Sup, you beautiful bastards.
Hope you have a fantastic Monday,
even though I know a ton of you for, you know,
very legitimate reasons had to call in sick this morning.
But welcome back to the Philip DeFranco Show.
Buckle up, hit that like button,
and let's just jump into it.
And the first thing we're gonna talk about today
is this story that just blew up over the weekend,
and that is a story involving Johnny Depp and Amber Heard.
Because right now, they are in a vicious
he said, she said legal battle,
both claiming physical and emotional abuse against the other. All right, so Johnny Depp and Amber Heard, because right now they are in a vicious he said, she said legal battle, both claiming physical and emotional abuse against the other.
All right, so Johnny Depp and Amber Heard
married back in 2015, but by May of the next year,
Heard filed for divorce, citing irreconcilable differences,
and notably in that filing, she said, quote,
"'During the entirety of our relationship,
"'Johnny has been verbally and physically abusive to me.
"'I endured excessive emotional, verbal,
"'and physical abuse from Johnny,
"'which has included angry, hostile, humiliating,
"'and threatening assaults to me
whenever I questioned his authority or disagreed with him.
And adding, Johnny has a long-held and widely acknowledged
public and private history of drug and alcohol abuse.
He has a short fuse.
He is often paranoid,
and his temper is exceptionally scary for me
as it has proven many times to be physically dangerous
and or life-threatening to me.
Johnny's relationship with reality oscillates
depending upon his interaction with alcohol and drugs. With that we also saw Heard submit
images of herself with bruises on her face. A few days later
she then applied for and was granted a restraining order against Depp. Then in August of 2016 TMZ released a video of Depp throwing a
wine bottle, also a glass. This is Heard stands nearby, you can hear him yelling. Also after this Heard denied that she was responsible for leaking
the clip. Ultimately what we ended up seeing happen then was later that month
she and Depp reached a divorce settlement with her receiving seven million dollars. With a note here being that Heard denied that she was responsible for leaking the clip. And ultimately what we ended up seeing happen then was later that month, she and Depp reached
a divorce settlement with her receiving $7 million.
With a note here being that Heard announced
that she would be donating that entire amount
to the ACLU and the Children's Hospital of Los Angeles.
So after some more back and forth with attorney fees,
the divorce was finalized in January of 2017.
After that, this story seemed to go quiet for a while.
But then in late 2018, we see things start again.
First, October 2018, while speaking with British GQ,
Depp said, quote,
The thing that hurt me is being presented
as something you're really as far away from
as you could possibly get, you know?
Following that, we saw Heard's attorney telling Page Six,
Mr. Depp is shamefully continuing his psychological abuse
of Ms. Heard, who has attempted to put a very painful part
of her life firmly in her past.
One need only look at the physical evidence
to draw the proper conclusion.
Following that, in December of 2018,
Heard wrote an op-ed in the Washington Post titled,
"'I spoke up against sexual violence
"'and faced our culture's wrath.'
"'That has to change.'"
And in that op-ed, Heard never directly mentions
death by name, but says, like many women,
"'I had been harassed and sexually assaulted
"'by the time I was of college age, but I kept quiet.
"'I did not expect filing complaints to bring justice,
"'and I didn't see myself as a victim.
"'Then two years ago, I became a public figure
representing domestic abuse and I felt the full force
of our culture's wrath for women who speak out.
And around that, Heard then went on to say that her role
in a movie had been recast, that the global fashion brand
had dropped her, and that there were doubts
that she'd be able to keep her role in Aquaman.
And this is mentioned because Depp's team
has largely accused Heard of making the allegations
to quote, advance her career and extend
her 15 minutes of fame.
Now, following a few days after that op-ed,
Depp was dropped from any future
Pirates of the Caribbean films.
You know, and just prior to that, in November,
the second Fantastic Beasts movie had come out
and there was massive social backlash.
This over Depp's casting as Grindelwald.
Right, but then after that, January of last year, right,
2019, we begin to see something interesting
start to take shape.
And this because Depp's attorney reportedly told E! News
that they had filed a partial list of evidence
that we will use to disprove the fraudulent
underlying allegations against Mr. Depp.
And saying that list included dozens of videos,
security tapes, eyewitness statements,
and sworn affidavits and deposition transcripts from 2016.
And by March of 2019, Depp sued Heard
for $50 million in a defamation lawsuit,
with that lawsuit alleging that it wasn't Heard,
but rather Depp who was the victim of abuse.
That lawsuit also blaming Heard's op-ed
for him being dropped from Pirates of the Caribbean.
Heard then filed a motion to dismiss that complaint,
but was later denied.
Following that, Depp then submitted a declaration
of support for his lawsuit, with that letter alleging
that Heard had actually painted on her bruises.
