So Stormy Daniels' new lawyer, Clark Brewster, has told CNN that Joe Takapina, the lawyer who's basically made a fool of himself, purportedly representing Donald Trump in connection with the Manhattan District Attorney's Office, a criminal investigation of Donald Trump, did in fact have communications with Stormy Daniels dating back to 2018, which Stormy Daniels' new lawyer, Clark Brewster, has turned over to the
Starting point is 00:01:59 Manhattan Prosecutor's Office. We previously discussed this here on the Midas Touch Network that Joe Takapina on a CNN appearance in 2018, when he was asked about Stormy Daniels, he mentioned on this appearance that he couldn't really talk much about it on air. He said that Stormy Daniels had consulted him on a confidential basis and that he believed that that consultation constituted an attorney-client relationship based on New York State Bar Rule 1.18, as well as the American Bar Association's corresponding Rule 1.18, which says, even if you are not formally retained to represent a client, a consultation for a prospective client establishes an attorney-client relationship whereby you have to keep your communications confidential and whereby you can't necessarily represent someone who may be adverse
Starting point is 00:03:02 to the prospective client who you represented or who you thought you may be representing or advised about potentially representing during that consultation. And in this specific circumstance, Joe Takapina now representing Donald Trump in connection with the Manhattan District Attorney's Office criminal investigation in 2023. The Trump representation would be adverse to a prospective client consultation with Stormy Daniels that took place in 2018. I want to show you the clip right now of Joe Takapina on the CNN interview back from 2018, where Takapina admits it. Takapina says, look, I can't get into this information because I had a consultation with Stormy Daniels, so I have to keep it confidential. Here, play this
Starting point is 00:03:54 clip. So before being represented by Avenetti, Stormy approached you about representation. Did you get any impression that she may have signed the NDA under duress, and was she afraid of her physical safety? You know, of course, I can't really talk about my impressions or any conversations the impression that she may have signed the NDA under duress? And was she afraid of her physical safety? You know, of course, I can't really talk about my impressions or any conversations we had because there is an attorney client privilege that attached even to a consultation. But what I will say to that is, is without hearing from her attorney any further details regarding who that physical threat was made by, it's really hard for us to sit here and say it's Trump or it's Trump's people. And by the way, while we're at it, in 2018, Takapina also had an interview with CNN where he basically threw Trump under the bus in 2018,
Starting point is 00:04:35 or not even throw him under the bus, told the truth in 2018. 2023, Joe Takapina is the MAGA lawyer, make attorney, get attorney lawyer. But back in 2018, when Takapina is the MAGA lawyer, make attorney, get attorney lawyer. But back in 2018, when Takapina wanted to actually tell the truth, Takapina said that based on the information he had seen, Trump could be in very big trouble. Just for to refresh your recollection, watch 2018 Takapina play this clip. Once that net is out, once the microscope is on you, everything is fair game. And it's hard to argue, oh, you can't look at this or you can't look at that. So yes, if there's an issue with that payment to Stormy Daniels being that it was made on behalf of the candidate, okay, and it was not declared, that's fair game, unfortunately, if that's the case.
