UNBIASED - Cornell Case Update: Jane Doe’s Sworn Statement, New Texts & What the Title IX Investigation Found
Episode Date: October 17, 2026This episode is a full update on the Cornell University Jane Doe case and the allegations involving members of the Chi Phi fraternity. We start with the six-page sworn statement Jane Doe gave Cornell... investigators — the statement that was ultimately sent to the Tompkins County District Attorney before prosecutors declined to bring criminal charges. We walk through what Jane Doe said happened that night, what the DA actually reviewed, and why prosecutors originally concluded the evidence did not establish lack of consent under New York criminal law. Then, we go through the newly released text-message exchanges between Jane Doe, Matthew Ingalls and Jonathan Newell in the days and weeks after the alleged assault, including the messages both sides are likely to point to as the civil lawsuit and renewed criminal investigation move forward. We also break down Cornell’s Title IX findings against the accused students, who was found responsible for sexual assault, what punishments were imposed, and the critical difference between Cornell’s definition of incapacitation and New York’s criminal law. Plus: Winston Lee joins Gillio Lopes in seeking to remove New York Attorney General Letitia James from the criminal investigation; Cornell’s Faculty Senate debates a no-confidence resolution; Tompkins County lawmakers consider an independent audit of the District Attorney’s Office; Cornell brings in New York State Police investigators; new data reveals how Cornell has historically punished students found responsible for sexual assault; and one of the students expelled in the Jane Doe case reportedly transferred to Nova Southeastern University. This episode separates what Jane Doe alleges, what the accused men say, what Cornell’s internal investigation found, what prosecutors previously concluded, and what remains unresolved as the investigation continues. Welcome back to Unbiased Politics. It is Saturday, October 17th, and we have a lot to catch up on with the Cornell situation. So we're doing a special episode today. I have been excluding these updates from the last two episodes just because all of this really needed its own episode. It would have taken up too much time in the more recent episodes. And we had, of course, other things to cover. So since we last spoke, we've gotten the six-page sworn statement that was sent to the DA, more text messages between Jane Doe and some of the accused and the Title IX findings. Also,
Also, all frat events have now been canceled.
Students pursuing criminal charges will now have access to independent New York State
police investigators.
One of the accused is asking for a gag order.
There are also other legal developments as well.
So we're going to cover it all.
This is how we're going to do it.
We will spend the first 20 minutes or so covering the six-page sworn statement, along with
a brief analysis of why the DA chose not to pursue charges.
then we'll spend the next 20 minutes after that covering the newly released text exchanges between
Jane Doe and two of the accused men.
We'll also include another brief analysis after that.
And then we'll spend about 10 minutes covering the Title IX findings.
And we'll spend the last five minutes or so covering some of the other updates like the banning
of the frat events, some legal updates, the no confidence meeting, stuff like that.
So with that, let's start with the sworn statement.
And also, I guess I should mention, I know a lot of you are here for the updates, obviously,
but as we go through this sworn statement and the text messages, so really the first 40 minutes of
this episode, it will be a lot of reading. I'm going to be reading Jane Doe's sworn statement.
I'm going to be reading the text messages verbatim. So it's a lot of reading. Just keep that in mind.
Now specifically as it pertains to this six-page statement, this is the statement that Jane Doe signed off on
after her two-day interview with investigators. This is the statement that,
was supposed to summarize the statements she made in that interview. And this is the statement that was
sent to the DA when Cornell investigators asked the DA whether criminal charges were warranted,
and the DA ultimately said no. Now, this goes without saying, but I'm not going to read all six pages
in full. We would be here all day. I will, however, read you the relevant portions, which is actually
most of the statement, if I'm being honest, if you do want to read all six pages in full,
you can always find it in the sources section for this episode, which can be found on my website,
unbiasednetwork.com, or you can always find the link in the show notes for today's episode.
I will be filling in the names of the men where I know the names belong just to make it easier to
follow. Otherwise, I'll be saying the word redacted a million times. It'll be really hard to keep up.
If I don't know for sure that a person's name belongs there, I will say redacted.
So she starts the statement by explaining that she was going out with her sorority.
sisters that night and prior to actually going out to the bar, she started drinking with all of them
at the sorority house where they lived. She says that by 8.30 p.m. that night, she was at about a five or a six
out of ten out of ten in terms of intoxication, then went to a bar called Moone's where she said she was
served more alcohol despite having a mark on her hand indicating that she was underage. She then went to
another bar called Lot 10, where she did not have any additional drinks, but it was there that she
says she realized all of her friends were really drunk and with their dates. So she decided to head over to
the kifai house to see her friend Matthew Ingalls. She also noted that she had gone to the kifai
house about 10 days prior with her brother. And while she was there, the time before this incident,
one of the frat brothers offered her ketamine, but she declined because she says she doesn't
believe in using her drugs and ketamine's not her speed. So fast forward to October 19th,
Jane Doe writes, quote, when I got to 10.7 Edgemore Lane, it was between 10.30 p.m. and 11 p.m.
and I remember feeling numb from being cold and intoxicated.
At this point, I would say I was about a five out of ten level of intoxication.
Shortly after that, Ingalls got me a beer, which I'm fairly certain was unopened because
I believe I opened the beer can with my teeth.
Ingalls and I then went onto the dance floor where we danced a little.
I would say that our dancing was definitely flirtatious in nature.
I was okay with the dancing being flirtatious in nature because I was attracted to Ingalls
and was open to the idea of dating him.
At some point, while we were dancing, Ingle said he wanted to ask me something and pulled me
over to a quiet area. Ingalls asked how I would feel about having a threesome with two male partners.
At first, I was kind of shocked, but I eventually agreed due to how attracted I was to Ingalls
on top of my drunken curiousness. I asked Ingalls who the other male partner would be, and he
responded by saying, we'll find someone. Ingalls had me follow him down the hallway. When I entered
the room, Newell was already sitting on a couch inside of the room. I know it was Newell because I've
known Newell for about a year. I've also previously been intimate with Newell one time, which was
around September or October of 2023. From what I remember, I believe at this point, it was just
Ingalls, Newell, and myself that were in this room. I remember being excited because I thought
that Ingles and Newell wanting to have a threesome meant they were gay, which would have meant
they were part of my community as I am bisexual. I believe I said something like, I didn't know
you were all fruity. Redacted responded by saying he was homo curious, redacted just kind of laughed
and didn't say anything else. At the start of the threesome, I would say I was about a five or six out of
10 level of intoxication. I would say that I was pretty okay with having this threesome with Ingls and
Newell. During the threesome, I began to feel Newell hit me many times on my butt. I remember that
the hits were hurting me and one hit in particular sent a sharp pain through me, which caused me
to turn around and say, damn. I remember that particular hit was jolting and forced me to pause momentarily.
