Starting point is 00:02:47 going pop and shit that's a fact but for me I'm kind of following the symbolism I'm kind of following the plot from what I'm seeing it looked like you know Drake like the overall plot is this Drake got something in a bag there's some liars which we're going to just term as Pinocchio that's trying to get what he has and at every moment they're about to catch up with him he's been able to evade them until episode three at the end they finally caught up with them and now we're going to see what happens he's always alone there's some like
Starting point is 00:03:22 there's some thematic symbolism in here but I'm not sure it matches the music yet right I think what did I miss was a perfect kickoff because it kind of epitomized what the overarching
Starting point is 00:03:38 theme of it this is but the which one song which obviously like I get it it's music he's trying to make a hit song I felt that didn't connect as it should have and then we're at episode three I'm guessing we're getting two tracks

So we're hearing the same beat 100 times, and if you're expecting to hear some crazy shit or hear a diss or hear whatever you want to hear and you don't get it, we almost have for two hours.
Starting point is 00:05:44 I can see why somebody might be frustrated with that. Again, I respect the fact that the nigga doing a rollout, period. So I'm going to sit here and, you know, just try to make, sense of this. I feel like we get it. For me, if I had one critique, give us the slapper. We want the number one record.

Well, whichever case you have more time, less time in custody, that's what would happen. And you get the credit for all the times you've served.
Starting point is 01:52:27 And again, that sentence would be 16 years, a shade over 16 years, three months and four to stay. prison. I would have to order restitution. The state would tell me the amount of that restitution. That restitution would be joint several with any of your other co-defendants. If any of the other co-defendants were convicted at trial or entered pleas, in other words, the restitution only has to be paid once, but each person is responsible for 100% of it. All right, but as soon as it's paid, it's paid. I would have to impose mandatory court costs in each case, and I would have to impose a mandatory cost of prosecution in each case, which is $100. So, Mr. Henry, do you understand the offer that the state is making to you?
Starting point is 01:53:08 Okay, the 16 years, three months, and shape more. So I'm going to pause on it at this point, Mr. Henry. It's going to give you some time, whether that be tonight or also over the weekend to talk to your lawyers about it. Make sure they answer all your questions, talk to your family about it, so you can make a decision as to what you want to do. Now let me explain this to you, sir. I can't make the state making an offer, and I can't make you accept any other. offer. I'm just the referee. Okay, this is a business decision between you, your lawyers, and the state. And if you want to accept it and resolve both cases that way, that's fine with me.
Starting point is 01:53:41 And if you want to have a trial in both cases, that's fine with me too. It doesn't matter to me in any way, shape, or form. But whether it be tomorrow when I see you tomorrow, and then Ms. Wilcox tree already has tomorrow at 9 o'clock, that'll remain on. But I'll put them on both cases as well next Tuesday which is September the 9th this is called 1 30 in the afternoon September the 9th at 1 30 in the afternoon we'll call it trial status in both cases that's when you're gonna we're gonna have to finish this conversation mr. Henry and you're gonna have to tell me that either that you understand the offer that the state's making that your lawyers have
Starting point is 01:54:17 answered your questions about it and then you're gonna have to tell me what your decision is whether you want to accept the offer whether you want to reject the offer mr. Henry the one additional thing that I like to talk to people who are sitting in this situation that you're sitting in right now to have this conversation with us follows. Just seem reasonable, but I do think the judge is pushing for him to take it.
Starting point is 01:54:36 You know, most, you know, charges and cases are really resolved by plea deals. And I'm going to be honest, I don't think they have that much on him. I think they do got accessory to murder, but they have to prove the murder first. So it's not like a slam dunk. and I think they're kind of scaring him a bit.
Starting point is 01:55:01 They got to prove that Melly did the murder. I don't think that he was involved in, even if we believe the state, he's not involved in the murder. So they gave him these charges to really, you know, fuck with him. But I think he would beat those murder charges. It would be the murder charge of the two guys. I think he would beat it.
