It's really great to be back in the seat today. We've got a great show for you today. There is no shortage of things going on. I'm coming to you live from Southern California. California news is America news right now.
Starting point is 00:01:15 And we've had nothing but news. I swear, in this administration, you cannot take, you cannot go to the bathroom. You cannot take like one day off. I close my eyes for one second. And, you know, there's a shooting at the White House, White House Correspondence dinner. I was, you know, when that happened, I was sort of up and about.
Starting point is 00:01:37 I was going to watch some of the Fox News feed. And then I happened to see a text from, or an ex post from Katie Pablitch, who I knew, who I know personally and I knew was there. And boom, we're off to the races. Or sorry, maybe that was out of turn. Sad turn of phrase there. But anyway, the ensuing chaos has been absolutely ridiculous, but not unexpected. left has completely melt down. They continue to melt down. President Trump and the right,
Starting point is 00:02:07 in my opinion, continue to give the left opportunities to compromise to cross the other side, at least meet us in the middle here. Okay. And every time it feels like they're about to do it, they pull back. They just can't bring themselves all the way. President Trump gave them a wonderful opportunity, you know, brought them to the White House. Hey, you know, we've all been through something together. Maybe I'm going to hold back a little on that speech I was going to give. But the next day, it was, we were back in conspiracy territory. And not only did you hear people on the left talking about how this is obviously a setup, but then you have people like Barack Obama, our former president, I don't know if you remember that guy. And he comes out with the most ridiculous statement.
Starting point is 00:02:56 Well, we don't yet know what the shooter's motive is. We knew from jump. We literally knew from the second the news broke. The man left a manifesto. The problem was, is that the manifesto sounds actually perfectly reasonable if you're a Democrat. And that's why the Democrats have to pretend that they don't know what the motive is. I went and read the manifesto. And I have to tell you, although obviously I thought he, you know, his ideas are crazy. He laid them out very logically and reasonably and calmly.
Starting point is 00:03:29 he had self-reflection. He was self-aware. The sad truth is he sounded just like a Democrat. He sounded just like a modern Democrat. And before we jump off this show with some other craziness that's going on, I do want to play a clip from CNN last night discussing Cole Allen, this White House correspondent's dinner shooter, and discussing what they found in his posts.
Starting point is 00:03:58 And I think that they came to the conclusion that I came to. Let's go ahead and play it. Andrew Kaczynski, K-File. You have new reporting on the suspect of things you found just combing through his social media. So we're talking about this note. But you found a whole lot more. In fact, thousands of things more. Like what?
Starting point is 00:04:14 Well, that's right. We reviewed 4,700 posts from two social media accounts that appear to belong to the suspect. And they include comments that compare the President Trump to Aldef Hitler, encouraged others to critical of his presidency to purchase guns. Now, a Justice Department official confirmed to CNN that this X account, C-Force 3000. Okay. We last step, but honestly, when Andrew was just going down that list, it was just all of the talking points that you would hear on CNN or any other left-leaning channel. It was no difference.
Starting point is 00:04:53 This guy was cherry-picking statements from Kamala Harris, from Gavin Newsome, from the DNC, Nancy Pelosi. see. He was cherry picking these statements. That's what he was reading. That's what he was inspired by. Do you remember when Senator Gabby Giffords was shot in the head many years ago, I think a decade or more now? And they blamed it on Sarah Palin because she had a campaign ad, had a target with Gabby Gifford's face on it, which obviously were targeting her district. And we spent 10 years blaming Sarah Palin for Gabby Gifford's shooting. And even though it was a Democrat that shot her, we spent 10 years blaming her. And but now suddenly the Democrats have no blame to go anywhere except Trump. We, we had a governor's debate here in California.
Starting point is 00:05:47 You all know we're doing that thing here. We're hopefully going to get a new and Republican governor come November. We had a debate last night. But there was, you know, there were eight people, I think, on the. the state, but really there were nine because Trump was the ninth candidate. Democrats only talked about him. Democrats can only blame Trump. He is the only name on their lips. He is the only problem on their lips. It's an obsession. It's like a teenage girl with her first crush, except she's schizophrenic and has access to automatic weapons. These people are insane. All right, we're going to
Starting point is 00:06:24 get back to this, but I want to just pivot a little bit to some of the, well, more insanity. I don't know. Do you watch Dr. Drew to get sanity? I do. I actually get a lot of sanity from Dr. Drew. He talks a lot about crazy things. I am not nearly as sane or calm or reasonable as Dr. Drew. So I hope you're ready for what you tuned in for today. You're not getting like a gentleman today. You're getting a menopausal middle-aged woman who has just about had enough of all of this. and I live in California. So, you know, double whammy. But as you guys know, California is not just our, it's not just our financial fraud.
Starting point is 00:07:04 We're going to talk about that later. It's not just our voter fraud. We also have gender fraud in this state. And there have been boys stealing the medals, the competition medals of high school girl athletes up and down this state for years now, four years. So joining me, right now to talk about this and talk about what the federal government is going to do for us here in California. And what they can do for us is Julie Hamill. She is the assistant United States attorney with the U.S. Attorney's Office for the Central District of California, where she serves as civil rights
Starting point is 00:07:41 coordinator. Prior to joining the Department of Justice, she founded the California Justice Center, a public interest law firm under the California Policy Center where she defended the constitutional rights of Californians and worked on Title IX Enforcement in Athletics. She is also a personal friend of mine, a fellow mama bear. We met getting into this very fight for our kids and our girls. Julie Hamill is coming up next. Our laws as it pertain to substances are draconian
Starting point is 00:08:13 and bizarre. The psychopaths start this fact. He was an alcoholic because of social media and pornography, PTSD, love addiction. Fentanyl and heroin. Ridiculous. I'm a doctor for. I'm a doctor for. I say, where the hell you think I learned that? I'm just saying, you go to treatment before you kill people. I am a clinician. I observe things about these chemicals.
