Starting point is 00:01:28 Yay, indeed. Jimmy, yay, indeed. My name is James Petrigallo. I'm here with my co-host. I'm Jimmy Wissman. Thank you so much for joining us today on another fun, crazy, wild, murderous edition of Crime and Sports. Let's pick it up. Let's do this.
Starting point is 00:01:43 Part two of Spider-man cedric marks and uh in part one uh he was generally a complete asshole in case you missed part one he was a pretty very mediocre fighter most of his wins came against either the same guy who he beat like five times or other men who've never fought before and never fought again after he beat them. And if they had any sort of career at all, they beat him. They beat his ass, and we did all of that. So he was punching everybody. You can imagine he'll hit anybody, people, women.
Starting point is 00:02:21 It doesn't matter. He was being – his girlfriend has disappeared and they're like years ago they're interested in talking to him about that baby's mother two bodies have just been found in his father's very small hometown that no one even knows exists unless you go there which he happens to to do. Clearview? Clearview, which he's connected to. A lot of bad things. He's been arrested, and then he escaped from a prison van and was hunted for 12 hours with dogs and helicopters and all of this, and he was half a block away inside of a garbage
Starting point is 00:03:00 can the entire time. And then they finally found him. Not a big, a 55-gallon drum of a trash can the entire time and then they finally found him not a big a 55 gallon drum of a trash can like you'd see outside of something that you throw garbage in and it was like the dogs were on the way back in they were like coming back in from the field and they were like hey hold on a minute what's this oh shit here he is there he is right next to the police station obviously he's been here a minute he was just like the the garbage in front of the jail that's where he was just hidden there and it worked so unbelievable that
Starting point is 00:03:30 is crazy but we'll get to all of that we'll pick back up here where it's about to get even crazier you have no idea we're gonna we're gonna be finding there's body parts there's all sorts of wild stuff here before we do do that though before we before we do do do do do that. Do do. Do do that. Before we do that, definitely want to say thanks for all that you do for us, number one. Head over to shutupandgivememurder.com to get all your merchandise and stuff like that, any kind of information about the show. Definitely listen to our other shows, Small Town Murder, which is pretty self-explanatory. Just like this, but with murders in small towns. And then Your Stupid Opinions, our our new show which is just absolutely crazy this week there's some kind of
Starting point is 00:04:11 cock ring dildo contraption a little scorpion people somebody called the grand canyon kind of mid which i think is amazing you got to check it out it's a crazy show it's amazing check that out and listen and uh you certainly want to do that. And you definitely want Patreon. That's the main thing here. Patreon.com slash Crime in Sports is where you get all the bonus material. Anybody, $5 a month or above. $5?
Starting point is 00:04:35 It's a box of cereal. Incredible. One box. You want like eight bowls of Lucky Charms? Or you could have a couple hundred back episodes of bonus stuff to binge on and new stuff every other week one crime and sports and one small town murder and what do you get access to jimmy what do they get all of it every last damn word of it so this week what you're gonna get for crime and sports we're gonna talk about something weird because not really weird but just something
Starting point is 00:05:01 isn't really crime related but just one of those things where I'm like, what's the story here? And I want to find out. We're going to talk about roller derby. Okay. It was the biggest thing there was in the 50s. It was like as big as wrestling was in the 50s and in the 60s. Well, it was on TV. That's what I mean, in the 60s.
Starting point is 00:05:18 I know they kind of killed it by putting it on TV every day. And then it was like, who wants to be a millionaire back in the day? It just lost popularity. Too much weakest link. day. And then it was like, who wants to be a millionaire back in the day? It just lost popularity. Too much weakest link. Yeah, but then it came back. When I was a little kid in the early 80s, there was Roller Derby on Saturday mornings. I remember the T-Birds and this one.
Starting point is 00:05:34 Is it real? What is it? Is it a sport? I still don't know how you score. Is it real? There's fighting involved. Is it like wrestling? I don't know what it is.
Starting point is 00:05:43 Is it part real, part a show? I'm not sure, but we'll figure out Roller like wrestling? I don't know what it is. Is it part reel, part a show? I'm not sure, but we'll figure out Roller Derby because I don't know. There was a movie Roller Ball, right? Yeah, I don't know if that was about Roller Derby, was it? It was like Roller Derby, but there was a ball game involved in it. Was he in it? He was in one of those movies. Was that the second one?
Starting point is 00:06:00 I don't fucking know. Because I feel like Paul Newman was in one. I don't know. Oh, yeah, maybe. Was that about Roller Derby? There was an old one, right? Why is there a ball involved in roller derby? Not in roller derby, but in roller ball there was. Oh, it's a different
Starting point is 00:06:12 sport. Well, we'll find out as a bonus to the bonus. We'll figure out what roller ball was, too. How's that? All right. And then for Small Town Murder, it's time again. It's been seven months, so we're going to catch up with all the folks at Love After Lockup and find out what's been going on. People have died.
Starting point is 00:06:29 People are dead on that show. There's bodies in this week. There is bodies in this season, in the last two seasons that we're going to talk about. It's one season that they break into two. So check all that out. We'll talk about all of this stuff. Figure out roller derby and more. Patreon.com slash crime and sports.
Starting point is 00:06:45 All right. That said, let's get into Cedric. Let's do it. Let's do it. Okay. Like I said, they just pulled him out of a garbage can. Let's go, you stinky fuck. In full bright orange jail uniform.
Starting point is 00:06:59 Removed him. There's like a, you know, just a little package of ho-hos falls off of him. He's got ramen noodles in his hair. He's got a McDonald's bag over his foot. It's just really a mess. A cup of noodles stuck to his shoulder. Yeah, the whole thing is just terrifying. Then it comes out a few days after all this.
Starting point is 00:07:20 Oh, my God. February 5th, 2019. He's got a pregnant girlfriend what yeah oh yeah yeah in addition to the missing girlfriend and these other people he's got a pregnant girlfriend now oh my god her name is maya maxwell and uh she steps she's 26 where's she at she She's in Texas. And she. Wow. She's 26 years old. He's what is he 44 at this point. Wow. And she says that he killed her ex and her friend and she witnessed the murders inside of a Texas home.
Starting point is 00:07:59 And that's how the police found the shallow grave in Clearview. OK. The tip that they got wasn't a tip. It was a full-on, here you go, silver platter. Her ex is involved? Yes. Hold on. Yes.
Starting point is 00:08:15 That's this whole, it gets way deeper. My God. So now there's three people that he's suspected of murdering and an apparent witness to two of these murders here. Wow. Yeah. She's, I think, six months pregnant at this point too so that's and he still has a wife oh oh yeah yeah no that's fine he has i think multiple wives because he's gotten to he's gotten married when he's still married already in this story believable so this guy has no like the law never comes up in his thinking, ever. 2019?
Starting point is 00:08:49 Not even like I should get divorced before I get remarried. He's just like, I do what I want. Get divorced first, you fucking idiot. You can't do that. In 2019, he does this. Yeah, this is wild shit. So an affidavit filed says that Maya Maxwell told the temple police that Cedric Marks killed both Jenna Scott, who's one of the missing one of the bodies found in Clearview, who was 28 and Michael Swearingen, Al's great grandson, I'm sure, who was 32 in a home in Killeen
Starting point is 00:09:17 on January 3rd and that she was there and witnessed it. And Swearingen is her ex? Apparently so. Yes. Yeah. Or maybe Jenna was her ex, but I think it was Swearingen. Oh ex apparently so yes yeah or maybe jenna was her ex but i think it was swear oh we don't know so yeah she was jailed maxwell they arrested her on an evidence tampering charge after she admitted to dumping swearingen's car in austin texas so that's how they got her in and then they said well this car yeah and his phone was two blocks away. Exactly.
Starting point is 00:09:47 Exactly. So they told her, like, well, it seems to us like the fact that you're involved in this dumping a car thing, there's probably more than you that, you know, and all this. And she said, well, let me tell you everything. I got a lot to tell. I got a story to tell, as Biggie once said here. So he said that, yeah, she's five months pregnant, sorry. She says that both Jenna and Michael were alive when they arrived at the home. And she said she first saw Cedric enter a room with Swearengin.
Starting point is 00:10:21 And then when Cedric left the room, Swearengin was dead. So he killed him at some point in there he then went into a room with Scott who then by that point was also dead and then he came out um so that's that's what she says so not she doesn't give much detail the press doesn't give this much detail but the affidavit also says that Maxwell told police she was present when the bodies were moved to Clearview, Oklahoma, from Killeen. Oh, boy. Which is like 350 miles, by the way. That's a long ride.
Starting point is 00:10:52 That's a long ride. That's like Phoenix to L.A. That's a fucking ride. With two bodies in the car. Yeah, six hours with two bodies in the car. Good luck. It seems like every time he enters a room with people, he's the only one that walks out.
Starting point is 00:11:06 That'd be a little on the scary side for that ride. And you're going with him. Yeah. Right. Wow. That's imagine the white knuckle ride of, he used to suck riding with weed in the car when it was illegal everywhere. Like that was a, that's annoying.
Starting point is 00:11:21 But the white knuckle ride with two bodies in the back, you gotta got to be a cold son of a bitch to, like, be. He was calm, she said. Yeah. You know, like, flicking through the radio and shit. They'd have to stop for gas, for Christ's sake. Oh, yeah. And be around other people. He's getting snacks.
Starting point is 00:11:35 That's a six-hour drive. He's stopping for at least, you know, some Cheetos or something. There and back, if he does it all in one trip, that's still all goddamn day. That's a lot of riding. What's our car snack, Jimmy? What's he going to get? I hope he got some turnpike chicken. Not the turnpike chicken.
Starting point is 00:11:52 What do we get always? Oh, you know he's eating Subway. Subway and Bugles, of course, for some reason. I've had Bugles like three times in the last five years. It's only when I'm in a car the two of us are in a car for hours at a time we're like let's get some bugles okay why are they good now
Starting point is 00:12:11 I don't know they look the easiest to digest on the rack at a gas station and you can just stick your finger in and come out with a bugle on it you don't have to grab them it seems like a more sanitary way to reach in the bag right they feel like they won't hurt me they don't have to grab them. It seems like a more sanitary way to reach in the bag, right?
Starting point is 00:12:25 I don't know. They feel like they won't hurt me. Yeah. They don't feel scary at all. No, bugle thimbles. Yeah. Meanwhile, they're pointy. They can be scary.
Starting point is 00:12:34 Yeah. They can fuck your mouth up for sure. Oh, yeah, yeah, yeah. After when you eat, you know, two bags of them in six hours. Two bags and a salty treat? Oh, boy. And we're not talking. It sounds about to be raw. We're not talking travel.
Starting point is 00:12:43 We're talking whole bags. Big one. Yeah. For your house. That's we just fucking like i'm having a super bowl party different flavors yeah let's get some of that ranch fucking flavor that's good and let's get the regular too that's how we that's how we drive so um janelle mcdonough who is marx's wife at the time and the mother of his two children is also also in jail in Michigan, as we know, on the obstruction of justice. So he's gotten both of his women, his wife and his pregnant girlfriend, to participate in this with him. This is a scary man. States apart. States apart.
Starting point is 00:13:17 Yeah, he can control people from another state. So she's accused of obviously letting those two stay in her home from january 5th january 9th she allowed maxwell and marks to stay in her home we went over that last time but just in case catch people up don't really yeah part two of a show they'd be like here's a recap information yeah this information matters so um yeah this my God, I can't believe that. And he was obviously found in a trash can. Now, he met Jenna Scott, Cedric did, on Tinder in 2015. Right. That's wonderful.
Starting point is 00:13:55 Like we said, she had applied for a protective order against him after he broke into her home and threatened her and her nine-year-old daughter. And they declined it. Yeah, yeah. That's what the judge wouldn't give it to her. If we remember, we went over his statement uh the judge's statement in his burglary arrest though it was claimed he was hang angry at him for ending their relationship and she claimed that he choked her all the time and threatened her life jesus christ um his mom now i'm sorry swearingen who is now in a a long term relationship with a woman named Rachel Foster, was friends with Jenna.
Starting point is 00:14:28 And I guess the ex of the of his pregnant girlfriend, which seems like a really big coincidence. But Swearingen's mom said, I've been falling apart. I've been exhausted because I can't sleep. We used to watch these cases on Dateline in 2020, and they don't show the personal side of it. And it's horrific. It's a nightmare. Yeah. That is the thing about those.
Starting point is 00:14:52 Your son's missing. That's horrible. Yeah. Right. She said Michael and Jenna are not coming back, and that nightmare is still there, and they don't show that on those TV shows. They do, though. They show family members crying all the time on TV shows. That's usually the base of the show is like.
Starting point is 00:15:06 Yeah. And generally, if they say this person's dead, they're not coming home. They're not coming. Yeah. Yeah. So we're not trying to make fun of her. I'm just saying. I'm just saying.
Starting point is 00:15:13 Yeah. Yeah. So Jenna Scott's father said it's still tough to process. We're still grieving. And we're fortunate that Jenna and Michael were found and that this is going to move forward as a murder case, as it should. And we will seek justice at some point in the future for Jenna and Michael. We will.
Starting point is 00:15:29 Wow. So those are separate thoughts. The murder case is going forward, but then we're going to seek justice. Like I'm going to find him myself is what it sounds like. Oh, they're going to sentence him to some things. And then after they do that, then we'll figure out how to get justice. I'm going to pay a scumbag to shank him. do that then we'll figure out how to get justice i'm gonna pay a scumbag to shank him i'm gonna put fucking a hundred dollars in somebody's commissary and they'll cut his throat in the
Starting point is 00:15:49 shower we also bought flower sacks and uh and horses we're coming to get him yeah jesus christ man so uh yeah they also bring up here at this point that don't forget april peace as well she is the one who's been missing in minnesota since 2009 yeah right so his other girlfriend last time she was seen was in bloomington minnesota on march 17 2009 and hasn't been heard for from or found since and her kids missing too uh no no just no yeah just her so they said april peace was reported missing in september 2009 the case has been open since that time. We're aware of the developments in Texas regarding another missing persons case and have been in contact with local law enforcement.
Starting point is 00:16:32 Yeah. And that was in the midst of their custody battle. Right. Yeah. That's he was having the custody battle. She failed to show up for court and he told the court, well, she must have relapsed. And then they gave him custody of the kid. Right.
Starting point is 00:16:47 She never showed up. He was never arrested. He was questioned. But that's how that goes. Now, February 9th, 2019. He's got a lot against him right now. He's got the girlfriend saying he did it and everything. He does a video call from a Texas jail where he does a an interview with a tv station kprc
Starting point is 00:17:08 2 and this is there's clips of this on youtube and he is unhinged man um really he is going to be unhinged from here on out just i'm talking he's been unhinged for you know more than an episode now but i mean this is just way to hear him in court. This guy is off the fucking charts. Insane. Wow. He says he didn't kill Jenna Scott or Michael Swearingen. You got to be kidding me. He said, I can only imagine what's going on with their family.
Starting point is 00:17:35 And I'm so sorry for their losses. But I did not. There he is not using contractions. Yeah, I did not. And had nothing to do with this. Yeah, but Maya said you did yeah does he know that that's the thing someone yeah does he know your your girlfriend said i saw him i was in the house with him yeah your girlfriend said we took a really long ride together with them and listen to the breakdown too i'm sorry for their losses but i did not and had nothing to
Starting point is 00:18:04 do with this you that's not a state i did not what what did you not do right they usually say like i had nothing to do with their death that's minimizing that's saying i didn't kill him because kill is a rough word he wouldn't even he didn't even acknowledge they're dead they were dead the first one i did not left off and that had nothing to do with this. With what? Two bodies is just this. That's a big this. That's a lot of this right there.
Starting point is 00:18:32 Really broad stroking it here, sir. Too much this, Cedric. That's a, oof. Man. So, yeah, he says he didn't do it. He said he was not. And by the way, when he escaped from the prison van and then hid in the garbage can, he said that he, quote, was not trying to escape. He was just hungry?
Starting point is 00:18:51 He loves garbage. When he was a kid, you know, he felt more comfortable of when he was scared or something. He'd crawl into a garbage can and it felt safe to him. I was not trying to escape. I was trying to help Lenny Dykstra find his grill. That's it. I was afraid that maybe Lenny Dykstra find his grill. That's it. I was afraid that maybe Lenny Dykstra's dentures were in there. That's what it was.
Starting point is 00:19:09 I called that clown wrestler guy, but he didn't show up. What the fuck was his name? I don't even remember. It doesn't matter. Sprinkles? Sprinkles, I think, yes. He said, I was actually in fear, and I was not going anywhere at all. In fear of what?
Starting point is 00:19:23 You're in a fucking transport van. That is interesting. By the way, they do mention in this article that neither the police nor the company that was transporting him, the Texas Prisoner Transportation Service, have explained how he managed to not stay in custody when he was wearing leg, hand and belly restraints. Yeah. in custody when he was wearing leg, hand, and belly restraints. Yeah, how they let him go, guys. He's wearing the whole serial killer outfit when all their chains are connected and their hands are down by their hips because it's connected to their belly and their legs. That's what he was wearing.
