can and will be used against you in the court of law. Fortunately for us,
Donald Trump can't keep his
mouth shut. And every time he opens his mouth, he actually further incriminates himself. To go back
to the clips that we played earlier on the show, Donald Trump admitted that he took the documents.
He made no effort to even pretend like it was an accident. He made no effort. He simply said,
I took the documents. And in recent
statements, Donald Trump is also saying, actually give them back to me. They're my documents. I'm
supposed to have the documents. Every statement Trump makes, he is digging his hole deeper,
just like every statement he made in this E. Jean Carroll case has dug his hole deeper.
And we saw in those depositions, those brutal depositions that
Donald, that was taken of Donald Trump and the E. Jean Carroll case when he like confused
E. Jean Carroll for his ex-wife. And he just destroyed his own case, all of his statements
on truth social, all that stuff he's repeating. But this time he's repeating it on a criminal level against the federal government.
And the repercussions of that are going to be far more than $10 million, $20 million,
$50 million. We're talking about real prison time, a real prison time, mostly because Donald
Trump cannot shut his mouth. It's the only time in history that I've wanted Donald Trump
to keep talking. I'm usually like, dude, shut the hell up. But now-
Donald Trump though is not asserting defenses that are legal defenses, right? He's abandoned
that. That's not his focus, right? What he is trying to do is overthrow our democracy.
That in a way is his defense. I am going to destroy the judiciary. I am going to
destroy the Department of Justice. I am going to destroy the FBI. I am going to take down this
country. That is Donald Trump's defense. It has nothing to do with the way you would actually defend these
cases. And by the way, Ben, honestly, if Trump were to win a second term, God forbid, I wouldn't
feel safe. When he says everything that he says also, Donald Trump, he casts a very wide net.
He'll say like, President Biden, everybody who allowed the country to be destroyed the way it is.
Like he's basically saying anybody who opposes him publicly, anybody who opposes Donald Trump, he will use the Justice Department and he will use his raw power to persecute them, prosecute them, imprison them.
That's what Donald Trump is saying.
He wants to get rid of all this. He could not be clearer at this moment in saying that his whole, I mean, he uses the words himself, his whole presidency would be a retribution tour. And he would be taking all of his anger about all of these cases out on his enemies. And that includes the press, that includes people like us, that includes people like Biden, that includes every single Democrat. That's who Donald Trump wants to destroy.
You listening to this, I mean, that's who Donald Trump wants to come for. It's dangerous.
He is saying it out loud. Let me make this observation too, which is the reason
that the crowd in front of the Miami federal courthouse, despite the proud boys and other
groups telling people to show up. The reason
the crowd, though, ultimately is small, you have to give a lot of credit, though, to Merrick Garland
and the Department of Justice for prosecuting these terroristic groups and these individuals
who engaged in the conduct that they did to try to overthrow our democracy during the January 6th insurrection.
That's the way law and order is supposed to work as a deterrent, right? So people say, wow,
I see these oath keepers getting sentenced to 20 years in prison. They are getting convicted
of seditious conspiracy. I'm not going to do that conduct again. Meanwhile, the modern day Republican
parties are doing what? They're saying, we better sing songs with the insurrectionists.
Let them free the January 6th political prisoners. Why? Because they want to create
basically their terroristic army. They need those people because their policies are not designed to
exist within our legal framework, our honored legal framework of democracy and our system of
justice. They want to destroy it from the outside to exalt an authoritarian Putin-style emperor.
And they are using Putin propaganda, which we'll talk about in a little bit on this episode.
They are using information from Russian oligarchs who are trying to destroy America.
In Russian, laundered through Rudy Giuliani in 2020, that makes all of
these claims against Biden because they're our enemy. Of course, the Russian oligarch is going
to say things about Biden, who's trying to defeat the Russian oligarchs. And the GOP is focused on
how can we offer protection to the Russian oligarchs? Will somebody think of the oligarchs?
Will somebody please think of them?
We'll get to that.
But I do want to talk about a special counsel.
Jack Smith continues his other criminal investigation into Trump relating to the January 6th insurrection.
Concurrently, at the exact same time, Trump is being arraigned.