Starting point is 00:08:32 Let's just deal with what's real. We used to get these calls on Loveline all the time, educate adolescents, and to prevent, and to treat. You have trouble. You can't stop, and you want to help stop it. I can help. I got a lot to say. I got a lot more to say. All right.

Starting point is 00:09:18 Well, before we hit the intro, I did introduce our next guest. This is very important. This is a prestigious guest, actually. Julie Hamill, who's the assistant district attorney for the DOJ. It's a long title. Let me read it again. Assistant United States Attorney with the U.S. Attorney's Office for the Central District of California. It's a lot, but the work is a lot. And Julie is joining us today to talk to us about what's going on here with Title IX in California with our girls, Julie Hamill. Welcome to the show. Thank you very much for having me on. It is great to see you again. And I'm really happy to be here. And I'm not that prestigious. I am a public servant with the U.S. Attorney's Office. And I'm very grateful.
Starting point is 00:10:04 to be doing this work. You know what? I'll tell you what, Julie, I never thought I want, I never wanted to know as much about the DOJ as I do in the year of our Lord 2026. So it is prestigious because previously, yeah, there's a certain sort of resentment you have towards the people in DOJ because the department has traditionally, at least under the last administration, been weaponized. And so it feels good to see action going on at the DOJ. And so, and I know you as a fellow mama bear. So, yeah, I'm really happy to have you there. And I hope that, you know, the work is fulfilling for you.
Starting point is 00:10:44 I know it's not easy work and it's not always exciting work, but I hope you're at least getting the job done out there, girl. We're trying and it is, it's very fulfilling. I'm lucky to be working under the leadership of Bill O'Saley here, who's the head of the office for the Central District of California and under Harmeet Dillard. who runs the Civil Rights Division of the United States Department of Justice out in D.C. And there is no shortage of work. Unfortunately, on this issue that we're going to talk about today, the United States litigation
Starting point is 00:11:17 against California, the California Department of Education and CIF is taking a lot longer than it should. You know, on the day he was inaugurated, President Trump issued an executive order on this very topic, defending women from gender ideology, extremism, and restoring biological truth to the federal government. That was January of 2025. It is now April of 26, and we have states like California, Maine, and Minnesota that have dug their heels in and are refusing to abide Title IX, and they're insisting that males continue to compete in girls' sports. So that's why we're still here, and we're still fighting it out in court.
Starting point is 00:12:03 Well, here in California, it is a particularly insidious problem. And one case that's really made national headlines is the case of this young man. I know you in your capacity with California Policy Center previous to this job, you had, you've been on CNN talking about this. A lot of people may remember you from that interview. But this young man, A.B. Hernandez is a teenage boy. He's a boy. and he has been basically just snatching track and field titles from high school
Starting point is 00:12:35 girls athletes up and down the state in state championships despite what Julie just laid out for you, the president's direct order to stop doing this. And I just wrote recently about one of, I think, which is one of the most egregious thefts, and something that you would think the left would be concerned about. This boy actually stole a 35, 45 year old title from a black woman at the Mount Sack Invitational's. And I'll just talk about this briefly for the audience. They don't know. A.B. Hernandez pulled off a hat trick. He won the triple jump, the long jump, and the high jump. Okay, this is a high school boy. I want you to imagine how much further and higher he is jumping,
Starting point is 00:13:25 than the girls. He is a boy. He won all three of those championships in the invitational. And the last time somebody did that was in the early 1980s, Wendy Brown, a black woman. So he literally stole that title not just from a woman, but a black woman. And it is crickets on the left about this. So that's just one example of the egregious violations that are happening here in California. And yet when we parents, try to step up, we ask our attorney general, can you do something about this? This is in violation of the law. We get treated like the criminals. We get treated like the bigots. We get treated like the second-class citizens. Our girls get treated like the second-class citizen. What resistance are you facing here in California?
Starting point is 00:14:14 Where is it coming from? Why is this taking so long? I can only speculate as to why. But what we're dealing with is in California, the United States Department of Education about a year ago conducted an investigation. They issued findings showing that California's policy, you know, Education Code 221.5F, which you and I talked about, I think, a year ago on your show, and the CIF Regulation 300D that require schools to allow students to participate in sports and use the facilities that align with their gender identity instead of sex. So the United States Department of Education determined that California was in violation of Title IX because of this law and because of this
Starting point is 00:15:04 policy. And they gave California 10 days to come into voluntary compliance. This is about a year ago now. And they said, look, if you come into voluntary compliance and you stop allowing males to participate in girls' sports, we will go away. And you're in compliance with Title IX. California, of course, fought as hard as they could and rejected this offer. And so the Department of Education referred this to the United States Department of Justice. The United States Department of Justice sued, I believe, in July of 2025. And in September of 2025, the state filed a motion to dismiss the case. And I'll get into some of their arguments in a bit.
Starting point is 00:15:49 But they filed this motion to dismiss. We opposed it. There was a reply. It's fully briefed in October of 2025. And then it was taken under submission by the court in January of this year. So that means our judge has taken the motion to dismiss the entire case under submission and has not yet issued a ruling. It's possible that the judge is waiting for the Hickokx versus Little decision to come out of the United States Supreme Court. That was argued. in January of this year and we expect a decision probably by June. And in that case, and stop me if I'm rambling on and boring you. No, no, no. But the Hecawks decision, the Hecocks decision, combined with the BPJ versus West Virginia case, these are cases that are sort of the inverse of what California has going on. So in Hecox, this is an Idaho case where a male student who wanted to compete on the female teams challenged Idaho's law that restricted participation in sports based
Starting point is 00:16:55 on sex, which is directly in alignment with Title IX and the intent and purpose, the original purpose of Title IX. And so this athlete challenged the law. This made it all the way up to the Supreme Court. And you may recall that this particular athlete filed a statement with the United States Supreme Court saying that they were no longer going to compete, trying to moot the case before the Supreme Court could make a decision. And so we don't know whether or not the United States Supreme Court is going to address the issues that exist in California in this case, because in California, you have the opposite. You have a state that is requiring schools to allow gender identity-based participation and does not allow schools to mandate sex-based participation. It's the opposite of what
Starting point is 00:17:44 Idaho has done. And so it is possible. that the Supreme Court can render some sort of decision that addresses both, or it may just limit its decision to address states that have this biological sex-based participation mandate. And so right now, the United States Department of Justice has cases pending in Minnesota, Maine, and California, and we're all in somewhat of a holding pattern waiting to see what happens with this decision. And I wish that there was something we could do to speed it up because there are still women and girls being deprived of their rights. They are being forced to compete
Starting point is 00:18:27 with males. People are losing titles, historical titles. And I have to watch what I say. So I'm going to limit myself what's in the pleadings. But, you know, for a personal. Let me let me, Let me just add, stop you right there, Julie, and just add, I know that I'm stating the obvious here, but this feels it's such a deep injustice. Like I cannot believe that we are here, that we are having to do this in 2026, that we actually have to go all the way to the Supreme Court to protect our girls from. boys in their sports and in their locker rooms when up until five minutes ago, everyone on earth agreed that this was wrong, that this was, that there are two different sexes. And it feels absurd to have to be back in a position.
