David's part of Rebel Headquarters for us. Great to have you guys here. So we're going to do a lot
of coverage of whether Biden should drop out and just give you a little bit of preview of that.
The lunatics have re-taken the asylum.
So last night it appeared that it was almost certain because he's nearly a cadaver.
But the zombie army has reorganized today.
So we will tell you all about that and how the Democratic Party has decided, yeah, weekend at Biden's.
Let's do this.
We think we got this.
I believe they're literally mentally deranged.
Okay, so we will talk about that throughout the show.
There's a lot to get to there.
It's also fact checks of both sides.
But first, Supreme Court decision, because there's also monumental Supreme Court decisions today.
One of them is one of the most important cases of our lifetimes.
So having said all of that, David, take it away.
Jack, the U.S. Supreme Court on this day ruled that the federal prosecutors,
the U.S. Justice Department, improperly charged some of the general.
six defendants with obstruction. The ruling means that as many as 250 who have been convicted
or are still waiting a trial in the charge of obstructing an official proceeding could now
move to vacate their convictions, their sentences, and their pleas. On January the 6th,
2021, a essentially off-duty Pennsylvania police officer by the name of Joseph Fisher stormed
into the Capitol and allegedly assaulted a Capitol Hill police officer. Fisher was later
charge with several charges, including several crimes, including obstruction. But as the Washington
Post reports, the charge carries a 20-year maximum penalty. And as part of the law enacted after
the exposure of massive fraud and treading of documents during the collapse of the energy
giant Enrod, writing for the Supreme Court majority, Chief Justice John Roberts said
prosecutor's broad reading of the statute gives them too much discretion to seek a 20-year
maximum sentence for acts. Congress saw fit to punish only with
far shorter terms of imprisonment. Here's more from ABC News Supreme Court contributor Kate Shaw,
as to why federal prosecutors tried to use this obstruction statute to begin with.
The Justice Department took a look at the statute and said it criminalizes otherwise obstructing
or impeding unofficial proceeding. That is broad language, and it applies to individuals who sought
to obstruct the counting of electoral votes to certify Joe Biden as the winner of the presidential
election. So they thought the statute actually did cover this conduct. And so they went forward
with the charge. What the court here says is you have to look both at the context in which
this law was passed, but also surrounding language, which makes reference to documents and
records. And again, it's not that prosecutors could never charge, you know, storming the
capital under this provision of law. But there needs to be, again, a connection to the destruction
of records and documents, not just, you know, blocking a proceeding.
Translation, if Joseph Fisher and others had actually destroyed, say, the Electoral College documents themselves, then perhaps the Justice Department could have used this obstruction statute passed in the week of Enron.
But because it was simply blocking the proceeding, the court decided, no, you can't use a statute. It is too broad.
80% of the 1,400 people who have been charged in connection with January 6th have not been charged with this obstruction statute.
So 80%, this is not going to affect them.
Most of them were charged with either trespassing or assaulting a police officer or resisting
a law enforcement officer.
However, in the Donald Trump election interference case brought by special counsel
Jack Smith in Washington, D.C., two of the four felony charges facing Trump involve
the obstruction statute.
The Washington Post writes that special counsel Jack Smith, who brought the case against
Trump has previously argued that even if the Supreme Court ruled in this direction,
the criminal charges against Trump would still stand.
However, soon after today's decision, Donald Trump posted on social media, true social, big win.
Big win. Jack, your thoughts.
So mixed on this for two reasons. First on the issue of the statute itself, is it a little too vague?
Am I worried about it? Yes. Why? Because when you say a protest is obstruction, well, then you could really outlaw a lot of protests.
and I do not want to go in that direction, and that's a terrible idea.
Now, having said that, if this is an obstruction, what is?
They literally interrupted the certification of the election with the intent of interrupting
a government act and a monumentally important government act.
And not only that, it was intended to cause delay so they could bring in the fake
electors from the states and pretend that they were the real electors. It doesn't get any more
textbook obstruction than this. If they didn't mean this by obstruction, what did they mean?
Would you have to interrupt the proceedings, you have to break and enter, you have to take over
Congress, but plus would you have to burn a specific tonnage of documents? I mean, what kind of
absurd interpretation is this.
So, okay, so I guess, but you know what, what's going to happen?
I mean, this is what's wrong with a deeply, deeply politicized Supreme Court.
When it comes to the left wing, they'll probably say, oh, you walk by the Capitol, obstruction.
When it comes to the right wing, oh, you took over the Capitol, you delayed the proceedings
so that you could help Trump do a coup with his fake electors.
I don't see it.
I don't see any obstruction.
If they didn't mean this, what in the world did they mean by the statute?
The Supreme Court is a bunch of liars.
They know that this is exactly what obstruction is.
They don't give a damn.
They just want to let the January 6th guys off.
All right, Farron, what do you think?
No, I agree with you on a lot of that.
But I will add, when you look through this ruling, there is a small part that Chief Justice Roberts put in there that basically, well, it exactly says, you know, the government has an obligation to prove a defendant impaired the availability or integrity for use in an official proceeding of record.
documents, objects or other things used in an official proceeding or attempted to do so.
