Yay's, yay has been very thankful for little things that I, I've done or I've done or I've tried to do for other artists, whether it's speaking up, whether it's doing A, B, C, or D.

So if you do something that rises to the level of not getting a cash bill, they can't give you a cash bail. They can be like, yo, $200,000, they can't do it. See if they got to let you out or they don't let you out at all until trial.
Starting point is 00:15:37 And in the case of he's accused of pulling a gun on a woman, they look at your priors and other shit like that. And, you know, he probably got a bunch of other gun charges. I don't know if any convictions. And they're like, all right, we're not letting you out. And it don't matter if you're a celebrity and that. That's the kind of like the good and bad thing about state. like Jersey that are no cash bail, which means it was initially aimed to allow people who couldn't

Because they had a whole rubric of, hey, if it meets this thing right here and it doesn't, they have almost a point system, you just get out of jail immediately, right? But it also was meant to like, you know, hold criminals, which means there's no way you could get out unless a judge lets you out. and a lot of times those people sit. So apparently Fabio was sitting until his court date. He's accused of pulling a gun on a woman during an argument. Supposedly of her parking spot or something like that.

It's kind of fucked up and kind of missing, right? He's been in jail since January, supposedly. Let's read the story. So Fabio For him been in jail for allegedly,
Starting point is 00:16:58 gun on a woman. If you've noticed, on his Instagram, he ain't post shit. He hasn't been posting shit because he's incarcerated. So, Fabio, 4. Yeah, he's only posted, like, he hasn't posted things since the arrest.
Starting point is 00:17:18 He was kind of gaining some steam with the Platboy Max. I'm the real Platt Boy Max, right? Remember that song? Right? But, um, look like all that momentum has been dried up, right? I'm not these rappers.

It's been quiet since he's been in jail since January. In a police theory obtained by TMZ, the rapper's accused of pointing a gun at a woman who asked for help jumpstart in her car on New Year's.
Starting point is 00:18:02 She must have thought this nigga was Kevin Gates. You thought he was going to jumpstart the fucking car with his bare hands. Nah, my nigga, I'm going to jumpstart it with this pistol. What's popping? Okay. To be held in jail in New Jersey with the incident took place during the confrontation. Fabio allegedly told the woman, if I see you parked in front of this building again, they're going to be a fucking problem.
Starting point is 00:18:19 Witness reportedly called 911 and local police have said that the apartment surveillance cameras corroborated their statements. And that's the thing about, you know, rule number one, especially in Jersey. You don't pull a gun. You might as well kill the person. I'm going to be honest with you. If you ever pull a gun in Jersey, kill a person. Again, I'm not giving no advice, but that's the thing. Pulling a gun is assault.
Starting point is 00:18:40 So if you pull a gun and point it, you're assaulting the person. So you might as well shoot them, right? You might as well give them a leg, and if you give them a leg, and if you give them a, depending on how you shoot them, it could be attempted murder. So you might as well kill them. At least they can't show up the court. Like, it just keeps escalating.
Starting point is 00:18:55 Guns, Jersey, don't go well together. You get what I'm saying? Even if you have it legally, like, for example, I'm all my unlegally. But you know, shit, you hope there's never a time somebody forced you to pull a gun. But when you pull it, you just got to do your thing. You feel what I'm saying? Anyway, yeah, so pulling a gun on somebody is a huge deal, right? So he was later arrested and looked like they looked at a surveillance camera.
Starting point is 00:19:16 They said, nigger, you pulled a gun on the woman, right? He was later arrested on January 18. It was hit with charges, including a lawful possession of a weapon, terroristic threats, and aggravated assault. So you could tell that, you know, he probably, you know, in Jersey, you have to have to have. a permit to have any weapon. It's not like one of those states like Florida or Georgia where it's permitless. According to TMZ, who spoke to Fabio Legal Representative Adam Lusberg, he's expected to be released in the next few months. They claim the police never recovered the weapon, but obviously they probably saw it on surveillance tape. And he has faith that the case
Starting point is 00:19:48 will be open and shut. Now, I think they might actually beat the case. They never found the gun. Yeah, you know, they could go with the theory that AACP Rocking went with, which is like, yo, I've never seen the gun. Like, that was a fake gun, you know what I mean? even though you could still be charged for using a fake gun to seem real. You know what I'm saying? Just days before his arrest, he was involved in one of the strangest rap beef at the top of the year, one little T.J. And two were kicked off of Max's stream for smoking.

