Like, the David situation is kind of like, it's kind of really trippy. The cops aren't saying none, but they're leaving them free. I'm really wondering, I don't know.

Starting point is 00:01:18 that now if you guys don't know and aren't hip to what went on uh sean p ditty combs was sentenced on october 3rd he was actually sentenced to 50 months which if you do the math on that the math on that ends up being four years and two months okay now along with that which by the way i don't think there's been a post i'm i'm gonna send you uh like did he pulled out all the stops here like i mean all the stops. Like first and foremost, first and foremost, I don't know if this is, if it's still up here or it will populate. Gina showed up to court. I don't know if anyone noticed that. So Gina, and by the way, thank you to, there's a really nice young, beautiful lady who's a chat queen who corrected me. She said, listen, I'm just sick and tired of you

Starting point is 00:02:44 And she was asked a question, hey, what do you feel about it? She said, hey, listen, I am not in fear. And she pretty much welcomed the idea that, she welcomed the idea that Diddy could be released and she wouldn't be unfair. Now, there was speculation and I think we all thought some people, you know, they heard from rumbling to the court or otherwise that Gina was actually victim number three. However, ultimately, victim number three never testified in the case. Now, some people believe that she got cold feet.
Starting point is 00:03:17 It was actually mentioned during the trial that victim three would not be there in it. And actually, it didn't really. specify why she wouldn't be there, whether it was an unwillingness to testify or whatever the case is. Now, she did write a letter, but this was her showing up to court. And I'm telling you, man, you know, listen, men lie, women lie, but that bank account don't. Did he really got these women? They all showed up. I mean, Young Miami didn't show up, but she wrote a letter. His baby mama wrote a letter. Every woman that, you know, is pretty much still expecting that, you know, when Poppy comes home, the gravy train is going to continue.
Starting point is 00:03:54 They showed up whether with the letter or for especially Gina, she showed up in person. Now, shout to my man Mo Gagnet, who was actually the attorney for her. You know, he was the representing attorney for her while she went into court today. It says Gina showed up to court after pending a letter of support for Diddy. As you may recall, she was supposed to testify as a victim in a trial, but prosecutors was unable to reach her, the first. time when the time came now remember the letter she wrote she wrote saying that they were trying to force her to be a victim even though she saw no victim um there was no victim she wasn't a victim
Starting point is 00:04:34 jena hon letter that's fine it again so in her letter this is what her letter said her letter and let me see i can pull the whole thing up right here her letter said i know you're I've been thinking a lot about it. I saw letters in the press. I was submitted by many concerned the sentencing. Not one asked me or told me to write this letter, but felt my voice should be heard as I was identified at victim three. And I understand the charges that were brought concerning me,
Starting point is 00:05:10 including accusations of sex trafficking and prostitution. I cooperated fully with prosecutors. I met with them three times, answered their questions, and gave them all the information and evidence I had, including pictures, videos, and text messages from my phone. During those meetings, I felt pressure if to feel like a victim, I told them I was not, but they insisted that I was even when I expressed my truth otherwise. I understand they concluded I had been sex trafficked and involved in forced prostitution,
Starting point is 00:05:35 but I didn't agree with that conclusion. I wasn't trafficking. I didn't engage in prostitution with him or others. That would have been my testimony of call to the stand. I was subpoenaed and fully prepared to testify and answered all the questions truthfully, but I was informed by my lawyer that I would not be called to the stand. I want to emphasize and understand the seriousness of the case. Now, let me stop right there.
Starting point is 00:05:54 This woman is basically claiming that, you know, and I always wondered why was she a victim in the first place? But clearly, I'm actually believing her in this because I wondered if she had flipped on Diddy and then got cold feet and tried to flip back. You know, she'd try to do a speed backflip just twice. Starting point is 00:40:03 Sean Diddy Combs will be The sentencing will begin today. Hopefully it will finish today. Turns out that at least four of his lawyers want to speak. And the judge hasn't said no. Mia will speak as a victim. The judge upheld that, Judge Serbanian. And at midnight last night, Brian Steele,
Starting point is 00:40:22 who's put in a series of letters of support, Miles Guo among them, Palm Beach, chaplain of the police there, and Sean Combs' letter himself. but he put in a video he was supposed to give it to the prosecution at 5 p.m., and I'm sure he did, but at midnight he put a drop-box links
Starting point is 00:40:41 into the docket. So we dropped boxed and we put it up, and you can find it. It's a, well, you can say, I haven't rarely seen that, but it's not the only time I've seen it. I actually do remember a sentencing for another defendant delayed so they could produce a video to try to show the judge who they were. Here, I don't think there's any,
Starting point is 00:41:00 I think Suburbanians heard quite a bit of testimony about the days at revolt, um, bad boy, the family, he's seen the, you know, so I don't really know what it brings to the table.
Starting point is 00:41:13 Okay. And I wonder whether all of this sort of, uh, hoopla is going to drive it into more than one day. I really, that would be ridiculous because this is the day. And, um,
Starting point is 00:41:24 on the one hand, the government wants 11 years. On the other hand, Combs wants time served. Now granted, 11 years I thought was preposterous. it was clear that the government was trying to get, you know, like some consolation prize. Like, they lost on the major charges that could send Didi away for a long time.
