If you care about law and order, democracy, evidence, normalcy, well, Donald Trump's latest interview, the Republican Party goes deeper and deeper down the Donald Trump cult rabbit hole. It's astonishing, really. In the latest interview, take for example, Donald Trump cites Vladimir Putin's support as the reason the United States Department of Justice should not prosecute him. Donald Trump says he doesn't know what a subpoena is. I've never heard of the word before.
Starting point is 00:02:34 What's a subpoena? And he says that he can steal documents and do whatever he wants to do. Megan, I can do whatever I want to do. And that was only him getting started in this interview. Also, apparently, MAGA Republicans are only getting started disgracing our nation. Kevin McCarthy announced a sham impeachment inquiry earlier this week against President Biden with absolutely no evidence, and instead basically promoting debunked QAnon-style conspiracy theories about the Biden brand, what they're talking about. Kevin McCarthy launched this impeachment inquiry, we now know,
Starting point is 00:03:22 at the direction of Donald Trump and Marjorie Taylor Greene, and I guess trying to appease the other right-wing MAGA Republicans like Matt Gates. And so Matt Gates responded, not saying thank you, Kevin McCarthy, but by calling Kevin McCarthy a, quote, sad and pathetic man, mocking Kevin McCarthy for having low testosterone, saying that he should star in a low T ad, and calling for his removal. Kevin McCarthy then responded by cursing out Matt Gaetz and other MAGA Republicans, saying, file the effing motion to remove me if that's what you want to do. I mean, seriously, are they capable of, at a bare minimum, just acting like adults?
Starting point is 00:04:16 Lauren Boebert shows the answer is absolutely no. Boebert was attending a Beetlejuice Theater performance in Denver with her new boyfriend, and she could not control her own behavior there. She was so loud and rowdy and out of control. She was kicked out of the theater, kicking and screaming. And she was saying, do you know who I am? Do you know who I am? Yeah. Sadly, we do unfortunately know who you are. There she is right there. Also, Donald Trump filed an Article 78 proceeding in New York. This is a very rare writ proceeding, and he filed it against
Starting point is 00:05:10 New York State Court Judge Arthur Ngoron, who's presiding over the New York Attorney General $250 million fraud case, which is set to go to trial on October 2nd. Donald Trump was seeking an emergency stay so that the summary judgment motions that were filed could be ruled on first, and then I guess give a broader opportunity to prepare after a ruling on those summary judgment motions. Well, the appellate justice in the first department, David Friedman, actually issued a temporary stay order of the trial until a five-justice panel convenes, which should take place fairly soon, to rule on a request for a longer, more indefinite stay in the proceedings. As of now, the October 2nd trial date still appears to be the date when trial will take place, although this could impact that and cause further delay. New
Starting point is 00:06:16 York Attorney General Letitia James says that she's prepared to go to trial October 2nd, but that date is certainly slightly in flux now as a result, I think, of this surprising ruling by the First Department appellate justice. Also, President Biden continues to travel the country to talk about Bidenomics in Maryland. He gave a speech comparing Bidenomics to Manganomics. Manganomics, he explains, means eliminating Social Security and Medicare and tax cuts for the very wealthy. And hopefully those billionaires grace us by trickling down some benefits to the rest
Starting point is 00:07:00 of us. Meanwhile, Bidenomics has led to the lowest unemployment in 50 years. A manufacturing super cycle is underway. Talk about the fastest manufacturing rebound in over 40 years, more than 13.5 million jobs. Real wages are increasing, outpacing inflation, the highest GDP growth in the G7, lowest inflation in the G7, strongest two years in small business applications ever. But there you have President Biden talking about issues, talking about how we can help the American people. Folks, got a lot to discuss on today's Midas Touch podcast. I'm Ben Micellis, joined by Brett and Jordy. It's been a rough one for me today.
Starting point is 00:07:54 My cell phone has not been working today. It had that SOS message that came up early in the morning. I just fixed it before going live. And then I got a barrage, a deluge of about 400 text messages just hit me. So we finally found Ben's Achilles heel, I think is what happened because I have never seen somebody. Too soon, Jets fans too soon, too soon. Apologies to the Jets fans out there, but I have never seen somebody so incapacitated, so decimated, just completely up and destroyed frazzled than when Ben's phone stopped working today. This was a very rough day for Midas Touch Network co-founder Ben Micellus.
Starting point is 00:08:52 And Ben, I'm just so happy that you made it through these tough times. I know I understand the struggle. I understand as a fellow phone addict how difficult it is, especially when your job of delivering people the breaking news runs through that device in your hand. And when that device is bricked, Ben's brain as well. You're so funny, though. You were like, Ben, why does not having a cell phone impact what you're doing? I'm like, because I'm how do you think I'm breaking the news? Well, we have brother Nate for the listeners and the viewers out there.
Starting point is 00:09:31 The brother nature of the Midas touch network really showed itself today. We fell into a lot of old habits with each other. Ben, why did there was a lot of yelling, a lot of scream, all centered around love. I'm just glad. I'm just glad Ben made it through this tragic time and that he's doing okay. And thoughts and prayers, the Midas Mighty is there with you. I hope you are doing all right. But you're bouncing back big, Ben, making the podcast relatively on time.
Starting point is 00:10:00 I think that's pretty good. And we have a lot to talk about. And quite frankly, these podcast episodes with all the news that is flowing in every single day, which really also adds to the stress when you cannot see everything going on with Ben today. hours long and we'd constantly be speaking about new things. So I'm going to turn it over to you, Jordy, because I know we have a lot to discuss, but Jordy, how are you doing today? How are you doing? I know Jordy really wants to talk about the article 78 proceedings and the quasi writ of mandamus in New York. So don't say that a little bit. Don't be a jerk to me just because your phone went out today. Don't even start. I got so much ammo to go with me. I mean, I'm not done talking about the phone. So that's what I'm going to use my 30 seconds for here is y'all. Ben was like a boxer who like took a punch to the face with his phone today and just didn't recover until the 16th
Starting point is 00:11:04 round. So Ben, I'm so happy you made it to the show. I know there's a lot of great information. Okay. One more thing. One more thing. You want to see how also you know how connected Ben usually is on a typical day. I was getting text messages from other people saying, is Ben all right. I haven't heard from Ben. I haven't gotten a response. Like the people were worried. People were concerned about you, Ben. Like you, like after a couple hours, by the way, this wasn't even like at the end of the day, like one hour, no Ben response. And they're like, is he okay? Should I call nine one one? What's the deal? And I'm like, he's fine. The phone is not working, but he's figuring it out.
Starting point is 00:11:43 How do you get two phones? You should just have two phones. Yeah, you got to get a burner. You know, you need a backup. You're an adult. You should have two phones. I got so many. Hey, can you please call me back just to confirm you're okay? We need a proof of life photo, Ben.
Starting point is 00:11:57 Anything, please. Well, I appreciate the love. I appreciate the concern. Back in action. Let's get into it, folks. I want to talk about this interview with the clips being released earlier in the day between Megyn Kelly and Donald Trump. Some context, I think, for that interview in general, right? Donald Trump previously had attacked her back in 2016 in connection with the debates back then. He said really horrific, misogynistic things about her. She was then
Starting point is 00:12:34 basically canceled in the MAGO world. She left Fox, ended up getting a job on, I think, NBC. She was really kind of struggled there in a world where you actually have to, I don't know, try to do an interview that doesn't involve praising a cult. By the way, Ben, if that doesn't tell you all you need to know also about the media and how they operate, their first move, it was NBC, right? They hired Megyn Kelly, paid her an astronomical sum of money, millions and millions and millions of dollars, an absurd amount. And then her show didn't quite work out because that's not what the American people wanted to see. They did not want to be gaslighted by Megyn Kelly on a daily basis.
Starting point is 00:13:24 And so they got rid of Megyn Kelly. They still had to pay her like the 20 some million dollars. Like just move after move. You got to scratch your head and go like, what are you doing? Like, like honestly, what the heck are you doing? Sorry. Well, then you got the perfect example is like this week, new host of meet the press, right?
