Robert Herr, the man who investigated President Biden's handling of classified documents, delivered devastating testimony today before a congressional committee. The transcript of Mr. Herr's questioning of Mr. Biden was released prior to the testimony, and it revealed that Mr. Biden had over 100 memory lapses during the time Mr. Herr questioned him about the classified documents that were found in Mr. Biden's private office and home. And so we'll start today's True News with this headline from the Daily Mail. Biden forgot the year Beau died, his son Beau, when Trump was elected and said, I don't recall, I don't remember, and I don't have no... Expletive idea. Yes, idea. More than 100 times, according to the transcript of Robert Herr's interview.

And this transcript was released just, I mean, just minutes before Special Counsel Herr was giving his testimony to Congress today. Purpose, obviously purposely done that way, so there wouldn't be any time to review the transcript. But, of course, the media is out there chasing it. So what prompted the interview? Well, after Mr. Herr released his report a month or so ago, the White House and the Biden campaign organization, the Democrats, went on the attack and tried to smear Mr. Herr. They tried to paint him as a liar, an exaggerator. A Republican plant. A Republican plant, a Trump crony.

They did, you know, the typical assault on somebody's character and their name and reputation to reduce the damage done by Mr. Herr's comments. Then Mr. Biden was asked again, this is how long ago was this? This is in February, right? Almost a month ago. So it was released. The report was released on the 13th, and then President Biden had remarks on the 14th. And he came out swinging and tried to look very angry and say, how dare, how dare this man, Herr, ask me when my son, Beau, died? And the implication was that Mr. Herr set up Mr. Biden, had these trick questions and and tried to make him look bad. That's what the White House wanted you to believe a month ago. That's what the media told you. Let's watch that video again. I know there's some attention paid to some language and report about

my recollection of events. There's even reference that I don't remember when my son died. How in the hell dare he raise that? Frankly, when I was asked the question, I thought to myself, it wasn't any of their damn business. So the implication there is that Special Counsel Herr, a member of his staff, brought up the question of Beau Biden's death. And of course, the president went on the attack on that, supposedly went on the attack. But as Paul Harvey would say, now we have the rest of the story.

And it was Mr. Biden who brought up the death of his son. And then mr herr asked him questions and mr biden couldn't remember the date of his son's death right that's what really happened the transcript shows it it's in black and white and it it shows that mr biden well uh at best doc doesn't have a good memory about what happened on that day he was questioned. Right. So which is it? Is Mr. Biden a liar or does Mr. Biden not remember about the questioning about when he did not remember things? Well, and that's really at the heart of the report there, Rick, because the conclusion that special counsel Herr came down to at the very end was that, and you'll see this in some of the clips that we pulled today,

Rick, from Herr's testimony, in that Joe Biden knew that he had classified documents. He knew it. But the conclusion that special counsel Herr came to is that we can't prosecute him because a jury would believe he's just a doddering old man. Sitting in the White House with nuclear launch codes. Right. Let's jump down to number five. We're going to show you some clips from today's testimony. Is the testimony still underway? It's still underway right now. It's still happening right now. That's what I thought. I had been watching it earlier this morning. So these video clips are complements of C-SPAN. And in this first one, Mr. Herr, again, the

special counsel who was appointed to look into how Mr. Biden handled classified documents after he left the vice presidency. In this, he said he identified evidence that Joe Biden willfully retained classified materials. Let's watch. My team and I conducted a thorough independent investigation. We identified evidence that the president willfully retained classified materials after the end of his vice presidency when he was a private citizen. This evidence included an audio recorded conversation during which Mr. Biden told his ghostwriter that he had, quote, just found all the classified stuff downstairs, end quote. When Mr. Biden said this, he was a private citizen

speaking to his ghostwriter in his private rental home in Virginia. So in that particular segment there, this is a special counsel, her laying out the case that yes, President Joe Biden willfully retained classified documents. Now, Rick, anybody else in the world, anybody, you, all right, if you willfully retained classified documents, what would happen to you? You'd go to prison, but you don't even have to willfully do it. Right. You just have it. You're just in possession.

You go to prison. Willfully or unwillfully, possession sends you to prison. The only difference might be the number of years that you're sent to prison. Right. But you're going to prison. He mentioned that they had an audio recording. And so I'm going to jump down to number seven. Yes.