Going on at the exact same time. Trump ally and Nevada GOP chair,
Michael McDonald and Nevada GOP vice chair, Jim DeGraffenried, who were the fake electors in
Trump's attempt to steal the 2020 election. They certified their names in the state that Trump won,
even though that Biden won. And McDonald's cell phone had previously been
seized by the Department of Justice. They went before the grand jury in Washington, D.C. to
testify. I expect indictments to be handed down there late August, probably early September.
I mean, I think I hit the document theft case pretty much on the money in June, I think we'll see the other case
indictments handed down September, October the latest, but I think-
It'll come into focus too.
Late August, September as well. So that case proceeds in earnest. We know that,
and this discovery actually happened through Ruby Freeman and Shea Moss's defamation case
in Washington, D.C.
That case is before federal judge Beryl Howell there, where remember Rudy Giuliani was trying
to claim that he was too poor to participate in discovery and that he owed the electronic
discovery vendors.
So he tried to drag it out, right?
But Ruby Freeman and Shea Moss's lawyers, they stuck with it, motion
after motion. Then Rudy Giuliani had to basically claim, oh no, I'm actually able to pay for it now.
And why was he doing this delay, delay, delay? And he was trying to hide stuff.
And he's trying to hide what, this was a big discovery in the Ruby Freeman Seamus case,
that the email that Giuliani was using was rhelenwithnumbers
at gmail.com, and his name would show up as Helen. And so that's how he would use,
and I think that was his mother's name or something. And that's the name that he would use
when communicating with Mark Meadows to try to hide his communications. That came out finally in these proceedings.
So that just goes to show you why you've got to stick to it because Giuliani and Trump,
all of their tactics are designed to just wear you out. So you just go, I'm done with this.
This is annoying. This is, but great lawyering right there. And then, of course, Lindsey Graham, who said if the Republicans were to ever elect Donald Trump, that would be the destruction of the GOP, perhaps the only accurate thing Lindsey Graham has said in the past many, in Washington, D.C., and the potential that
Donald Trump will be indicted for crimes relating to the insurrection. Play this clip.
It seems to be selective prosecution. So President Trump has every right to defend himself.
I think politically, it probably makes him stronger in the primary. If the special counsel
indicts President Trump in Washington, D.C. for anything related to January 6th, that
will be considered a major outrage by Republicans because you could convict any Republican of
anything in Washington, D.C., and I fear that's where this is going as sort of an insurance
policy.
I mean, Lindsey Graham, remember, this is the guy who on January 6th made a huge spectacle and said, all right, everybody,
I'm done.
This is where I get off the Trump train.
He went too far, finally went too far.
And then like a day later, he was back.
I don't know.
Probably Trump gave him a phone call or he got some scary news about something that was
going to be, I don't even understand what they're holding over Lindsey Graham or if
he's just that weak and cowardly that this is who he's become. But his whole argument there is also just absolutely
basically, okay, so Republicans commit any crimes they want as long as it's in DC.
Because as long as it's in DC, it's going to be a biased jury. So you can't bring charges against
the Republican in DC. So that's their, like the purge,
they can commit as many crimes in this area as long as they want, but they're not allowed to be indicted there or tried there because it's unfair to the Republicans. Republicans also get
such the benefit of the doubt in so many prosecutions. I think like literally every
director of the FBI, like in history has been a Republican, like every single one, there's never been a
democratic FBI director, yet they still claim this victim complex. Don't do crimes. Just don't do the
crimes if you don't want to be charged with the crimes. And this was one of the most, one of the
gravest, most serious crimes in American history. If you read that indictment, that speaking indictment, those 38 counts with citing recordings,
text messages, photographs, photographs taken by Donald Trump's employees well before
any subpoenas were issued, well before the DOJ executed a search warrant that
demonstrate how Donald Trump was hiding these classified records. By the way, which Donald
Trump claims, oh, that was the DOJ who took these photographs and planted it. No, that was your
co-defendant, Walt Nauta, who took those photographs well before the Department of Justice ever even sent a subpoena. But if you
read that indictment and you're like, cool, cool, this is okay conduct. You have zero credibility
and everything else. I don't care what political party, I don't care what country, I don't care
what planet you are from. You read this indictment and you go, that is
horrific conduct and that person should not be anywhere near a position of power. It's absurd.