Starting point is 00:13:45 Okay. The perfect example is like this week, new host of Meet the Press, right? Okay, NBC, who's your first guest going to be to change the tone? Let's get Donald Trump as a guest. That's their first new guest on Meet the Press is Donald Trump. Like, really? What are you doing? So then Megyn Kelly, after not succeeding at NBC, she was like, all right, well, what do I do to get attention again and get supporters back, right? that spews all of the hate and really leans into just the nastiest, nastiest kind of vitriolic rhetoric that divides America. That's where she went rather than let's uplift and help and do great things. And guess what? It's actually pretty successful, right? Sirius gave her a deal for like, I don't know what, like nine, $10 million, you
Starting point is 00:14:45 know, a year. And by the way, you know, if you go and just look at her, it just goes to show you to Brett, like the way corporate America sees things. Like if you look at like her audience and her views, I mean, don't get me wrong. It's, it's, it's, it's okay. But they want to throw serious, I won't just name every corporate, but they all throw money. Hey, let's get her to just say horrible things. Billions of dollars. Let's lose money and pay millions of dollars to someone to divide America. Just terrific. So she does an interview with Donald Trump. And preceding this interview, of course, was the impeachment inquiry announcement by Kevin McCarthy. Preceding this was Donald Trump posting things like, it's all happening even worse than anyone
Starting point is 00:15:39 projected. President Vladimir Putin of Russia is using crooked Joe Biden's illegal banana republic style treatment of his political opponent who is beating him badly in the polls to condemn America and all the good things that one stood for. The whole world is watching as the USA is being torn apart by dreams of election interference. So that's like, he kind of drops these test bubbles too and sees like, okay, so we're cool with Vladimir Putin. And then he kind of leans into it. And as outrageous as that is, it's like, wait a minute. Are you using Vladimir Putin as your defense for why you shouldn't be prosecuted because Vladimir Putin views the United States of America?
Starting point is 00:16:21 It's funny how they always align on messaging. Magan Putin always vary in sync on what to say there and seem to take cues from one another. Trump says something, Putin starts spouting the same thing. Putin says something, all the MAGA people start echoing the same messaging and really on every single topic. But that should also tell you kind of everything you need to know when you look at who are people allying themselves with. And the MAGA movement and Donald Trump and the Republican Party, quite frankly, have firmly put themselves in Russia's camp. They have said these are our friends.
Starting point is 00:16:55 Their disinformation tactics, the way they manipulate the American media to spread hate and disinformation. Let's get in on that. We got to get in on that. And then they create their own disinformation chambers to do the same exact thing that the Russians do. They go, oh, thanks for the help. We're going to run with that. Continue to help us. We'll keep amplifying you on these platforms and we'll work together. We'll collude in this way. How about that? And that's what they do every single day. And then we talked about on the last podcast, like the speech he gave at South Dakota with praising Kim Jong-un.
Starting point is 00:17:34 And I went to my friend Kim Jong-un. You know, he loves to collect his nuclear weapons. He loves collecting them. And then the crowd's like, yeah, you're cheering Kim Jong-un collecting nuclear weapons and threatening. What are you even talking about? You know, and that's constantly what I'm asking here on the Midas Touch. Now we're like, for real, like what? And I'll tell you, I firmly believe, firmly believe the silent majority of America also hears that. And they're like, what? And the reason that this community at the Midas Touch
Starting point is 00:18:15 Network and the Midas Mighty has grown so much is because people have been, you know, you tune on NBC, you turn on ABC, you turn on whatever. You've just watched a speech where Donald Trump has praised Vladimir Putin, attacked Dr. Fauci, praised the insurrectionist, called every prosecutor and judge deranged. And you've left that as just a regular person saying, all right, that was really screwed up, right? All right, let me see what they're saying on the news about it. Donald Trump gave a speech in South Dakota in front of a audience of 7,000 people. The audience gave a rousing standing ovation as Donald Trump used the line that they love the most. Joe Biden, you're fired.
Starting point is 00:19:06 This was yet another round. It's like, okay, what are you talking about? He just is praising Vladimir Putin. And you see how, did you guys see how Meet the Press is promoting this interview with Trump for the weekend? So they released their first clip and their first like breaking news from the interview that they decided to run with is breaking news. Donald Trump says he will not pardon himself if elected president. That's what they're running with. First off, everything the guy This is a guy who a judge and a jury has said raped a woman. Look at who we are dealing with here. And when you look at some of these other kind of cases in horror, when you look at somebody like a Danny Masterson, who was just sentenced to 30 years in prison for his actions, when you look at people like Harvey Weinstein and the consequences that they faced for their actions and the rightful treatment that people view these people with after these judgments
Starting point is 00:20:12 are made. And then you look at Donald Trump, who did many of the same things that these individuals did. And the media wants to treat this man like he is just a normal political candidate. Just, oh, well, are you going to pardon yourself, Mr. Trump? Oh, no. Oh, good for you. He's not going to pardon himself. The whole thing is just absurd. And watching it every day drives me crazy.
Starting point is 00:20:38 And I think there are obviously people who do a really good job. There are a lot of people on MSNBC who I think do a great job and have framed the impeachment in a very great way. At the same time, these networks all tend to do things that just are so baffling that it really makes you scratch your head. And we're going to talk about today, the Bidenomics speech. Biden gave an address, say a big address on the economy, where he trotted out his new branding of MAGA-nomics and talked about the MAGA economic agenda of destruction versus the Biden economic agenda that's seen a lot of great success. And this is how MSNBC presented it. They decided to show the video
Starting point is 00:21:20 of Biden speaking about the economy without sound, without sound, while their panel discussed the ramifications of the indictment today that dropped of Hunter Biden. That's how MSNBC broadcast the speech where President Biden talked about the economy. And then they have the nerve and the next breath to go, I can't seem to understand why the voters, they don't seem to get that the economy is actually doing quite well. Look, all these voters think we're in a recession, but the numbers don't say that. Look, we've had the strongest GDP growth of any G7 nation, but that message just doesn't seem to be making it to voters. That must be a Biden messaging issue. Like, look in a freaking mirror. Why are people reading Animal Farm and think that there's animals in it?
Starting point is 00:22:14 I mean, why? The thing with MSNBC that one thing, Ben, real quick with imagine seeing what went down with the CNN Trump town hall and learning all the wrong lessons from that. It's just such a head scratcher when it comes to a legacy media, like an MSNBC, when they start to play this weird game and it's really all for viewership like that, like that's what they're going for. I think they're competing for ratings on the weekend show with their new talent. And that's why they want this. They, they want this strictly for numbers and that's it. They don't want to give you the information that you should actually know. That's it. They're just going for a ratings grab. It's pathetic. And it's really disappointing from an MSNBC.
Starting point is 00:22:52 What I'm grateful for, the bottom line though, is that their viewers are coming here. Right. So when they do stuff like that, the reality is it reinforces why there is a Midas Touch Network. So I guess on the one hand, when I criticize them, it's like, all right, they're feeding their own destruction. Anyway, I want to get back to Megyn Kelly at the debate asked Donald Trump about Donald Trump's statement that was recorded where Donald Trump says that when you're famous like he is, you can grab women by the, you know, he used the words and get away with it. When you're a star, they let you do anything. And then Donald Trump said that he's a star and Donald Trump boasted about sexually assaulting women. It's on a recording. So Megyn Kelly had the audacity in 2015 to ask him a question about that during a debate and
Starting point is 00:23:53 to ask him about how that he thinks impacts women voters and potential women voters. He then responded by saying later on that she has, Megan Kelly's out of control and that she has quote, blood coming out of her wherever, end quote. That's what Donald Trump said about Megan Kelly. And then Megan, like third grade, like, like who teaches people like third graders don't act like, like the left, like it's disgusting what he says, but also like talks like that. And then the implication, obviously, uh, it doesn't have to be said, but it's that, okay. People know that people, I think people have the implication. Yeah.
Starting point is 00:24:38 Um, and, and, and, and, and then, and then, so then the AP, the big headline coming out of this interview was, Megyn Kelly welcomes Donald Trump back for an interview after eight years. That was the headline by AP. So let's take a look at this interview after eight years. Here, Donald Trump admits that it is retribution why he basically commanded the MAGA Republicans in the House to launch this impeachment inquiry against President Biden with no evidence. Play the clip. Nancy Pelosi, crazy Nancy, said, we're going to impeach him. They didn't do inquiries. They went out and they voted because they had the votes. And as usual, everybody votes for the Democrats. It's a little bit easier. They didn't do inquiries. They went out and they voted because they had the votes. And as usual, everybody votes, you know, for the Democrats. It's a little bit easier. They didn't
Starting point is 00:25:28 have Mitt Romney's of the world. And that's really nice because now he's not running today, as you know, he just announced. I think that's great for the Republican Party, for the country and for Utah. But that's going to be up to them whether or not they want to do it. I have no idea whether they will or not. We do have a lot of other things, but it's quite important. And they did it to me. And had they not done it to me, I think, and nobody officially said this, but I think had they not done it to me, then I'm very popular in the region. They like me and I like them, the Republican Party. Perhaps you wouldn't have it being done to them. And this is going to happen with indictments too, fake indictments.