Starting point is 00:19:55 And they've got like a four-inch stride. And he took off somehow in that. Like, that seems tough. He also says this. He says, that Maxwell woman, crazy. Maya Maxwell, total nutcase okay yeah pregnancy hormones you know how they are one day they want ice yeah yeah one day they want ice cream and wheat thins the next day they're saying they were there during a murder it's just it's
Starting point is 00:20:18 hormones it's all hormones you know it's a peanut butter pickle and onion sandwich and and she'll calm down and then she'll yeah well no she'll that one day and then the next day it's this. You know, you never know. So he says that he believes that the police forced her to make those statements. Yeah. He says, quote, I believe that they coerced her and scared her and forced her to say some of those things. But none of this has involved me. So she did it your pregnant
Starting point is 00:20:46 girlfriend killed these two people so he's being held on 1.75 million dollar bond for charges that include capital murder which is uh yeah he says this this is the best one too quote not only do i have no history of violence toward women or children. What? Not only have I reinvented myself completely, but I teach women's assault programs for free. Or I
Starting point is 00:21:16 did before I went on the run. So I'm trying to help women, as a matter of fact. I'm teaching them how to fend guys like you think I am off. This is crazy. You guys are fucking nuts. teaching them how to fend guys like you think i am off this is crazy you guys are fucking nuts wow i'm how to sniff us out that's what i'm saying so this is fucking crazy now we don't know what dates he's had but now it comes out with all of these other things he's been arrested for over the years that didn't come out in the paper when they he got arrested
Starting point is 00:21:41 so it didn't come out in the news at all. These are charges and convictions in other states. Some were dismissed. Who knows? We have phone harassment in Seattle, which we knew about. Criminal assault in Tacoma. A fugitive warrant in Michigan, which we knew about. Assault and battery with a dangerous weapon in Tulsa. Robbery with a firearm in Tulsa County, Oklahoma.
Starting point is 00:22:04 Robbery attempt with a dangerous weapon in Tulsa County. Robbery with a firearm in Tulsa County, Oklahoma. Robbery attempt with a dangerous weapon in Tulsa County. Robbery with a firearm in Tulsa County. Attempted escape. And then the phone harassment he was convicted of and the violent robbery he was convicted of and charged sentence to 15 years at the time. By the way, we found out that when the first episode we said he was from tulsa california we were like that's really weird that doesn't exist okay there are multiple sources that say he's from tulsa california it's not one source that right multiple three different sites said tulsa california and they were reputable ones so we were like yeah that makes sense and then you look into
Starting point is 00:22:43 it you know if you look at 14 sites, you see Oklahoma on there. And then you can just deduce because then we looked up, is there a Tulsa, California? And there isn't. So we had a week's worth of tweeting for nothing. For nothing. All of that. For nothing. So, yeah, people, that's funny.
Starting point is 00:23:02 This is going to come out. It's going to be out there, but they'll still be tweeting. that's the problem we're like no no just listen there's more we promise we know we're dumb yeah so february 11th 2011 they uh he says okay the judge who said he was not comfortable with dismissing the protection order there he said he said he wasn't comfortable with dismissing the protective order that the woman had against him that he's now been accused of killing but he said that marks he thought he acted in self-defense that's why that's what it was oh so they're both aggressive and she was more aggressive and he's not giving a restraining order somebody that's more aggressive than the other person that's what the judge is saying well yeah because he had said um in court cedric said she knew just how to do enough to keep me going
Starting point is 00:23:49 and a lot of times she beat me and she punched me okay so he said oh it must have been self-defense yeah i like how in court by the way she said about him scott quote he gets his you know whatever keeps him going it comes from a place of evilness. That's what she said about him. A place of evilness is great. I like that a lot. So Scott described an incident in either January 2018 or December 2017 in which she said she was at Marx's house. She said she had his cell phone in the bathroom and was about to go through it.
Starting point is 00:24:25 She's about to find some shit out. Don't do that. Quote, I was in the bathroom and he came up to me and he walked up from behind me and he had one of his arms around my neck like this. And she said that she passed out when she woke up. He was on top of her. Now, we talked about this incident, but here's the actual quote from it here. She said that he then put his hands around her neck and choked her until she lost consciousness again and then in 2018 he put one hand around her neck and covered her mouth and nose with the other hand until she passed out she said that his two children were in the house at the time and um yeah that's that's wild uh he said who he by the way way, during, Oh my God, during all of that, he had represented himself in court,
Starting point is 00:25:07 which didn't work. No. And he said, well, why didn't you ever report any of the attacks to the police? And she said, I couldn't tell my parents and have them worrying about me and having to fear for my life and having my friends fear for my life. And I was too far down my career path to be making this known. That's what she said. Like a lot of people. It was just a very inconvenient thing and she was trying to I don't know, mitigate it in some kind of way here.
Starting point is 00:25:34 She also said that there was a time when he had a desire to hurt and kill animals as well. She described an incident in which she said that Cedric hurt his baby cousin as well here. She said it was in a car seat. He just takes the buckle of the seat and like hit the baby with it.
Starting point is 00:25:53 What the fuck, man? He hit the baby with the fuck. With a buckle? Yes, with the buckle. That's what she said here. So now during that trial as well, they called Swearengin to the stand. Yeah. And he never got to testify because there was a some technical issue about it here in the beginning. But then he finally gets up there and Marks asked the judge if his kids could sit in the courtroom.
Starting point is 00:26:21 And the judge said, I am not comfortable comfortable i don't want children in the proceeding oh that's right he said that the uh the other lawyer said that the prosecutor said i don't want children in the courtroom right now i want to hear this shit yeah they said but it was an open courtroom and they were marxist children so if he wanted them there he could as his parents as the parents say it was okay for them so then they said the witness sequestration rule. That's why Swearingen never got to testify. Okay. So here is the original affidavit from Jenna Scott. Okay.
Starting point is 00:26:52 I started dating Cedric Marks in August 2015. We met through an online app called, and this must be a typo, in the affidavit, probably an autocorrect, Tinder. Tinder.
Starting point is 00:27:04 Met him on Tinder, which is like tinder but for people you want to murder i guess or for potential murder yeah it's just straight up sex that's it that's all it is tender right just meat just all meat meat in every direction tender tender meat as our relationship progressed i became aware of his manipulative and deceitful nature i believe he's a pathological liar i also believe he's a psychopath he told me about killing pets when he was a child in oklahoma and that he was in and out of psychiatric facilities during his childhood he told me he had killed someone in oklahoma but that he was able to cover it up and he could do the same here in tex He was convicted of a felony in Oklahoma. He does not have a driver's license,
Starting point is 00:27:48 but he drives all over Bell County in his red Jeep. He told me he would hurt my family and me repeatedly. Every time I try to break up with him, he threatens me. He's an MMA professional fighter. He trains fighters. He has a gang of fighters who will do his bidding. He has threatened me physically and threatened my livelihood. On two occasions, he choked me until I lost consciousness. Each time he allowed me to regain consciousness, then choked me out again. When we've talked about these, all these assaults happen within the last six months. I would have to I have to stay away from him to stay safe and protect the people I love.
Starting point is 00:28:22 Last year, my counselor called the police to report that Cedric was harassing me. I will bring those records with me to the hearing. I'm terrified of this man that I know so much about him, now that I know so much about him. I worry about his children and do not want to keep him and want to keep him away from my child. She said that he contacted the dean of the college where I'm at graduate school
Starting point is 00:28:44 and tried to get me expelled because of a video he has of me. Oh, no. I do not know what all the videos show that he has. I want them. I got a feeling. I have a feeling, too. I want them back and destroyed so he cannot hold them over my head any longer. He played at least one of them for the dean.
Starting point is 00:29:01 He threatens me every time I try to break up with him. He knows how to push all my buttons. I know he can kill me, and I do not want him to be able to pick me up and throw me down just because he can. In spring of this year, he picked me up out of his Jeep and threw me to the ground in front of title boxing. I'm terrified of this man. I've just gotten away from him after three years. I need to be protected from this man. And that's the affidavit that the judge refused
Starting point is 00:29:25 to give a protective water on how all right i won't question a judge because he clearly yeah he has much more than us education on this and he's probably wow many more stories than i i mean look at it i'd go you know what go ahead got this. Perhaps we should have more than one judge look at things like that. If one feels that maybe no, maybe pass it to another and be like, I don't think. But maybe you am I am I too immersed in this? Have I heard too much? And maybe for my shock value. I'm hard to shock now.
Starting point is 00:30:02 Yeah, I think I think that's what it is. It's me. You know what? It's me. You know what? It's me. He picked me up out of a Jeep and threw me to the ground. Yeah, in front of- In public. In public, in front of the place he worked, by the way, in front of his job. Taylor Swift is soaring high, her every move captured in the news cycle and devoured by

That seems to not fly, right? What? no i don't think that that seems to not fly right that doesn't seem that's not right how do you how do you not issue it based on that alone in public in public yeah well they said he said she came at me and i was in fear of her so the judge said well let's just call it even fuck it knock on the wall and ask the other judge in the next courtroom to come over no shit he had his son testify in this trial by the way had a son testify got him up on the stand one of the boys told a story of a time when he said jenna scott or scott came over to their house as they were leaving to go to a toy store yeah he said his father was in his car when scott began screaming and banging on the car window he said she then laid down behind the front tire.
Starting point is 00:32:48 After that, he said that Scott got in the car and started yelling at his dad. Quote, she was screaming at you, and then she was talking to his dad because his dad's questioning him. And then she was leaning over to the driver's side, and she had her hand out, which looked like, it was, to me, looked like she was trying to hit you. I wonder, this isn't coached at all.
Starting point is 00:33:07 I'm sure they also spoke about the violence between Scott and his dad. The guy, the kid said that Scott would hit and spit at Cedric and that one time threatened to kill him. Both boys testified that Mark's never threatened Scott if she left him, but said that Scott would often threaten him if he tried to leave her. He's representing himself? Oh, yeah, yeah.
Starting point is 00:33:28 And he thinks this testimony is good? Yes. This is a woman that's dead, yes? This is the trial for the first, this isn't the death, yeah, she's not dead yet because she's still testifying. Okay, they're still talking about, okay, all right. Yeah, yeah, she's still testifying. This is real good. This is excellent, yeah.
Starting point is 00:33:49 So this is the hearing for the restraining order. Oh, for the restraining order, got it. Yeah, this is all that. So we're just getting some deeper background into this relationship here. So he testified and said that she was the aggressor. He only acted in self-defense. He said the incident in which she took his phone and he choked her, he told a different story saying she threw the phone at him and then ran outside to her Jeep. He said she later came back in the house and went to the bathroom.
Starting point is 00:34:18 He said she went to the bathroom and began banging her head on the counter. She banged her head so hard she chipped her tooth. He talked about how Scott would often hit him, but that he never hit her back. He said that he knew, that she knew he would never hit a woman. He said, that's why she took advantage of me, hit me so much. She knew that I would never hit her back, and I haven't. He then explained the alleged choking incident,
Starting point is 00:34:42 saying he was laying on his bed when she jumped on top of him and began punching him in the groin. Just jumped on him like a like a hyperactive puppy and just started working over the ball bag. Just really fucking pummeling it. Nutsack in his speed bag in his nutsack here. And then she he said, quote, she would jackhammer punch me several times before I finally stood up. How many times did it take getting punched in the balls before you stand up? That's a pretty tough man. That's a tough man.
Starting point is 00:35:15 Are those things numb? Also a brain damaged man who it took 10 seconds to register that his balls are being fucking walloped. He said, I grabbed her by the shoulder and I spun her around and put her in what's called a rear-end choke, or as she called it, a chokehold. I did that to defend myself from her. He said that she never lost consciousness
Starting point is 00:35:36 and that she continued to talk. And yeah, so the judge ended up issuing a temporary restraining order until he could reach a final decision. And then, yeah, that's how that went. They said so. He ended up not doing it. And he said, I'm not super comfortable.
Starting point is 00:35:52 But, hey, what the fuck, basically, the judge said. Why not? So, yeah, that's pretty goddamn wild, I think, honestly. How does that judge not issue two and tell them both to stay the fuck away from each other yeah if that's the case then you know what good then you get one too yeah everybody stay away from everybody yeah everybody gets one but he does get the well she gets a temporary restraining order at first but then he doesn't want to give the whole the whole deal i guess is how it works here um so, so April 4th, 2019,
Starting point is 00:36:25 he's been indicted on capital murder charges in Texas. Okay. And, um, yeah. And so has Maya. She's charged still with tampering with evidence, even though she's going to testify,
Starting point is 00:36:35 which they'll do that. They'll, she'll plea. And then they'll say like, we'll do sentencing after you testify to make sure you testify and all that kind of shit. So they say that they found their bodies. Swearingen died of asphyxiation from being strangled.
Starting point is 00:36:51 Like a rear naked choke? Like a choke. They said Scott's autopsy hadn't been completed at this point, but they do say that she died from definitely homicidal violence. Yeah. Yeah. Definitely homicidal violence. Yeah. Scott's family told the newspaper that she they hope, quote, I hope the D.A. is planning on pursuing the death penalty. That's pretty much what's on, 2019, here, Cedric Marks says that Maya Maxwell is pregnant with his baby. This is when he announces it. By the way, my accomplice is pregnant.
Starting point is 00:37:36 He writes a letter to Channel 6, K-C-E-N, Channel 6, and says, hey, she's pregnant. And she's also, they've charged her with capital murder as well so they sent a letter there they sent a letter to marx the news did asking him whether he had anything to do with the murder of scott and swearingen he didn't say yes or no but he did say he knows who harmed scott but he doesn't give a name he just says minimized again yeah i know who harmed her that's what he said which again minimized yeah he's he's couldn't be more obvious distanced and minimized that's wild he said that maxwell's eight months pregnant with his baby and he said that maxwell is also receiving threats
Starting point is 00:38:17 from her lawyer and he was blocking her mail and visits okay the lawyer i guess so channel six reached out to maxwell's attorney and he said that's bullshit he said since being appointed to represent ms maxwell on january 30th i have been working with her on her case at no point have i ever threatened her blocked her from calling anyone or refused her visits all of the actions i have taken in her case have been with the consent and have been consistent with her wishes. Fair. Okay. Marks wrote in the letter that he thinks prosecutors are trying to force Maxwell in a plea deal.
Starting point is 00:38:53 Yeah. He said he made several accusations in this letter against jail staff, attorneys and police, which none of which could be substantiated. So, yeah, basically it was a rant against everybody's out to get him. So he's trying to utilize the media to try to muddle this case and cause it to be just a problem for everybody. Absolutely, yeah. He's saying it's everybody's against me. It's the jail staff.
Starting point is 00:39:17 It's her. It's the prosecutors. It's her lawyers. Historically, I'm trying to think of a single fucking time that this has ever worked that's a tough one yeah it hasn't worked much not a murder charge case anyway june 4th 2019 uh maya gives birth in jail she should yeah had a boy over the weekend all right and uh they said it's unclear what whose family it's going to be given to, this baby. She didn't get to keep him? Little mascot.
Starting point is 00:39:48 This is our jail mascot. Women's prison's crazy because they have fucking like the maternity wing. Yeah. And they're like, I've seen specials on it. Like one was at Rikers and they're just like, they're the most supportive all hanging out. Like, it's crazy. You're like, this is jail. This is so weird.
Starting point is 00:40:11 And they're wearing like their own clothes and shit yeah it's very strange so august 14th 2019 they decide that they are going to go for the death penalty against mr marks here oh boy yep notice to seek the death penalty they said that um he pled by the way, quote, absolutely not guilty to capital murder. Absolutely. Yeah. Which I believe is OJ's. You took OJ's thing. He said absolutely, positively, 100 percent not guilty. But he said, I think that's too wordy.
Starting point is 00:40:37 Go with absolutely not guilty. I'm going to trim the fat on this. I'm going to trim the fat and not bury the lead here. So, wow. This is fucking amazing uh the they claim that mark's attorney michael white said he was not surprised by the prosecutor seeking the death penalty he also said that his client is anticipating his day in court when his story can be told we gotta stop saying that anticipating his court. Can't wait. Yeah, that is backfiring an awful lot.
Starting point is 00:41:07 Can't wait. Yeah, this is not looking good for him here. The child, by the way, is being looked after by social services as the... Both families said, this is a baby of evil, maybe. Let's not keep it. Or social services said, no, and also no. Both of you are bad. That's what I mean. Look at what you people have produced. We don't want this. No, and also no. Yeah. Both of you are bad. That's what I mean.
Starting point is 00:41:26 Look at what you people have produced. We can't give this to you. You're going to have more. This is fucking crazy. So, yeah, that's how that goes. October 17th, 2019, there is a motion that will allow him to wear civilian clothes during the double murder trial, which I thought you were always supposed to be able to in trial. You should be able to.