At that point, I noticed that Ingalls appeared really sleepy and he was no longer fully erect,
which led me to stop giving him oral sex.
At the same time, I told Newell that we needed to stop having sex in order to make sure Ingl's
was okay.
Newell then stopped having sex with me and Ingles took a seat on the couch while saying something
like, I'm going to die.
Newell laughed at that and I was really confused because I wasn't sure if Engels was serious
about dying.
Ingalls then said he was going to take a nap and refresh himself and he proceeded to fall
asleep on the couch.
While Ingalls was sleeping, Newell began to dry heave as if he was going to vomit.
I began to take care of Newell by patting his back while also wake him.
Ingalls every few minutes to make sure he was okay. At this point, I had my dress mostly back on,
and I was consoling Newell on the couch and telling him it was okay if he needed to vomit.
Newell told me he was pretty sure he wasn't going to vomit. Eventually, Newell and I would start
making out for a very short amount of time. While Newell and I were making out, he reached for
the area near my vagina several times, and each time he did, I would swat his hand away.
While we were making out, there was a knock at the door. I asked Newell if I should open the door,
and he replied by saying yes and that it was probably Lopes who lived in the room we were currently in.
Hearing that we were in Lopes room, I decided to let him in because it was his room.
When Lopes entered the room, Newell told me to sit on his lap.
Newell could see now, was still not wearing any pants, and he was fully erect.
I sat on Newell's lap using my dress as a barrier between him and me.
As I was sitting on Newell's lap, Lopes introduced himself to me and reached out to shake my hand.
When I made contact with Lopes' hand, he pulled me into him and we began making out.
while Lopes was kissing me, Newell began groping me. Specifically, he began reaching for the area
near my vagina again. Eventually, Lopes, Newell, and myself would end up on the bed next to the bed
where Ingalls was sleeping and we began to have a threesome. I don't remember much of this threesome
with Lopes and Newell because much of the night after Lopes entered the room, I was pretty
incapacitated. I do remember performing oral sex on Redacted while Redacted had vaginal sex
with me from behind. I don't specifically remember having sex with Redacted at that point, but I do
remember hearing Lopes and Newell say something about having a turn. While Lopes Newell and I were
having a threesome, Ingalls would eventually wake up. When he woke up, he saw that Lopes Newell and I were
having a threesome and exclaimed, hell yeah. Ingalls then said, he wanted to take part and asked about
making it a foursome, to which I said, hell no. I said, hell no, because I knew a foursome meant that
I would have to take part in anal sex, which I am very much so against doing based on a traumatic experience
I've had with that in the past. I don't remember much of what happened directly after I told Ingle,
knows no to the foresum, but at some point, Lopes left the room without me realizing.
Lopes didn't say anything to me prior to leaving the room from what I remember.
From what I remember, at one point, at that point, a group of multiple men walked into the room.
I was instantly horrified, and I remember squealing out loud and running across the room
and hiding under the covers on another bed that was in the room.
End quote.
Okay, so just to save time here, she says, she knew one of the guys that came into the room
but didn't know the two others.
She felt like there was also a fourth person in the room, but couldn't
remember that one's name. She said, quote, the night becomes really, the night really becomes a blur
for me at that point. I don't remember much of what happened in the next few minutes, but I do remember
being covered up in the bed. At some point, the person who was introduced to me as Sarabia said something
very rude and mean to me. I don't remember exactly what he said, but I remember that even the other
guys in the room had a negative reaction to what Sarabia had said to me. I instantly became defensive
and sat up quickly in the bed to confront Sarabia about what he had said to me. In doing so, the covers had
fallen off my breasts, which were now exposed to everyone in the room. As I was defending myself to
Sarabia and yelling at him, he apologized and grabbed my face and started kissing me. I quickly
backed away to stop Sarabia from kissing me, and I remember not having many emotions at that point
because I was starting to become completely numb to the whole situation. I remember grabbing
Newell's arm at some point and saying to him, I don't know who any of these people are. Newell replied
by laughing and asked if I wanted to do more ketamine. When he asked that, it hit me that I had taken ketamine
on the couch with Newell and Ingalls earlier in the night. Redacted would later tell me I had also
smoked marijuana from a large bong, as well as consumed Jamaican liquor while on the couch with him
and redacted. I remember smoking marijuana, but the ketamine and Jamaican liquor, I have zero
memory of. All I could remember was the feeling that I had already done ketamine once, so why not do it a
second time? Also, I had become extremely uncomfortable with how this night was turning out. So my thought
was, if I do ketamine again, maybe I'll pass out. My thought was that if I passed out and these men
had sex with me, then they could be charged with rape. At that point, Newell poured a line of
ketamine on his erect penis, implying for me to snort the line. I then snorted the line of ketamine,
which was a heavy amount of ketamine. I know it was a heavy amount based on how hard it hit me.
At that point, I was back under the covers and Newell got under the covers with me where he again
tried reaching for the area of my vagina. I should say that during my entire time on the bed,
surrounded by these men, Newell did reach for my vagina multiple times. At that point,
the group of men began flooding me with compliments about my belly.
body. All of them were talking about how pretty I was, which was very confusing to me because
although it was very nice to hear these things being said, I was still very uncomfortable with the
situation I was in. Shortly after that, I believe it was redacted who asked if they could all do
drugs off of my perfect body. Seeing as I was already laying down and feeling extremely tired,
I told him, sure. And then a group of men all started pouring various things all over my body.