Starting point is 00:22:46 What else? ESPN has drawn its largest NBA TV audience since during the first 11 games of the first round. Okay, okay. Yeah, niggas been fighting, scrapping. There's been a lot going on. You know, I spoke to Dirk's lawyer. It's coming out on an episode dropping today on off the record, but Dirk released a statement,
Starting point is 00:23:08 and this is the first time Dirk is kind of like officially spoke from his own account, and he releases via his own account. He said, listen, man, the recent development in Dirk's legal case have brought a harsh truth to light. The government presented false evidence to a grand jury to indict him. This is injustice. That's a violation of the very system that's supposed to protect all of us. Now, let me give you the explanation.
Starting point is 00:23:30 I think we went over this in depth already. The grand jury is a secret proceeding that the government gets to go unanswered, uncontested, to provide investigatory supposed probable cause or facts that could establish to a grand jury that there's probable cause that you committed a crime. If they agree with that, they majority vote to indict you, and then you have to stand trial. A grand jury is only to determine, is there a grand jury. enough evidence to bring it to trial.
Starting point is 00:24:03 According to Dirk, he's saying that they presented some stuff to the grand jury. Remember, Dirk don't got no lawyers in the room. Nobody's there, but the prosecutor and the jury, okay? There's actually, there's not even a judge there. You get what I'm saying? It's like, it's like an administrative person, but pretty much the prosecutor runs the whole thing, right? Like the prosecutor gets to dictate a lot of rules in that type of sentence.
Starting point is 00:24:23 And the prosecutor presented something that just wasn't true. They claimed that Dirk put a video of Kondo, Rondo, like, you know what I mean, crying? oh, no, and all that type of stuff, like making fun of the pop death in one of the songs that he did with Babyface Ray called A Wonderful or something. And that wasn't true. So Dirk's lawyer said, yo, if y'all presented that to the grand jury and y'all got an indictment off of that because here's a thing. Just to anybody we talked about this on the pod with his lawyer, Dirk was charging a criminal complaint. He was then added to the original indictment that featured everybody but him in a superseding indictment, which is the second indictment. when they added him to the indictment as the new co-defendant,
Starting point is 00:25:04 the only new fact they put in is that Dirk bragged about the murder through his songs and with visuals. And they're saying if you got a whole new indictment that you added him to, right, with only one fact that was new that he bragged about the murder, well, you got an indictment in a false way because that wasn't, that was a fan-made video. Anyway, he says, Dirk has always used music to tell stories to express pain and heal,

Starting point is 00:27:50 The cops usually made the decision on it. The cops and the prosecutors, they make the decision on it and say, we're going or we're not going, right? They said, we don't want to get blamed for this because later on if this comes out, it's on TMZ and they said, oh, these fucking cops covered up for act,
Starting point is 00:28:03 whatever. They sent it to a grand jury. The grand jury's job only is to say, Is there evidence or not? The grand jury, at least in Jersey, 23 people. I think in the feds, I think it might be 23 as well. They got to get 12 people to agree. They're voting on probable cause.
Starting point is 00:28:16 Now, here's the thing. There's a saying you could indict a fucking ham sandwich. Here's why. When this grand jury shit is happening, I don't know. I don't know who's in it. I don't know what they even told them. Right? Now, obviously, we cooperated with them.
Starting point is 00:28:28 We gave them fucking evidence. We say, yo, here's our surveillance tape. So they probably played the surveillance tape. God knows what they fucking saw on that shit. Because I didn't even watch all that shit. I just know we ain't do nothing. The grand jury looks at it, say there's no evidence. Okay, why did I say that?
Starting point is 00:28:42 Because on a grand jury, whoever's going to be the potential defendant is not in the room. You could say anything. You could literally say to the people, yo, that ain't going to lie, man. All right, I imagine the grand jury was like this, right? And they said, yeah, you know, I fuck this kid named whatever, whatever, nor never happened. But let's say that's a lie. That's a lie that just told the grand jury. The fucking grand jury at that point is going to be corrupted, be like, wait,
Starting point is 00:29:12 act already fucked a kid. Oh, and then they're like, oh, you know, act like he murdered two other people. They're like, where? Act murdered two people too? He's a bad person. Now, when it's come time to vote on is there evidence, they might be tainted by just that. You get what I'm saying? So you can't present false evidence.
Starting point is 00:29:29 You got to present evidence of a crime. So when you get something that's a fan-made edit and you, put it in a grand jury where they're going to decide because it's a really fickle case for Dirk did Dirk motherfucking did he do a murder for hire or maybe he's just friends with the guys who slid and he has nothing to do with it. He didn't promise people money to center. So when they're putting, oh, Dirk is bragging like yeah, I put the money up and he's putting the edit of the and he's putting out of video using the, it looks like Dirk is like overtly like basking in it.

So when you submit that to the grand jury, it's not that you, like, it's like, I don't know why I'm even doing this much to explain to you. No, he doesn't get indicted over a clip, but you can't put false evidence out there.