Starting point is 00:26:05 And I think you're going to see that as time goes by. You're going to see Republicans, when they're in power, doing it. And it's a shame when that happens. I'm not in favor of that, but that's what's going to happen because that's human nature. And just even the subtle things that he says too, not so subtle, the things he says too. And that's so subtle. The things he says at the beginning where he's like, and crazy Nancy Pelosi, like just his whole language is incredibly rude, abrasive, horrific, disqualifying for that position. Next, Donald Trump admits in this interview with Megyn Kelly to the crimes that he's being prosecuted for, saying, I'm allowed to have these documents. I'm allowed to. I could do whatever I want to do here. Play the clip.
Starting point is 00:26:50 We have a deranged guy named Jack Smith who's been overturned at the Supreme Court a number of times, and he gets overturned. You know why he gets overturned? Because he goes too far. They don't even mention the Presidential Records Act. This is all about the Presidential Records Act. I'm allowed to have these documents. I'm allowed to take these documents, classified or not classified. And frankly, when I have them, they become unclassified. People think you have to go through a ritual. You don't. At least in my opinion, you don't. Well, your opinion is wrong. That's a violation of the law right there. And you're not the president. And the Presidential Records Act doesn't allow you to just say, I hereby declare those CIA documents,
Starting point is 00:27:37 those highly classified nuclear... Shazam! Shazam! They belong to me now. They are my personal property. The limited use of the Presidential Records Act involves situations where Donald Trump cites the Clinton socks case all the time. Those were personal notes that Bill Clinton took for an autobiography. If Donald Trump took personal notes for an autobiography, he could then claim them pursuant to the Presidential Records Act as personal. But you don't get to declare nuclear secrets and war plans as owning them, nor have your lawyers made that argument in court yet. Yeah. At one point, Donald Trump's lawyers fairly recently, it seems, told him to make sure that you say whenever you're going to make a crazy ass claim, say it's your opinion. Because in all the recent interviews, he always goes, my opinion,
Starting point is 00:28:40 my opinion is that as if that negates the fact that you're admitting to doing crimes, he started doing it with the election interference thing. And in one of his interviews, he kind of like does it. And then he kind of forgets to do it. But a few interviews ago, I forget even which program this is on. I think it was one of the Fox interviews. He goes, it's my opinion. The election was stolen. That's my opinion. The election was stolen. Now he goes, it's my opinion. Like, just imagine trying to use that in any of those, my opinion, I election was stolen. Now he goes, it's my opinion. Just imagine trying to use that in any of those. My opinion. I could have robbed that bank. I mean, it was my opinion that the fees they were charging were too high. So it was my opinion that I could go in there and I could
Starting point is 00:29:14 steal all the money from the vault. Just my opinion. I guess we just have a different opinion. Free speech. Free speech. It's the most insane thing. And he just sneaks it in. And that doesn't help your argument. And what's unusual about this trial that's going to come up is that he's already admitted to the crimes. I don't think Jack Smith has to do a lot of legwork in proving that he did it. Donald Trump says, I did it. So we could almost move past that step and go to the next step at this point. And the crimes that he's charged with is not the Presidential Records Act. Jack Smith disposed of that stupid argument in one footnote once. What are you even talking about? The Presidential Records Act has nothing to do with this. The criminal statutes do. The violation of the Espionage Act, obstruction of justice, making false statements, those are the crimes.
Starting point is 00:30:13 That's what you've been charged with. You know, Megyn Kelly, though, she's talented. She really is. That's why it's really disappointing to see talented people utilizing their skills for bad things. Like this was actually a good moment of the interview where Megyn Kelly says, so in July of 2021, it's alleged by special counsel, Jack Smith, who claims that he has witnesses. It's on audio recording as well, but the witnesses are all lined up, that say you were showing them war plans of Iran, that these were top secret,
Starting point is 00:30:52 highly classified documents that you were waving around to people who were not authorized to see it and you were not authorized to have it. So what were you waving around at that meeting, which is very specifically referred to in the indictment and the superseding indictment? Play the clip. Why would you be holding up a newspaper saying this is still secret? I'd have to look at it. I could declassify it if I were president. I would have to look at it.
Starting point is 00:31:18 But that's what you told Brett Baier. You told Brett Baier that that was a newspaper or a magazine. I could have declassified. No, I also told Brett Baier, as I remember, I don't know, it was a longtime interview. Will you tell me what were you waving around in that meeting? I also told Brett Baer that it wasn't a classified document. What were you waving around in that meeting? Because it certainly sounds like it was an attack plan.
Starting point is 00:31:34 I'm not going to talk to you about that because that's already been, I think, very substantiated and there's no problem with it. It hasn't been substantiated. Jack Smith says it was the attack plan. And you told Brett Baer it was the attack plan. Let me tell you. here we go again. I'm covered by the Presidential Records Act. I'm allowed to do what I want to do. I'm allowed to have documents.
Starting point is 00:31:54 First off, the way he treats her again is just so utterly demeaning. But the way she's questioning him, and by the way, those are perfectly fair questions. Right. It almost reminds me of how, like if like a teenager who's hiding marijuana and a bong from their parents. Right. And then the parents saying to their, oddly specific. I was thinking the same thing, oddlyly specific here, B. Keep going. Come down to the kitchen, son. Come down to the kitchen, son. So we have some questions for you. We found a bong and some marijuana in your bedroom.
Starting point is 00:32:36 Why did you have that? That wasn't a marijuana. That wasn't a bong. That wasn't. What do you? I'm allowed to have it. I'm allowed to do anything i want to do like isn't that's what it's like i mean it's like what are we watching there what is that
Starting point is 00:32:53 if you have uh additional stories to share we could save that for the patreon after and we could break down that very oddly specific reference. Where'd you, where'd you even hide it? I just, I could, I very rarely, if ever, I don't like weed. It's I don't enjoy weed. I don't, I don't like weed. I don't like it. There's no substantiation that I like presidential records act. I don't like the weed. I don't like the weed. I don't like it.
Starting point is 00:33:26 I really don't. I mean, people think I look high when I do this, but I do not. I know. You didn't inhale. That's all. You didn't inhale. Okay. So let me show you.
Starting point is 00:33:34 Let me show you. Maybe. Let me show you the next clip. I don't. I do this. I do this. Okay. This is Megyn Kelly saying, do you believe...
Starting point is 00:33:45 Just play the next clip. Megyn Kelly says, do you believe that every CIA document that came to you as president becomes yours just because? Here, play this clip. Do you believe that every CIA document that came to you as president was automatically yours to keep no matter what?
Starting point is 00:33:58 I'm not gonna answer that question because... Oh, so that's the dispute. No, no. Because I think it's clear in the document. The Presidential Records Act was a very complex thing that took a long time to do having to do more with richard nixon because he kept everything you know you know that right yeah and they said we don't want to have this anymore so they did this and these thugs and deranged people they didn't even mention that they never mentioned that they never talked about that.
Starting point is 00:34:27 They never said, gee, the Presidential Records Act. Do you know they don't even mention it? And everybody knows that I'm covered by that. So you can't have obstruction when they create. Very sniffly. Like, what are we, what is that? What the freak is that? Here, let me show you the next one. This is Donald Trump citing Vladimir Putin as a defense against his indictments. they go after their political opponent. And other countries are doing that, too. Other countries that don't like us are doing that. They're saying it's a bigger story. They love it because it makes us look very bad. It makes us look very bad. And they're
Starting point is 00:35:14 fake indictments. Fannie Willis and all of these people, these are all fake indictments. They're all fake. Everything's fake. They're fake. Russia's Russia. I mean, look, that interview, what you watched there, again, is not normal behavior. And if you want to show clips like that, if you want to do an interview like that, you have to be prepared to fact check it the way we do it here. You have to be willing to call out that behavior. You just have to say what it is. And that's what we'll do here always on the Midas Touch Network. We got to talk about this sham impeachment as well, because there's so much chaos going on in Capitol Hill, right? Didn't it feel like for a while, where was all the chaos? Well, it's because they were on summer recess. They've all returned and now we've got stories of Boebert vaping in theaters and acting like a maniac and getting kicked out. We've got Marjorie Taylor Greene calling- Like a bunch of freaking maniacs. Yeah, they are.
Starting point is 00:36:26 Marjorie Taylor Greene. Think about the peace and calm over the past few weeks without them. We didn't have these crazy hearings. We didn't have these crazy appearances on TV. It felt nice. It felt nice. We still had drama. We still had legal updates. We still had, sure, plenty of crazy things happening, but the House Republicans, noticeablyably absent and the country felt generally dare i say lighter happier uh better uh and it just goes to show you how much damage they inflict on chaos yeah i want to sue for emotional absolutely you got mac gates coming back yelling at mcc he has low T. I mean, it's just like weird, like WWE freakish behavior, Ben. I like when they fight, though. That's I want to get I want to get into I want to get into those clubs.