Starting point is 00:41:45 Yeah. I thought that was a national law, but I guess that's just state by state because most. Is that right? He had to have a motion to do that. That's crazy. To wear civilian clothing instead of a prison uniform during jury selection in the trial. Yeah. If you put a guy in a prison uniform, he's a prisoner.
Starting point is 00:42:01 I can see that guy's a monster right now. Criminal. That's what you say. If a guy walks in a police uniform, you go, that guy's a cop. Right. Any uniform you put on that guy, our brain is going to think that's what he does. That's what he is. So, yeah, you can't not let a person wear a suit.
Starting point is 00:42:19 And they're not convicted yet, too. Right. That's the other part. And as soon as somebody said that, as soon as somebody said, well, I don't know, if they're in the uniform, they look like they're criminals. Everybody should be like, oh, yeah, yeah, yeah. That makes sense. We'll always put them in a suit. Duh.
Starting point is 00:42:33 Yeah. Jesus Christ. They also, they want to send their, they filed motions to send off evidence for independent analysis and DNA testing on all physical evidence the defense wants. Yeah. So March 19th, 2020 here. He is charged with the disappearance of April. Oh, yeah. Yes.
Starting point is 00:42:57 He is there also charged as another woman from Washington. Kelly, Kelly, Christine Sorenson, who's 34 at this point so she was young as fuck she was like 21 when this happened yeah yes um they said that he's been a person of interest obviously in peace's disappearance since 2019 but they've been able to do a lot of investigating since he's been in jail and um yeah that's what's going on they uh marks and Peace, obviously, we know they have a son, and he's fucking gone. So her body's never been found. The complaint says that before the alleged murder here, Sorensen, the young lady, told police that Marks grabbed Peace from the vehicle, put her in a chokehold, and dragged her out of sight. Oh, my.
Starting point is 00:43:43 He just chokes people to death. That's what he does. Well, there's no chokes people to death. That's what he does. Yeah. Well, there's no medic to wave it off. That's what I mean. She allegedly then tells police that a crying Marx later returned, saying that he killed Peace, then cut off her hands and removed her teeth.
Starting point is 00:44:00 Oh, boy. That is the next step. Yeah. If you're, that is the next step yeah if you're that is like are you what are you in the fucking lucchese family like what's going on your teeth and hands that's like are you a russian hitman what the fuck are you doing you can't do that that is insane so, yes, according to this, detectives met last month with Marks' wife, Janelle McDonough, who allegedly said Marks had confessed to killing Peace, saying that he did it in order to get sole custody of his son. So he told his wife about it. You know that other chick I'm banging who I got pregnant? Yeah. Don't worry. Don't worry. She's out of the picture. Holy shit. Yeah, that's wild. So the investigators here, the police said they never gave up on finding out the truth.
Starting point is 00:44:50 They said our thoughts are with the family as they reflect back on the 11 painful years she went missing. We'd also like to recognize the detectives who worked on the case, blah, blah, blah. So, yep, he said, wow. And he also, so he told two people about this. The one of the, one of the women here, either Sorenson or his wife said that he told them that the remains were buried somewhere in the Dakotas buried, buried up there. Yeah. At least it wasn't in his fucking hometown. buried up there yeah at least it wasn't his fucking hometown so august 25th 2021 the trial is going to start capital murder trial death penalty on the table tons of evidence against him in texas you want a fucking lawyer that's good like the best you want anybody other than yourself you want the best lawyer possible don't you you want like i mean this is like oh this is time give me texas johnny c that's who i want it's gonna say we saw the oj trial when you
Starting point is 00:45:51 have lawyers you can see what happens we've heard of a lot of trials where they don't have lawyers like that it doesn't go down like that he says i think i'll represent myself. Unbelievable. In a capital murder case. In Texas. In Texas. Okay. Wow. He signed the motion to discharge his counsel. Wow. The judge ordered the regional public defender for capital cases to hand over the defense file to Cedric Marks.
Starting point is 00:46:19 Holy shit. The judge said okay? Yeah, they let him do it it which is crazy because that seems like i guess but they go through a lot of things now where you basically sign away you basically say look i know i'm not a good lawyer yeah i know i'd be better represented by somebody else but i'm insisting on this so if this fucks up i can't say the judge let me do this and he shouldn't have that's kind of how it goes now you've got to at least sign away one appeal. Yeah, this is crazy.
Starting point is 00:46:49 So the date is set for it. It's going to begin in April 2023. April 17th, 2023 is when it was going to start. And this is after all sorts of legal wranglings over whether he's going to be able to represent himself. The most recent delay was due to Marx's request that each potential juror be submitted to individual questioning, which they don't normally do. Everybody. They normally like, who here has family in law enforcement?
Starting point is 00:47:16 They dismiss that group of people. He wants to talk to every single person because it takes longer. He wants it. He wants to. And he's in jail. What the fuck else does he have to do? That's the thing. That's the other problem.
Starting point is 00:47:26 That's just another person he gets to talk to today. Yeah. So then there was a motion. Then the judge had to think about that. And that was a delay to see if he would let them delay it even fucking more. Right. Jesus Christ. So yeah, he's accused of choking at least, well, the two that he's being charged with
Starting point is 00:47:42 here are the two chokeouts for scott and swearingen which is insane that he choked these two people to death after he choked another lady to death and drove them all the way across the panhandle of texas that's what's fucking crazy so trial comes going here and um it's a you know this is a tense trial there's i can't imagine two younger people are dead and their families are very pissed off, rightfully so. And he's representing himself, which it's one thing if the defendant sits there quietly through the whole trial. You'd glance over at him and want to fucking choke him out every once in a while. Yeah.
Starting point is 00:48:17 But if he gets up and constantly talks and won't shut the fuck up and is a pain in the ass and a problem. I don't know how you don't jump out of your seat and just be like, I am going to beat you to fucking death in the courtroom with the judge's gavel. I can't take it anymore. Like the guy from that fucking parade driving guy? Yeah. Oh, fuck. He would not shut up.
Starting point is 00:48:38 Yeah, exactly. That's what I mean. That asshole. How do you deal with that? Ted Bundy did the same thing. People who do this represent themselves. It's clearly not in their best interest. No, no.
Starting point is 00:48:50 This is because they're a narcissist and they have a giant ego and they like to hear themselves talk. Or they're trying to cause so much disruption. They're trying to get a mistrial. But that doesn't happen. What happens is you go to jail forever. Yep. happen what happens is you go to jail forever yep and at the same time they also at the center of it somewhere is the desire to be able to hold court literally hold court and fucking do whatever yeah you get to question the people who are against you personally and you know try to intimidate
Starting point is 00:49:19 them or whatever the fuck you do meanwhile you're fucking with a pissed off state of texas that you just drove two bodies allegedly through their state and sidestepped the texas rangers all the way through the panhandle where they are the most ruthless those sons of bitches you can't do two miles over the speed limit without getting a ticket and he got two bodies through that fucking unbelievable two bodies so yeah he said that the prosecutor said there will be a lot of evidence they have a walmart surveillance footage of cedric buying clothes and a shovel before the two bodies were taken to oklahoma perfect that's not great he's gonna i'm gonna be dirty and i need to dig a hole i need I need to dig a hole and then a change of clothes. Oh, man.
Starting point is 00:50:09 He said that he plans to cross-examine each piece of evidence that implies he's guilty. He also said that he's been asking for a speedy trial since 2001 and he says he wants, quote, justice for everyone. Oh, I got a feeling you're gonna get it this motherfucker is out of his mind out of his mind the first witness called to the stand was deborah harrison who's the mother of swearingen she took everyone through the day that she found out her son was missing she said that uh she went to her son's house in the morning because she was informed an alarm was going off she walked around the house and saw her son's dog in the kennel she assumed that he made a quick trip to the store but around noon came and
Starting point is 00:50:51 she found out that he didn't go to a work meeting so she called the police and they said that he and his car neither of them were anywhere to be found she said he was a good son and uh she had to convince the temple police that this wasn't normal for him, and he didn't just take off. Because they were like, he's a young guy. He probably drove somewhere. Maybe he's got a girlfriend, and he went and saw her. And they're like, no, damn it. He's missing.
Starting point is 00:51:13 And this guy gets to cross-examine that. Yes. He gets to cross-examine the mother of a victim. Oh, dear Christ. Think about that, how that is. But think about how dumb and egotistical you have to do to do that. Because do you think the jury likes that? God, no.
Starting point is 00:51:31 They see you as a monster. If you can't be aggressive with her. No. And if you are, you're just extra torturing a woman. And then we see you as a guy that's getting more pleasure from this murder. You look way worse. And if you're extra nice, it looks creepy. The only way to do that is to have a lawyer who's not you.
Starting point is 00:51:50 If only there was someone who could ask these questions for you. If only that existed in this country. Some sort of intermediary. Yeah, some guy. You could tell him what to ask and stuff, but then he would do it and they wouldn't hate you personally for it. Kind of like why we have agents. So you don't hate us personally for being d of like why we have agents yeah so you don't hate us
Starting point is 00:52:05 personally for being dicks and wanting more money from you not you people personally venues and such yeah so jesus she mentioned that her son had told her how mark said he was going to kill him while he was leaving a 2018 protective order hearing against marks in the court he told him he's going to kill him after he put on his big show. Swearingen had bought a gun and security cameras after the threat because he was afraid. She said she thought at the time Marks said that he was that because he was angry that she didn't think it would actually happen. That's how it went. So April 18th here. Jenna Scott's mother.
Starting point is 00:52:45 She testifies. Yeah. She said that she was scared. Her daughter was scared of Marks. And she explained how the two dated for nearly three years. She said that Marks was kind at the beginning. Then he became physically and emotionally abusive and that Jenna tried to file a protective order against him in 2018 with the judge denied it. So, yeah, it's crazy that he's cross-examining.
Starting point is 00:53:09 He asked her, Marks asked the victim's mother, if she was aware that Jenna Scott was reportedly charged with domestic abuse and making terroristic threats in 2011. But the mother said that she wasn't aware. And Cedric said, I'd like to remind you that you're under oath. wasn't aware and the cedric said i'd like to remind you that you're under oath if i'm on the jury i cannot wait to fucking say this guy's guilty i can't wait like can i can we stop this now because there's a lot of evidence and to remind you just his the way he's acting now makes me think he's even guiltier than any amount of evidence. That shovel and all that stuff, you can show me all that you want. I want to fucking strap this guy into a chair of some kind myself. Maybe not electric, but something.
Starting point is 00:53:53 He just told a woman that's missing her child, I'd like to remind you under oath. You're under oath, so please talk shit about your child in court. In cross-examination, Marx also brought up that he taught self-defense classes and is an advocate against domestic violence well that must mean he's innocent then obviously he says that jenna scott took those classes so she should know how to defend herself so how would he beat her i showed her all my best moves wow so she got off the stand and started you know sobbing and. It was a horrible experience, I'm sure. But she gutted it out, threw it, and didn't cry on the stand. That's impressive. Swearingen's best friend, Corey Cross, was called as the next witness. Sounds like an 80s pop star. You know Corey Cross? You know that guy? Yeah, that song. Or just the love interest in any John Hughes movie.
Starting point is 00:54:46 that song and wow just the love interest in any john hughes movie yeah cory cross i could see uh jason marsden playing that role james marsden jason james marsden yeah he could play hi i'm cory cross you're damn right you are yeah cross is just one of those uh he's one of the friends uh who helped access the security footage from swearingen's home as well as track down his phone location history wow so uh there's footage they see in the courtroom watching swearingen leave his house at 4 10 p.m and that's the last time you see him alive okay the next morning the mother comes and he's not there so he's been gone that whole time. Jenna Scott then runs into Swearingen's house at 438. Okay. Then there's another person who rings the doorbell around 715.
Starting point is 00:55:32 So when Mark's question cross here about the person at the front door, he asked if the hand was a black man's hand or if the bone structure was similar to his. Was it a black person with a hand like mine yeah and cross said that you can't tell the skin color from the security footage because it's nighttime and the footage is gray so everybody looks gray is what it is it's just uh yeah everybody's a newspaper fucking comic character at this point yeah look at any fucking ring doorbell or any of them and i yeah you just yeah unless you have amazing lights out there so they said the two went back and forth and debated the matter for over an hour cedric hour over the hand before the judge finally said okay
Starting point is 00:56:20 move along now which the judge should have cut that off after the first three times it went back and forth. Ten minutes. Yeah. So after the doorbell ring from an unknown person, the report show that the motion detection was activated throughout the rest of the evening. However, the log shows the footage was accessed and deleted around 830 p.m. on January 3rd, 2019. Wow. Yeah. The next footage, video footage, is of Swearingen's girlfriend, Rachel Foster,
Starting point is 00:56:50 ringing the doorbell around 10.39 p.m. that same night. At 10.46, she knocks again. So she rings the doorbell, waits a while, and then knocks again. Almost four hours later. Yeah. There isn't much activity throughout the rest of the night, Again, almost four hours later. Yeah.
Starting point is 00:57:04 There isn't much activity throughout the rest of the night. But reports show text messages from both Jenna Scott and Michael around 3 a.m. to their friends. OK. So they were somewhere. Now, flash forward here. 8 p.m. There's a text message exchange or 8 a.m. The next morning. There's a text message exchange between Jenna and her mom.
Starting point is 00:57:22 there's a text message exchange between Jenna and her mom. Jenna said she's going to a doctor's appointment and is planning on heading back from Austin, which is where she said her and Swearingen were going the night before. So, around 8.15am now, January
Starting point is 00:57:38 4th, 2019, Swearingen's mom, Deborah Harrison, was notified that alarms were going off at her son's house. However, he wasn't there, and Harrison was notified that alarms were going off at her son's house. However, he wasn't there and neither was Jenna Scott. Wow. So after analyzing the phone history tracking cross and his friends were able to locate swear engines car in Austin,
Starting point is 00:57:56 Texas near a barbecue restaurant. So they found the car, but not him. Right. So when he can, Mark's continued to cross cross examine cross, he doing cross on cross. Yeah. He brought up video that he wanted to submit into evidence. It contained video of parts of Jenna and Scott, Jenna, Scott and Mark's his relationship. So prior to the testimony, the judge denied the request of submitting it as evidence. And Mark said to the judge, we may as well not have a trial if I can't present evidence, which isn't how trials work.
Starting point is 00:58:28 They tell you what you can do. Also, he doesn't know that he's doing it, but this looks so bad. It's making it worse. Every bit of information that he introduces, you can see where it's going to and this is so bad for him. But for him, I think psychologically to be in charge of this and going to and this is so bad for him but for him i think psychologically to be in charge of this and in control of this is more important than the outcome you might be right it's that big of a i have to think about how he controls everybody yeah he controls every woman
Starting point is 00:58:58 every person in his life he chokes people he's a he needs to control shit. He doesn't realize that the story that's being told right now in the mind of a normal person looks like he killed people and then texted their fucking family with their phone. That is psychotic and disgusting. Psychotic and sick. It's like cutting somebody's hands and taking their teeth. Yes. Like a dangerous human being. He's a sick taking their teeth. Yes. Yeah. Like a dangerous human being. He's a sick, sick, sick fuck. Wow.
Starting point is 00:59:29 And then took the man's phone, got into his doorbell app, and deleted footage from his phone. That's what I mean. Sick. Scary. Scary. Scary individual. That's like this guy. Yeah.
Starting point is 00:59:43 You can't even. Like this is what Ted Bundy wanted to do. He wanted to control the narrative. The courtroom. Yeah. He knew he was getting convicted. Yeah. He knew the evidence was against him and all that, but he wanted to control it all.
Starting point is 00:59:56 He wanted to show off. He wanted to give his side of the story, which is Ted Bundy. You have a side to the story, man. That's what I'm saying. This fucking guy. Get the fuck out of here. Wow. Another witness comes up, family friend and a religious mentor to Swearengin. He said that Michael was childlike and a realist.
Starting point is 01:00:16 I don't know how you can be both of those things at the same time. What the fuck? I don't get it, but he said he was a good man. He went through how he looked through Swearengen's bank account, laptop, and security system to find out where Michael and Jenna were located. He also aided in building the community timeline of Jenna and Michael's whereabouts. All their friends accessed all this shit
Starting point is 01:00:34 and they were all like, it was like a technology project together to try to- Good for them. Yeah, it's pretty cool. The wait is over. So far, you're not losing. The only thing you're losing is my patience. Quickly, I see that.
Starting point is 01:00:46 Bing! The queen of the courtroom is back. I didn't do anything. You wouldn't know the truth if it came up and slapped you in the face. I see he's not intimidated by anything. I can fix that. New cases. She wanted to fight me.
Starting point is 01:01:03 Leave her alone. Okay, so, me. Leave her. A long. Okay, so, um... This is not a so. This is a period. Classic Judy. Did you sleep with her? Yes, Your Honor. You married his cousin. His brother.
Starting point is 01:01:17 That's not him. Yes, ma'am. I would make a beeline for the door. The Emmy Award-winning series returns. How did I know that? I have crystal ball in my head. It's an all new season. It's streaming. You can say anything. Judy Justice.