Depp also saying that Heard caused him
serious bodily injury, that she was abusive
while on a mix of prescription amphetamines
and non-prescription drugs with alcohol, saying that she had hit, punched,
and kicked him and frequently threw objects
into his body and head, including heavy bottles,
soda cans, burning candles, television remote controls,
and paint thinner cans, which severely injured him.
Depp also submitting his own set of photos
showing bruises on his face, as well as a photo
showing a partially severed finger that he said he suffered
after asking Heard to sign a post-nuptial agreement.
Heard then allegedly got so mad,
she started throwing bottles at him with Depp,
claiming that one exploded when hitting a countertop,
ripping off the tip of his finger in the process.
And notably there, Depp also alleged
that Heard put him through emotional abuse,
saying that at one point, she or one of her friends
defecated in his bed as a prank.
So during that time, Heard responded with more photos
of her own that allegedly shows bruises,
also a clump of hair she says was ripped out.
But all of that then brings us to the reason
we're talking about this today.
There is audio that has now been published
by the Daily Mail where we hear an exchange
between Depp and Heard.
And I watched you lie and then I-
I didn't punch you, by the way.
I'm sorry that I didn't hit you across the face
in a proper slap, but I was hitting you.
It was not punching you.
Babe, you're not punched
don't tell me what it feels like to be punched because you start physical fights
because you start physical fights I did start a physical fight yeah you did so I had to get
out of there yes you did so you did the right thing the big thing the you know what you are
admirable every single time what what's your excuse when there's not a physical fight?
What's the excuse that you're still being admirable, right?
Just by running away?
And you can sit here and call me names, but you get called a name and what do you do?
That's the last insult!
The argument then continues for several more minutes until we hear this.
Because I love you and I do not want to leave you. I do not want a divorce. I do not want
you out of my life. I just want peace. If things get physical, we have to separate.
I can't promise you that I'll be perfect.
I can't promise you I won't get physical again.
God, I sometimes get so mad I lose it.
I can promise you, I mean, you know,
do everything to change.
Right, so in that we hear Heard admitting
to starting fights and hitting Depp in that audio.
That audio has also been confirmed by Depp's lawyer
as having been a conversation from 2015.
Notably there, we saw Depp's lawyer say,
"'The first confessional tape she made
"'reveals a conversation any real abuse victim
"'will recognize all too well.
"'It exposes that Ms. Heard perpetrated
"'serial violence against Mr. Depp
"'and then concocted an elaborate abuse hoax
"'to cover it up.
"'Ms. Heard gives a motive for her violence.
"'Mr. Depp always trying to quote split
"'to escape her abuse.'" Now on the other side of this, Heard's a motive for her violence. Mr. Depp always trying to quote, "'Split' to escape her abuse."
Now on the other side of this,
Heard's lawyer didn't outright confirm or deny the video
or audio, but said in a statement to USA Today,
"'The fact that a woman fights or talks back
"'does not mean that she has not been the subject
"'of repeated domestic violence and abuse.
"'It is a myth to say, as Mr. Depp apparently is implying,
"'that if Ms. Heard slapped him,
"'then she can't also be a victim.
"'That is just not true.'"
Now as far as the public reaction to this,
so far it really does appear that there is a massive
swelling of support for Johnny Depp.
We saw justice for Johnny Depp trending,
people trying to share the photos, the new audio.
We're also seeing things like a Change.org petition
for Amber Heard to be removed from Aquaman 2
that has over 104,000 signatures as of recording this video.
But yeah, I mean as far as what happens from here,
we're gonna have to wait and see.
Right, does this continue to build up?
Does more come out here?
Does it follow the trend like we've seen of past instances
where all of a sudden the other side releases something
or says something?
Yeah, with that said, I'd really love to know your thoughts
on this whole story, the new developments, let me know.
And then let's talk about it.
It's finally happening, the Iowa caucuses.
Honestly, there was something about the last year
of democratic campaigning that it just felt like four.
Yeah, all of this is supposed to start at 8 p.m. Eastern tonight at over 1600 sites.
Results are fully expected to be in at around 11 p.m. Eastern time.
And so one, this is gonna be interesting because we're finally getting to the voting portion and this kind of just sets the stage.
But also two, while it was already gonna be interesting to see who got the most votes,
given the nature of a caucus, it's gonna be very, very interesting.
So if you've never taken part in a caucus,
it's not like just a regular vote.
As FiveThirtyEight.com explains,
they're showing up at a place
like a high school gymnasium at 7 p.m.
and physically forming preference groups.
All the Elizabeth Warren supporters
stand at one corner of the room
and all the Joe Biden supporters in another, for instance.