Starting point is 00:37:14 But, Brett, you raise a great point, which is during our after show immediately after these podcasts today, I'm going to give you my stories. Starting point is 00:42:23 Thank you, Miracle-Made, for sponsoring this. Welcome back. We're live on slash Midas to treat yourself. Thank you, MiracleMate, for sponsoring this. Welcome back. We're live on the Midas Touch podcast. It is chaos on Capitol Hill. And unfortunately, that means chaos for the United States of America because of the behavior of MAGA Republicans inside the Capitol building, outside the Capitol building. It has real world ramifications on us all. We went from a Congress that was controlled by Democrats in the House of Representatives, where things like the PACT Act and the CHIPS Act and the Infrastructure Act and
Starting point is 00:43:02 the Inflation Reduction Act, important pieces of legislation that actually does things for the American people from the infrastructure projects, 36,000 of them that we see taking place across the country to reducing the cost of prescription drug prices, allowing the government to negotiate cheaper prices as a Medicare negotiator. We're talking about capping the price of insulin to $35 or less per month. I mean, real world benefits taking place. But now we've got Kevin McCarthy and MAGA Republicans announcing a sham impeachment inquiry because Donald Trump told them to do it. And also MAGA Republicans threatening to shut down our government to stop funding it unless there, again, threats, demands, hostage demands are met, just like they did a few and he was going to make this big announcement despite having no evidence of wrongdoing. And they've been doing these investigations now for what, nearly a year.
Starting point is 00:44:13 Like it's been a very long time. We've been covering how horribly the investigations have been going. They've been trotting out these so-called whistleblowers and some end up, oh, look, he died before he could have come. Or, oh, that one, he was actually, he's actually on the run. He's in the spa business and he was actually an indicted fugitive on the run from the FBI. And everyone they trotted, one of them was admitted during the hearing to being paid by Trump advisor, Kash Patel. It couldn't have gone more comically terribly for Kevin McCarthy, but the point of this was never to actually find any evidence. The point of this is to try to tarnish President Biden, to try to harm his approval ratings, and to seek retribution
Starting point is 00:45:00 against President Biden because Donald Trump was impeached and because Donald Trump is currently facing 91 felony counts. So what they want to do, let's be clear, what they want to do is they want voters, not really the voters who are in tune with the news on a daily basis, but the average voter who are fed headlines by the mainstream media and just pick up things here and there. They want voters to go, oh, yeah, sure. I heard about the Trump indictments and the Trump corruption. But look, Biden also, like he's being impeached, right? And so Hunter, you know, Biden, you know, bribery.
Starting point is 00:45:41 So, you know, it's all the same, right? I mean, they're both bad. So I guess I just got to choose, you know, who I think is less bad. I, you know, it's all the same, right? I mean, they're both bad. So I guess I just got, I guess I just got to choose, you know, who I think is less bad. I don't know. Then they're both the same. That's kind of what they want. And first, let me take you back to 2015 because in 2015, when Kevin McCarthy wanted to be speaker of the house, Kevin McCarthy went on Fox and he made a pitch to Sean Hannity about why he would be best as the Republican leader. And here in 2015, Kevin McCarthy completely gave away the game on the purpose of the Republican investigations,
Starting point is 00:46:22 admitting that they were specifically designed to hurt Hillary Clinton's poll numbers. Let me play that clip first, and then we'll get into the rest. The question I think you really want to ask me is, how am I going to be different? What are you going to see differently? I love how you ask my questions, but go ahead. That was one of my questions. Go right ahead. I knew you'd want to ask it. What you're going to see is a conservative speaker that takes a conservative Congress that puts a strategy to fight and win. And let me give you one example. Everybody thought Hillary Clinton was unbeatable, right?
Starting point is 00:46:53 But we put together a Benghazi special committee, a select committee. What are her numbers today? Her numbers are dropping. Why? Because she's untrustable. But no one would have known any of that had happened had we not thought. I agree. That's something good. I give you credit for that. I give you credit for sequestration. I'll give you credit what credit is due.
Starting point is 00:47:14 Okay. So that's an admission right there. And those aren't conservative things that he's talking. Look, I'll be the most conservative. Kevin also takes on this very weird voice, almost as if he is possessed when he goes on these shows. And when you know that he is being a complete BS artist and does not even buy what is coming out of his mouth, the voice is weird. The look in his eyes is just very – The voice is incredibly weird. Just the whole thing is wildly uncomfortable. Like the worst poker player ever. Like the worst. The ever. Like the worst.
Starting point is 00:47:45 The worst. Hi, everybody. And his cheeks are bright red. Like the guy wears his... I've got a really good hand. I don't know. I could be lying. I don't know.
Starting point is 00:47:58 I think that's the thing with his voice too. I mean, he sounds so weird because every time he opens his mouth and speaks, a little bit of his soul leaves his body. I must be. Yeah, I think I think I think that could like an elected official. Yeah, he's got to keep he's got to keep that in. But he can't because he has succumbed to the most extremist members of his party to try to, I would say, keep his power. But the guy is like the most powerless person on the planet. Like who are, what are you really there for? Like, is this what you really dreamed of when you
Starting point is 00:48:31 envisioned yourself as speaker of the house? And he has created this deal. He, he agreed to this deal with the most extreme forces in his party during that marathon night that Ben covered here in the Midas Touch Network, the 15 rounds of voting where he allowed any one single member to invoke a motion to vacate the chair, to then start a vote to kick him out, to oust him from his role as Speaker of the House. So he constantly needs to keep that in mind. So he came out with this whole impeachment inquiry, which, let me tell you straight up also, means nothing. And I'll get into a little bit of why in a second. But he came up with that to appease those MAGA extremists in his party. And he has allied himself very closely with Marjorie Taylor Greene. And this is what Marjorie Taylor Greene wanted. She met with Donald Trump days ago. This is what Donald Trump told her what to do. And she came back to Kevin McCarthy and gave him that update. Donald Trump also has been on the phone with house GOP leaders and people like Elise Stefanik and has told him exactly what he wants them to do. Anytime you hear all this talk about weaponization of the government or this is election interference,
Starting point is 00:49:54 remember their accusations are what they do. Donald Trump, this has been proven, Donald Trump has directed and not just in posts, I was trying to figure out what you call the posts on his network, not just in posts on his social media network, but Donald Trump has literally picked up the phone and told Republicans, you need to impeach Joe Biden. That's why this is happening. Let's get it straight. That right there shows you how BS this all is. Even just a few months ago, James Comer said that he was bragging, oh, look, our investigations, look, they're doing a good job. You see Biden's poll numbers going down. They're doing a good job. The whole reasoning behind this is to try to hurt Biden's poll numbers. And the reason why I said the impeachment inquiry doesn't really mean anything is because they gain no additional power here. Marjorie Taylor Greene is trying to pitch this as some sort of win. Oh, now we get to subpoena. Now we get to subpoena everybody, and we're going to let them know who's boss when we subpoena them, and we're going to get the truth out of them, these evil, fascist,
Starting point is 00:51:05 communist, socialist people. The Marge impression is just like, it's right up there. It's Mark Levin and Marge, Brett. It's like, those are my two favorite for the show. High praise to be compared to Ben's Mark Levin impression. Here's the thing. They have subpoena power right now. They've been subpoenaing people. They've been doing their investigation for months and months and months and have not uncovered a single thing. So they've gained no new authority. Justice, when House Democrats were moving to impeach Trump at the time, the Biden administration is bound by a DOJ policy that says if the House Republicans do not hold a vote on impeachment, then they are not even allowed to cooperate with the investigation at all. And that's because Trump didn't want to cooperate with his impeachment investigation. The Democrats did hold a vote on it. They actually had the votes for it, despite Kevin McCarthy's
Starting point is 00:52:10 lies about that, which we'll see in a few clips shortly. But Kevin McCarthy did not have the votes. And so he came out and he said, I'm going to unilaterally say, it's an impeachment inquiry now. A lot of people though, aren't on board with this. So you have two factions. Now you have people like representative Ken Buck, who's a hardline Republican member of the house freedom caucus who came out today. And he said, there are 20 people, at least in the Republican party, 20 20 members at least who would not vote for this impeachment inquiry. I'll play you this clip first. I'll get to the spending bill in a second.
