We can confirm that the information received from the individuals questioned by police earlier in the Empire case has in fact shifted the trajectory of the investigation, said Guglemi, who did not elaborate further. Starting point is 00:31:52 And so, you know, he's declaring a national emergency at the border and people are all on a tis because they're saying it's unconstitutional. And I'm watching a lot of the experts. And first of all, you people don't know what the National Emergencies Act is. I'll just give you a quick history. Enacted in 1976, the United States federal law passed to end all previous national emergencies and to formalize the emergency powers of the president. The act empowers the president to activate special powers during a crisis,
Starting point is 00:32:23 but imposes certain procedural formalities when invoking such powers. The perceived need for the law arose from the scope and numbers of laws granting special powers to the executive in times of national emergency. Congress can undo an emergency declaration with either a joint resolution, and they're probably going to try that against Trump, and he's going to veto it, and the president's signature, or with a veto-proof two-thirds majority vote, which ain't going to happen, powers available under this act are limited to the 136 emergency powers Congress has defined by law. The legislation was signed by Gerald Ford after he did a backflip off a table and banged his head on September 14, 1976. As of February 2019, 59 national emergencies have been declared, more than 30 of which remain in effect. I'm listening to the experts on this on TV,
Starting point is 00:33:10 and a lot of them said he didn't have to make a big deal about this. He didn't have to declare a national emergency. There's like four or five provisions in the bill where he could have got the money. where he could have got the money. There's only one part of the declaration about actually building the wall. He would have had trouble getting the money, but he has the right to grab money
Starting point is 00:33:35 from other agencies and funds. And if he did that without doing this, he would have come up with $4.5 billion, which is like they said, a stone's throw from the six he was asking for. We'll go to the Ninth Circuit. We'll lose there. We'll go to a appellate court. We'll lose there. And then we'll go on to another thing, probably lose there. And they'll go to Supreme Court. We'll win.
Starting point is 00:34:33 Like when he had the ban on people coming into the country. But he's probably right. Again, I have to wave to my boy, Alan Dershowitz. These people are Mark Levins of the world that know the Constitution. But I know his main job as president is to defend this country. Of course, the left is saying, what crisis? You're making it up. You're making it up, and they're saying,
Starting point is 00:34:54 they keep bringing this up, which made me laugh the first time I heard it. They're going, most of the drugs that are coming through are coming through the legal ports of entry. Okay, but you don't keep statistics where there's no borders or no fences. So you don't know what you don't know,

It's like saying the TSA stops the most terrorists coming through. Yeah, they're the only ones attempting to stop them. You don't know what's coming through the place where there's no border or no fence.