Starting point is 01:01:34 Only on Freebie. So around 1.10pm at the end of the time on the stand, not in the timeline of the murder, at trial here. The prosecution there, Marks was going back and forth with this Kurtz guy on statements over doorbell footage analysis and phone data tracking. Another guy, Richie Davis, took the stand, childhood friend of Swearengin. They were in a band together and shit.
Starting point is 01:02:02 He says that Michael liked to play sports and wanted to be a Christian metal vocalist interesting okay he said whatever floats your boat I guess he said that but never ever play me Christian metal because I will fucking lose my mind I just don't want to hear
Starting point is 01:02:20 I just don't know how that's a thing I don't know how you can do that I just don't want to hear a chord of that shit at all i mean the whole idea is to go against what that is yes that's the thing yeah so we're gonna we're gonna turn it on its head man it's an anti-hero that goes with the i don't get it it makes no sense so this guy davis said he found out when michael went missing he immediately knew something was wrong. Not seeing bank activity since Michael liked to eat out often. He goes, well, he hasn't eaten anywhere. So that's weird.
Starting point is 01:02:51 So they confirmed the security activity log of Michael's home came from January 3rd. And tracking down the car to Austin, they said that Michael's car was left unlocked when found. They said that that wasn't a thing that Michael would usually do. Michael had no spare car key. Before the recess, they told prosecutors that he reached out to Swearingen's neighbors to see if they had any footage as well. They found video from January 3rd that evening of a white vehicle near Swearingen's home. So the guy said that neighbors didn't recognize the vehicle. January 3rd that evening of a white vehicle near swear engines home. Okay.
Starting point is 01:03:28 So the guy said that neighbors didn't recognize the vehicle. It was driving back and forth in front of his home though. Huh? It marks his cross examination. He asked if that person could tell if anyone was in the vehicle and if he knew when the video was taken the process. Yeah, it's driving. Yeah.
Starting point is 01:03:46 Clearly somebody's in there. What are we talking are we talking about obviously yeah could you see anybody it was a ghost car it's just it's just going yeah so when the prosecutor countered to say the picture was a captured video of a vehicle in motion so we pretty sure know somebody was inside that's exactly what he said like his his honest to god fucking thought was do you are you sure anybody was in that car that's your that's why you don't represent yourself because that's not a question that just makes you look like a moron to the jury sure that they weren't doing the tiktok trend and dancing on the side of it you don't know where they duck down below the window level dancing on the side. Then they were just going to hop back in.
Starting point is 01:04:25 It's possible. Ghost riding the whip. That's right. So they, Mark's asked if, uh, if Davis knew of Jenna, uh,
Starting point is 01:04:35 and Scott's relationship, uh, and the recognition of a black truck, Davis said he heard of a black truck near swearing in his home, but had no footage of it. So Kayla Reese then takes the stand. She's a neighbor who's diagonal to Swearingen's home. Around 11.25 a.m. Tuesday, they have that.
Starting point is 01:04:56 They said that – oh, I'm sorry. Back to Corey Cross because the other person came on just to say she saw the car. Cross says that Michael liked to let others know where he was going and was communicative and responsive. Swearingen is everybody's best friend, they said. Well, he's also a guy in his 20s in 2019, so he tells everybody everything about his entire life. Everything. Yeah, it's documented thoroughly. You could put together a timeline of every morsel of food the man's eaten probably for five years. You know what I mean? And that's not an insult. It's just,
Starting point is 01:05:28 no, that's how people are. Society is. Yeah. So, uh, they continue to discuss the timeline and the rest of Swearingen and Scott's family and friends, uh, put together detailing their activities. They mentioned how security records were visible to see activity in Michael's house and that the swear engines, I guess it was access to delete the camera footage, like we said, from 830 to 843 p.m. from Michael's Google account, which could probably be accessed from his phone. So Marks was denied bringing one of his exhibits after Corey alleged that he saw a video of Marks recording Jenna after taking her out of her car. The court then went through doorbell footage of what Swearingen and Scott were last seen on video. Now, April 20th, so 4-20 trial here, after reporting them missing, both of their families, Swearingen and Scott, met up at Swearingen's home to help with search efforts.
Starting point is 01:06:26 So one of the officers who arrived there helped out as well. That's Officer James Lewis. He said the Swearingen family told him items from the home were missing and out of place. That's what they said. So shit had gone down in the house. So the cop took photos around the home. In the photos, three knives from the kitchen block, from the knife block in the kitchen, were missing. Also in the garage, items his family said could usually be found in the trunk of his car were found inside of the garage off to the side.
Starting point is 01:06:55 Huh, like they were unloaded. Yes. No forensics were taken of the items in the kitchen or garage or collect any DNA for some reason. What the fuck? I don't know why that is. Because they don't really think that the cops are still this is the first day so the cops are still on so there's like a 30 year old guy quote missing and his car's gone and he's off with some other woman even though he has a girlfriend and we're gonna not think that he's just hanging out with this other girl right
Starting point is 01:07:20 that's what the cops think here so swearingaringen's girlfriend, Rachel Foster, she took the stand here and examined the text messages she sent to the family and friends when she found out Swearingen was missing. In those messages, she mentioned the crazy ex Jenna was with him and how he was how Jenna's crazy ex was dangerous, meaning Cedric. He's dangerous. So Foster also said Marks texted about, quote, cutting Michael's head off in 2018 that he wanted to. Not that he had. So she also mentioned how she'd always heard of what Marks had done to Scott, but never saw him do anything to her with his own with her own eyes. Never witnessed the abuse. Also a mention of a Facebook post where Swearengin expressed his love for someone. Foster
Starting point is 01:08:08 says Marx assumed it was about Scott and freaked out. That's his woman, goddammit, even though they're not together. Made an assumption. Yeah. So, owners of businesses outside of where Swearengin's car was found said that he
Starting point is 01:08:24 and Scott, when they weren't missing, took the stand. Surveillance video ofen's car was found said that he and Scott, when they were at Messing, took the stand. Surveillance video of where the car is found was shown in court. April 21st, Austin Police crime scene supervisor processed Swearingen's car for DNA. So he's going to testify. He said there were fingerprints on the car and candy wrappers and parts of the inside of the car. So we're there just all over the place. Road snacks. After testing bugle bags, you know how it goes.
Starting point is 01:08:50 Yeah. After testing the evidence on local, state, and federally automated systems, nothing was detected. Also, no keys found inside the car. Hyundai field service engineer John Ray Morrison examined the GPS of the car. The car was at two locations, one in Temple, one in Killeen, on January 3rd, 2019. No locations were detected after that day. So it was driven from Killeen to Temple, dropped off, and then there you go.
Starting point is 01:09:19 So one point they tried to make clear was how the floor mat on the driver's side of the car was missing, but the rest of the car had floor mats. Interesting. Yeah. So maybe some blood on there or whatever. So we stepped on something, got it on the mat, and we take the mat with us. That's how it goes, man. Another witness here was a member of the First Baptist Church and Temple. And the witness said she saw Marks for a split second parked inside of a
Starting point is 01:09:46 white car in the church parking lot. Oh, Mark's argued. She didn't have enough time to determine whether it was him or not. So her claim isn't substantial. However, the witness stood firm on her belief that it was, I saw you motherfucker.
Starting point is 01:09:59 Yeah, that's the thing. It's much easier for a lawyer to go. Couldn't you be confused with my client here from across the room? When you're standing four feet from someone and they go, I saw you, motherfucker. It's hard. To a juror, that means a lot. Seeing someone go, I saw you.
Starting point is 01:10:17 Your eyes that's looking at me now, that's what I saw. You notice how I'm not wearing glasses? You can't say I need thicker ones. I saw you, motherfucker. You. That's so much harder than You notice how I'm not wearing glasses? You can't say I need thicker ones. I saw you, motherfucker. You. That's so much harder than an attorney going, you sure? Well, we can't be sure. Anyway, move on.
Starting point is 01:10:31 An attorney can say that. You can't do that if you're arguing with a person. So on April 24th of 2023, the crime scene technician, Kelsey Kemp. Is everybody a fucking alliterative name in this entire thing? Criss-cross. Crississcross and fucking kelsey kemp and so they're going over photos uh that she took of swearingen's home and marks his girlfriend or her home as well marks his girlfriend now he's got another girlfriend by the way jesus christ in addition to his exes that he's stalking and his fucking wife and his other wife. Are they his girlfriend or does he force them to be his girlfriend?
Starting point is 01:11:11 Yeah, we don't know what the voluntariness of the whole affair is. I just assume it's involuntary. It's got to be involuntary, right? There's no consent upon a relationship here. It's just, you're my girlfriend okay i mean i think no with cedric everybody says the same thing first few weeks real nice guy lures you in everything's great then you have no choice after that you're my girlfriend forever you're locked in yeah and you're locked in yeah wild so two uh according to the crime scene person here, two blood swabs were found in Swearingen's home, one on the garage floor and one in the hallway.
Starting point is 01:11:51 So that's interesting here. From the girlfriend's house, from Mark's girlfriend's house, 86 photos were presented to the jury. They found a white Toyota RAV4 with dirt on the tires and a damaged license plate frame. They also swabbed multiple drains throughout the house as well. Yeah. So a former undersheriff in Hughes County, Oklahoma, Colin Brian Fowler, he gets up to explain how he found the bodies. And I guess the Oklahoma State Bureau of Investigation had asked him for help
Starting point is 01:12:26 in the missing persons case so he narrowed the search down to four potential locations after investigators said to look for an abandoned home near a camper and a garage with a broken roof because that's what the woman remembered his pregnant girlfriend who went with him
Starting point is 01:12:42 Maya he eventually found the location in a rural forested area. Imagine searching through rural Oklahoma looking for an abandoned home near a camper and a garage with a broken roof. Feels like there's probably a lot of those. A few of those, right? Gee, front porch poop bucket out there, too. Is that there?
Starting point is 01:13:01 Because I bet there's a couple. This is a real city slickers uh treasure wow this is unbelievable how the hell do you do that yeah we're looking for the legends of curly's bodies here at the back of the site he saw an area where the earth had been disturbed due to open patches of mud with multiple pieces of broken branches covering it yeah that'll do it in addition to the mud and branches a pet carrier a board and a camper shell or on top of the site so just any shit he could find put on top yeah which makes it just stand out it's like we had a small town murder where someone killed someone
Starting point is 01:13:36 and then put a fucking dishwasher on top of it and we were like that stands out like a like a dishwasher in the woods that's the only way you could say. Is that a camper top and a pet carrier? Let's look over there. Why is that there? Let's see what's under it. Holy shit. The next witness to come up here was the Oklahoma State Bureau of Investigation Special Agent Kent. By the way, that's an impressive title so far.
Starting point is 01:14:05 Oklahoma State Bureau of Investigation Special Agent Kent. By the way, that's an impressive title so far. Oklahoma State Bureau of Investigation Special Agent Kent. And then his last name comes up, Titsworth. And it's just funny. And then it's just funny. And then it's just ruined. The whole thing's ruined. I'm Special Agent Ken fucking Titsworth. Kent Titsworth here.
Starting point is 01:14:29 This is partner Coxdrip. Yeah. Partner Cockdrip and my other partner Assitch. We're all here. Oh boy. He aided with the discoveries also. He said they were placed deliberately under debris. Aerial footage of a square head shovel on the south side of the road was shown to the courtroom.
Starting point is 01:14:52 This is where the bodies were discovered. Law enforcement didn't recognize the shovel in 2019 because the shovel was placed behind lots of shrubs. But in cross-examination, Sedgwick asked about the shovel evidence, and Titsworth said just last week they visited the site to try to find it. However, they couldn't find the actual piece of evidence. They just had the picture of it, basically. It's almost like if somebody wandering around found a shovel that was only used once, might go ahead and steal that. Might take it, yeah, an abandoned house and all that kind of shit they also said that the shovel in the picture resembled the one purchased by marks at walmart
Starting point is 01:15:31 the walmart by the way which was just minutes away from the site in henrietta oklahoma so um that's a man that doesn't know how to dig james you don't buy a fucking square shovel he was like i'm gonna need to put my foot on it. Yeah, that's not great at all. That's like for shoveling coal, basically. That's not for digging in the ground. You need a point to penetrate the earth at that point. That's a soft pile that you're moving with a square shovel. Pile of ashes or something.
Starting point is 01:15:58 Yeah, that's not going to work. You better get yourself a spade, buddy. Yeah, you need, especially that Oklahoma ground is going to be pretty hard. Oh, boy. So Angela Berg, a forensic anthropologist in Oklahoma, walked the jury through the pictures she took of the removal of the bodies from the sites here. During the viewings of this, people had to leave the courtroom because it was, you know, there was some disturbance. room because it was you know that's intense that's a disturbance they said they were it was easy to find because excess soil placed around the area caused a halo effect where the bodies would later be discovered so oh man he basically made a map to the bodies for them drew a couple of big circles
Starting point is 01:16:37 you gotta dig real deep um according to this person it took two days for them to uncover the bodies the hole was only two feet deep that's your issue can't do that because you had a square shovel man yeah he was like fuck this deep enough you're gonna dug to china if you got a fucking spade you chose a shit digging instrument yeah you chose a goddamn bullshit shovel and this is what you get for it if you're gonna murder and double murder especially you gotta have the proper implements, everybody. This is a crime and sports rule. New rule. If you're going to bury a body, get a proper fucking shovel.
Starting point is 01:17:12 Sorry. Bring a spade and a sharpshooter, my friend. This is ridiculous. My Christ. So they said that it took the female body, which is Scott, was found face down and underneath the male's body, who was laying upward. So they were back to back. That's how much of a dick he is, too. He was like, I'll put them back to back so their genitals can't touch because I'm jealous of my dead girlfriend, ex-girlfriend.
Starting point is 01:17:37 Wow. Isn't it? It's a little worse, too, that he threw the woman on the bottom with her face in the dirt. Yeah, face down. That's so fucked up. Because she's the reason why we're here, in his mind. You know what I mean? In his crazy fucking mind.
Starting point is 01:17:50 So, yeah. April 25th, during the afternoon, prosecutors presented surveillance footage from the Walmart that showed two people who appeared to be Cedric Marks and Maya Maxwell, his pregnant girlfriend there, buying a shovel, thermal clothing, shoes, and an X-Acto knife. Why not? Oh, boy. According to the receipt, these purchases were made January 4th, 2019 at 4.09 p.m. Not great.
Starting point is 01:18:14 During the cross-examination, though, Marks presented several screenshots from the same video, but one was not admitted into court due to alterations. He's trying to fuck around here. Earlier here, Leon Neal was the first witness to take the stand. Marks wanted to exclude Neal from speaking, saying Neal had a lack of identifying marks on January 4th near the Shannon property here. He said the judge overruled and Neal was able to testify. He said he saw them neil said he spoke with a black man near this property saying he was showing his girlfriend his old stomping grounds and had knowledge of the area so this guy talked to
Starting point is 01:18:56 marks that day in the area of where the bodies were in an area where there's 300 people 60 60 people 60 60 you're telling. 60, actually. 60. You're telling me another black guy came through saying these used to – more than two people have left this town? Yeah. I feel like they all stay. More than him and his dad. Was it your dad, Cedric? Was he the one?
Starting point is 01:19:29 In a cross-examination, Neal said he couldn't confirm with certainty that the man he spoke to on the night of January 4th was Marks and was unable to identify the vehicle. He was only able to say it was a dark vehicle. Leon's distant relative and hunting partner, Justin Massey here, so Leon Neal's buddy here, he was with him that day, gave similar testimony. So they get Titsworth back on the stand. Yeah. Let's see what you got, Titsworth. Let's go. Can we get Juggs back up here right quick? Let's go. Let's go, Juggsworth. Do your thing.
Starting point is 01:19:54 Let's go, man. So he came back to the witness stand and Titsworth told the jury that a member of the Golden family is related to the Marks family. The Golden family grounds is where Neal and Massey were hunting. A forensic pathologist for the chief medical examiner's office came to the stand. She said that Michael's family had to leave the courtroom because this was going to be an autopsy testimony, so it was bad.
Starting point is 01:20:20 They performed the autopsies, went through photos. They performed the autopsies, went through photos. They said that Scott died from homicidal violence, saying that her she wasn't just choked, man. Her mouth was taped. Good God. Her body was bruised from head to toe and her ribs were fractured. She beat this. He beat the shit out of this poor fucking woman.
Starting point is 01:20:45 They said that Michael's death also homicide deemed asphyxia caused by strangulation. She said Michael had bruises on his legs, back and torso and multiple hemorrhages as well. Marks was offered to examine the photos and he didn't want to review them before being presented. He did object to them being shown saying they show prejudice and the judge
Starting point is 01:21:02 said no, they're autopsy photos. This is what we do cross exam Marks asked asked if the bruises hemorrhages and bone fractures on Jenna and Michael were done post mortem and they said no that's not done idiot
Starting point is 01:21:16 he said did you do that and they said no that's not done in medical examination right we don't say beat the shit out of the corpse and let's look at it. We didn't break ribs, no. What we do is we hang it up like a piece of meat, like Rocky, and we punch it a lot just to get our aggression out, and then we examine it later when we're done.