At some point, shortly after the men were doing drugs off my body, loaps and another male
enter the room and said something like, okay, we're shutting down whatever the fuck
this is. When Lopes and the other males said they were shutting it down, the group of men all began to
scatter. I attempted to get up off the bed, but became very dizzy due to my pot syndrome, as well as the
fact that I had consumed that extra bump of ketamine. I remember one of the guys had his hand on my
back, and he encouraged me to stay seated for as long as I needed to. He even told the other men to
give me a second so I could gather myself. Eventually, I was able to stand up from the bed, and someone was able to
get my dress and bring it to me. I then put my dress on, but had to sit down again due to how
dizzy I was. At that point, Ingles and Lee ushered me out of the room and brought me upstairs to a small
room. Once we were inside of the office space, Ingles and Lee sat on chairs and one of them said,
let's do more ketamine. Ingles and Lee then poured some ketamine, but I can't remember
where they poured it. I remember snorting more ketamine, and this time it made my eyes feel like
they were spinning in opposite directions. I remember feeling extremely high and trying to close
my eyes to stop them from spinning. At this point, Engels said he wanted to have sex again because
he wanted redemption for passing out earlier in the night during the threesome with himself Newell and
me. I told Ingles that I was tired in an attempt to prolong having to answer his question. I don't
remember how it started, but somehow I was having a threesome in the office space with Ingles and Lee.
I was performing oral sex on Lee while Ingalls had vaginal sex with me from behind. I remember
being totally disgusted at the situation and I felt very tired and intoxicated. I would say that my
level of overall intoxication was about an eight out of ten level of intoxicated. I would say that it was
the most intoxicated I've ever been in my life. I felt like I was unable to make any decisions because
of how intoxicated I was. The threesome continued until at some point around 5.45 a.m. I said that I was tired
and needed to turn in. At that point, both guys stopped the threesome with me as far as I can remember.
Ingalls told me that I could stay the rest of the night in his bed, and he brought me to his room.
I fell asleep in Engle's bed and woke up at around 10 a.m. on Sunday, October 20th. Shortly after
I woke up, Redacted was hovering over me with both of his arms on either side of me. I asked him
what he was doing and he said he was going to put his penis in my mouth. I replied by saying,
know in a mean way to him, and at that point he got away from me. Shortly after that, Ingalls
drove me back to my sorority house. When I walked inside of my house, a bunch of my sorority sisters
were there, and they asked what had happened to me based on how rough I looked. I replied by
simply saying ketamine and walked upstairs to my room. I then took a shower, which is when I noticed
the bruising starting to form on my butt. I canceled my plans for the entire day and took some
preemptive medicine for what felt like an oncoming urinary tract infection, and then I went to
to sleep. When I woke up later that day at around 4 or 5 p.m. I was made aware that what had happened
to me at Kai Fi was becoming public knowledge. It was made clear to me by several friends that the
members of Kai Fi were bragging about having an eight some with me. Some rumors said it was 10 people,
but nonetheless, it was now obvious that everyone knew it was me that this had happened to. During
this whole situation that took place at the Kai Phi fraternity, I want it stated that I had to swat
Newell's hand away several times from the area of my vagina. And I believe I even told him that I was
uncomfortable at certain points during the night. Also, when Ingalls was asking me about wanting to
have sex again while in the office space, I told him that I was tired and I believe I said something
along the lines of, I don't have it in me. Ingles had asked me several times and I don't remember
at all how we started having that threesome. Also, while in the office space, I remember redacted asking
me to give him oral sex and he stated he couldn't get erect. I told him that if he couldn't get
himself erect, then I wouldn't be able to. Again, I don't remember how that threesome started,
but I do remember that both Ingalls and Lee were asking me to have sex so many times that I finally gave in.
To me, that felt like coercion. Also, I felt like due to my intoxication, they should have known how intoxicated I was based on how I was slurring my words.
End quote. So that is the six-page sworn statement that was given to the DA when Cornell Police asked the DA to review it and decide whether criminal charges were warranted.
The DA reviewed the statement, determined there was no evidence of lack of consent.
So remember, under New York law for sex offenses to be brought, there has to be a lack of consent.
Now, lack of consent can result from either forcible compulsion, mental incapacitation of the victim, physical helplessness of the victim, or where the victim clearly expressed that she did not consent to the act.
So the DA in this case specifically said, quote, there's no evidence in Jane Doe's statement indicating that she clearly expressed that she did not consent to the act.
according to the statement, each time Jane Doe asked to stop the sexual conduct, the sexual conduct stopped.
Thus, with no evidence of a lack of consent, criminal charges simply could not be sustained, end quote.
Now, something to note is that Jane Doe said at one point in her statement, quote, I was pretty incapacitated, end quote.
And as we just said, incapacitation can be a, can cause a lack of consent.
But in New York, for incapacitation to result in lack of consent, the drugs or alcohol
causing the incapacitation had to have been administered without consent.
So the DA determined through reading that statement that the, that the ingestion of drugs
and alcohol was completely voluntary.
And therefore, despite her saying in that statement that she was she was pretty incapacitated,
the DA determined that the legal definition of incapacitation under New York state law was not met.
Now, we do know that the DA's office did not review Jane Doe's actual interview transcript,
and we know that the DA's office chose not to review the additional evidence that came later.
So whether that additional evidence or a review of the interview transcript would have changed the DA's mind,
something we'll never know. But as we've discussed, this is now in the Attorney General's hand.
So she will now review all of the evidence, all of the evidence that's available, and will
ultimately decide whether in her view the legal definition of lack of consent was met.
Now, later in this episode, we will cover Cornell's Title IX findings. And you will see how
Cornell's definition of lack of consent is very different than the definition under New York state law.
and why that changed the result, why criminal charges weren't brought,
but some of these students were, in fact, found responsible for sexual assault under Cornell's policies.
So let's take a break here.
When we come back, we'll get to some of the new text exchanges.
We'll also talk about the Title IX findings.
And then, of course, we'll get to some of the other updates.

So the other big update is the fact that the full text exchanges between Jane Doe and
Jonathan Newell and Jane Doe and Matthew Ingalls have been released.
Now keep in mind, I have been saying over the last couple of weeks that we have only gotten
snippets of the full story, right?