Starting point is 00:19:34 We're brought here by the left, which brought us feminism, believe all women, all of that stuff. And now we're full circle and we're back to having to beg and plead to be treated as equal beings in the society. But this time it's not coming from all big bad businessmen who don't want us to vote. It's coming from the so-called tolerant progressive left. And it's just deeply offensive. You said that there were challenges, that there were challenges or in the complaint, the motion to dismiss what some of their reasons were in the motion. And I want to get to that.
Starting point is 00:20:16 I know it's absurd. I can tell them to look on your face. And I know it's like I'm going to laugh everybody at whatever she says, I'm sure. But just know that in my heart, I am raging. This is absolutely absurd. There should be no challenge to this. This is absolutely on its face. I'll let you.
Starting point is 00:20:35 You continue, Julie. Wow us. What's in there? I need to know. So I am, this is coming out of their text. It's not my opinion. They contend that the text of Title IX and its implementing regulations do not require
Starting point is 00:20:53 the exclusion of males from girls' sports and facilities. And prevailing law in the night circuit forecloses such an interpretation. And so I remember reading that when it first came out. And I just thought how, what concept to, it is the end result of that idea and that analysis is an eradication of Title IX. You cannot have Title IX protections for girls and women if you include men in the definition of women. It's gone. You have no more Title IX. And so to make that argument in public was quite something to witness. But that's what we're dealing with.
Starting point is 00:21:45 And in that statement, they said, prevailing law in the Ninth Circuit forecloses such an interpretation. And they're talking about Hecox versus Little because the lower court opinion, the Ninth Circuit opinion, tended to support their position in this case. but I'm not so sure that the United States Supreme Court is going to be convinced that you don't have to exclude males from participation in girls sports in order to honor Title IX. I feel like I know which one will have trouble being convinced. I feel like I know. That is absolutely insane. That is insane.
Starting point is 00:22:36 Do the Democrat, I mean, you can't answer this question, but I'm going to say it anyway, and then you give me your lawyer answers, but the Democrats just want to think we can end Title IX altogether. Look, today, Escodist decision came down about the gerrymandering. And I've been tuning into Blue Sky and where all of my favorite left is, and crazy people hang out, and they have been framing that as the end of civil rights, the idea of this gerrymandering thing, not including race, we need to scale back on that,
Starting point is 00:23:17 and that it essentially dismantles a third of the voter rights act. They're just horrified over it. They're screeching over it. And yet what you just explained to us that is being brought by the other side in this case, is that basically what they would be doing would be dismantling a constitutional amendment. So while they're simultaneously screeching about a constitutional amendment being taken down on the back of politics, and they want to take down this constitutional amendment on the back of politics.
Starting point is 00:23:50 Yeah, well, Title IX, it's not a constitutional amendment. It's a statute, but it is the same thing. It is, there is an effort by certain. states to attempt to dismantle it. And as you may recall, the prior administration attempted to enact a new Title IX regulation that would have redefined sex to include gender identity, thereby allowing men to participate in girls' sports and use girls' facilities. And it was soundly rejected nationwide by multiple district courts. And they said, you know, a regulation cannot exceed the bounds of what a statute says. And this regulation turns Title IX on its head. Because instead
Starting point is 00:24:37 of protecting girls and women, you're basically just eliminating this category altogether. If you don't have a category that's exclusive to women and girls, then there's no protection. You can't have protection under Title IX if men are women. It's very simple. I don't know why we have to keep talking about it, but here we are. It's worse than that. We don't have to keep talking about it. We actually have to pay lawyers to go prosecute these cases. Like, it's worse than that.
Starting point is 00:25:08 The taxpayers are having to bear the cost of simply getting officers of the law. People who are appointed, lawfully appointed, and they are supposed to uphold the law, trying to get them to honor the law. This is what we, the taxpayer, have to be engaged in. when we have so many other things we need to be doing and should be doing. But yeah, you're right. If Title IX is erased, again, what is the point? What have we been doing this whole time?
Starting point is 00:25:39 I do want to drill down just a little bit more on here in California because it's sort of the mother load of all this stuff that is happening here. And is there any kind of legal remedy for a young girl who has her title stolen by a boy like A.B. Hernandez? You know, I'm just watching it happen. And Julie, the other thing that really just burns my butt is when you hear someone pop in on a thread or make an argument and is usually a man that makes this argument. Well, it's just one woman. Trans athletes only make up 0.002% of high school athletics across the United States. And it's just one competition.
