Once again, there was, there were a couple of things I left out of my election thing a couple of days ago.
And this is an important one.

citizen petitions
otherwise we would have
had a legal
marijuana by now.
It offers to actually
vote on stuff like
this. It has come

this is what they chose to
try to force upon us.
And there's some

and there's a very historical reason
for that.
And it is
discussed in this

How could electing the Kansas
Supreme Court affects issues like abortion and school funding?

Kansas Supreme Court justices
it would give voters the ability
to directly pick
Kansas
Supreme Court justices but
critics say the ripple effects will be massive and they will.
I'll open that because I've felt on to read that.
So Kansas used to elect justices,
but that changed after a 1950s scam by scheme, rather,
by then Governor Fred Hall.
Now there's a statewide vote in August that would return
to directing directly.
electing justices for the state's highest court.
Hall's scheme went like this.
So the Chief Justice, William Smith,
retired abruptly because of health reasons.
All right.
Number one, we have a justice calling it quits.
Hall then resigned as governor just 11 days before
leaving office because he wasn't nominated again.
Part two.
Finally, Hall's
Lieutenant Governor
John McEwish,
apologies of
on Ms. Brennan's in that
appointed
Hall to the Supreme Court.
So,
so there you go.
Chief Justice
steps down. Governor steps down
from his job.
Lieutenant Governor gets promoted
to governor and
appoints
former governor
to the court, basically what.
Sounds a little fishy to mean.
Well, that's it.
Nothing Hall did was illegal,
but after this scandal known as the triple play,
Kansas changed its constitution
away from the direct election of
justices to a merit-based system
where panel screens candidates.
The current system includes a nine-per-
panel appointed by the governor and lawyers.
All judges are
start up as lawyers.
They know the law.
The commission is composed of five lawyers
who are elected by licensed attorneys in Kansas.
Again, these people know the law,
and the other four are picked by the governor.
When there's a vacancy in the court,
this commission vets
candidates that sends three finalists to the governor to pick one.

But this Constitutional Amendment vote in August would return to directly electing justices on the Supreme Court.
Conservative lawmakers and business leaders argue that change.
will lead to a needed check on judicial power.
Activists and former justices oppose it,
opposed to it,
believe direct elections will lead to partisan justices
who make legal decisions on issues like abortion access
and education funding based on campaign donations,
not the rule of law.

abortion rights
some critics
of the change to this
as they're
going to
yeah some critics of the change
point to this
as a redo of the
uh... 2020
votes on constitutional
abortion rights, which
Kansans rejected in favor of abortion access.
It seems that's the one issue
Republicans run on
almost consistently.
When we shouldn't have abortions.
We're a pro-life.
George Conlon put it best.
You know, why, why is it?
Most of the people who are against abortion,
are people who want to want to fuck in the first place.
And they're not pro-life.
They're anti-woman.
So, move.
Great Plains present.
I'm then Great Plains,
Plains, maybe.
And CEO, Emily Wales,
said this time the strategy is restricting abortion
through how justices are selected.
This is about banning abortion
and restricting rights that can
have demanded they keep, she said.
May conservative lawmakers in Kansas have not been happy about court rulings on abortion
rights and school funding.
Whale says that this is what the August 4 amendment vote is really about.
The end game is but justice on the Supreme Court that are going to be in line with
their political values.