That phrase right there actually does leave open the possibility that a lot of these
obstruction charges are going to remain. Now obviously not for all of them. And I do think
there's a good chance these two charges against Donald Trump could be dropped just for the ease
of things for Jack Smith, but I think a lot of these capital rioters are still going to find
themselves facing these charges because this is not necessarily just a blanket, you can't
do this at all. When we're talking about people that are in the actual chamber, obviously that
would fall under Robert's own definition of things used in an official proceeding, right?
we can't be in the capital because you're crawling over our chairs with a bunch of zip ties in
your hands. You're walking out with the podium. What are we supposed to do at that point?
So there is some wiggle room there for prosecutors at the DOJ to still bring some of these
charges depending on who the individual is and their specific case. But it's going to be very
difficult because of this ruling. And if you have them on other charges, it may just be easier at that
point to drop those anyway and just say, okay, well, we'll know you on the trespassing, the assault
and all the other things. We'll just get rid of this one. So, you know, making their lives
easier at the DOJ, it may be more worthwhile to look at a lot of these and see where you can drop it,
see where you can win it. But it's going to be a lot of work. And the Supreme Court
really did screw them over on this.
What do you think?
Well, and it's it's screwing over not only, of course, you know, the Justice Department
in terms of the prosecution of these January 6th defendants, but I think also it does make life
so much more difficult for Jack Smith.
He may think he's got a legal theory as to why because of what Donald Trump did and
the incitement and everything that maybe somehow this does actually apply to obstruction
as defined by this Enron statute, but this is going to mean one more set of hearings over
that which will likely delay Jack Smith if he wants to pursue all for felony charges.
And oh, by the way, it could be delayed even more.
depending what the Supreme Court does with the immunity decision.
So it's just one more sort of roadblock for Jack Smith and his prosecution of Donald Trump in DC.
And it stretches things out.
And I think that just has a lot of us pulling our hair out.
Yeah, so my last thoughts on this is, so it makes it sound like they're not obstructing anything because they didn't shred documents or something, right?
Well, they obstructed a thing called the certification of the election.
Is that not a thing?
If that's not a thing, then what is a thing?
Is Mike Pence a thing, because they were planning to obstruct them by murdering him.
They were chanting, hang Mike Pence, hang Mike Pence.
Is it like, well, no, if they destroyed one piece of paper, then we might have an issue.
But if they murdered the vice president, not an issue.
I mean, an issue on other crimes, but not an obstruction.
But why did they want to murder the vice president?
By the way, look at this, guys.
Joe Biden is losing to a guy who didn't mind that his supporters were going to murder his vice president.
That's Mark Meadows, his chief of staffs told Trump.
They're going to, your fans are going to murder the vice president.
And he said he didn't mind.
So is Mike Pence a thing?
Is that, is an obstruction to kill the guy who would have certified the election?
This is not hyperbole.
A massive crowd chanting, hang Mike Pence, hang Mike Pence.
But the Supreme Court can't find obstruction.
Where is it?
I can't tell.
Oh, it's a right winger?
I don't see anything.
I don't see anything at all.
And then finally, I'm, I loathing.
Merrick Garland for not filing charges instantly and charging insurrection.
If a fake elector's scheme and a violent takeover of the capital is not
insurrection, what the hell is insurrection? And why didn't you actually try to
prove it so we can definitively show it to the American people? Or even if you lose
brother, at least we adjudicated it and then we could be done with it and we can
try to heal and unite as a country. But now, nope, whenever it's, you know, now look, I feel like
I'm in a topsy-turvy, bizarre world where it's some portions of the radical left says if it's
our perceived side, there is no crime. And now the right wing says, if it's our side, there is
no crime. There is no crime you could commit on either side that if you're perceived to be
on that side, they would say is a crime. And the rest of us are stuck in this torture chamber
of gas lighting. So this country's in deep, deep trouble. You know, just adding on to, you know,
you're talking about Merrick Garland and not charging these people with insurrection, it brings me to a
point that I had made, you know, all the way back towards the end of 2022 when Democrats were
about to, you know, not have their majority in Congress anymore. And I repeatedly said, one of the
things they need to do is make an official congressional declaration, hold a vote on it,
to officially declare January 6th, 2021 as an insurrection, right? Put it in the books,
official congressional recognition of that day as an insurrection. And that could have solved
a lot of problems, right? It could have made it a lot easier to charge these people with
insurrection, but Congress didn't do it. Just like they only launched an investigation into
Jared Kushner, you know, in October, I think it was of 2022 right before they lost their majority.
So there's a lot of screw-ups over the last few years, too many to go around to even count at this point.
But yeah, it all comes down to the Democrats don't take action when they need to take action, when they can actually do something.
And then at the end of it, they're like, oh, wow, we just didn't have time to do it.
We ran out, oopsie-do. I guess we'll try it next time.
And it's continuously frustrating, having to use those same talking points basically for the last 20 years that I've been doing this.
this.
Let's talk about the debate.
I can tell you, it started minutes in.
It started with the first couple of answers.
And it has continued throughout the night from, oh, my God, oh my God, oh my God, oh, my
God to what do we do about this?
And it involves very senior people in the Democratic Party,
including elected officials saying we have a problem.