Starting point is 00:26:22 It's just one boy. It's just one year, which is grossly offensive. because for that one girl, that's her one chance. And I'm, you know, what do people, what remedy do girls have while they wait for justice? It's very upsetting. And I can't, I can't provide legal advice, but if a girl is being deprived of opportunities, of equality in educational programs, because of these policies, she should file a Title IX claim. And there are, every school district has a Title IX coordinator. Um,
Starting point is 00:27:02 but, you know, these, these issues, it's, it's a lot more complicated legally than it should be, um, in terms of litigation. Unfortunately, what we've seen in California with these private lawsuits brought by women and girls is that they're, they're usually kicked on standing. And it's really hard. When you're dealing with high school athletes, they're in, it's a very short window of, time that they're competing. And when they graduate, their cases are mooted. And so that's what we keep seeing happen is. Wow. I didn't know that. So when they graduate, then the case, that's it. It can't go any further because it doesn't apply anymore. That's how the courts are are dismissing the cases. Yes. Wow. I did not know that. And this is really, let me just drill down on this for a second,
Starting point is 00:27:52 because that's insidious too. When we were working through a Julie Ranfer School Board, and she won once in time. And I was also running for school board at the same time. I lost. But that's how we met. And but one of the complaints, common complaints that I saw popping up when people like you and I really got the bug to run was like, you know what? I feel like these people, they weighed us out.
Starting point is 00:28:21 Moms, you know, we get all worked up and we're ready to go fight. and we're ready to go fight for our kids. That's why we ran. We were running for our kids. But then our kids are only kids for so long. And then your kid ages out of the system. And it feels like the other side, in this case, in school board cases is union, usually union-supported candidates.
Starting point is 00:28:44 The unions just are waiting us out. They're there forever. They have their jobs forever. They work in the school system forever. Our kids are only in their, you know, 12 years or less. And then they age out. And then those parents age out. You're tired of the fight. You got to move on to other things. You've got to fight for your kids for other things. And that feels like a tactic too. And that's that this feels like a tactic. You know, we're going to,
Starting point is 00:29:11 we're going to wait out justice. We're going to wait out these people. They're going to get tired and go away. But we're always going to be here. Well, and that's sort of where we come in with the United States Department of Justice. That we are, we are trying to enforce these rights. on behalf of the women and girls who are suffering in California, in Maine, in Minnesota. We are trying and we are just locked up in litigation in the courts. I'm not going to give up. I took this job because I believe in the work and I'm very passionate about it. It's taking a lot longer than I would have hoped, but I'm going to see it through. Well, let's talk about that for one second because since I have a representative of the DOJ on the line,
Starting point is 00:30:00 you know, one of the things that I hear a lot of complaints from supporters of this administration, people who are very excited for it, people say, DOJ is working too slow. They're always working too slow. We want to see arrests. We want to see victories. We want to see court cases won. Where are the prosecutions, yada, yada, yada. It feels from this side of the fence, people, it's easy, and I am guilty of this too.
Starting point is 00:30:26 People look at the DOJ and say, why is it moving so slow? Maybe you can shed some line on that for people who have that very same question, not just about this, but in general how the DOJ works. I am very much not authorized to speak as to main justice and how things operate. I don't handle criminal matters. But with respect to this case and with this issue, we did move very quickly and we are locked in a litigation system. So we are at the mercy of the federal district court.
Starting point is 00:31:01 And there's nothing more that we can do at this point aside from wait for an order from the court. And so unfortunately, I know people want action. I want action. I want results. but the wheels of justice turned slowly, and they unfortunately always have. I think they actually turn a little bit more quickly in federal court than they do in state court, at least in Southern California.
Starting point is 00:31:32 But it's frustrating, but that's just the reality of how the legal process works. Yeah. Yeah, well, fair enough. And that's what I expect. And when you live in a state like California, out where it has taken, you know, 20 years to build a train to nowhere that still hasn't been built, you know, you understand how things, things move really slow. But here's how it goes, folks. Things crawl, they move really slow and then change happens all at once. So, you know,
Starting point is 00:32:07 hang on to your hats. Give our reps at the DOJ some grace as they work through legal systems that are designed to lock them up and hobble them and hobble us. But we do want to respect your time, Julie, and thank you so much for taking the time to sit with us and talk to us about Title IX, Julie Hamill, Assistant United States Attorney in the Central District of California. You're doing the Lord's Work out there,
Starting point is 00:32:37 and we wish you the best. Thank you. Keep it up. Thank you so much for having me. Our girls need you, Julie. I tell you what, it's insidious what they do. They try to wait out your passion. This is what they do. They try to wait out your passion.
Starting point is 00:32:57 And it works a lot of the time because normal Americans, good people, all they want to do is get up, go to work, earn their paycheck, come home, support their families, love on their families, get up the next day and do it all again. We don't want to be bothered with this other stuff. But while we're not being bothered with it, these people, like my mother-in-law says, you know, the good book says evil stays up all night long, plotting, just plotting. And we just have people that are plotting. It is absolutely disgusting. And I think there's no other explanation for this. This is about Trump. The left has been consumed with Trump derangement syndrome. It's hilarious how they call the right a Maga call, even if you're not. You know, like I wouldn't call Dr. Drew, Mara. Maga cult at all, you know, or you or a lot of the people that Drew has on this show, I wouldn't call them part of the Maga cult. But anybody who is on the right gets described as maga.
Starting point is 00:33:56 But again, everything with the left is projection. Literally everything, even that, because they're the ones in the cult. And their leader is Trump and they don't even know it. Their leader is Trump. He's the one they focus on. He's the one they worship. Right? What is worship? It's what you give your time and attention to. That's worship. They worship Trump. He consumes their daily life. They give all their money to him. Did you see George Conway Jr. or George Conway, Kelly Ann Conway's ex-husband the other day, I think he was talking to The View or some stupid liberal podcast. Who cares? And he was proudly telling them about how he gave a million dollars of his children's inheritance to. to the Biden campaign, to the Biden campaign, a million dollars.
Starting point is 00:34:51 That's a guy gave the cult of the left, a million dollars. So they're given their time, their attention, their worship. And even their women, they're giving their women over to this cult, right? Unfortunately, ours too. the women get sacrificed on the altar of trans ideology and all of the weirdness that comes out of that. I mean, they have all the hallmarks of a cult. And as the late Mike Rinder said, he was infamous for defecting from the Scientology cult. And he did that whole series with Lear and Remini.