Starting point is 00:36:44 in the 2018-2019 United States federal government shutdown, in response to the refusal of Congress to appropriate the $5.7 billion that Trump requested, declared a national emergency on February 15th. Trump's declaration was unprecedented in that none of the 58 previous emergency declarations involved circumventing Congress to spend money it had expressly refused to authorize. Well, let's go to a smart guy. This is one of the senior advisors for Trump. He's my favorite. I call him dead eye Stephen Miller. This guy's got the eyes of a serial killer and he's got the brand. He's like super smart. But he was on with Chris Wallace and his
Starting point is 00:37:23 Chris Wallace questioning Stephen Miller, who's a senior adviser to Trump and his way I said about the declaration. Well, as you know, when George Bush came into office, illegal immigration total doubled from six million to 12 million by the time he left office. That represented an astonishing betrayal of the American people. And I'm not going to sit here today and tell you that George Bush defended this country on the southern border because he did not. going to sit here today and tell you that George Bush defended this country on the southern border because he did not. One of the biggest changes that's happened since then and now is the mass release of illegal aliens due to a patchwork of court rulings and loopholes in our federal laws and changing tactics from smugglers and transnational organizations. I don't want to go into all of this, but I mean, let's just focus on that one issue. Four times as many people were coming across the border in 2000 as now.
Starting point is 00:38:05 So why is that a natural emergency? Back then, 95% could be turned around in a matter of days. Exactly. As a result of loopholes, activist judicial rulings, and increasing sophistication from cartels, the reality is that more than half of people crossing the border are what we call non-impactable. They can't be turned around. And so what you see is sophisticated operations and smugglers will actually push out migrants and children and family units to divert border agents. And then because there's not secured areas with the wall, they'll then cross after the border agents have been diverted to those areas.
Starting point is 00:38:37 That was the first clip, right? He was addressing crossings being, they love to throw that in the crossings, it's down since 2000 and blah, blah. Yeah, because it's a whole different ballgame now. You set foot in, there's by the way, there's an immigration lawyer telling you what to say.
Starting point is 00:38:52 You set foot in there and then you can claim asylum and then we can't just turn around and go get the fuck out of here. Then he addressed the drugs through the ports of rent, which I just talked about. But here's basically what I just said.
Starting point is 00:39:06 But Chris, the problem with the statement that you're apprehending 80 or 90 percent of drugs at ports of entry, that's like saying you apprehend most contraband at TSA checkpoints at airports. You apprehend the contraband there because that's where you have the people. That's where you have the screeners. I assure you, if we had people of that same density and screeners of that same density across every single inch and mile of the southern border, you'd have more drugs interdicted in those areas. You don't know what you don't know. You don't catch what you don't catch. Exactly. And then finally on the they addressed the constitutionality of it. He didn't get that deep into it again. That's why I want to hear from Dershowitz. But here's what he
Starting point is 00:39:43 said about that. President Trump wants to do a clear violation. Violation. Founders of what James Madison talked about is giving Congress the power of the purse. No, because Congress in 1976 passed the National Emergencies Act and gave the president the authority as a result of that to invoke a national emergency in many different circumstances, but among them for the use of military construction funds. And that was the point I was making earlier, is that if the president were to say we're going to use military construction funds to, say, increase the perimeter around a base in Bagram, around a base in Syria, nobody would even say anything about it. We have 4,000 troops on the border right now, and as a result of that mission, they need
Starting point is 00:40:21 to secure those areas where they're patrolling. But let's talk about national emergencies. National emergencies have been declared 59 times since 1976 when the law was passed, the National Emergencies Act. Can you point to a single instance, even one, where the president asked Congress for money, Congress refused to give him that money, and the president then invoked national emergency powers to get the money. First of all, can you find out one case? What you're missing, Chris, is that the national emergencies don't all have the same authorities and the same justification. I understand that, but there have been 59.
Starting point is 00:40:55 Can you find one case like that? This authority specifically refers to the use of military construction funds. Other emergencies, for example, were declared to promote... Wait, wait, wait. I mean, if you want to talk about military constructions, do you know how many times military construction has been invoked as a national emergency? Twice. Twice. Right. Twice. Once by George H.W. Bush during the middle of the Gulf War and the second time by George W. Bush right after 9-11. This is hardly comparable to either of those. Can you name one foreign threat in the world today
Starting point is 00:41:28 outside this country's borders that currently kills more Americans than the threats crossing our southern border? You know, the joy of this is I get to ask you questions you don't get to ask. Then answer my question. Can you name one case where a president has asked Congress for money,
Starting point is 00:41:46 Congress has refused, and the president has then invoked national powers to get the money anyway? Well, this current situation... Just yes or no, sir. The current situation pertains specifically to the military construction authority. I'm just asking. Has there been a case where Congress asked for money for military construction, Congress said no, and he then... The meaning of the statute, Chris, is clear on its own terms. If you don't like the statute, or members of Congress don't like the statute...
Starting point is 00:42:10 Would you agree the answer is no? There hasn't been a single case like this. But the premise of your question is also false, because Congress has appropriated money for construction of border barriers consistently. This is part of a national security mission. But it has never done this under a national emergency where President... So what? We declared a national emergency to promote democracy in Belarus, to promote democracy in Zimbabwe. But it didn't entail taking money that Congress refused to appropriate.
Starting point is 00:42:32 But they didn't refuse to appropriate it. They passed a law specifically saying the president could have this authority. It's in the plain statute. That's a decision that Congress made. And if people don't like that, they can address it. Again, I wait, Alan Dershowitz. But that's the part where it mentions actual military funds.
Starting point is 00:42:55 Supposedly that's, and Congress said no. That's the part they refused. So that's why he's doing the end run. But he could grab from those other parts of the bill money that would have added up to a little under six bill or whatever the fuck. I don't know why all of us who voted for him just don't send him five dollars. He could build a thousand foot wall made of diamonds.

The boy, a student at Lawton Charles Middle Academy in Lakeland, Florida, was charged with disrupting a school function and resisting arrest without violence on February 4th. He's 11 years old. When he told her he believed the flag was racist and the anthem was offensive, Alvarez said, the fuck's wrong with you, bitch? No, Alvarez asked him why. Why, if it was so bad here, he did not go to another place to live. Oh, my God. I love this teacher.

The student also allegedly called school leaders racist, threatened to get the school resource officer and principal fired, and beat up Alvarez because it's in his DNA. He denied threatening to beat the teacher in an interview. Oh, he's a liar, too.
Starting point is 01:11:25 He was later seen giving Jussie Smollett a handjob behind a dumpster at the PS-122 school. Polk County Public School spokesman Kyle Kennedy insisted that the boy was not arrested for failing to stand for the Pledge of Allegiance.