Starting point is 01:55:21 But accessory to murder, I believe he would, you know, be found guilty on if, if, um, they could prove that Melly did the murder. Because the state's ideology would be you help the murderer cover it up after the fact. But if they currently they can't prove that Melly did the murder, this guy can't be the accessory to the murder they can't prove. So, you know, it's still rolling a die a bit just to, you know, he could beat this whole case. it depends on if he wants to quote unquote i guess stay solid now we don't hear about a cooperation
Starting point is 01:56:03 type of um situation and because it's a state court it's not as black and white as that so this deal that exists we don't know if there's some other arrangement that is contingent on right now um clearly it looks like it's in front of the judge so it's it It looks like it wouldn't come with maybe any additional cooperation unless there was cooperation before. But it could have been cooperation, right? It could have been cooperation that's kind of like installed in the deal. We don't know, right?
Starting point is 01:56:41 Because again, for this plea deal to officially go, the judge has to sign off on it, but it has to be put in front of the judge after it's been accepted. and sometimes the prosecutor will be like, well, we got to see that you satisfactorily dealt with the stipulations as per the deal, which means you're going to tell. Like, for example, the guy Cornelius Smith,
Starting point is 01:57:07 in the Doff case, he has a plea deal that's sitting on the table, right? We don't know the details of that plea deal yet. But he has that plea deal, but that won't get signed off or even offered to the judge until well it's going to get done now because everybody got went to jail or it got
Starting point is 01:57:31 acquitted Hernandez-Govon got acquitted straight drop went to jail this tells me there might not be cooperation but you can't rule it out because the judge is saying you have until tomorrow and this deal is no good after that supposedly
Starting point is 01:57:46 the reason that I'm doing this is because I want the record to be clear what the state's offer was and the record to be clear that you understood it and that you had enough time to talk to your lawyers about it you had enough time to talk to your family about it you weren't under any pressure to make a decision whatever you thought was in your best interest
Starting point is 01:58:06 because it goes kind of like this and I'm sure your lawyers could speak to it better than I can. If you accept the state's offer, that's fine. And again, if you don't accept it, that's fine too. But if you don't accept it and one of these trials doesn't go your way, and you end up with life in Florida State Prison, which is a mandatory sentence on a lot of these counts.
Starting point is 01:58:28 Usually people in that situation, then they'll file what's called a motion for post-conviction relief, and they'll say, hey, Judge, you know, my lawyer never told me I didn't know that I could resolve all this for 16 years and three months. And if they would have told me that, I would have done it. And now I'm sitting here with a light Senate. So that's the reason I'm having this conversation now. So the record is going to be crystal clear on that issue. if it doesn't go your way, that argument's not going to be available to you to come back and say, hey, my lawyers didn't tell me about this or I didn't know about this.
Starting point is 01:58:59 So that's why I'm talking to you about it now. So Mr. Henry, do you have any questions for me about the maximum possible penalties involved and what the state's offer is to you as we're talking about it right now? Okay. All right. So I'm going to pause on that part of the conversation, and we'll finish that other part of the conversation, either tomorrow or next Tuesday afternoon. I'm going to leave Yon for tomorrow,
Starting point is 01:59:23 all pending motions, which is September the 5th at 9. It was the morning of the 26th, October 26, 2018 morning. Yes. And what, if anything, like the call that you were to be used to be. I believe it's very generic,
Starting point is 01:59:44 a couple of dead bodies at the hospital being dropped off by a friend. And just so you know, I don't get into great details when they call me out when I'm asleep because most of the time early information is not accurate. So that's all I had is some semblance of what was going on when I head to the hospital. And you specifically do that.
Starting point is 02:00:00 You don't know too much so that you could get there and perform your own. Yeah, exactly. And let me ask you, at that point in time, what was your goal with in your office department? I know you were a homicide attack, but were you kind of stepping back again because you were getting ready to retire. Yeah, it looked kind of internally within our team. We know when people were about to retire.