quoted Chris Kobach.
I'm ashamed to say he's associated with

being the
worst elected partisan
in Kansas history
as he outlined a new path to an abortion
ban which begins by directly electing
justices. Colbach
did not response to request.
for comments. During a recent gubernatorial debate, Republican Senate President Ty Masterson,
remember him, the guy who's single-handedly made all marijuana illegal in this state,
says the state should have like justice is because they would better represent Kansas.
Here is my response to Mr. Masterson. I'm going to support whoever gives the people of Kansas
is the biggest voice of that branch.
That's the problem.
We have a court that does not reflect the Kansas people's values.
Again, which is why we can't have nice things.
Checks and balances.
James Franco is the president of the right-leaning thing to take the Kansas Policy Institute,
another group that can go fuck themselves.
Franco says he does not believe there's currently a check on judicial power.
Whatever, dude.
It was just hard for me to think that that has really proven itself to be the cause of nine unelected people on this nominee commission.
This guy said, says, judges do have to face retention in elections in Kansas.
These yes or no votes give voters the ability to remove justices.
Franco argues that it is not enough.
I think it is, dude.
He says that the law of turnout numbers of these elections
do not lend themselves to a true societal check on judicial.
Power, one moron.
Former Kansas Supreme Court Chief Justice
Lawton Nuss
does believe in the power of retention
elections says electing justices will bring politics and campaign funding into the court.
Thus was selected for the court in 2002, by then Republican Governor Bill Graves.
He served as Chief Justice for most of the 2010s before retiring in 2019.
Nuss noted that his last potential vote, they received more than 600,000 yes votes,
which he described as democracy in action.
Nuss does not think that directly electing judges would be a positive for Kansas.
I agree.
He points to a recent Wisconsin Supreme Court election,
which brought millions of dollars from a donor.

said this could lead Kansas

where donors want rulings they agree
with
to which I will
go ahead and Kansas already has
a dark money problem
on the Republican side

the Koch brothers
or Koch Brother
because the other one's dead

Americans for prosperity.

And frankly
on the left,
it's
the education lobby.
Moving on.
They expect something
from their investments
says enough that compromises
the entirety of the court.
Business decisions.
Kansas
Chamber of Commerce, President,
and CEO,
So Eric Stafford wants to allow Kansas direct to vote for their justices.
So again, another guy who can go fuck himself.
Stafford specifically appointed one issue that has been hurting the state's business climates,
a 2019 decision which removes state caps on non-economic damages,
including pain and suffering and personal injury lawsuits.
Stafford said that decision led to uncertainty in driving up insurance costs for businesses.
When there is no cap, there is no certainty.
It makes it more difficult.
Stafford also pointed to a 2019 state legal climate ranking that pulls business executives and corporate attorneys
from the U.S. Chamber Commerce Institute for Legal Reform.
It asks how fair and reasonable each state's legal liability system is in that poll by the pro-business group.
Kansas ranked 32nd.
In the early 2010, Kansas was consistently ranked in the top 10, the business poll.
Huh.
So this jackass wants to take us back to Bram Pakistan.
It was not good for the average candidate.
and period. I don't care how you try to spend that.
Overall, Stafford S.Y. Lawyers should help choose who they put on the nominating committee
while other professions are not given that same rights. He described it as a pretty
elitist attitude because the judge is not the law and so do lawyers, idiot?
Stafford says that educators do not get to choose that.
their own school board and CEOs do not get to choose the state's governor.
Why is one profession so smart and so educated?

Education funding impacts.
Education advocates also worry that an elected Supreme Court could undo past rulings,
determining what is adequate.

This includes the lawsuit that eventually resulted in schools receiving an inflammatory,
inflationary, rather adjustments in funding.
This adjustment requires lawmakers to pass budgets that take into account the ever-increasing
school district costs of fuel, food, and salaries.
Kansas Association of School Board's Assistance, Executive Director of Advocacy and Governmental Relations, that is a long title.
Leah Fleeter said this allows schools to be treated equally by lawmakers.
Prices go up for public schools just as it do for businesses in the state.
some lawmakers want to consider changes to this inflationary adjustment.
Kansas Republican state rep Troy Waymaster,
I wonder if anyone's running against him,
is one of the states' lead budget riders.
Waymaster says earlier this year during the budget debate
that the Gannon decision is causing large annual increases,
in school funding.
Next year, this body will have
the opportunity to look at the school finance
formula, and
there needs to be some changes made.
Changes could mean
new lawsuits over
education funding, you idiot.
This guy never made it past high
school. Education
advocates
wonder how the courts
might rule on major issues like this
in the future. If it's
composed of elected officials.
And that's the end of that's by doing.