But here's the thing. This is how Republicans think. Oh, in this indictment, it mentions that
Donald Trump is caught on recordings saying these things. Okay, you know what that's called? Evidence. A recording of Donald Trump is actually
tangible evidence. It exists. It is a real thing. So what do Republicans do? They go,
there are 17, they make up 17 recordings of President Biden being bribed by a Russian
oligarch and we've got, and we've got him.
And then what does the right-wing media do? Joe Bribin, Joe Bribin, massive scandal. What do
people like this Tim Pool, who's basically an op, who pretends to be like a liberal guy, Tim Pool,
or like a disenchanted Democrat, just total bullshit. Tim Pool goes,
Biden has been credibly accused of coercing a bribe from a foreign executive. Wow. Credibly.
Wow. Their whole machinery goes into effect. His whole thing is a BS op. The guy is strictly a
troll and his entire thing is just writing things that he know will get
engagement.
He knows exactly what he's doing.
And he takes all of his viewers for absolute morons and he just plays into it for engagement.
That's all he cares about is attention.
That's part of the whole right wing machinery, right?
Credibly accused just to create this equivalence.
Trump was on a recording.
Biden's on a recording.
No, Biden's not a recording. No,
Biden's not being credibly accused, you freaking moron. It is a Russian oligarch who freaking
works from Vladimir Putin who laundered this information through Rudy Giuliani in 2020.
The allegations are about something that happened like three years before that even.
It was rejected by Bill Barr. Bill Barr can say whatever he wants, but how do you know it was
rejected? If he accepted it, he would have appointed a special counsel. That's what you
do in a situation if you think there's credible criminal allegations. The document is in Russian. It's hearsay on top of hearsay, meaning a paid
FBI informant, so one level removed, got this allegation by a Russian oligarch who reported
on what the Russian oligarch heard. Hearsay within hearsay within hearsay in freaking Russian
by someone with clear intentions to destroy our democracy. I think
Democratic Congress member Dan Goldman said it best during one of the congressional hearings.
Play the clip. We've heard so much about this FBI 1023 form and how it includes sensational
allegations about a massive alleged bribery scheme by President Biden. So I was really eager
to read that document this week. Did the majority actually find some actual evidence of wrongdoing
by the president? Of course not. But it's even worse than that. This document that they will
not stop talking about is shockingly just a three-year-old secondhand
hearsay, uncorroborated rehashing of Rudy Giuliani's bogus allegations that he got from
corrupt Ukrainian officials. Now, we all know that former President Donald Trump was impeached
because he tried to extort President Zelensky to announce
an investigation into this Ukrainian company Burisma that would benefit Trump's political
campaign. The theory goes that then Vice President urged Ukraine to fire its prosecutor general
because he was investigating Burisma and the president wanted to help his son who was on the Burisma board.
You know where Giuliani got this information from? That fired prosecutor general himself,
the corrupt prosecutor general. I want to talk about this. I want to talk about how the GOP has been saying that they need to protect Russian oligarchs who launder this defamatory information. But one thing I'm
noticing right now in our YouTube chat, I'm seeing like Jack Smith emojis. I'm seeing
empty badges right now as I'm looking at some of these comments. Brett, can you explain what's
going on and how people, if they want to access this, how they can do it? Because right now,
I'm the least technologically savvy amongst the brothers.

And we said right away on the show, we're like, yeah, it's obviously bullshit. Like all their other things, this is an obvious lie.
And why? Because you know what? We're a bit experienced now with these Republicans.
We know how they operate. And I think our audience is very savvy too. And they know
how the Republicans operate, just in deception and lies and gaslighting. And it's one fake story onto the next story.
And this, like all the other stories, once the Republicans actually started feeling the heat
and they were in a place where they had to actually show proof, show your work, Republicans,
show your work, evidence, let's say more than an allegation that a Russian oligarch,
let's see the evidence, just like all the other allegations that have been made
over the past few months, this one ended exactly the same or is in the process of ending exactly
the same. Oh, we don't even know if these tapes exist. We don't even know if they exist. Is the
whistleblower alive? Is the whistleblower dead? I mean, how many times have we heard these things
now between there are at least two missing whistleblowers now that the
Republicans have put forward. There were the documents that were going to blow the lid off
the Hunter Biden scandal and were going to lead to Joe Biden's downfall. This was going to be it.