Starting point is 00:35:28 And unfortunately, he passed away last year. But Mike Rinder used to say, a cult is not defined by what happens to you when you join it. A cult is defined by what happens to you when you try to leave. Try to be a person on the left who exhibits like a modicum of reason or compromise. What happens to that person? They become a mag occultist. So that is what we're dealing with. We're dealing with a cult on the left.
Starting point is 00:35:57 And yeah, the wheels of justice turn slowly. And yes, they have all kinds of strategies to wait us out. but that's why you can't get tired. That's why when you're ready to pull back, you have to double down instead. I think what I said is correct. Change comes very slowly and then it happens all at once. And you have to be ready for the change that happen all at once.

Starting point is 00:42:32 Have you heard that there's some fraud going on around there, out there? I don't know if you heard anything. California. Oh, man, I saw Stephen Miller on CNN, or not CNN. They would never have him on. I can't remember where Fox News, I think. And he was saying that they've been digging into the Somali-led fraud in Minnesota. And he was saying that he thinks we're going to discover
Starting point is 00:43:01 that the United States taxpayer has been sending not just hundreds of billions, but perhaps trillions of dollars to Somali over the years to Somalia. Here in California, you know, the great Nick Shirley who broke that scandal in Minnesota. He's come to California and created all kinds of havoc. Our politicians don't even know what to do when Nick Shirley shows up. You know, when a guy shows up and puts a microphone in your face in California, Have you ever wondered why Camel Harris sounds so freaking dumb? Like really, like every time she opens her mouth, don't you go, wow, she is stupid.
Starting point is 00:43:38 And I don't mean that as an insult, although I do mean it to be insulting. But you do notice, right? She's stupid. There's no there there. And same with Gavin, when you hear Gavin and Karen Bass and a lot of other California politicians, it's because they have absolutely no challenges here. Nobody challenges anything. And so a politician can walk around.
Starting point is 00:44:04 And that's what they're building this new addition in the California Capitol for, so that they can walk underground and not have to face any reporters. They can walk around. They never get any hard questions. They never get any. Nobody ever circles back to here. And so they just kind of float through life. Every Democrat politician in California stumbles up.
Starting point is 00:44:22 And then they get to you in Washington, D.C., and then they become America's problem. and I mean, the proof is in the pudding. So our next guest is a gentleman who is aiming to solve that problem, or at least solve part of that problem here in America. Please welcome to the show. Herb Morgan, he is a candidate for California State Controller. He is a seasoned investment professional with nearly four decades of experience in financial markets.
Starting point is 00:44:50 He found an efficient market advisors, one of the nation's earliest ETF-based investment firms, which grew to manage $1.5 billion in assets, before being acquired in 2017, where he now serves as the chief investment officer. He previously served on the San Diego City Employees Retirement System Board, elected board chair twice, and you can follow Herb on X at Herb, the number four controller.
Starting point is 00:45:19 Herb, the number four controller, he's also America's coolest nerd. Please welcome to the show, Herb Morgan. Herb. Hey, Herbie. How are you doing? Herbie is good today. I'm so glad to have you. I'm so glad to have you.
Starting point is 00:45:36 Herb, you are running for state controller here in California and you're running. It's a different kind of race actually than we've seen before. You're running on a whole ticket. Although we don't really have that ability to do that. It's a ticket in name only. But the golden ticket, which is Steve Hilton's ticket, you've got running mates like. Gloria Romero for lieutenant governor, Michael Gates for attorney general. He's been on this show before. And of course, you, Herb, you're running for state controller. But the reason why I asked for you,
Starting point is 00:46:06 and I asked for you specifically, because I think this is a very important office that almost nobody understands. Nobody knows about most people don't even pay attention to it on their ballot. And I'm one of those people. I only discovered it, Herb, because you are running on the golden ticket and it made me look you up and it made me look up what this job is and I realized, holy cow, a bad job, Kira, like I'm being a bad American. I've been letting this office slide by me for years. So I want to talk about a little bit about what this is and why it's so important. So before we get into some of this fraud stuff, explain Herb. And if you want to introduce a little bit about yourself as well, but what the hell is a state controller and why are you running for it?
Starting point is 00:46:52 Yeah, you know, so a state controller, when you think about it, there's a controller, there's a treasurer, and there's an auditor. And those are three very, very different things. Two of them are elected. Treasurer and controller. In California, under our 1879 constitution, the controller is the executive elected by the people, reports to the people, does not report to the governor, who is charged with financial controls on the flow of,
Starting point is 00:47:22 money. In other words, the person whose job is to prevent the fraud, that's it. Like, that's the job. Make sure the money doesn't get stolen. They don't get to have an opinion on how it's spent. Oh, boy, you put my cup up on there. I love the cup. I got in a little trouble for that. They don't decide policy. They don't decide spending. But once the legislature makes their decisions, it's the controller's job. It's such a big amount of money, right? It's $320 billion this year as our state budget. The controller's supposed to make sure that money goes to where the legislature wants it to go
Starting point is 00:48:04 and it doesn't get stolen. So they're in charge of financial controls. They pre-audit, all spending, approve it, and then it's post-audit to make sure it wasn't stolen on the way. So my question, when I go out and give the campaign speech is, I just ask everybody, how's the current controller doing? And then, of course, the room just erupts into raucous laughter. Because California state government, and I hate to say what I'm about to say,
Starting point is 00:48:32 but I say it without abatement, reservation, or exception. California state government is a criminal enterprise, top to bottom. It is the world's largest money laundering operation. Tony Soprano would be proud of this place. Dude, I'm so glad you said that because I just said that today earlier on my live podcast, that everything that happens here at the state level in our government is criminal. Almost everything.