Starting point is 01:21:36 It softens them up a little bit. Because you can't kill them more. Yeah, we figure, fuck it. You can't kill them more. It's fine. How could he possibly ask that question that question wow that is fucking amazing so april 26th here yeah capital murder suspect cedric marks is removed from the courtroom after a profanity filled outburst oh is that on youtube no it's not cameras in this court
Starting point is 01:22:00 damn it this will not be the last time he does this over the course of the trial, by the way. Yeah. Tossed his ass out of court, had to remove him here on the eighth day, and he directed profanity toward prosecutors and the judge after the jury left for recess. Oh, so they
Starting point is 01:22:20 didn't even get to see it. You can't call the judge a cunt, generally. That's a bad move in trial. He can't say motherfucker to the it. You can't call the judge a cunt generally. That's a bad move in trial. He can't say motherfucker to the prosecutor either. Nope. He yelled and cursed, telling everyone in the courtroom, especially the judge and the prosecutor, that they were, quote, trying to stop him from doing what he's trying to do. Which is lie and manipulate this proceeding so I don't have to pay the consequences for my actions. You're trying to stop me from doing it and I don't like it. Where's Titsworth?
Starting point is 01:22:47 I want to yell at him. Do what I'm trying to do. What I'm trying to do. It's like a little kid. I'm trying to do this and you're not letting me. You're stopping me trying to do what I'm trying to do. Yeah, sounds just like a little kid saying that. Oh, my God.
Starting point is 01:23:09 saying that oh my god he uh he displayed frustration after he failed to get his girlfriend who's not his girlfriend anymore rebecca to authenticate evidence like isn't this shit right she was like no no i'm not saying that shit he was attempting to admit still photos from a personal video of scott into evidence arguing the footage proves why her permanent court record from 2018 was denied. He's been trying to admit the video into evidence since the start of the trial. She said she's seen the video. However, state prosecutors kept objecting to the way Marks would improperly ask questions to authenticate the evidence, you know, because he's not a fucking lawyer. Because he doesn't know how this works.
Starting point is 01:23:43 Yeah. At one point, he asked her, quote, in the video, did you hear Jenna call me? Which you can't, that's leading. Then uttered a few curse words, which caused the objection. Call me a motherfucker, piece of shit, asshole, whatever. After the outburst and his removal,
Starting point is 01:24:00 there was a small break in testimony. People in the courtroom looked a little surprised by what happened there. She would go on to testify that Mark started training her, this is how he found women, at the title boxing in 2011, and that led to an on-and-off relationship for seven years. He's what? Yes. While he's married, knocking this girl up,
Starting point is 01:24:23 being so jealous of this other one that he kills her, he's also got another girlfriend. And he does this all through the title boxing. Or tender. Or tender. Tender. Tender. Generates new relationships constantly. Oh, and these women in the thing, I mean, he's a big, strong guy who's doing this for free and trying to help them, and he's a good guy,
Starting point is 01:24:46 and he's tough. That's gotta be exhausting. It's fucking diabolical is what it is. It's diabolical. So text messages between Marx and Rebecca showed in court hinted at that they loved each other. She provided financial assistance to him and even bought him
Starting point is 01:25:02 his red Jeep. Unreal. Yep. She said after she went to visit her family in wyoming then her friends in las vegas between december 16th 2018 and january 7 2019 this was during the time that swearingen yeah yeah my girlfriend's gone i guess it's a good time to kill her at this point she believed marks was in michigan because that's what he told her oh she said that he was supposed to come back to Texas due to one of his warrants, so she asked him to pick her up from the airport in Austin once she got back from the trip. You imagine. We'll go turn you in.
Starting point is 01:25:35 Buying a car for a man who calls you while you're on vacation telling you, I got to go turn myself in for my warrants. I just bought you a car. Like, well, use the car to pick me up from the airport and then go turn yourself in. That's fine. She said that she mailed her spare house key to him in Michigan before he returned to Texas, which he did. He was in Michigan with his ex-wife there, or his wife, I should say, because they never
Starting point is 01:26:00 got divorced. What am I talking about, ex-wife? That woman's wearing a ring. This is crazy. So on December 16, 2018, she was on her trip. She said that Marks was texting her saying he hoped to see her when she returned, which is weird. She said this confused her because they'd already discussed him picking her up from the airport and taking her home. Like, you are going to see me.
Starting point is 01:26:22 You fucking better be at Terminal 3 at 4.28 p.m.m when i get in that's what we talked about i'm carrying on i don't even have to go to baggage claim you fucking better be there don't give a buffer between the landing and the thing once we get to the gate i'm out so on january 1st he texted her saying i used and hurt people and just got away for a while but this is what's this is what it's to come what it's that's why we typed it this is what it's to come this is what I deserve it's here
Starting point is 01:26:53 and it's time for me to pay I used and hurt you to remember who I really am I have no heart I'm inhuman I won't be seeing you again I hope it hurts when they shoot me i hope there's a hell i'm a fucking manipulating piece of shit and you deserve better i have a long drive tomorrow stop texting me bye she should have said cool done and done never gonna talk to you again yeah
Starting point is 01:27:18 wow during the cross-examination he asked her if the text made her believe that he was going to harm himself due to past experiences. And she said yes. Because this was before the murder. So they were still in communication even after he said stop texting me, bye. And on January 5th, 2019, he told her that he would not be able to pick her up because the roads were bad and he was in the ER due to a bicep injury. her up because the roads were bad and he was in the ER due to a bicep injury. So since she had knowledge in health and fitness, she was a trained MMA fighter. Now, state prosecutors asked her if you could tear your bicep by lifting a vehicle out of the mud or lifting 276 pounds of dead weight.
Starting point is 01:27:59 And she answered, yes, that's possible. By the way, Swearingngin weighed 276 pounds. Of dead weight. Of dead weight. Yeah. He argued, though, that he never attempted to lift a vehicle, he wouldn't stretch before workouts with Rebecca, and that he took torn muscles seriously because he wants to continue fighting. Really? 45 and never being any good.
Starting point is 01:28:23 Hilarious. And she said, yeah, that's true. That's what you said. January 7th, 2019, he texted Rebecca about how stressed and scared he was and to not tell anyone where he was. At that point, it was known to the public that Swearingen and Scott were missing. He also texted her to express disappointment and disbelief at how he was being made to look like, quote, the monster for the victim's disappearance when he's the one who has evidence against her. Right. January 8th, 2019, she texted Marks, Rebecca texted Marks,
Starting point is 01:29:01 asking him if he ever visited her house while she was gone because she noticed something was off when she returned home. He says she said a hand towel was missing, a picture of the two of them on their fridge was gone, on her fridge, and the driver's seat of her Toyota RAV4 SUV was pushed forward. She left her spare car key on the kitchen counter while she was away. She also said that her house and car were clean
Starting point is 01:29:20 before she left for the trip, but when she returned, her tires were muddy and it looked like something was spilled on the console. Yeah. She also stated that her friend told her that her light was on while she was away,
Starting point is 01:29:34 which confused her, knowing that he was the only one with the spare key. So, hmm, wonder who was there. A few days later, she also noticed that all of her trash bags, her two rolls of black electrical tape, towels, and her couch pillow were all missing. Why would all those be gone? Weird.
Starting point is 01:29:51 It's like a murder kit. And then my car's all muddy and there's shit spilled everywhere? It looks like someone just killed people and then took their bodies out to the middle of nowhere and buried them. Just off the top of my head, just looking around. What about trash bags and electric tape and then she discovered her bathroom light wasn't working and that was because the light bulb was unscrewed a bit why even did that like fucking vito corleone and godfather too when he killed don fenucci there and he did the light and the guy shot him so yeah that's interesting so uh they also uh testimony reveals
Starting point is 01:30:27 a detective visited her home on january 10th and they searched her house on january 27th the state prosecutors played the video footage from the henrietta walmart she identified the man wearing the title boxing sweatshirt as cedric marks he's even wearing he's wearing it says cedric and fucking cursive over his left tit i wonder who that is you can't james you cannot go out of the house without wearing your brand it's self-promotion you gotta wear you gotta do it man holy shit not when you're burying bodies idiot oh my god um after reviewing footage from swearingen's neighborhood during the date she was out of town she confirmed the vehicle driving from Swearingen's neighborhood during the date she was out of town, she confirmed the vehicle driving past Swearingen's house several times was, in fact, her car.
Starting point is 01:31:10 Yeah. Yes. And the prosecutors pointed out that it looked like there was someone in the passenger seat as well, and she agreed, which we know that's Maya, his pregnant girlfriend, who I'm sure Rebecca has no idea about. She has no idea. Yeah. When Mark's cross-examined her, though,
Starting point is 01:31:26 she agreed with him that the footage was blurry and that it was hard to tell if there were two people in the car. So he intimidated her into that, which now you're watching him intimidate a woman he's in a relationship with, or was. Great point. The jury gets to watch and see what it looks like when he... Watch him manipulate.
Starting point is 01:31:41 Yeah, watch. You can tell if she's scared of him. You can tell if someone's scared of him. You can tell if someone's scared of someone. You can see it in their eyes. Absolutely. You can see it. If that fear comes out and it's palpable to that jury, that is bad for him. You bet.
Starting point is 01:31:53 That's why they tell you to sit there and shut the fuck up if you're a defendant. You sit there. You doodle. You make it look like you're taking notes. You lean over. You whisper to your fucking defense attorney every now and then. Look like you're busy working. You offer him a piece of gum, the defense attorney every now and then. Look like you're busy working. You offer him a piece of gum, the defense attorney.
Starting point is 01:32:09 He takes it so you look like a human being. That sort of shit. You don't do this. This is a nightmare. This is crazy. Holy shit. What a fucking idiot. So Marks also asked details about the relationship, and she stated she never heard threats from him regarding Swearengin and Scott,
Starting point is 01:32:26 and that Marks was never violent with her while they were together. Well, I mean, ever, I guess. So she also confirmed that there were no droplets of human droplets or human fluid once she returned home. That's a weird way to put it. And I never heard the words human fluid before put together. It's a good bad name. It's a good bad name. Human. It's a good band name, Human Fluid, like a Christian metal band. Human Fluid.
Starting point is 01:32:53 Human Fluid, we sing about the Lord. That's what you want right there. So toward the end of this testimony, he tried several times again to admit still images of this video that he has with Scott that will prove everything somehow. He really wants this video allowed. He does. Well, at this point, it's become a thing that he can stand on as like, they won't let me make a defense. They won't let you see it so clearly. It's because I'm innocent. And he said, I don't know why the state is trying to hide this from the jury.
Starting point is 01:33:24 Yeah, there it is. They're trying to hide this from the jury yeah there it is trying to make it so there's something being hidden and they're just like whatever so um this is fucking wild the judge warned him about any further outbursts during the trial good okay thursday the 27th of april cedric mark's trial day fucking nine i think here data from his phone reveals some details here, which is fucking fun, from his own phone, actually, here. The trial, the first witness
Starting point is 01:33:52 was special deputy of the Grand Rapids, Michigan Police Department. He was on the fugitive task force that arrested Marks. He said they arrested him at the Rivertown Crossing Mall by tracking his cell phone. He said out of 20 years at his job, Marks was the most tense transport he's ever had.
Starting point is 01:34:12 And he said he didn't want Marks to harm him, considering he's a professional fighter. He didn't want to get into a scrap with the fucking guy, basically. He wanted to get him in cuffs as soon as possible and tighten those bitches up. In 20 years, this is the most dangerous man I've ever encountered. Yeah, and he's a murderer probably, so that's another problem here. At least alleged, yeah. He argued that he didn't resist arrest. He argued with the cop while he's on the stand that he didn't resist arrest and wasn't aggressive during the transport.
Starting point is 01:34:37 And the guy said, no, I didn't say you did. I just said that I was aware of your background and it was tense for me. I didn't want you to. I was afraid of your background and it was, you know, tense for me. I didn't want you to. I was afraid of that. Yeah. So then they brought the cop in who had interviewed the Maya Maxwell and said how she had pretty much immediately told them where the victim's bodies were buried. That was easy to get.
Starting point is 01:34:58 She also confirmed the pictures from the crime scene that were taken by Oklahoma officers and sent to Michigan was the crime scene. That is the place where it happened and all that kind of shit here. Yeah. Officers also seized his Jeep in Michigan. He stated how there were no signs of biological evidence and no smell of cleaning materials here, saying that I didn't try to hide anything in my car. Did I? anything in my car did i um in the car they found marx's id uh and a background check of scott which included her address from october 18th 2018 why he was doing checks on her keeping track of her
Starting point is 01:35:34 making sure he knew yeah he argued that you can get a background check of a person to look at their criminal history which is what he was doing that's what he said okay he said that i've been to her house and i didn't need to look up her address. I knew where she lived. So another police Michigan police sergeant came up, a detective sergeant, and he explained he was able to get data from Cedric Marks from Janelle McDonough, his wife, and from Maya Maxwell's phones through a software system called Celebrite. He discovered that Marks and McDonough's location services were turned off, but not Maxwell's. Oh. Yeah, she kept hers on. So they were able to track her. They said that Maxwell's search history had car washes near me,
Starting point is 01:36:19 weather in Henrietta, which is where the Walmart is, and Temple, Texas news to see if anything was on the news about it. I just want to see what the weather's going to be like. Just looking. Just looking. We'll be driving through there. Yeah, I need to know. Should I wear closed-toed shoes?
Starting point is 01:36:36 Should we stop at Walmart and buy thermal clothing or not? Because I don't know. That's fucking amazing. He argued that the searches weren't on his phone they weren't even on my phone okay and that the location services could have had could have been turned off because it was a prepaid phone so he doesn't know if they were ever on i don't i never turned them on or off so they said that the state prosecutors brought up how he himself on his phone searched, quote, how to block a cell phone's data, which removes it from the network on January 8th, 2019.
Starting point is 01:37:11 So that was after. Which removes it from the network. What a block of the data. Yeah. Yeah. Another Michigan cop testified next. He said how McDonough's office, you know, his wife's office at the National Guard in Muskegon had questionable items. The boss found a hidden suitcase filled with Marx's paperwork.
Starting point is 01:37:31 She had his he has all these fucking women doing his bidding. He's got she's hiding her stuff in her National Guard office. What the fuck? What the fuck? Also had his MMA fighting license, a debit card, and a, quote, loaded AR pocket pistol buried under clothes and towels. Wow. This is fucking insane. She had that in her office.
Starting point is 01:38:12 Mark said that Muskegon is 35 miles away from Grand Rapids, which is where he was located, and his DNA was not on the weapon. So even though literally his MMA fighting license is in there and his debit card, those are two things. Not mine. Wasn't me. Wasn't me. Wow. That is very interesting. So the next day they recall some more cops, and they're talking about text messages and the RAV4 and all that kind of thing. The one cop testified he traveled to Oklahoma to help excavate Jenna Scott and Michael Swearingen, help transport the vehicle back to Texas. He measured the distance from the burial site to Marks' family plot at the North Fork Cemetery to be 703 yards from his family plot.
Starting point is 01:38:46 It's right there. It's next to a cemetery with his family in it. Holy shit. He said, this is where bodies go. I'll just put it next to that. Wow. I know of a place where they put bodies. Yeah, I'm familiar.
Starting point is 01:38:59 From the grave sites, Russell received, this is the cop Russell, received swabs from items placed at the camper site from the Oklahoma State Bureau of Investigation. One of the physical items that they received was a Gatorade bottle placed inside the grave with Jenna and Michael. Uh-oh. Yeah. Russell then testified going to Michigan, that he went to Michigan to help Temple detectives Corey Powell and Ashley Cunningham collect evidence for Michigan State Police. There, prosecutors requested to speak outside the presence of the jury and said that they have new evidence outside the discovery of Powell's interviews with Marks' family and friends after Marks attempted to escape from jail and hid in the garbage can. Okay. Mark said, we don't need to see those.
Starting point is 01:39:43 No? Let's not have that. It's useless? Yeah, that's crazy. That's that's ridiculous. The court was about to resume as Mark's had time to review the extended phone data there. He said this was a last minute move by the state. He's very disappointed. This is what Mark says here. The judge gave Marks and his counsel time to look over footage and do all this type of shit here. Marks asked the judge to squash the in-person subpoena for his wife, saying that there's a transportation conflict for her to fly in from Tennessee, leaving her kids by themselves. She can't make it. Let's just call it. We don't need that. The judge said, no, no, we'll figure it out.
Starting point is 01:40:24 That's good. We'll figure it out. That's good. We'll we'll we'll figure it out. He then cross examined the Texas Ranger Adam Russell, who testified earlier. He admitted he did not know the test results of the blood swabs gathered from Swearengin's home. He also was unaware if DNA was gathered on the water bottle, Gatorade bottle gathered from the burial site. Along with severe weather, the judge ended the trial to give Marks time to finish looking over the phone data and because I guess there was tornadoes a coming. So the next, May 2nd is when they resume. But he was supposed to go Monday, but he was too sick, Marks. They had to cancel court that day.