Outlets choose, they have editorial discretion, and they choose what to roll.
report on and what ultimately makes it to the public, assuming the public doesn't have access to
these documents that the outlets are reporting on, right? So this is a perfect example. Originally,
we knew that Jonathan Newell texted Jane Doe apologizing for how things went down. He said his
memory is quote unquote kind of fuzzy and that he and another man we didn't know who at the time
feel bad for being too intoxicated to, quote, shut it down and kick people out before it got way out of
hand, end quote. And we know that Jane Doe replied that her memory is quote unquote super clouded
too and that Jane Doe said that they had all been heavily intoxicated and that she wrote,
quote, none of the sexual stuff was illegal. End quote. We also know that she told Newell that
she liked being with him and another man. And we know that she suggested they smoked together again,
but quote, like leave out the extra five billion men and ketamine. End quote. So,
That's what was reported a couple of weeks ago. That was the extent of what we knew. But at the time, I said, keep in mind, these are snippets of a conversation. And now a few weeks later, we have the full exchange. So Newell texted, we'll cover Newell's text first and then we'll get to Jane Doe's text with Ingl's. So Newell texted Jane Doe and wrote, hey, I just want to apologize for how things went down the other night. My memory is kind of fuzzy about a lot of it. But me and Ingalls both feel like shit for being too fucked up to shut it down and kick people out before it got out of hand.
You're an amazing person, and I genuinely hope you're not catching as much heat from this as we are.
We've been shutting down any stories we've heard, but again, I'm so, so sorry.
Jane Doe then replies, aw, I really appreciate this text.
My memory is super clouded, too.
I think we were all way too fucking drunk and high.
I'm getting a little heat.
Pai-fi girls can't get my name out of their mouth, but that's to be expected.
But at the end of the day, none of the sexual stuff was illegal, and honestly, I really liked being with you and Matt.
So anything anyone has to say about the gang bang is out of their jurisdiction.
I don't think we should feel any shame for the party. Our body, our choice. Also, yes, while it may have
been nice for like only four people to have been around, y'all were both super out of it and they should
have taken it upon themselves to leave. At the end of the day, you, Matt and I were in your bed and they
didn't need to get up in that. But if you have any regrets or anything you want to talk about,
I'm always here to talk about it because that was a lot. I really do love you and Matt and I promise
I won't get quiet and weird with you like I did last time. P.S. I'm not sure if you remember,
but I did ketamine off your dick at some point, and I honestly think that was one of the most insane jaw-dropping moments of the night, end quote.
Newell then writes, quote, I'm just glad you're okay. I was kind of upset with all the stories going around earlier, but at the end of the day, that's all they are.
And I have no memory of that last part with he adds a couple of crying emojis.
Do then writes, oh, Jesus, not the stories. I don't even think I want to know. I know I'm socially a massive slut right now, and I like can't bear to hear it because I'm really.
really not. Newell replied, funny enough, I haven't heard your name yet in any of them. Someone
thought Matt Odeed in the room, though. Doe responds. I heard that one too, but it was the night before.
Honestly, it was such a good time for it to happen because I heard everyone went feral that Friday and
Saturday. Newell responds, oh yeah, it was, but pretty good timing. Just makes everything less
believable. Doe replies, it'll be funny in a couple of months. Newell replies, so funny.
Doe then writes, we should smoke again sometime, but like leave out the extra five billion men.
and ketamine. Newell responds, oh, definitely, I'm off hard drugs for good. Doe then tells Newell that
she lost her earrings. Newell says he'll look for them when he cleans the next day after class.
And then Doe says, quote, marked it on rice purity, so I'm good. I've got all the mom lore I need,
end quote. They then exchange a couple of emojis. And their next text exchange is three days later
when Doe texted Newell saying, quote, redacted said, I should talk to you,
now. What happened? Newell then initially writes, huh? That's off. Nothing happened. But then a couple of hours,
Newell writes again, oh, I was at Pi-Fi last night. I think that's it. That Pi-Fi is presumably
her sorority. He says, I went like fully prepared to be interrogated and denied and deny everything,
but they never even brought it up. I think it's mostly blown over by now. Doe doesn't reply to
that text message from Newell, but then six days later, so Halloween, October 1st, October 30,
first. Doe writes, did you find my earrings? My mom gave them to me for my birthday. I really want them back. Newell replies, I'm
sorry, I haven't seen them. I'll look more when I get back from class. What do they look like? Doe then sends Newell a
picture. Newell says, okay, I'll look right now. How are you, by the way? Doe doesn't respond.
A few hours later, Newell says, cleaned my section of the room and didn't find them. I'll do a full room,
clean tomorrow, and look. Sorry, I've been busy with setup. And there he is presumably talking about
the setup for the Halloween party, because as we'll talk about in a bit,
Kai Phi was hosting a Halloween party that Jane Doe was initially invited to, but then eventually
uninvited from.
So Doe does not respond to that text.
And four days later, on November 3rd, Doe text Newell and writes, quote, let's be clear
that 90% of what happened that night wasn't consensual.
I was given more key than I can remember.
And I know that I told you I felt uncomfortable and I didn't know anyone in the
room. All I remember after that was you giving me Ket to do off your dick in front of everyone
like a sex doll worker." End quote. Newell responds. And I don't remember any of this happening,
which is why I've been feeling so terrible about the whole situation. I know that is no excuse and
neither is how fucked up I was, but I genuinely want you to know and hope you know that had I been
less fucked up and even somewhat aware of the situation and how out of hand it got, I would have
shut it down the second guy started walking in the room. Like I'm so, so sorry for everything
that happened that night and everything you've been going through since. You are genuinely someone
I respect so much and one of the strongest people I know. And even though you're pissed with me for what
happened, which is completely warranted, I still want to be here for you as someone you can talk to
or come to when you need anything. Again, I'm so, so sorry and there's no excuse for anything,
but I'm begging you to please talk to me because I want to be here for you through this.
End quote. So those are the texts we have between Newell and Doe. Now, at this point.
Now for the text between Doe and Matthew Ingalls. Ingalls text to Doe on October 22nd, so three days,
after the incident and says,
Yo, it's Matt. Doe replies,
Hey, King, how you?
What was Convo with your ex?
Engels writes, just something about how I'm the worst person in the world.
Oh, well, I think she needs space and time.
Also, I'm really fucking frustrated that motherfuckers won't stay out of my business.
Doe replies, why does she think that?
What do you mean?
Who's bothering you?
Also, there are probably some crazy mixed emotions about the pregnancy.
That's a really heavy thing for a woman to carry, but still doesn't give right to be mean.