Starting point is 00:41:45 But they wanted to get like a consolation victory to be like, well, we got him on buying pussy. And we've given him an enormous amount of time. And I think they were going to try to peddle that as a victory to say, well, it's not that we're happy. that he's going to get, let's say a guy 11 years, 11 years for buying pussy, but with everything that came out in trial, he's a bad guy and a bad guy goes away for 11 years. You don't care what he goes away for. Like, for example, I can't remember who it is. You guys probably remember or spamming in the chat. There was like some mobster, gangster, whatever, that they were trying to get on like murder charges and all these drug charges or whatever the cases,
Starting point is 00:42:27 they could never do it. And the thing that sent him to jail was like taxes. And the government and so took it as a win. I'm like, yeah, we got him. You know what I mean? Because, like, hey, they basically sold it to everyone like, this is a bad guy. We couldn't get him on certain things, but we all know he's a bad guy.
Starting point is 00:42:41 So we don't care why he goes to jail. Let's just send him to jail. And that's what they were trying to do to Ditty, right? Which is, hey, we might have not got it for some of the stuff, but we've smeared his character enough. You know he's a piece of shit. So let's just get this piece of shit away for a long amount of time. Somebody said Al Capone, yes, right?
Starting point is 00:43:01 Is it Al Capone? I'll see. Al Capone went to jail. Let's see. Al Capone went to jail. Yeah. Yeah.
Starting point is 00:43:18 Yeah, Al Capone went to jail and served time at the Cook County Jail. The U.S. penitentiary in Atlanta and the federal penitentiary on Alcatraz and the federal correctional institution on Terminal Island. his conviction for tax evasion rather than his known criminal activity led to his imprisonment. Wow.
Starting point is 00:43:36 That's crazy, right? So, like, he went there for tax evasion, not necessarily for these other things. Okay. So where will he come down? We will be covering it in great detail and live. Now, what else can we say? Here's another, this is a lesser known, but we covered about a week, 10 days ago, the case of a, it was described.
Starting point is 00:43:59 as a queen's school teacher, but he was indicted in the SDNY, Christopher Ward. He was detained for a second time yesterday, but we learned and reported, it seems to me it's exclusively, that he was teaching in Manhattan, as recently as July and August of this year, the La Man, Camp Le Man, Le Man, School in Lower Manhattan on Broad Street. We published the email that they sent around. Parents are pretty upset that they weren't immediately told. only they from their point of view they were told only when they read about the case on intercity press so there's that of course there's other cases here going on but we
Starting point is 00:44:40 also don't we don't only cover the courts we're covering the world of finance and transparency even during the shutdown the FDIC is rubber stamping branch applications okay all right so I'll give you a little bit of the highlights before we kind of like you know get to the the eventual sentencing. We could read through some of the stuff, but, you know, again, we already know the final outcome, so I'm not going to go line by line or tweet by tweet. I'll give you some highlights.
Starting point is 00:45:11 They basically said, you know, Diddy has worked on. They kind of admitted that Diddy did a lot of these things while he was under the influence. He's taken many steps to control his anger and also deal with the substance abuse problem. They basically say he has taken accountability. He eventually did speak. Obviously, the prosecutor was not trying to hear that. They won't 11 years. So they're like, yo, this guy is still the guy who is rich and famous who,
Starting point is 00:45:45 this is just a joke to him. He can't wait to go back home to start doing this thing again. And he thinks it's a foregone conclusion. He's going to get out of here today. And he thinks he's going to get out of here today. How do we know? He's booking speaking engagements already. The judge was not happy with that.
Starting point is 00:46:01 The judge was really not happy with that at all. Right. That culminated into this was around noon. Okay, here we are. Matthew Russell Lee, inner city press. We're midway through one hopes the sentencing of Sean Diddy Combs. Today, Friday, October 3rd, Southern District Court, New York Courthouse behind me. This was a walk that we used to take during the trial, but we'll do it today.
Starting point is 00:46:24 We'll be resuming. What's happened this morning? Well, the judge dealt with the sentencing guidelines. He turned down a number of government enhancements, but still had arrived at a hefty guideline. But he also said, it's just advisory. Government wants 11 years. Did he wants time served? What happened after that?
Starting point is 00:46:40 Well, Khrushislavik laid it on. She said this is not a typical Mann Act case, and I think most explosively. She said Diddy has already set up speaking engagements in Miami for next week and called it hubris. she also said that Mia, the the victim who testified at trial, the person who testified at trial as Mia, would not testify, due in large part to a letter
Starting point is 00:47:07 from the defense that she called bullying. And the judge seemed to agree. He said it was inappropriate, don't do it again, but it's unclear when it could happen again, given that this is the sentencing. In any event, unless there's a re-sentencing, of course. Then we had, well, in no particular order, there's going to be a guy, a reverend doctor, and maybe a reentry person testifying.
Starting point is 00:47:29 But Nicole Westmoreland spoke about Diddy as an icon. She seemed to cry a couple of times or sobbed. I just ran into somebody who said he didn't believe it. I don't know. She's a fine lawyer. She did some great cross-examining. I don't know if that was necessary. I don't know if maybe she couldn't help it.
Starting point is 00:47:46 I don't know. Now, another thing that interestingly happened during the sentence in hearing, a lot of Diddy's lawyers spoke. I believe Brian Steele spoke. Driscoll, who supposedly was like this younger, the youngest guy on the team that was smart and technical. He was applauded for knowing all the info. He was right to it, but he wasn't the person who appealed to maybe people's emotions or could really speak too well to a juror, but he was like a fact guy. Like imagine like going to Geek Squad. You know what I mean? Like, no disrespect to him. He's like the partner of. He's like the partner of. of Alexandria Shapiro, who's known to be an appellate lawyer.
