When I scroll down in this article, the actual memo did not say that gender is determined by genitalia. Here's what the memo actually says according to the same New York Times article.

They quote part of the memo, and so that's all we have to go on. We don't have the actual memo. We have the New York Times quotation of the memo, and the memo says this. Sex means a person's status as male or female based on immutable biological traits identifiable by or before birth. The sex listed on a person's birth certificate as originally issued shall constitute definitive proof of a person's sex unless rebutted by reliable genetic evidence. So I read that and I was like, whoa, whoa, whoa, wait, wait a minute. They did not

use the term gender, nor did they use the term genitalia. They specifically three times used the term sex. Now, as I've said before, and hopefully you have heard this or know this, but sex refers to a person's anatomy, their sex chromosomes, their internal reproductive organs, their external genitalia, and their secondary sex characteristics produced by their distinctive endocrine systems, whether somebody has high levels or low levels of testosterone. All of those cumulatively determine a person's sex. So gender, however, has, I mean, the typical ways that gender is used today, I mean, it refers to one's internal sense of self, who you feel on the inside, who you identify as. It refers to your external expression, your clothing, your interests you identify as. It refers to your external expression, your

clothing, your interests, your hobbies. It refers to cultural expectations of certain masculine or feminine roles. So there is some overlap between sex and gender, but gender captures the flexibility of what it means to experience yourself as male or female in today's society. And it varies from culture to culture.