Starting point is 00:49:07 And at how long can we go on like this in a state like California and still be considered a state in the union of the United States of America, right? Like at some point, you're just a banana republic. at some point, you're a dictatorship. At some point, you're not fulfilling your state duties. So, yeah, it is a criminal enterprise, but right now our options to defeat that are through the law and at the ballot box. And there are a lot of people in other states right now, Herb, who probably just heard you explain what that is and thought, gosh, I should go look to see who my state controller is and what exactly it is that they do.
Starting point is 00:49:48 Let's take a state like Minnesota because it's like high on the radar right now and a lot of this fraud, Somali fraud is getting uncovered and they're going to be, they're deep in it and probably some people are going to go to jail over this. And they're still, the DOJ is still digging through some of this stuff. In a state like that, let's say, Herb, you were the state controller. What can you, and that's a, you know, Minnesota
Starting point is 00:50:13 is Democrat controlled. So you are running as a Republican in California to go to ostensibly a supermajority atmosphere in California. And Minnesota is the same way. What would a decent state controller have meant to a state like Minnesota, given what we're seeing there now? Yeah, such an insightful question because the state controller's role, really in every state, it's similar, right? Whether it's Minnesota, Florida, California, the states controls roles to be that financial centurion, that cop, who just makes sure that everybody follows the rules. And we've gotten to this point in American politics
Starting point is 00:50:52 where states are all red or all blue. When you do that all red or all blue, what you lose is the checks and balances that this country was built on. It made our country great. So what's happened in California, I hate to say it, but could have also happened in an all red state.
Starting point is 00:51:09 Right? If we just had every, it's what it happens. when you have every office and every part of the state government, people start slowly misbehaving. And then other people see the people around them misbehaving, and then they start to misbehave. And then the next generation comes in and they think, well, it's okay to misbehave.
Starting point is 00:51:25 When I say misbehave, I mean steal the money. And so I am the one after Minnesota broke. I wrote a white paper. My friend, Steve Hilton, got it in the hands of the president. The next day, the president tweeted the war on fraud in California. has begun. He then brought it up in the state of the union later in January. He then appointed J.D. Vance to hit it up. He's done this through executive order. And it's not just California. I think California is the very beginning of this. We're going to find it in states that are
Starting point is 00:51:56 absolute power one side of the other. I think in particular, you're going to find it a little more in the blue states because they tend to be more in favor of higher levels of spending. But here in California, the number I came up with, I think you've got my little paper up there, I did a five-year look back. And because, as you say, I'm a nerd, I didn't sort of make up numbers. It's not hyperbole. We went to the legislative analyst reports. I went to the governor's own budgets, and I went to the state auditor's reports and the state auditor's high-risk report that comes out every other year in December. And if you, and I just took all of the different programs of state government and said, just on their own admission from their own auditors, and I think the number is actually bigger,
Starting point is 00:52:41 what is the total exposure to fraud, to waste, to abuse, so not all of it's criminal. It might just be negligent. Over five years in California, that's $425 billion. And then I started just to go down this rabbit hole of, well, who's being harmed? Well, how about the drug addicted, the alcohol addicted, the mentally deficient, the single mom living in a car, trying to make two jobs, you know, to get the kids of school and do all this stuff. Our schools are K through 12. California is spending $140 billion this year on K through 12. Yet we're, you generally ranked 36, 38th, 40th in educational outcomes in the country. It's an absolute travesty that we've, what happens we've just gotten so wealthy as a society, right? The wealth that's been
Starting point is 00:53:32 created over the last 20 years in America is immense. And so tax revenues have grown almost exponentially. And we've figured out how to push the money out the door, but we haven't figured out the proper financial controls to assure that the bad actors aren't out there taking it. I have a solution for that. I think the solution I will win. And I think that solution will be implemented in California.
Starting point is 00:53:57 And then I think it'll get exported. You know, as it goes California, so goes the nation. I think my solution, radical transparency, will get, explored throughout the rest of the country. Tell us, I want to just backtrack a little bit of her because I was really interested in what you so hesitantly said about California, the entire California state government basically being a criminal enterprise. And you're not wrong. And I think that is exactly the right description. Even today, we had news about Gavin Newsom pushing money to the unions, which in turn push money back out to PACs that push money.
Starting point is 00:54:36 out to Newsom to buy his book to put him on the New York sellers, New York Times bestseller list. Like it is, and that's just one thing. It happens at the local level. I ran for school board in 2022 and there's all kinds of tip for tat going on in there and all kinds of circular funding. What has, give us some examples of how you think this is a, you know, this is a money laundering operation. Have you come across anything particularly interesting? Oh, how much time do you have? I can give you so many examples. Dr. Drew's not here. We can take all the time in the world.
Starting point is 00:55:08 Caleb doesn't need to go home. He's fine. Right. So let's just start. I think the easiest low-lying fruit. And remember, I did the report. You can download the report at Herb Morgan.com, and you can see the details on all the different governmental agencies.
Starting point is 00:55:20 But I'm just going to go to one. I'll start with the homeless services. Again, the most needy among us. I happen to be sitting in San Francisco today. And what I saw walking the streets just to go to lunch today is heartbreaking, heart-wrenching. These people deserve help. They should be helped. We are rich. We charge more in taxes and we can help them. The question is we spent
Starting point is 00:55:41 $24 billion. Why didn't they get any help? That's really the question. And so it's because the money was stolen. So like we fund a police department and we deliver police services. We fund a fire department and we fund fire services. But in our cities and our counties, we don't have homeless service. We don't have uniformed officers that take care of the homeless, for example. So what we do is we just give money to non-profit enterprises called NGOs, non-governmental operations. And in places like L.A. County, those numbers can be very big. These NGOs can take 25, 26 million. Your prior guest, Julie Hamill, works for U.S. Attorney Bill Assaley, and he has made several very high-profile arrests of people who ran these nonprofits.
Starting point is 00:56:34 So what they did is they went to a county health services and they said, I can solve the homeless problem. Give me $28 million, $26 million. That's a fact. We know that happened. Then we know these same people are being charged with taking the money and instead of spending it to help the homeless, they're using it for their own benefit. We have private jet travel to Hawaii.