Engels replies, some women in Theta are talking about business to do
exclusively with my ex and I. I don't even know these people. It doesn't matter, though,
it'll pass. And then specifically in response to the pregnancy test, Ingle's writes, yeah, that's true.
And then asks Doe, how are you? Doe responds, quote, people always want to talk about something.
Like I had transgender allegations last year, but I just gave it no attention and it disappeared.
Silence is the most powerful response always. But I always want to say something is the problem.
I'm feeling better, but I took today off because I was just feeling so sick. I always get fevers with my UTI.
Engels responds, exactly. Yeah, I'm so sorry you're going through that. You feeling better today? What's the usual timeline with those? Do doesn't seem to answer that text, but then about seven hours later, she texted him and wrote, quote, bro, everyone knows. I'm incredibly stressed out. Some random bitch told some of my friends. I don't even know who she is. How the fuck does she know me? Engels replies, dude, I have no fucking idea. This shit is incredibly frustrating. And now I know how fast, how fast nonsense spreads at this school. It's fan behavior from everyone talking about it. Boring people have nothing to.
do with their time. It'll blow over in a couple of days, I imagine. Until then, we just have to sit
tight. How have you been coping with the stress? You need anything? Doe replies, I will also say this is
fucking ruining my life temporarily. My reputation is destroyed and I'm utterly ashamed. I'm fucking
pissed because this many people shouldn't know, and I feel like I know who some of the rats in the
room were. If I ever find out, I swear to God, it's on site. Literally, people are making it crazier
every fucking day. On top of it, I have a UTI. All I do is sleep and cry all day. Ingalls replies, I'm
so sorry, dude, this sounds incredibly overwhelming and fucked up on all fronts. I've been dealing
with similar stuff on my end, but obviously it doesn't compare to what you're going through.
The most reassuring thing I can offer is that this will blow over and soon. Stupid bitches like to
yap and the fact they're doing it just shows they're jealous of you for any number of reasons.
I understand the regret, but personally, I don't think you have anything to be ashamed of.
The only shameful thing is how this spread and how people won't shut up about it, which just reflects
poorly, which just reflects poorly on them, to be honest. As far as the UTI, I'm pretty ignorant about how that
works, but if there's anything, medicine, a call, et cetera, you need for me, then let me know
and I can make it happen.
This sucks, dude, but we've both been through worse, right?
I'm sorry if this isn't what you're looking for, but I'm here for you anyway.
And he adds two heart emojis to the end of that message.
Doe responds, you're right.
I think you're right.
It'll get better and you think everyone's just jealous of us, but also like everyone needs
to grow up because sexuality and sex and shit is changing and stuff.
Like, this is going to become more common.
I'm also really open-minded, though.
I love you, King.
Also, tell anyone who gives you shit that I'll actually beat them up.
They don't want the smoke, I promise.
Also, I had transgender allegations last year, too.
So if anyone mentioned it, I mentioned the fact that I've been rumored about so many times.
And we know I'm not transgender.
So Ingles then sends crying emojis.
And then on another day, Ingles texted Joe and wrote, you good, I'm in the library.
Doe writes, Jonathan Deft told people,
Jonathan is Newell. She writes, Jonathan Deft told people, I heard something today and I know he told
people. He was at Pi-Fi two nights ago. Angles responded, quote, he didn't talk about it at Pi-Fi for sure.
They wouldn't bring that up in front of him when his story has been it's not true the whole time.
I'll ask him, though it was definitely one of the upperclassmen in the room who told someone else and spread it.
That one isn't believable, though. Who told you this? If we can narrow down the girl, we can narrow down the
suspects. I know it wasn't redacted. Trust me, he would never. Doe writes, she wouldn't
tell me who she heard it from because it's one of her friends. So I'm just dropping it. I give up.
I'm defeated. Ingles then says, I'm so sorry. I know this sucks a lot, but I think hopefully
very soon these idiots will move on and it'll be done with. Then a couple of days later, Doe sends a
screenshot of a forum that talks about Kai Phi brothers doing drugs and gang raping a sophomore.
So this is October 28th that she sends the screenshot that would be nine days after the incident.
Engels replies, ridiculous. I'm going to report that.
role. Doe does not respond to that message from Ingalls, but texts Ingle's the next day and asks if he has a sighing, presumably a cigarette. Ingle's text back hours later, apologizing because he had passed out and didn't text her back in a timely fashion the next day. Ingl's writes, quote, redacted wants it to be known that if anyone acts even remotely disrespectful when you come tomorrow, this is presumably referring to the Kai Phi Halloween party, that you should come to either me or him.
him and he'll find their ass and kick them out of the party. They won't be able to sleep at the
house that night. He also told me to tell you that Kai Fi is your house and you are welcome here at any
point. End quote. Doe responds. Thank you. I really appreciate that with a heart symbol. And she writes,
I'll bring my Sigs tomorrow. I love that man. End quote. Ingalls then says, quote, redacted wants to call you
really quick. So expect a phone call. And that's when Doe responds, quote, I was uninvited, but of course it was
quote unquote, for me. I knew this was going to happen. The woman will always get the short end of the
stick. Y'all aren't my friends. Y'all are covering your asses. Ingalls writes, wait, are you sure?
Redacted told me you're still invited. You are still invited. Doe replies, he can go fuck himself.
I'm done. He's not a friend of mine. So that was October 30th. Then on October 31st,
Ingalls texted Doe and asked, how are you doing? Redacted told me, you're still good to come,
and he was offering advice. Where's your head at? End quote. Doe responds, no.
two days later ingles texted doe saying call in ten question mark doe replies k question mark
and then a few days later on november 5th ingles asks doe how she's doing do does not respond
on november 7th do says call me ingles says he'll call her in seven to eight minutes asks if
everything is okay do writes quote i mean no i've been to the er this week end quote ingles responds
shit, I'll hurry home right now. Doe then asks for someone's number and Ingalls sends it.
And then Ingalls attempted to call a couple of times, but Doe was on the other line the first time and the
second time she texted him saying I'm with my mom. What's up? Ingle's replied, quote, my ex told me I'm
being labeled as an assaulter in the public eye. I was going to ask you if you may have said
something along those lines to someone, but I know you wouldn't. End quote. Doe answered,
quote, I haven't said anything, but I do know people are changing the narrative because like in any
sexual scenario with one woman and many men, the woman is probably the victim. I know there are
rumors that was gang banged. I've never said anything against you, but I have against redacted.