Starting point is 01:41:06 Too sick. Next day, they get a forensic detective to come in. He received and extracted cell phone data from Cedric Marks' devices and got limited info on Jenna Scott's cell phone and Michael Swearingen's tablet as well. So they got him up there to do all of that they keep bringing in um they also bring in advanced enhanced videos with magnified frames of the surveillance also what a burger footage walmart footage and footage from the first baptist church and temple so in the enhanced walmart footage it shows the man and the woman who appeared to be marx and maya maxwell with the women's shoes resembling the same pair law enforcement seized when searching Janelle's rental home.
Starting point is 01:41:48 So that connects that. Also, they said that here, Cedric Marx's wife, Janelle, she testifies again. The prosecutor, she testifies now. Prosecution goes through all of her messages and call log. And in multiple calls between Maya and Marx in this time period, Janelle says she doesn't remember any of the conversations. I don't remember.
Starting point is 01:42:08 She just kept saying. I don't know. I don't recall. Because she's not trying to help him or anything. A woman who had... Think about it. She's been married to him for 20 fucking years. She knows what he's capable of.
Starting point is 01:42:20 She knows everything. Yeah. This is wild. So the next day, Marx cross-examines his ex-wife. or his wife, his current wife, on their relationship. It's his wife here. Also, Mark's relationship with Maya Maxwell and what Janelle knows of Mark's relationship with Jenna Scott. Janelle admitted to being scared of law enforcement and willing to do whatever is needed to avoid consequences, by the way. willing to do whatever is needed to avoid consequences, by the way. She doesn't want to be charged with any of this because she was helping him. So she admitted their children, Logan and Adrian, whose mother is April Peace,
Starting point is 01:43:00 testified for Marks in Scott's protective hearing against Cedric. With Janelle making the statement, Marks played in court a video of himself and Jenna Scott in an altercation. And doing this, the judge told Mark's to stop the video and get the jury out of the fucking room. You're not. He just started playing it. Like on shit. Like you're not allowed.
Starting point is 01:43:18 Get out the fuck out of them, out of the room. Oh my God. Have you ever heard this video? Jesus Christ. Mark said he played the video since the prosecution opened the door on May 2nd going through Janelle's messages with a screenshot of the video in her phone. So that means that he should be able to play the whole video and show the context. So with the prosecution doing this, he said he felt it was okay to play the video in front of the jury and in front of the jury for janelle just to refresh her memory it's not because i've been
Starting point is 01:43:48 trying to get it in the whole trial and you've been saying no remember this video yeah he said being that it's evidence already admitted by the state um they overruled uh the objection though and said the video has been admitted but it can't be played due to the motion here so the da wanted to admit new evidence to show marx's character history and behavior of violence so they asked janelle what she knew about the 2009 disappearance of april peace and uh she said that marx told her he killed april peace a few years after peace was reported missing so she just burned him there. He's not on trial for that, but the fact that he did it and told his wife about it isn't good.
Starting point is 01:44:31 She said she received two VHS tapes from Marks saying he did this to save his son Adrian from April. So she is in custody of Adrian now? Yeah, she has the two kids that he had with her. That's who they have. This is fucking crazy. Holy. Janelle cried when saying this, by the way. Janelle gave the VHS tapes to Minnesota police and admits lying to them in her first interviews.
Starting point is 01:44:57 Janelle then said she eventually changed her statements due to guilt. And Marks cross-examines her over the VHS tapes. She said she never saw the videos until Minnesota police played them for her. Played them. And he says, why'd you give that to him, bitch? Yo, why'd you blow up my spot? What the fuck? You know you're fucking this up for me?
Starting point is 01:45:16 Fucking this all up. Janelle also admits she lied to authorities under the circumstances for when Marks made this confession not being true. authorities under the circumstances for when marks made this this confession not being true with the statements from janelle marks made the motion to deny the vhs tapes being admitted into court due to the trial's focus on jenna scott and swearingen here the judge sustained marks's objection not to admit the vhs tapes into evidence because it's a prior bad act and whatever so he when you're your own attorney you can testify without testifying which is fucking crazy pretty wild so um yeah they she also testifies uh here to uh that marx asked her to delete messages between them and to lie to police about his whereabouts when
Starting point is 01:45:58 he traveled from michigan to texas she also told marx that she had no direct knowledge of what happened in texas and ok and Oklahoma when speaking to police. However, with the prosecution, she said that Maya Maxwell told her about what happened there. So after she leaves the stand, the prosecution wants to bring a detective in from Killeen. And so they go back and forth and go over whether his record, his criminal record is relevant here. That goes back and forth. This detective they want to bring into domestic violence casework with Jenna Scott and Cedric Marks in 2018.
Starting point is 01:46:34 So, yeah, I guess this detective said outside the presence of the jury that Jenna contacted Holtzclaw to say she was going to have an abortion as Marks and Scott were filing charges against each other. Marx did not add if this did not add to say. Basically, he said that he's trying. It would extend the trial by weeks to defend himself against these allegations and all every allegation that comes up. Can we concentrate on a very charge at a time? Come on.
Starting point is 01:47:03 This is overwhelming. i'm new to this i'm not a lawyer i don't know if anybody's noticed here but i'm not i'm not doing this oh my god um that's fucking amazing so they said that this this detective speaks on the stand she said she did the domestic violence case work like we. She said that she served, that she spoke to Cedric Marks and Jenna Scott individually after Marks was served a protection order in 2018. 51 minutes later that day is when Marks came to the Killeen Police Department with videos and audio clips he wanted to present of Jenna assaulting him. So, yeah.
Starting point is 01:47:55 Holtzclaw found out the video of Jenna hitting Marx was taken in January and charged Marx for filing a false police report because he said that it was from the week before. It was actually months later. And also a misdemeanor for bodily injury assault. January is also the same period from what Holtzclaw says jenna was documented to have taken an abortion pill as well oh yeah because mark's got her pregnant of course because he's got to spread this horrible gna that he fucking has to everybody problem jesus christ jenna's father testified that marks broke up with up with Jenna in March of 2018, saying their relationship was done by May or June. On June 2nd, Marks says this is the day he recorded an audio clip between him and Jenna Scott after they had a physical altercation. Marks alleged that Jenna punched
Starting point is 01:48:36 him multiple times in this altercation. So that's how that goes. August 21st, 2018, the detective here said she got an email from Jenna saying Mark's broke into her home, threatening her and her daughter. And they had the whole trial that we talked about. They also bring up here. Jesus Christ, these fucking unbelievable. They bring up the holds claw. This is this detective said that she witnessed marks and Maya Maxwell encountered Jenna and her father as they were leaving the courthouse. This guy, the father testified,
Starting point is 01:49:13 Maya Maxwell passed Jenna a blanket in that moment and said, kill yourself, bitch. And for marks to drive off. I don't know. That's fucking wild. The father added a vehicle appearing to have marks and maxwell inside of it flicked them off as jonathan and jenna left the area
Starting point is 01:49:29 also gave him the finger as well yeah so then the detective testified to receiving emails from scott about packages being delivered to her home the first package had a t-shirt um with a picture of a t-shirt of Jenna and Cedric on it. It was the kid, I guess, with a handwritten letter that Jenna wrote. The second package had another letter typed out. The first package came from a Fort Hood address. The second came from Title Boxing Gym. Yeah. Marks in cross-examination with this detective asked if she had a history of going
Starting point is 01:50:08 after men who filed domestic violence claims which she denied to counter this and murder people yeah i mean that's there's that so he played audio in the audio scott is heard saying she wants to get back with marks marks tells scott to leave him alone and she abused him when she broke up with him so um interesting uh he wants to play a second audio clip it's objected to it's a whole lot of shit here they bring in more people stephanie meek a forensic expert she says she did seven case prints on cedric marcus uh marks and processed items from swear engines home and a Hyundai Genesis. They said that they did two additional case prints outside of the work and also had inconclusive results.
Starting point is 01:50:52 So they don't have a lot of physical evidence here because there's a lot of inconclusive shit going on here. They said they tested clothing. They tested all this shit, all this. So the next day, they have more forensic people come in and they said that one forensic expert said that this is one of the largest cases she's worked in her 20 years of experience. She said that the adds the number of samples in this one case she ran tests on is the equivalent to 30 to 40 cases. They said that being unable to find DNA on anything at the
Starting point is 01:51:23 burial site nor anything on Jenna and Michael's body, they never found anything. They said that being unable to find DNA on anything at the burial site nor anything on Jenna and Michael's body, they never found anything. They said the changing weather could have interfered with having legible DNA results. Yeah, if it was constant weather and they weren't that far under, they're going to get a lot of water on them washed away. They said that the results on the Hyundai Genesis show probable chance of having Cedric Marks and Maya Maxwell's DNA on it. But with the DNA samples being mixed, they couldn't make a confirmation. So, yeah, they're having a hard time. Marks reviewed the lab results showing no distinct tie to him or Maya having DNA on Jenner or Michael. And he asked if it's possible to wipe DNA without leaving some behind.
Starting point is 01:52:04 And they said, well, yeah, sure, it's possible. Yeah, you clean it. It's, you know, anything you fucking clean isn't going to be there anymore, probably. So they talked about tracking the cell phone. January 3rd, Marx's phone is seen going from his girlfriend Rebecca's home in Killeen to a cell tower near Michael's home between 3 and 9 p.m. At 9.20, Marks' phone is seen going back and forth between Killeen and the Belton area. His phone is then seen going down to South Austin at 1.50 a.m., right to where Michael
Starting point is 01:52:37 Swearingen's car was located, by the way. My God. Marks' phone is seen in Oklahoma between 2 and 10.30 p.m. the next day, close to where the bodies were located. Oh, and he's definitely at Walmart. Afterwards, the phone was seen going back to Michigan. So they said everything is consistent with being the murderer. That's where the murderer's phone would have gone here. Marks did cross-examination of this analysis.
Starting point is 01:53:11 And they said, well, yes, cell phone towers don't pinpoint your exact location, but within a 21-mile radius. And so Marks then says that this guy has an unconscious bias against him. Yeah, but why were you within 21 miles of dead bodies in your hometown when you don't live anywhere near there? That is fucking wild. The prosecution asked if it would be difficult to fake cell site analysis, and he said it would be exceedingly complex because the data came from four different phones
Starting point is 01:53:44 and four different cell phone carriers. So, you know, it's kind of hard to manipulate that. So, yeah, they were saying it identifies him in every area they need him to be in, obviously. And it's rough. January 3rd, Marks asked Maxwell to drop him off at a friend's house before turning himself in. But it was the house of Michael Swearengin. After suspicion that Marks was cheating, Maxwell went back to the house before turning himself in, but it was the house of Michael Swearengin. After suspicion that Marks was cheating, Maxwell went back to the house to find Jenna Scott
Starting point is 01:54:09 handcuffed to a table, but Miss Cedric was not there. She takes the stand to do this. Maya Maxwell says that Jenna Scott and Michael Swearengin here, Maxwell believes she was driving from Michigan to Texas with Marks to turn him in because there was a warrant out for his arrest. Because that's what he told her. When they arrived, they drove around for hours in the Austin and Temple area. And Maxwell thought he was just delaying turning himself in because he didn't want to do it.
Starting point is 01:54:36 Then he asked her to drop him off at a friend's house before he turned himself in. It was swearing. She went back to the house, busted through because she thought she was going to catch him in bed with some girl instead she finds jenna scott handcuffed to a fucking table and he's not even there what the fuck so maxwell said she left she kept calling cedric at first he didn't answer but then but when he uh then told her to calm down and go back to Rebecca's house where they were staying. Hours later, he arrived with both Swearengin and Scott at Rebecca's house and put them in separate bathrooms.
Starting point is 01:55:13 Remember, she was out of town. Remember, the light bulb was unscrewed. The car was gone. This is fucking crazy. So she says that she, by the way she's took a plea deal yeah maxwell did she's going to serve 20 years with a chance of parole for two counts of tampering with evidence so she didn't get off completely here at all no 20 years is very complicit yeah um so she said that she initially lied to police saying her and marks didn't go to texas then she said they went to
Starting point is 01:55:43 texas looking for an action figure for Marx's son. That's how she said she is. They were like, well, we know you were in Texas. She goes, OK, yeah, we went to Texas, but it was just to look for an action. We were he man shopping. Yeah. Then they said, well, we know that's not true. And she said, OK, we had dead bodies.
Starting point is 01:55:58 That's why we went there. She went from action figures to dead bodies like that. Wow. So, yeah, she said she told them everything she can remember. She said she was scared telling law enforcement the truth saying I was scared because I knew once I did Cedric would know and I wanted me and my son to be okay.
Starting point is 01:56:14 I knew Janelle was loyal and would tell marks anything. So I couldn't let her know that I knew that. Right. So she said that law enforcement did a good job in keeping her safe. And, um, yeah. So she said that she seemed, a good job in keeping her safe. And yeah, so she said that she seemed everybody said she seemed very firm. But then he comes up and cross exam and asked Maxwell if is real is really telling the truth for her plea deal. Is that why you're doing this?
Starting point is 01:56:38 And she said yes. And they said that she said law enforcement did not take her to Oklahoma. But Marks himself brought her when he buried the two of them. She admitted to Mark she doesn't remember the letter she wrote to him from jail in May of 2019. She also doesn't remember the letter she wrote to Marks wanting to keep their relationship in December of 2018. She does, though, admit to receiving letters from Marks while in jail. One letter was a single was inside a legal mail envelope with attorneys names on the front. But it was a letter from C in jail. One letter was a single, uh, was inside a legal mail envelope with attorney's names on the front, but it was a letter from Cedric in the letter. Mark gives her the
Starting point is 01:57:11 option to keep lying and be another jail story, losing her son or go on through his attorney and fight the case together. She asked, um, when Mark's asked Maxwell Maxwell if she ever did make the note of the notice to leave Janelle's home. Maya said no due to being homeless and claims that Marx made her lose her job. Wow. She also testified they did not go to Henrietta Walmart after Marx made claims they went there for fishing equipment. She wasn't there when he said that. So she didn't know that was the story now. Oh.
Starting point is 01:57:44 So she said no we didn't go there. She said she doesn't remember Marks mentioning he wanted to drop charges against Jenna Scott. And she did admit that Marks didn't want to come with her. She didn't want her to come with him on his January 1st trip back to Texas. No, he didn't want to witness to his fucking murders here. Also, how do you say we went to Walmart and then bought? How do you be specific at all about what you bought at walmart it post 2005 they have everything documented everything
Starting point is 01:58:14 is documented down to fucking everything um maxwell admits that marks initially didn't want her to join him on the trip and had to convince him to let her come they go over the specific details marks drilled into maxwell about inconsistent statements she gave to police join him on the trip and had to convince him to let her come. They go over the specific details. Marks drilled into Maxwell about inconsistent statements she gave to police and why she didn't call the authorities on what she allegedly said. She broke down having to admit she didn't call authorities, saying she didn't feel safe to speak with anyone. She also testified to Marks telling her he killed another man in Tulsa named Andre Oggins for hitting him,
Starting point is 01:58:44 but Marks questioned this statement to see if Maxwell was given the info by police. He killed another man in Tulsa named Andre Ogans for hitting him. But Marks questioned this statement to see if Maxwell was given the info by police. Jesus Christ. So the next day, she's still on the stand and he's grilling. Yeah. She said, I was never going to keep quiet about this. She said she was going to try to figure out when the safest time would be and all of that. And he's saying that's bullshit. She said, I never was scared of law enforcement.
Starting point is 01:59:10 They kept me safe. Now, the illegal mail thing, they go over that again. He started with cross-examination and said Maxwell had her head down and did not make eye contact with Marks as she gave testimony yeah what does that look like to you i mean she's fucking terrified yeah you see a dude yelling at a lady and she's not she's got her fucking head down not making eye contact that's what children do when they're scared of their parents that's fucking wow i'd be like whoa that's a scary guy whatever he did he probably did because that's scary. Marks says that they talk about love letters they exchanged in prison and all that sort of thing.
Starting point is 01:59:56 She said, I just didn't want to be alone. That's it. So she just didn't want to be alone. So, yeah, she kind of wanted to be him. Marks asked if she remembered they were going on a fishing trip with his family in the area. In the Walmart surveillance video that had been played multiple times mark says they were buying a shovel a box cutter and a change of clothes because it was all for a fishing trip you're gonna beat the shit out of them yeah well they're underground this fish people go for see these normal people they don't think outside the box they look for fish in the water i know where they really. I know where they really are. I know where they really are. I know where the fish are. She said, quote, none of that ever happened.
Starting point is 02:00:29 No. Which is great. That's fucking hilarious. Mark said Maxwell could have called at any point in their trip when she was alone at the house in Michigan, but she never contacted law enforcement and said, hey, my boyfriend's a murderer. No, because she's scared of him. Yeah. She said, why didn't you call law enforcement after seeing Jenna handcuffed in the home?