Was it really debate?
Is that really the word where we're going to get to that in just a second?
I would say it was more of a carnival barking contest.
But nonetheless, there is an all out panic in the Democratic Party following Joe Biden's
disastrous performance last night during the presidential CNN event.
We're suddenly hearing calls from Democratic insiders, lawmakers, and media pundits for
President Biden to bow out of the race.
We're going to give you his unbelievable response in just a moment, so stick around for that.
But before we get to some of the reactions, let's give you the unfortunate reminders as to why last night's debate has Democrats in a state of hysteria.
Making sure that we're able to make every single solitary person eligible for what I've been able to do with the COVID, excuse me, with dealing with everything we have to do with,
Look, if we finally beat Medicare and I'm going to continue to move until we get the total ban on the total initiative relative to what we're going to do with more border patrol and more asylum officers.
President Trump?
I really don't know what he said at the end of that sentence.
I don't think he knows what he said either.
Look, what I did, for example, he wants to get rid of the ability of Medicare to,
For the ability to, for the, us to be able to negotiate drug price with the big pharma companies dealing with the segregation that exists among these corporate, these corporate relations that collude to keep people out of their houses.
I made sure every company in the world, every pharmaceutical company cannot have to pay.
And by the way, so every day, that was just awful. That's just terrible.
He just got up from a ventilator or his deathbed.
And that was just far from the extent of Biden's painful moments during this event, which is why so many people are now asking him to step aside.
Watch.
If he were CEO, and he turned into performance like that, would any corporation in America, any Fortune 500 corporation in America, keep him on his CEO?
We saw last night why this race has been close and why I fear Donald Trump will be the next president of the United States unless things change.
He didn't do well at all. He did not do well at all. We're still far from our convention and there is time for this party to figure out a different way forward if he will allow us to do that.
It kind of pains me to say this today, but I think President Biden needs.
to step down and be replaced.
There is a conversation happening inside Biden's circle and certainly a much more frank
conversation happening inside the Democratic coalition.
Conversations range from whether he should be in this race tomorrow morning to what was
wrong with him.
Maybe he needs to go.
Maybe he needs to be honest with himself and the American people.
He can bow out at this time with grace and dignity.
He has a record he can be proud of.
He believes that he is the only person that can do it.
The problem is after tonight, his party doesn't believe that.
Other Democratic lawmakers had even harsher words.
Here's some of what political reported from lawmakers and operatives.
They said, we are effed, needs to throw on the towel.
He's incoherent.
I picked the wrong day to stop sniffing glue.
He has to go, not good.
Time for an open convention.
Biden is toast, Biden needs to drop out, no question.
Hard to argue that Biden should be our nominee.
He failed.
One congressman told CNN that he wanted to jump
off a bridge when President Biden stumbled during an answer about the national debt.
Here's what the New York Times opinion page looked like today after the debate.
Tom Friedman, President Biden is my friend. He must buy out of the race.
Frank Bruny, Biden cannot go on like this.
Patrick Keely, I'm hearing high anxiety from Democrats over Biden's debate performance.
Nick Kristoff, President Biden, it is time to drop out.
A lot of Democrats, Jenk, have been pouring over what are the details?
What's the possibility for forcing Biden out?
There's really no way of doing that.
There may be some sort of opportunity if Biden were to voluntarily say, okay, I'm not going to continue.
Then there was a mechanism, but the deadline is actually not the convention.
It's actually August the 6th, which is before the convention, because that's the deadline for the Democrats certifying your nominee in order to get on the ballot in Ohio.
So imagine trying to solve this, not necessarily at a convention, but remotely or through Zoom.

The man is obviously way too old, has something, I don't know,
what it is, he's obviously hiding it, onset dementia, Alzheimer's, Parkinson's, I don't know,
but he definitely has something, you can't remember anything. We beat Medicare. You think they're
not going to use that in an ad? You think that's the best candidate the Democratic Party has?
If that's the best candidate Democratic Party has, the Democratic Party is a disaster.
If you think that, you think the Democratic Party is the worst party in American history,
history. There's not a single Democrat better than that to go up against Trump. And if you say,
oh yeah, of course, there's dozens of better candidates, but I would rather be polite to a
person in power than to beat Trump. I don't care about beating Trump. I don't think it's an important
election. I don't think that democracy is on the line. So I just rather defer to Joe Biden
because I wouldn't want to upset his feelings. I mean, this is insanity. No, I'm sorry.
If you think Joe Biden's going to win, you just don't know anything about politics and you're in blue MAGA and now we've got to rescue red MAGA, blue MAGA, everybody's in a goddamn cult, don't you have eyes and ears? How could you? If you didn't watch the debate, I get it. Watch the debate. If you watch that debate and think Biden nailed it, you check yourself into a mental hospital. Or forget, oh, well, he had a rough night. Okay, yeah, okay, I get it. He didn't nail it. But he's still the best guy. We got it. I bet he means.