Starting point is 00:48:29 Alexandra Superior also spoke, but also Driscoll spoke, and then also Nicole Westmoreland spoke. Now, if you don't know Nicole Westmoreland, she's an African-American lady that I said was, you know, maybe MVP is doing too much if I'm trying to, like, give her credit. But she's definitely six women of the year, right? Like she supposedly did such an amazing fucking job at eviscerating every single witness that she was assigned to with Diddy's case. And you know where she came from? She came from Fulton County, which is Atlanta.
Starting point is 00:49:09 She was seen there. By the way, she's also a sexual assault survivor. And I can't, you know, I think, you know, her team was open to do an interview with me. So maybe we get that done eventually. but I can't do anything but give her so much credit for being fucking amazing at her job, but specifically in this case she showed up like no other among a all-star team of lawyers. And she spoke at a sentencing and she cried. She shed tears.
Starting point is 00:49:44 She shed tears saying that the person she met, which is her client now, did he, changed her life. and he had such a big and dramatic impact on her. I know somebody that might be like, well, you know, that money make you do anything. By the way, this is her over here. That money make you do anything. But, you know, she's a African-American woman who is defending an African-American man
Starting point is 00:50:11 and she's saying, hey, listen, this guy has made a tremendous impact even though my life, not only because he hired me, but just him as a person. And that's what Matthew Russell's talking about. ...of times or sob. I just ran into somebody who said he didn't believe it. I don't know. She's a fine lawyer.
Starting point is 00:50:34 She did some great cross-examining. I don't know if that was necessary. I don't know if that maybe she couldn't help it. I don't know. The kids spoke and there were some tears. It seemed genuine. You know, not for me to say. Driscoll spoke.
Starting point is 00:50:48 Driscoll, Alexander Shapiro's partner. One of our partners, Driscoll, spoke about comparing it to various cases, including that of Dylan Jordan. We covered that case. He was a movie director charged with running a prostitution ring and also raping somebody. He got 60 months, but that was the maximum he could get given the plea agreement. So I don't know. We did something on the side. We did a little extra about Dylan Jordan.
Starting point is 00:51:13 Driscoll said he's read all 900 Man Act cases that are available in PACER. Some people were like, whoa, hats off to Driscoll. Hatch off to Driscoll. Coming up in the afternoon. Once again, Driscoll, he's like the guy who he reads something once. He remembers it for a lifetime. He was there to remind the judge of other precedent cases where people were convicted of similar charges and what did they get. Now, one of the cases they brought up is a case where a guy was actually even accused of having some forced prostitution.
Starting point is 00:51:49 And not only prostitution, but forced prostitution because the, the victim in that case was a minor. And that person got 14 months. Now, here's a problem, which, you know, obviously, I think that's where the prosecutor is going to come in and bring it up. And the judge is going to consider like, okay, you know, the law is supposed to be applied, you know, evenly and fairly. But in that case, it's not that they're trying to be racist or biased because it's ditty.
Starting point is 00:52:12 In that case, that person took a plea. And you take a plea and not go to trial. We all know. You get easier or favorable terms that. that the judge would most likely agree with. Diddy took it to trial, and though he won on the sex trafficking in Enrico, he lost on prostitution. So they're not going to give you, or, you know, I know they're saying, well, the guy got 14 months. Did he damn near spent 14 months?
Starting point is 00:52:37 Let's let him go on time serve. But, you know, and they're trying to like emphasize, well, the other case has a minor. There's no minors on Diddy's case. However, Diddy did take this to trial. And what came out in trial is a lot of allegations. And one of the surprising things was, I'm not sure if you guys knew, but I didn't even know. The judge in his sentencing,
Starting point is 00:53:01 he could take into account everything he heard in trial. So even the stuff that was used as evidence for the charges that he wasn't guilty on, those allegations. He could, like, for example, they presented, yo, did he try to blow up a niggas car? That's to support a RICO charge. he was found innocent of RICO However, they could take that
Starting point is 00:53:24 Or the judge could take that in consideration Say if I let this guy back out on the street He might be violent He might be trying to blow people's cars up again Which to me I think it's kind of fucked up But apparently judges could take Whatever they want into consideration Sentencing is very subjective
Starting point is 00:53:41 It's based on really what the judge Feels like unless there's just like These hard set mandatories Minimums or whatever the case is Brian Steele, Xavier Donaldson, Combs himself, and then it could happen. It could happen today. There was some talk of it going into Monday. It's going to be close, but I can't see how three speakers.
Starting point is 00:54:03 Well, it depends how the Reverend Doctor, the reentry guy, I don't know if it's necessary. It'd really be up to Judge Srebrenian if he wants to get it done today. And of course, the census itself is totally up to Judge Suburbanian. We're halfway through, and we're live tweeting. and this now is the scene I'll show it from afar because it's going to be getting through it
Starting point is 00:54:24 is going to be something else we've got cameras on one side of the street we've got a crowd in front of the building we've got a CBS car here but we'll end it right here we're heading back in inner city press do we continue
Starting point is 00:54:37 okay so yeah the judge eventually agrees that uh didi should be sentenced to 50 months which by the way the judge you know I was thinking it was going to be the three year marker and some people
Starting point is 00:54:58 thought that the it was going to be between 15 and 21 months but the judge actually declined that the judge actually thought there was those cause for upward departure from what you know ditty's lawyers were arguing as the guidelines and actually said no they actually he actually thinks more than three years would be appropriate or that's the guideline he's going to look at and he went one year above that. He went to four, four years, two months, okay? I'll play this last thing. I know I've been playing videos a bunch.