And do they play the recording? No, they don't. He just talks about it. Let's watch. So you have audio recording from his ghostwriter where the president acknowledges that the information he has is classified and he's sharing with his ghostwriter. We have an audio recording capturing a statement from Mr. Biden saying to his ghostwriter in February of 2017, quote, I just found all the classified stuff downstairs, end quote. And then again, reciting passages from a meeting in the situation. Yes.

And those are in President Biden's own words. Correct. Right. So he's and the ghostwriter has no classified. No, he has no clearance, no classified clearance to anything. Correct. That is our understanding that Mr. Zwanitzer was not authorized to receive classified information. So there's another crime, right?

His speechwriter was in possession of classified documents. And later on, we'll show a clip where the ghostwriter, the speechwriter, actually attempted to destroy evidence. We'll have that. That's another crime. So obstruction of justice. But right now, down in just miles from us, Fort Pierce, Florida, at the federal courthouse, Mr. Trump will be on trial in Fort Pierce for having possession of classified documents in Mar-a-Lago, his home.

That's right. He's facing something like 450 years in prison. What's wrong with this story? What's happening here you you have a federal investigator saying we have mr biden admitting we have an audio recording of him saying i just found all the classified documents and he's not going to go to prison that's right he's not even going to be indicted yes he's not going to resign but mr Trump is going to go to prison for 450 years we have two sets of

we have a double justice system now the law is no longer fair justice is no longer blind if you are a Republican if you're a conservative if you're a patriot if you're a Christian, if you're a conservative, if you're a patriot, if you're a Christian, you will probably go to prison.

If you're a leftist, a Democrat, a deep stater, you'll get rewarded. You'll get a reward for breaking the law. You'll get promoted. But you're not going to be prosecuted. You're not going to be prosecuted. You're not going to go to prison. This is devastating to the image of the United States of America as a constitutional republic built on the rule of law. report, President Biden made his memory an issue. Yes. I mean, he made his memory an issue. And so you can't blame it on special counsel Herr making an issue because it really was President Biden that did that. He put himself out there.

He put his memory and his recollection on public trial. Did Mr. Biden or his advisors not think that this would happen, that the transcript would be released, that Mr. Herr would be brought in before a congressional committee? Did they not think this through? It's like they rushed out quickly to do damage control. Oh, they did. And they created more damage. But what happened in congressional testimony today is the Democrats tried to accuse her of making memory an issue. And so we have this clip. This is C-SPAN. This is number six

for control. This is special counsel Herr's response to those accusations. The evidence and the president himself put his memory squarely at issue. We interviewed the president and asked him about his recorded statement. Quote, I just found all the classified stuff downstairs, end quote. He told us that he didn't remember saying that to his ghostwriter. He also said he didn't remember finding any classified material in his home after his vice presidency. And he didn't remember anything about how classified documents about Afghanistan made their way into his garage. My assessment in the report about the relevance of the president's memory was necessary and accurate and fair. Most importantly, what I wrote is what I believe the

evidence shows and what I expect jurors would perceive and believe. I did not sanitize my explanation, nor did I disparage the president unfairly. I explained to the attorney general my decision and the reasons for it. That's what I was required to do. You know, the story as it's developed and everything, we know about the classified documents at the University of Pennsylvania Center, the Chinese funded University of Pennsylvania Center, and about his garage. But Rick, in this next clip we'll share with you Special Counsel Herr gets questioned about all the places that classified documents. Are there more places? Oh yes.

Wait until you see this clip. Let's watch. Mr. Herr, classified documents were found at the Penn-Biden Center? That's correct. They were found in President Biden's garage? In Wilmington, Delaware, yes. And in his basement den? Also in the same home, yes.

In his main floor office? Correct. And his third floor den? Correct. At the University of Delaware? Correct. And at major and his main floor office. Correct. And his third floor den. Correct. At the University of Delaware. Correct. And at the Biden Institute. Correct. That's seven places, Rick, seven different locations for classified documents being found. At least Donald Trump kept them all in Mar-a-Lago. What is being done to Donald Trump is so unfair. I don't care what you

think about Donald Trump, whether you like him or don't like him, whether you want him elected again or not, it doesn't matter. What they're doing to him is not fair. If you're going to put Mr. Trump in prison, you have to put Mr. Biden in prison. And if you're not going to put Mr. Biden in