Trump, he's losing every swing state. This is pre-debate. He's lost his panics. He lost,
he used boat. He's lost everything. He's down 12 points in Nevada. But no, no. I, and the
reason why I'm desponding guys is as you're going to find out around the show. First of all,
the Democratic Party, Joe Biden, et cetera, saying, no, we nailed it. We're good. Not
even close to dropping out. No way. And now the bots and trolls are all over social media
going, oh yeah, one big, it wasn't a bad night, no big deal.
He's back on his A game.
He's so great, he's a dynamo behind the scenes.
Yeah, yeah, yeah, yeah.
Well, I can't have a conversation with someone who's not attached to reality.
That's that's insanity.
So, I mean, if you lost morning, Joe, remember I told you guys, that's the bellwether, right?
He's the epicenter of the establishment.
And even Joe Scarborough, like, watch it.
It was like, I got, I gotta say it.
We got, we can't.
This is crazy.
If you're saying Biden should continue, you're basically,
saying, I'm totally good with Trump winning. I'm good. I did a poll on Twitter,
already like 3,000 votes on it. If you, does Trump want Biden to drop out of the race or to
stay in the race? 84% say stay in the race. Of course he wants Biden to stay in the race.
It's a guaranteed victory. Who wouldn't want him to stay in the race? Why would you want to
run against someone that has a mind? Right? Like, okay. So and and last thing for now,
it will go around. Mika said in that segment, she was upset that they're throwing in the towel,
basically the rest of the morning jail crew. And she said, you know, I know we're choosing not to
spin this. Oh, so you spin everything else. Thank you for admitting that. Appreciate it.

You know, you said Joe obviously has something.

I mean, that's the whole reason.

And, you know, I was sitting here watching Scarborough in that clip you showed talking about like a CEO, would you, would you have a CEO that acts like this?
And my initial thought was, you know, all three of us here, we run shows and we've run shows for years and years.
If you had a guest, come on, that gave that kind of performance that Biden was giving
last night, every one of us would say, hey, delete that guy's number from the Rolodex.
We're never calling them back.
That was horrible.
I don't ever want to hear that person on this show again.
And if it's not even up to standard for a guest on our shows, then it sure as hell is not
up to the standard of somebody that's going to have the nuclear code, somebody that has to go and
talk to world leaders, you know, at the drop of a hat. I woke up this morning, going through
headlines, looking for stories. Everything, of course, is about the debate. And even some of the,
you know, far left websites or not necessarily far left, but sometimes a little more center left
websites, everybody, there is not a single outlet out there as of this morning. Now as day goes on,
it kind of mellowed a bit. But as of this morning, every outlet said the same thing, whether it was,
you know, Politico, raw story, talking points memo, and then BBC, Al Jazeera, independent online.
So we've even got international papers telling us this is bad. All of them in agreement that this
was a horrific performance by President Biden. U.S. allies, the headlines tell us, are panicked about
Biden's performance, not just because it could mean more Trump, but they're panicked about it because
of what it could mean for their own foreign policy dealing with the United States, right?
Like they've got six months at least to deal with this guy. And they're terrified. So this isn't
just contained to the United States freaking out. This is the global, the globe telling us,
Hey, Democrats, this is bad, maybe you should do something while you still have the chance,
because that's the point. There's still a chance. There's still a way. But every hour that ticks
by, we are wasting precious time. And it really is every hour at this point. We've got to make
that decision and we have to make it quickly. Yeah. And I want to speak to those people out
there who say, oh, maybe this was a one off. Maybe it wasn't that mad. Maybe it won't be fatal.
First of all, I get, I appreciate that if you read the debate transcript and we're to look at what Donald Trump said and what Joe Biden said, just by the transcript, you might think, oh, Joe Biden did pretty well. Look at all the facts that he's talked about. Look how they addressed. There were a couple of positives, but it was fine. And I also get that, sure, President Obama back in 2012 had a disastrous first debate. And I get that John Federman in 2020 had a horrible first debate, right? It's crazy. But there's a difference between Barack Obama and the talent that he has and what Joe Biden.
is looking at now. There's a difference between John Federman who had potential for an upside for recovery
and President Biden who's not getting younger by the day. And secondly, this may not be fair.
It may not be fair that in this televised era, how you come across on TV, that being wrong,
but strong is better than being weak and right. And maybe that's just not fair, but that's reality.
And the reality is if you're going to compete and you're going to win a presidential campaign
in this era, you have to come across as confident and articulate. And,
And maybe even loud, maybe even a carnival barker, especially when the debate hosts are not fact checking anybody.
There's an even greater imperative view to be strong. And that's the reality.
And people who don't want to live in that reality can fantasize about, oh, maybe Joe Biden has a better debate in September.
Maybe the convention comes and brings everybody together. Maybe Donald Trump has some sort of terrible health thing.
And somehow Joe Biden does it. I have been doing this for 30 years. I've never seen an debate this disastrous.
It will cost the Democrats, the White House, period.
And it's not about it being an off night.
It's about his current mental state.
It's not like he's a 57 year old and he had an off night.
No, he's an 81 year old who can't finish his thoughts.
So I'm going to get to the poll results in a second.
First of all, Jesse wrote it on Super Chat.
I like both candidates, but I think we need somebody older.
Thank you for lightening the mood, right?
I mean, but Blue Maga might think that.
They might think we're not old enough.