Starting point is 00:55:30 And then I'll get into what the sentence means. And, oh, well, we'll get into what Diddy said on the stand. So Diddy did say some stuff? By the way, let me pull Lauren Conlin in here because she was there in court and check us out. Hi, everyone. It's Lauren Conlin. I am outside of the federal courthouse for Diddy Sentencing. It's totally chaotic here. The courtroom is just overflowing. All of his family is here. You know, there's a few family
Starting point is 00:56:01 friends. All of his kids, Gina is here. I did not mention that on my shorter video for LA magazine, but I'm going to mention it here. And we're on a lunch break, so I'm going pretty, pretty quickly. But the day started off with Judge Subramanian, basically going through each sides objections to the pre-sentencing report. He, you know, again, I'm not going into crazy detail, but he essentially just overruled all of them, except he did say that acquitted conduct would be taken into consideration for sentencing, which is the violence. So he also, he made a comment about how he felt like Diddy wasn't really taking any culpability or responsibility to the guilty verdict. And his team is still pushing the whole
Starting point is 00:56:48 I paid for time with these escorts, and he said that's just frankly ridiculous. And I'm paraphrasing, by the way. Now, that's kind of important. The judge looked like they want to Ditty to just admit, hey, I did do this illegal act of interstate prostitution. Now, the reason why Ditty might not go for that angle is because this whole thing is an appealable,
Starting point is 00:57:20 conviction, right? He is going to be following appeals on the convictions he did get. So, like, in sentencing, he's not going to just admit it and just be like, I'm sorry for pain for prostitutes because that's an admission in itself. So here's the thing. He's kind of deflecting, but then the judge is looking at the deflection to say, I can't go easy on you because I could tell you're still fighting this idea of why you got sentenced, right? Or not know why you got found guilty. So that's a mitigating factor to be thought
Starting point is 00:57:56 about. Let's see. Okay, so sorry, it's so noisy. Oh, he also, the judge said he agreed with the sentencing guideline report, guideline report of his offense level being a 27 and the criminal history category being one, which would be 70 to 87 months and a 25K to 250K fine. Christy Slavic spoke for the government. She started off by saying today is about accountability and justice. Today is for the public. So she just kind of, you know, went into why he should be sentenced this way because he's violent, etc., etc. Her case law that was asked for by the judge, it was a case.
Starting point is 00:58:42 It was Dylan Jordan. And she said this guy got 60 months. and he was a man act conspirator. So this is a man act conspiracy case. He had similar conduct to Diddy. He loved bombed his victims, you know, used force, fraud, coercion, all that stuff. And he was imposed a stricter sentencing. And the judge actually said, and Patrick Driscoll went into this as well, he's like, well, wasn't he,
Starting point is 00:59:11 well, didn't he serve this guy eight years in a Cuban prison before this? so his criminal history was pretty bad and this was the second chance. And she said, yeah. So Slavic kind of admitted herself that Diddy's case is very different. And I, you know, that wasn't great case law. God, stop. But yeah, she said this is a transportation case with added factors of violence. Driscoll came out and just dropped all the hammers and saying why, you know, this case law just,
Starting point is 00:59:41 it didn't make sense and it's not appropriate. He also said he reviewed nine over 900 man act cases and in all of them. He basically said the average was like a 27 month sentence. I'm skipping over a lot of this. He, you know, went into, again, very detailed case law. He said some very, he basically shared a vile text message in another case where this defendant got a way less of a sentence than Diddy and he just, or that they were trying to impose on Diddy. And he just said, yeah, this, you know, did he never said anything like this to any of his quote-unquote victims? And it was something like, you know, all you're good for is your, you know, what lady parts.
Starting point is 01:00:24 I should make a mold of them. I'm paraphrasing, whatever. Oh, Nicole Westmoreland got up there. She started crying. And she said how much, you know, Combs meant to her as a person, how much he influenced her. Specifically in her personal life, talked about all his charity, what he did, you know, for charter schools and this and that and talked about his NBC work. He's teaching a class at NBC that, you know, has really gone a long way for inmates.
Starting point is 01:00:52 And, okay, so let me just skip to this part. Diddy's kids got up there. And every single one of his kids, except for the two-year-old, spoke. Delilah, his daughter, sobbed, Jesse sobbed. They all kind of were very, very emotional. But the girls were, it was tough. Delilah at the end was like, please, please, you know, have mercy on our father. All the kids said he's a changed man. They can tell that he's changed.
Starting point is 01:01:18 They played the 11-minute video. Diddy was sobbing. He broke down when they played Kim Porter and all the family surrounding Kim Porter, and it was just, yeah, it was crazy. Oh, also, the prosecution brought up something about Diddy booking a speaking engagement in Miami next week saying how he didn't take this seriously. I don't know what that's about. I haven't had a chance to Google it. But everybody head over to LA Magazine as well for my update there and I'll be... Okay. So
Starting point is 01:01:49 in the afternoon, Diddy takes the stand himself and Did he actually speaks to the judge. I don't know necessarily takes a stand so let me correct that. He spoke in court and he addressed the judge and with him addressing the judge
Starting point is 01:02:06 part of one of the final parts of him trying to convince the judge that I'm not that bad of a person. Let's get to that. And then let's see if we could extrapolate certain parts from it, even though it's just a monologue. There's no questions. There's no nothing.
