Starting point is 00:02:02 The rest of the week, it's The Mighty. Do you remember the name Ty Cobb? No, I'm not talking about the Hall of Fame baseball player who set 90 MLB records during his career. I'm sure there's another podcast for that if you want to learn more about that. I'm of course talking about Donald Trump's mustachioed ex-attorney who was part of the Trump administration legal team and represented Donald Trump during his first impeachment. But these days, Ty Cobb isn't so quick to come to Donald Trump's defense. In fact, during a recent interview, Cobb slammed Trump as a deeply wounded narcissist incapable of change.
Starting point is 00:02:40 And Cobb said Trump's attempts to overturn the 2020 election are criminal and that he should be disqualified from office. Our legal expert and Midas Touch co-founder Ben Micellis brings you the story. I'm Ben Micellis from the Midas Touch network. Donald Trump's former White House lawyer, Ty Cobb, who represented Trump in connection with the Mueller investigation, has some not just harsh words for Donald Trump, but believes that Donald Trump should be criminally prosecuted. Let me just take a step back there. Donald Trump's former White House lawyer, Ty Cobb, who, by the way, is a fairly respected person within D.C. legal circles who represented Trump to the chagrin of many during theb here, but shows that Ty Cobb had other situations with Trump where he found that he shouldn't be criminally prosecuted. But
Starting point is 00:03:51 unequivocally, Ty Cobb, Trump's former White House lawyer, I just have to say it over and over again, believes that Trump should be criminally prosecuted. Now, not only that, but he shares it publicly now. He just went on a podcast called The Takeout, which is hosted by Major Garrett, who used to be on Fox, who's now with CBS. And unequivocally here, let's play the first clip where he says that Trump committed a them, could be an offense well worthy of prosecution. Sure. Well worthy of prosecution. But if, as I suspect— This is about January 6th. Yes, that is about January 6th.
Starting point is 00:04:37 I think that's much different. I think that was the first time in American history that a president unconstitutionally attempted to remain in power illegally. And I think that is from your vantage point, prosecutable and should be prosecuted. In my own in my own view and and their constitutional practitioners and scholars who agree or disagree. I believe that is that would merit prosecution. And for the audience, you can't get more clear than that. And here's another clip where he talks about Trump engaging in criminal conduct, especially related to Vice President Pence.
Starting point is 00:05:17 Play this clip. Which is exactly, as you acknowledged, how I feel. You know, I don't think the big lie. That's that, and this is this. Right. I don't think the big lie, interfering with Pence, you know, saying Mike deserves this when people are shouting, kill Pence. Right. I think that's outrageous. what the vice president, you know, was obligated to do, trying to, you know, persuade him in very
Starting point is 00:05:49 aggressive and personal efforts to not not to certify the election and to send certain electors back. I think that was I think that was criminal. And one of the things that Ty Cobb is advocating for here in this podcast, you know, again, former Trump lawyer, former White House lawyer in the Trump administration, what he is advocating for is that Section 3 of the 14th Amendment, which would disqualify someone from holding office who engages in insurrection, would disqualify them the same way we saw that happen recently with the guy in New Mexico who was an insurrectionist disqualify them the same way we saw that happen recently with the guy in New Mexico who was an insurrectionist named Coy Griffin or something like that, who was involved in the insurrection, was disqualified from being the Otero County Commissioner out in New Mexico,
Starting point is 00:06:37 and a lawsuit was brought there. Ty Cobb is calling for Trump to be disqualified. He's saying it's clear he violated the 14th Amendment. He gave aid and comfort to insurrectionists that he should be held accountable. Here, play this clip. And what is it about the president's personality that made him impenetrable to Barr's assertions, his own legal counsel's assertion, his own campaign's assertions. What is it about him that couldn't hear that? Abject narcissism. And the wounding.
Starting point is 00:07:15 Since he couldn't believe that he actually lost. Right. He doesn't believe he lost. I believe that. And do you think he ever will? Well, I think in some aspect he knows he did, but not in the aspect that penetrates his public persona. Do you think he will run again? So that's a very interesting question, and that brings me back to another sort of obstacle that I see to the healing of America. There is a simple way to disqualify President Trump. He clearly violated the 14th Amendment of the Constitution, Article 3,
Starting point is 00:07:58 when he gave aid and comfort in three hours of inaction with regard to what was happening on the Capitol and sent out the equivocal email about Pence suggesting that Pence had failed. That clearly gave aid and comfort to the insurrectionists. Under Article III, giving aid and comfort to the insurrectionists means, after a joint declaration by the House and the Senate, a majority majority only. And it doesn't require 60 or 67. You're disqualified. You're disqualified forever from ever running again. You know, I disagree with Ty Cobb on a lot of things and a lot of issues.
Starting point is 00:08:37 But here there's unanimity here, you know, amongst level headedheaded individuals who follow the law, who observe what Trump did and go, that is criminal. That is dangerous. He is an insurrectionist. It's not a close call where Donald Trump's own lawyer from the white house who defended him during the Mueller investigation, defended him there were lots of people, including me, believe that Donald Trump should be prosecuted for all of the conduct he engaged in there, including, by the way, in the Mueller report, which was completely mischaracterized by Bill Barr, and where Mueller had this convention that you shouldn't prosecute current presidents, but otherwise believe that a prosecution was merited. And then Bill Barr killed the investigation. But setting all that aside, this is someone who defended Trump during that
Starting point is 00:09:30 time period. And he goes, Trump's a criminal. Trump's an insurrectionist. Trump's own lawyer is saying that. Here you have the clips of it. Pretty incredible stuff. And this was just at the end of last week, again, on this podcast, The Takeout with Major Garrett. You could watch or if you want to listen to the whole interview, you could listen to it. What you'll find if you listen to the whole 45-minute and 18-second interview is the guy's a fairly right-wing person. And a lot of stuff that I heard when I listened to the full 45-minute interview, I was like, come on, man, really? It was hard to listen to the full interview. But here, fundamentally, he and I and mostly all people who want to follow the law and follow the Constitution are saying, look, Trump needs to be prosecuted for