Maybe we go 98, maybe we're, all right, anyway.
So I want to pick up on a couple of things that Farran said, you know, he talked about if you had a guess that was then that incoherent, you'd never have him back on.
Look, I talked to a lot of candidates who were trying to be Justice Democrats when we first started the organization, right?
If I talked to a candidate who said, you need to end Medicare, I'd be like, no, no, no, no, no, no, no, no, no, no.
We have no chance if this guy runs.
So we'd have no chance if a guy like that ran, but the Democrats are going to run him against Trump.
Okay, it's insanity.
Now, guys, think about the convention.
They're going to chant four more years.
That's embarrassing.
It's going to hurt the candidate rather than help the candidate
because it's going to remind everybody four more years.
You're going to add four more years to Biden's current physical state.
The minute they chant four more years, we lose the election.
Look, guys, it's a gaslighting factor.
I told you, look, this is in a sense like APAC revealed a game.
about lobbyists, you know, that the politicians will do anything as long as, you know,
donors give them money, anything, right? Well, this is revealing the game about the parties.
The Democratic Party doesn't care about you, they don't care about winning elections.
All they care about is their own power, money, salary, status, title.

in world history. If somebody suggested that, I'd say, guys, get realistic. That's the most
outlandish daydream you've ever had.
But that daydream for Trump has now turned into a national nightmare for the rest of us.
Because right now, as things stand, he is not getting out.
And we're going to get slaughtered in this election.

During 12 hours after the disastrous debate and the despair began to set in, here was the reporting on CNN.
What are you hearing from the Biden team, Kayla?
Well, John, the Biden team as of this moment plans to pack up what few wins they had on the debate stage last night.
You've already seen some of those packaged and posted on social media and to move on and focus on what's coming down the pike.
There are no plans, I'm told, for the president to drop out of the race.
And even further, I'm told that the president is still committed to a second debate in September, which is.
That second debate in September would be after the Democratic convention, and it's not just Joe Biden who's saying that he's not getting out.
It's also his campaign finance chair who's also saying it.
CNN reported that in spite of the many calls for Biden to drop out again, there's nobody in Biden's inner circle, including Joe Biden, who is even going to entertain the thought, never might, never mind actually get out.
And Biden's already getting some support from a swath of Democrats who are either choosing to either completely deny what happened at the debate or the reality of.
Biden's condition or brush past them in favor of criticizing Donald Trump.
Let's start with Jill Biden, who gave this bizarre praise of her husband last night immediately
after the CNN event.
Joe, you did such a great job.
You answered every question.
You knew all the facts.
And let me ask the crowd, what did Trump do?
Why?
Great.
Joe Biden answered the questions, except, of course, when he left, you know, 90 seconds on the clock.
In any case, it's generally acknowledged that Jill Biden and Barack Obama hold the most influence over Joe Biden.
And clearly, Jill Biden is still pushing Joe to run.
And today, Barack Obama did the same thing, writing on X, bad debate nights happened.
Trust me, I know.
But this election is still a choice between someone who was fought for ordinary folks his entire life.
And someone who only cares about themselves between someone who tells the truth, who knows right from wrong and will give it to the American people straight.
And someone who lies through his teeth or his own benefit, last night didn't change that.
And it's why so much is at stake in November.
The support of Barack Obama and Jill Biden seems to indicate that for now,
Joe Biden is not going to voluntarily drop out of the race.
And as we said before, there's no mechanism for Joe Biden to essentially be forced off the ticket.
Joe Biden also got some props from some congressional Democrats and state governors.
Let's take a look.
We've got to have the back of this president.
You don't turn your back because of one performance.
What kind of party does that?
This president is delivered.
We need to deliver for him at this moment.
With all due respect, the more time we start having these conversations go down these rabbit
hall is unhelpful to our democracy, our fate and future of this country, the world.
Joe Biden had a bad debate night, and he's got a burden on him to show people that he is still
able to move forward in these debates and in prosecuting the case against.
Donald Trump. I believe he can do that. I also believe that we all have a responsibility to help
him do that. Yeah, Joe Biden's voice was raspy, but the difference in his optimism and his
record compared to Donald Trump's torrent of lies and aggression was stark.
Tonight we saw two things. People can choose between a con in chief or a commander in chief.
And so there is only one clear choice. And that clear choice is Joe Biden and the blue team.
And that's exactly why we're here.
Well, let's end with the most delusional Democrat of them all, and that is President Biden himself.
Here's what he said at a North Carolina rally today.
Folks, let me tell you why I'm here in North Carolina.
I'm here in North Carolina for one reason, because I intend to win this state in November.
Are you going to see that?
I think we are.
Roy is right, we win here, we win the election.
I don't walk as easy as I used to.
I don't speak as smoothly as I used to.
I don't debate as well as I used to.
But I know what I do know.
I know how to tell the truth.
Only Joe Biden could have a crowd and a teleprompter
that he could read at the debate.
Maybe things might have been different.
Is it really advisable for Joe Biden to be seen?
not deciding North Carolina as far as how he's going to win the election.
Well, according to real club politics, Donald Trump maintains a significant lead over Biden in the swing state of North Carolina by 6.7% on average.
