Donald Trump continuing his whining tour across the United States of America,
showing up at the New York Attorney General's civil fraud trials closing arguments. This was an 11-week, 44-day trial. New York Attorney General Letitia James is requesting approximately $370 million in
disgorgement damages. Before the trial even commenced, New York Attorney General Letitia
James prevailed on summary judgment, meaning that the judge has already found that for purposes of
the dissolution cause of action that New York
Attorney General Letitia James was seeking, dissolving Trump's business entities, that New
York Attorney General Letitia James prevailed on those claims. The judge ordered the dissolution.
So what this 11-week, 44-day trial was all about was the money, disgorgement damages, as well as
additional remedies such as permanently banning Donald Trump from ever engaging in real estate
in the state of New York again.
That is something New York Attorney General Letitia James has requested.
New York Attorney General Letitia James has also requested a five-year ban from Don
Jr. and Eric Trump from doing anything having to do with real estate in the state of New York.
Again, let me show you before Donald Trump entered the courtroom for closing arguments today,
Donald Trump did that same whiny press conference that he normally does.
By the way, you could see him here in court. But before that, he did that whiny press conference
where he attacks the judge, attacks the city, attacks New York Attorney General Letitia James.
Take a look at Donald Trump just throwing an absolute fit before closing arguments.
Then I just want to discuss what he's saying. And let's just go kind of point by point and just show
why what he's saying is so utterly false and just so completely whiny. Here, play this clip.
And we're going through it, but it is indeed a terrible witch hunt. We're going to have a news
conference a little bit later on. As you know, I want to speak. I want to make the summation.
At this moment, the judge is not letting me make the summation
because I'll bring up things that he doesn't want to hear.
And it's a very unfair trial. Nobody's seen anything like this.
I don't think they've ever seen anything like this.
We have a situation where a statute was used that doesn't give me a jury,
so I have no jury. I really have no rights, and nobody thinks it's constitutional. Legal scholars are writing about it like it's something they shouldn't be allowed. So I am hoping to speak and to help my lawyers reveal all of the defects of this case that should have never been brought.
Very, very strong financial statements.
They thought it was the opposite.
They had no idea because I'm a private company.
Then they saw them knock their socks off.
They couldn't believe it.
But great financial statements.
Everything is good. We have a level of detail
in our defense that nobody's ever had. This is a case that should have never been brought,
and it was brought. And it's very unfair, and it's very bad for New York State. Companies
are fleeing. People are fleeing. The streets are crack-ridden. And Letitia James, all she
thinks about is get Trump. She's been dreaming about it for years. And Letitia James, that's all she thinks about is get Trump.
She's been dreaming about it for years.
And it's not the way a state should be run.
Because this is a state that's been in big trouble.
You have all the businesses fleeing and yet the people fleeing.
The people that pay taxes.
People that don't pay taxes are coming in.
So that's not what you want.
So I want to thank you. We're going to have a news conference today.
We don't know the time. We'll notify you. So you hear there Donald Trump saying this is a witch hunt.
The judge won't let me speak.
Donald Trump says no one's ever seen anything like this. He whines and says that I have no rights.
I have no rights.
He says it's interference.
He says this is political interference. He says he
has a strong balance sheet. And he says, because of this case, people are fleeing the state of
New York. They're fleeing New York City, which is, of course, absolutely false. With respect to this
issue of Donald Trump, a party to a case, delivering closing argument, I just want to be very clear
that that is against all of the rules in the state of New York and in states across the United
States of America. The law is very clear. If you are a party to a lawsuit and you are represented
by lawyers, meaning you're not representing yourself, your lawyers
give the closing argument.
That is what the rules are.
If you fire your lawyer, so if Donald Trump fired Chris Keis and Alina Haba, then the
rules would say, okay, then you can give a closing argument or you can represent yourself
throughout the trial.
But you're represented by your lawyers now, so your lawyers are the ones who do the work.
That's what the rules say.
Despite that that's what the rules say, the judge, Justice N'Goran here,
when Trump's lawyer requested Trump give the closing argument or a portion,
Justice N'Goran, who's presiding
over this case, said, I will allow it. I will exercise my discretion and I will allow Donald
Trump to give the closing argument, to give the summation, which you just heard Donald Trump say
he's not allowed to give. But the only condition, the judge said, is Donald Trump has to agree that his summation,
that his closing argument follows the same rules and guidelines that any lawyer who were
to come before this court would have to follow in their closing arguments.
And all Justice N'Goran said is, I just want Donald Trump to confirm on the record
before he gives the closing argument
that he understands that he has to follow the same rules
in delivering that closing argument
that you, Donald Trump's lawyer, would give,
that the New York Attorney General lawyers would give,
or any litigant before this court would have to follow.
If he understands that, he's free to give a closing argument,
to which Donald Trump's lawyers said that's very unfair.
No, we are not okay with that.
To which Justice N'Goran responded,
well, the fact that you're saying that you're not okay
with following the most basic rules that everybody has
to follow in every single court tells me that I was right to require that the rules be confirmed
by you and Donald Trump before giving the closing argument. So once again, I will give you a
deadline because courts have deadlines. Let me know if Donald Trump will
follow the rules that everybody follows in court, and then he can give the closing argument to which
Mr. Keis, Donald Trump's lawyer, complained and said, again, this is unfair. So then Judge
Agoura said, well, then he's not giving the closing argument. If you don't follow the rules,
you're not giving the closing argument. So what if ordinary people,

And by the way, just so you can see it with your own eyes,
because I think it's important that you know what the data is versus,
oh, this is just one perspective or there's lots of perspectives.
