Reports circulating on Monday from various news agencies say President Joe Biden is resisting calls to step down and not seek a second term as president. Meanwhile, the U.S. Supreme Court handed President Trump a major victory on Monday morning. This is true news for Monday, July 1st, 2024. Let's begin our commentary and analysis of today's news by looking at this headline published today by the Wall Street Journal. Supreme Court rules Trump has significant immunity from prosecution.
Starting point is 00:01:44 This is a big story. This is a big one. This is a big story today. This is a big one. This is what he was waiting for. This guts a lot of the case that the Jack Smith case is bringing against President Trump. And so the court said that a president cannot be prosecuted for acts that he took during his presidency that were official acts. Right. Now, he also said that that immunity did not cover unofficial acts.
Starting point is 00:02:17 But whenever the president is carrying out official acts, he has immunity. And so this is going to really pull the rug out from under Jack Smith's case. Not going to end it. But it's going to seriously damage it. It's going to set it back. They're not going to have a trial before the election. Not at this point. No.
Starting point is 00:02:39 There's not enough time to recover from the decision to get refocused. Jonathan Turley, legal expert, had this to say regarding this decision on Fox News earlier this morning. Let me go to you, Jonathan Turley, for a reaction to this decision so far. Well, this is along the lines of what many of us anticipated, that the court did not go with absolute immunity on everything, but did say that there's absolute immunity when it comes to core constitutional powers. We're still going through the opinion to see if there's any assistance on where that line is to be
Starting point is 00:03:15 drawn. This case is going to have to go back to the district court, which is going to have to try to sort of thread this needle to determine what in the case would not fall under these protections. But this is obviously a win for President Trump in the sense that the special counsel was arguing, as with the lower court, that there was very little immunity here to be concerned with. The counsel for the government was assuring the court that they really didn't have much to be concerned with here in terms of any changes in the status of the government was assuring the court that they really didn't have much to be concerned with here in terms of any changes in the status of the case. That's clearly not what won the day.
Starting point is 00:03:51 The court here is saying that we do need lines here drawn to protect presidents, so they have some breathing room. And you have to sort of wonder how the context affected the justices. I mean, if they want to look at the implications of leaving presidents without protection, they just need to look around the country. Even though Manhattan was not a federal case, it was a political prosecution in the view of many of us that was rather raw and open. And so this is a context that must have concentrated the minds of these justices as they did what Justice Gorsuch said and tried to write for the ages to have something not for this case, but for
Starting point is 00:04:29 future cases and future presidents. Donald Trump did it again. Teflon Don. It is amazing. Now, it wasn't a total win for him today. No. But it's a big win. Right.
Starting point is 00:04:45 And this is going to knock the case off the schedule for the election year. There's no way Jack Smith's going to be able to finish this case this year, which means it's going to get thrown into 2025. Donald Trump's going to be in the White House. So what it means is that each aspect of Jack Smith's case now has to be analyzed as to whether President Trump was acting in his constitutional capacity or an unofficial capacity. That's right. And there's going to be a fight over each one of those lines. That's right. And that's why it gets stretched out beyond the election at this point. And the government –
Starting point is 00:05:22 So they punted and they actually got to run the ball down the field they did the government lawyers were telling the supreme court um hey there's hardly this is so it so cut and dry you shouldn't even be wasting any time thinking about it just rule in our favor but the but the court did think about it and the court said no there's a lot here that has to be decided. And they ended up deciding in favor of Donald Trump. Now, another major court ruling today, New York Times reporting, the Supreme Court declines to rule on technology platforms, free speech rights.
Starting point is 00:06:02 Now, notice how they phrase this, the free speech rights of technology platforms. The case that was decided was two laws, one from Texas, one from Florida, that put restrictions on technology social media platforms from deplatforming and censoring people. Right. That's the essence of it. They ought to go out and say, you know, tech platforms' right to deplatform. But the argument that the technology companies made was, you're infringing on our free speech rights. We have the right to decide that you can't be heard or seen.
Starting point is 00:06:49 Right. So the Supreme Court did not rule one way or the other. They kicked it back. They kicked the can down the road. They sent it back to a lower court to decide. But here in Florida, Florida's law actually said candidates could not – a candidate or public office holder could not be censored or deplatformed. So the law is still on hold. It hasn't been ruled unconstitutional, but it's not been ruled constitutional.