Voters may also join in an uncommitted group.
They explain this is called
the first alignment of voter preferences.
So right at the top,
it feels like it's kind of
a basic vote, but it's all public.
But then as FiveThirtyEight explains,
voters in candidate groups that fail to meet
a viability threshold in the first alignment,
as they explain typically 15% of the vote,
but it can be higher in smaller precincts,
have one of three choices.
They can join a viable group.
They can try to combine with voters in other
non-viable groups to achieve viability.
As they explain, for example, if the Warren group
initially has 14% of the vote,
it's not necessarily dead in the water.
Rather, it could recruit a few Tom Steyer votes
or Michael Bennett supporters, et cetera, to get to 15%.
However, it can't recruit voters from groups
that already achieved viability.
That's because once a group is viable,
it can continue to add new voters and grow larger,
but it can't lose them.
Or they could just go home.
Nothing forces them to participate
in further rounds of caucusing.
That last option, in my opinion,
is gonna be one of the most interesting numbers to see.
And that is because there's this poll
that's been going around where people were saying,
who do you support?
Would you support another candidate
if your person didn't win?
And then seeing the varying percentages
of those who would not support.
One of the biggest standouts were Yang supporters.
Right, and then ultimately you get to the final count
in these caucuses.
And I personally have zero clue
who's looking like the winner here.
I think that might be in large part due
to Democratic voters being somewhat freaked out.
There's this really interesting piece put out by the Daily, or rather the Field.
They were talking to Iowa voters and you could just see how many people were at battle with themselves.
Kind of bouncing between who they personally supported as a candidate and then also supporting
someone they think that maybe is more electable in other states.
Right, when I see that and I hear that and there are a lot of people I feel like that
are voting not so much for a candidate as much as pretty much anyone but Trump, it feels like it
might be the prime opportunity to have ranked choice voting. Right, at the very least in a
primary, right, this is the person that I want, but if not them, this person, if not them, this person.
At the very least, a system like that might help against the idea of, okay, well, I like this person,
they probably have no chance. Right, for example, on the Democratic side, that's definitely been a
thing said about Andrew Yang constantly.
Then you could be like, well, if my dream candidate
didn't do it, then this person, this person.
Whereas with the way that the Iowa caucuses work,
you have to kind of try and make educated guesses.
Right, because for the candidates who get over 15%,
we don't get a chance to see who they might vote for
if their person wasn't nominated.
But also, I'm going off a little on the tangent,
that's the situation, we're gonna see what happens tonight,
we're gonna see what happens in several states
in the following weeks and months.
And I guess, here we go.
Question I'll attach to this story though is,
who do you think is going to come out on top?
Who do you think should come out on top?
And then let's talk about news and updates
regarding the coronavirus, which I really hope
that this is a general understanding
for everything we talk about,
but especially with this story.
Don't just hear one thing and then tune everything out.
Try and listen to the whole piece.
So today the World Health Organization chief said that
in China there have been 17,238 confirmed cases
and 361 deaths, as well as 151 confirmed cases
and one death in 23 other countries.
And there, that one death was reported by the Philippines
yesterday and marks the first time that there was a death
from this virus outside of China.
But at the same time, the WHO chief also reportedly said
that there are very few cases outside of China
and that, quote, panic and fear
were the real challenges here, adding,
"'It's no reason to really panic now.
"'The chances of getting this going
"'to anywhere outside China is very low,
"'and even in China when you go to other provinces,
"'it's very low.'"
And also saying that there were no need for measures
that unnecessarily interfere
with international travel and trade.
Right, and this is something
that the World Health Organization has repeatedly hit
over and over the last few days
as more and more countries ramp up travel restrictions.
The US, for example, has already implemented
some of the strongest measures outside of China.
On Friday, the Trump administration declared
a public health emergency.
That announcement was made by Health and Human Services
Secretary Alex Azar, who said that the risk
of contracting coronavirus in the United States was low,
but added, we are working to keep the risk low.
With that declaration, Azar also announced
that all foreign nationals who had been to China
in the past 14 days will be barred
from entering the states starting Sunday.
Although notably there, those restrictions do not apply
to immediate family members of US citizens
and permanent residents.
Azar also saying that US citizens who have been to Wuhan
or the province Wuhan is in over the last two weeks
will be subject to quarantine for 14 days,
and that US citizens who have been to other areas
of mainland China in the last two weeks
will be subject to screening for 14 days as well. Now, after that announcement, China and the US citizens who have been to other areas of mainland China in the last two weeks will be subject to screening for 14 days as well.
Now, after that announcement,
China criticized the US response
with a foreign ministry spokesperson reportedly saying,
"'Just as the WHO recommended against travel restrictions,
"'the US rushed to go in the opposite way.'