Starting point is 00:52:53 But you've said that you're against the impeachment inquiry as of now because you haven't seen yet any concrete evidence that shows President Biden financially benefited from Hunter's business deals. Do you think that Speaker McCarthy did not bring it to the floor for a vote? As he said, he would because he was afraid that it wouldn't pass, that people like you might not vote for it. Oh, he knew it wouldn't pass. There are probably more than 20 Republican votes that would not have been in favor of this. He not only did he say he was going to bring it to the floor, but he criticized Nancy Pelosi for not bringing it to the floor when she was impeaching Donald Trump. So he has a long history of what he thinks needs to happen before impeachment. But when you don't have the votes, you don't bring it to the floor. So that's one side of the Republican Party right now, basically acknowledging that this is complete and utter BS. And Representative Ken Buck is absolutely right. Here's a Kevin McCarthy tweet from 2019 when the
Starting point is 00:53:50 Democrats were speaking about impeaching Trump for actual reasons, because they actually had evidence. And here's what Kevin McCarthy wrote. He wrote, this is September 2019. Here are the facts. Speaker Pelosi can't decide on impeachment unilaterally. It requires a full vote of the House of Representatives. Two, the House has voted three times on articles of impeachment. Each vote failed. Three, for Dems, this is all about politics, not about facts. Such utter projection. And he could very well just be speaking about himself here. Even as recently as like a week ago, he went to Breitbart and he told Breitbart that he would only move forward with an impeachment inquiry if he had the votes. That clearly has been proven to be a lie.
Starting point is 00:54:37 So you have people like Buck on one side and more than 20 other Republicans. And then you have the most extreme members of the party, and Ken Buck is no moderate, but you have the most extreme MAGA members of the party, like Matt Gaetz, who are absolutely furious because even they acknowledge that this is kind of a BS action by Kevin McCarthy. So Matt Gaetz came out, Matt Gaetz called it a baby step. He is constantly now going on TV and trashing Kevin McCarthy. And he was on Ari Melber's show last night. And first he said, Kevin McCarthy, he said he is a sad and pathetic liar. Here's the clip. The speaker, he seems to be implying that you are not doing these things for the reasons you say,
Starting point is 00:55:23 but that you were requesting or perhaps through other people requesting some special handling or treatment in the ethics complaint. You're saying that's a lie tonight. That is it. That is an abject lie from a sad and pathetic man who lies to hold on to power. Could you imagine if a single Democrat said something like that about then Speaker Nancy Pelosi? What the headlines would be? Democrats did not have that chaos. Every week with the Democrats, you heard, oh, the House of Representatives just passed the bill to lower insulin prices to $35 a month. Oh, the House of Representatives just passed a bill to ensure that it is legal for women to cross states to get an abortion because Republicans want to ban it. Oh, the House Democrats just passed a bill to stop companies from price gouging on gas prices. These are the kind of stories that you are seeing and the actions and the words that we are seeing from this conference.
Starting point is 00:56:25 But Gates wasn't done there. Gates, after Ari Melber played a clip of Kevin McCarthy, told Ari Melber, I wasn't sure if he just played a clip of Kevin McCarthy or if that was a commercial for low T. All we're trying to do is not impeachment. Nothing to do with impeachment. Let's just answer these questions. Had the president been truthful when he said he never talked to his son about business or never dealt with the reason, never dealt with the criminal case, we would never do this. It's not impeachment. Nothing to do with it. Congressman, the question is, one, is this an inquiry that's going towards impeachment?
Starting point is 00:57:02 If so, what is the high crime or misdemeanor? And is Kevin McCarthy handling this the right way this week or not? I couldn't tell if you cut away to Kevin McCarthy or a commercial for low T, because yesterday's impeachment is somehow today's not impeachment. Good gracious, if we actually have to go make the case against Joe Biden, let's hope we have effective people like Jim Jordan and James Comer making the case and maybe turn off Kevin McCarthy's microphone for a while. You know, it also tells you everything that his example of effective people are Jim Jordan and James Comer, two of like the least effective moronic people to ever have a seat in the House of Representatives. But I'll give them a little,
Starting point is 00:57:45 there's a lot of competition. The whole clip makes me feel gross watching it, honestly, if I'm being totally honest. But imagine, Brett, to your point, and sorry to cut you off here, I'll let you keep going in a sec. Imagine if for one second this happened with the Democrats. Could you imagine what those headlines would be? No. And you constantly got headlines when things were fine with the Democrats, Democrats in disarray. I'm not seeing a lot of Republicans in disarray commentary now from the Beltway media. However, Republicans are definitely in disarray here. And it was a little hard to hear in the clip, but in the clip, McCarthy also kind of tries to have it both ways. He's like,
Starting point is 00:58:21 oh, this is an impeachment. This actually is an impeachment. It's just, and if the Biden administration was just honest with us about Burisma, let's talk about Burisma for a brief second. These are the same allegations that Trump ran with, that Trump tried to get Zelensky to extort. He tried to extort Zelensky with. These are the same exact allegations that Trump actually got impeached over. These have already been litigated. They were already proven false years ago. And Donald Trump was literally impeached for trying to extort Vladimir Zelensky over these false accusations. And now they are rehashing the same stories that have already been debunked. Gates not done there. He took to the House floor and he threatened that he was going to possibly invoke the motion to vacate the chair and oust Kevin McCarthy from the speakership.
Starting point is 00:59:13 On this very floor in January, the whole world witnessed a historic contest for House Speaker. I rise today to serve notice. Mr. Speaker, you are out of compliance with the agreement that allowed you to assume this role. The path forward for the House of Representatives is to either bring you into immediate total compliance or remove you pursuant to a motion to vacate the chair. House Republicans now are playing this bizarre game of fascist chicken where they're each trying to get each other to do what they want to do here. It's a bunch of fascists. And you have Gates threatening that he's going to invoke the motion to vacate. And you have McCarthy getting increasingly angry and concerned about it.
Starting point is 01:00:06 And McCarthy today during a closed door meeting where he was talking about their impeachment strategy exploded at the House GOP caucus. McCarthy erupted in a profanity-laced tirade and he yelled at his caucus that if you want to oust me, then get on with it and move the effing motion. That's what McCarthy said to his caucus. He is absolutely furious about it. And so Gates' response today, Gates goes, Kevin, he's a little unhinged, this guy. I'm not sure it's helpful to have a guy who's this unhinged and off his rocker leading this party. I'm concerned for the speaker that he seems to be a little rattled and unhinged in a time when we need focus and strong effort. Whether or not McCarthy faces a motion to vacate is within his own hands.
Starting point is 01:00:56 You know, I think Representative Dan Goldman of the Democrats really summed it up best. Then going back to what I was saying about Volodymyr Zelensky, when they tried to pull these stunts, when Trump tried to pull these stunts on Ukrainian president Zelensky, Zelensky actually stood strong against him. Zelensky said, no, I'm not going to investigate your political opponent for your false accusations. The Republicans on the other hand, do not have the spine or courage that Zelensky has. And Representative Goldman was very clear about that in this brilliant moment on the House floor. And so why are we going to spend the next few months on a bogus and sham impeachment inquiry? Because Donald Trump wants them to. And Donald Trump has been calling them
Starting point is 01:01:47 and urging them to do it because he was impeached twice. One of those impeachments of Donald Trump was because he tried to extort the president of Ukraine to investigate Hunter Biden. The president of Ukraine refused. Unfortunately, House Republicans don't have the spine that President Zelensky has, and they are now doing Donald Trump's bidding. Powerful words by Representative Dan Goldman. And now you have these House Republicans going on TV and Senate Republicans as well going on TV. And there are many in the Senate GOP that are actually like kind of furious with the House GOP. They are enraged that they are doing this. They see this, you know, and rightfully so as extremely damaging to their electoral chances. This is not a good look for House Republicans who for so long have been beating the drum of inflation and all these other issues. I guess when those issues actually start to improve and are doing better and are under control, they need to pivot to other things. They know that this isn't going to resonate with the voters. So you have various people going on
Starting point is 01:03:00 TV and the ones who still want to try to kind of play both sides. You have like representative waltz from Florida who said that, uh, to Caitlin Collins said the point of the inquiry is actually to give us greater standing to get the full evidence. Listen, you're supposed to get the evidence and then you call for impeachment. You don't use impeachment to get the evidence. When Nancy Pelosi was speaker and she called the vote. They had already had hard evidence linking Donald Trump to these crimes. They had a much shorter period of investigation than this, how these house Republicans had. And then she called the vote once they actually had evidence. That's actually what you're supposed to do. Then you have people like Senator Mitt Romney who said, I haven't heard any allegation of something that would rise to a level of a high crime or misdemeanor. You have others
Starting point is 01:03:50 in the Senate GOP. You have Shelley Moore Capito stated she does not see enough evidence to impeach Biden. You have even Marco Rubio saying that attempts to impeach a sitting president like Biden should generally be avoided for the interest of the country. You have Texas Senator John Cornyn saying House Republicans could investigate without launching a former impeachment inquiry, which is what they've been doing. He then stated that rather than doing something they know is unlikely to end the way they would like, maybe they would like to emphasize other things. So these are the dynamics right now with the Republicans in Congress. Meanwhile, President Biden seems fairly unfazed by it all.