Starting point is 01:02:23 He's just saying, Judge, I'm sorry, which, by the way, he apologized to Jane Doe. He apologized to Cassie. He apologized to his family. He apologized to the court. He apologized to the victims. And he said he was definitely under the influence. And he didn't really know. know I'll let Lauren talk
Starting point is 01:02:44 Hi everyone I just got out of federal court and Diddy has officially been sentenced by Judge Sobermanian to 50 months in federal prison I believe that his 12 or 13 months that he's already done will be accounted for
Starting point is 01:03:00 we're gonna try to figure out how much time he has to serve but we're gonna figure out how much time he has to serve Um, we're going to figure out how much time he has to serve y'all. But, um, from, from, from, from, from what we kind of know, is this thing I'm turn on or no, okay. From what we kind of know, um, he's going to get credit for time, serve.
Starting point is 01:03:32 And then there's a few programs that might help him out. So we're going to figure out what, when we actually reasonably think he's going to come home. But let's play this first. Sometimes you can serve only 85% of your sentence, uh, based on, on good behavior. But man, I heard Judge Sophrmanian say the words. I need to impose a significant sentence two or three times when he was giving his speech. And I was just thinking, oh, my gosh, what the hell is this sentence going to be?
Starting point is 01:03:59 But let me get back to that really quick. Okay. So when we got back from lunch, Brian Steele was speaking. And, you know, I'll just go through this quickly because I really want to get to what did he said and what the judge said. So Brian Steele spoke. and then Xavier Donaldson spoke, and then a reverend spoke. Let me see. The reverend.
Starting point is 01:04:22 Is that, is that, what was that name? T.D. Jake or whatever that guy name is? Friend, he was in Miami, and he kind of talked about, you know, just rehabilitation and how he would personally help Diddy if he got out of prison or jail, excuse me. I am truly sorry for all of it, no matter what they say. And he was referring obviously to the prosecution. He said, I am truly humbled. And then he looked at his kids and he said, you know...
Starting point is 01:06:39 Truly humbled under God, y'all. Truly humbled under God. I'm sorry that I failed you as a father, looked at his mom and said, I'm sorry that I failed you as a son. His voice broke. He said he failed his community. He asked your honor for mercy for, you know, I can't change the past, but I can change the future. He doesn't take his man act conviction lightly. He takes full accountability, full responsibility.
Starting point is 01:07:04 He knows the severity of it. He said, you know, I want everyone to know that I'm truly sorry for it all. So then we took five minutes and the judge came back and just. said, I want to make sure you know that you are being sentenced on the conviction of the Man Act, not RICO or trafficking. However, the statute of the defendant's sentence should consider characteristics of the defendant, you know, the violence. So then he, you know, went into all the things that impressed him about Combs, his MDC work, his, he lifted communities worldwide, his entrepreneurship is iconic, he said. The court knows you have problems.
Starting point is 01:07:42 with addiction and it may have exacerbated this blah blah blah and he you know he praises him and then he goes and says you know um but the court has to consider all the behavior into consideration and he said you know you abused or you you basically used your power and control to abuse women who um loved you i i really hate that that's being considered what's the point like this trial Make me look at the justice system like very differently. You go to, you know, it's basically saying we ain't catch you on the murder, but you did steal the candy in the store. So since we ain't catch you on the murder,
Starting point is 01:08:24 but we did hear that you were toting a gun every time and yeah, whatever, whatever. And maybe you did this and you robbed this person, even though you're not charged for those things. For you stealing the candy, we're going to give you 20 years. Huh? Like, this is like a makeup call. I kind of hate it. What's the point of how?
Starting point is 01:08:42 having these charges, you should just be like, this is a morality test. If you're a bad person, we're just going to send you away. You just need to go away because he beat the most serious charges that the evidence that is being brought up at a sentence is being brought up again. So it's like, oh, yeah, beat a girl up. but that was to support that I was sex trafficking these women by force. But it was deemed that I wasn't sex trafficking than by force. So how are you sentenced me for something that I wasn't even charged with?
Starting point is 01:09:24 Now, one thing I said about Judge Suburanean from the get-go, he's a give-and-take judge chat. He's a person who I think he wanted to satisfy both parties so bad. So even in a loss. And I think most people in the legal community and the law enforcement community would consider this a loss for the prosecutors. He wants them to feel like they're got a victory. And when I mean by a give and take judge, he's like, okay, all right, well, you know,
Starting point is 01:09:56 you're not guilty of these things that would make me have to give you 20 years, but also I got to give them something because if I let you out on time, served and look like blah blah blah so take four years he's a given take right like he's he's really trying to appease everybody and even in loss he's trying to appease the people who were trying put ditty in jail for life like that's the only thing i could think about you and you psychologically and physically abuse them to get your way the evidence of abuse in this case was massive and he said and we saw it and then he he listed you know the bruce broken, or he held the broken door, you know, the bruises, the everything that we saw in court
Starting point is 01:10:42 pretty much. And he said, these were serious offenses that harmed two women's. This conduct occurred for over a decade. And you had the power and the resources to keep it going because you did not get caught. And again, he kept. Now, keep in mind, none of those things are, none of those things are man act, like, you know, related things, right? Because the man act, it's not forced prostitution. It's just prostitution. By the way, also, interestingly enough, if he's only getting sentenced
Starting point is 01:11:19 or he only got convicted for prostitution, how come none of the actual prostitutes who all testified, well, not all, but some of them testified in the case, why weren't their opinions valued? Because they would, you know, if they're, I get it, they were not charged, that immunity, but they were also involved in these acts.