Farron, what's going on with these Democrats, Gavin Newsom, and the rest who are falling in line and trying to convince everybody.
Oh, it's not so bad.
There's no doubt in my mind that all these folks know in their heads, you know, this is bad.
And obviously, you got to be a good player, you got to be the team player, you know, blue team.
team as they say. And so they're they're not going to come out and say the obvious. But trust me,
I think behind closed doors, they're either saying it to their friends or they're making
phone calls because they know how bad it is. Because here's the issue and Jane touched on
this in the previous segment. You know, all the polls have been shifting back towards Donald
Trump, right? We had almost a month of just bad polls for Donald Trump following the felony
convictions, bad poll after bad poll after bad poll. And then within two days before the debate,
everything started to switch back to Trump. So it's not just that Biden needed to not screw up.
It's that Biden needed a solid win in that debate. He had no margin for error and he could not have
performed worse. And for these Democrats to go out there and say like, everybody has bad debate,
It's not like he just forgot a statistic.
It's not that he didn't land his one-liners.
It was that whatever is going on up here was on full display for the American public to see and realize,
wait a minute, there's something wrong.
This isn't normal. This isn't what happens just because you have a cold.
There's something going on that scares me.
Donald Trump, yes, he lied every time he opened his mouth,
sure, we get that. But those lies are going to be forgotten a lot quicker than those images
of Biden standing there just looking off into the distance as if he sees a ghost. Those
pictures are going to circulate on social media for the next six months. Those images of the
glassy-eyed, jaw-dropped Biden will be in every Republican attack ad for the next six months.
That's not something you just overcome with, oh, well, he'll study more next time.
No, that this wasn't a bad debate.
It was a bad handed it that everybody finally got to see.
That's what it is.
Yeah.
Jack, I have a question for you.
And I know you and I have spoken offline a lot about to Barack Obama.
And I think we were talking a year ago, like almost exactly a year ago about how Barack Obama had lunch with Biden at the White House.
And there's all sorts of reporting that Obama was trying to convince Joe Biden.
Look, don't do this.
Get out.
And then, you know, Biden wouldn't want to do it.
And so, so Obama wouldn't throw him under the bus.
What does Barack Obama gain now by standing up for Joe Biden?
Because doesn't it become Barack Obama's legacy if Joe Biden loses to Donald Trump?
Yeah, so there's no question that Obama has come in here to make sure that they put duct tape on the holes in the ship.
And they needed something significant to be able to do that.
like Jill Biden going rah-rah is not the answer.
I'm going to come back to her in a second.
They needed real stature of someone to come in and say everything's going to be all right.
So obviously they called Obama.
They must have begged and pleaded to have him do this.
And there's only two possibilities, David.
One is that he's doing it because he thinks, oh, okay, I already tried.
And he's super stubborn.
The dementia is set in.
There's nothing we could do.
We can't force him out because he's the president.
And he's got all the delegates, so I, all right, let's try to win this thing with a ship that's definitely going to sink, but I'll do, I'll be my team player.
That's option one.
Option two is they put doing the duct tape so they can come up with a plan because they're not going to come up with a plan to drop out in half a day, right?
But then, hey, in a week or two weeks or three days, they all come out and go, well, you know what, even though we had it.
I mean, Obama told you we had it.
Everybody said we were definitely going to win.
But you know what? Joe Biden's so magnanimous that he's going to drop out anyway because
he doesn't want to take any percent of chance that Trump might win, right? I'm hoping against hope
that that's what they're going to do. That is the logical thing to do, in which case that would
explain what Obama is doing in a rational way. But if it's not, and they're just trying to make
us, you know, they're Obama, they send an Obama to be the master gas lighter. All it does is drag
Obama down with Biden.
So now, but I did want to go back to Jill Biden.
That was the most cringed thing that anybody's ever seen.
So they say, oh, don't worry, Joe's fine.
Meanwhile, Joe's standing up there like this after the debate.
And Jill Biden's the only one speaking.
And she's like, you did good Joe.
You answered all the questions like a good kid.
What are we doing?
I want you to think about this, she knows, it's not like this is a surprise to her.
You think this is the first time Biden has acted like that, that he's forgotten half the
things he was going to say, mumbling, totally unaware of what's happening?
No, Jill Biden has known all along.
Everybody that works at the White House has known all along.
Everybody at the DNC, they all know.
They've been trying to hide reality from us.
Reality slipped out last night.
They're trying to put it back, put that genie back in the bottle.
Meanwhile, Jill Biden is rolling this guy out going, go, go, I want to get back in power.
Okay, hey, Dr. Jill Biden, if you'd like to be president, why don't you run?
But just doing elder abuse to your husband here is not helping anyone.
And if that hurts your feelings, because, oh my God, she's the first lady.
We're supposed to be really genteel with the powerful.
We're not, we don't worry about the average citizen, average American.
You're going to suffer because this guy's going to lose to Trump?

tells, and then this coach comes out in the press conferences, he didn't fumble. And there was
no but and we didn't lose by 40. You could say it all you want. Trump said it after he lost in
2020. It isn't going to make any difference at all. And you know what they're going to do?
They're going to run that clip of Joe Biden saying we beat Medicare over and over and over again.