Starting point is 00:56:57 We have range rovers. We have mansions in Brentwood. We have the guy who double flipped. He got a hotel under contract for $11 million, but he sold it to his nonprofit for $27 million. And he put $16 million in his pocket. And this is a, it's not just California, but California happens to be where I live.
Starting point is 00:57:20 So this is all outlined in these documents. And so my brain, because I'm a financial guy, I'm an auditor, I'm like, well, isn't the state auditing these people? If I give you $26 million, Kera, I'm going to expect like a report, how my money was spent. So I went out and contacted some NGOs that, you know, they're not all bad. Some are doing, you know, God's work, you know, all over. But when you go to them and I ask them, when you get that massive grant, do you get an audit? Does the state demand to see your transactions, everything you spent money on?
Starting point is 00:57:57 And they just say no. all we get asked is to attest once a year. We get an email and the email says, did you spend the money lawfully and did you help homeless? And I attest that I did and they send it back. So all of these people who got arrested and charged under U.S. Attorney Bill O'Sahili and Julie Hamill's office, I went and took their name and went to the website
Starting point is 00:58:18 where you list political contributions. Okay? And the ones I checked, I didn't check every single name. It's been a lot of arrests. But when I checked, I found out, their political contributions, his public information, went to Attorney General Rob Bonta.
Starting point is 00:58:35 They went to Assemblywoman, Jackie Irwin. These are L.A. County, Democrat people, Jackie, and then a state with Bonta. And then I see that they all hit the max. So they also then donated to Act Blue. So you're donating to Democrat politicians.
Starting point is 00:58:52 You're in an all-democrat state. You're getting a homeless grant to provide services. you're paying yourself a massively inflated salary. You're using the money to double flip a hotel or buy a range roller or one person was charged with buying a $7 million mansion on the west side of L.A. And then you realize, and again, this is just one small department. This is actually one of our smallest departments.
Starting point is 00:59:20 The same thing happens with education funding, right? People buy stuff and then it doesn't get used. I wrote a whole paper on my website How to Fix the Education System in California. We had Prop 98. We spent $140 billion, $28,000 per kid in California, and we can't read at the fourth grade level. I'm going to stop you right there.
Starting point is 00:59:41 I'm going to ask people, what would you do for $28,000, right? Like, what would you do for your kid if I just gave it to you? The list goes on and on. It's incredible. I'm blown away just hearing, and I know a lot of this. I know a lot of this stuff. And even I can't, I'm always surprised at how much more there is. The rock goes deep.
Starting point is 01:00:04 We've got to let you go, Herb, we've got to wrap up this show. I, I am so glad that you joined us. I hope the listeners got something out of this. Starting point is 01:04:10 I'm very aware that I'm hosting Dr. Drew's show. He's so reasonable and I'm a crazy person. So it's like I'm wondering how full of rage I can get and be asked again to host this show. But I have to tell you, I'm really angry. I'm angry these days. And Julie, Herb, both those, and then what we started out with the White House, the Correspondence Dinner Shooter, if you, the theme of today's show is like, it's all going to hell. It's all falling apart. Like in the beginning, in 2024, when Trump first took office, it was, we were riding high, right, for a few months, like, oh, okay, it was a sense of relief.
Starting point is 01:04:52 Even if you weren't a huge MAGA supporter, you knew you didn't want Camilla. Harrison was a sense of relief. Maybe we're going to get back to some kind of normalcy. But then Elon Musk and burning Teslas and no kings protests and people setting cars on fire. And then, you know, the guy who, you know where it started? It started with that guy who threw the subway sandwich on at the National Guard. Remember when Trump said the National Guard into D.C. And it was some, some like, boogie white guy, you know, some guy who doesn't have a freaking care in the world otherwise. He's fine. He makes six figures, you know, him and his gay partner share a condo in downtown D.C. No kids. Three dogs. You know, they vacation three times a year. Like, he's fine.
Starting point is 01:05:47 But he threw this subway sandwich because he's got a big problem with Trump and nothing happened to him. He got let out. He stills his job. You know, and so when we excused, we excused the little things and we didn't just excuse them, but we laughed at them and I'm just as guilty. Folks, I'm just as guilty of this. We laughed. Oh my, and you can go onto my website, just caretavis.com. And you can see articles from back then and me like, oh my gosh, doesn't Maxine Waters seem like super crazy? Aren't these people absolute lunatics? and it was funny for about three months. And then people started dying and then Charlie died. Charlie was murdered.
Starting point is 01:06:29 We normalize this is like, isn't the left crazy, isn't left crazy. But you know what we didn't think about? We didn't think that maybe the left isn't just crazy. Maybe they're activated. That's why I think it matters that the 8647 thing from James, James Comey. We came yesterday, I think last night. Castro Tell announced that they're, they've arrested him on charges, bringing him up on charges.