Starting point is 02:00:21 and we try not to put them in a really important position as they close to retirement for reasons like this yeah yeah retired and so but yeah I was definitely taking a back seat on a lot of things I think that my saying was I don't want to I don't want to enter the shooter I don't want to find the gun I don't want to interview the shooter I don't want to find the other so what was your role when you arrived from Humphrey we were trying to locate the scene of the crime Why are you all trying to locate the scene of the crime? Evidence, video, I mean, hard evidence, video, anything, we could. So also, we want to make sure it's in our jurisdiction.
Starting point is 02:01:04 That's the important part. But no, we just try to determine where the crime occurred. At the time when you go to court, like how you could get the suspect in this case? No, he's a victim. You all, at half point, would you to the victim of, just try by shooting? Yes.
Starting point is 02:01:21 Yes. So when Portland Henry got into your car, what kind of car were you all driving? It would have been a detective car. I'm not sure if... So basically he drops off the dead bodies at the hospital. The police show up. The police is kind of hearing him say, yo, these guys shot at us. They killed two of my friends.
Starting point is 02:01:42 And the cop basically says, yo, where did you I get shot at? He tells him a story and the cop says, okay, get in my car. go to the place that this happened at right so they're trying to find the crime scene on mark yeah yeah would there be any cage in the back or anything like that no do you all wear in the arms back i want to stab believe who's in the front seat yes what the district had me do with you in the vehicle he directed me to the location and it seemed like it wasn't very forthcoming and uh went back to the station.
Starting point is 02:02:22 He was courteous. Obviously, I don't think he's cooperative for that situation. So there was no questioning that. No, well, questioning is, where is this location? Exactly, exactly, yeah. Nothing about, you know, potential suspect or, you know, the investigative part.
Starting point is 02:02:44 We're just trying to determine where it happened, what happened. He's a witness. He can... Okay, so it looked like... I don't know when they added these murder charges. to him because I know he had an accessory for murder but look like they've added the murder charges
Starting point is 02:02:59 and look like this is a preliminary hearing for this. So, I don't know. We'll see. We'll see. We'll see. All right. By the way, speaking of which, Cardi B. Cardi B actually beat her case and I know we didn't really get to cover it, but Cardi B
Starting point is 02:03:18 won her case for assault and battery. She was officially cleared and this is how it ended. Lennes Elmzar, Ms. Elmzar, touch Ms. Ellis in the intent to harm or offend Ms. Ellis. Number two, Ms. Ellis did not consent to being touched. Number three, Ms. Ellis was harmed or offended by Ms. Elmz. Four, a reasonable person in Ms. Ellis's situation would have been offended by the touching.
Starting point is 02:04:26 Answer, no. Question two, did Ms. Ellis prove Elmzorz acted with the intent to cause harm or offensive contact with Miss Ellis. Number two, Ms. Ellis reasonably believed that she was about to be touched in a harm. Number three, Ms. Ellis did not consent to Ms. Elmanzar's conduct. Number four, Ms. Ellis was harmed. And number five, Ms. Elman's conduct was a substantial factor in causing Ms. Ellis' harm. Answer, no.
Starting point is 02:05:05 By the way, because this is a civil trial, this is why the verdict sheet is very different, different and that's why they're reading it like that. Section B, intentional infliction of emotional distress. Question five, did Ms. Ellis prove all of the following elements of intentional infliction of emotional distress? One, Ms. Elmzar is engaged, Ms. Elmzar engaged in extreme and outrageous conduct beyond mere insults, threats, indignities, annoyances, hurt feelings, or other trivialities that a reasonable person is expected to endure.