Starting point is 01:11:44 Maybe they could, they could have spoke their mind and be like, hey, during these acts, we felt Diddy, we understood and we felt that he was paying us for prostitution or, oh, you know what, we just thought it was just Cassie doing. Like, how come none of their opinions, even though they testified, matter now, like almost they could have never been a victim of being prostitutes? Because the idea of Dibby getting sentenced for prostitution, right? Is that they're saying he prostituted Cassie, Jane Doe, and the prostitutes. Yet none of the prostitutes really have a voice, especially to come to sentences.
Starting point is 01:12:26 I'm going to read that donation in a second, give a second. Impose a significant sentence because X, Y, Z. And I'm like, oh, my gosh, is it going to be more than like 11 years? And then he said, you know, the government's, you know, request of the 11 years is too much, but the defense 14 months is too little. So based on the facts and the circumstances of this case and the profound impact of, you know, what happened to Cassie and Jane, he said that, oh, and he took into consideration the sentencing disparities that Patrick Driscoll brought up. And then he said yes. So he will be imposing a 50 months of incarceration,
Starting point is 01:13:07 which is four years, two months, a $500,000 fine, and terms of supervised release of five years and outpatient treatment. And I got to get all my notes together. I will put all of this in writing, but that is essentially what happened. And he didn't seem to really react at this except he sighed, put his head back. He looked upset. When it was over, he looked at his family, kind of. drugged. His family didn't

But he commuted them, which means that instead of serving the six life sentences that he had to do, he basically said, as of today, your sentence is fulfilled. Starting point is 01:17:29 So I think he's going to give a commutation, not a pardon. A pardon means you never got convicted. Did he doesn't have a domestic violence conviction?
Starting point is 01:26:14 Did he has no convictions? So to have a first offender get slammed with four years. Which, by the way, he got convicted of two counts. I'm not just sure how the judge looked at it in terms of sentencing, but that's basically two years in a month, right? Two years in a month for each charge, which is two months, which is two charges. So that's four years and two months for prostitution?
Starting point is 01:26:45 Of two, three very serious charges, which would have landed him life. in prison. A jury acquitted him of those charges and he was left with two charges, man act charges or prostitution, which are considered misdemeanors in state cases. Some states don't even prosecute them and gave the first offender, first offense, no criminal history no infractions at mdc brooklyn already served 12 and a half months denied bail yet still on very weak man at prostitution charges gave him an upward departure of nine levels enhanced him nine levels and did an with departure going against what he asked for his word judge submarine you lie judge submarine
Starting point is 01:28:04 your word is some shit you a liar because in your order dated july the night 2025 you asked for uh uh usc 18 24 20 not but if you don't know shon zha He was incarcerated at one point. So, like, you know, a lot of stuff is personal to him because he's been in some of these situations. And he felt railroaded by the legal system then. And he thought that Diti was getting railroaded by them now. 21, criminal history category one,
Starting point is 01:28:40 sentencing guideline range 2G1.1, subsection 1, subsection 8, which is a base offense level of 14. You asked for that. if you wanted to add the coercion, which according to Mark Agnifalo, you mentioned step eight, nine, 10 times in your little soliloquy,
Starting point is 01:29:05 it should have been enhanced in your letter to a USC 182422 with the enhancement for the coercion. But you didn't ask for that. You went against your own word. You went against, your own world. Went against your own world.

It's a standard deviation, two or three, or four or five standard deviation for a judge to do An upward departure, nine levels on a first offender with a criminal history category of zero. Let's try to do some math on reasonably when Diddy might come home. Now, so Diddy was locked up on September 16th, 2024. Let's do the math. did he's been incarcerated for a year and a month right September, October, right?
Starting point is 01:31:13 So he's been locked up for 13 months, right? I want to show you guys how I do this because this is how we could reasonably, um, um, understand. So actually I'll just keep everything in Google because they have their AI. He sentenced to 50 months, 50 minus 13. That's 13 months. Didi would have 37 months left, right? So 37 months, 37 months to years. That would be three years from then. However, there's a few things helping Diddy out. Let's reverse the math and let's go back to the 50 months he's sent to. to the 50 months he's sentenced to before we even get to time served is going to be offsetted by what's called good behavior did he end up in jail doing all the bullshit he's not trying to fight people he's not trying to do this he ain't job blah blah blah the the federal
Starting point is 01:32:23 guidelines allow for 15% off of your sentence for that so let's let's do let's do this Calculator Okay, we got one here So 50 months Times 0.85 That's going to be 42 and a half We're going to call it 43
Starting point is 01:32:46 For the sake of conversation So even though he was sentenced to 50 months If he was going to serve all of it And given good behavior time He would serve 42.5 Or let's just call it 43 months Okay So let's use the new number, 43.
Starting point is 01:33:06 43. Now, there's two things that are operating that might help them out. And we're going to Google it. There's number one, the First Step Act. Don't know if you guys know what that is. Which president signed the First Step Act, which, by the way, Oh, my God, signed a Constitution. No.
Starting point is 01:33:27 First Step Act. And this is not an endorsement of, you know, you know, Donald J. Trump, but Trump is the person who did it. Now, what is the first step act? So the first step act, and we get an overview here, this is the Federal Bureau of Prisons. He signed into law in 2018, which basically they wanted to improve criminal justice outcomes and reduce the size of federal prisons, right? So this matters for federal crimes, federal prison.