Certainly not a gesture of goodwill."
But also of note there, the United States
is not the only country to impose travel restrictions.
According to reports, Australia, Singapore, and New Zealand
have implemented similar travel bans on foreign nationals
who have gone to China.
Other countries like Japan and South Korea
are denying entry from foreigners
who visited the province Wuhan is in.
Italy and Israel have reportedly stopped
all incoming air traffic from China,
while airlines all over the world have also announced
they will not fly to or from the country right now.
Russia, which we mentioned last week,
had closed its Far East land border with China,
is now saying it might deport foreigners with coronavirus.
North Korea and Mongolia, which also share borders with China
have sealed them entirely.
But notably here, Hong Kong,
which is an autonomous city state of China,
which also shares a land border with the country has not.
This despite calls to close the border
from pro-democracy protesters, hospital workers,
businesses, and even some pro-government lawmakers.
Especially as the number of coronavirus cases in Hong Kong
has risen to 15.
Now as far as what they've done there,
last week Hong Kong's embattled leader Carrie Lam
put some travel restrictions in place,
but denied calls for a full border closure.
And to add to that today,
Lam announced that she was closing four more crossing points
along the city's border with mainland China,
but that still leaves three crossing points open.
Now as a result, thousands of hospital workers in Hong Kong
have launched a five-day strike
calling for all border crossings to be sealed.
Lam for her part has said a full closure
would be a quote
discriminatory approach. But others have pointed out that Lam who is a strong supporter of China and hand-picked by Beijing is just listening to directives from the Chinese Communist Party. Adding that despite the growing public health crisis
she's putting her obligations to the party before her own people. Now despite the growing travel restrictions a Chinese foreign ministry
spokesperson said in a statement today that China respects the decision of some countries to adopt or enhance quarantine measures at border entry,
but also added some countries, the US in particular,
have inappropriately overreacted,
which certainly runs counter to WHO advice.
With the spokeswoman also saying the US response
could only create and spread fear,
which is a very bad example,
adding even American media and experts
doubted the government's decision,
saying that the US government's restrictions on China
are precisely what the WHO rejects,
that the US is turning from overconfidence
to fear and overreaction,
and that banning the entry of visitors
who travel to China in the past 14 days
is suspected to be violating civil rights
instead of reducing risks of virus spreading.
Although, I will say that is an interesting claim,
especially because from our side,
what we've seen a lot of the media do is creating hysteria.
Once again, this is in part due to a fight for views,
people just trying to create the biggest headline possible
for someone to click.
I understand that.
I think we have to be careful because yes,
some people are fully engaged in this topic.
They're reading all the information.
They're hearing this whole story, right?
The whole, the full piece.
But there are also a ton of people that get their news
just by looking at headlines or sharing headlines.
Right, so when you see headlines like the ones
that are going out today, like more people have died
from Wuhan Coronavirus than SARS in mainland China.
Right, and so you look at that headline, that's horrifying.
Also, I'm not saying that this is not factual,
but the specifics in the situation
give us a better understanding.
And also I think there is a calming effect.
As we talked about last time,
one of the reasons that more people were infected with this
is that people could actually give it to one another
before symptoms showed up.
Right, it's part of the reason we're seeing
14 day quarantines.
And while of course there being more cases,
there being more death, that is concerning.
Once again, there are notable differences.
One, according to reports, health experts are encouraged
by the steady rise in the number of recoveries.
Right, on Sunday China's health commission reported
that there were 361 deaths, but also reported
that there were 475 recoveries.
Right, and so regarding the number of recoveries,
they're taking it as evidence that the treatments have been effective
and that the virus does not appear to be as deadly as SARS.
Noting that SARS had a mortality rate of 9.6%, right,
almost a one in 10 die.
Whereas they say with this,
2% of those reported to have been infected
with the new coronavirus have died.
So once again, this is not to dismiss the coronavirus,
but to have a greater understanding of the situation.
This is a very big deal in China.
But if you're in a place like the United States right now,
there is no cause for full-blown panic. you're in a place like the United States right now, there is no cause for full blown panic.
If there's anything you should be concerned about right now,
it is the flu.
According to reports, this flu season,
10,000 people just in the US alone have died from the flu
with over 180,000 hospitalizations.
But even saying those numbers is why I understand
that people would be scared of the coronavirus
in the United States.
Right when it comes to the flu, for example,
the CDC says the fatality rate regarding the flu is 0.95%.
All right, so main points here,
hopefully you have a better understanding.
It is still concerning.
It's why we're gonna keep an eye on it,
but yeah, we have to wait to see what happens from here.