I had a friend who was going to kai-fi and I said don't, but I never mentioned your name.
Engels then said, okay, I appreciate that a lot. Thank you. So this is the same day that Doe went to an
emergency room and requested a rape kit. The next day, on November 8th, Engel,
texted Doe saying, you free to call soon. Cornell Armada when we call, sending so I remember, end quote. Doe then responds, quote, what? I think I'm done talking to you. End quote. Engle says, what can you call? Doe writes, no, never again. Ingle's responds, what did I lie about? And that is the end of the exchange that we have. We know that Doe went to Cornell police the next day to report the incident. And again, just to kind of put the timing into context, she reported the incident on a
November 9th and then sat for that two-day interview November 14th and 15th.
So let's do just a quick analysis here.
Both parts of both of these conversations are going to be relevant in Jane Doe's civil case
and potentially a criminal case if charges are ultimately brought.
But Jane Doe's civil case is what's currently going on.
So attorneys for the accused are going to use these text messages to argue that the earlier
messages show that Jane Doe said that at least some of the sexual activity was consensual,
said none of the sexual stuff was illegal, said the stuff that happened was going to be
common one day because sex and sexuality are changing, and continued to have friendly
conversations with these two individuals afterward. Therefore, the attorneys for the accused
will argue they can't be held liable for sexual assault. Jane Doe's attorneys, though,
will argue that those same messages show someone who was still processing what happened
and whose understanding of the night changed as she remembered more and learned more about what had
happened. Jane Doe herself has already made a pretty clear distinction between the sexual
activity she says she initially agreed to with Newell and Ingalls and what she says happened
later as more men entered the room and she became more intoxicated. So these text messages will play a
pretty big role in the civil case and of course a criminal case as well if charges are brought.
Let's take our second and final break here. When we come back, we'll talk about some of those
Title IX findings that have recently been brought to light and we'll finish with some of the
other developments here. So your decaf oat milk extra but not piping hot, four pumps of caramel,

So far, we've covered Jane Do's sworn statement and the more complete text conversations that she had with Ingalls and Newell in the days and weeks after the incident.
Now, let's get into the Title IX findings.
So we've talked in a past episode about the specific punishments each accused person received.
And we will touch on those again just as part of this discussion.
But what we're going to talk about now is what Cornell's internal Title IX process found as part of its investigation, the conclusions that it came to.
Now, keep in mind that Cornell's Title IX process is very different from a criminal prosecution, right?
Those are two totally different things.
Cornell investigated this incident under its own university sexual misconduct procedures.
That investigation lasted several months.
There was a three-person hearing panel that ultimately heard evidence over 12 days in May 2025.
Both Jane Doe and the accused students had an opportunity to testify and present evidence and challenge evidence.
So kind of similar to what we would see with a criminal trial.
but also different. Unlike a criminal prosecution, where the government has to prove guilt beyond
a reasonable doubt, Cornell uses what's called the preponderance of the evidence standard.
That means the panel has to determine that it is more likely than not that the prohibited
conduct occurred. So anything over a 50% likelihood that the conduct occurred rather than
the much higher burden required to convict somebody of a crime. However, in civil cases,
civil cases also use a preponderance of the evidence standard.
So the standard in Jane Doe's civil lawsuit will be the same as the standard in in Cornell's Title IX investigation.
There's another big difference here, too.
Cornell's rules regarding incapacitation are broader than New York's criminal definition of mental incapacitation.
Under Cornell's policy, someone can be too intoxicated to consent,
even if they voluntarily consume the alcohol or drugs.
Cornell defines someone as incapacitated when they lack the ability to knowingly choose to participate
in sexual activity.
And it specifically says alcohol or drugs can cause that incapacity depending on the level of
intoxication.
So that definition was a massive part of this Title IX investigation.
Now, when Cornell is deciding whether someone violated the policy, the question is,
did that person know the other?
person was incapacitated. And if not, should a sober, reasonable person in that situation have known?
If the answer to either question is yes, Cornell says affirmative consent was not there. So if the guys
were too high or drunk themselves to realize Jane Doe was unable to knowingly choose to participate
in sexual activity, that doesn't excuse it under Cornell's policy. The question is, also, what a sober
reasonable person in that same situation should have realized. If a sober reasonable person
should have known Jane Doe was incapacitated, Cornell can find that affirmative consent was absent,
even if the accused student says he was too intoxicated to recognize it at the time. So that is obviously
very different from the particular provision of New York criminal law that we've been talking about.
under New York's current criminal statute, mental incapacitation from drugs or alcohol requires
that the intoxicating substance have been administered without the person's consent or that some other
non-consensual act rendered the person incapable of appraising or controlling their conduct.
So somebody voluntarily drinking or, you know, voluntarily taking drugs can potentially become
incapacitated under Cornell's rules, even though that fact, standing alone would not satisfy New York.
York's definition for a criminal sex offense.
So that's one really big difference that helps show how Cornell and the DA could look at
some of the same conduct and reach very different conclusions.
Now, let's get into the actual Title IX findings.
And we'll start with Matthew Ingalls.
We're kind of going to go one accused at a time.
Cornell found Ingalls responsible for sexual assault and he was expelled because of it.
According to discipline summaries, the panel concluded that Ingalls had been willing to
to, quote, manipulate, exploit, and endanger, end quote, Jane Doe for his own self-interest and for the
entertainment of others. So Inglis is the person Jane Doe originally went to Kai Phi to C. She has said
that she initially agreed to the threesome with Ingalls and Newell, but said later in the night,
Ingalls participated in other sexual activity after she had consumed more drugs and become
much more intoxicated that was very different than the initial sexual encounter.
Engels has disputed Jane Doe's account, but again, based on that preponderance of the evidence standard and Cornell's definitions of sexual assault and consent, Ingalls was found responsible for sexual assault.
Jonathan Newell was also found responsible for sexual assault and was also expelled.
Newell is the person Jane Doe says she initially agreed to have sex with, along with Ingalls, though she told investigators that Newell repeatedly reached for her vaginal area multiple times.
times and she swatted his hand away multiple times.
She also said Newell gave her the ketamine and participated in more sexual activity later
in the night that she says was different than the initial consensual encounter.