Starting point is 01:04:32 He is staying focused on the job. President Biden responding for the first time publicly during a fundraiser on Wednesday night in McLean, Virginia, saying, quote, Everybody always asks about impeachment. I get up every day. Not a joke. Not focused on impeachment. I get up every day, not a joke, not focused on impeachment. I've got a job to do. I've got to deal with the issues that affect the American people every single solitary day. And I think that really sums up the priority differences here between the Republicans and the Democrats. And I think it's important that the Democrats stay in the fight though. I think you need powerful voices like Dan Goldman. I think you need a powerful pushback here because you can't let them run over you like they did with
Starting point is 01:05:20 Hillary Clinton with their BS accusations back then. You got to put up a fight. But I like to see that President Biden is focusing on the issues. He's not taking the bait of these Republicans and playing into all of it. And let me just paint the broader picture for a second. The Republicans are currently trying to shut down the entire government. The deadline for the government shutdown is September 30th. We are racing towards that date. Every single shutdown, all of them in the past 30 years, have occurred when the Republican Party controlled the House of Representatives. This is only a stunt that they pull when they are in charge. Last time it happened, we saw people at food pantries. We saw an $8 billion hit to the economy. They treat the American people and the people who need these paychecks, they treat them
Starting point is 01:06:12 like pawns in their political game. They treat them like garbage. And the shutdown would result in furloughed workers. Agencies would close. A lot of essential programs that people rely upon in this country would be placed in peril. And this comes right after that standoff that we had with the debt ceiling just months ago. It is ridiculous that Republicans continue to hold the country hostage. It continuously comes from one side, and then they put in poison pills and say, what, we would avoid a government
Starting point is 01:06:45 shutdown if you just let us impeach Biden. That's literally one of their conditions. We need to move forward with the impeachment of Biden if you're going to let us not shut down the government. We need to end all of our funding to Ukraine if we're not going to shut down the government. It's cynical. It's ridiculous. It's designed to make Biden look bad. But at the end of the day, I think all of this are going to backfire on these House Republicans. People see right through it. It is absolute BS. We have a lot more updates to bring you here. Donald Trump suing the judge in the New York AG's case. We got a lot of updates on that. That's a bizarre move. I'm excited to hear Ben's takes on it.
Starting point is 01:07:26 Biden speaking out against magnomics. And Biden also threw out nicknames for Donald Trump, getting in on the nickname game. And I thought they were pretty effective. And Vice President Kamala Harris also embarking on a college tour. All that and more when we get back. We're going to take a quick break. And Lauren Boebert. Oh, and Lauren Boebert getting kicked out of a movie theater. And we have the CCTV footage,
Starting point is 01:07:53 all that and more. Don't you dare go anywhere right after this quick break. We're live on the Midas Touch podcast, Ben, Brett, and Jordy. I think first let's talk about this, I guess you can frame it as a lawsuit that Donald Trump filed against the judge presiding over the New York Attorney General case, Judge Arthur N'Goran. Then let's talk about Lauren Boebert. But then most importantly, let's talk about Bidenomics and I think a very powerful speech that President Biden gave in Maryland earlier. So this lawsuit that Donald Trump filed against Judge Arthur Ngoran, it's really a writ. It looks like it's styled as a lawsuit against the judge,
Starting point is 01:11:54 but that's really kind of just how the caption page is phrased. So it's basically a civil version of like a writ of mandate asking the appeals court, it's an appellate department, the first appellate department in New York, to take some emergency action pursuant to this article 78, trying to restrain the conduct of an official government officer in the state of New York. Here, the official government officer is Justice Arthur Ngoran, the trial judge. You see, the issue is that trial in the New York Attorney General's civil fraud case is set for October 2nd, but currently pending before Judge Arthur Ngoran are two dispositive motions, two motions that could potentially dispose of or change the dynamic of the entire
Starting point is 01:12:47 case, right? On the one hand, you have a summary judgment filed by New York Attorney General Letitia James. On the other hand, you have a summary judgment motion that's filed by Donald Trump. Trump wants the case dismissed. New York Attorney General Letitia James wants Judge N'Goran to make a finding that liability is established so that the only issue to determine is damages. One of the unique things here is that Donald Trump's lawyer, Alina Haba, one of the lawyers, Alina Haba, she failed to check the box early on in the case to request a jury trial. So Donald Trump didn't follow the CPLR, the rules of civil procedure in New York, didn't demand a jury trial and now is whining that there is no jury trial. That's just kind of a separate issue.
Starting point is 01:13:38 He waived the jury trial. Literally, it was a box that she could have just checked saying, Donald Trump hereby demands a jury trial. They never checked that box. But what Donald Trump is saying is, look, we need to kind of, remember we did the video on that one sentence minute order where Ngoran was like, I'm not, this is without merit, entirely without merit. Trump was saying, look, we have a three-week delay period after you rule on the summary judgments so that we can then take an appeal. He didn't say this, but this is what Trump's thinking, take an appeal if we think that the order is incorrect or this way we can prepare for trial. And Nogorin's like, no,
Starting point is 01:14:30 you're going to trial. So this emergency filing with the appellate department is basically saying we need to build in this additional timeframe for summary judgment to be heard and then a period thereafter to prepare for trial. That's kind of the discrete relief. But of course, we know Donald Trump really is seeking delay, delay, delay, delay. So they ran to a judge in the appellate department, and the judge that ultimately heard it said, look, what I'm going to do for now is I will issue a temporary stay of the trial date, but I need this to go before a five-judge panel, a full panel in the first department, and they will hear this. So the way it's being kind of reported on is that Trump won this request for a stay. And that is partially true. It was not denied. The court did grant
Starting point is 01:15:36 a partial stay pending the ruling of the five justices coming together and making a ruling. What most legal commentators feel is that the panel is going to come together fairly quickly. They'll review these issues and they'll make a determination that trial is going to proceed or there can be a three-week delay of the trial, but this isn't a motion to dismiss the case or end the case or stop the case. This is Donald Trump trying to throw up a Hail Mary just to delay the inevitability. This case is going to go to trial. The question is when, and we all expected it to go October 2nd. That's in flux. I can't say for certain it's going to go October 2nd based on what the judge just did in the appellate department, but it's going to go soon. It is a desperate delay tactic, but a delay tactic that seems to at least created some more confusion right now
Starting point is 01:16:46 over when this trial date is ultimately going to be. But ultimately too, part of this kind of Trump playbook we've seen, it's like you waive the jury trial. Because of the waiver of the jury trial, I think it places the case in a very different trajectory to be prepared for trial than it would if there was a jury, right? If there was a jury, Trump's point actually, you know, and I just want to be fair in my reporting, it makes sense, right? Imagine a summary judgment ruling just takes place that will have a major impact on the direction of the case, right? And then that may limit claims or alter claims or change the time period. It's just the reality of it. So then to say, okay, you're going in front of a jury in the next few days, how would you know what your case is to prepare it in front of a jury in the next few days, how would you know what your case is to prepare it in front of a jury? And again, I think Trump's going to lose this case. I think Trump committed crimes. This is a civil case. I think he's going to lose the civil case. I'm just talking as a
Starting point is 01:17:55 litigator, as someone who practices. If a court just ruled on a summary judgment and altered the case dramatically, and then I had to go to trial 24 hours later, that's not a typical thing to occur if there's a jury trial. But because Donald Trump waived the jury trial, the summary judgment presentations before Judge Ngoran, that's basically going to be what the trial is. Sure, you're going to put on the live witnesses, but the summary judgment is basically the sides putting out all of their facts. So what else is in Goron going to need to do? And in terms of in Goron limiting the evidence, he's going to be the trier of fact, not a jury. So it'll be very easy for him to do that and not cause delay or confusion. So I wanted to sort through what's been filed. I'm sure you're hearing a lot of different things about it. The short of it is that it may cause a delay in this, but we don't know that yet.