They were sent in a UPS to Tucker Carlson and Tucker Carlson had a whole show planned around
him, but oh no, oh no, just before his show, Ben,
the document we're missing, the package. Deep state UPS. Deep state UPS. Rhinos.
It's been not quite the right word, but amazing in like a wow, that's crazy kind of way
to witness the Republican kind of user reaction to all of this and how they don't realize that they are
being played over and over and over again. So the new one, when I saw this news that they are now
saying, oh, this new whistleblower may have died, the whistleblower, he was ready to take down the
Biden crime family, Ben, but he died. You have to be alive, I think, to die.
Yeah, you have to exist in the first place.
And so what do I see these right-wing people say to responses from the people who have gaslit them over the past few days into saying that there were these bombshell tapes that were going to
take Biden down? Do they go, oh, you know what? You obviously lied to me. This is the same thing
that's happened every other time. No, they immediately go, oh, did she get Hillary Clinton? Did the Clintons get her? Did the Bidens get her? And on our show, the interview that you
did with Representative Jared Moskowitz, he had a really- I had so much fun with that interview.
He had a really, really, really funny comment about this entire situation. And I wasn't going
to play it right now, but because I'm talking about it, let's play. This is Moskowitz talking about how, you know, Biden's kind of Schrodinger's president to these Republicans.
He's whatever they want them to be.
Is he sleepy?

Is he a criminal mastermind?
Yeah.

Every day they go on TV and they talk about he's sleepy.

more than any parent should ever have to deal with okay but they're trying to take one of the

And just a fantastic interview. But so, as you know, we've been talking about this new Republican scam.
It started with Chuck Grassley on the Senate floor announcing that he may have seen this evidence and alleged
by a Russian this. You can't even follow this. But now, just a few short days later,
after hours of going on TV networks, of going on Newsmax, of going on Fox, of endless think
pieces on Fox.com and
Breitbart and whatever other crazy websites there are out there.
All of a sudden, after demanding Joe Biden's impeachment over this, they went, we need
to impeach Biden.
Impeach him over these – over Russian oligarchs allegations.
Now, they're not too sure that the tapes exist.
They might exist.
They might not exist.
You know, what is a tape even? What is life?
I don't know. These Republicans don't know either. So first I'll play you this clip of Jim Jordan,
and he is on some far right radio show. And I had to look up the show to make sure it wasn't some
random dude just on his lawn. The footage that I'm about to show you, it's like a
guy on his lawn, but this is apparently a show via Newsmax or something. But Jim Jordan admits,
not too sure if the tapes exist, but nevertheless- And the guy who's interviewing him wants to know
how the Republicans are protecting the Russian oligarchs.
That'll be clip two, which I'll play after. So the first one is not sure if the tapes exist.
But Joe Biden might need to be impeached anyway. Here's the first clip.
Do you think that now impeachment is back on the table as far as the speaker is concerned
because of these revelations and the seriousness of these allegations?
Well, I do think that that that's a decision for the entire conference. If if these allegations? Well, I do think that that's a decision for the entire conference. If these
allegations are, you know, if the proof becomes so compelling that, you know, even the mainstream
press, I think, would have to look at it. But we don't know for sure if these tapes exist. If they
do and they say what Senator Grassley has said that he thinks they're going to say, then I think
it's a different animal. But I do think
that impeachment is
something we have to look at.
So it doesn't know if the tapes exist,
but impeachment is something they're going to have to look at.
Impeachment's on the table for tapes that don't exist.
Impeachment, made-up allegation,
made-up tapes, they don't exist.
But just pause.
Whatever your political
party is,
if that made sense to you that's very problematic
absolutely but ben but ben will somebody please think of the oligarchs will somebody please think
of the oligarchs play the clip this oligarch who you know i mean you you can blame him because he
wanted he was trying to buy his way into the U.S. government.
But allegedly he had a client. He was able to buy off Joe Biden and his and his cokehead son.
Now, many people believe that once this oligarch is identified, that he could be a target for those who don't want this information out there.
Is the GOP taking steps to protect the oligarch well uh we we that
that name in the in the when i read the report uh the 1023 that that is redacted so um yeah that
that's that's in in the report there too but we don't want anyone to get hurt you certainly don't
want a source who's been helpful to our country. You certainly don't want to have to do anything that would jeopardize his safety.