Starting point is 00:05:20 And quite frankly, Michael Cohenhen again um has made statements that would give rise to suspicion for any prosecutor to say that doesn't make sense that a lawyer took out a home equity loan with his own money paid somebody that he didn't even know on behalf of a client who by the way had the wherewithal on the money to afford 130 000 and by the way didn't tell the client about the settlement agreement. It's an illegal agreement. It's a fraud. If that's in fact the case, you can't pay with it, pay a client settlement with your own money. You can't make a settlement to bind your client without him knowing about it. So how could he say that? Now, if that's true, he's got some problems and the agreement's a fraud and null and void. If it's not true, then where did the money come from? Mr. Cohen was not being honest. Where did the money come from? If it leads back to the Trump
Starting point is 00:06:08 campaign funding, that's a big problem. This is a Pandora's box that's going to be opened and unfortunately is not going to have any good results for the president. Now, Takapina in typical MAGA lawyer fashion is, I don't know, just saying a bunch of nonsense. His response to the news that Stormy Daniels, through her new lawyer Clark Brewster, is turning over these communications that took place between Takapina and Stormy Daniels. Takapina basically says, well, when I was asked that question back in 2018 on CNN, I was lying. I was just saying that to CNN because I really didn't want to even answer the question. So I just wanted to deflect the question. That's why I said that there was a attorney-client confidential relationship that was established with Stormy
Starting point is 00:06:57 Daniels. What? That makes absolutely no sense at all. I mean, the fact that Takapina said that there was an attorney-client relationship established based on a consultation with a prospective client back in 2018, the fact that there are email communications with Stormy Daniels, by the way, that's enough. And if Stormy Daniels believes that consultation now constituted an attorney-client relationship, you don't need a retainer agreement. You don't need a contract with a prospective client. The mere consultation could constitute and form this confidential relationship where it would be an ethical violation to now represent someone who is adverse
Starting point is 00:07:40 to Stormy Daniels, which is exactly what is taking place here. Look, I want to show you now what Michael Cohen said on the Political Beatdown, the podcast that I co-host with Michael Cohen. And Cohen had a message for Takapina, like, what in the world are you doing right now? Because you clearly don't know the law of holes because you just keep on digging. And Cohen really looked at the camera during political beatdown and said, do you see what happened to me? How after what you saw happened to me, what I went through, what I've had to go through, you are going to then literally make the mistakes that I have been trying to warn people about here. Starting point is 00:08:31 your license? You have any idea the hardship that I am going through on a daily basis, the hardship that I've put my family through because of my stupid loyalty to a guy who never deserved it. Could you imagine, right? I mean, how much shit that I've had to endure as a direct result of, again, my loyalty to Donald. And this is what you want to do. So where are we right now? Well, the Manhattan District Attorney's office is going to review the communications that were handed over by Stormy Daniels. I guess the interesting part about it is after seeing how horrible Takapino has been on the various interviews he's given on Donald Trump's behalf over the past few weeks, to some extent, if Takapino is disqualified from representing Donald Trump, that may end up actually being a
Starting point is 00:09:27 good thing for Donald Trump because, I mean, Takapina would be doing a horrible job. How could that person that we saw try to grab the paper from Ari Melber's hand, the person who was literally, I think, admitting that Donald Trump engaged in more criminal conduct. That's the individual who's going to be representing Trump. One consequence of violating this ethical rule is disqualification. If a court ultimately finds that the prospective client relationship established this confidential relationship such that he can't represent someone with an adverse interest, That's one possibility. He gets disqualified. He gets walled off from others in the firm. His whole firm could be
Starting point is 00:10:12 disqualified from representing Donald Trump. And there may be broader issues. I don't know if Stormy Daniels is additionally going to file a complaint with the New York State Bar, similar to how state bar complaints were filed against Rudy Giuliani and Jenna Ellis and Sidney Powell and other Trump lawyers. But then there could be serious consequences potentially with Takapina's law license if indeed it is determined that there is an ethical violation that took place, again, there's no finding that that's taken place. But if indeed there is a prospective client relationship, if indeed there was confidential information that was improperly provided to Donald Trump, that would be very problematic. Obviously, no one knows what specifically took
Starting point is 00:11:03 place, but we do have what took place on CNN and what Clark Brewster, Stormy Daniels' lawyer, is saying publicly about the situation, that there are these documents that were turned over to the Manhattan District Attorney's Office. And I mean, look just what's happening with Donald Trump's lawyers throughout the country as well. I mean, you've got Evan Corcoran and Jennifer Little. You got them in Washington, D.C., federal court where the Court of Appeals as well as the D.C. federal court have basically found, basically they have found, that the crime fraud exception applies to their communications with Donald Trump, that Donald Trump was using them to commit ongoing crimes like obstruction of justice. They've had to turn over their notes. They've had to turn over their audio.
Starting point is 00:11:56 Some of them took audio notes as well. And so, you know, everything in Trump's orbit is collapsing right now all at once. And yet you still have someone like Takapina saying, sign me up. I will never understand it, but I will be here with all of you Midas Mighty to expose it.