Starting point is 01:33:56 Diddy happens to have a federal crime and is in federal prison. So it requires the Attorney General to develop a risk in a, and means an assessment system to be used by BOP to assess the recidivism, risk, and criminogenic means of all federal prisoners. Okay. Now, this is going to be like long-winded. But to kind of make it a little bit, you know, succinct, it gives federal inmates up to 45 or 54 days of good time credit for every year of their imposed sentence. okay so essentially and and by the way there is some requirements here um some of the requirements and by the i think the first step act was meant for people who were incarcerated federally
Starting point is 01:34:45 for crimes that had to do with you know maybe some sales of drugs but you were like you're the first time you ever got locked up for such a crime you're not like a drug king thing right and it wanted to, it says eligible inmates can earn time towards their pre-release custody. Offense that makes inmates ineligible to earn time are generally categorized as violent. Does Did he have violent allegations? Yes, but violent convictions? No. Involving terrorism, espionage. No. Human trafficking. Sex and sexual exploitation. Now, this is where I, they're probably going to argue this, it might go to appeal. They're going to try to probably argue that Dittie's Man Act violation, even though that's sex, you know, that's in the sex realm, that it's not necessarily, it shouldn't be not considered.
Starting point is 01:35:52 But I'm going to be honest with you, I think they're not going to consider Diddy for the first step act. So again, also, it excludes offensive. as a repeat felon in possession of a firearm, blah, blah, blah. So basically, if this wasn't a sex charge, Diddy would be, like, shoe in for this. I don't think this is going to help him out. But just to let you know, 54 days of every year that was sentenced,
Starting point is 01:36:17 let's see how that would play out if we were supposed to think about it. 54, remember, it's every year, each year, so Diddy ask four years? So it would be four times 54, right? That's 220. Do I got my math right? I think I do.
Starting point is 01:36:35 Four times 54 is 220. And then there's two months so we get some time off of that too. So like 220, let's call it 235. 235. So Diddy would have gotten 235 days off for the first step back. He's not a felon. He's whatever, whatever. This is the first time these things are happening.
Starting point is 01:37:00 he would have gotten time off based on the First Step Act. However, because his conviction does involve some sex stuff, I don't believe he will because the First Step Act bar people who involved in human trafficking. He wasn't accused of human trafficking or sex trafficking, but I think they would consider the Man Act sex exploitation, honestly. So already, remember, so good time, we got a calculator here, 43. If the first step act was supposed to work, we would have minused another 12. So it would, like about 12 months, because it would be 250.
Starting point is 01:37:47 Actually, we could say like maybe 11 or 10 months. But even then, even 10 off of this is good, right? So it would have been down to 33. Now, what is going to help Diddy, because I don't think this will help him, But if it did help him, let's say we're nice. We're going to add this 10 back. We're going to add it back because I don't think he's going to qualify for this because of the nature of charges. But let's act like he's getting everything his way.
Starting point is 01:38:14 Minus 10. So he would have to serve 33. Keep in mind, he's done 13. So we're going to minus 13 off of it too. So we got 33 months to serve. Remember, good behavior and first step act. But there's another thing that would help ditty out. What would help ditty out is called the RDAP program, right?
Starting point is 01:38:34 Now, what the RDAP program is in federal prison early release is that it says there's different categories of it, right? So if you're serving between 31 to 36 months, you get nine months reduction if you do the program. and by the way, how it works is that they have to determine that you had a drug problem. The eligibility is to qualify for the reduction, inmate must have a verifiable substance abuse problem. I think that's easy to prove for Diddy. Diddy literally was taking 15 drugs, not only to fuck the bitches, but to do his thing. So, like, he's definitely going to qualify.
Starting point is 01:39:18 Priorities for the program placement is given to inmates with early release days, so wait times could be long, especially for those with longer sentences. It's open to nonviolent offenders and participation is voluntary. This is a program that's definitely going to be in Diddy's wheelhouse. This is what Diddy needs to come home earlier. So what would it help him with? So the sentence length determines a reduction. So Diddy was given 50 months.
Starting point is 01:39:44 So we don't even have to think about these, right? So if you're only given 30 months or less, you can only get six months off. If you're given between 31 to 36 months, you can only get nine months off. but when you're given over 37 months, which Diddy was given 50, you could get up to 12 months. So if Diddy goes to this program and he, you know, does this drug program, the RDAP program, we have to minus 12 months. Okay? So it says inmates serving over 37 months or more could receive the whole 12 month reduction.
Starting point is 01:40:15 So let's go back to the calculator. Remember, 43 is good time. So you got sentence of 50, 43 is good time. we gave him the 10 for the first step act but I don't think he's going to qualify but let's we're acting like he qualifies remember we said we're going to add it back at the end okay cool so we're at 33 but let's minus another 12 because he's going to do the drug program that's the fact minus 12 leaves him at 21 right with the 21 he already served 13 minus 13 8 months which means two two two two months in in prison six months in a halfway house usually a halfway house around six months or so

Ditty is asking the judge that he wants to go do his time at a pretty much a low security federal correctional institution in New Jersey. His legal team asked and said that a FCI Fort Dix, pause, is the best landed spot for Diddy because he could address his drug abuse issues. Remember, they keep heavy on the drug abuse.
Starting point is 01:44:06 Why are that program, right? And he could maximize family visitations and rehabilitative efforts. Tenney's father, Mark Gerrigo, was previously told Harvey that Diddy will have a target on his back wherever he ends up. And Diddy's attorneys told the judge Friday that someone already planned to shank Diddy.

So a camp is generally one of the better places to be.