We understand that.
But by the same token, the American people, we the people, have a right to know what's really going on,
particularly with the guy who's the head of our government, the President of the United States.
If what's alleged is actually accurate, that's huge news.
That's huge concern.
That's a big problem. So that's why we think this
needs to be made public with the appropriate redaction of the sources.
It's made public, first off. You're talking about it. You've made it very public. The reason that
it is classified information is because it is information that was laundered by
our enemy to try to destroy our democracy. That's why they had to look at this in a sensitive
compartmented information facility or a skiff. But you're all talking about it. And by the way,
here's the thing. If there truly was a recording of President Biden while he was the vice president being bribed
and him talking about being bribed, which doesn't exist, just because I'm a supporter of Biden
and just because I am a supporter of the Democrats now because they're the only pro-democracy party, I wouldn't be like,
socks case, the socks case. No, I would be, that is horrible. But we live in an evidence-based
system and our processes shun that type of innuendo and defamatory rumors. The bottom line, what investigative bodies are
supposed to do is investigate. And if there's no evidence supporting it, you don't just use
the bare naked allegations of a Putin puppet to say, well, this person's saying it. I don't have anything that actually
supports it. But he should be impeached anyway. Like, who cares? No, this is serious, serious
business right here. And this is serious business. You have the clip of Giuliani,
where he talks about how the whistleblower died. You got Giuliani who lied. These people lie about everything.
And Giuliani is the one who laundered these documents to Bill Barr in 2020 when Barr rejected.
On a day in which we find out that the Bidens took a $10 million bribe from a Ukrainian,
Mykola Zashevsky, which I could have told you, you know, and did tell them three
years ago. And they followed up on none of the evidence I gave them. They were hoping the people
would disappear or die. It's extraordinary. I gave them one witness that any investigator would
jump through hoops to go to. Gave them a witness who is a woman who was the chief accountant at
this crooked company barisma she was the wife of the former owner who died under suspicious
circumstances uh and she was willing to give up all of the offshore bank accounts, including the Biden's. And you also have, by the way, Chuck, but this is who they like. This is who the MAGA Republicans look to for leadership. And that's
why to me, this isn't a Republican or Democrat thing, right? This is a truth thing. This is a threshold of competence thing. This is a law and order thing. And this is a, hey,
let's not turn America into a satellite nation of Vladimir Putin thing that these modern day
Republicans definitely want. By the way, I think when Saudi Arabia did this whole thing with live
golf, they were like, well, the Russians already
got the NRA. So how else do we get to these Republicans? Let's just go with golf. As long
as we influence them with golf, you got the Russians and the NRA. These people can be bought
and sold so easily. And then you got Chuck Grassley, who said, we're not interested in
whether or not the accusations against President Biden are correct or not in the first place. You then have
Fox. We have this photo of one of their stories that says, because Biden was asked about these
issues. And Biden laughed and he was like, why are you asking me dumb questions? This is the
stupidest question. I'm trying to do things for our nation. And this was the headline on Fox. Biden chuckles at reporters question about possible Burisma
recordings. He laughs in your face, America. Just think about how disgusting. After all,
you know right now that that's the Fox. He laughs in your face. It's a made up stupid story
that supports Vladimir Putin. Wake up, America, Brett.
Yeah, it's absolutely, absolutely disgusting. And you could go down the list, James Comer also,
James Comer said, yeah, we're not too sure if these tapes exist. And I've seen a lot of people
in the comments right now, and I've seen a lot of people in our comments when we make videos like this say, but why,
if it's all BS, like it obviously is, why is nobody filing defamation lawsuits? Why isn't
Biden suing them? And everybody here is kind of weaponizing the law to their advantage,
which is how it goes. First, the bar for defamation is so astronomically high,
but it doesn't even matter because there's a thing called the speech or debate clause,
which bounds all the people in Congress, which really kind of makes them be able to say almost
anything except in various circumstances. As long as they claim they are investigating something
and they are using their congressional powers to investigate, they could claim immunity under
the constitution speech or debate clause. And also Biden is not suing for defamation. Biden is trying to
improve our economy. Biden is dealing with the CHIPS Act and the PACT Act.
Biden specifically ignores all of this stuff.