I want to tell you about a scandal.
It's the only scandal in the history of the Kansas court system.
It's the story of an ambitious politician that tainted both the governorship and the state's
highest court.
The story starts on September 23rd, 1952 at the Al Capitan Theater in L.A.

at the time he had just been
nominated as Dwight Eisenhower's ringmate
but
the press got wind
of a secret fund
Nixon's supporters
created for him
to pay political expenses
not surprisingly
at churches of improprieties
surfaced
followed by calls for him to resign from the tickets.
Oh, so they knew 20 years beforehand
he was corrupt as fuck.
So Nixon did something that's never been done.
He went directly to the people on television.
Going straight to the people seems so easy now
with YouTube, Twitter, Instagram, this podcast.
But six years ago was unheard of to go
around the media
around
the

to go around
the media
was
revolutionary
I can't

know for sure
but
it's a
pretty good
bets

Hall
was watching
the night
of the
Nixon speech
Hall
was
Kansas
Lieutenant
Governor
Hall was ambitious but unpopular among the GOP elite in Kansas.
He would go on to be elected governor but find himself on the outskirts of the party.
Hall, like Nixon, would go directly to the people and would change politics and the legal system in Kansas in a way that we are still feeling right this minute.
So, yeah, that's the guy.
There's two things that strike people about Fred Hall.
First, there's a bit of Bernie Sanders in his politics.
He's way more liberal than most Republicans in Kansas at the time.
He was for pumping more money into public education in prisons, and he was pro-union.
While most Republicans in the States weren't as conservative as they are now,
they certainly were not pro-union.
That more than anything,
drive the Fred Hall story.
After two terms, and by the way, in the 50s,
in the 50s, it wasn't like it is today.
Back then, you had liberal Republicans,
and he had conservative Democrats.
In fact, yeah, there's a phenomenon called Dixie.
crats. We didn't get to the
we really didn't get to the
setup that we have today
until about a decade
later in the 60s with civil
rights. But
let's continue with this
article. After two terms
as lieutenant governor, he won the
Republican nomination
before governor in 1954.
I'll be out with
little enthusiasm from the party.
It was pretty clear the GOP went
tolerate another whole term in
in 1956
and that was especially true after he
battled the legislature
in 1956
he had a tough
GOP primary
and
without
party backing he did
what virtually no politician
had done before he went on TV
to speak directly
to the people
the first of
his 30 minutes
television specials aired
on January
1956.
These half-hour shows aired on
W-I-B-W in Topeka
K-A-K-E in
W-D-A-F in K-C
currently the Fox
Station.
And the TV shows may have
added to Hull's
Troubles with the party.
On one show, he
talked about pumping more money
into prisons.
He wanted to not just
incarcerate people, but try
to re-ealtate them with
education and psychological help.
In another, he went on
about how important public schools are
and how Kansas not only
needed more teachers, but
to pay them more money. No shit.
That's still an issue today.
And in all of them,
he talked about the cabal
of men running the
and how he was elected to throw the rascals out.
But nothing helps.
Hall became the only sitting governor in Kansas history to lose the Republican primary.
He was the lamest of lame ducks, but all wasn't done.
He had a reputation being aggressive and pugnacious, but nobody could have predicted his next move.
His next move was a conspiracy that was both sleazy and genius.
Fred Hall had.
had no plans to move back to Dodge City as a loser as a one-time governor.
He concocted the only judicial scandal in Kansas history.
It even has a cool name, the Triple Play.
In addition to Hall, there were two other actors in the Triple Play.
First, there was the Chief Justice of the Kansas Supreme Court, William Smith,
a longtime Republican Party stalwart.
Remember, Kansas was elected.