Newell was also the individual who sent that Snapchat message in the frat group, the message
that said free pussy.
Newell's position during the investigation was that the sexual activity was consensual,
but similar to Ingalls, Cornell's panel ultimately found him responsible.
for sexual assault and expelled him.
Then we have Gileo Lopes.
Now, Lopes acknowledged having sexual contact with Jane Doe, but he has maintained through
his attorney that their encounter was consensual and that Jane Doe initiated the sexual
activity.
His attorney has also said Lopes didn't believe Jane Doe was impaired, but Cornell's Title IX
process determined that Lopes should have known Jane Doe was incapacitated and therefore found him
responsible also for sexual assault.
So notice the standard there.
Cornell did not have to find that Lopes knew she was an incapacitated.
Under Cornell's policy, it can be enough that a sober, reasonable person in his circumstances should have known.
Lopes was suspended for three semesters, followed by two years of disciplinary probation.
He was also given a no contact order, required to complete sexual harassment education, and required to write a reflection paper.
His attorney has called Cornell's conclusion unfair and says Lopes continues to maintain that the encounter was consensual.
Winston Lee received a two-year suspension, followed by several semesters of disciplinary probation.
He was also, like Lopes, given a no-contact order, required to complete sexual harassment education, and required to write a reflection paper.
Jane Doe says Lee participated in that final threesome in the office, so it was the final threesome of the night with her and Ingalls after more ketamine had been consumed and she was severely intoxicated.
However, Lee told investigators that Doe initiated sexual activity and that he later received verbal permission before participating in the threesome.
Now, reporting on Cornell's records specifies Lee's punishment, but the exact label Cornell attached to the finding against Lee has not been reported.
So I can't tell you that Cornell found a particular offense until we have the actual finding.
What I can say is that after reviewing the evidence, Cornell imposed one of the most serious sanctions short of expulsion, which was,
was that two-year suspension followed by probation.
So we've covered four individuals so far.
Those four individuals, two of them were expelled, two of them were suspended.
Those are the four individuals that engaged in sexual activity with Jane Doe.
The other individuals that we are about to cover did not engage in sexual activities.
Some made physical contact, as you will hear in a second, but none of the individuals we are about to cover engaged in sexual activity.
Diego Sarabia was another individual here.
He had already graduated by the time Cornell's disciplinary panel reached its decision.
Jane Doe accused him of grabbing her face and kissing her after she said she pulled away from an initial kiss.
Cornell ultimately issued what's called a persona non-grata order, which bars him from Cornell's campus for three years.
And again, the reporting does not identify the complete set of
findings for Sarabia.
Then we have Scott Norris and Scott Kreshmore, neither of whom was accused of having
intercourse with Jane Doe or having any sort of sexual conduct with Jane Doe, though both
were accused of going in the room after seeing Newell's Snapchat message.
Both of these individuals ultimately received no contact orders, were required to complete
educational work involving sexual harassment, social media, and bystander intervention,
and were required to write reflection papers as well.
Norris has said that he did not participate in sexual activity or drug use and that Cornell did not find him responsible for those accusations.
Now, Kreshmore is actually the person who's finding we know the most about because he challenged Cornell's decision in court, which we've talked about briefly in a past episode.
But because he challenged Cornell's decision, portions of his otherwise private disciplinary proceeding became public.
So we know that Cornell initially charged him with sexual assault and sexual exploitation, but that the panel ultimately found him
not responsible for either of those offenses.
Instead, it found him responsible for attempted sexual exploitation.
The panel found that after seeing Newell's Snapchat message and learning that there was a woman
in the room upstairs, Kreshmore went into that room intending to either observe someone who
was naked or engage in sexual activity without that person's consent.
Kreshmore has disputed the finding.
He says that he believed the Snapchat message was a joke and that Jane Doe was covered
when he entered the room.
He's argued that Cornell unfairly found him responsible.
for attempted sexual exploitation because he had not been specifically charged with that offense beforehand.
Now, he did go to a state court. He asked a judge to overturn Cornell's decision, but the judge rejected that, that challenge because the judge found that Cornell's procedures allowed the panel to find responsibility for other violations that came out through the presentation of evidence.
So he didn't need to be charged with it initially to ultimately be found responsible for it.
and the judge determined that Cornell's determination was not arbitrary or capricious.
Kreshmore has continued to appeal.
So that is what we know about the findings.
Essentially, okay, the panel found that the initial threesome was consensual.
But after that initial threesome, Jane Doe consumed more drugs and alcohol.
And Cornell's panel found that she reached a point where she was incapacitated,
meaning she could no longer knowingly choose to participate in sexual activity.
And in finding this, so if you read the Title IX findings, the panel talks about the effects
of ketamine and how ketamine makes someone feel and the fact that Jane Doe recounted her feelings
after doing ketamine and what she felt after doing ketamine and determined that what she was
describing lined up with the effects of ketamine.
and therefore, I mean, I believe she said at one point that it felt like the, it felt like the lights were on, but no one was home or something to that effect.
I don't want to get it wrong.
But basically she said that she knew she was, you know, alive.
She just there was, she was incapable of making decisions, basically.
So based on that testimony from her, the panel found that she at a point in the night where she had consumed more alcohol and ketamine that she had consumed more alcohol and ketamine that she.
became incapacitated. And once she was incapacitated, she could no longer give affirmative consent
under Cornell's policy. Because of that, for each of the men involved, the question became,
did he know she was incapacitated or should a sober, reasonable person in that same situation should
have known? So for the sexual activity where Cornell found that the standard was met, the panel
determined that affirmative consent was not there and that the conduct constituted.
sexual assault under Cornell's policy.
One last note here before we move on to some of the other updates.
I've said this a million times, but we have to remember that New York state law is much
different than Cornell's policy when it comes to sexual assault and lack of consent.