Starting point is 02:05:46 2. Ms. Almanzar intended to cause Ms. Ellis' emotional distress. Number three, Ms. Ellis suffered severe emotional distress. And number four, Ms. Elmzor's extreme and outrageous conduct to suffer severe emotional distress. Answer, no. Section C, negligence and contributory negligence. Number eight, did Ms. Ellis prove all of the following elements of negligence? Number one, Ms. Almanzar was negligent. Number two, Ms. Alamazar's negligence caused Ms. Ellis to suffer physical harm rather than only emotional distress.
Starting point is 02:06:33 And three, Ms. Almanzar's negligence was a substantial factor in causing Ms. Ellis's harm. All right. This shit is long. All right. George Bulola number three all right there's an administration of all the jury all right let me ask the foreman was it unanimous as to all the questions yes all right so the question that the clerk is going to be asking is
Starting point is 02:07:09 was it unanimous as to all questions question one or just all questions no ask all questions yes go through each one each of the jurors was it unanimous Was the unanimousal one? Pretty much, they've, again, in civil court, not criminal court, it's not about like necessarily guilty or not, because it's not beyond a reasonable doubt. It's the preponderance of the evidence. So usually when they discuss civil allegations is,
Starting point is 02:07:43 are you liable for, like, for example, somebody slaps me, I would sue the person for slapping me or injure me, me or battery or whatever. And the way the jury would look at it is not if you're guilty of slapping me, right? It's are you liable for the injury I received? Which civil cases are very interesting because you could actually be found liable for something you didn't do. And that's kind of a risk in civil law or civil cases, period.
Starting point is 02:08:22 Because it's not, do you believe, again, you even hear one of the questions is, do you, they have to answer if Cardi was, if they blame her for the woman getting injured or having a scar, whatever. So it's very different. But basically, they said no to everything. Yes. Number three. Yes. Number three. Yes.
Starting point is 02:08:47 Yes. Yes. Yes. Yes. Yes. to this case. I know that you've paid a great deal of attention throughout the matter, which was especially evidence by the
Starting point is 02:09:15 questions that you did submit. I want to thank you for that time of and attention. By the way, the opposing lawyer for the plaintiff clearly was like some rookie who took this on contingency, hoping to get a big payday. They sued for $24 million. They were hoping to get some
Starting point is 02:09:30 type of, there was just shaking the tree hoping something would fall. And actually, they were probably hoping Cardi would settle. And, you know, remember I made the statement that why would Card even go to court? I'm pretty sure the reason why. Actually, I know the reason why. Because you pay one motherfucker.
Starting point is 02:09:46 People start lining up with wild things because they're like, yeah, we sue you for $24 million. And even if we get only $50,000, fuck it. We don't have $50,000. Thank you for the money. So she got to stand on business. And this was a stand-on-business type of thing. Now, in civil law, in most places, they have what was called Slash. I don't know if you guys ever heard what that is.
Starting point is 02:10:11 Slap is a, it's a, they have slap laws to prevent frivolous lawsuits or people who are taking advantage of the legal process who in turn by suing you are infringing upon your rights. Like there's a, so in some cases when there is a motion for, it's like an anti-SLAPP motion, the person who lost the case has to cover the cost of the person you sued, right? And Cardi later talked about this. She said that, yo, the next time she going to start putting belt to ask the motherfuckers
Starting point is 02:10:52 because she's tired of people thinking they could just sue and whatever. So first thing, first, I want to think my lawyers. I want to think the jurors. I want to think the judge. and I want to thank the respectful press. I really, really appreciate that. And I want to thank everybody at home supporting me. I know you guys having a little key with the moment,
Starting point is 02:11:19 but to be honest with you, I have missed my kids' first day of school today. I miss my kids last week of school yesterday because of this. And I'm not even playing around. Even if I'm in my deathbed, I swear to God, I will say it in my deathbed. I did not touch that woman. I did not touch that girl.
Starting point is 02:11:42 I didn't lay my hands on that girl. And with that being said, with that being said, this time around, I'm going to be nice. The next person that tried to do a frivolous lawsuit against me, I'm going to counter sue. And I'm going to make you pay. Yeah, so countersue and again, what's called, you know, again, this is the attorney might not be familiar with, but it's called slap. Like, for example, this Meg the Stalian versus Milagro thing, again, I don't know the full details of that case, but it might qualify for what's called slap, right? The idea is, for example, if, and I'm going to use that case as an example, right?