Starting point is 02:00:49 And she said she recalled the last, she started crying again and said that she recalled the last breathing moments of Scott. And she said her reasoning is all because she didn't feel safe. And Mark said, it's because your story isn't true. Right.
Starting point is 02:01:05 Jesus Christ. They also played footage of him and scott and swearingen walking in and out of swearingen's home she confirmed that this was the house they were handcuffed in um this is fucking crazy so um yeah he keeps he keeps going after her basically he his whole thing is if i can batter her into submission then maybe i can blame her for everything or whatever the fuck it is and uh he plays a outside the presence of the jury he plays a part of a jail phone call between him and maya speaking about her pregnancy concerns and how police uh reached her og ob gyn he um, he does that. He also did this as an attempt to discredit statements in her police interviews. He attempted to play the phone call in court. He wanted to play it on his computer. The judge denied it and said, no, again, not doing that shit.
Starting point is 02:01:58 So in Maxwell's testimony about what happened in Oklahoma, she said she initially had the white camper shell placed on the burial site to mark the location so police could find it. That's what she said. She says that Mark said she did see bruises on Jenna's neck. He said, did you see anything that looked wrong with her? And she said, well, bruises on the fucking neck. She said she lost trust in Janelle when she told her what happened in Texas. She quoted Janelle to say they've been best friends for 16 years and know a lot of the
Starting point is 02:02:28 same people. In this mention, Maxwell says she doesn't believe Janelle is a monster unlike Marx. Right. So he also questions Maxwell on her past use of lithium and tremadol to discredit her testimony. Okay. So she's got mental problems, but it's probably PTSD from you. She said that she rarely used lithium and responsibly used Tremadol as prescribed. So he continued to cross-examine her.
Starting point is 02:02:58 He alleged how she wanted to get revenge on Jenna in the past due to Jenna's relationship with him. And she said, I never wanted to hurt or harm Jenna and Michael. They didn't deserve what he did to them. Said that to the jury. Well, after he asked a question, he later alleged that she has motivation and bias to speak out against him. Even adding how her plea deal can help her see her son.
Starting point is 02:03:20 She broke down and said, I feel horrible about this and I accept responsibility. This is something I didn't want and I'm not upset with my acceptance. So he just keeps badgering this woman on the stand. Um, he, the prosecution makes a motion saying Mark's made strenuous offenses, bringing up other murders in his cross examination and to prove Maxwell had
Starting point is 02:03:41 valid fear and not immediately telling police. Maxwell said, Mark's made these confessions to her on their trip to Oklahoma back to Michigan. Maxwell says Marks first confessed to killing cats and kittens. Then he told her that he killed a boy when he was a minor. Yeah. Then Maxwell says Marks killed a man in prison in Oklahoma with others off camera not to be caught. in prison in Oklahoma with others off camera not to be caught.
Starting point is 02:04:09 Out of prison, Maxwell says Marks told him he told her he killed Andre Ogans for hitting him while in the Oklahoma prison to cut up his body into pieces and burn them. That's what he did. He said once they got out of prison, he got his revenge from a guy in prison who used to be in prison and then cut his body into pieces and burned them. Burned him. Yeah. prison who used to be in prison and then cut his body into pieces and burned them burned him yeah in discussing what marks allegedly did to ogans maxwell said janelle mcdonough helped bury ogans and move the body to another location wow um that's a lot this is a chick that's a staff sergeant
Starting point is 02:04:39 this is fucking insane yeah uh so poof uh Marks allegedly told Maxwell that he was having legal battles with a female trying to take his kid away. And then he said he killed April as well. So, holy shit. She finished her time on the witness stand. Finally, it's just a lot to a Bank of Bank of America representative came out and got bank records from January 2019. And a recording of Marks calling to close his bank account. He said in the audio he believes his ex has his bank account information. That's why he said it.
Starting point is 02:05:12 So he's very paranoid about all this. Also, they try to figure out how he tore his bicep and all that kind of thing. When, well, Mark's told Powell here, Powell is the police interview, yes, thats told Powell here, Powell is the police interview. Yes, that's Corey Powell here. He gets back on the witness stand. They're going back and forth. Powell was unable to get the casino footage in Oklahoma where Maxwell pulled out money.
Starting point is 02:05:38 They said, though, the police, Powell learned Marks tore his bicep from lifting the Jeep from the mud, according to Maxwell. Wow. He was trying to lift it. Yeah. That's I got to get out of here. Yeah. After speaking with Powell with Maxwell, Powell did his first interview with Marx to see what he had to say. At the beginning of the interview, Marx immediately made statements trying to clear his name right away.
Starting point is 02:06:02 I know I'm here. Yeah. He said he met Michael a few times and not knowing him well and admits to threatening him in March 2018, but he said he thinks Michael's a super friendly person. Yeah. Yeah, he said that, yeah,
Starting point is 02:06:15 he just lied about everything. He said, what about, you know, I want to ask you about the killing of Jenna and Michael, and Mark said, I'm not a killer, I'm not a kidnapper. Made them disappear. That's all I got to say. I ain't a killer, but don't push me. Is that what he said?
Starting point is 02:06:28 I'm not a killer. I'm not a kidnapper. Made them disappear. That's all I got to say. Yeah. I didn't kidnap or kill them, but I made them disappear. What the fuck does that mean? What the fuck?
Starting point is 02:06:37 So the guy pressed Marks to tell the truth, saying he already got it from Maxwell. And Mark said he doesn't know why she would say anything like that. She's been in Michigan the whole time. I don't know shit about what you're talking about. So, yeah, he continues his testimony. In a recorded interview, Mark said he'd plead guilty to murder charges if he'd be able to be released on bail to sell action figures to raise money for his family.
Starting point is 02:07:00 Why does he love action figures so much? He's going to sell action figures to raise money for his family let me go he's charged with fucking death penalty murder yeah and he says just but i should be let out on bail during the trucks i gotta sell some action figures so i have some stuff to do the judge said quote there is no way we're going to let you out you are absolutely never ever getting out of here get back in there oh my god um in a video mark in this one video here mark said he went down to texas to turn himself in he then explained this is a police interview how everything was crushing him since august 2018 in this period mark said he couldn't think, feel, and focus. He
Starting point is 02:07:46 also felt like he was seeing Jenna everywhere and also that he tried to commit suicide. It's almost like he has brain damage from being hit in the head a lot for fucking 20 years. Is that possible? And I'm being haunted by somebody that I hurt. He just described every symptom. I'm confused.
Starting point is 02:08:02 I want to commit suicide. I see things that aren't there. Wow. so they asked him if he remembers his trip to texas and he said he doesn't remember specific things rushing through his head at the time he could only remember uh all he could remember was crying when janelle sent him a picture of the boys he's a fucking mess um he also said that Maxwell had a deep hatred for Jenna Scott, so I would look at her. Marks told the detective he remembered Maya taping Jenna's mouth in a bathtub and putting a bag over Jenna's head to suffocate her. So he ended up putting himself there, but saying Maya did all this. But you're right there.
Starting point is 02:08:43 He even mentioned a spiked club was used, but then recanted his statement. What? Yeah. When Detective Powell asked about what happened to Michael in the same time period, he said he can't recall. Wow. In the video, this is, like I said, the interrogation video, he said he doesn't remember going to the Henrietta Walmart with Jenna and Michael's bodies in his Jeep. He also doesn't remember driving around Austin. He said he only remembers driving back up to Michigan.
Starting point is 02:09:12 In the video, the cop responds to Mark saying the jury doesn't want to hear you say you can't remember time periods or not knowing what happened to Jenna and Michael. He says it's all his fault for being in a relationship with Jenna, ignoring his kids and for getting back with Maxwell. Wow. He also said that he had no part in the death of April
Starting point is 02:09:31 piece as well. Just in case you were going to ask about that. I didn't do any of this. Maya did it all. He questions Marx to know more background information
Starting point is 02:09:39 on him. Marx tells the detective he suffered sexual abuse from a family member and stayed in and out of detention centers and psychiatric facilities as a minor. Perfect. This makes sense now.
Starting point is 02:09:52 That makes more sense. So, yeah, he also after his arrest, he tried to get out of jail as well, which is fucking amazing. That's wild. They said that, he said I'd be willing to admit anything. I just want to sell action figures.
Starting point is 02:10:07 I'm not going to run. I just, I'm not going to leave my children. I just want to sell action figures. I just got a passion for this. He's got a, yeah, it's more about a passion for this project.
Starting point is 02:10:18 Funko pops are my life. Yeah. He said, here's the deal. You're not getting out of jail. That's not going to happen. We're not going to let you sell those things. That's the deal. You're not getting out of jail. That's not going to happen. We're not going to let you sell those things. That's the reality of it.
Starting point is 02:10:28 You're a person of interest in a heinous crime. There's no way we're going to let you out. And then they said, we're here to tell the truth. And Mark said, I know what happened to Michael and Jenna. He then denied he killed Scott, saying he entered a state of blackout that may have been service-related, and it was likely Maya Maxwell who killed Scott. Boys, what a yarn. All over the place. What a yarn.
Starting point is 02:10:55 He said, Maya absolutely hated Jenna because I lied to Maya. I told Maya I'd been with Jenna a lot shorter than I did. So Marks tried to press the police on what they knew, but he was trying to get information. But he denied he was the one who killed them. He said, I did not kill Jenna at all. I did not. So non-contractions at all, which makes no sense. I killed her a little bit, maybe.
Starting point is 02:11:18 Not at all. So they said, so you were present when Maya killed Jenna. And he made an unintelligible motion while handcuffed. And the detective said, I think that answer is yes. He said, how did Maya kill Jenna? And he said, if Maya did something like that, she'd use a plastic bag. I know Maya. I know her killing styles.
Starting point is 02:11:38 Usually real familiar when she kills a young lady. It's in a place with a plastic bag. Like they were both mob hit men.'s like he likes a 32 that's what he's he's he's preferable to that that's the garage guy so yeah um so they said though that uh i've one of the detectives said i've seen michael's injuries and i'm telling you maya couldn't have done that obviously so he asked cedric what do you think happened to Michael? And in the interrogation, he said, Mark said, quote, I'm not here to say I did or didn't do anything because all the evidence is pointing to me. Oh, boy.
Starting point is 02:12:16 Okay. So then Powell tried to show Mark's photo evidence of Scott and Swearengin being unearthed, but he didn't want to look. No. And Powell said, the detective said, it's a big old hole with Michael and Jenna laying in it. evidence of scott and swearingen being unearthed but he didn't want to look no and he's powell said the detective said it's a big old hole with michael and jenna laying in it and uh mark said please don't show me something terrible i'm very sensitive i might throw up i just ate my just i get sick i get a little queasy just a queasy thing they pressed marks on why he stopped at a casino possibly with bodies still in the back of the car and and whether Marks knew about Scott and Swearingen's impending funerals later that week.
Starting point is 02:12:48 And he maintained he couldn't remember exactly what had happened, but he's not a murderer. He said, quote, I'm not a killer. That's what they said. And the guy said, well, I dug the bodies of Jenna and Michael up in Clearview, Oklahoma, 700 yards from where your family has a burial space. He said, I think the jury is going to have a problem with you not remembering what happened to Michael. And he said, quote, those those 12 people are not going to want to hear. I blacked out. That's what he said.
Starting point is 02:13:15 And Mark seemed to accept his fault. And he said, every last bit of this is my fault. It's all my fault. I put myself in a lot of bad situations. So they're playing this in court yeah it looks really fucking bad we'll just put it that way um he said that uh marx was in uh into contact with a bondsman on january 4th his therapist and his attorney on the evening of the 5th paul said mark's phone location in jol, Illinois, refutes the alibi of being at Island Jiu Jitsu in Michigan. So they go through all the fact that he obviously didn't do that.
Starting point is 02:13:50 Lying like crazy. Yeah. Yeah. Mark's went over Powell's timeline to catch if there's any incorrect data or all this type of shit. Cross examination. He asked Powell if if if Powell made the timeline of events he believed transpired and all of that. In the timeline, Marx mentioned the numerous calls with women, Paul said, are Marx's girlfriend. Marx asked Paul how many women did he speak to to say they were in a relationship with Marx himself. How many women did you talk to that said they're in a relationship with me? Right. you talked to that said they're in a relationship with me right powell said he knows of 17 girlfriends who have been in a relationship with marks a lot at the same time 17 17 um that is
Starting point is 02:14:34 fucking how do you keep that straight that's a lot man that is fucking bonkers um i don't even know what does mark say that. That is fucking... Does he refute it? No, no. He just wanted to get that in open court to show what a dick slinger he is. What a cocksman. That's the other thing. Yeah, it's an ego.
Starting point is 02:14:54 That's why he's doing this, so he can get in what he wants. How many girls did you find that I've slept with? That's a fucking mess. So this cross-examination eventually leads to Marks being drug out of the courtroom. Really? Yeah. So Marks exclaimed to the judge that the court is protecting the detective in what Marks says is a dishonest investigation. It's a sham!
Starting point is 02:15:17 He said, I'm sitting here trying to save my life and you're sitting here trying to protect this piece of garbage? The prosecution knows he's a piece of garbage so he's escorted back to a holding cell for 15 minutes to chill the fuck out and um yeah so then they go on he comes back and then he's got a fucking you know read in he's got to then cross-examine him again marks received numerous objections by the state for his questions over relevancy, hearsay, speculation, and then he lashed out at the judge again. He said, you should be ashamed of yourself, to the judge. You shouldn't even be a
Starting point is 02:15:54 judge in a hot dog eating contest. You don't really need a judge there. If they ate it, you just count. In a pie eating contest. Wow. Hot dog eating contest. That's what he screamed as he shrugged from the courtroom again. They have to keep letting him back in because that's what it is.
Starting point is 02:16:17 Because he's a lawyer. We're up to day 23 of the trial now. Jesus Christ. Three weeks of this shit? three of the trial now. Jesus Christ. Three weeks of this shit? If this was on television, this would be the most intriguing trial of all time.
Starting point is 02:16:30 But unfortunately, they didn't show it here. They said that on January 2nd 2019, Marks allegedly made searches on how to delete messages on Android phones and how to retrieve data. The same day, Marks' phone had website searches to find personal information on Bruce Thomas. Marks has said in court searches to find personal information on Bruce Thomas.
Starting point is 02:16:47 Marks has said in court Thomas had a former relationship with Jenna. He's going after her ex-boyfriend. Oh, my God. Between November and December 2018, evidence shows Mark's Yahoo mail account had searches for Jenna Scott and marriage certificates. See if she got married. to see if she got married. On Maxwell's phone, it showed Google map activity for car washes in Missouri and the distance between these car washes and back to Muskegon. So, yeah, they talk about all his background checks, and there's a lot going on here.
Starting point is 02:17:19 He said that, yeah, him cross-examining people, he's got to know that that doesn't look good. He has to. Has to. No, he doesn't. He doesn't know. So the state rests its case. Yeah.
Starting point is 02:17:33 The judge rejects his motion for a directed verdict. He said, I'd like a verdict of get this fucking out of here right now. After that case, obviously, judge, it's over. Directed verdict of not guilty and we take a fucking hike right but he said no um his first witness was former king b lounge business owner william mahanky jr who said he can't remember seeing jenna and michael at his bar in downtown austin a paralegal who worked with marks came to testify she said she didn't know or remember the little information marks tried to bring up in his direct examination.
Starting point is 02:18:08 These are his witnesses, and they're like, I don't know what you're talking about. Team Texas Canines employee Crystal Fields testified her dogs did detect human scents in Michael's home, but clarified her dogs' detections can't confirm a death in the area. I mean, you never know. her dog's detections can't confirm a death in the area. You never know. So they said they didn't know why they were being called to testify and also said they didn't want to be in court. These people don't know why I'm here.
Starting point is 02:18:33 After these witnesses, Detective Powell was recalled to testify next. Marks insinuated Powell didn't use geofence data in his investigation, possibly because it conflicted with possible phone locations. Powell said, no, I didn't use geofence data in his investigation, possibly because it conflicted with possible phone locations. Powell said, no, I didn't scam the investigation. Then he claimed that Powell altered his phone records to present them to the court. Now you're reaching. That's easily checked on what was there originally and what's here now. It's all electronic, so you can bring it up.
Starting point is 02:19:04 It's not like you can fix a paper to look like it's old. They've scanned it in. It's it's this is 2000 fucking 20 here. So 2023. So then he brought up Maya Maxwell to testify again. She denied that she merged details from her past interviews to make a narrative. And she denied killing jenna scott when questioned directly about it she also denied being kicked out of her friend's home before
Starting point is 02:19:30 staying with mark's marks his friends maxwell said mark spoke to her friend uh to then be kicked out like he got her kicked out he continually said maxwell's lying to the jury and even asked if she's ready to take a polygraph test to which the jury that they objected because that doesn't count in court anyway he finally brings in he's a terrible defense attorney he really is truly yeah and all the witnesses are like I don't know why I'm here either that or it's people he's already badgered and he's recalling them to badger them again his last witness was his former former title co-worker, Rashard Hicks. Hicks testified he knows Marks and is a trained MMA fighter.