They're going to use Miriam Adelson's $100 million to run that ad until everybody thinks
that Joe Biden is trying to kill Medicare, one of the two most popular programs in America. Either
they're going to think he's trying to kill Medicare or he's senile. Pick him. Under which
scenario do we win? If you want Trump to win, you hope that Joe Biden stays in the race.
There is no other answer. All right, sorry, I'm just going so over. As you can tell, I'm worked

what's next cnn actually did run a fact check last night unfortunately it came an hour and 20
minutes after biden and trump left the stage the candidate's performance and demeanor tonight
notwithstanding there is the crucial question of the truth of what was actually said on stage and our fact
Daniel Dale joins us now. So Daniel, what stands out to you? What stood out was the staggering
number of false claims from former President Trump. On first count, Aaron, I counted at least 30,
30 false claims. That's right according to CNN, an hour and 15 minutes after their event.
Donald Trump had lied at least 30 times. We'll get to some of those falsehoods momentarily.
But first, we should note that CNN also reported that President Biden lied nine times.
And let's see what some of those lies were. Watch.
He said he's the only president in a while who didn't have any troops dying anywhere in the world.
Troops have, of course, died on his watch.
He said he's put in a $15 per shot cap on insulin in Medicare.
It's a $35 a month cap.
He said it's a $200 cap on overall drug spending in Medicare.
It's $2,000 a year.
He said the border now has fewer crossings than when Trump was in office.
That's generally not true.
He said or at least strongly suggested unemployment was at 15% when he took office.
It was actually 6.4.
He said Trump wants to get rid of Social Security.
Trump doesn't. He said billionaires pay 8.2% in taxes. It's much higher. He said Trump told Americans to inject bleach amid COVID. We know Trump made foolish comments about scientists studying disinfectant injection, but didn't frame it as advice to people. And Biden said the border patrol endorsed him. No, its union supported the border bill he'd supported, never endorsed him himself. In fairness, the president did appear to clarify that one.
CNN's bias is so clear when you look at what they are identifying as President Biden's lies,
because Donald Trump has repeatedly suggested that he would cut Social Security.
And it's absolutely true that many billionaires pay much less than an 8.5% tax rate.
Anyway, let's move on to Donald Trump's avalanche of lies.
In fact, Donald Trump lied so many times that we don't have the time to list them all,
but this clip will give you an idea of how blatantly and absurd the Donald Trump lies were.
Watch.
He said some Democratic states allow people to execute babies after birth,
an egregious lie that is illegal in every state.
He said everybody, even Democrats, wanted Roe v. Wade overturn.
Roe was supported by two-thirds of Americans, even more Democrats.
He said every legal scholar wanted Roe overturn, abortion return to the states.
Legal scholars have told me directly, this is not true.
He said the U.S. currently has the biggest budget deficit ever.
No, that happened under Trump in 2020.
He said the U.S. currently has a record trade deficit with China.
that also happened under Trump in 2018.
He said Biden personally gets a lot of money from China, zero evidence of this.
He said there were no terror attacks during his presidency.
In fact, there were multiple attacks.
He said Iran didn't fund Hamas, Hasbalah, other terror groups under his presidency.
Iran, in fact, did.
He said Biden wants to quadruple people's taxes, that is pure fiction.
He said the U.S. has provided way more aid to Ukraine than Europe had.
It's actually the opposite.
He said the U.S. has provided about $200 billion in Ukraine aid.
It's closer to $110 billion.
He said 18 or 19 million people have crossed the border under Biden.
That is millions too high.
He said many of these migrants are from prisons or mental institutions.
His own campaign cannot corroborate this.
He said Biden has only created jobs for illegal immigrants, total nonsense.
He said Nancy Pelosi turned down his offer of 10,000 National Guard troops on January 6th.
There's no evidence she even got such an offer.
And you know what's so amazing as that Dana Bash and Jake Tapper knew this stuff off of the top of their head.
And yet they said nothing, nothing during this.
event while CNN's getting a lot of flack from a lot of people for not even trying to push back in
Donald Trump's whoppers. Washington most columnist Karen Aftia wrote today, whatever the agreement to
not push back or fact check in real time, this is disturbing to me. This is how democracy and norms
get eroded. Fact checking and preparedness are part of the safeguards to keep people in power
accountable. This nation is in trouble. And I want to be clear, I worked at CNN for five years.
I know Jake Tapper and Dan Abash and David Chene, their political director, I like them personally,
but their legacy is now permanently stained by this. If CNN cannot even attempt to say,
wait a second, Donald Trump, how can you say X, Y and Z? Where's your proof? If they can't
even signal to the audience that Donald Trump has just delivered a whopper, even if it's
difficult to do, or even if it turns it on themselves, if you don't stand for truth as a news
organization, why do you exist CNN? Why do you exist if you can't push back?
at all. And if this nation, because of Donald Trump turns to fascism, if Donald Trump
wins and this nation goes to fascism, that will be part of CNN's legacy. Two things can be true.
Joe Biden had a disaster debate. It was terrible. But this was also a terrible night for journalism
because there was no journalism during this event. It was not a debate. It was a carnival barking
contest in which CNN had robots, who I like personally, but professionally, they threw their
their reputation down the toilet by not challenging anything.