Biden is going to file a defamation case against Jim Jordan.
Additionally, Fox does it to more people than just Biden, who's obviously has
more important things to do.
So why not the defamation suits?
There's a speech or debate clause where they just say it's a part of a legislative function.
And then you'd say, OK, but what about Fox?
What about first off, they were hit with a massive suit for something else.
But what about Fox?
What about Newsmax?
What about Rudy Giuliani? These people aren't in government. What protections do they have? Well, they
weaponize the First Amendment. And the way they do it is you'll notice that anytime they say
something that is especially outlandish, they will always couch it in terms like allegedly,
or sources say, or they will cite their own coverage on another
Fox report, New York Post or Wall Street Journal. James Comer says, even in the piece that Ben said
before, that disgusting post on fox.com, you notice it's in quotes. He laughs in your face,
America, at possible Burisma recordings. The language they use in
these headlines is very deliberate. Republicans accuse, DOJ.
Republicans accuse. That's how they actually get around it, by not necessarily stating it as a
fact, but these people are accusing. There are critics say X, Y, and Z. This is a bit of a tangent, but while we're on Fox, Fox had a
particularly horrific tweet the other day as well, where they attacked the LGBTQ community as they do.
And this is an example of exactly what I'm saying here. They were talking about the pride event that
the White House held this year,. They posted this and ultimately deleted it
when they faced a lot of backlash. This was what they said, quote, White House flew controversial
new transgender flag that promotes grooming and pedophilia. Say critics. The say critics
part was the part of them saving themselves right there. Meanwhile, that's just absolutely false
and disgusting and obviously defamatory on its face. And the White House actually clapped back
at them. You had other White House staffers responding. They were using, for those who
can't see it, they had showed a picture of the progress pride flag that was being flown
on the White House during the pride parade. And the progress pride flag has added black and brown
stripes to the flag for communities of color. It added pink, white, and light blue for the trans
and non-binary community. And these White House staffers brilliantly responded to Fox's disgusting post with this, Fox using the exact same flag design
covered in their Fox letters and their Fox logo that they circulated internally in their pamphlet
on corporate social responsibility. Just to show you how full of shit Fox is throughout all this. And Fox actually ended up deleting that absolutely abhorrent tweet.
And then they reposted the article and it was still completely disgusting.
But they softened up the language just a little bit.
But that's how they lie.
That's how they get away with what critics say, sources say, Republicans' opinions' opinion pieces, and they weaponize this to such
nefarious ends. So when you see things like that, just be aware of it and take note of it.
Where is this coming from? Oh, sources say. Who's the source? Oh, Tom Fitton is the source.
Oh, Stephen Miller is the source. It's always the most messed up source imaginable,
some sort of Trump flunky, whatever, like 100% of the time.
And then you saw with that Fox story as well, it talks about double standard, right? This is how
they try to create the equivalence. The double standard is on the one hand, you're accusing
Donald Trump of recordings. On the other hand, President Biden's got recordings.
It's just a double standard. And let's just conflate them when they are completely and very
different things. And they know that, but they are engaged in propaganda. And that is exactly
what they're trying to do. Before we move on to the next topic, though, I got there was one moment
during the Jared Moskowitz interview where he talked about Chuck Grassley, who's the source
of this most recent lie about the recordings. I won't try to paraphrase. I'll let Jared Moskowitz
do it himself. Play this clip. We have this 1023 form that the FBI is talking about. And obviously,
I can't go into the details because unlike the Republicans who pledge not to talk about confidential information and go talk about it, I actually won't.
OK, but, you know, they're now trying to say, well, by the way, we have audio tapes.
The form shows audio tapes.
By the way, this form, which was filled out, OK, now three years ago, is about a conversation that happened seven years ago in Russian.
OK, double hearsay.
You can't make this stuff up.
And now there's 17 audio tapes.
And Chuck Grassley, who's still using his BlackBerry,
even though they turned the service off.
Okay, this is the guy who's going to tell us they got 17 audio tapes.
Like, what was he?
I mean, just come on.
I mean, and so what Democrats have to do is we have to
recognize that's the game right and we have to play you have to do you have to go back you have to
fight it and you have to expose it like in the stories that we discussed today
everybody watching and listening to this where else have you even heard these stories being discussed
the way we have today with the facts, with actual evidence using their words? There is
actually, and this is always what you, me, Jordy, what we talk about sometimes, and others
on the network, I'm like, there's really nobody. I was like, is there nobody else?