Starting point is 01:18:55 It's going to go in front of a five-judge panel very soon, and they're ultimately going to rule. But remember, this is a bench trial, not a jury trial. So that's what this rule or this rule 78 motion was all about. Article 78 proceeding was all about. Okay. Lauren Boebert, Lauren Boebert, Brett Jordy. So we've previously reported a lot of police being called on Lauren Boebert very recently, right? I mean, we reported how the police was setting aside this incident in Denver, which, by the way, she hates on Denver all the time. And she talks so negatively about the town that her boyfriend's from or the city where he's from. And he's held a drag queen show at his bar. It turns out he's a bar owner. Like just the hypocrisy here is always just like completely next level. But we've reported here how the police were called on Lauren
Starting point is 01:19:57 Boebert when, uh, or the family's home when her husband was attacking one of her children. And then she got on the phone it was horrific call remember and she said my kid's okay you know there's nothing you need to do here my like she basically acted like her kid was making up the abuse that he called 9-1-1 for that was horrific we did another video on bobert getting a 9-1-1 call of the neighbor because like the bobert family i think her husband and the kids were like driving, uh, like go-karts into, uh, like their mailboxes and like, like 40 miles per hour around the neighborhood. And so the police were called there. If you go back, like Bobert has a very long rap sheet
Starting point is 01:20:39 herself, like very long, like she's been arrested multiple times for really horrific things throughout her life, like 2005, 2010, 2013, 2014, 2016, and failure to show up at court repeated over and over again. had with her husband who she's since divorced that was when her husband exposed his genitals at a bowling alley to minors that was the that that's what made them love each other like that they fell in love over that over that encounter i'm not making that that was the encounter i think that was their first date um where that took place and and and and it's just horrific stuff it's just horrific stuff and It's just horrific stuff. And now we learned that she went with her new boyfriend to the Beetlejuice theatrical performance in Denver. And she was being so loud, obnoxious, and abrasive. Some people reported that she was vaping.
Starting point is 01:21:40 Other people said that that wasn't true. There's mixed reports. Look how many people are in there too just like behaving themselves acting like normal individuals and then the one individual causing chaos in this large theater who has to be kicked out by security escorted to the front door and have the cops called on her is a republican Congresswoman. I mean, how embarrassing. So embarrassing. And then her response that was, well, if you want to get mad at me for just dancing and having a good time, guilty as charged, it's just like, can you behave normal? Can you be the people being here? We say it all the time on the show, Ben. It's like these people, these Lauren Boebert's, the Matt Gaetz's, but specifically also the show, Ben's like these people, these Lauren
Starting point is 01:22:25 Boebert's, the Matt Gaetz's, but specifically also the Boebert's and the MTG, they're unhirable Jim Jordans in any profession. Like think about if you owned a business, would you trust them doing literally anything for your business? No, but yet they're elected officials leading the country. That is some scary stuff. And to your point, exactly, Ben, like she is the only one for our audio listeners. If you haven't seen this footage, head over to youtube.com slash Midas touch or the Midas touch YouTube channel, whatever gets
Starting point is 01:22:54 you there faster. We're showing the footage right now. It is a packed crowd, hundreds of people. And she's the only one behaving like a total maniac, and she's an elected official? That's so, so pathetic. So pathetic. She's not going to win Denver next time, I'll tell you that. Well, yeah. I mean, I don't know how you look at that behavior as a voter in her district and go, this is who I want representing me. This is exactly who I want representing me. Brett, I want to hear from you about Bidenomics versus Maganomics and the speech. The one thing I do want to mention, though, and it's worth mentioning, is the indictment of Hunter Biden on three charges related to false statements and the purchase of a firearm. If you want to know how the hypocrisy of the MAGA Republicans, because of the, let me just read this, what Abby Lowell, Hunter Biden's lawyer said. So let me get this. What changed between
Starting point is 01:23:54 Hunter Biden's plea deal and the charges that were brought today? Not the facts, not the law, just the politics. Don't see what the, and then Harry Littman says, don't see what the fair rebuttal to this is, but that's what's changed. And you want to talk about weaponization. You had the MAGA Republicans all send letters to the judge and put the pressure on the prosecutor. You see how their weaponization actually works. They convinced the guy, the prosecutor, to file whatever charges exist. And the ones that he came up with are three charges related to false statements in the purchase of a firearm, essentially saying that while Hunter Biden was high during a very dark time in his life and he purchased a firearm. And by the way, Hunter Biden admitted to this in his book, right? So it wasn't like, it was like a lot of sleuthing,
Starting point is 01:24:50 like Hunter Biden as part of trying to admit to being a drug addict before and come to terms with himself and what that period was like, talked about it. So that's what they charged him for, that he bought a gun while he was high. And this was a charge that has been found to be held unconstitutional by a court of appeals and federal court. And just shows you the hypocrisy that MAGA Republicans walking around with AR-15 pins on, right? The thing that they want to prosecute hunter biden for is is purchasing a a weapon when he was high once i mean ridiculous ridiculous stuff but that's what they're doing and the way i feel about it is look everybody if you violate the law you should be held to uh account for crimes, period, full stop. I still want to recognize the hypocrisy.
Starting point is 01:25:47 I want to recognize that this is completely out of the norm. No other American, zero zip zilch would be charged with this. Zero. Yeah, I think literally zero people in Delaware have ever been charged under this law. It's not, it's not something that's charged. And I think that's something that Hunter Biden's attorneys are going to bring up. Like this has literally been never charged and we had a, and ever, and we've had a deal. And so what changed? The only thing that changed is that Republicans in the house bullied you on Twitter and in congressional hearings. And so you decided to change what you want to do. I mean, that's what it's going to be. And, and yeah, I mean, the irony of Republicans going after Hunter Biden on gun charges for lying on his gun application, by the way, Republicans have lobbied numerous times to
Starting point is 01:26:41 remove these laws. And now, and now they, this is what they are going after Hunter on. Not only that, but the tax issue. The two things that Republicans are trying to strip away any sort of authority over, guns and taxes, that's what they go after Hunter for. And of course, they're Republicans. They're not like, yes, we got them. They're like, oh, this is also a cover up. This is also a cover up because none of their other things that they have said, like Marjorie Taylor Greene was like, why didn't they indict Hunter for human trafficking? Because that's your fever dream because you made that up because that's your defamatory statement. That's why. They don't just charge people willy-nilly for made-up things that you say. And so Republicans are upset. You had Donald Trump even going on his social media app and saying things like, the prosecutor, David Wise, he was appointed by two Democrat senators of Delaware under the blue slip. No, you appointed him, Donald Trump. He was a Trump appointee. This is from the Trump White House archives. I could pull it up right here. President Donald Trump. He was a Trump appointee. This is from the Trump White House
Starting point is 01:27:45 archives. I could pull it up right here. President Donald J. Trump announces ninth wave of United States attorney nominations and third wave of United States marshal nominations. And right there, if confirmed, David Weiss will serve as the United States attorney for the district of Delaware. Like you can't just lie about these things. So my, I'll let the Republican voters decide, I guess, what you want. Cause there's, it's either one of two things and it could be both, but either Donald Trump has severe dementia and cannot remember a single thing and, and is completely mentally incapacitated. Or Donald Trump is a complete and total pathological liar. It's one of the two. It could be both, but you got to decide which it is because it's not the truth.
Starting point is 01:28:32 Because here's the letter from the Trump White House where Donald Trump himself appointed the guy. And here is Donald Trump lying about it. Yeah, he's lying about everything. Ben, Ben, Ben. You calling me. Yeah. He's lying about everything. Ben, Ben, Ben. You calling me? Yeah. I'm trying to also remember when Hunter Biden, I'm trying to remember when Hunter Biden also led American Middle East policy or held a position in the government that's in any way relevant to this. I mean, Hunter Biden's a private citizen. One person did remind me, hey, didn't Hunter Biden many, many, many years ago before any of this hold a board position on Amtrak appointed by Republican, appointed by George W. Bush? And to that, I said, you know,
Starting point is 01:29:18 I guess that is a government position like 20 years ago. I mean, it was a long time ago, but that actually does show for everybody who was saying he has no board experience. That kind of also rebuts another MAGA Republican talking point that he sat on. And I think he sat on two very important boards. He sat on the Amtrak board and he also sat on the United Nations food board, which was responsible, the UN Food Aid, which has like a $3 billion budget. And he did that very successfully. So it's not like Jared Kushner, who had no experience at all running an investment fund, all of a sudden getting $3 billion. And of course, also the other distinction with Kushner is Kushner held a government position, one that
Starting point is 01:30:03 we didn't elect him to. Anyway, Brett, tell us about Bidenomics versus Manganomics. Well, let me get into one thing real quick and not that we have to show it just real quick, just real quick. So the Megyn Kelly interview, not that we have to rehash that, Brett, but this is to your point, just to show you that Trump is totally mentally incapacitated. It's scary. When they bring up Fauci, the guy just totally has Fauci amnesia about how he handled this. We're not going to play any more clips. So if you want to go, we have a story up on MidasTouch.com. Definitely check out MidasTouch.com where all things news
Starting point is 01:30:36 and breaking news and pro-democracy goes to live. We got to work on that slogan. But during that interview, during that interview, Fauci was brought up. How did you handle the Fauci situation? And just weird that they're even continuing to bring up Fauci, that Megyn Kelly is digging into the archives there and pressing him on Fauci like it's this big controversial thing. I guess if you're a MAGA Republican, it is. And Ben, to your other point about Biden serving on those boards, the MAGA Republicans don't deal in facts. They just deal in inflammatory talking points. So whatever's going to hit the headline the hardest, they'll just roll out like it's true. And so anyway, back to the Fauci point real quick,
Starting point is 01:31:11 they bring it up and Trump just totally forgets how he handled the situation, the role, the achievements that he gave Fauci. It's all so pathetic. Yeah. Megyn Kelly asks him point blank, why did you give him an award? The accommodation. Yeah, why did you give Dr. Fauci this award? You gave it to Dr. Fauci, you gave it to Dr. Birx. Why did you give it the award? And he's like, I didn't.