Starting point is 00:07:18 What the judges said was that the lower courts needed to spend more time studying and reviewing the laws. And make another decision. So it just got delayed. Not a good one for free speech. Yeah, major decisions today. Now, the thing that we're going to spend some time, you know, probably the next 20 minutes talking about here is the fallout from the Democratic. Well, the fallout from the debate last week where the whole world saw Joe Biden, the real Joe Biden, the real Joe Biden struggling to form sentences. And now the spin is underway. What appeared to be a clear case where the Democrats are going to push Joe Biden out and get a new candidate.
Starting point is 00:08:16 That's not where we're at today. It looked like that last week. I mean, they were in a state of shock Thursday night after the debate, and Friday they were panicking. But today, it's a different story. And they're going to stick with Joe Biden, Doc. We'll see. All right. We'll see.
Starting point is 00:08:39 All right. Let's look at it. Democrats say one thing. So Reuters, top Democrats rule out replacing Biden amid calls for him to quit 2024 race. This is the way Reuters is seeing it. So top Democrats on Sunday ruled out the possibility of replacing President Joe Biden as their nominee after a feeble debate performance and called on party members to focus instead on the consequences of a second Trump presidency. After days of hand-wringing about Biden's poor night on stage debating Trump, Democratic leaders firmly rejected calls for their party to choose a younger presidential candidate for the November 5th election.
Starting point is 00:09:28 Biden, 81, meanwhile, was huddling with family members at the Camp David presidential retreat on Sunday. The New York Times cited people close to the situation as saying that Biden's family were urging him to stay in the race and keep fighting. The paper said some members of his clan privately expressed exasperation how his staff prepared him for Thursday night's event. In other words, they're blaming his top aides for his performance. The unfortunate truth is that Biden should withdraw from the race for the good of the nation he serves so admirably for half a century. And that's coming from the Atlanta Journal-Constitution, speaking editorial on Sunday.
Starting point is 00:10:06 The shade of retirement is now necessary for President Biden. Democratic leaders rejected it. And that makes a second major newspaper outlet in the country, New York Times being the first one, now the Atlanta Journal-Constitution being the second. That has called for Joe Biden to step down. Absolutely not, responded Georgia Democratic Senator Raphael Warnock, one of several Democrats seen as a possible replacement for Biden. We actually have a clip of Senator Warnock.
Starting point is 00:10:34 I don't know if you want to run it now or not. Yeah, let's do it. It's number nine. He was on Meet the Press. And, man, he's taking a hard line saying there's nothing wrong with biden he just had a bad night right just an off night let's watch this yeah morning to you it is great to have you here let me start with the debate president biden had one goal to prove to voters that he was capable of serving another four years in office. By all accounts, he did not meet his own benchmark.
Starting point is 00:11:07 Your hometown paper, the Atlanta Journal-Constitution, has joined the list of newspapers calling for him to drop out. Do you think President Biden should drop out of this race, Senator? Oh, absolutely not. You know, they say if it's Sunday morning, it's meet the press. I'll tell you, as a pastor, it's for me, it's church time. And I can tell you that there have been more than a few Sundays when I wish I had preached a better sermon. But after the sermon was over, it was my job to embody the message, to show up for the people that I serve.
Starting point is 00:11:41 And that's what Joe Biden has been doing his entire life, his entire life of public service. And over the last four years, he's been showing up for the American people. He's been showing up for seniors as they've been dealing with the rising cost of prescription drugs of having to choose between buying food and buying medicine in the wealthiest nation on the planet. He's been showing up for workers. He's been showing up for folks who, chasing the American dream, found themselves mired in student debt, a kind of government-sanctioned debt trap. And he found a way, while being resisted by Trump's allies, to forgive that debt and give people a fighting chance.