Starting point is 01:06:59 The left, of course, is framing this as, oh, Trump, he's so sensitive he didn't like the messages in the seashells. No. When you put the totality of what has gone on, hell, not just the last 10 months, the last 10 years in this country, when it comes to Trump derangement syndrome and how absolutely insane the left is, you have to consider that a message like that isn't just from a guy like that from the former FBI FBI director from a guy like that a message like that and that that guy knows all kinds of sciops all kinds of the all kinds of the really dirty shady stuff that our intelligence community gets up to and does to its own citizens James Comey is a guy that knows that so you have a guy that
Starting point is 01:07:48 knows a lot of stuff. He has a lot of information. And then he writes this message in the sand, 86, 47, you can't, given the totality of all of the insanity that has happened to this point at the hands of the left, if you are at the DOJ, if you are at the FBI or if you are at DHS, you have to take that as some code. You at least have to investigate it as some code. And I can tell you that the DOJ, you heard Julie Hamill on her here earlier, she's very careful with her words, right? So the DOJ is not just doing things willy-nilly. They're not just throwing out indictments
Starting point is 01:08:25 and hoping that they're going to get a catch. There's more to this than just 86-47 in the sand. The DOJ knows that. And we're going to see a lot more coming out in the coming weeks and months. Well, we are finding out exactly what's been going on on the left. And I and it absolutely this is on the left. It's been in a, a dissent into madness. And it's been a slow descent. But what did I just say? I said change happens slowly and then all at
Starting point is 01:09:02 once. And this change happened slowly. It started in the 80s with political correctness and we had some of those debates and then there were some words you couldn't say out loud and then insults you know got shortened or we use euphemisms for them we're not allowed to say those things and then we had um we had uh the the gay rights movement which turned into this huge slippery slope which is now given us the trans rights movements which is why we had julie hamill on this show now girls are having to go to the Supreme Court for their right to compete in single sex sports. Did you ever think you saw the day? We took the Bible out of classrooms, right? And everyone said, well, you know, freedom of religion and we don't want to offend anybody else. And we don't want,
Starting point is 01:09:55 you know, oh, that establishment clause. We took the Bible out. We took religion out of the public square in the United States. We told our kids, we don't talk politics. We don't talk politics. and we don't talk religion. We stop teaching them civics. We stopped teaching history. It's just one thing after another. We took out math and put in critical race theory. We took out merit-based hiring and we put in DEI.
Starting point is 01:10:23 It's been a slow methodical push to insanity. But in 2024, change happened overnight and their insanity exploded all at once. And now it's exploding all over us. every day. And for a while there, we were helpless. We were pretty damn helpless, but we're not that helpless anymore. And I'm going to tell you, before I let this show go, I'm going to tell you what I tell all my listeners every day. And I give speeches all up and down the state. By the way, if you want me to come talk to your organization, please reach out to me because I give a speech and it is the same speech now. I've changed it in 2026 because things are getting so crazy.
Starting point is 01:11:04 And it's this. We're at war. We're at war. We're at war and nobody has the luxury of being neutral anymore. There are no neutral actions. Everybody is picking sides. Everybody's going to have to pick a side. And unfortunately for you, reasonable independent voter who might be, you know, a middle of the road voter, I'm not Democrat, I'm not Republican. Unfortunately for you, you're over here now.
Starting point is 01:11:30 I'm sorry. The left hates America. Progressives, Democrats, they hate America and everything they are doing. is aimed at you. Trump was right when he said, they're not trying to kill me. They're trying to kill you. They're coming for you.
Starting point is 01:11:45 I'm just standing in the way. And we know that because what happened after Biden won in 2020? That's when all of these, this transgender insanity started. Women started having to share their spaces with perverted men. Girls started losing their titles to boys in their athletics. Dylan Mulvaney started advertising for Bud. light. Like the insanity started then. It was very dark times. And we were, we were rather helpless,
Starting point is 01:12:17 although there were many people fight in the battle, many people fighting at the legal level, and thank God for all you people, and thank you. And they're still fighting to this day. But now, and that's when the left was happy, the guys like James Carville, that's one that the left was happy to be like, yeah, we need to take the heat down. And I'm a reasonable, I'm a reasonable person, you know, let's talk, let's compromise. They only ever meant, you know, let's talk until you come over to my side. But even then, the craziest people that you see out there right now being super bonkers, they were a little more palatable back in the day.
Starting point is 01:13:01 But what happened was you won. You won. America started winning. And the left had no other choice with two. lose their damn minds because they were absolutely committed to this. And they really thought that they had changed everything for good. And they thought you were going to go away. And they were tricked to believing that it would be easy to make you go away because you're the minority because everything I watch on TV and in the movies and on MS Now or M Snow or whatever the
Starting point is 01:13:31 hell we're calling it. Everything I'm watching on there tells me that you people are in the minority. you're the crazy freak fringe. They've been setting this up for years. And that's why Obama has to pretend that there's no motive. And that's why the left has to pretend that this is a both-size issue. Because they understand when they read Cole Allen's manifesto, when they see the justification of things like Tyler Robinson, Charlie Kirk's murderer.
Starting point is 01:14:06 Do you remember and that CNN reporter gave this loving report about the beautiful, loving, romantic note that Tyler Robinson left for his lover? You know, they have to, they have to. Because they know deep down inside that they sound exactly like the White House shooter. And that's what they're encouraging. This is war. We've been in a cold war for many years. years a lot of us haven't known. It's a hot war right now. And let's hope it doesn't become a kinetic war. But I think this means we do have to pay more attention to what's going on, not just at the
Starting point is 01:14:45 federal level. We have midterms coming up. That's important. It's a big gerrymandering decision today. That's a big deal that bodes well for Republicans. But think about Herb Morgan and what he's running to do. State controller, a boring office, maybe a seemingly boring guy, a boring white guy named Herb. We need more boring white guys. I heard it's not boring. I partied with him. He's super fun. But, you know, we need more boring people, you know, that don't have agendas.
Starting point is 01:15:15 And that means you need to start paying attention to what's going on locally. Get to a city council meeting. If you don't know where to start, start at a meeting. Any meeting. Any meeting. Pick one. School board, city council, whatever. Go and it'll change your world.
Starting point is 01:15:31 But this is a war and you have two choices in it. my friends, and that's it. There are only two options. You are either a soldier or a victim. I'm not telling you to be violent. I know this is a violent analogy. I'm not encouraging violence, but what I am telling you is that we are in a war. That is for sure. It's a civil war. And it's being gendered up by the left because we're winning. And I think that's the good news. We're winning. And people like Julie Hamill are out there and her more, Oregon are out there and even Dr. Drew out there just doing his job of getting the truth out there and telling the truth. Even with the wellness company, you know, even with stuff like that,
Starting point is 01:16:12 teaching people how to take back their health, the more independence you have from this behemoth government, both in your state and federal governments, the more prosperous you're going to be as an American. So I think this is a great place to leave it. I've gone over my time, but I do have a big mouth. Caleb, I told you, we were not going to have any problems with this.