Starting point is 02:12:24 Meg the Stalian don't like that this girl is talking about her or criticizing her or supporting Tory, right? So you know what Meg the Stalian does? She gets Rock Nation to sue Milagro, and by the case, there's a gag order that she can't even talk about, Magdalian, while the case is going on. What does that do? Well, it infringes upon Milagro's right to actually exercise her First Amendment right, which is the right to free speech, right? Because now her rights is being appealed on.
Starting point is 02:12:57 Also, the motive of the lawsuit is to tie up Milagro in litigation drain her resources and also silence her, right? So if a judge agrees with that, that the lawsuit you brought is to try to shut somebody up, that's not how lawsuits work. You would file a anti-slap motion if it's going to get thrown out. And usually when a judge is about to dismiss those cases, they would grant you an anti-SLAPP motion to say,
Starting point is 02:13:37 because you try to take away all this person's right, you got to pay for all their shit. So that's the way I think people like Cardi B. Now, granted, that's more seen in like, you know, things where your First Amendment right is being infringed on. But slap also applies to any type of lawsuit where it's just frivolous. Like, yo, if 50 chicks try to sue her for verbal abuse, or, oh, you hit me, but there's not any type of proof in these lawsuits,
Starting point is 02:14:10 those would be considered slap lawsuits. You're taking up the resources of Cardi B, of the court, and if it's frivolous and it really has no basis in reality, and it's a clear attempt to try to silence someone or try to keep them in court or harass them, a judge would think about granting that motion to get you, paid back for whatever. Now granted, does Cardi B have anything to gain? Even if she was granted that slap motion, the anti-slap motion? No, Cardi's lawyers probably cost her a couple hundred thousand.
Starting point is 02:14:47 That woman who sued her don't got a couple hundred thousand. But she got to at least try to fight back because once you let one person think they could sue you and you just settle, it's World War Five, right? Because this is not okay. I think people have like this, misinterpretations of celebrities like it's that oh well we can ask for this and they're going to settle you don't work at home and you don't work all day and you don't work for your money to give out your money so don't ever think that I'm just going to give you my money that I work hard for I don't lay in bed all day I work all day and I work hard for my money for my kids and for people I take care of so don't you ever think that you're going to sue me and I'm just going to settle and my bad let me let me let me

I think Floyd struck this deal as soon as he saw Jake Paul and Javante Davis do their deal, which if you don't know, it's rumored to be like a $100 million deal. Jake Paul,
Starting point is 02:22:18 Jervante. And I think that's where boxing is at right now. Boxing is at the place where, hey, why even really have to train diligently for these fights in your weight class? Like, I think people want to see him versus, uh, what is it, uh, Shakur Stevenson? That's his name. But Shakur is just not a household name like that. He's just, he, there's no pizzazz. There's no star power. So it might be a good fight. However, fuck the fight. If you, it's about the money for these guys. And reportedly in this $100 million fight purse, he's going to be taking home $40 million. $40 million for fighting Jake Paul and Jake Paul is going to be taking home $60 million.
Starting point is 02:23:12 You see how boxing has gotten to this point where it's like, why actually do fights that, you know, would be super competitive or whatever, like, you know, they're building up these ranks and these belts. Fuck the belts and all that other shit. You know, notoriously, Floyd said this, Legacy don't pay my bills. Because people were like, why don't you fight this person this time?
Starting point is 02:23:34 Legacy don't pay my bills. I fight the shit that makes sense, and the shit that makes dollars make a lot of sense. So, Javante was getting 40. You're getting, 60 million is going to Jake Paul. And as soon as Floyd sees that, you know Floyd's all about the money. Floyd goes and grabs Tyson and says,