Christopher Kice sends an email to the court and says, Happy New Year.
At this time, the defense anticipates that closing arguments will take approximately
two hours, two hours and 15 minutes total.
I will present the more extensive argument and then Ms. Haba and Mr. Robert will also
present more limited arguments.
Additionally, Donald Trump
plans to present argument at closing as well, but we anticipate all such arguments will be completed
within the above time estimate. Okay. So then there's a response by the New York attorney
general's office objecting to that, citing the New York statute, which says under CPLR, if any party, quote,
appears by attorney, such party may not act in person in the action except by consent of the
court, CPLR 321A. So they're not allowed to do it unless the court says you can do it. So then what
is, and by the way, I'm very confident that Donald Trump knew
that because Donald Trump always wants to play the victim. I don't think, I think his lawyers
advised him of what that New York law said. That's very well known. And Donald Trump always wants to
put himself into a position to whine and play the victim, right? So Judge N'Goran then responds to Trump's lawyer, just putting in
that Donald Trump is going to testify. And here's what Judge N'Goran said.
In the email to which this email responds, Mr. Keiss, Trump's lawyer, announced that defendant
Donald J. Trump plans to present argument at closing. Pursuant to CPLR. That's, that's the rules of
procedure 321 quote. If a party appears by attorney, such party may not act in person
in the action, except by consent of the court. Mr. Trump obviously appears by attorney,
meaning he's represented by Chris Keiss and Alina Abba. Thus, and as far as my research has revealed, whether he may present a
closing argument is completely at my discretion. Particularly in a non-jury trial, I am inclined
to let everyone have his or her say. Moreover, the more reasoned analysis I receive, the better I
will be able to decide this case correctly. Furthermore, Mr. Trump is the person with by far the most at
stake in this enforcement action. Thus, in my sole discretion, I will consent to let Mr. Trump
make a closing argument if and only if through counsel by January 9th, 2024, and by himself
personally on the record, just before he speaks, he agrees to limit his subjects to what is permissible in a counsel's closing argument.
That is commentary on the relevant material facts that are in evidence and application of the relevant law to those facts.
He may not seek to introduce new evidence.
He may not testify.
He may not comment on irrelevant matters. In particular, and without limitation, he may not deliver a campaign speech, and he may not impugn myself, my staff, plaintiff, plaintiff staff, or the New York State court system, none of which is relevant to this case, and all of which except commenting on my staff can be done and is being done in other forums. If Mr. Trump violates any of these rules,
I will not hesitate to cut him off mid-sentence and admonish him. If he continues to violate the
rules, I will end his closing argument and prevent him from making any further statements in the
courtroom. If he violates the current gag order against him, I will immediately direct the court
officers to remove him from the courtroom forthwith and will fine him
not less than $50,000. Finally, he must state on the record before he begins to speak that he also
understands that without exception, defendants collectively have only from 1015 to 1245 with
one 15-minute break to present their arguments, meaning that whatever time he speaks is time
that other defense attorneys will not have.
Plaintiffs will also have two hours and 15 minutes from 2.15 to 4.30 to present closing
arguments.
Mr. Kice, kindly respond.
And then Kice responds, Justice Ngorong, thank you for your response and proposal below.
And he says, first, I agree that this is as a non-jury trial,
your inclination to let everybody speak. Then he goes, however, he, Donald Trump, cannot agree,
nor would I recommend him to do so to the proposed preconditions and prior restraints.
That's what Christopher Kai says. He's not going to do it. Then in Goran responds, you and your clients' rejection of the reasonable, normal limits
I am imposing on any argument by Mr. Trump, which are the same limits the law imposes
on any person making a closing argument, completely justifies the needs to have them in the first
place.
And then Christopher Kai goes and complains about how
Justice Ngoran, this is very unfair. You're not allowing President Trump, who has been wrongfully
demeaned and belittled by an out of control, politically motivated attorney general to blah,
blah, blah. I mean, that's why I say it is a whining tour across the country. And everything
that Donald Trump says is a lie.
I have a strong balance sheet.
No, you don't.
If you had a strong balance sheet, then why would you have to say that your 10,000 square foot penthouse was 30,000 square feet?
Why would you have to say that your buildings were fully leased out when they were rent controlled and they were not fully leased out. Why would you have to say that Mar-a-Lago was a residential property to inflate the values when you had previously executed deeds saying it was forever intended to be used as a commercial property as a club so you could pay less property taxes?
Why have you engaged in persistent and systemic fraud and to the point where your
so-called experts that you brought in? Oh, and by the way, when you said, oh, the statute's never
been brought before, the expert who you had testified, testified in another case utilizing
the statute under the New York attorney general's authority, which has been used before and has been
used with some regularity before as well. And then your expert
has to say that your fraud actually were just mistakes and basically typos that you made.
It's just so pathetic. And I want to go back to how I started this video. For me, it's just the
whining. It's this whining, weak whining tour. And I think we're starting to see people just
discuss that. Like this guy just goes around the country, claims he's a billionaire, and then just
whines about how unfair things are to him. Pull yourself up by your bootstraps, you freaking
treasonous traitor. Come on, what are you talking? Whiny, just so whiny. Anyway, Donald Trump's tantrum right there.