So just because the Title IX panel found that some of these students committed sexual
assault under the university's policy, that doesn't automatically mean Letitia James will
be able to prove every element of sexual assault beyond a reasonable doubt and get a conviction
because the law is different. Now, when we talk about an indictment, so let's say Latisha James
brings these possible charges to a grand jury and seeks an indictment to return an indictment,
the standard is as much lower. The standard is not beyond a reasonable doubt. The standard is
more of a probable cause standard. So the question is, is there enough evidence to reasonably
believe that a crime was committed? The standard is much lower than beyond a reasonable doubt. So we may
see if Letitia James decides to present possible charges to a grand jury, we may see a grand jury
return in indictment. But all of this to say that just keep in mind that even though this Title IX
investigation found that these students were, or some of these students were responsible for
sexual assault, that doesn't automatically mean that they committed the crime of sexual assault
under New York law. Okay, let's get into some of the other updates that are actually seven or eight
updates we have to go through. So we're just kind of, we're going to rapid fire through these.
number one, Cornell has made the decision to suspend parties and social events at frat houses for the rest of the year.
So through the spring, Cornell says if a frat violates that restriction and holds an in-house party or social event anyway,
that chapter will immediately be placed on emergency suspension.
Cornell's president said this move allows the university to take the rest of the school year to take a bigger look at frat life
and determine whether and how it can safely continue.
Cornell says it will work with students and faculty to come up with other ways for students to socialize in the meantime.
Second, there's been a change involving how sexual assault allegations are investigated on campus.
So remember, Jane Doe's case was investigated by Cornell University Police.
Cornell Police are real police officers.
They have full law enforcement authority, but they're Cornell's police department.
So one of the big questions that's come out of this case is, you know, whether a university's own police department should be the one investigating allegations involving that university and its students.
So at least while this independent review is underway, Cornell is creating a second option for students.
And the university says that it'll be working with the New York state police so that students who want to pursue criminal charges can have their allegations investigated by state police investigators who are completely independent of Cornell.
Those investigators would interview the student and then prepare a comprehensive investigative summary and send that or refer that summary to the appropriate law enforcement agency.
Now, Cornell hasn't said whether state police will completely take over those investigations, whether Cornell police will still have some sort of role, or even how cases will be referred between the two.
So we don't know specifics there, but according to Cornell, students pursuing criminal charges will now have access to an outside police agency rather than having to rely solely on Cornell's own police department.
Three, we talked about this in a previous episode, or I should say we talked about Gileo Lopes going to court in.
a previous episode to try to remove New York Attorney General Letitia James from this investigation.
Well, now Winston Lee, who is another accused individual, has filed his own challenge, also asking
a judge to disqualify James from serving as special prosecutor.
Lee's attorneys are basically making the same argument that we talked about before, and that is
that before Governor Hockel appointed James to investigate this case, James had already gone on social
media and expressed support for Jane Doe. So Lee's attorneys argue that those,
comments create an appearance that James had already reached a conclusion before reviewing the
evidence. And they wrote that James and Hockel have created what they call a blatant appearance
of impropriety and argue that someone who is presumed innocent should not be investigated by a
prosecutor who, in their view, has already publicly endorsed the accuser.
Four, we have a separate legal fight happening in Jane Doe's civil suit because Diego Sarabia
is asking the judge for a gag order, essentially asking the judge to limit what the parties and their lawyers can say about this case in public.
His attorneys argue that all of the interviews and public discussion of disputed evidence could make it harder to eventually find impartial jurors.
Jane Doe's attorney is fighting this request, arguing that the defendants and their lawyers have also been speaking publicly,
and that a gag order would unfairly restrict Jane Doe's ability to respond to the allegations made by the other.
side. Jane Doe's attorney is also accusing the defendant's attorney of leaking confidential
Title IX records to news outlets, which defense attorneys deny. So the judge will have to balance,
right, the defendant's right to a fair trial with the free speech rights of the parties involved
here when ultimately making a decision on this requested gag order. Five, Cornell's faculty
Senate held the first of two meetings on a proposed no confidence resolution, which is aimed
the university's central administration over its handling of sexual assault.
They are scheduled to meet again on October 28th to actually vote on the resolution.
However, even if this resolution does pass, the resolution would be non-binding.
So it would not mandate that the administration take any action.
It would basically just be this like formal statement that faculty members don't trust
the administration's handling of the issue.
That doesn't mean the administration wouldn't take action or make any changes as a result
of the resolution.
it just means the administration wouldn't be required to.
Six.
County lawmakers are now considering an independent audit of the Tompkins County DA's office.
So the Tompkins County legislature is expected to vote next week on a resolution that would authorize a review of the Tompkins County DA's office.
Of course, the Tompkins County's DA's office is the DA's office that ultimately chose not to pursue charges and chose not to review the additional evidence that it was offered.
Seven Cornell's publicly available data on 51 formal complaints involving sexual assault or attempted
sexual assault between mid-2020 and mid-2020-for resulted in 16 students being found responsible
for sexual assaults. Of those 16, two were expelled, six were suspended, seven receive lesser
punishments like probation, written reprimands, directed study, no contact orders, things like that.
And then one of those cases is still under appeal. And then finally, the last update that Washington
host reported that one of the men Cornell expelled later transferred to Nova Southeastern University,
which is a private university in South Florida. Nova Southeastern's president sent a message to students
earlier this month, acknowledging that the Cornell allegations may, quote, involve a student
who later transferred to NSU, end quote. And the university says that at the time he was admitted,
it was not aware of the allegations that were later reported in the media and that once it learned
about them, it acted immediately in the interest of campus safety. No, Nova has.
hasn't said whether the student is currently enrolled or what action it took, it cited federal
student privacy laws. This development, though, has raised an interesting question about what
happens when a student is disciplined by one university and then transfers somewhere else. Because
under New York law, when a college student is suspended or expelled after being found responsible
for certain misconduct, including sexual violence or sexual assault, the school is required to put
a notation on that student's transcript.
But the notation doesn't necessarily say what that student did.
It can indicate that the student was suspended or expelled following a disciplinary process,
but it doesn't lay out the underlying conduct.
Nova, though, says that as a normal practice, if an applicant's transcript shows an expulsion
or other disciplinary notation, the university does do additional due diligence.
Now, there are still questions here, obviously.
Cornell did not say whether the student's transcript contained a disciplinary note.
notation. We also don't know when he even applied to Nova. We don't know whether he applied
while Cornell's proceedings were still ongoing before he was found responsible, before an
expulsion notation would have appeared or at some point thereafter. So there's so quite a bit we
don't know here. But those are the quick updates. And I think that should get us to current.
As always, thank you for being here. If you enjoyed today's show or you found it valuable,