That was a disaster.
Our nation is indeed in very serious trouble.
So when it comes to Biden's so called lies, there were some in there.
Like so when he said no service member died on his wife, that's a weird lie,
Afghanistan, let alone several other instances, right?
But the rest of it wasn't really lies.
And it doesn't do many favors to tell you the truth about it.
But the reality is that he keeps forgetting things.
So he forgot that the insulin price was $35 and he said $15 twice.
But once he corrected to $35, David's right that there are metrics by which billionaires only do pay about 8.2% of their income or wealth, depending on how you look at it.
So I think CNN, as you saw my live coverage, you've seen what I've said today, I thought Biden was an epic disaster.
Probably the, not probably, definitely the worst debate I have ever seen.
Definitely at the presidential level, maybe at any level.
So it's not like I'm pulling my punches on Biden.
But his issue is in the lying, at least in this debate.
He's told some whoppers in the past, like how his uncle was eaten by cannibals.
Okay, so no one is shielding Biden here.
But lying was not part of the problem last night for Joe Biden.
Donald Trump, on the other hand, guys, this is why I can't all show long, I'll be yelling at blue MAGA who thinks Biden nailed it, right?
To be fair to them, not nailed it, but they think he should still be the candidate, even though he's clearly going to lose.
Now, Red MAGA, come on, guys, you really believe that Norway and Paraguay decided to, oh, let's get our mental asylum guys and the prisoners, let's fly them to the Mexican U.S. border and then release them.
Come on, come on, just think for one second that you think that Biden quadrupled your taxes?
Have you paid your taxes?
Did you see if it was quadrupled or not?
You think that there's such a thing as a post-birth abortion.
So if a 28-year-old was killed, would that be a post-birth abortion?
Okay, I mean, he says such maniacal things.
How could you possibly believe it?
So we're stuck in these just total alternate reality bubbles that make no sense at all.
I mean, one last one.
All of the jobs that Biden created went to illegal immigrants.
All of them?
All of them.
So this is what we're stuck with, a guy who can't finish a sentence,
and a guy who cannot say a sentence without lying.
And not lying a little, like preposterous, Dr. Evil lies.
Fair.
You know, it really is funny that CNN, you know, Jake Tapper and Bash there, when Trump said that there are these democratic states that have these post birth abortions, which is murder, they didn't even have to necessarily say, wait a minute, that's a lie. They could have even had fun with it. They could have said, real quick, which states? Which governors? Go ahead. We just, we want the list right now. Everybody's watching.
Make them look stupid.
Like that's what I would prefer even more than just a basic fact check of saying,
wait a minute, that's not right.
Make these people look as stupid as they think the American public is.
That's what we need.
If we're not going to have real journalism, then let's have real fun with it.
Let's make them feel stupid when they try to treat us like we're stupid.
That's what I would like at this point because obviously we're not going to get real journalism anymore.
We're not going to get anybody that stands up to the powers that be during these debates.
They know these are probably the two most powerful men in the country, if not on the entire planet.
So they don't want to push the buttons.
They don't want Donald Trump to go out there tomorrow and say something horrible about them on truth social.
So they sit there, mouth shut, letting all of this happen.
And it's just, it was a disgusting day, not just for Biden, but for journalism itself here in the United States.
Yeah, I'm going to add one last thing to what Farron said, because last night I made such a similar point.
I said Biden should have said when Trump said, oh, they're releasing all their mental asylum inmates.
Which countries? Which countries are releasing their prisoners and their inmates into America?
because then he'd be forced to make up countries.
Then you'd have to go to those countries and ask them,
hey, have you guys actually released all the inmates from your mental asylums?
And how did you get them to the border?
Did you drive them?
Did you hire, get a bus?
So at one point, Trump claimed that there was no one crossing the border when he was president.
I remember Fox News losing their minds over the caravans when Trump was president.
Like, do you guys care about reality at all?
Okay, last thing is about the anchors.
So Biden is the one who's supposed to counter his opponent, and he's supposed to make these points in a debate.
But David and Farron are right.
The journalists still have a responsibility not to the candidates, but to their audience.
So Biden is incapacitated.
He can't speak.
He can't think he can't do anything.
So now you see one guy is melted, and the other guy is lying to millions of millions of people nonstop.
You have some sort of responsibility to your audience.
to say, hey guys, sorry, but I've got to just let you know your taxes didn't quadruple.
Like bare, bare minimum.
We said that there was an incredibly low bar for Biden, and he couldn't clear it.
And there was a pretty low bar for the anchors because the opponent is supposed to challenge the guy,
but they couldn't clear that low bar either.
And most importantly, you know why?
Because Trump and his goons yelled at him for about a month straight.
Oh, yeah, you, you're going to do these.
unfair fact checks. Oh yeah. They hate Trump. They're going to counter Trump. Oh, they better not
say anything. They better not say anything. And what happens? CNN got scared. Well, it's not
exactly a profile and courage to say we're going to lay down. We're not going to do our jobs
because Trump yelled at us. That's really sad. All right, we got to go. Everybody check out