Starting point is 02:20:11 Or he knows he is a trained MMA fighter who strikes to take down his opponents. He's more of a striker. He's not a ground-and-pound choker. As we found, it's always TKO with punches. But that's against other fighters. If it's a non-fighter it's way easier to choke them yeah overwhelm them yeah they they know that more people know how to punch than defend a ground attack you know what i mean so he said that uh he does admit though that uh marx is capable of
Starting point is 02:20:38 grappling someone to choke them he said is he even am i even capable i'm a terrible ground fighter right look at my record let's look at the people I fought. You know, yeah. He said he'd have a few more witnesses to testify in person and the rest that was in person. The rest will testify online. So he finally rests his case after he calls Rebecca. the former with Corey Powell in the second search of her home and stands on her previous testimony that she noticed more items from her home were missing after the police did the initial search. So they also call a D a DNA. No DARS,
Starting point is 02:21:15 no DARS, no DARS testified that she went to Rebecca's home on January 3rd and 4th and found no boxes left on her porch to pick up. No DARS said she contacted Rebecca about seeing a light on in her home, but no one was present. Then he calls his sons back up to testify online from Tennessee. Logan testified first
Starting point is 02:21:38 to describe how he saw Jenna Scott hit and threaten Cedric Marks, just like in the last thing they testified to. Logan said he doesn't remember much leading up to Marks' trip to Texas besides him going with Maxwell to see his lawyer. So a lot of I don't remember, I don't remember, that sort of thing. In cross-examination, Logan told the prosecutor he doesn't remember telling authorities that Marks' burgllar recharge from August 2018.
Starting point is 02:22:08 How Mark's himself broke into Jenna's home to request she drop the charges. Doesn't remember any of that, which he's a kid. He might not remember because it was five years ago. Man. So they also bring up Adrian. Adrian testifies he doesn't remember Mark's threatening Michael over the phone. Adrian mentioned similar experiences to Logan about Scott making threatening remarks there. Marks' first wife, Christina, testifies, the first one, first first, that we didn't even know existed, by the way. She is before Janelle.
Starting point is 02:22:39 She said that she spoke to Marks on New Year's Eve 2018 and heard that he was depressed and having a rough day. She was worried about his well-being and tried to call him between January 1st through the 3rd, and it was being sent to voicemail. She told the FBI she was unable to find her phone records from this time period, but said she never received calls from Marks in this time frame, only heard from him after he was in jail. So, he rests his case. Defense fucking rests. Ha ha. Mic drop on that shit. Right.
Starting point is 02:23:12 Holy shit. This is crazy. So they're going to deliberate. Testimony is over with. And yeah, they testify. They brought all sorts of people in. After everybody rests and there's extra stuff because they recall, and then they rest, rest, and then it's over. So here we go.
Starting point is 02:23:31 He is accused of these murders of these two people, obviously. The verdict comes in. Here we go. And it comes in. The closing arguments began 1045 in the morning, setting the stage for his closing arguments. Yeah, that's fun. Their closing arguments are simple. While many of us were starting to enjoy the new year, what was happening to Jenna and Michael was horrible.
Starting point is 02:23:56 The cell phones, each and every one, gave us clear indicators of what was going on, where it was going on, and when it was going on. on, where it was going on, and when it was going on. They came down to Texas, and Cedric Marks used the skill set he had as an MMA fighter to strangle two people. There you go. So he makes his closing statements, and he says, I didn't commit the crime. I didn't kill these people. As bad as my relationship was with Jenna, I never would have done that to her. He said, yeah, I'm a fighter.
Starting point is 02:24:24 He said, I am an MMA fighter I have a certain skill set but that doesn't mean I'm going out there just using that skill set to do crimes okay yeah I'm not just doing crimes yeah he said he said that their monster is a guy who dresses up as spider-man and has a bunch of toys because he said that you know they his fighting persona is spider-man so he like, that's their monster. He goes, I dress up like Spider-Man. I have a bunch of toys. Does that sound like a monster to you?
Starting point is 02:24:50 I'm a toy guy. What are you talking about? I like action figures. Yeah. He pointed out that he had no injuries consistent with killing two people during a possible fight. He said, without any marks on my body, I don't know how many of you in this room have been in a street fight, but that ain't gonna happen. He also continued his attack
Starting point is 02:25:07 on the lead police investigator, said Detective Corey Powell puts false facts in multiple search warrants. False facts? False facts. He said also, please look at the science. The science will not lie to you. That's right. And the district attorney came back
Starting point is 02:25:24 and said, we never called Cedric Marks a monster. The state never called Cedric Marks a monster. Maya Maxwell called him a monster. That's because she saw what he did. Right.
Starting point is 02:25:33 We didn't say shit. Yeah. So that's crazy. So they asked that the, again, they showed in the closing, they showed the victims' bodies. They asked the family
Starting point is 02:25:44 to look away. He said he left him in a shallow grave in an embarrassing position because he was so mad. Wow. Yep. He said they showed all of the photos of the autopsies, showed marks on both their wrists and ankles consistent with being bound before they were killed, along with severe injuries to Scott from blows so hard and strong they broke her ribs. That is fucking wild. And then they say he wants you to believe that Maya Maxwell is the mastermind behind all of this. And they said, look at the video.
Starting point is 02:26:16 Look at the video from Walmart. Where is Maya Maxwell? Three steps behind. Three steps behind. That's the position she had in life. That's the position all women had in his life. All the women in his life didn't even know about each other. He was obsessive.
Starting point is 02:26:30 He was relentless, and he was going to pursue her, and he did. He said, we were able to capture every piece of evidence in this case, but what we were – we weren't able to. But what we were able to do is gather every piece of evidence we could and put it in front of you. Warts and all. He said, I want I hear. I think I want this. I think I want to end with this. I want the last words for him to hear before he's found guilty are the words Jenna heard. Are you ready, Mr. Marks?
Starting point is 02:26:56 Because there's there's one more decision to make and we've proven it behind or beyond a reasonable doubt. So there you go. And he said that, yeah, the homicide detective said he's just overwhelmed by all this. They talked to him later on. The press did. So they said afterwards, they asked Powell, the detective, what was it like with him cross-examining you and all that? And he said, well, that's what he's supposed to do. He's got to find something and I'm it, which is the fucking truth.
Starting point is 02:27:25 So May 25th here. Here we go. It comes out. The jury finds him fucking guilty of everything. Yeah. Absolutely super guilty of shit. Yeah. I think that's the technical legal term they use.
Starting point is 02:27:39 Well, in Texas. Yeah. Super guilty, bro, I believe is what was said here. So, yeah, they find him guilty and he says, I didn't commit any crime. I can look at the family and say I did not kill your daughter. I did not kill your son here. Yep, they said that Maya Maxwell said he was a convincing liar, and he lied all the time, and that's what they said. So, sentencing comes around.
Starting point is 02:28:04 Here we go. this is where the fireworks happen okay state shows videos and it argues uh it argues shows mark's confessing as we found out to the killing of april peace because then this can all come up in sentencing yeah that by the way if you don't like putting them in the to death for these two There's another one that he admitted to doing as well. He said, though, that's ridiculous. He said, quote, even if I was to get away with this, I'll show you this video. I'm a bad person, but I'm not a bad person to let a child go to get hurt. I hope I can be I hope to be reunited with you. But if I fail at this, I succeeded anyway because I freed you. That's what he said in the recording that they found. So at one point, the DA objected to Mark's making self-serving statements.
Starting point is 02:28:53 Mark said, this is a death penalty case. I deserve to do a self-serving statement because I'm fighting for my fucking life. This caused the deputies to surround him and the judge tried to deescalate everything. Hey, calm down. But then Mark says, I don't know why you're all looking at me like you're about to do something.
Starting point is 02:29:12 Oh my goodness Christ. So yeah, he was yelling. Then he starts yelling that April peace was a drug addict who kidnapped her children from their fathers and used to steal things from people and all this type of shit. He yelled about pieces, mother Dorothy saying that she's a fucking liar and she did this and she did that.
Starting point is 02:29:29 Dude, not helping yourself. Yeah, that is wild. So her mother said, April Peace's mother said she was afraid. She knows he would never leave her alone. He wanted to control her. Peace went to a homeless shelter with both she and Marx's son in Washington. And that's how they ended up finding her and all that kind of shit. So, wow, that's crazy.
Starting point is 02:29:58 Marx got a temporary control of his son. And the piece, his mother said, basically, I gave my grandson to the man who killed my daughter. Right. So June 6th. Here we go. They get more people here to to tell that he's lying. Charles Roberts, he testifies about how how Marx broke his jaw while enlisted at Fort Hood in 2001. This character evidence.
Starting point is 02:30:25 Roberts was in an intimate relationship with Sharon Baxter after she had broken up with Marx, and so Marx obviously went to him. Yeah, Marx broke into Sharon's home to attack him, by the way. Wow. He testified that he did press charges, but had to drop them for military relocation. He couldn't be coming back to go to court.
Starting point is 02:30:44 He admitted, though, that Marks came to visit his house before he moved and was unsure how Marks found out where he lived. Shanner and Baxter testified after Roberts to confirm that he did break into her home and did that. She said she was fearful in her relationship with Marks. She said during the relationship, he stalked her after they broke up and choked her while he was mad at her in the relationship. Sounds like him. Yep. Marks asked Sharon why she's getting to lie in front of the whole jury. That was his question. She said, I'm not lying.
Starting point is 02:31:16 She said that Marks claims of her were false and doesn't recall ever hitting Marks or Janelle, or allowing marks to stay at her home in Texas, which he said, didn't you let me stay there? And she was like, no. So he's irritated. He's pissed off. Janelle came back to testify what she knew about April.
Starting point is 02:31:35 And, um, yeah. So in her, in the examination here, the DA started to play video. Uh, Mark's left Janelle saying he was going to save Adrian and take care of the boys.
Starting point is 02:31:47 He shouted profanity. Quote, these are such disgusting people to make her stick to a lie she told, and you're helping them. Whether I'm put to death or not, this is a dirty system, dirty country, dirty people. Dirty system, dirty country country dirty people yeah not bad that is awesome that is uh that is fucking amazing but only because of this if they let him go he'd say we live in a land of democracy and wonder it's fantastic so they also um jesus christ uh marx ended up he shouts profanity these are such disgusting things Fantastic. So they also Jesus Christ. Marks ended up he shouts profanity. These are such disgusting things.
Starting point is 02:32:31 The judge immediately asked him to be escorted outside the courtroom. He comes back into the courtroom to ask to be excused while the video is being played. The judge denies it, saying he's representing himself and needs to be in the courtroom for all phases to do that. Marks then demands that he's taken out of the courtroom. You will remove me. After recess, she said that Marks made his confession to her a few years after April went missing.
Starting point is 02:32:53 This is his wife, Janelle, recounting the confession. She said that Marks and his former girlfriend Kelly got peace in Minnesota to kill her in an abandoned shack in North or South Dakota. Jesus Christ. She wasn't certain of how peace was killed, but said that Marks, in his confession,
Starting point is 02:33:13 he made April's body unidentifiable while removing her hands and feet as well, by the way, and her teeth. She said she was shocked and didn't do anything when he told her that. She said that Marks talked in between her last testimony about wanting to remarry her since she's testified in court. She's actually finally got a divorce from him. She said she declined because she didn't know fact from fiction with everything happening. Also, he's a fucking murderer. That's also the other thing. She said she does remember him being a good dad but is starting
Starting point is 02:33:46 to see some manipulation and then she confirmed that she and marks won't get back together yeah yeah um her former boss said that she uh that marks used to verbally abuse janelle as well then jenna's parents come out for their plea you know talking about how this has affected their lives and it leaves a huge hole in her siblings lives and everything else gut-wrenching for the family i mean that they've had health problems alongside other people since then because they're yeah this is a horrible horrible thing for these poor people so um this guy says uh this is harrison here he says marx is all about his children and talks about how wonderful they are. What about my child, or Karen Scott's, or Dorothy Peace's?
Starting point is 02:34:30 Think about that, Mr. Marx. He has many friends. He didn't meet anyone who didn't love him except Cedric Marx. Man, this is fucking brutal for these poor people. So through this whole thing, Marx, he says, Cedric says, is this the Jenna Scott capital murder trial or the April peace trial? I don't understand. Oh, for heaven's sake, dude. He then said, these are disgusting fucking people, your honor.
Starting point is 02:34:56 To have them play this for her off a lie, whether they put me to death or not. Disgusting. He says it again. It's all dirty. The people, the country system, it's all fucking dirty i'm out of water you're out of water the whole system's out of water he went on the and justice for all al pacino rant so here we go after a week-long punishment phase here they come back death is on the table or life in prison without parole um here um yeah he said they uh they you know come back out here he is um by the way they have all these
Starting point is 02:35:36 audio clips too saying i wanted to hurt her that was a mistake it's so bad um it's so fucking bad they tell him you sir yeah may fuck off death penalty for you is that right yes uh death penalty and um just got it just got it yep this was 2023 just brand new yep um they said would you agree you're a danger to people when you want to be and he said no which is fucking amazing um they said what about that it's it's amazing man they kept bringing up by the way at one point and this is a great thing in his interrogation or during this trial they said you're trying to tell the truth tell the truth and garza looked this is the prosecutor looked at marks and he said he's still trying to control this narrative. And Mark said, no, I just really hate you to the prosecutor. Oh, so his girlfriend enters a guilty plea, receives her sentence, 20 years in prison for tampering as well.
Starting point is 02:36:37 So this ain't over. No, no, no, no. This is there's going to be appeals and all sorts of stuff here tampering with a corpse. She's got all this type of shit. And finally she is sentenced to that. The parents of the victim say they are standing strong. Michael's mother said, we waited all this time and we got what we wanted. He was found guilty and given the death sentence, and that's what he deserves.
Starting point is 02:37:01 So I guess all the parents had become friends here. deserves so i guess all the parents had become friends yeah here um they ended up all the parents together created a thing called priceless beginnings it's an organization that holds several events and has raised thousands of dollars to support victims of domestic violence awesome that's a very nice thing we should fucking donate to that yeah that's nice we're gonna do that you should do out there maybe that's good i think look it up and everything but yeah it sounds it's fascinating sounds like people with a passion for this. Yeah. It's terrible that people have to do that, but I mean, that's life.
Starting point is 02:37:34 Also, we've only got him for three. There's got to be more. There's got to be more. Fuck, he's admitted to at least two more that we know of. So, I mean, he's a serial killer, this fucking guy. He's a bad man. Absolute serial killer. He's a fucking stone-cold killer here.
Starting point is 02:37:50 Yeah. They said, we started out with the kiddos dealing with domestic violence because Jenna was a victim. Michael was trying to help her, and that's why we focus on domestic violence. It's important because there's a great need in Bell County. We've helped a lot of people get out of the situation and we'll continue to do that. So that's good. That's good for them.
Starting point is 02:38:07 August 23rd, 2023. Wow. Very recently. He is trying to get an appeal here on this and he is denied his appeal. Keep on keeping on shit bag. Yup. He said during the trial,
Starting point is 02:38:22 he represented himself and he had to leave the courtroom several times because of his outbursts. Therefore, you know, he should get a break for that. So here he is. He's on death row at this point. His TDCJ number, this is like his whatever number, is 999-628. So there he is. He's in Tulsa. He's fucked, man.
Starting point is 02:38:46 They got him in Oklahoma, huh? Yeah, yeah, in Oklahoma. Yeah, he's shit out of luck, man. He is done, done, done. So, no, he's in Texas, Texas Department of Criminal Info, death row, because that's where it happened. He buried him in Texas. He buried him in Oklahoma, but he killed him in Killeen, Texas.
Starting point is 02:39:01 So that's where he is. Do they have him in Tulsa, or do they have him in Texas? No, no, they have him in Texas. They have him in Texas, Texas. So that's where he is. Do they have him in Tulsa or do they have him in Texas? No, no. They have him in Texas. They have him in Texas. Yeah. He's certainly in Texas and that's where he is. He's in a lot of trouble. So he's in a lot of trouble.
Starting point is 02:39:12 He is definitely going to be appealing because it's a death penalty case. He's going to get a lot of appeals, but he doesn't have a lot of legs to stand on here. They're going to get him. Yeah. He's in deep shit. And if there's anybody who the death penalty was made for he's begging for it yeah this guy is fucking asking for it he's a bad person if you watch that trial as a juror and you're not even like a pro death penalty person because we're not like yay yay death penalty just because they fuck it up a
Starting point is 02:39:41 lot right but this guy's just every action of his life is begging to be put out yeah he bet you'd be like can we kill him as a jury honest to christ yeah can you tie him up and throw him on the floor we'll just kick him to death because we all hate this man that's a dangerous person it's a very dangerous person it's a serial killer so there we go he's a serial killer um and we just covered him for you. Enjoy that. Thank you so much for listening. Thank you for listening to that crazy shit. And if you enjoyed that, tell everyone about it.