Starting point is 00:12:24 The question this morning is not, what is Joe Biden going to do? The question is, who has Donald Trump ever shown up for other than himself and people like himself? I'm with Joe Biden, and it's our assignment to make sure that he gets over the finish line come November, not for his sake, but for the country's sake. Senator, I hear you saying, look, this was a bad performance, but a lot of Democrats are saying, boy, it was more than that. It raised real concerns about his readiness, his ability to serve another four years. What was your reaction when you saw him struggling to complete sentences? Well, listen, if they weren't engaged in a little bit of hand-wringing, they wouldn't be Democrats. And again, maybe it's because I preach every Sunday.
Starting point is 00:13:12 There are bad debates happening, as President Obama has said. And this was 90 minutes. There's bad debates and there's really bad debates. You got to give him credit. He's slick. And, you know, they're circling the wagons for now. For now, they're circling the wagons. We got about two months.
Starting point is 00:13:38 Yes. No, about six weeks. Yes. Mid-August is the Democratic convention. But there are mixed messages coming out of media reports here. I mean, what the senator from Georgia, I mean, it's the old line, who are you going to believe, me or your lying eyes? Your lying eyes, right. So the whole world saw Joe Biden.
Starting point is 00:13:59 But this wasn't new. This is the thing that really gets me about how the news media and the democrats are playing this game they acted thursday night like oh shucks look at that look at that he's he's senile he's got dementia when did this happen how come nobody told us no you knew about it for a long time. What the shock was, they realized. The American people now know. The American people now know. And there was no way for them to lie and spin it. Okay.
Starting point is 00:14:34 The Democrats knew he was mentally gone a year or two ago. I mean, if you look at videos of Joe Biden in 2020, he still had control of his mind. He was in the debates with Donald Trump. He was still functioning. But along the way, he clearly regressed and is no longer a no longer has a firm grasp on reality. Over the weekend, the Michigan governor, Gretchen Whitmer, said,
Starting point is 00:16:10 I will not run. I don't want anybody trying to draft me. I don't want anybody working to get me elected president. However, I have a warning to Joe Biden. Okay? What was the warning? You're going to lose the state of Michigan. Yes. In fact, she said the state
Starting point is 00:16:36 of Michigan is no longer winnable. She doesn't believe they can pull it out. It's in a nosedive. And she's the governor. And she can't take the lead to get the state to go Democrat.
Starting point is 00:16:53 To me, that just signals how big the damage was from the debate. Yes. So there's the first one. And you've got it. You're on to this. This is where I'm going with it. The damage was so bad that nobody wants to be tainted with it. Right. Our next story, and the timing is amazing here.
Starting point is 00:17:13 So, Daily News, Steve Bannon will report to prison Monday to begin a four-month sentence. And while we were watching the Senator Vance video, a doc told me that Steve Bannon just turned himself in to a federal prison. Trevor Burrus, Jr.: Yes, this is from WBAL in Baltimore radio station that Trump ally Steve Bannon surrendered to federal prison to serve a four-month sentence. That's going to be a prison in Danbury, Connecticut, Rick. So he is surrendering today. Any other news day, this would probably be a top story for us.
Starting point is 00:17:50 But last night, Steve Bannon was very vocal about everything that was going on as far as him surrendering to federal authorities and everything. What he's going to prison for is contempt of Congress. Which means he didn't respond to a subpoena to give testimony. Right. Same as Peter Navarro is right now. But, you know, all this, Doc, brings back something from August of 2016. Right. From August of 2016, when Mr. Bannon was a new advisor to – well, at that time, presidential candidate Donald Trump. Yes.
Starting point is 00:18:35 And he made a comment. A couple weeks before – well, a month and a half before the election. He made a comment that caused you and me to pause and go, what do you mean by that? There's the article from 2016. You see the headline? Steve Bannon, Trump's top guy, told me he was a Leninist. As in Lenin. Right.
Starting point is 00:19:00 From the Soviet Union. Right. The Bolshevik Communist Revolution. He went on to say, this is Bannon, Lenin, he answered, wanted to destroy the state, and that's my goal too. I want to bring everything crashing down and destroy all of today's establishment. Bannon was employing Lenin's strategy for Tea Party populist goals. He included in that group the Republican and Democratic parties,
Starting point is 00:19:22 as well as the traditional conservative press. So not only was he identifying as a Leninist, but by bringing everything down, he was also identifying as an anarchist. And so, you're right, this gave us pause, and so everything Steve Bannon