I spent hours today by spent hours watching those podcasts,
like watching the podcast where Jim Jordan spoke to whoever that was. I still can't get over this.
Is it a Zoom background? I digress. I want to talk about some good news and President Biden
policies. The first thing though, I've been doing some digging on the issue of these Jack Smith emojis. And apparently the way you get the Jack Smith emoji is you have to become a member
of the YouTube. So on the bottom right where it has that dollar sign, then it allows you to use
emojis. So there's a benefit right there and it supports the growth of this network.

good news right now. This is good news that I think we all should be able to celebrate. I think
everybody has been wanting inflation to come down and now we could confirm that inflation has now
dropped since last June to now from 9.1% to 4%. So for those counting, for the past 11 straight months now, inflation has fallen.
It's now at the lowest pace that it's been in over two years and wages are now up and wages
have surpassed even when you add in inflation, which is all a good sign for everybody who's
concerned about higher prices. Now, that still means that it's 4% increase from
last year. So people might think, I don't understand how is inflation coming down? I still
see prices more expensive than they were at that time. Well, think of it as like, if you go from,
I don't know, 60 miles an hour in a car to 45 miles an hour in a car. You're still moving forward, right? But you're moving at a slower pace. And inflation is natural in a economic system. You just don't want inflation to be
too crazy. And obviously with the Trump policies, the way they handled COVID, the way COVID upended
economies across the world and supply chains, we have been in a period of high inflation
that seems to be fading month by
month. We're seeing a lot of positive indicators. Now, we're just going to keep taking away these
talking points from the right today that they love to say. And I know facts aren't going to
necessarily pierce their bubble. They never let the facts get in the way of a good narrative.
But border crossings, just a few weeks ago on the show, we were talking about the Republicans and they were going, there's an imminent invasion. Title 42 is going to expire
and there's going to be an invasion. You're all at risk. Everybody's lives are at risk.
Once again, they go straight to, we need to impeach Biden because the invasion is coming,
folks. The invasion is coming. Well, by the way, because of Republicans and constantly
saying to, hey, we're not in a pandemic anymore. There shouldn't be pandemic powers. And then
Biden's like, okay, well, Title 42 is a pandemic power. It is a national health emergency policy.
It's not an immigration policy. So you know how Kevin
McCarthy, you're cheering on, you saying there's no longer a pandemic. That's fine. But that means
you can't invoke legally Title 42 anymore. So what does Biden say he's going to do? Okay,
let's actually implement an immigration policy as opposed to a emergency orders COVID healthcare policy. They've been
planning for it for a long time and it's actually working better than Trump.
By the way, and Democrats are always also the ones to always put forth a very thoughtful
immigration policy that actually deals with the complexity of our issues. And anytime that even
has a chance of
coming to the floor, they either don't allow it like they did under President Biden, or they
immediately start going to their same talking points of, oh, that's amnesty. And then they
take a very hard line stance that basically all immigrants need to be kicked out of the country.
And so if there is no room for nuance in a very complicated immigration system,
which quite frankly, both parties over the years have really let become a bit of a disaster,
we're not going to get anything done if you're going to take a hard line stance.
And when somebody in the Democrats, which is usually almost always the case, puts forth a
plan that actually deals with the complexities, and then you go in your same crazy Fox talking points, like the issue is never going
to get solved. And that's because of you. They're unwilling to solve the issue because they like to
use it as a political football, but that's not all. Not only were, did I even say border crossings
down 70%? That's the number seven, zero 70%, 70. Yet they still want to impeach Biden over the border.
These people, man. Meanwhile, the murder rate is also down 12% year to date. That's a pretty good
sign. These are all the talking points that Republicans like to spew on a daily basis.
These are all run very counter to their narrative. And also some
good news from the judiciary, President Biden got another judge confirmed, which is always great.
And it's also great when you're able to compare it and contrast it to the previous administration.