Starting point is 01:31:36 I mean, I don't know who did that, actually. I don't know. I didn't do that. I don't know who did that, actually. I don't know who did that. Actually, I don't know who did that. And like you did it once again. We have the proof right here from your own website. President Trump awards presidential commendations to Operation Warp Speed Team. Jared Kushner got an award. Why the fuck did Jared hear Kushter getting the word in? Kushter, man. Dr. Deborah Birx, Dr. Anthony Fauci.
Starting point is 01:32:06 He's out here giving presidential awards to his son-in-law and to Dr. Fauci. And then he's asked about it by Meg Kelly. I don't know who did that, actually. I don't know who did that. It's crazy. And just to show you also how far down the rabbit hole Republicans are, I'll hit on this super quickly. But the FDA on Monday approved this reformulated COVID vaccine that targets the new sub-variants. And they're recommending everyone six months and older protect themselves and get the vaccine that helps against the new variants.
Starting point is 01:32:35 And I'm sure a lot of people now also know a good amount of people who are getting COVID. It's going around. So this is a booster that you want to get. And so what do the Republicans do? You have DeSantis issuing an order, warning residents under 65 in Florida, telling them not to take the vaccine. Not even like, do whatever you want. It's a free state. Get it if you think it's best for you. Talk to your doctor.
Starting point is 01:33:02 He's saying explicitly, do not get the vaccine if you're under 65. It is dangerous to your health. That to me is absolutely criminal, especially when you note that Florida literally leads the country in new COVID hospitalizations, leads the country. And when you have all these studies that look into excess COVID deaths, when you look at Florida and Ohio during the first 22 months of the pandemic, it found the excess COVID death rate of Republican voters was 15% higher than that of Democrats. And that gap exploded once the vaccines came out because a lot fewer Democrats were dying after that fact. And a lot of Republicans were continuing to die. The body count continued to rise
Starting point is 01:33:51 because they refused to take the vaccine. It's just so dangerous. And all for what? All for votes? You're going to kill people? Let's be real about what DeSantis is doing. He's killing his own citizens for votes and he can't even get votes because no one even likes him anymore. And then he's killing his own voters for votes. So the math there doesn't even probably equate to what it really is. And he's doing it with people's lives, not to sound callous about it. It's very sad. Everything is stupid in the Republican administration.
Starting point is 01:34:52 It was like the one thing they actually got through was giving these bailouts to billionaires and giving them a whole bunch of money through their failed PPP program, making cuts to social safety programs like social security and Medicare. The Republicans now want to eliminate Medicare's ability to negotiate drug prices. I mean, that was something Trump literally ran on until Trump had a meeting with the pharmaceutical lobby and then reversed course on his decision. But that was actually one of Trump's big platform planks in 2016. And Biden actually got that done and it's going to help a lot of people. And they also want to remove the $35 cap on Medicare for Medicare recipients on insulin, like just things that are outright going to hurt people. So then you look at Bidenomics, which we currently have the lowest unemployment in 50 years. We have this new manufacturing
Starting point is 01:35:43 super cycle, which is the envy of the world. It's the fastest rebound to manufacturing in over 40 years. You have more than 13.5 million jobs added when Trump is one of two presidents to actually lose jobs during his presidency. And Biden was very quick to take note of that. I'll get to that in a second. You have real wages increasing, which is outpacing inflation, the highest GDP growth in the G7, the lowest inflation in the G7, the strongest two years in small business applications ever. You have a lot of good economic news coming out of the Biden administration. I'm not going to pretend like everything's perfect because it's a hard time out there for a lot of people. Inflation
Starting point is 01:36:20 has hurt a lot of people. But I think when you compare it, as Biden says, compare me to the alternative, not to the almighty. And when you compare him as well to literally every other country in the world, you look at the G7 and you go, wow, out of every country, the United States actually has the lowest inflation. Out of every country, the United States actually added the most jobs since COVID and has far surpassed the amount of jobs that were in the country before COVID. I mean, those are important data points to me. And so a couple moments that stood out to me from this Biden speech today was when Biden brought up the fact that Trump constantly would refer to himself, and this is real, but he would refer to himself as the king of debt.
Starting point is 01:37:09 That's a legitimate thing that Trump would refer to himself as. And Biden goes, he's not just the king of debt. Trump is the emperor of debt. I'll play this clip for you. When it comes to reducing debt, so let's compare the records a little bit. Under my predecessor,
Starting point is 01:37:27 you remember the self-professed king of debt? Well, it turned out he was. He's actually the emperor of debt. He created more debt than any other president did in one year. No, I'm serious. For starters, when he passed that $2 trillion tax cut, skewed to the wealthy and big corporations, they didn't pay for a penny of it. The end result was that it has ballooned the national debt by nearly 40%.
Starting point is 01:37:49 Over a 200-year accumulated debt, it ballooned it by 40%. Well, I've taken a different approach with the help of your delegation. And I'm not being solicitous when I say that. You have the best delegation in the country. And that's not just because my whole family's from Baltimore. Look, we just cut the budget deficit by a hundred. We, they, helped me cut the deficit by 160 billion dollars. 160 billion. You know how we did it? By giving Medicare the power to negotiate for lower prescription drug costs. You know, I'm excited to see Biden out there talking about his accomplishments,
Starting point is 01:38:38 to see the vice president out there talking about her accomplishments and the accomplishments of the administration. It's important for people to see that. And that's why I get so annoyed, frankly, when you have those moments and the media talks about Hunter while they show just the footage of President Biden. I think it's completely a disgrace. This was one of my favorite moments, though, when President Biden brought up the fact that Trump was one of just two presidents to leave office with a loss of jobs and came up with a new nickname for Trump, Donald Hoover Trump. In fact, only two presidents in American history with fewer jobs the day they left office than when they started. One was President Hoover and the other was Donald Hoover Trump. Seriously, only two presidents in American history.
Starting point is 01:39:33 And look, you may remember my predecessor promised to be the greatest job president in history. Well, it didn't really work out that way. He lost 2 million jobs over the course of his presidency, 2 million. We've created 13.4 million new jobs. We not only recovered all the jobs we lost during the pandemic, we've added millions more. We've seen record lows in unemployment, particularly, and I've focused on this my whole career, particularly for AfricanAmericans and Hispanic workers and veterans. You know, workers without high school diplomas, the lowest unemployment rate in 70 years for women now. You know, by the way, when I got elected, I promised I wanted an administration that looked
Starting point is 01:40:16 like America. I got more women in the cabinet than any president has ever in history. I got more women, more women than men in the cabinet. And when you look at the actual jobs numbers, like on a chart, it really hammers home just the crazy disparity in what presidential administrations are better for the economy. I saw this chart. I thought this was absolutely stunning. If you're listening, I recommend you go check out the visual for this on the YouTube page. But you have here that only 4%, and this graph really does a great job at hammering it home, only 4% of the 49 million jobs created since 1989 occurred under Republican presidents, 96%, 96% of the jobs added in the United States
Starting point is 01:41:11 of America since 1989 occurred during democratic administrations. I mean, that is just an absolutely stunning, stunning, stunning, stunning statistic. I want to show you before we finish up here, I just want to show you the reception that Vice President Kamala Harris got today. She was at Hampton University and you keep having a lot of these columnists come out and they go, she needs to leave the ticket. And they like coordinate to like get these messaging and they don't see the actual excitement that certain groups have for her and that a lot of Americans have for her, especially Gen Z audiences. And here, when she went to the college, here was first the crowd outside to set the scene,
Starting point is 01:41:52 the line waiting to see her. And then I just want to quickly show you the absolute party that was happening inside as these students were waiting for Kamala Harris to speak. I want to be here. This looks like so much fun. Big democracy energy at Hampton University. And brothers, I think we covered a whole lot here. I think we hit all the bases. You know, I want to thank the Midas Mighty for being here.
