Yeah, it's a situation that catches a lot of people off guard, especially first-time offenders.

Let's start with the basics. What exactly is a DWI in Texas? And what kind of penalties are we talking about here? So in Texas, driving while intoxicated means operating a motor vehicle in a public place
Starting point is 00:00:49 with a blood alcohol concentration of 0.08% or more, or basically not having normal use of your mental or physical faculties due to alcohol or drugs. For a first time offense, you're looking at fine. fines up to $2,000, jail time anywhere from 3 to 180 days, and your driver's license can be suspended for up to a year. Wow, that's pretty serious. And I'm guessing those penalties can go up depending on the circumstances. Oh, definitely.

If you have a child in the car, that's a whole different ballgame with mandatory suspension periods. Right. Makes sense. Now, let's say someone just got arrested. What should they actually do in that moment? First thing, stay calm and cooperate. I know that sounds simple, but getting aggressive or confrontational can make things worse. You're legally required to provide ID and comply with chemical tests under Texas's implied consent law. But here's the key. You have the right to remain silent in the right to consult an attorney before answering any incriminating questions.