We've known the disasters, how big of a disaster these appointment can be and how important they
are when you actually get somebody who is competent in the judiciary. And the Senate voted 50 to 49 to confirm Dale Ho to
be a federal district court judge in New York. That marks number 133, Ben, 133 for President
Biden. At this point, the Democratic led Senate has confirmed 98 district court judges, 34 appeals
court judges, one Supreme
Court justice for Biden. And at this period in time, President Biden is still outpacing Trump
in confirming the judges. As of today, Biden secured 133 judges with the Schumer-led Senate.
For comparison purposes, at the same time, Trump had had 118 through the McConnell-led Senate. So that's 133
to 118. And we definitely have a lot of catch-up to do with the incompetent people,
with the blatantly unqualified people. And it's not just me saying unqualified. The Bar Association
said these people are unqualified to have these jobs. You remember when there were those confirmation
hearings under Trump and the senators would ask him, has anybody here done a trial before?
And there'd be like five potential nominees.
Raise your hand if you've ever been at a trial.
And these are people who Trump had suggested that they be confirmed by the Senate.
These are people he was appointing.
No one raised their hand.
Okay.
Has anybody here sat at a deposition before? And like one person raised, only one person was at a deposition. Okay. Has anybody here sat at a deposition before? And like one person raised,
only one person was at a deposition. Okay. Did you take the deposition? No. Okay. What'd you do?
Well, I helped the partner prepare for the deposition. Again, that's not political.
That's competence. That's competence right there. Yeah. And their whole strategy is always pick
somebody as young as possible who will do your bidding.
That's all they care about because a lot of these are lifetime appointments and they want
to get somebody in there who is going to make the most extremist policies, set the most
extreme landscape possible across the country and be in there for the longest period of the time.
But moving on, another big news. President Biden, it's such a stark contrast the way he uses the
bully pulpit of the presidency compared to how somebody like Donald Trump used the bully pulpit
of the presidency. And President Biden, when he gets up there and gives his speeches,
he often speaks about issues that
people actually have to deal with on a daily basis. And one of the issues that President
Biden has made a big part of the presidency is this whole concept of junk fees. And we all know
from going on websites, whether it's Ticketmaster or whatever, the airline websites, that they often
throw in a bunch of hidden fees that you don't really see
until you get to the very last stage and you're checking out and you're like,
$250 service fee? How is that even possible? But today, there are actually a handful of companies
that announced that they are no longer going to hide their fees from the total ticket costs.
And they cited President Biden as calling them out
to make this change. President Biden has also pushed Congress to pass legislation to sign this
into law. But as of today, you have companies like Concert Giant Live Nation, the mobile ticket
vendor SeatGeek, XBK, Airbnb, the Pablo Center, TickPick, Dice, Newport Festivals Foundation, and others,
all saying that they will no longer hide fees from the American people. That's a big win for
consumers. And one of those things that you probably don't think about on a daily basis,
but when you're in that situation, you're like, oh, this is absolutely ridiculous.
And then a big ruling for Native Americans today in the Supreme Court. I think this
surprised a lot of folks. I think the Supreme Court has made quite a few surprising
rulings. I wonder if they're actively trying to get back in the good graces of the American people
and not trying to seem as extremist as they are. And I'm not going to pretend like they are not
still a problem, but in a major win for Native American tribes, the Supreme Court ruled in a
7-2 decision to keep the Indian Child Welfare Act intact. This act had reversed decades of this
shameful U.S. policy that actually separated Native American children from their families
and tribes. Absolutely disgusting that people on the right would even want to bring a lawsuit to
get rid of this policy. And the fact that you had two justices even dissenting from it.
And I'll let you guys guess who are the two justices who dissented.
Yes, of course, Clarence Thomas and Samuel Alito.
By the way, the justices who Trump and DeSantis say that they want to model their future Supreme
Court justice picks on.
We'll just say that.
Yeah.
So anyway, that's the good news there. A lot to be happy of. And the differences in
priorities and the differences in approach and the differences in how are we going to help people
versus how are we going to hurt people? How are we going to deliver people information that they
need and transparency when they're online and trying to buy tickets for a
flight or a concert, or how are we going to lie to the American people and gaslight them and feed
them false information and get them riled up and angry? There is always such a contrast as we do
these shows. And that's why I think it's so important to show the bad, to make sure that we show the good so that people get the full picture of everything.
I hate when people both sides the issues, but I think it's important to see both sides good and bad rather than both sides of a bad argument versus a good argument.