did Smith...
How long had Smith been
a player in GOP
politics? Remember the archiver
episode on John Brinkley
the goat gland
doctors
would
ran a writing
campaign for governor in
1930?
Well, many believe Brinkley might
have won head
not so many ballots been disallowed.
The man in charge of deciding which bounds were legal,
William Smith, who was state attorney general at the time.
The other player was Lieutenant Governor John McEwish.
He was a newspaper man by trade.
He owns the Harvey County Times in his hometown of Newton.
So here's the triple play.
On December 31st,
In 1956, Smith sent a letter to the Secretary of State resigning as Chief Justice.
Smith was ill and wanted to resign, but being a good Republican, he didn't want to quit and lead.
Let the newly Democratic Governor George Docking pick his replacement.
Then on January 3rd, 1957,
Hall sent a similar letter, quitting just 11 days before his term ended.
Bekewish was in the hospital in Newton,
and Hall dispatched a highway patrolman to bring him back to Topeka.
Bekewish was automatically elevated to governor,
and he immediately appointed Hall to the state's highest court,
and the triple play was done.
Hall was on the Supreme Court.
where he hopes to launch a future bid for governor.
But Kansas wasn't used to that kind of backdoor deal,
and the backlash was immediate and severe.
This is what the Kansas City Times,
signed note to A1-2 Youngton,
we used to have two newspapers.
The Times was in the morning,
and the star was in the evenings and the weekends.
But the Times went away and the Star is the primary paper today.
So this is one of the Casey Times had to say in January 1957, the headline was a brazen
raw deal for Kansas justice.
The deal was close in deepest secrecy.
this indicated the participants were fearful of public reaction and did not believe it could stand in the latter day.
If all was not merely a political appointment, it was an appointment to the highest court in the state.
In the 1957 session, the legislature would pass a constitutional amendment requiring justices to be chosen with a merit system.
the next day the appointment passed was 70% of the votes and everyone was happy at least until a few years ago.
Fred Hall had no way of knowing that the triple play would directly affect one of the hottest issues in Kansas politics today.
How the state funds public education.
Up until the 1990s, nobody thought much about had Kansas picked Supreme Court justices.
and judges for the Court of Appeals.
Except for the triple play, there had never been a scandal.
Kansas courts generally had a good reputation, but in 1992, a lawsuit known as Montoy v. Kansas was filed.
Alleged the state wasn't putting enough money into the school system, and that violated Article 6 of the state constitution.
The case goes to the Supreme Court.
and the justices agree.
Kansas lawmakers needed to
find more money
for schools.
The
state also lost a case
called Gannon.
The case
that is now causing conservatives
in the legislation and
Hare Brownback
to desperately want to dump
the marriage system that was born
from the triple
play for
all the turmoil and trouble, Fred Hall
would cause his stint
and on the Kansas political
stage was
pretty brief.
He spent
just two years as the justice
resigning
in 1958 to make
another run at the Republican
nomination for governor
where he was trounced
by 60 points by Clyde
Jr., who spent
most of his life
as the editor of the Parsons son.
Hall would go on to a successful career
as a lawyer in California
in the booming aeronautics business.
He eventually returned to Dodge to practice law,
but in his fairly brief political career,
he introduced television to Kansas politics
and a scandal to the court system.
He would be responsible for radically changed,
changing the way judges are picked
and
for the political battle
over the same thing
today. Hall
died in 1970, he was only
53.
And
I guess this is in a podcast
form already.
So we won't
be hearing
that portion.
But
yeah, if

This is, in fact, where I went to college.
And came here.
Oh, yeah, I got one of the other.

volunteers okay I'll volunteer it'll be this Saturday evening it's not too far
from where I'm standing right now or walking right now so it's gonna be up the stairs
over here let me show you to up these stairs that's the old dorm
to your left new word dorms over here.

That's not where we're going today.
Going back to the car because I have one hour of parking.

And I actually took the back entrance to the administrative building.

going on a couple months ago,
the Royals announced
they were indeed
doing the new ballpark
downtown
Crown Center area.
And today
this is Kansas

of some sort.