Starting point is 02:24:40 when word first hit the block that 15 year old Celeste Rivas Hernandez's body got discovered all decomposed in David's Tesla, no one believed in. But the feds just confirmed new evidence that clears David's name in the homicide case. And the new name they mentioned will change everything you thought you knew about this case. When the streets started talking
Starting point is 02:24:58 and the evidence got real. Okay, okay. I think this is a little bit kept. So let me just go long crimes. Because from what I've seen, they never cleared his name. So let me see if we could find. So Steve, September 8th, authorities have not identified, a suspect nor a person of interest. And to be clear, David has not officially been implicated in
Starting point is 02:25:27 any wrongdoing or any crime and law enforcement have not even come out with a definitive connection between the singer and Celeste. But I want to bring on right now Will Sveilar, who's a retired detective commander. Will, thank you so much for taking the time. You and I haven't had a chance to talk about this case yet. As it's really in the news, it's continuing to develop. We're trying to understand what's happening behind the scenes. since you and I haven't spoken, let me get your perspective. Why no arrest? Why not name any suspect?
Starting point is 02:25:57 Why not name any person of interest at this point? It's been weeks now and it's almost, what are we at? Almost a month, almost a full month since the body was found. Well, one thing that might be clear on is a crime has been committed. Now, and the crime is minimum, we call it in Illinois, desecration of a corpse or improper handling of a dead body. the girl was put in the trunk of a car dismembered somebody did that that's a crime now the events leading up to her death and her actual cause of death still has to be determined and without that you're not going to get a murder charge unless somebody says it's a murder and that's the medical examiner you're not going to get a murder charge to a couple of that we've talked about this extensively here on sidebar but i haven't talked to you about it LAPD captain commanding officer scott m williams told people magazine quote the los angeles county medical examiner has not determine to cause or manner of her death. So we don't know for sure if anyone has any criminal
Starting point is 02:26:53 culpability for her death beyond the concealment of her dead body. Now with that in mind, something I don't think we've talked about yet, is that Fox 11, L.A., Fox 11 L.A., they spoke with a private investigator, Steve Fisher, who apparently got his hands on images of that car, the Tesla, that Celeste was found in. And remember, this car was apparently sitting there for weeks before it was towed to that tow yard and then workers there smelled this foul odor and alerted authorities, but it was in the Hollywood Hills. Now, it could suggest she was in that trunk for that extended period of time, too. We don't know how long she was in the trunk per se, but her body was decomposed. Anyway, so Fisher says, quote, the car almost looks like it's been off road in the desert or something.
Starting point is 02:27:36 The wheel wells are all beat up. There's a huge dent in the back. This could have been an overdose, and they panicked and hit her body because they didn't want to expose the relationship. relationship between her and the minor. And by the way, she was found one day after she would have turned 15. That's unlikely because if you're trying to not get found out, why leave the corpse in your car? With that in mind, you had mentioned that a crime has been committed. We're just not exactly sure how many crimes. That's absolutely true. And that's correct. Everything we talk about now as far as cause of death's a speculation until we have some science to back it up when you talk about a crime we talk about concealment the dismemberment the desecration of the corpse we also talk about a situation
Starting point is 02:28:22 where if they can prove that there's some sort of relationship between a 14 year old and a 20 year old that's a problem for him at the age of consent in Illinois is 17 you can't give consent at 14 to be with an adult there's another crime that's like the backside of that is another crime if the LAPD can come up with definitive proof that he was in fact involved in a relationship he has another problem. Let's analyze this a bit. What makes more sense to you? Someone panicked, put the body in the car, didn't have enough time to know what to do with it. The car was there for a long period of time, though, so I don't know if that makes sense. Or we're purposely putting it in this car. We know it's registered to David. The car is near where the property he was renting was. There's an argument.
Starting point is 02:29:01 We're targeting David. I mean, what makes more sense to you? Well, it's an awful elaborate scheme to target David by arrival or something along those lines to do a murder and then steal his car and put the body in a car. Now, he never reported this car stolen, so we don't know if there's an auto theft in that. That seems pretty elaborate to me. The girl dying over natural causes is possible. A murder is definitely possible. And you say the car's found not far from where the house he was renting. The car has been evidence that it's been in the desert off the road. If I'm investigating. All right. So it's kind of interesting because I'm starting to realize how quickly people get into a conspiracy back. And it's happened in many different situations. It's happening.
Starting point is 02:29:42 here with this David stuff. I see people doing it with Charlie Kurt stuff. But essentially, people are floating with these ideas that maybe the dude didn't do anything. And this is either bad luck or maybe someone sent him up. I'm not going to go with that, but it is interesting to hear these guys kind of like rationing it out. I am trying to find a route from his home to where this body is found and see if there is any, like, you know, part of the, out of the desert or an off-road area where maybe she dies or she's killed. they take her to that spot, they do what they do to her body, put in the car, and they give her to and then ditch the car. So there's a lot of things that still have to be determined.
Starting point is 02:30:19 So if you're a fan of sidebar, by the way, then you know we cover a lot of cases and we put out a lot of clips a day. Our producer, everybody, and I guess this whatsoever, I haven't seen a statement like that. Now, I'm not suggesting that he is. Again, he hasn't been officially implicated in wrongdoing. But would it be typical of police to say if he had absolutely no involvement in this whatsoever, And there's this whole cloud on a lot of public attention. I have to imagine they have more information than we do at this point. Would they come out and immediately, you know, clear him of anything?
Starting point is 02:30:57 It's case by case basis. I mean, if there's, if you absolutely know it's not him, you know that. But I can tell you that these detectives are operating on theories too. There's probably two or three different theories that they're operating under. And I think they're not giving that information that he's been cleared because they just don't know yet. They're still trying to figure out exactly what went down. what caused this girl's death. And we talk about persons of interest.
